French existentialism is commonly regarded as the main impetus for the universal significance that Kafka gained in postwar France. A leading critic, Marthe Robert, has contended that this entailed an outright rejection of interest in the biographical, linguistic and historical dimension of Kafka's writing in order to interpret it as a general expression of the human condition. This article will consider this claim in the light of Sartre's original conceptualization of a dialectic of the universal and the particular in the (...) intercultural mediation of the work of art. The notion of a 'true universality' proposed by Sartre as a defence of Kafka during the 1962 Moscow Peace Conference will allow for a reassessment of Robert's criticism in a paradoxical reversal of terms: it is precisely the inevitable loss of context and the appropriation within one's own particular situation which allow the literary work to elucidate a foreign historical context and thereby gain a wider significance. Rather than a universal meaning of the work, Sartre's concept points to literature's potential to continually release specific meanings in new contexts. (shrink)

In 1943, Jean-Paul Sartre published several important articles of literary criticism on Blanchot, Camus and Bataille. In addition to propounding his own literary views, these articles functioned as a means of marking out his own version of existentialism, which risked being conflated with the Camusian absurd. Whereas Camus, according to Sartre, advocated a detached attitude in the face of the meaninglessness of existence, Sartre maintained that the subject cannot withdraw from the situation and that existence is ultimately meaningful. One author (...) in particular, Franz Kafka, acts as the figurative ‘prism’ through which Sartre challenges rival versions of existential thinking. He does so by introducing the concept of le fantastique on account of Kafka’s work. In so doing, Sartre not only rebutted the dominant interpretation, according to which Kafka was an absurd author, but also uncovered a historical critique implicit in the Prague author’s work. The comic book hero Superman grew from a social crusader and a “champion of the oppressed” in the 1930s, to a patriotic and paternalistic fighter for “Truth, Justice, and the American way” in the 1940s and 1950s, to a compassionate Christ‐like savior in the latter part of the twentieth century – and always defending the Judeo‐Christian values upheld by the American majority. Friedrich Nietzsche’s “superman,” on the other hand, firmly rejects the very same values its superhero namesake upholds. While it (...) has been a common trope in the superhero genre and popular culture in general to characterize figures explicitly based on Nietzsche’s Übermensch as inhuman monsters, this chapter argues that Nietzsche’s concept can be reinstated through the character of Superman himself. Like Übermensch, Superman is strong, creative, noble, independent, and life‐affirming, but unlike him, Superman is compassionate and looks out for the little guy. (shrink)

ABSTRACTThe principle of informed refusal poses a specific problem when it is invoked by a pregnant woman who, in spite of having accepted her pregnancy, refuses the diagnostic and/or therapeutic measures that would ensure the well‐being of her endangered fetus. Guidelines issued by professional bodies in the developed world are conflicting: either they allow autonomy and informed consent to be overruled to the benefit of the fetus, or they recommend the full respect of these principles. A number of medical ethicists (...) advocate the overruling of alleged irrational or unreasonable refusal for the benefit of the fetus. The present essay supports the view of fetal rights to health and to life based on the principle that an ‘accepted’ fetus is a ‘third person’. In developing countries, however, the implementation of the latter principle is likely to be in conflict with a ‘communitarian’ perception of the individual – in this case, the pregnant woman. Within the scope of the limitations to the right to autonomy of J.S. Mill's ‘harm principle’, the South African Patients’ Charter makes provision for informed refusal. The fact that, in practice, it is not implemented illustrates the well‐known difficulty of applying Western bioethical principles in real life in the developing world. (shrink)

The French medical context is characterized by institutionalization of the ethical reflection in health care facilities and an important disparity between spaces of ethical reflection. In theory, the healthcare professional may mobilise an arsenal of resources to help him in his ethical reflection. But what happens in practice? We conducted semi-structured interviews with 22 health-care professionals who did and did not have recourse to clinical ethical committees. We also implemented two focus groups with 18 professionals involved in various spaces of (...) ethical reflection in order to let them debate about a better way to organize ethical reflection in their institutional contexts. The qualitative analysis allows to us to underline the coexistence of different conceptions of ethics among health care professionals. We also observed that the participants in our study shared the experience of ethically problematic situations as roadblocks in the process of communication and decision-making. We therefore report the factors which favour or inhibit the ethical course leading to the resolution or at the very least soothing of the situation at hand. Finally, we discuss methodological issues and underline the fact that while the patient is at the heart of the professional’s ethical preoccupations, this does not imply that they are actors in decisions that concern them. Habitat fragmentation produces isolated patches characterized by increased edge effects from an originally continuous habitat. The shapes of these patches often show a high degree of irregularity: their shapes deviate significantly from regular geometrical shapes such as rectangular and elliptical ones. In fractal theory, the geometry of patches created by a common landscape transformation process should be statistically similar, i.e. their fractal dimensions and their form factors should be equal. In this paper, we analyze 49 woodlot fragments (Pinus sylvestris L.) (...) in the Belgian Kempen region to study the direct relationship between a transformation process and the concomitant patch geometry. Although the fractal dimension of the woodlots is scattered (i.e. they are not statistically similar), the perimeter-area relation of the fragments is characterized by a single, ‘dimension-like’ exponent. This exponent suggests a certain shape homogeneity among the patches, which is confirmed by the absence of hierarchical levels associated with sharp increases of the fractal dimension at scale transitions. The interaction of different natural (soil factor, vegetation type) and anthropogenic (afforestation, urbanization) processes during patch development is assumed to have generated this feature. Comparison of the area and perimeter fractal dimension with an ecological index for habitat quality, the interior-to-edge ratio, shows that the fractal dimension is suitable for predicting interior habitat presence, which is more likely for patches with smooth perimeters and compact areas. The ratio of the area to the perimeter fractal dimension confirms this observation, with high values for high interior-to-edge ratios, characteristic for regularly shaped patches. (shrink)

From a theoretical perspective, most discussions of statistical learning have focused on the possible “statistical” properties that are the object of learning. Much less attention has been given to defining what “learning” is in the context of “statistical learning.” One major difficulty is that SL research has been monitoring participants’ performance in laboratory settings with a strikingly narrow set of tasks, where learning is typically assessed offline, through a set of two-alternative-forced-choice questions, which follow a brief visual or auditory familiarization (...) stream. Is that all there is to characterizing SL abilities? Here we adopt a novel perspective for investigating the processing of regularities in the visual modality. By tracking online performance in a self-paced SL paradigm, we focus on the trajectory of learning. In a set of three experiments we show that this paradigm provides a reliable and valid signature of SL performance, and it offers important insights for understanding how statistical regularities are perceived and assimilated in the visual modality. This demonstrates the promise of integrating different operational measures to our theory of SL. (shrink)

This study was conducted to determine how culture influences the ethical perception of managers. Most studies conducted so far have only stated similarities and differences in ethical perception between cultural or ethnic groups and little attention has been paid towards understanding how cultural values influence the ethnic groups' ethical perception. Moreover, most empirical research in this area has focused on moral judgement, moral decision making and action, with limited empirical work in the area of ethical perception. A total of 22 (...) interviews were conducted and the questionnaire survey yielded 272 managerial responses. Three implications were obtained based on the findings of the study. The first implication is that differences in ethical perception can exist when one culture attributes moral significance to something that another culture does not. The results of the study also suggest that similarities in ethical perception can occur when a situation is viewed as an accepted and institutionalised part of doing business. Finally, the findings of the study also show that the influence of culture on ethical perception varied according to the different types of scenarios. (shrink)

This article deals with the concept of sentience, and more specifically with the argument from sentience as it is used by utilitarians in the abortion debate and in the advocacy of animal rights. It is argued that sentience is more than feeling pleasure and pain (with empha sis on pain), and that pain is an inborn protection required to fit into the world rather than the substance of evil. S. The reality factor, however, is that five years later there are still more ‘technically illegal’ abortions than legal ones. Amongst other factors, one of the main obstacles to access to this constitutionally enshrined human right is the right to conscientious objection/refusal. Although the right to conscientious objection is also a basic human right, the case of refusal to provide abortion (...) services on conscientious objection grounds should not be seen as absolute and inalienable, at least in the developing world. In the developed world, where referral to another service provider is for the most part accessible, a conscientious objector to abortion does not really put the abortion seeker’s life at risk. The same cannot be said in developing countries even when abortion is decriminalised. This is because referral procedures are fraught with major obstacles. The target article by Locke & Bogin (L&B) focuses on the evolution of language as a communicative tool. They neglect, however, that from infancy onwards humans have the ability to go beyond successful behaviour and to reflect upon language (and other domains of knowledge) as a problem space in its own right. This ability is not found in other species and may well be what makes humans unique.

English summary: Until well into the 18th century, the concept of the soul played a major role in the scientific, religious, aesthetic and metaphysical discussion of humanity representing the highest level of existence. In modernity, this concept of the soul has lost its significance. It seems to have been replaced by terms such as subjectivity, personality and individuality. At the same time a symbolic added value which deifies clear description appears to have attached itself to the definition of the soul. (...)
