Of those who have tried to establish the connection between hermeneutics and phenomenology, two stand out: Martin Heidegger and Paul Ricoeur. In Being and Time, Heidegger famously declared that phenomenology is a hermeneutic, though not in the sense of an epistemological theory of interpretation. In From Text to Action, Ricoeur set out to show how it is possible for hermeneutics and phenomenology to have a relationship of “mutual belonging”. This chapter examines four programmatic statements on the relationship: two versions offered (...) by Heidegger in the 1920s and two versions offered by Ricoeur, one in the late 1960s and the other in the mid‐1980s. Attention is drawn both to the evolution of Heidegger's and Ricoeur's thinking on the subject and to the ways in which the various accounts differ from one another. (shrink)

Inspired by the report, Reimagining our Futures Together. A New Social Contract for Education, which warns that humanity and planet Earth are under threat, but acknowledges that education has the power to bring about profound change, this article makes the case for giving careful consideration both to Paul Ricœur’s reflections on humanity and human capacities, and to his comments on “true education” and the educational value of poetic thought. To get a sense of where scientific-technological civilization is headed, it draws (...) on the work of Allen Buchanan and Dominique Janicaud. It then examines Ricœur’s account of the essential characteristics of education and his thoughts on the roles of families and teachers. It argues that Ricœur’s proposal for the cultivation of an “ethical consciousness” offers greater protection for humanity in an uncertain future than Janicaud and Buchanan’s proposals for “ethical vigilance” and rules-based protective measures. This article takes up Paul Ricœur’s suggestion that he learned more about the idea of justice by positioning himself on the juridical plane than he had by moving directly to a consideration of political theory. It contends that Ricœur’s very interesting but largely neglected text, “The Just between the Legal and the Good,” illustrates the value of doing philosophical work at a level where there is an imperative to make a judgement and following on from that to distribute, in the (...) fairest way possible, the goods that are at the heart of the dispute. The article also offers a detailed commentary on Ricœur’s text, noting the unusual form of critique that it brings to bear on Rawls’s principles of justice. It also discusses Ricœur’s proposals for entrenching those principles in a concrete judicial practice. (shrink)

Dominique Janicaud considered Paul Ricœur an ally in the dispute with those who, like Emmanuel Lévinas and Jean-Luc Marion, allegedly failed to keep phenomenology within its proper methodological limits. Janicaud also claimed to have been guided by Ricœur when it came to developing positive proposals for the future direction of phenomenology. This paper argues, however, that Janicaud misinterpreted key passages in works by Ricœur that address phenomenological issues. It also offers alternative readings which take account of the wider context. Thus, (...) for example, Ricœur’s comments on Lévinasian phenomenology are shown to be appreciative rather than polemical. The paper also discusses Ricœur’s rarely commented upon oblique and indirect response to Janicaud, which establishes that Ricœur chose to align himself with phenomenologists who had taken “the theological turn.”. Heidegger's history of hermeneutics discovered nothing more than a “diluted” understanding of hermeneutics in Schleiermacher and Dilthey. In contrast, Gadamer's and Ricoeur's histories of hermeneutics placed little or no emphasis on the premodern period, focusing instead on the rise of the “hermeneutic problem” in Schleiermacher's work and the development of that problematic in works by Dilthey and Heidegger. Ricoeur added Gadamer to that list, recognizing that Gadamer was instrumental in the way he had received and perceived the problem in question. (...) Charles R. Bambach argues that it was, in fact, Karl Barth's “crisis theology” that had inspired Heidegger's “destructive” alternative to the conventional view of historical research. He revealed that he had followed Hegel when writing his history of hermeneutics, noting that his decision to do so had consequences for the way he depicted the rise of hermeneutics; and the way his history of hermeneutics ended. This is the first collection of essays examining Paul Ricoeur's writings on law, bringing together eminent Ricoeur scholars from around the world to demonstrate the importance of Ricoeur's philosophy for the juridical field while offering new paths to extend and build on his work.

Public, private, non-profit and for-profit nursing education enterprises in the U.S. are competing with one another in a newly complex and volatile educational landscape, placing academic leaders into situations fraught with moral, ethical and legal compromise with few precedents for guidance. This case study provides a richly contextualized narrative exploration of ethical and legal challenges to one leader’s moral courage, a fictionalized exploration drawn from multiple sources over time, to form a composite that is nonetheless firmly rooted in the complexity (...) and competitiveness characteristic of nursing education today. Our purpose is three-fold: 1) to direct the reader to moral and ethical questions that require thoughtful discourse and analysis among current and future academic nursing leaders; 2) to raise the issue of the need for regulations and oversight that reflect the changing realities of today’s increasingly complex and competitive educational arena; and 3) to encourage nursing education leaders to share additional cases that resonate for them, and in so doing, to expand the wellspring of ideas from which we can all draw in becoming more effective and morally courageous leaders. This article surveys recent feminist contributions to moral philosophy with an emphasis on those works which engage with debates within mainstream ethics. The article begins by examining a tension said to arise from the two criteria a theory must meet if it is to count as feminist moral theory: the women's experience requirement and the feminist conclusion requirement. Subsequent sections deal with feminist relational theories of rights, feminist work on responsibility and feminist contractarian approaches to ethics. the standard reading of plato's Republic is that justice is predicated of the ideal city and of the philosophers, and that all other constitutions, both psychic and political, that are mentioned in the course of the dialogue are in some way or another defective and unjust. A non-standard reading appears to be gaining traction, however. This book attempts to reframe abortion rights by focusing not on a woman's right to choose abortion, but rather on a woman's right to consent to pregnancy. Drawing on legal, medical, and philosophical definitions of pregnancy, it disaggregates the consent to sexual intercourse from the consent to pregnancy and argues that men and women have equal right to bodily integrity, which is defined as the freedom from nonconsensual bodily intrusion. Greek Philosophers of the Hellenistic Age examines an important but frequently neglected group of philosophers writing after Aristotle between the third and first centuries B.C. The work of a distinguished intellectual historian, this book is based on an erudite reading of a vast number of primary sources: the Greek and Latin writings of the philosophers, and the fragments, paraphrases, and testimonies from their lost works. Kristeller explores the thought of Epicurus; Zenon and Cleanthes, the founder of the Stoic school and (...) his successor; Pyrrhon and Arcesilaus, the founder of Skepticism and the philosopher who introduced it into the Platonic Academy; and Chrysippus, the third head of the Stoic school and its most important representative. This article explores the epistemological and strategic issues facing feminists embarking upon narrative explorations into women's experiences. It considers the implications for feminist epistemology of acknowledging women's participation in dominant ideologies about their social role. Focusing upon questions of women's agency, it asks how this `conforming knowledge' might complicate postmodernist feminist notions of resisting and reconstructing law's categorisation of `Woman'. It also represents an attempt to clarify, in advance of my own analysis of women's agency in abortion decision-making, why postmodern (...) feminists might talk to women – the `subjects' of law's constructive power. It seeks additionally to open a discussion among a wider audience of feminists about what we might do with the information uncovered through listening to women's own stories in an area pronounced upon authoritatively by a multitude of discourses. In this paper I argue for the use of Deleuzian theories in educational contexts. In particular, I am interested in the use of the concept of rhizomes, and the analysis of texts as rhizomes, drawing on Deleuze and Guattari's work in A Thousand Plateaus (1987). I discuss the possibilities for using rhizomatics in educational contexts through an exploration of the construction of an 'apparatus of social critique' (Buchanan, 2000). I then describe a rhizomatic understanding of the relationships between teachers and (...) policy texts, which can disrupt commonsense understandings of these relations. I provide examples from my own research (Honan, 2001) of a rhizo-textual analysis of policy texts. This rhizo-textual analysis involved an exploration of the construction of the subject position, teacher, within one policy text, as well as a mapping of two teachers' readings of this text. The paper concludes with a discussion of the implications for using Deleuzian theory in educational contexts, implications for both policy developers and educational researchers. (shrink)

Rousseau’s account of the “legislator” or “lawgiver” is commonly regarded as one of the most far-fetched, ominous, and baffling parts of his teaching in the Social Contract. In brief, Rousseau’s lawgiver seems to be a proto-totalitarian figure whose self-appointed mission is to found a political community by “denaturing” people at a single stroke and who may be a mere figment of Rousseau’s overheated imagination. Accordingly, this part of the Social Contract threatens to make a mockery of Rousseau’s claim to be (...) “taking men as they are and laws they can be,” as well as his claim that the combination of “ freedom and equality” is “the greatest good” in the civil state. Following and extending Rousseau’s own method of teaching by examples, however, this essay argues that Benjamin Franklin’s influence over the American republic—especially through his posthumous Autobiography—offers a prosaic example of the apparently fantastical phenomenon sketched by Rousseau. In fact, I argue that Franklin’s case corresponds more fully to Rousseau’s description than do any of Rousseau’s own examples (such as Moses, Lycurgus, and Numa) and that Franklin showed in practice what Rousseau suggested in theory: that a lawgiver can succeed without relying on coercion and without undercutting the equality that underlies a just society. Franklin’s denaturing influence, I suggest, has been crucial for the durability of republicanism in the United States, given the country’s size and diversity. (shrink)

Kit Fine and Gideon Rosen propose to define constitutive essence in terms of ground-theoretic notions and some form of consequential essence. But we think that the Fine–Rosen proposal is a mistake. On the Fine–Rosen proposal, constitutive essence ends up including properties that, on the central notion of essence, are necessary but not essential. This is because consequential essence is closed under logical consequence, and the ability of logical consequence to add properties to an object’s consequential essence outstrips the ability of (...) ground-theoretic notions, as used in the Fine–Rosen proposal, to take those properties out. The necessary-but-not-essential properties that, on the Fine–Rosen proposal, end up in constitutive essence include the sorts of necessary-but-not-essential properties that, others have noted, end up in consequential essence. Emerging child welfare policies promoting preventive and early intervention services present a challenge to professional ethics, raising questions about how to balance respect for service users with concern for social justice. This article explains how the UK policy involves shifting the balance of power away from families towards state and professional decision making. The policy is predicated on sharing information between professionals to inform risk and need assessment and so poses a problem for the ethic of confidentiality in a helping (...) relationship. This article examines the arguments for information sharing and questions whether the predicted benefits for children outweigh the cost of eroding family privacy and changing the nature of professional relationships with service users.
