En matière de criminalité, le Japon fait figure d’exception. La population incarcérée y diminue en moyenne de 3,6 % par an et le taux de criminalité est en baisse depuis 2007. La densité d’incarcération dans les prisons japonaises n’est que de 74 % contre 120 % en France en avril 2017. Le Japon partage l’appareil démocratique et le développement économique des pays occidentaux mais se distingue par son éloignement géographique et culturel. Or les sciences criminologiques étudiant la philosophie d’un pays (...) et ses traditions idéologiques sont fondamentales dans la réflexion sur la criminalité. Elles témoignent du fait que le crime est autant influencé par le droit, l’histoire et l’économie d’un pays, que par l’ancrage culturel d’une civilisation qui possède ses propres schèmes mentaux et comportementaux. Argumentation schemes can be described as abstract structures representing the most generic types of argument, constituting the building blocks of the ones used in everyday reasoning. This paper investigates the structure, classification, and uses of such schemes. Three goals are pursued: 1) to describe the schemes, showing how they evolved and how they have been classified in the traditional and the modern theories; 2) to propose a method for classifying them based on ancient and modern developments; and 3) to outline (...) and show how schemes can be used to describe and analyze or produce real arguments. To this purpose, we will build on the traditional distinctions for building a dichotomic classification of schemes, and we will advance a modular approach to argument analysis, in which different argumentation schemes are combined together in order to represent each step of reasoning on which a complex argument relies. Finally, we will show how schemes are applied to formal systems, focusing on their applications to Artificial Intelligence, AI & Law, argument mining, and formal ontologies. (shrink)

Mathematics appears to play a genuine explanatory role in science. But how do mathematical explanations work? Recently, a counterfactual approach to mathematical explanation has been suggested. I argue that such a view fails to differentiate the explanatory uses of mathematics within science from the non-explanatory uses. I go on to offer a solution to this problem by combining elements of the counterfactual theory of explanation with elements of a unification theory of explanation. The result is a theory according to which (...) a counterfactual is explanatory when it is an instance of a generalized counterfactual scheme. (shrink)

The paper develops a classificatory system of basic argument types on the basis of the epis-temological approach to argumentation. This approach has provided strict rules for several kinds of argu-ments. These kinds may be brought into a system of basic irreducible types, which rely on different parts of epistemology: deductive logic, probability theory, utility theory. The system reduces a huge mass of differ-ent argument schemes to basic types and gives them an epistemological foundation.

The current discussions of conceptual schemes and related topics are misguided; for they are based on a tacit assumption that the difference between two schemes consists in the different distributions in truth-values. I argue that what should concern us, in the discussions of conceptual schemes and related issues, is not truth-values of assertions, but rather the truth-value-status of the sentences used to make the assertions. This is because the genuine conceptual innovation between alternative theories or languages does not lie in (...) differences in determining truth-values of their sentences, but turns on whether these sentences have truth-values when considered within the context of a competing one. This new interpretation of the notion of conceptual schemes, which I refer to as presuppositional languages, is not only good in itself—for establishing the intelligibility and tenability of the notion—but quite beneficial in its effect on other related issues. This paper demonstrates how argumentation schemes can be used in decision support systems that help clinicians in making treatment decisions. The work builds on the use of computational argumentation, a rigorous approach to reasoning with complex data that places strong emphasis on being able to justify and explain the decisions that are recommended. The main contribution of the paper is to present a novel set of specialised argumentation schemes that can be used in the context of a clinical decision support (...) system to assist in reasoning about what treatments to offer. These schemes provide a mechanism for capturing clinical reasoning in such a way that it can be handled by the formal reasoning mechanisms of formal argumentation. The paper describes how the integration between argumentation schemes and formal argumentation may be carried out, sketches how this is achieved by an implementation that we have created and illustrates the overall process on a small set of case studies. I draw attention to how one of Donald Davidson’s arguments against the claim that others have an alternative conceptual scheme does not look compatible with his rejection of analytic truths – how his rejection of the third dogma of empiricism depends on accepting the first. The appendix contests Davidson’s approach to organizing the Pacific Ocean.

Douglas Walton’s multitudinous contributions to the study of argumentation seldom, if ever, directly engage with argumentation in mathematics. Nonetheless, several of the innovations with which he is most closely associated lend themselves to improving our understanding of mathematical arguments. I concentrate on two such innovations: dialogue types (§1) and argumentation schemes (§2). I argue that both devices are much more applicable to mathematical reasoning than may be commonly supposed.

According to the argument scheme approach, to evaluate a given scheme-saturating instance completely does entail asking all critical questions relevant to it. Although this is a central task for argumentation theorists, the field currently lacks a method for providing a complete argument evaluation. Approaching this task at the meta-level, we combine a logical with a substantive approach to the argument schemes by starting from Toulmin’s schema: ‘data, warrant, so claim’. For the yet more general schema: ‘premise; if premise, then conclusion; (...) so conclusion’, we forward a meta-level CQ-list that is arguably both complete and applicable. This list should inform ongoing theoretical efforts at generating appropriate object-level CQs for specific argument schemes. (shrink)

At the end of the 19th century, most professional historians – wherever they existed – deemed history to be a form of knowledge ruled by a method that bears no resemblance with those most commonly traceable in the natural sciences. The bulk of the historian’s task was then frequently regarded as being the application of procedures frequently referred to as ‘historical method’. In the context of such an emerging interest on historical methods and methodology, at least three textbooks stand out: (...) Johann Gustav Droysen’s Grundriss der Historik (Outline of the Theory of History), Ernst Bernheim’s Lehrbuch der historischen Methode (Handbook of Historical Method), and Charles Langlois and Charles Seignobos’s Introduction aux études historiques (Introduction to the Study of History). These books were quite influential in Germany, France, and elsewhere, and they very much helped promote a general idea of historical method that would become relatively consensual among historians of many nationalities by the early 20th century. Such a relative agreement on historical method sponsored both the communication and the development of a sense of disciplinary identity among historians trained within different and sometimes conflicting national traditions. It was then partially extended, partially challenged, and surely made more complex when, from the 1920s on, social and economic historians became a good part of the historiographical establishment in many countries. -/- The three books by Droysen, Bernheim, and Langlois and Seignobos were already pieced together by Rolf Torstendahl, who studied them as a group of texts that, despite their differences, contributed to shape the developments outlined above. However, Torstendahl’s primary aim was to show how Droysen, Bernheim, and Seignobos all resorted to ‘method’ as a way to circumvent skepticism against the possibility of historical knowledge, rather than investigate the internal interrelationships between the three texts. In this chapter I follow precisely this latter, not yet taken, road, focusing on crucial cross-references between the Grundriss, the Lehrbuch, and the Introduction. I intend to show that, at a general level, the schemes of historical method found in these texts are largely convergent, and that this convergence is due to Bernheim’s reading of Droysen and to Langlois and Seignobos’s reading of Bernheim. I will attempt to do it through a regressive approach that starts with an analysis of the Introduction. Aspects of the editorial history and circulation of the three texts will also be briefly addressed, as a way to illustrate their special importance within the framework of early 20th century historical theory. Because my argument calls for a focus on the most general lines of Droysen’s, Bernheim’s, and Langlois and Seignobos’s schemes of historical method, I will, for the sake of consistency, refrain from analysing in-depth the complex epistemological and ontological arguments in which those schemes are nested. Commentaires sur l'interprétation de la phénoménologie chez N. Kaufmann qui préconise une approche que j'ai appelée la lecture frégéenne de la phénoménologie. Je commente brièvement quelques-uns des problèmes liés à cette approche. J'examinerai ensuite le postulat de base de cette approche de la phénoménologie qui consiste à voir dans la théorie husserlienne de l'intentionnalité la tentative d'articuler le concept de directionalité emprunté de Brentano sur la théorie de la signification de Frege. Cette question fait l'objet de la deuxième et de (...) la troisième section où j'examine la thèse suivant laquelle la théorie de la signification de Frege aurait rendu possible à la fois de résoudre les difficultés inhérentes à la conception immanentiste de l'intentionnalité de Brentano, et d'élaborer une théorie relationnelle de l'intentionnalité. Dans la quatrième section, je pose la question de savoir comment et à quelles conditions cette théorie de l'intentionnalité pourrait nous être utile devant les problèmes auxquels nous faisons face actuellement dans la philosophie de l'esprit. Dans la dernière section, j'énumère quelques traits caractéristiques de l'analyse intentionnelle et évalue sa pertinence dans le domaine des phénomènes mentaux et de l'action. Wittgenstein, selon R. Rorty, accepte dans ses Recherches philosophiques une variété d' « antireprésentationnalisme » en ce sens qu 'il refuse la distinction entre certaines représentations envers lesquelles on devrait adopter une attitude réaliste et d'autres envers lesquelles il faudrait adopter une attitude non réaliste . Je soutiens dans cet article que le contraire est vrai. Wittgenstein adhère en particulier à une forme de non-réalisme quant au concept de signification et certains concepts d'états et de processus mentaux. L'expression « (...) la signification de M » n 'a pas selon lui une fonction reférentielle . Une expression du vocabulaire mental telle que « savoir réciter l'alphabet» ne désigne pas un état interne de l'individu sachant réciter l'alphabet. « Savoir réciter l'alphabet » et « la signification de M » ne sont pas des expressions employées pour « parler de » quelque chose ou s'y référer.R. Rorty daims that Wittgenstein agrees in the Philosophical Investigations with "antirepresentationalism " in that he rejects the distinction between representations toward which we should have a realist attitude and those toward which we should have the opposite, nonrealist, attitude. The aim of this paper is to show that this reading is incorrect. Wittgenstein accepts antirealist views in particular with respect to meaning and some mentalconcepts. The expression "the meaning of W", he holds, is not a referential expression . Expressions from our mental vocabulary such as "knowing the ABC" do not refer to internal states . "The meaning of W" and "knowing the ABC" are not expressions used to refer to or "talk about" anything. (shrink)

Is it possible to distinguish communities of arguers by tracking the argumentation schemes they employ? There are many ways of relating schemes to communities, but not all are productive. Attention must be paid not only to the admissibility of schemes within a community of argumentational practice, but also to their comparative frequency. Two examples are discussed: informal mathematics, a convenient source of well-documented argumentational practice, and anthropological evidence of nonstandard reasoning.

J’explore de façon critique la supposition du DSM[1] et de théoriciens tels que Wakefield et Gert selon laquelle les troubles mentaux doivent être attribués à un individu plutôt qu’à un groupe de personnes. Cette supposition est particulièrement problématique en pédopsychiatrie où le système familial est très souvent au centre de l’attention clinique. Il y a bien sûr des éléments de preuve substantiels indiquant que certains troubles mentaux des individus sont causés par leurs relations avec les autres et que (...) leur guérison est grandement facilitée en traitant le groupe, tel que la famille, comme un tout. Malgré cela, il y a eu beaucoup moins de travail conceptuel visant à définir ce que cela pourrait être pour un couple, une famille ou un autre groupe que de se voir attribuer un trouble mental. Pour traiter de cette question, j’utilise un débat entre Wakefield et Murphy et Woolfolk sur la question de savoir s’il fait partie du concept de trouble mental que celui-ci soit causé par une dysfonction interne de la personne. Je discute aussi de la proposition faite par Bolton d’abandonner complètement le concept de trouble mental et d’utiliser plutôt le concept, plus large, de problème de santé mentale. Je soutiens qu’en fin de compte le caractère individuel des troubles mentaux ne constitue pas une vérité conceptuelle a priori, et qu’il faut faire intervenir des considérations pragmatiques pour décider s’il est utile de nous limiter à une telle définition ou si nous pourrions être mieux servis par une définition plus extensive. Je fais le lien avec le pragmatisme et je soutiens qu’une approche pluraliste non réductive est particulièrement appropriée en pédopsychiatrie.I critically explore the assumption of the DSM and theorists such as Wakefield and Gert that mental disorder must be attributed to an individual rather than a group of people. This assumption is especially problematic in child and adolescent psychiatry where very often the focus of clinical attention is the family system. There is of course substantial evidence that some mental disorders of individuals are caused by their relationships with other people and that their recovery is greatly facilitated by treating the group, such as a family, as a whole. However, there has been much less conceptual work on defining what it might be for a couple, family or other group to itself be attributed a mental disorder. To address this issue, I employ a debate between Wakefield , Murphy and Woolfolk on whether it is part of the concept of a mental disorder that it is caused by an internal malfunction of a person. I also discuss the proposal of Bolton that we do away with the concept of mental disorder altogether and instead use a broader concept of mental health problem. I argue that ultimately it is not an a priori conceptual truth that mental disorders are individual, and we need to bring in pragmatic considerations to decide whether it is helpful to restrict ourselves to such a definition or whether we could be better served by a more expansive definition. I link this to the philosophical view of pragmatism and argue that a pluralistic nonreductive approach is especially appropriate in child and adolescent psychiatry. (shrink)

My paper sets out to compare neuroaesthetics and transcendental philosophy, concerning the perception of schemes of imitation in aesthetic experience. The argument is structured in four steps: first, I will introduce the function of schemes in mirror-neuron-based processes and in general in the embodiment theory of Mark Johnson and George Lakoff; second, I will consider some analogical relations between a transcendental approach and neuroaesthetics concerning semantics; third, starting with the statement that one open question in neuroaesthetics is how creativity emerges, (...) I would like to propose a transcendental account about sensible schemes as a possible foundation of creativity. I will conclude my paper with some examples from visual arts and aesthetic practices in general. (shrink)

This paper pays tribute to the distinguished legal and political philosopher Joseph Raz, who recently passed away. I present a response to Donald Davidson on conceptual schemes which tries to imitate Raz’s writing style, which attracts me despite the difficulties it poses. The response includes a definition.

In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

This paper uses the language of formal dialectics to explore how argumentation schemes and their critical questions can be characterized as an extension to traditional dialectical systems. The aim is to construct a dialectical system in which the set of locutions is extended to include scheme-based moves the set of structural rules describes the roles that critical questioning can play; and the set of commitment rules distinguishes between exceptions and assumptions.

Gilbert Ryle’s The Concept of Mind was published over 50 years ago to wide acclaim, but his legacy has been tempered because of important misconceptions, including a) that contemporary philosophy has sufficiently absorbed what is valuable about his contribution; b) that he is responsible for propounding a version of philosophical behaviourism; and c) that Ryle travels down a substantially different philosophical track from that of Wittgenstein. This critical introduction sets out to overturn these misconceptions. It is extremely rare for a (...) UK-based philosopher to be invited to produce a critical introduction for a book published (in French) in France. The French publication has led to a) an invitation to produce an entry for Ryle for Stanford’s (on-line) Encyclopaedia of Philosophy, b) an AHRC research leave award to turn the introduction into a (English) book; an invitation to give lectures on the book at the Université de Picardie. The English version of the critical has received warm praise from a number of philosophers, including Cora Diamond. (shrink)

Trust is a natural mechanism by which an autonomous party, an agent, can deal with the inherent uncertainty regarding the behaviours of other parties and the uncertainty in the information it shares with those parties. Trust is thus crucial in any decentralised system. This paper builds on recent efforts to use argumentation to reason about trust. Specifically, a set of schemes is provided, and abstract patterns of reasoning that apply in multiple situations geared towards trust. Schemes are described in which (...) one agent, A, can establish arguments for trusting another agent, B, directly, as well as schemes that A can use to construct arguments for trusting C, where C is trusted by B. For both sets of schemes, a set of critical questions is offered that identify the situations in which these schemes can fail. (shrink)

The aim of this investigation is to explore the role of argumentation schemes in enthymeme reconstruction. This aim is pursued by studying selected cases of incomplete arguments in natural language discourse to see what the requirements are for filling in the unstated premises and conclusions in some systematic and useful way. Some of these cases are best handled using deductive tools, while others respond best to an analysis based on defeasible argumentations schemes. The approach is also shown to work reasonably (...) well for weak arguments, a class of arguments that has always been difficult to analyze without the principle of charity producing a straw man. Safe Safety arguments are key components in a safety case. Too often, safety arguments are constructed without proper reasoning. To address this, we argue that informal logic argument schemes have important roles to play in safety argument construction and reviewing process. Ten commonly used reasoning schemes in computer system safety domain are proposed. The role of informal logic dialogue games in computer system safety arguments reviewing is also discussed and the intended work in this area is proposed. It is anticipated (...) that this work will contribute toward the development of computer system safety arguments, and help to move forward the interplay between research in informal logic and research in computer system safety engineering. After characterizing the general outlines of Davidson's criticism of the idea of conceptual schemes, the specifics of his argument are examined and evaluated. It is argued that his argument against radically different conceptual schemes does mark out plausible limits to what might be thought of as differences against conceptual schemes, but it is doubtful that those he mentioned as proponents of the idea envisions such differences. It is argued that the stylized character of Davidson's arguments against the less radical variants (...) of the idea fail to foreclose the possibility of differences that many would find interesting. Argumentation schemes [1–3] are a relatively recent notion that continues an extremely ancient debate on one of the foundations of human reasoning, human comprehension, and obviously human argumentation, i.e., the topics. To understand the revolutionary nature of Walton’s work on this subject matter, it is necessary to place it in the debate that it continues and contributes to, namely a view of logic that is much broader than the formalistic perspective that has been adopted from the 20th century until nowadays. (...) With his book Argumentation schemes for presumptive reasoning, Walton attempted to start a dialogue between three different fields or views on human reasoning – one (argumentation theory) very recent, one (dialectics) very ancient and with a very long tradition, and one (formal logic) relatively recent, but dominating in philosophy. Argumentation schemes were proposed as dialectical instruments, in the sense that they represented arguments not only as formal relations, but also as pragmatic inferences in the sense that they depend on what the interlocutors share and accept in a given dialogical circumstance and affect their dialogical relation. In this introduction, the notion of argumentation scheme will be analyzed in detail, showing its different dimensions and its defining features which make them an extremely useful instrument in Artificial Intelligence. This theoretical background will be followed by a literature review on the uses of the schemes in computing, aimed at identifying the most important areas and trends, the most promising proposals, and the directions of future research. In the present paper the concept of a covering is presented and developed. The relationship between cover schemes, frames (complete Heyting algebras), Kripke models, and frame-valued set theory is discussed. Finally cover schemes and framevalued set theory are applied in the context of Markopoulou’s account of discrete spacetime as sets “evolving” over a causal set. We observe that Markopoulou’s proposal may be effectively realized by working within an appropriate frame-valued model of set theory. We go on to show that, within (...) this framework, cover schemes may be used to force certain conditions to prevail in the associated models: for example, rendering the universe timeless, obliterating a given event or forcing it to become the universe’s “beginning”. Many commentators and experts arguethat extensive agricultural systems across theEuropean Union (EU) should be supported toreach the two main functions of the EuropeanModel of Agriculture (EMA): lively economicsystems and environmental awareness. We arguethat the main current policy instrument of theEMA, the CAP (Common Agricultural Policy),should be targeted to take advantage ofexisting regional diversity in social realitiesand agricultural structures. Community-basedresearch work has been carried out throughoutthe 1990s in the cereal–sheep farming system ofCastile-La Mancha (south-central Spain), wherea system of land-use operates in (...) which cerealcropping and sheep farming are carried out onthe same land. Local agricultural staff andfarmers acted as collaborators in rating themain constraints and devising proposals forstructural, social, and institutional reforms.Results showed that the two social groupsinvolved (cultivators and pastoralists) haddivergent interests and unbalanced numbers forcollective action to be effective. Governmentintervention is required, but current EUagricultural policy is not accomplishing therestructuring objectives. Results of theopinion survey also support switching the EUsubsidy scheme to sheep from a per-head basisto a per-hectare basis and making grazing landmore accessible to landless shepherds. Regionalpolicy schemes should be devised that aretailored to meet the circumstances ofparticular land areas, but sensible policyschemes can only be devised after properknowledge of the structure and institutionalframework of EU agricultural systems. This paper is an examination and evaluation of McDowell’s criticisms of Davidson’s views on conceptual schemes and empiricism. I will argue that McDowell does not understand the real nature of Davidson’s arguments against the scheme-content dualism and that his new empiricist proposal fails to solve all the problems that old empiricism has traditionally raised. This is so because Davidson does not try to reject only a certain conception of experience by rejecting the dualism of scheme and content, but a way (...) of thinking about meaning and knowledge that assumes a dualism that cannot be maintained. This paper presents a position called Scheme-based Alethic Realism, which reconciles a realist position on the nature of truth with a pluralistic Kantian perspective that allows for multiple environments in which truthmaking relationships are established. We argue that truthmaking functions are constrained by a stable phenomenal world and a stable cognitive architecture. This account takes truth as normatively distinct from epistemic justification while relativizing the truth conditions of our statements to what we call Frameworks. The pluralistic aspect allows that these (...) stable elements, while constraining representational and linguistic schemes, do not define a single framework for truthmaking relations. We strengthen this position by considering themes on situated rational agency from cognitive science and artificial intelligence, arguing that whatever enables or supports rational action within a particular environment must figure into some account of truth and truthmaking, and vice versa. We address the biological dynamics problem of the persistence of several species in conditions of non-existence of an equilibrium, including an example of stabilization by predation and the very controversial “competitive exclusion”. We give normal forms for various examples of such persistence and comments on the involved topology, which implies the presence of exceptional heteroclinic connections binding equilibria on the boundary.

Argumentation schemes have played a key role in our research projects on computational models of natural argument over the last decade. The catalogue of schemes in Walton, Reed and Macagno’s 2008 book, Argumentation Schemes, served as our starting point for analysis of the naturally occurring arguments in written text, i.e., text in different genres having different types of author, audience, and subject domain, for different argument goals, and for different possible future applications. We would often first attempt to analyze the (...) arguments in our corpora in terms of those schemes, then adapt schemes as needed for the goals of the project, and in some cases implement them for use in computational models. Among computational researchers, the main interest in argumentation schemes has been for use in argument mining by applying machine learning methods to existing argument corpora. In contrast, a primary goal of our research has been to learn more about written arguments themselves in various contemporary fields. Our approach has been to manually analyze semantics, discourse structure, argumentation, and rhetoric in texts. Another goal has been to create sharable digital corpora containing the results of our studies. Our approach has been to define argument schemes for use by human corpus annotators or for use in logic programs for argument mining. The third goal is to design useful computer applications based upon our studies, such as argument diagramming systems that provide argument schemes as building blocks. This paper describes each of the various projects: the methods, the argument schemes that were identified, and how they were used. Then a synthesis of the results is given with a discussion of open issues. (shrink)

This paper is an examination and evaluation of McDowell’s criticisms of Davidson’s views on conceptual schemes and empiricism. I will argue that McDowell does not understand the real nature of Davidson’s arguments against the scheme-content dualism and that his new empiricist proposal fails to solve all the problems that old empiricism has traditionally raised. This is so because Davidson does not try to reject only a certain conception of experience by rejecting the dualism of scheme and content, but a way (...) of thinking about meaning and knowledge that assumes a dualism that cannot be maintained. Many public information documents attempt to persuade the recipients that they should engage in or refrain from specific behaviour. This is based on the assumption that the recipient will decide about his or her behaviour on the basis of the information given and a rational evaluation of the pros and cons. An analysis of 20 public information brochures shows that the argumentation in persuasive brochures is often not marked as such. Argumentation is presented as factual information, and in many instances (...) the task of making argumentational links and drawing conclusions is left to the reader. However, since the information offered does follow familiar argumentational schemes, readers can, in principle, reconstruct the argument. All the brochures make use of pragmatic argumentation (argumentation from consequences),i. e.,they formulate at least certain benefits of the desirable behaviour or disadvantages of the undesirable behaviour. In addition, they make regular use of argumentation from cause to effect and argumentation from example. Argumentation from rules and argumentation from authority are less frequently used. This empirical analysis of the use of argumentation schemes is a solid base for interesting and rich hypotheses about the cognitive processing of persuasive brochures. Central processing requires the reader to be able to reconstruct argumentation from informational texts and to identify and evaluate various types of argumentation. (shrink)
