This article presents a theorized and conceptually informed method for the undertaking of an ethics audit organization. At an operational level, the overall integrity of an organization, it is argued, may be evaluated through the application of a conceptual frame-work that embraces the inter-related themes of individual responsibility, social equity and political responsibility. Finally, a method is presented for ethics audit which was developed in the auditing of a national public sector sports organization: sportscotland. This emphasizes the significance of key (...) personnel (individuals and in groups) in producing and reproducing the organizational ethos, whilst recognizing the importance of anonymity and confidentiality throughout the process. The theoretical terrain of the ethics audit is articulated through a consideration of ethics as applied moral philosophy, equity as social justice and corporate governance as the moral health (or otherwise) of a public sector sports organization. Over the last two decades sport-related research has become increasingly influenced by ethical propriety and institutional governance. Whilst there has been thorough consideration of biomedical and associated research in sport and exercise, social research in sport studies has received less attention. In this article, following a brief contextualization of the current climate for research ethics discourse, the planks of an argument for social research in sport without informed consent are addressed. Dealing with ideas linked to ecological validity, impracticality, averting alarm, (...) public interest and ‘leaving only footprints’, a case is made based on two important questions: (a) is the research useful?; and (b) are other research methods available that are fit-for-purpose and allow informed consent to be secured? If the answers are ‘yes’ and ‘no’, respectively, the case should be considered. In such instances the principle of ‘McFee’s friends’ serves as an important source of guidance for researchers. The role of the ‘enforcer’ in elite-level sports contests is a familiar one. Simply, the role involves establishing or restoring a ‘moral balance’ to the sporting encounter when it is absent – usually when match officials are thought to be failing to apply the laws/rules of the game. How the enforcer secures this outcome is more morally contentious as it may involve deliberate violations of the laws/rules of the sport. In this paper we consider the role of the enforcer in (...) rugby union. First we interrogate some of the extant sports ethics literature and explore the notion of ‘fairness’ in the well-played game, including the role of the enforcer. Second, we illustrate conceptually how the ethos of elite sport as a moral discourse creates a theoretical platform from which to assess the intervention of an enforcer. Third, we address the role of match officials as members of the practice community from an institutional sense (what the international governing body for rugby union makes explicit) and from an empirical sense (what actually occurs or might occur) in the circumstances that precipitate the intervention of ‘enforcers’. We conclude that the conceptual tension between the laws and the spirit (ethos) of the game is reflected in the choices facing players when playing the game. (shrink)

It is commonly understood that in its focus on rights and obligations law is centrally concerned with organising responsibility. In defining how obligations are created, in contract or property law, say, or imposed, as in tort, public, or criminal law, law and legal institutions are usually seen as society’s key mode of asserting and defining the content and scope of responsibilities. This book takes the converse view: legal institutions are centrally involved in organising irresponsibility. Particularly with respect to the production (...) of large-scale harms – including extensive human rights violations, forms of colonialism, or environmental or nuclear devastation – and in opposition to conventional understandings of responsibility in law, morality and politics, the book provides a detailed analysis of the ways in which legal institutions – their practices, concepts, and categories – themselves operate as much to deflect responsibility for harms suffered as they do to acknowledge them. Drawing on a series of case studies from local, national, and global concerns the book analyses how law facilitates dispersals and disavowals of responsibility, and it shows how it does so in consistent and patterned ways. In assessing how this ‘organised irresponsibility’ operates, and what its consequences are for both legal analysis and society generally, a thoroughgoing re-evaluation of law’s methods, operation, and consequences is required. At stake is nothing less than a fundamental re-assessment of the role of modern law in the production and legitimation of human suffering. This innovative and interdisciplinary book provides a sustained challenge to conventional thinking about law and legal institutions. To what extent should parents be able to choose the kind of child they have? The unfortunate phrase 'designer baby' has become familiar in debates surrounding reproduction. As a reference to current possibilities the term is misleading, but the phrase may indicate a societal concern of some kind about control and choice in the course of reproduction. Typically, people can choose whether to have a child. They may also have an interest in choosing, to some extent, the conditions under which (...) they do so, such as whether they have a child with a serious disability or disease. The purpose of this book is to explore the difficult and controversial question of the appropriate ethical and legal extent of reproductive autonomy in this context. The book examines ethical, legal and public policy issues in prenatal screening, prenatal diagnosis (PND), selective abortion and preimplantation genetic diagnosis (PGD). It explores the ethics of these selection practices and the ability of current ethical guidelines and legal mechanisms, including the law on selective abortion and wrongful birth, to deal with advances in genetic and other knowledge in these areas. Unlike in the United States, in England the relevant law is not inherently rights-based, but the impact of the Human Rights Act 1998 inevitably raises questions about the proper scope of reproductive autonomy in this context. The implications of the analysis are considered for the development of relevant law, public policy and ethical guidelines and will be of interest to academics in medical law and ethics, health professionals, lawyers, those working on public policy and students with an interest in these issues. African Philosophy and St Thomas Aquinas have both been taught in African universities, but the engagement between the continent’s indigenous philosophical tradition and the Catholic intellectual tradition’s preeminent strand, has not been thorough. Presupposing that plural philosophical traditions contribute to the search to better understand, this research embarks upon a comparative analysis of the perspectives of the African ubuntu philosophy and Thomist philosophical conceptualisations of human becoming and being. Through analysis of dimensions of both traditions, it is contended that human (...) fulness arises through relationality. It is argued that in centring on the interpersonal encounter and the consequent recognition of another’s being through mutual engagement, these philosophical traditions open to each other. Further, both traditions contribute toward the ontology of personhood in ubuntu and the good of mutual indwelling, respectively. (shrink)

We apply the analysis that we have developed over the course of several publications on the significance of ignorance for decision-making, especially in surrogate (and, thus, in political) contexts, to political decision-making, such as it has been, during the COVID-19 pandemic (see Scheall 2019; Crutchfield and Scheall 2019; Scheall and Crutchfield 2020; Scheall 2020). Policy responses to the coronavirus constitute a case study of the problem of policymaker ignorance. We argue that political responses to the virus cannot be explained by (...) assuming that the interests of policymakers were at loggerheads with those of their constituents at the beginning of the crisis. In order to explain the responses of policymakers, it is necessary to recognize the effects of relevant ignorance on their incentives to pursue different policy objectives. We discuss the knowledge that policymakers required at the start of the pandemic in order to deliberately realize the goal of limiting overall human suffering and the spontaneous forces that could have facilitated the realization of this goal. The problem of policymaker ignorance implies that policymakers have not earnestly pursued the goal of limiting overall suffering due to the novel coronavirus, but have repeatedly resorted to the pursuit of relatively less epistemically burdensome goals. The problem of policymaker ignorance explains why policymakers have focused primarily on limiting one kind of suffering – physical suffering due to the virus – and have mostly ignored related kinds of suffering, i.e., the economic, sociological, psychological, and physical suffering caused by policies to limit physical suffering from the virus. The problem of policymaker ignorance also helps to explain why policymakers relied on the relatively blunt instrument of economic lockdown rather than more focused protection policies, and why they continue to resort to lockdowns, despite the emerging scientific evidence of their ineffectiveness at mitigating physical suffering due to the virus. In David Hume's Humanity, Yenor shows how Hume's skepticism is a moment leading Hume to defend a philosophy that is grounded in the inescapable assumptions of common life. Humane virtues reflect the proper reaction to the complex mixture of human faculties that define the human condition. These gentle virtues best find their home in the modern commercial republic, of which England is the leading example. Hume's defense (...) of both common life philosophy and humanity are, however, flawed by his secretly dogmatic assumptions about the nature of history and his Enlightened approach to religious teachings and psychology. This study makes the case for Hume's manner of grounding philosophy in common life is essential to any reinvigoration of the humanities. With human language, the same utterance can have different meanings in different contexts. Nevertheless, listeners almost invariably converge upon the correct intended meaning. The classic Gricean explanation of how this is achieved posits the existence of four maxims of conversation, which speakers are assumed to follow. Armed with this knowledge, listeners are able to interpret utterances in a contextually sensible way. This account enjoys wide acceptance, but it has not gone unchallenged. Specifically, Relevance Theory offers an explicitly cognitive account of (...) utterance interpretation that presents a radical challenge to the neo‐Gricean paradigm. Evolutionary considerations are one way in which we can choose between competing theories. A simple game‐theoretic model of the evolution of communication is presented, and it is used to derive a number of basic qualities that will be satisfied by all evolved communication systems. These qualities are observed to precisely predict the foundational principles of Relevance Theory. The model thus provides biological support for that enterprise in general, and for the plausibility of the cognitive mechanisms that it describes in particular. (shrink)

In this paper we distinguish between epistemic dilemmas, epistemic quasi-dilemmas, and quasi epistemic dilemmas. Our starting point is the commonsense position that S faces a genuine dilemma only when S must take one of two paths and both are bad. It’s the “must” that we think is key. Moral dilemmas arise because there are cases where S must perform A and S must perform B—where ‘must’ implies a moral duty—but S cannot do both. In such a situation, S is doomed (...) to violate a moral obligation. Analogously, S face’s a genuine epistemic dilemma only if she has an epistemic duty to believe that p and at the same time an epistemic duty to not believe that p (either because she has a duty to believe ~p or a duty to suspend judgment). We argue that such cases never arise because there is no epistemic duty to adopt a particular doxastic attitude towards any particular proposition (ever). Hence, there are no epistemic dilemmas. Nevertheless, one might suppose there are situations in which one’s evidence pulls in different directions without determining a uniquely justified doxastic attitude. Such epistemic quasi-dilemmas aren’t full-fledged dilemmas, but they are arguably close enough to pose a genuine problem for the believer. But we argue that there are no genuine epistemic quasi-dilemmas either: They are all resolvable in principle. Fans of dissonance will not be totally disappointed, however, since we argue that there may well be quasi-epistemic dilemmas. These are genuinely unwinnable situations in which one’s moral or pragmatic obligations to do epistemically-relevant things make incompatible demands. (shrink)

Settling the debate over conscientious refusal (CR) in liberal democracies requires us to develop a conception of the healthcare provider’s moral role. Because CR claims and resulting policy changes take place in specific sociopolitical contexts with unique histories and diverse polities, the _method_ we use for deriving the healthcare norms should itself be a democratic, context-dependent inquiry. To this end, I begin by describing some prerequisites—which I call _publicity conditions_—for any democratic account of healthcare norms that conflict or jibe with (...) CR. Next, drawing on Ronald Dworkin’s jurisprudence and Tom Beauchamp & James Childress’s approach to bioethical reasoning, I briefly introduce one method for generating healthcare norms that is faithful to the publicity conditions and has potential to constructively, and democratically, derive important boundaries for CR. Finally, I argue that many critics of CR fail to similarly ground their accounts of healthcare norms in healthcare professionals’ sociopolitical contexts, often relying instead on their own interpretation of a generally stateable healthcare norm. This leads to their misconstruing both the value judgments on which their own approaches rest and the public, political values that are often invoked in favor of CR. (shrink)

In recent years, two important books by Yoram Cohen and Matthew Rutz have marked significant progress in research on the archives of Late Bronze Age Emar in northwestern Syria. Both of them approach Emar by way of its scribes. Cohen undertakes a systematic review of all named scribes identified in texts associated with Emar, while Rutz narrows his object to the building that yielded by far the largest number of excavated tablets. This new book takes an innovative and novel approach to the study of jurisprudence. Drawing together a range of specialists, making original contributions, it provides a summary, analysis, and critique of basic themes in, and major contributions to, the study of jurisprudence. The book explores issues and ideas in jurisprudence in a way that integrates them with legal study more broadly, avoiding the tendency in recent years for the subject to become overly inward-looking, specialist and technical, leaving students and the (...) subject adrift. It picks up mid-range concepts such as rights, sovereignty, and adjudication and charts their interrelation and uses in law and legal theory. The approach taken to the subject is an interdisciplinary one, and involves making linkages with contemporary issues in political and social theory, such as the changing role of the state, forms of dispute resolution and the courts. It also addresses topics not normally covered, or covered only indirectly in other jurisprudence textbooks, such as globalisation and legal culture. An evidentialist can be extreme about epistemic requirements in a couple of different ways. At the reductionist end of the spectrum are those who think our epistemic obligations are fully satisfied by the mere having of evidential fit—where having implies nothing about doing. Your beliefs ought to align with your evidence, in other words, but there’s nothing you’re obligated to do in order to get yourself into the epistemically optimal position. At the expansionist end of the spectrum are those who (...) think we ought to do more—epistemically-speaking—than just bring about a state of evidential fit. We ought to get more evidence, for instance, if it’s somehow relevant to our beliefs. Rather leery of extremists, we prefer a moderate account of epistemic obligation. It’s a conjunction of three theses: (1) We never have an epistemic duty to believe any particular proposition; (2) We’re epistemically obligated to reflect on our evidence in order to produce a state of evidential fit; (3) We’re never epistemically obligated to acquire any additional evidence. How should we conceive of policymakers for the purposes of political analysis? In particular, if we wish to explain and predict political decisions and their consequences, if we wish to ensure that political action is as effective as it can be, how should we think of policymakers? Should we think of them as they are commonly conceived in traditional political analysis, i.e., as uniquely knowledgeable and as either altruistic (i.e., as motivated to realize goals associated with their constituents’ interests) or (...) knavish (i.e., as motivated to realize goals associated with their own personal interests), or should we treat them as possibly ignorant with respect to their political tasks? -/- It is always an open question whether policymakers possess the knowledge required to realize some policy objective. It should never be assumed a priori that policymaker knowledge is adequate to the policy tasks with which policymakers are charged. Politicians need knowledge concerning the causes of social phenomena adequate to control events sufficiently well to ensure the success of their policies. No argument has ever been offered for the standard, if only implicit, assumption that policymakers, somehow automatically, possess this knowledge. In many contexts, there is no reason to believe that policymakers possess or can acquire this knowledge. Indeed, a bit of reflection reveals how unlikely it is that and how rare the circumstances must be in which policymakers meet this condition, which political philosophers, theorists, economists, and other political thinkers have traditionally assumed as a matter of course. -/- The main purpose of the book is to encourage a conversation among scholars and students of political inquiry (in philosophy and political theory, political science, economics and political economy) concerning the best way to conceive of policymakers for the purposes of such inquiry. -/- The book defends an alternative, more realistic, method of political analysis. The book argues against the false assumption that policymakers are epistemically privileged. The book presents and defends the alternative assumption that, with respect to the knowledge required to discharge their political tasks effectively, policymakers are at least as ignorant as constituents. -/- The book further argues that whether policymakers are altruistic or knavish is, in the first instance, a function of the nature and extent of their ignorance with regard to constituent-minded policy goals. Policymakers who possess the knowledge required to be effectively altruistic are more likely to be altruistic, other things the same, than policymakers who are ignorant of the knowledge that successful altruism requires. -/- This being said, my goal is more to leave readers thinking about and inclined to debate these profound issues than to prescribe a particular methodological conclusion (even less to advocate a particular political conclusion). The book is a heuristic for spurring further conversation. It makes of readers fellow interlocutors partnered with the characters (and the author!) of the dialogue. -/- The vehicle for this analysis is a conversation between four friends, philosophy graduate students, with different interests, different levels and kinds of experience, and different political preferences. The four friends consider how politicians should be conceived for the purposes of analyzing political decision-making and its consequences. -/- In his famous Dialogues concerning Natural Religion, David Hume concluded that the assumption of an all-knowing and all-powerful God was neither necessary nor sufficient to explain natural phenomena. Dialogues concerning Natural Politics does for social science what Hume did for natural science. Both books undermine the assumption that some epistemically privileged being – God in the case of natural phenomena and God-like politicians in the case of social phenomena – must be invoked to explain relevant phenomena.
