This paper concerns what Jerry Fodor calls a 'metaphysical mystery': How can there by macroregularities that are realized by wildly heterogeneous lower level mechanisms? But the answer to this question is not as mysterious as many, including Jaegwon Kim, Ned Block, and Jerry Fodor might think. The multiple realizability of the properties of the special sciences such as psychology is best understood as a kind of universality, where 'universality' is used in the technical sense one finds in the (...) physics literature. It is argued that the same explanatory strategy used by physicists to provide understanding of universal behavior in physics can be used to explain how special science properties can be heterogeneously multiply realized. In this paper I criticize Cartwright's analysis of capacities and offer an alternative analysis. I argue that Cartwright's attempt to connect capacities to her condition CC fails because individuals can exercise capacities only in certain contexts. My own analysis emphasizes three features of capacities: 1) Capacities belong to individuals; 2) Capacities are typically not metaphysically fundamental properties of individuals, but can be explained by referring to structural properties of individuals; and 3) Laws are best understood as ascriptions of capacities.

La théorie esthétique de Kant n'est plausible que si nous rejetons l'affirmation répandue selon laquelle cette exigence est normative. The article is devoted to historico-philosophical investigation of the grounds of universalism of special type. This universalism, inherent in transcendental thinking, was radicalized in quasi-transcendental discourse of Jacques Derrida. It is established that explicit critique of universalism in deconstructive philosophy is aimed at “logo-centric” paradigm of universality which is questioned by (quasi)transcendental philosophy. Constitutive function of difference and otherness in establishment of transcendental and especially quasi-transcendental universality was brought to light. It was shown that in (quasi)transcendental discourse singularity (...) is involved into the sphere of universal, whereas “dogmatic” universalism brought singularity and/or particularity outside, thus questioning its own claims. Tracing transcendentalist tendency to balance status and significance of universal and particular (singular), the author concludes that relation between them makes possible constituting hyper-universality of special type. Universal implications of the Derrida’s notion “quasi-transcendental” are defined. It was determined that one of the main factors constituting universalism of quasi-transcendental type is the deconstruction of binary thinking, accomplished first of all with the help of principles: differance, insolvability (aporia) and trace. Among them insolvability implies universality revealing the overlap and mutual conditioning of alternative (at a glance) elements. Instead, the trace conditions superiority of logo-centric alternatives “primary-secondary” and “presence-absence”. (shrink)

I argue for the thesis (UL) that there are certain logical abilities that any rational creature must have. Opposition to UL comes from naturalized epistemologists who hold that it is a purely empirical question which logical abilities a rational creature has. I provide arguments that any creatures meeting certain conditions—plausible necessary conditions on rationality—must have certain specific logical concepts and be able to use them in certain specific ways. For example, I argue that any creature able to grasp theories must (...) have a concept of conjunction subject to the usual introduction and elimination rules. I also deal with disjunction, conditionality and negation. Finally, I put UL to work in showing how it could be used to define a notion of logical obviousness that would be well suited to certain contexts—e.g. radical translation and epistemic logic—in which a concept of obviousness is often invoked. A physically consistent semi-classical treatment of black holes requires universality arguments to deal with the `trans-Planckian' problem where quantum spacetime effects appear to be amplified such that they undermine the entire semi-classical modelling framework. We evaluate three families of such arguments in comparison with Wilsonian renormalization group universality arguments found in the context of condensed matter physics. Our analysis is framed by the crucial distinction between robustness and universality. Particular emphasis is placed on the quality whereby the (...) various arguments are underpinned by `integrated' notions of robustness and universality. Whereas the principal strength of Wilsonian universality arguments can be understood in terms of the presence of such integration, the principal weakness of all three universality arguments for Hawking radiation is its absence. The work reported in this monograph was begun in the winter of 1967 in a graduate seminar at Berkeley. Many of the basic data were gathered by members of the seminar and the theoretical framework presented here was initially developed in the context of the seminar discussions. Much has been discovered since1969, the date of original publication, regarding the psychophysical and neurophysical determinants of universal, cross-linguistic constraints on the shape of basic color lexicons, and something, albeit less, can now also (...) be said with some confidence regarding the constraining effects of these language-independent processes of color perception and conceptualization on the direction of evolution of basic color term lexicons. Studies in several developing countries for treatmen to prevent HIV-transmission from mother to child generated considerable controversy in 1997. Critics of the studies argued that basic principles of research ethics were violated. According to the critics, researchers subjected women in developing countries to studies that would have been unethical in the United States and that the researchers were therefore engaged in unethical exploitation ofcitizens of the developing countries in which the studies were conducted.While the critics agreed that unethical exploitation had (...) occurred, they differed on the exact nature of the exploitation. Some observers condemned the researchers for employing a double standard — because the researchers were applying a standard of care that would have been unacceptable in their own country. In the view of these critics, researchers should have been comparing the experimental treatment to established therapy rather than to placebo, as would have been required in the United States or other developed countries. Often, a more or less universal quality is attributed to certain legal concepts. For refugee scholars working between 1933 and 1945, the universal quality of these concepts was challenged on two fronts: first, the breaking down of the Weimar Constitution and the German Rechtsstaat under Nazi rule demonstrated the fragility of a constitutional and legal order. Moreover, the breakdown of the German Rechtsstaat was felt on a deeper conceptual level. ‘Immutable’ legal concepts turned out to be easily mutated to conform (...) to Nazi ideology. The second major challenge to the universality of concepts thus pertains to the universal characteristics of the ‘concept of a concept’ itself. In brief, what German refugee legal scholars attempted to create in the course of the 1930s and 1940s was a ‘universal’ Rechtsstaat centred around concepts and legal scholarship that would avoid the breakdown by placing it into a feasible and balanced system of legal enforcement on an international level. Thus, in their new academic context, rather than dismissing the Rechtsstaatliche function of legal concepts and the role of legal scholars, refugee scholarship ventured to enhance it. This contribution argues that the development of Hersch Lauterpacht’s concept of human rights constitutes such an enhancement. (shrink)

This article offers a decolonial methodology that questions the universality tied to the concept of gender. While not questioning that the modern/colonial capitalist gender system is an oppressive, variable, systemic organization of power, it argues that it is not universal; that is, that not all peoples organize their relations in terms of and on the grounds of gender. Its aim is to offer a decolonial methodology to both study colonized people who live at the colonial difference, but also to (...) engage in decolonial coalition. To see the colonial difference is to see coloniality/modernity as the place the colonized inhabit and the situation of oppression from which the colonized create meanings that are not assimilated. One can often encounter claims that classical (Kolmogorovian) probability theory cannot handle, or even is contradicted by, certain empirical findings or substantive theories. This note joins several previous attempts to explain that these claims are unjustified, illustrating this on the issues of (non)existence of joint distributions, probabilities of ordered events, and additivity of probabilities. The specific focus of this note is on showing that the mistakes underlying these claims can be precluded by labeling all random variables involved contextually. Moreover, contextual (...) labeling also enables a valuable additional way of analyzing probabilistic aspects of empirical situations: determining whether the random variables involved form a contextual system, in the sense generalized from quantum mechanics. Thus, to the extent the Wang-Busemeyer QQ equality for the question order effect holds, the system describing them is noncontextual. The double-slit experiment and its behavioral analogues also turn out to form a noncontextual system, having the same probabilistic format (cyclic system of rank 4) as the one describing spins of two entangled electrons. It is commonly claimed that the universality of critical phenomena is explained through particular applications of the renormalization group. This article has three aims: to clarify the structure of the explanation of universality, to discuss the physics of such RG explanations, and to examine the extent to which universality is thus explained. The derivation of critical exponents proceeds via a real-space or a field-theoretic approach to the RG. Building on work by Mainwood, this article argues that these (...) approaches ought to be distinguished: while the field-theoretic approach explains universality, the real-space approach fails to provide an adequate explanation. The concepts of the innateness, universality, species-specificity, and autonomy of the human language capacity have had an extreme impact on the psycholinguistic debate for over thirty years. These concepts are evaluated from several neurobiological perspectives, with an emphasis on the emergence of language and its decay due to brain lesion and progressive brain disease.Evidence of perceptuomotor homologies and preadaptations for human language in nonhuman primates suggests a gradual emergence of language during hominid evolution. Regarding ontogeny, the innate component of (...) language capacity is likely to be polygenic and shared with other developmental domains. Dissociations between verbal and nonverbal development are probably rooted in the perceptuomotor specializations of neural substrates rather than the autonomy of a grammar module. Aphasiologicaldata often assumed to suggest modular linguistic subsystems can be accounted for in terms of a neurofunctional model incorporating perceptuomotor-based regional specializationsand distributivity of representations. Thus, dissociations between grammatical functors and content words are due to different conditions of acquisition and resulting differences in neural representation. Human brains are characterized by multifactorial interindividual variability, and strict universality of functional organization is biologically unrealistic.A theoretical alternative is proposed according to which (1) linguistic specialization of brain areas is due to epigenetic and probabilistic maturational events, not to genetic ”hard-wiring,” and (2) linguistic knowledge is neurally represented in distributed cell assemblies whose topography reflects the perceptuomotor modalities involved in the acquisition and use of a given item of knowledge. The contribution tackles the analytical and hermeneutic problem, implied in today's notion of the 17-century “Scientific Revolution”, which comes to the front in trying to come to grips with the notion of European science, its discovery in Antiquity and its history in Middle Ages and Modern Age. We shall try to argue that, in its core, this revolution implies a notional revolution. The contribution investigates the function the of notions of “theory”, “doctrine” and “system”, which are constitutive for the formation (...) of science, each in itself being correlative to a specific type of scientific units attributed to the classical-Greek , Christian-Mediaeval , and modern notion of science . Pondering on the topic of these notions and their shifts in the Modern Age is the key towards a new understanding of the history of science, extending beyond the borders of the existing conceptions as based on natural sciences. Philosophers disagree whether composition as identity entails mereological universalism. Bricker :264–294, 2016) has recently considered an argument which concludes that composition as identity supports universalism. The key step in this argument is the thesis that any objects are identical to some object, which Bricker justifies with the principle of the universality of identity. I will spell out this principle in more detail and argue that it has an unexpected consequence. If the universality of identity holds, then composition as (...) identity not only leads us to universalism, but also leads to the view that there are no mereological atoms. (shrink)

ABSTRACT This essay focuses on two underlying presumptions that impinge on the effort of UNESCO to engender universal agreement on a set of bioethical norms: the conception of universality that pervades much of the document, and its disregard of structural inequalities that significantly impact health. Drawing on other UN system documents and recent feminist bioethics scholarship, we argue that the formulation of universal principles should not rely solely on shared ethical values, as the draft document affirms, but also on (...) differences in ethical values that obtain across cultures. UNESCO's earlier work on gender mainstreaming illustrates the necessity of thinking from multiple perspectives in generating universal norms. The declaration asserts the ‘fundamental equality of all human beings in dignity and rights’1 and insists that ‘the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition’2 yet it does not explicitly recognize disparities of power and wealth that deny equal dignity and rights to many. Without attention to structural (as opposed to merely accidental) inequities, UNESCO's invocation of rights is so abstract as to be incompatible with its avowed intention. (shrink)

French existentialism is commonly regarded as the main impetus for the universal significance that Kafka gained in postwar France. A leading critic, Marthe Robert, has contended that this entailed an outright rejection of interest in the biographical, linguistic and historical dimension of Kafka's writing in order to interpret it as a general expression of the human condition. This article will consider this claim in the light of Sartre's original conceptualization of a dialectic of the universal and the particular in the (...) intercultural mediation of the work of art. The notion of a 'true universality' proposed by Sartre as a defence of Kafka during the 1962 Moscow Peace Conference will allow for a reassessment of Robert's criticism in a paradoxical reversal of terms: it is precisely the inevitable loss of context and the appropriation within one's own particular situation which allow the literary work to elucidate a foreign historical context and thereby gain a wider significance. Rather than a universal meaning of the work, Sartre's concept points to literature's potential to continually release specific meanings in new contexts. (shrink)

A new set of “Sustainable Development Goals” are currently being negotiated at the United Nations, and there is a widespread consensus that these goals must be “universal.” This article analyses what universality might mean in this context, and its normative significance as a guiding principle for the goals. After briefly introducing the Sustainable Development Goals as found in the current stage of the negotiations, thearticle proceeds in three sections that consider three different senses of universality. In the first, (...) I outline the most intuitive or straightforward sense of universality as a claim about the scope of the goals, with limited import for the content. In the second section, I expand on this idea by noting a widespread understanding of the content of the goals which might also be thought universal and which reflects a moral cosmopolitan constraint on the ambition of each goal. Universality is paired with, and contrasted against, the need fordifferentiation. In the final section, I examine this idea of differentiation, asking how and how far, the goals should allow for country context. From this discussion arises a third account of universality which incorporates a demand for fair burden-sharing. I consider, and ultimately caution against, this account of universality, even though the demand forfairness is crucial in its own right. (shrink)
