The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. The paper discusses the structure, applications, and plausibility of the much-used parallel-case argument for workplace democracy. The argument rests on an analogy between firms and states according to which the justification of democracy in the state implies its justification in the workplace. The contribution of the paper is threefold. First, the argument is illustrated by applying it to two usual objections to workplace democracy, namely, that employees lack the expertise required to run a firm and that only capital suppliers should (...) have a say over the governance of the firm. Second, the structure of the argument is unfolded. Third, two salient similarities between firms and states regarding their internal and external effects and the standing of their members are addressed in order to asses the potential and limits of the argument, as well as three relevant differences regarding the voluntariness of their membership, the narrowness of their goals, and the stiffness of the competition they face. After considering these similarities and differences, the paper contends that the the parallel-case argument provides a sound reason in favor of democracy in the workplace—a reason, however, that needs to be importantly qualified and that is only pro tanto. The paradox of persisting opposition raises a puzzle for normative accounts of democratic legitimacy. It involves an outvoted democrat who opposes a given policy while supporting it. The article makes a threefold contribution to the existing literature. First, it considers pure proceduralist and pure instrumentalist alternatives to solve the paradox and finds them wanting — on normative, conceptual, and empirical grounds. Second, it presents a solution based on a two-level distinction between substantive and procedural legitimacy that shows that citizens are (...) consistent in endorsing the upshot of democratic procedures while opposing it. Third, it unpacks three reasons to non-instrumentally endorse such procedures — namely, the presence of reasonable disagreement, non-paternalism, and the right to democratically do wrong. In so doing, the article shows that those accounts of democratic legitimacy that rely on reasonable disagreement as a necessary condition for democratic procedures being called for are flawed, or at least incomplete, and offers a more complete alternative. Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from decisions that are particularly pervasive, coercively enforced, (...) hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. While unpacking these reasons, we address some criticisms of this constitutive link recently raised by Steven Wall and Jason Brennan. (shrink)

The paper examines two backward-looking principles about how the costs of mitigating and adapting to climate change should be distributed. According to the polluter pays principle, such costs should be borne by those who caused climate change. According to the beneficiary pays principle, they should be borne by those who have benefited from the activities causing climate change, regardless of whether they took part in such activities or not. Workplace democracy is often advocated on two intertwined views. The first is that the authority relation of employee to firm is akin to that of subject to state, such that reasons favoring democracy in the state may likewise apply to the firm. The second is that, when democratic controls are absent in the workplace, employees are liable to objectionable forms of subordination by their bosses, who may then issue arbitrary directives on matters ranging from pay to the allocation of overtime (...) and to relocation and promotion. Daniel Jacob and Christian Neuhäuser have recently submitted these views to careful criticism. They argue that the parallel between firms and states is unwarranted. For, unlike managerial authority, state authority is final. The state grants firms their legal status and subjects their authority to its regulations, which citizens in democracies already control. And they also argue that suitable workplace regulation alongside meaningful exit options may suffice to prevent, with no need for democratization, objectionable forms of workplace subjection. Neither view offers, they resolve, compelling reasons to believe that justice requires that firms be democratic. I here inspect these criticisms in turn, and offer reasons for skepticism. (shrink)

Self-employment merits protection and promotion, we often hear, because it confers independence from a boss. But what, if anything, is wrong with having a boss? On one of the two views that this chapter inspects, being under the power of a boss is objectionable as such, no matter how suitably checked this power may be, for it undermines workers’ agency. On a second view, which republican theorists favor, what is objectionable is subjection not to the power of a boss as (...) such but to their arbitrary power. The first view is unconvincing, I argue, as it entails (implausibly) that being under the power of others in realms like the family or the state is likewise objectionable as such. And although the second view yields compelling reasons for self-employment, it only does so when employers’ power is not suitably checked. When it is, such reasons are more easily outweighed by competing considerations, like those stemming from the further forms of dependence—on suppliers and purchasers—that self-employment may prompt. Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

Workplace democracy is often defined, and has recently been defended, as a form of intra-firm governance in which workers have control rights over management with no ownership requirement on their part. Using the normative tools of republican political theory, the paper examines bargaining power disparities and moral hazard problems resulting from the allocation of control rights and ownership to different groups within democratic firms, with a particular reference to the European codetermination system. With various qualifications related to potentially mitigating factors, (...) such as workforce and shareholder composition or risk aversion and reallocation, the paper contends that forms of workplace democracy in which workers control and own the firm, such as cooperativism, are preferable to other forms, such as codetermination, in which ownership and control rights are formally separated. The paper makes a twofold contribution. Firstly, it advances a preliminary account of the conditions that need to obtain for constitutional rights to be democratic. Secondly, in so doing, it defends precommitment-based theories from a criticism raised by Jeremy Waldron—namely, that constitutional rights do not become any more democratic when they are democratically adopted, for the people could adopt undemocratic policies without such policies becoming democratic as a result. The paper shows that the reductio applies to political rights, yet not (...) to non-political rights, such as reproductive, environmental, or privacy rights. The democratic status of the former is process-independent. The latter, by contrast, are democratic precisely when they are adopted by democratic means. (shrink)

Despite renewed interest in work, philosophers have largely ignored self-employment. This neglect is surprising, not just because self-employment was central to classic philosophizing about work, but also given that half of the global workforce today, including one in seven workers in OECD countries, are self-employed. We start off by offering a definition of self-employment, one that accounts for its various forms while avoiding misclassifying dependent self-employed workers as independent contractors, and by mapping the barriers to becoming and remaining self-employed (section (...) 2). We then examine five arguments why governments ought to promote self-employment, despite the forgone opportunities to promote employee work instead that this often entails (sections 3-7): the argument from job creation, the argument from job satisfaction, the argument from independence, the argument from occupational freedom, and the argument from subsistence under non-ideal circumstances. Some of these are unconvincing, we argue, but others are not. Although the strength of the latter arguments hangs on various context-dependent conditions, such that they need to be carefully weighed against considerations of efficiency and equality, they nonetheless offer compelling pro tanto reasons to promote, and not just to protect, self-employment. En 2002, Daniel Pearl, periodista del Wall Street Journal, era secuestrado y degollado ante una cámara. La grabación del degüello, con abierta intencionalidad pública, fue finalmente censurada por la inmensa mayoría de medios de comunicación occidentales y no trascendió el ámbito privado en el que se realizó. Las vejaciones y torturas fotografiadas en Abu Ghraib, en cambio, trascendieron en 2004 su inicial privacidad al ser publicadas por The New Yorker y la CBS, invadiendo así el espacio de lo público. ¿Qué (...) distingue ambas imágenes, determinando su «publicabilidad»? El presente artículo pretende analizar la censura de imágenes especialmente cruentas en los espacios informativos ¿i.e., al margen de los publicitarios o los de entretenimiento. Para ello, trataré de responder, en relación a este tipo de imágenes, a las siguientes preguntas: ¿Qué pueden mostrar? ¿Se deben mostrar? Y ¿cómo se deben mostrar? La primera pregunta se dirige a una cuestión estrictamente epistemológica. Dada su excesiva amplitud, me limitaré a establecer, por una parte, que es necesario defender una cierta idea de la verdad como correspondencia para poder distinguir entre imágenes verdaderas e imágenes falsas. Y, por otra parte, precisaré en qué podría consistir la falsedad de una imagen. Las dos segundas, en cambio, son de tipo ético y apuntan a la problemática formulación de una libertad de expresión relativa a las imágenes violentas. Trataré de poner de relieve la función decisiva de este tipo de imágenes como revulsivo y desarrollaré críticamente algunos de los argumentos habitualmente esgrimidos para impedir su difusión. Pretendo defender que, incluso si aceptamos que prima facie se debe poder ver todo, el centro del debate se halla en las condiciones de publicación y, principalmente, en la posible espectacularización mediática de las imágenes. El propósito de este artículo es mostrar la historicidad del modelo de Estado nacional, las implicaciones que de su desnaturalización extrae el laissez-faire liberal y su repercusión a escala local. Para ello se recorrerá el proceso de identificación de lo estatal y lo nacional y su función política y culturalmente ideológica, tomando como paradigma el modelo que Carl Schmitt elaboró a partir de la crisis del parlamentarismo en el II Reich. Posteriormente, se detallará la actual crisis de dicha identificación y (...) la progresiva acumulación de competencias por parte de instituciones de carácter transnacional. La relocalización internacional de la producción y la movilidad del conocimiento en la sociedad de la información ilustran hasta qué punto han quedado desfasadas las barreras nacionales. Se produce entonces un incremento espectacular de la presión sobre las políticas locales, obligadas a mejorar la oferta y la promoción urbanas para resultar competitivas en el mercado liberal. Y ello promoviendo la riqueza de proyectos con los que atraer el capital privado. Desde esta perspectiva podrá calibrarse hasta qué punto descansa el Fórum sobre una contradicción performativa entre su planteamiento público y el proyecto urbanístico, turístico y cognitivo que representa. Representing unborn generations to more suitably include future interests in today's climate policymaking has sparked much interest in recent years. In this review we survey the main proposed instruments to achieve this effect, some of which have been attempted in polities such as Israel, Philippines, Wales, Finland, and Chile. We first review recent normative work on the idea of representing future people in climate governance: The grounds on which it has been advocated, and the main difficulties that traditional forms of (...) representation have encountered when applied to this particular case. We then survey existing institutional means to represent generations to come. We separate out representation in courts, in parliament, and by independent bodies, and review specific instruments including climate litigation, parliamentary commissions, future representatives, youth quotas, and independent offices for future generations. We examine the particular forms whereby each of these may suitably represent future people, including audience representation, surrogate representation, and indicative representation, and discuss the main challenges they encounter in so doing. Institutions to address short-termism in public policymaking and to more suitably discharge our duties toward future generations have elicited much recent normative research, which this chapter surveys. It focuses on two prominent institutions: insulating devices, which seek to mitigate short-termist electoral pressures by transferring authority away to independent bodies, and constraining devices, which seek to bind elected officials to intergenerationally fair rules from which deviation is costly. The chapter first discusses sufficientarian, egalitarian, and prioritarian theories of our duties toward future (...) generations, and how an excessive focus on the short term in policymaking may hinder that such duties be fulfilled. It then surveys constraining and insulating devices, and inspects their effectiveness to address the epistemic, motivational, and institutional drivers of political short-termism as well as their intra- and intergenerational legitimacy. This paper examines the legitimacy conditions of constitutionalism by examining one particular type of constitutional provision: provisions aimed at advancing future generations’ interests. After covering the main forms that such provisions can adopt; it first considers three legitimacy gains of constitutionalising them. It then explores two legitimacy concerns that so doing raises. Given that constitutions are difficult to amend; constitutionalisation may threaten future generations’ sovereignty. And it may also make the constitution’s content impossible to adapt to changing circumstances and interests. (...) Economic disparities often translate into disparities in political influence, rendering political liberties less worthy to poor citizens than to wealthier ones. Concerned with this, Rawls advocated that a guarantee of the fair value of political liberties be included in the first principle of justice as fairness, with significant regulatory and distributive implications. He nonetheless supplied little examination of the content and grounding of such guarantee, which we here offer. After examining three uncompelling arguments in its favor, we complete a more (...) promising yet less explored argument that builds on the value of self-respect. We first inspect the conditions and duties that securing self-respect entails. We then look into how uneven allocations of the value of political liberties bear, expressively and due to the power imbalances they yield, on such conditions and duties. (shrink)

Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from (...) countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals. This volume has 41 chapters written to honor the 100th birthday of Mario Bunge. It celebrates the work of this influential Argentine/Canadian physicist and philosopher. This article examines gender imbalance in philosophy using statistical analysis of philosophy professionals and students in Spain. It is the only study on an international scope that provides complete, real data of an entire national system. This analysis shows that among teaching and research personnel, women make up 25% of the total, among full professors they represent 12%, and the glass-ceiling index in the field is the same as that in engineering. For the study, I resorted to a normalization of (...) indicators to allow for international comparisons, which I have done using the reports and analyses available in other countries. In the second part of the article, I use the Spanish data to test some recent hypotheses on gender imbalance in philosophy. The data does not confirm the theory of Neven Sesardic and Rafael de Clercq, which attributes the imbalance to differences in cognitive abilities. However, the data does partially confirm the study by Molly Paxton, Carrie Figdor, and Valerie Tiberius regarding the dissuasive effect of introductory courses in philosophy, as well as that by Sarah Leslie and her colleagues on the field-specific abilities belief hypothesis. This dissertation is a study of the relationship between dunamis and energeia in Aristotle’s ontology. Throughout his writings, Aristotle employs these terms to uncover what I call a proto-phenomenological description of the different ways of being. While contemporary scholarship has suggested the significance of dunamis and energeia for Aristotle’s understanding of being, the relationship between these terms has often been interpreted as mutually exclusive. Accordingly, dunamis would be understood as subordinate to energeia, which would function as the sole primary term (...) of Aristotle’s ontology. I argue that it is a mistake to consider dunamis and energeia as non-reciprocal and subordinate terms. Furthermore, I suggest that this mistake often leads to an underestimation of the dynamic character of Aristotle’s proto-phenomenological account of being. To recover this dimension of Aristotle’s thinking, I claim that dunamis and energeia ought to be understood as reciprocal and co-constitutive terms characterized by a constant and dynamic interrelation. To defend this interpretation, I turn to Aristotle’s conceptions of nature, movement, and soul as discussed in the Metaphysics, Physics, and De Anima. I argue that each of these key terms provide a concrete illustration of how dunamis and energeia function as co-constitutive principles for the manifestation of the being of natural beings. I propose that this proto-phenomenological approach to being remains Aristotle’s most significant and enduring contribution to Western ontology. (shrink)

This paper outlines a procedure for assessing the quality of failure explanations in engineering failure analysis. The procedure structures the information contained in explanations such that it enables to find weak points, to compare competing explanations, and to provide redesign recommendations. These features make the procedure a good asset for critical reflection on some areas of the engineering practice of failure analysis and redesign. The procedure structures relevant information contained in an explanation by means of structural equations so as to (...) make the relations between key elements more salient. Once structured, the information is examined on its potential to track counterfactual dependencies by offering answers to relevant what-if-things-had-been-different questions. This criterion for explanatory goodness derives from the philosophy of science literature on scientific explanation. The procedure is illustrated by applying it to two case studies, one on Failure Analysis in Mechanical Engineering (a broken vehicle shaft) and one on Failure Analysis in Civil Engineering (a collapse in a convention center). The procedure offers failure analysts a practical tool for critical reflection on some areas of their practice while offering a deeper understanding of the workings of failure analysis (framing it as an explanatory practice). It, therefore, allows to improve certain aspects of the explanatory practices of failure analysis and redesign, but it also offers a theoretical perspective that can clarify important features of these practices. Given the programmatic nature of the procedure and its object (assessing and refining explanations), it extends work on the domain of computational argumentation. (shrink)

This volume, the third in this Springer series, contains selected papers from the four workshops organized by the ESF Research Networking Programme "The Philosophy of Science in a European Perspective" in 2010: Pluralism in the Foundations of Statistics Points of Contact between the Philosophy of Physics and the Philosophy of Biology The Debate on Mathematical Modeling in the Social Sciences Historical Debates about Logic, Probability and Statistics The volume is accordingly divided in four sections, each of them containing papers coming (...) from the workshop focussing on one of these themes. While the programme's core topic for the year 2010 was probability and statistics, the organizers of the workshops embraced the opportunity of building bridges to more or less closely connected issues in general philosophy of science, philosophy of physics and philosophy of the special sciences. However, papers that analyze the concept of probability for various philosophical purposes are clearly a major theme in this volume, as it was in the previous volumes of the same series. This reflects the impressive productivity of probabilistic approaches in the philosophy of science, which form an important part of what has become known as formal epistemology - although, of course, there are non-probabilistic approaches in formal epistemology as well. In this paper, we evaluate Button’s claim that knot is a nasty connective. Knot’s nastiness is due to the fact that, when one extends the set \ with knot, the connective provides counterexamples to a number of classically valid operational rules in a sequent calculus proof system. We show that just as going non-transitive diminishes tonk’s nastiness, knot’s nastiness can also be reduced by dropping Reflexivity, a different structural rule. Since doing so restores all other rules in the system as (...) validity-preserving, we are inclined to conclude that there, knot is not that nasty. However, since motivating non-reflexivity is harder than motivating non-transitivity, we also acknowledge that disagreement with our conclusion is possible. (shrink)

A filosofia alemã do século XIX posterior a Hegel está bastante estudada em três direções. A primeira, que surge da luta entre hegelianos de esquerda e direita, acaba por conduzir ao materialismo e ao marxismo; a segunda, que se expressa na vertente irracionalista e anti-sistemática, passa por Schopenhauer, Kierkegaard e Nietzsche; a terceira é constituída pelo neo-kantismo e suas derivações, cuja versão oficial teria suas raízes fincadas pelo famoso discurso inaugural de Zeller e pelo livro de Otto Liebmann, que deram (...) o impulso ao movimento “Zurück zu Kant”. Em tal visão de conjunto, o grande ausente é um movimento contínuo, ainda quando irregular e multifacetado, que terminará conduzindo à filosofia contemporânea. Este movimento tem em Trendelenburg uma figura chave. É com suas “Investigações Lógicas” que se inicia a reformulação das relações entre filosofia e ciência e, neste sentido, o verdadeiro retorno a Kant. O fato de sua obra principal ter exatamente o mesmo nome que a coleção de ensaios temáticos de Frege, a obra de ruptura de Husserl e as dissertações de doutorado de Cohen, Dilthey e Brentano significa algo mais que curiosas coincidências. “Zurück zu Kant” (Adolf Trendelenburg the overcoming of idealism and the roots of contemporary philosophy) Abstract Considering history of philosophy as a whole, the two main traditions of thought from the 20th century (analytic and phenomenological-hermeneutic) can be regarded as being variants of one same fundamental turn. This systematic relation is connected to a common historical root. To highlight it implies to review the ideas that are deeply in the basis of the historiography of the German thought in the 19th century. Beyond names, problems and theses that may appear to have at first sight no relationship whatsoever, we can notice a continuous unitary development that has not yet received all the attention it deserves. In this movement, Adolf Trendelenburg stands out, once the beginners of both the abovementioned traditions and of neokantianism (Frege, Brentano, Dilthey and Cohen) received a decisive impulse from his reflections. Background Abortion is one of the most common gynaecological procedures. It is related to personal, social, and economic reasons under a legal term that is recognised as a common sexual and reproductive right in most of countries. However, making the decision to abort is complex, because it is politicised and is often framed in public discourse related to moral or ethical issues beyond women’s experiences. Therefore, it is subject to medical criteria, religious evaluations, and sociological analysis. Purpouse The aim of (...) this synthesis of qualitative studies was to synthesise the decision-making experiences of women who legally aborted. Research design and method The Noblit and Hare’s interpretive meta‐ethnography was conducted, and it was written in accordance with the eMERGe meta‐ethnography reporting guidance. Ten studies met the research objective and inclusion criteria, after a comprehensive systematic search strategy in five databases. Findings The metaphor “The wrestling between why and what will happen next” and three themes emerged from the data analysis: (1) Forces that incite the arm wrestling; (2) Facing social stigma; and (3) Defeated by a greater rival. The metaphor provided interpretive experiences of the moral conflict experienced by women who decided to have an abortion and emerged from the confrontation of the reasons why they decided to abort and the social repercussions that making the decision entails. The result of the struggle was loneliness and vulnerability. Conclusion The lines of action impact policy makers, the media, and health professionals. Actions should focus on the de-stigmatisation and normalisation of abortion, the use of appropriate language, and the training and sensitisation of health professionals. (shrink)
