In this chapter, I argue that the notion which Michael Walzer calls jus ad vim might improve the moral evaluation for using military lethal force in conflicts other than war, particularly those situations of conflict short-of-war. First, I describe his suggested approach to morally justifying the use of lethal force outside the context of war. I argue that Walzer’s jus ad vim is a broad concept that encapsulates a state’s mechanisms for exercising power short-of-war. I focus on his more narrow (...) use of jus ad vim which is the state’s use of lethal force. Next I address Tony Coady’s critique of jus ad vim. I argue that Coady highlights some important problems with jus ad vim, but these concerns are not sufficient to dismiss it completely. Then, in the final section, I argue that jus ad vim provides an appropriate “hybrid” moral framework for judging the ethical decision-making outside of war by complementing other conventional just war distinctions. A benefit of jus ad vim is that it stops us expanding the definition of war while still providing the necessary ethical framework for examining violent conflict outside that context. (shrink)

We argue for asymmetries between positive and negative partiality. Specifically, we defend four claims: i) there are forms of negative partiality that do not have positive counterparts; ii) the directionality of personal relationships has distinct effects on positive and negative partiality; iii) the extent of the interactions within a relationship affects positive and negative partiality differently; and iv) positive and negative partiality have different scope restrictions. We argue that these asymmetries point to a more fundamental moral principle, which we call (...) Morality’s Harmonious Propensity. According to this principle, morality has a propensity toward preserving positive relationships and dissolving negative ones. (shrink)

This paper applies a very traditional position within Natural Law Theory to Cyberspace. I shall first justify a Natural Law approach to Cyberspace by exploring the difficulties raised by the Internet to traditional principles of jurisprudence and the difficulties this presents for a Positive Law Theory account of legislation of Cyberspace. This will focus on issues relating to geography. I shall then explicate the paradigm of Natural Law accounts, the Treatise on Law, by Thomas Aquinas. From this account will emerge (...) the structure of law and the metaphysics of justice. I shall explore those aspects of Cyberspace which cause geography to be problematic for Positive Law Theory and show how these are essential, unavoidable and beneficial. I will then apply Aquinas’s structure of law and metaphysics of justice to these characteristics. From this will emerge an alternative approach to cyberlaw which has no problem with the nature of Cyberspace as it is but treats it as a positive foundation for new legal developments. (shrink)

Subject relative clauses (SRCs) are typically processed more easily than object relative clauses (ORCs), but this difference is diminished by an inanimate head‐noun in semantically non‐reversible ORCs (“The book that the boy is reading”). In two eye‐tracking experiments, we investigated the influence of animacy on online processing of semantically reversible SRCs and ORCs using lexically inanimate items that were perceptually animate due to motion (e.g., “Where is the tractor that the cow is chasing”). In Experiment 1, 48 children (aged 4;5–6;4) (...) and 32 adults listened to sentences that varied in the lexical animacy of the NP1 head‐noun (Animate/Inanimate) and relative clause (RC) type (SRC/ORC) with an animate NP2 while viewing two images depicting opposite actions. As expected, inanimate head‐nouns facilitated the correct interpretation of ORCs in children; however, online data revealed children were more likely to anticipate an SRC as the RC unfolded when an inanimate head‐noun was used, suggesting processing was sensitive to perceptual animacy. In Experiment 2, we repeated our design with inanimate (rather than animate) NP2s (e.g., “where is the tractor that the car is following”) to investigate whether our online findings were due to increased visual surprisal at an inanimate as agent, or to similarity‐based interference. We again found greater anticipation for an SRC in the inanimate condition, supporting our surprisal hypothesis. Across the experiments, offline measures show that lexical animacy influenced children's interpretation of ORCs, whereas online measures reveal that as RCs unfolded, children were sensitive to the perceptual animacy of lexically inanimate NPs, which was not reflected in the offline data. Overall measures of syntactic comprehension, inhibitory control, and verbal short‐term memory and working memory were not predictive of children's accuracy in RC interpretation, with the exception of a positive correlation with a standardized measure of syntactic comprehension in Experiment 1. Using a contemporary psychological theory of action and of motivation, Richard Brandt's Oxford lectures argue that the purpose of living should be to strive for the greatest good for the largest number of people. I defend the view that a significant ethical distinction can be made between justified killing in self-defense and police use of lethal force. I start by opposing the belief that police use of lethal force is morally justified on the basis of self-defense. Then I demonstrate that the state’s monopoly on the use of force within a given jurisdiction invests police officers with responsibilities that go beyond what morality requires of the average person. I argue that the police should primarily (...) be concerned with preserving public safety. As a consequence, police have additional moral permissions to use lethal force. But this also means that the principle of restraint is inherent to the policing function and therefore police are obliged to go to greater lengths to avoid killing. I concede that the just use of police force can be made difficult in extreme situations such as a mass riot. In such cases, police should take proportionate actions necessary to protect the lives of inhabitants by restoring order, which might include calling on military support. I conclude with a cautionary note opposing militarization of the policing role. (shrink)

Existing discussions of partiality have primarily examined special personal relationships between family, friends, or co-nationals. The negative analogue of such relationships – for example, the relationship of enmity – has, by contrast, been largely neglected. This chapter explores this adverse relation in more detail and considers the special reasons generated by it. We suggest that enmity can involve justified negative partiality, allowing members to give less consideration to each other’s interests. We then consider whether the negative partiality of enmity can (...) be justified through projects or the value inherent in the relationship, following two influential views about the justification of positive partiality. We argue that both accounts of partiality can be conceptually extended to the negative analogue, but doing so brings into focus the problems with such accounts of the grounds of partiality. (shrink)

This paper aims to provide a fresh historical perspective on the debates on vitalism and holism in Germany by analyzing the work of the zoologist Hans Spemann (1869–1941) in the interwar period. Following up previous historical studies, it takes the controversial question about Spemann’s affinity to vitalistic approaches as a starting point. The focus is on Spemann’s holistic research style, and on the shifting meanings of Spemann’s concept of an organizer. It is argued that the organizer concept unfolded multiple layers (...) of meanings (biological, philosophical, and popular) during the 1920s and early 1930s. A detailed analysis of the metaphorical dynamics in Spemann’s writings sheds light on the subtle vitalistic connotations of his experimental work. How Spemann’s work was received by contemporary scientists and philosophers is analyzed briefly, and Spemann’s holism is explored in the broader historical context of the various issues about reductionism and holism and related methodological questions that were so prominently discussed not only in Germany in the 1920s. The conventional view of Just War thinking holds that militaries operate under “special” moral rules in war. Conventional Just War thinking establishes a principled approach to such moral exceptionalism in order to prevent arbitrary or capricious uses of military force. It relies on the notion that soldiers are instruments of the state, which is a view that has been critiqued by the Revisionist movement. The Revisionist critique rightly puts greater emphasis on the moral agency of individual soldiers: they are not (...) mere instruments of the state. Although Revisionism has something particularly important to contribute when applied to cases that are short-of-war, where an individual agent’s moral culpability plays a greater role, soldiers fighting wars are not wholly autonomous moral agents. An Institutionalist approach that responds to Revisionist criticisms is a plausible alternative to the conventional Just War account for grounding the moral exceptionalism of war. For the Institutionalist, soldiers are moral agents with state-imposed obligations whose fundamental responsibility is the performance of the proper moral ends of the military institution they serve. If this is true, then soldiers have a moral obligation to be attentive to the moral corruption of the military institution of which they are a part. (shrink)

Research focusing on Anglo-European languages indicates that children’s acquisition of the subordinate structure of complement-clause constructions and the semantics of mental verbs facilitates their understanding of false belief, and that the two linguistic factors interact. Complement-clause constructions support false-belief development, but only when used with realis mental verbs like ‘think’ in the matrix clause (de Villiers, Jill. 2007. The interface of language and Theory of Mind.Lingua117(11). 1858–1878). In Chinese, however, only the semantics of mental verbs seems to play a facilitative (...) role in false-belief development (Cheung, Him, Hsuan-Chih Chen & William Yeung. 2009. Relations between mental verb and false belief understanding in Cantonese-speaking children.Journal of Experimental Child Psychology104(2). 141–155). We argue that these cross-linguistic differences can be explained by variations in availability and usage patterns of mental verbs and complement-clause constructions across languages. Unlike English, Mandarin-Chinese has a verb that indicates that a belief might be false:yi3wei2‘(falsely) think’. Our corpus analysis suggests that, unlike English caregivers, Mandarin-Chinese caregivers do not produce frequent, potentially unanalyzed, chunks with mental verbs and first-person subjects, such as ‘I think’. In an experiment, we found that the comprehension of complement-clause constructions used withyi3wei2‘(falsely) think’, but not withjue2de2‘think’, predicted Mandarin children’s false-belief understanding between the ages of 4 and 5. In contrast to English, whether mental verbs were used with first- or third-person subjects did not affect their correlation with false-belief understanding. (shrink)

In this dissertation, I defend a Russellian form of descriptivism. The main supporting argument invokes a relation between meaning and thought. I argue that the meanings of sentences are the thoughts people use them to express. This is part of a Gricean outlook on meaning according to which psychological intentionality is prior to, and determinative of, linguistic intentionality. The right approach to thought, I argue in Chapter 1, is a type of functionalism on which thoughts have narrow contents. On this (...) view, the attitude ascriptions of a regimented psychology capture what people really believe and desire. These attitude ascriptions have content clauses that are what David Lewis calls ‘modified Ramsey sentences.’ I then conclude that, since the meanings of sentences are the narrow contents of the thoughts speakers use them to express, the meanings of sentences can also be represented with such descriptive sentences. I extend the view so that it applies to individual words. The resulting view is a form of descriptivism. Referring, I claim in Chapter 2, is the expression of a de re attitude. I argue that the non-psychological, de re individuation of thoughts captures only contingent features of these thoughts. Furthermore, whether a thought counts as de re depends on the attributor’s context. These two characteristics carry over to reference. The referential properties of speech acts and expressions are merely contingent features. Furthermore, whether a speech act or expression counts as referring depends upon the attributor’s context. In Chapter 3, I apply this version of descriptivism to indexicals, demonstratives and names. Indexicals turn out to have non-descriptive, context-insensitive, semantically determined meanings. Demonstratives have descriptive, context-sensitive, pragmatically determined meanings. Names, finally, have descriptive, context-insensitive, semantically determined meanings. In the final chapter, I address Putnam's model-theoretic argument, the most formidable obstacle to the form descriptivism outlined here. I criticize Lewis's ‘magnetist’ solution that invokes primitive naturalness because it is committed to the existence of incorrigible error about the external world. I suggest an empiricist approach on which psychological intentionality, and so ultimately linguistic intentionality as well, is anchored in experience. (shrink)

Brandt (bio) and Lara Freidenfelds (bio)Human subjects research in the United States has only recently emerged as an important area of historical investigation. Over the last quarter century, scholars have begun the process of grounding within an historical context both the complex relationship between researchers and subjects and the processes by which biomedical knowledge is produced. (...) Their studies examine topics ranging from the impact of the anti-vivisectionist movement on human experimentation in the early twentieth century (Lederer 1995) to the development of the discipline of bioethics in the 1960s and 1970s (Rothman 1991) and the emergence of the legal concept of informed consent for human research (Katz, Glass, and Capron 1972). Many of the discussions focus on isolated incidents of scandal, such as the Tuskegee Syphilis Study (Jones 1993; Brandt 1978) and the Willowbrook School hepatitis study (Rothman and Rothman 1984). In doing so, they attempt to explain how such clearly unethical research could have been initiated and what consequences have resulted from public knowledge of such research.Nonetheless, the broader historical contexts and implications of human subjects research have yet to be fully delineated. This project will be of crucial importance, not only for historians, but also for those concerned with research policy and medical ethics. The historical examination of human subjects research will provide further insight into the details of research methods, the construction of protocols, and the historically specific interest in certain diseases. In addition, scholars will better understand the relationships of power and authority between researcher and subject, as well as the social and scientific mechanisms for the production of new biomedical knowledge. The period from 1946 to 1966, however, was a time of vigorous research characterized by a fragmented community of medical researchers who applied inconsistent ethical standards and employed highly variable research practices. Both military and civilian medical researchers were intensely interested in radiation and thus conducted human subjects research along those lines, including examinations of the effects of plutonium injections and of total body irradiation, the use of trace radioisotopes to study various body processes, and observations of the effects of radiation intentionally released into the environment. The U.S. Government sponsored several thousand such studies (ACHRE 1995 [GPO, pp. 227–31; Oxford, pp. 135–38]), some of which were conducted on hospital patients, institutionalized children, military personnel, and prisoners. The development of abstract schemas and productive rules in language is affected by both token and type frequencies. High token frequencies and surface similarities help to discover formal and functional commonalities between utterances and categorize them as instances of the same schema. High type frequencies and diversity help to develop slots in these schemas, which allow the production and comprehension of novel utterances. In the current study we looked at both token and type frequencies in two related constructions in German (...) child-directed speech: simple transitive and complement-clause constructions. Both constructions contain high frequency verbs, which potentially support the development of verb-specific schemas. However, only the frequent verbs in the transitive constructions occur with a variety of subject types, which also supports the development of a slot in the subject position. We then used an elicited production task to compare 4- and 5-year-old German-speaking children's productivity with simple transitive constructions and complement-clause constructions. The children were prompted to change the subjects of high and low frequency simple transitive verbs, such as essen ‘eat’ and naschen ‘nibble’, mental-state complement-taking verbs, such as denken ‘think’ and vermuten ‘presume’, and communication complement-taking verbs, such as sagen ‘say’ and berichten ‘report’. In accordance with earlier findings, children had less difficulty producing new utterances with high frequency transitive verbs than with low frequency transitive verbs. For the other verb classes, however, we found either reverse frequency effects or no frequency effects. For these verb classes, children's productivity can be determined by diversity rather than simple token frequency. We discuss how token frequency interacts with diversity, discourse function, semantic complexity, and syntactic complexity. (shrink)

Sparked by a remarkable result due to Hemaspaandra et al. [9], the voting rule attributed to Charles Dodgson has become one of the most studied voting rules in computational social choice. However, the computer science literature often neglects that Dodgson's rule has some serious shortcomings as a choice procedure. This short note contains four examples revealing Dodgson's deficiencies.

The US-Australia strategic relationship has evolved from more or less an adversarial position in the 19th century to an Australia largely dependent on the US during the Cold War to the interdependent partnership we see today. Strategic interdependence means that the US-Australia relationship is not merely a one-sided affair; that Australia has something of substance to offer the strategic relationship. Part of the reason that the relationship is strong is because of a shared language, similar social values, and compatible political-legal (...) systems. Moreover, the relationship has been thoroughly institutionalised via intelligence cooperation, defence science collaboration, and extensive personal relationships. But what the US really seems to value is Australia’s reliability as an ally. I argue that Australia best demonstrates its reliability as an ally, however, when it follows US strategic decision-making for the right reasons. This sense of reliability is more akin to trustworthiness than it is to loyalty. History demonstrates that Australia has not always agreed with the US. But agreeing doesn’t matter so much when Australia has established a track record of consistently applying sound reasoning to its strategic decisions and it has made substantive contributions to jointly sought after strategic outcomes. I defend a modified rights-based unjust threat account for morally justified killing in self-defense. Rights-based moral justifications for killing in self-defense presume that human beings have a right to defend themselves from unjust threats. An unjust threat account of self-defense says that this right is derived from an agent’s moral obligation to not pose a deadly threat to the defender. The failure to keep this moral obligation creates the moral asymmetry necessary to justify a defender killing the unjust threat in (...) self-defense. I argue that the other rights-based approaches explored here are unfair to the defender because they require her to prove moral fault in the threat. But then I suggest that the unjust threat account should be modified so that where the threat is non-culpable or only partially culpable, the defender should seek to share the cost and risk with the threat in order for both parties to survive. A key factor that affects whether and at what age children can demonstrate an understanding of false belief and complement‐clause constructions is the type of task used (whether it is implicit/indirect or explicit/direct). In the current study, we investigate, in an implicit/indirect way, whether children understand that a story character's belief can be true or false, and whether this understanding affects children's choice of linguistic structure to describe the character's belief or to explain the character's belief‐based action. We also measured (...) children's understanding of false belief in explicit false‐belief tasks. English‐ and German‐speaking young 4‐ and 5‐year‐olds as well as English‐ and German‐speaking adult controls heard complement‐clause constructions in a story context where the belief mentioned in the complement clause (e.g., “He thinks thatshe's not feeling well”) turned out to be false, true, or was left open. After hearing the test question (“Why does he not play with her?”), all age groups were most likely to repeat the whole complement‐clause construction when the belief turned out to be false. That is, they tended to explicitly refer to the character's perspective and say “He thinks…” When the belief turned out to be true, participants often reverted to a simple clause (“She's not feeling well”). Furthermore, children with better short‐term memory were more likely to repeat the whole complement‐clause construction. However, children's performance in explicit false‐belief tasks showed no relation to their performance in our novel, more implicit/indirect, task. Whether or not the complement clause was introduced by athatcomplementizer only had a small effect on the German adults’ responses, where leaving out the complementizer also changes the word order of the complement clause. Overall, our results suggest that task characteristics and individual differences in short‐term memory affect children's ability to demonstrate false‐belief understanding and to express this understanding linguistically. Themes of Christian martyrdom were central to popular political mobilization in El Salvador, as in much of Latin America, during the 1970s and 1980s. The story of Christ's sacrifice provided a powerful narrative for explaining injustice and political violence, a frame for interpretation as well as action during the twelve-year Salvadoran civil war, which ended in 1992 by a negotiated settlement. In the first part of this article we trace the politics of martyrdom and sacrifice through the war. The final (...) sections of the article examine the place of narratives of martyrdom and sacrifice in post-civil war El Salvador. While most Salvadorans today continue to experience high levels of inequality, poverty, and violence, the narratives of martyrdom and sacrifice that animated the revolutionary movements and liberation theology of the 1980s have lost much of their resonance. We suggest that the dispersion of both the perceived sources of, and the imagined solutions to, injustice contribute to the diminution in the importance of Christian narratives of martyrdom and sacrifice in El Salvador today. The so-called geek-culture becomes increasingly more mainstream, and its social and economic impact is growing. In contrast, there is very little quantitative psychological research on this subculture and the people immersed in it. The aim of this study was to investigate whether there are differences in the Big Five personality factors between Dungeons & Dragons players and non-players. Within a sample of 801 individuals – 399 Dungeons & Dragon players and 402 non-players - the results indicated that Dungeons & Dragons (...) players show statistically significant higher scores in extraversion as well as in openness to new experiences. Furthermore, we found a statistically significant correlation between Dungeons & Dragons players’ scores in extraversion and their character’s charisma. The results are in line with more recent findings from Big Five research in the geek-culture and contradict older findings regarding a low extraversion and high neuroticism of Dungeons & Dragon players. In 1891 Thέodore Flournoy became the first Professor of Psychology to be appointed at the University of Geneva, and his teaching regularly included references to religion. His successor, Georges Berguer, who taught psychology of religion, began as privat-docent in 1910 and received a full professorship in Religious Psychology and the History of Religion in 1928. French-speaking Switzerland is one of the rare places in the world where psychology of religion has been taught continuously since the very beginning of the 20th (...) century. The aim of this article is to shed light on this tradition and especially on Georges Berguer and Edmond Rochedieu who succeeded Flournoy. This historical enterprise concludes with some reflections on the role of the psychology of religion at the intersection of psychology and the study of religions. (shrink)

Professor Card is not disposed to object to the main argument of my paper, which was intended to reply to Professor Lyons’ suggestion that a utilitarian cannot explain how legal rights have moral force, and at the same time to urge that the particular form of utilitarianism espoused by Professor Hare in his recent work does seem to be open to the difficulty Professor Lyons alleges. Professor Card says she is ‘not dissatisfied’ with this reasoning. I suspect that Card views (...) my criticism of Professors Lyons and Hare as part of an in-house squabble among philosophers all of whom have utilitarian leanings of one sort or another; and she is not disposed to intervene in this. She does, however, have serious reservations about utilitarian views of rights in general, and about mine in particular; her paper consists almost entirely of her statement of these reservations. I find her remarks very welcome, since they express some objections which may be widely felt, and a response to which may therefore contribute to philosophers’ thinking about these issues. (shrink)
