Irish legislative engagement with abortion law reform has never been framed by recognition of the rights of pregnant women, girls and other people. Rather, where it has taken place at all, it has always been foetocentric and punitive, exceptionalising abortion and conceptualising law as a means of discouraging it. In important ways, the post-repeal landscape has failed to break decisively with this orientation. While in 2018 there was certainly more discussion of women’s entitlement not to be exiled from the country (...) in order to make decisions about reproduction, the framing that dominated legislative and government discourses of abortion law reform was one in which the ‘problem’ being addressed was such that unsafe medication, exclusion from formal medical systems, and the undeserved punishment of people who had received diagnoses of fatal foetal conditions in the course of their ‘much wanted pregnancies’ were the focus. There was little or no engagement in legislative politics with the right to choose, reproductive agency, reproductive justice or the moral standing of pregnant people as ethical decision makers when it came to their pregnancies. As a result, post-repeal abortion law reform was more about managing risk than maximising agency. I will argue that this underpins and partly explains the shortcomings of the new law: the Health (Regulation of Termination of Pregnancy) Act 2018 (‘HRTPA 2018’). Within that new legal regime, I argue, pregnant people continue to lack decisional security when it comes to their reproductive lives and are exposed to significant constitutional and dignitary harms as a result. The well-established pattern of Executive expansionism and limited oversight of Executive action in times of terrorism is problematic from the civil libertarian point of view. How to limit such action has been the subject of much scholarship, a large amount of which focuses on perceptions of institutional competence rather than effectiveness. For the authors, the effective control of security-focused state action is to be judged by the extent to which it consists only of action that is necessary and proportionate and (...) thereby strikes an appropriate balance between security exigencies and individual rights. This article, written and structured in dialectic form, presents competing perspectives on effective oversight mechanisms: on the one hand, an extra-constitutionalism perspective, proposing a limited role for the Judiciary and emphasizing the need for legislative and democratic controls; and on the other, an argument for judicial muscularity. Research ethicists have recently declared a new ethical imperative: that researchers should communicate the results of research to participants. For some analysts, the obligation is restricted to the communication of the general findings or conclusions of the study. However, other analysts extend the obligation to the disclosure of individual research results, especially where these results are perceived to have clinical relevance. Several scholars have advanced cogent critiques of the putative obligation to disclose individual research results. They question whether ethical goals (...) are served by disclosure or violated by non-disclosure, and whether the communication of research results respects ethically salient differences between research practices and clinical care. Empirical data on these questions are limited. Available evidence suggests, on the one hand, growing support for disclosure, and on the other, the potential for significant harm. (shrink)

Deception is part of the natural repertoire of adaptive behaviours in many organisms. In humans we see it in all domains of human activity including health care. Within health care, deception can be a matter of concern, but it is also used to protect patients, for instance against overwhelming and negative diagnostics. This paper demonstrates that deception and self‐deception are closely interlinked and that self‐deception facilitates deception. Furthermore, self‐deception tends to be used to reduce the discomfort we feel when we (...) are dishonest (cognitive dissonance). Merleau-Ponty identifies an intertwined affective state of anxiety and courage, claiming that these are one and the same thing, as a fundamental characteristic of human existence. I argue that trust, understood as phenomenologically basic, is the unity, or the something beyond, the singularly conceived states of anxiety and courage, and that trust itself cannot be conceived apart from these states. Merleau-Ponty says little, directly, about trust in his work, yet his focus on the fundamental precariousness of existence demands such an (...) exploration. I explore how our ordinary day-to-day experience of existence is related to an intertwined affective state of anxiety and courage and how trust is operative in affective depth, in order to understand how it is we come to speak of trust not only in terms of proximity and distance, emotional depth and extension across time, but most markedly, in terms of how we see someone and what it is like to be in relation to them. Ever since its publication by Carmelo Ottaviano in 1934, there has been little or no attempt to understand the meaning of the anonymous Liber contra Lombardum , an attack on the doctrinal statement on the Trinity issued by the Fourth Lateran Council of 1215.1The responsibility for this lies in large part with Ottaviano himself whose subtitle to the edition, Scuola di Gioacchino da Fiore, was vigorously criticised. The implication that the anonymous author belonged to the school of Joachim of Fiore (...) , the famous monastic reformer and theologian, was considered both groundless and misleading since there was no evidence of any Joachimist tradition of speculative thought on the Trinity. To those more familiar with the influence of Joachim's exegetical and eschatological framework, the rejection of Ottaviano's idea of a Joachimist tradition of trinitarian theology, to which the LcL belonged, will come as a surprise. The fact remains that no student of Joachim's trinitarian theology has endorsed Ottaviano's thesis. (shrink)

Badiou has said that his entire philosophical project stems from the need to “update” the traditional philosophical categories of Truth, Being, the Infinite and the Universal in the wake of the 19th Century German mathematician Georg Cantor’s explication of transfinite set theory. In his essay, “What is Love?”, he provides an account of one of the ways in which a post-Cantorian reconfiguration of the ontological status of the category of Woman might operate. This is given in the form of a (...) postscript subtitled “The Feminine Position and Humanity” wherein he gives Lacan’s conception of supplementary feminine jouissance “an extra turn of the screw”. This essay draws on Badiou’s reconfiguration of the philosophical category of Woman to examine the implications of another postscript, that which abruptly concludes the 2003 novel Elizabeth Costello by J. M. Coetzee. It reads Coetzee’s invention of the “Letter of Elizabeth, Lady Chandos” with recourse to Lacanian psychoanalytic theory and on through the ontological reconfiguration of the philosophical category of Woman demonstrated by Badiou. It argues that Coetzee assembles, through the intervention of the postscript, a situation that “makes it possible to argue”, along with Badiou, that, for the woman position, love knots together the four types of truths – Politics, Art, Science, and Love (2008, 196). Analysis of a diverse cross‐sample of plant‐insect interactions suggests that the abundance of vitamin C (L‐ascorbic acid, ascorbate or AsA) in plants influences their susceptibility to insect feeding. These effects may be mediated by AsAs roles as an essential dietary nutrient, as an antioxidant in the insect midgut, or as a substrate for plant‐derived ascorbate oxidase, which can lead to generation of toxic reactive oxygen species. Ascorbate can also influence the efficacy of plant defenses such as myrosinases and tannins, and (...) alter insects' susceptibility to natural enemies. Conversely, herbivores appear to influence both de novo synthesis and redox cycling of AsA in their host plants, thereby potentially altering the nutritional value of crops and their susceptibility to pests. The recent development of genetically modified crops with enhanced AsA content provides both an impetus and a tool set for further studies on the role of AsA in plant‐insect interactions. (shrink)

How might we construe the demand that is posed by the circulation of photographic images in the contemporary world other than the sense that is given to these in contemporary cosmopolitanism, that is, as an extension of the realm of representation to a wider humanity? The ontological reading of the image and its way of marking life given here delineates an approach to the evidence that images present that de-centres the place of human subjectivity as the locus of meaning. Using (...) the work of Jean-Luc Nancy on the image, and Judith Butler on the apprehension of grievable life, the essay seeks to phrase the nature of a demand arising from the image, as that which exceeds an immediate or given context. It is this demand, I suggest, that is given in the non-representational aspect of the image, its circulation out of context. To heed this demand, I argue, is to attend to what Nancy terms “being-singular-plural” and Butler “grievable life,” and to move beyond the cosmopolitan form of vision toward what Derrida terms “hospitality.”. The book begins with an overview of globalization, showing how wealth and power are concentrated in the hands of a transnational elite while ever increasing numbers of people are being marginalised. Institutions such as the World Trade Organisation and the International Monetary Fund are intent upon exercising a new hegemony over individuals as the role of the traditional nation state is transformed. At the centre of this power shift is a group of high-tech robber barons who dominate the Information Age (...) and exploit the technologies of globalization for their own narrow interests. The second part of the book explores the rise of the new grass roots oppositional movements around the world. Manifest in such diverse struggles as the uprising of the Zapatistas in Mexico and the battle of Seattle against the World Trade Organisation, this new postmodern politics is "de-centred" and has little interest in the old ideologies that dominated much of the twentieth century. The final section of the book contextualizes postmodern politics by drawing on contemporary examples. The authors discuss the demise of socialist and proto-socialist experiments in Chile, Grenada, Nicaragua and Cuba and the emergence of postmodern movements in Latin America. A philosophical frame for violence against women and girls creates unique opportunities to deepen our understanding of the embodied consequences of men’s violence. Using the seemingly innocuous example of being told to “cheer up” or “smile”, we draw on Simone de Beauvoir and Franz Fanon’s work on recognition to suggest that a phenomenological approach to sexual violence may help to voice previously inarticulable harms. The dual frame of Beauvoir and Fanon also highlights the need for philosophical work on sexual violence (...) to take account of the insights of intersectionality. (shrink)

Current naturalistic accounts of value face the problem of explaining the normative constraints that value impose on agents. Attempts to solve this problem have progressively relaxed the strictness of naturalistic requirements, up to the point of seeking theistic solutions. However, appeals to God are also problematic, since it is questionable that a relevant notion of God is conceivable at all: if God is wholly other He cannot matter for our choices and if He is a being among natural beings He (...) cannot explain our normative constraints. Engaging a discussion with Fiona Ellis’ treatment of the problem, this essay sketches an account of transcendence, which vindicates the conceivability of a notion of God suitable for the explanation of value. The proposal rests on the possibility of transcendental arguments based on analogy. (shrink)

How would you feel about your husband, wife, or partner masturbating using pornography or erotica? For many, this would be a betrayal – a kind of cheating. I explore whether monogamous relationships should forbid solo masturbation using erotica and pornography, considering two possible objections: (1) the objection that such activity is a kind of infidelity; (2) the objection that such activity involves attitudes, usually attitudes towards women that are incompatible with an equal, loving relationship. I argue that the use of (...) erotic material in solo masturbation should not count as cheating. Solo use of pornography differs significantly from interpersonal sexual activity. Thus, unlike causal interpersonal sex, it does not undermine the role of sex within the relationship. Additionally, freedom to explore sexual fantasy through masturbation is an important element of sexual autonomy. Objection (2) holds against some but not all erotic material. Sexual enjoyment of pornography that depicts, or is produced by, suffering or degradation involves a way of seeing others that has implications for the user’s relationships with others, particularly sexual relationships. However, not all erotic material involves objectionable attitudes towards others. Thus partners should allow moderate use of some types of erotica in solo-masturbation. (shrink)

This powerfully iconoclastic book reconsiders the influential nativist position toward the mind. Nativists assert that some concepts, beliefs, or capacities are innate or inborn: "native" to the mind rather than acquired. Fiona Cowie argues that this view is mistaken, demonstrating that nativism is an unstable amalgam of two quite different--and probably inconsistent--theses about the mind. Unlike empiricists, who postulate domain-neutral learning strategies, nativists insist that some learning tasks require special kinds of skills, and that these skills are hard-wired into (...) our brains at birth. This "faculties hypothesis" finds its modern expression in the views of Noam Chomsky. Cowie, marshaling recent empirical evidence from developmental psychology, psycholinguistics, computer science, and linguistics, provides a crisp and timely critique of Chomsky's nativism and defends in its place a moderately nativist approach to language acquisition. Also in contrast to empiricists, who view the mind as simply another natural phenomenon susceptible of scientific explanation, nativists suspect that the mental is inelectably mysterious. Cowie addresses this second strand in nativist thought, taking on the view articulated by Jerry Fodor and other nativists that learning, particularly concept acquisition, is a fundamentally inexplicable process. Cowie challenges this explanatory pessimism, and argues convincingly that concept acquisition is psychologically explicable. Traditional approaches to health ethics are often urban-centric, making implicit assumptions about how values and norms apply in health care practice, and as such may fail to take into account the complexity, depth, richness, and diversity of the rural context. There are ethically relevant differences between rural health practice and rural health services delivery and urban practice and delivery that go beyond the stereotypes associated with rural life and rural health services. Can the phenomenal character of perceptual experience be altered by the states of one's cognitive system, for example, one's thoughts or beliefs? If one thinks that this can happen then one thinks that there can be cognitive penetration of perceptual experience; otherwise, one thinks that perceptual experience is cognitively impenetrable. I claim that there is one alleged case of cognitive penetration that cannot be explained away by the standard strategies one can typically use to explain away alleged cases. The case (...) is one in which it seems subjects' beliefs about the typical colour of objects affects their colour experience. I propose a two-step mechanism of indirect cognitive penetration that explains how cognitive penetration may occur. I show that there is independent evidence that each step in this process can occur. I suspect that people who are opposed to the idea that perceptual experience is cognitively penetrable will be less opposed to the idea when they come to consider this indirect mechanism and that those who are generally sympathetic to the idea of cognitive penetrability will welcome the elucidation of this plausible mechanism. Fiona Woollard presents an original defence of the Doctrine of Doing and Allowing, according to which doing harm seems much harder to justify than merely allowing harm. She argues that the Doctrine is best understood as a principle that protects us from harmful imposition, and offers a moderate account of our obligations to offer aid to others.

: This paper responds to the sense of "crisis" or "trouble" that dominates contemporary feminist debate about the categories of sex and gender. It argues that this perception of crisis has emerged from a fundamental confusion of theoretical and political issues concerning the implications of the sex/gender debate for political representation and agency. It explores the sense in which this confusion is manifest in a debate between Seyla Benhabib and Judith Butler.

Ethical perspectives on regional, rural, and remote healthcare often, understandably and importantly, focus on inequities in access to services. In this commentary, we take the opportunity to examine the implications of normalizing metrocentric views, values, knowledge, and orientations, evidenced by the recent (2022) New South Wales inquiry into health outcomes and access to hospital and health services in regional, rural and remote New South Wales, for contemporary rural governance and justice debates. To do this, we draw on the feminist inspired (...) approach to rural health ethics involving analysis of power relationships developed by Simpson and McDonald and related ideas from critical health sociology.
