There is a flood of papers being published on new ways to diagnose Alzheimer disease before it is symptomatic, involving a combination of invasive tests , and pen and paper tests. This changes the landscape with respect to genetic tests for risk of AD, making rational suicide a much more feasible option. Before the availability of these presymptomatic tests, even someone with a high risk of developing AD could not know if and when the disease was approaching. One could (...) lose years of good life by committing suicide too soon, or risk waiting until it was too late and dementia had already sapped one of the ability to form and carry out a plan. One can now put together what one knows about one's risk, with continuing surveillance via these clinical tests, and have a good strategy for planning one's suicide before one becomes demented. This has implications for how these genetic and clinical tests are marketed and deployed, and the language one uses to speak about them. The phrase ‘there is nothing one can do’ is insulting and disrespectful of the planned suicide option, as is the language of the Risk Evaluation and Education for Alzheimer's Disease studies and others that conclude that it is ‘safe’ to tell subjects their risk status for AD. Further, the argument put forward by some researchers that presymptomatic testing should remain within research protocols, and the results not shared with subjects until such time as treatments become available, disrespects the autonomy of people at high risk who consider suicide an option. For over a decade now we live under an economic crisis, its metastases, and its effects. Since the turn of the century, we live under recurring security crises and state attempts to prevent them. This article examines the temporal horizons of the strategies the neoliberal state employs to combat the spectre of crisis in its two quintessential fields of action: the economy and security. It notes a pronounced contrast: whereas security strategy is pre-emptive, economic strategy is reactive. These two opposite (...) strategies aim to the same result: to cancel the future. Security strategy seeks to pre-emptively neutralise the possibility of non-liberal politics, canceling the possibility of political change. By not intervening proactively, economic strategy seeks to guarantee that the economy will remain as it is, averting economic change. This attempt of the state to cancel the future is symptomatic of a malaise affecting the capitalist class. Having fully conquered social resistance, the capitalist class tries to render the moment of its triumph permanent, fixing society in an eternal present. For the first time in its history, the capitalist class has neither vision nor appetite for the future. This signals its hegemonic implosion. (shrink)

Biomarker-based predictive tests for subjectively asymptomatic Alzheimer’s disease (AD) are utilized in research today. Novel applications of artificial intelligence (AI) promise to predict the onset of AD several years in advance without determining biomarker thresholds. Until now, little attention has been paid to the new ethical challenges that AI brings to the early diagnosis in asymptomatic individuals, beyond contributing to research purposes, when we still lack adequate treatment. The aim of this paper is to explore the ethical arguments put forward (...) for AI aided AD prediction in subjectively asymptomatic individuals and their ethical implications. The ethical assessment is based on a systematic literature search. Thematic analysis was conducted inductively of 18 included publications. The ethical framework includes the principles of autonomy, beneficence, non-maleficence, and justice. Reasons for offering predictive tests to asymptomatic individuals are the right to know, a positive balance of the risk-benefit assessment, and the opportunity for future planning. Reasons against are the lack of disease modifying treatment, the accuracy and explicability of AI aided prediction, the right not to know, and threats to social rights. We conclude that there are serious ethical concerns in offering early diagnosis to asymptomatic individuals and the issues raised by the application of AI add to the already known issues. Nevertheless, pre-symptomatic testing should only be offered on request to avoid inflicted harm. We recommend developing training for physicians in communicating AI aided prediction. (shrink)

L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. On new world order, internationalism, politics, and economic integration.

In this paper we discuss ethical implications of the use of mobile phone apps in the control of the COVID-19 pandemic. Contact tracing is a well-established feature of public health practice during infectious disease outbreaks and epidemics. However, the high proportion of pre-symptomatic transmission in COVID-19 means that standard contact tracing methods are too slow to stop the progression of infection through the population. To address this problem, many countries around the world have deployed or are developing mobile phone (...) apps capable of supporting instantaneous contact tracing. Informed by the on-going mapping of ‘proximity events’ these apps are intended both to inform public health policy and to provide alerts to individuals who have been in contact with a person with the infection. The proposed use of mobile phone data for ‘intelligent physical distancing’ in such contexts raises a number of important ethical questions. In our paper, we outline some ethical considerations that need to be addressed in any deployment of this kind of approach as part of a multidimensional public health response. We also, briefly, explore the implications for its use in future infectious disease outbreaks. (shrink)

A large part of the contemporary phenomenology of medicine has been devoted to accounts of health and illness, arguing that they contribute to the improvement of health care. Less focus has been paid to the issue of prevention of disease and the associated difficulty of adhering to health-promoting behaviours, which is arguably of equal importance. This article offers a phenomenological account of this disease prevention, focusing on how we—as embodied beings—engage with health-promoting behaviours. It specifically considers how we engage with (...) oral hygiene regimens to prevent periodontitis and why we are not good at it. The article suggests that poor adherence to health-promoting behaviours can be explained with reference to the concept of the absent body, because prevention of disease is generally concerned with pre-symptomatic illness experience. The final section contains a discussion of some strategies for the improvement of disease prevention based on this viewpoint. (shrink)

BackgroundThe discovery of biomarkers of ageing has led to the development of predictors of impending natural death and has paved the way for personalised estimation of the risk of death in the general population. This study intends to identify the ethical resources available to approach the idea of a long-lasting dying process and consider the perspective of death prediction. The reflection on human mortality is necessary but not sufficient to face this issue. Knowledge about death anticipation in clinical contexts allows (...) for a better understanding of it. Still, the very notion of prediction and its implications must be clarified. This study outlines in a prospective way issues that call for further investigation in the various fields concerned: ethical, psychological, medical and social.MethodsThe study is based on an interdisciplinary approach, a combination of philosophy, clinical psychology, medicine, demography, biology and actuarial science.ResultsThe present study proposes an understanding of death prediction based on its distinction with the relationship to human mortality and death anticipation, and on the analogy with the implications of genetic testing performed in pre-symptomatic stages of a disease. It leads to the identification of a multi-layered issue, including the individual and personal relationship to death prediction, the potential medical uses of biomarkers of ageing, the social and economic implications of the latter, especially in regard to the way longevity risk is perceived.ConclusionsThe present study work strives to propose a first sketch of what the implications of death prediction as such could be - from an individual, medical and social point of view. Both with anti-ageing medicine and the transhumanist quest for immortality, research on biomarkers of ageing brings back to the forefront crucial ethical matters: should we, as human beings, keep ignoring certain things, primarily the moment of our death, be it an estimation of it? If such knowledge was available, who should be informed about it and how such information should be given? Is it a knowledge that could be socially shared? (shrink)

The article tries to show, from the phenomenological posi­tion, that it must be possible to reflect on so called pre-linguistic experience. The argumenta­tion is based on a disputation with a symptomatic example used by Wittgen-stein to substan­tiate his language games theory. The analysis of the example at­tempts to indicate that the language games theory, which has to justify the rejection of the existence of pre-linguistic experience, meets with discre-pancies and difficulties which limit the range of this theory to a (...) certain extent. Because it presupposes the existence of „private“, experiential sphere in which – even before language and verbali­zation enter the game – the struc­turing of the world, identifi­cation of things and an elementary under-stan­ding of these processes must be realized. It seems that the dis-cussion on this topic is not only a spe­cific polemic over one problem that can be found in Wittgenstein, but has wider implications because the language games concept in the form of various „discourses“, „vocabularies“ or „cultures“ has found great favour in contemporary postmo­dern philo­sophy. On its basis postmodern philosophy very radi­cally crosses out the world, profanes its rational, objec­tive description and calls for free variation of different interpretations – their legitimacy is authenti­cated only by a consensus of their users. In this dispute, phe­nome­nology does not declare that there is a single true description of the world and that it is possible to find a reliable criterion for its definite legiti­mization. It does, however, draw on the fact that so called pre-linguistic expe­rience does not succumb to the variability of langu­age games and the interests of its users, but that it more and more cle­arly reflects the unitary and scru­table style of showing the real, ob­jectively given world even though this al­ways happens in se­emingly impalpable subjective acts. The notion of minimal, basic, pre-reflective or core self is currently debated in the philosophy of mind, cognitive sciences and developmental psychology. However, it is not clear which experiential features such a self is believed to possess. Studying the schizophrenic experience may help exploring the following aspects of the minimal self: the notion of perspective and first person perspective, the ‘mineness’ of the phenomenal field, the questions of transparency, embodiment of point of view, and the issues of agency and ownership, (...) considered as different and less fundamental than the feeling of mineness. Two clinical vignettes of patients with the diagnosis of schizophrenia will be presented: the first one, illustrating early illness stages, and the second case, of chronic schizophrenia, symptomatically marked by persistent hallucinations. Through their analysis, we will discuss the experiential dimensions of minimal self. (shrink)

Alzheimer’s Disease (AD) provides an excellent case study to investigate emerging conceptions of health, disease, pre-disease, and risk. Two scientific working groups have recently reconceptualized AD and created a new category of asymptomatic biomarker positive persons, who are either said to have preclinical AD, or to be at risk for AD. This article examines how prominent theories of health and disease would classify this condition: healthy or diseased? Next, the notion of being “at risk”—a state somewhere in-between health and disease—is (...) considered from various angles. It is concluded that medical-scientific developments urge us to let go of dichotomous ways of understanding disease, that the notion of “risk,” conceptualized as an increased chance of getting a symptomatic disease, might be a useful addition to our conceptual framework, and that we should pay more attention to the practical usefulness and implications of the ways in which we draw lines and define concepts. Animating Maurice Merleau-Ponty’s phenomenological idea of the body as a pre-reflective organizing principle in perception, consciousness and language has become a productive and popular endeavor within philosophy of mind during the last two decades. In this context Merleau-Ponty’s descriptions of an embodied mind has played a central role in the attempts to naturalize phenomenological insights in relation to cognitive science and neuropsychological research. In this dialogue the central role of art and aesthetics in phenomenology has been neglected or at best (...) treated as a peripheral phenomenon. In this article I argue that the failure to place art and aesthetics at the center of thought within phenomenology leads to a neglect of the expressive primacy of the body in movement. In the current naturalization of phenomenology the questions related to expressive movement are often consigned to the notions of motor intentionality or gesture. However, in his book How the Body Shapes the Mind the philosopher Shaun Gallagher interestingly concludes, based on experimental results, that bodily movements of gesture cannot be accounted for by the phenomenologically adapted notions of ‘body image’ and ‘body schema’. Symptomatically, Gallagher ends his chapter on bodily gesture with a section title asking the relevant question that remains unanswered within a phenomenology of mind: Expressive movement from the beginning? The search for an answer to this question points, in my view, to the possibility of a more radical understanding of the embodied mind based on the primacy of expressive experimentation rather than representational experience, which makes the question of art and aesthetics a core issue. Following the image of thought in the philosophy of Gilles Deleuze I argue that art, as the production of sensation through experimentation, presents us with a mode of thinking that accounts for expressive bodily movement as a constitutive force in subjective thought and experience. György Lukács’s Marxist phase is usually associated with his passage from neo-Kantianism to Hegelianism. Nonetheless, Nietzschean influences have been covertly present in Lukács’s philosophical development, particularly in his uncompromising distaste for the bourgeois society and the mediocrity of its quotidian values. A closer glance at Lukács’s corpus discloses that the influence of Nietzsche has been eclipsed by the Hegelian turn in his thought. Lukács hardly ever mentions the weight of Nietzsche on his early thinking, an influence that makes cameo appearances (...) throughout his lifetime writings. During the period of his adherence to a Stalinist approach to communism, his new subjectivity seems to be re-constituted through a disavowal of his earlier romantic anti-capitalism. Implicit in Lukács’s attack on Nietzsche in the Destruction of Reason (1952) is an acerbic reaction to the mute presence of the latter in his earlier thought. Apart from his ignorance of the unreliability of the collection of the Will to Power edited by Peter Gast and Elisabeth Förster-Nietzsche, his battle against the anti-proletariat Nietzsche in the Destruction is waged on a metaphysical, non-historical plain. Lukács’s pre-Marxist works (Soul and Form, On Poverty of Spirit, and The Theory of the Novel) in a sense betray the instance of a writer who writes most of someone where he omits his name. Thus perceived, Lukács’s early corpus lends itself to a symptomatic reading. -/- This essay seeks to extract the Nietzschean undercurrents of Lukács’s work through a reflection on the romantic anti-capitalist tendencies that the young Lukács shared with Nietzsche. For although it may appear that Nietzsche lacked a clear politics, his criticism of the bourgeois ethos as a structure based on debt/guilt [Schuld], and his critique of modern value-system and nihilism paved the way for the emergence of Lukács’s theory of reification. Nietzsche’s category of 'transvaluation of values’ suggests a total transfiguration of reality, a radical rupture with the ordinary state of things, and as such carries within itself a revolutionary promise. Drawing a distinction between political romanticism and romantic politics, I argue that romantic anti-capitalism contains a potential for the latter. The essay further traces the link between Lukács’s ‘romantic politics’ and the persistence of a thought of the tragic (a ‘tragic vision’) in his texts that, despite its temporary decline during his realist period, is undismissable in different constellations of his thought. This article commemorates the fiftieth anniversary of The Sociological Imagination by recalling, renewing and updating C. Wright Mills’ pledge to expand a politically aware, self-reflective and publicly accessible intellectual culture between aestheticism and scientism. We begin by sketching how Mills’ ‘bifocal’ vision of the translation between the close-up perspective on personal milieus and the longer view of social structures contrasts with recent calls for a public sociology which would sustain its professional legitimacy while reviving its critical conscience. To illustrate this (...) point, we argue that his project can be reframed in a way that ‘provincializes’ the universalizing claims and scientific aspirations of much of North American sociology by exposing its imperial unconscious in pre- and post-war movements toward the professionalization and scientization of knowledge. Here our focus turns to the prospects for a ‘sociology of empire’ to trace imperial forms which are symptomatically manifested both in the discipline’s assumptions about historical progress and in Mills’ critique of these assumptions. Finally, with an example from the history of British colonialism in Egypt, we show how, despite its blindspots, Mills’ vision of the sociological imagination implicitly projects an alternative ‘sociological map’ with distinct vantage points that can account for the changing cultural tasks of our time, especially concerning how collectives of human and non-human agents are unequally mediated within networks of power. We conclude by revisiting Mills’ distinctive approach to ‘the craft of sociology’, considered more as a prayer than a profession, and undertaken more as a personal and political calling than as career. In lieu of an abstract, here is a brief excerpt of the content:Exception in Žižek’s ThoughtErik Vogt (bio)One cannot fail to be struck by the repeated occurrences and invocations of some logic of exception as well as by the proliferation of examples or stand-ins for exceptional positions (“Jew”; “woman”; “class struggle”) or exceptional collectives (“proletariat”; “slum dwellers”) in many of Slavoj Žižek’s writings. The significance of thinking exception is evident not only in Žižek’s powerful reconceptualization of (a supposedly outdated) ideology (...) critique and in his intriguing materialist account of the relationship between Judaism and Christianity, but also in his interventions into contemporary debates as to what constitutes proper politics. For this reason, it might be appropriate, in a first sketch, to attempt to weave together some of the threads that combine into Žižek’s (critique of the) logic of exception.11The Symptom and Its Logic of ExceptionAlready Žižek’s early brilliant elaboration of a contemporary ideology critique in terms of a powerful coarticulation of Marx and Freud analyzes the “social symptom” in light of its hidden logic of exception [Sublime Object 11–53]. Since the “social symptom” is not to be grasped as some imbalance external to universality, but rather as its constitutive moment, it marks “a point of breakdown heterogeneous” to a given universal field that at the same time is “necessary for that field to achieve its closure, its accomplished form” [21]. A symptomatic ideology critique will seize on the logic of exception implicit in the fissures of universality by deciphering its “falseness,” insofar “as it necessarily includes a specific case which breaks its unity, lays open its falsity” [21]. What is impossible, then, is the claim to some totality or universality without including in it “the point of exception functioning as its internal negation” [23]. This seems to suggest that the “social symptom” does not present any obstacles to its ideological-critical decipherment according to the logic of exception. However, Žižek makes clear immediately that it often does not effect the dissolution of the “social symptom”; on the contrary, it might even reinforce it, insofar as this interpretive procedure appeals to and relies on an addressee that continues to be figured in terms of consistency, completeness, totality. Consequently, this interpretive procedure of dissolving the symptom remains stuck in the very logic of exception that it attempts to unearth [73–74]. This is the reason why Žižek suggests supplementing this notion of the “social symptom” as ciphered message with the notion of fantasy. He describes the relation between symptom and fantasy in the following manner: “Symptom implies and addresses some non-barred, consistent big Other which will retroactively confer on it its meaning; fantasy implies a crossed-out, barred, non-whole, inconsistent [End Page 61] Other—that is to say, it is filling out a void in the Other” [74]. A contemporary ideology critique will therefore have to account for both the exceptional status of the social symptom and its underlying social fantasy. In other words, ideology critiques must consist of two stages, of two complementary procedures:—one is discursive, the “symptomal reading” of the ideological text [...] demonstrating how a given ideological field is a result of a montage of heterogeneous “floating signifiers,” of their totalization through the intervention of certain “nodal points”;—the other aims at extracting the kernel of enjoyment, at articulating the way in which [...] an ideology implies, manipulates, produces a pre-ideological enjoyment structured in fantasy.[125]In short, what is required from ideology critique is an interpretation of the social symptom in such a way that it brings to light the very fundamental fantasy that, precisely as a preideological blockage to interpretation, has then to be traversed and correlated to the identification with the symptom. The article presents a comparison of the interpretations of Edmund Husserl’s early philosophy, created in different local contexts: ones by Polish researchers (Kazimir Tvardovsky, Jan Luka sevich, Vladyslav Tatarkevych, Roman Ingarden, Aleksander Rozenblum-Augustowski) in the period 1895-1945, and Ukrainian philosopher Volodymyr Yurynets. This comparison takes place against the background of considering the differences in the conditions of the development of philosophy in pre-war and interwar Poland and the USSR. The author demonstrates the similarity of the readings of Husserl’s phenomenology by (...) Polish researchers and Yurynets and proves that the similarity between them is not only in the thematic focus of criticism of phenomenological philosophy, but also in its validity and level. In addition, the author offers an approach to the study of Yurynets’ figure and work, based on considering him primarily as a representative of Western intellectual culture. In particular, the possibility of considering Yurynets ‘ objections to Husserl’s project of phenomenological philosophy not as determined by ideological dictates, but as symptomatic of the European intellectual culture of the beginning of the 20th century is substantiated. Both Yurynets and the Polish phenomenological movement criticize phenomenology for its lack of coherence, and it is about both the internal coherence of phenomenological philosophy and its coherence with contemporary sciences. Particular attention is paid to the role of Yurynets in the history of Ukrainian studies of phenomenological philosophy in the context of the discussion about the origins of phenomenological studies in Ukraine.The author considers the investigations of the phenomenological movement in Poland to be fruitful for modern studies of phenomenological philosophy in Ukraine - a phenomenon that had a significant impact on the development of a wide range of humanitarian disciplines in Europe in the 20th-21st centuries and which has direct intersections and common personalities with Ukrainian philosophy. A "symptomatic act" is an act that is evidence for a state that it has no tendency to cause. In this paper I show that when the evidential value of a symptomatic act might influence subsequent choices, causal decision theory may initially recommend against its own use for those subsequent choices. And if one knows that one will nevertheless use causal decision theory to make those subsequent choices, causal decision theory may favor the one-box solution in Newcomb's problem, (...) and may recommend against making cost-free observations. But if one can control one's future choices, then causal decision theory never recommends against cost-free observation. (shrink)

In this essay, I investigate the dynamic foundations of Hume’s philosophy which is so heavily dependent upon Newton’s physics. Hume’s ubiquitous phrase „force and vivacity” is symptomatic of his dynamic, rather than voluntaristic, position that dominates his interpretation of impressions, ideas, and causality in particular. After pointing out some inconsistencies of Hume’s Newtonism, I concentrate on Hume’s treatment of power. It is a well-known fact that Hume rejected natural powers, in fear of their occult character, but accepted human powers (...) giving them an actualist interpretation. I suggest that there is a dispositional treatment hidden in Hume’s statements which puts Hume in line with other philosophers of power. (shrink)

Hélène Cixous and Jacques Derrida position themselves very differently in relation to literature. This article analyses that difference in the light of their relation to the symptom, the fundamentally unanalysable form through which the unconscious manifests itself. While Derrida dwells more on the impossibility of ever accessing the original secret wound to whose existence the symptom opaquely attests, Cixous tends to focus more on the effect, the symptom itself. For both, the ‘chance’ of literature lies in the fact that neither (...) the source nor the destination of letters can be determined. I argue that the difference between Derrida's relative resignation to this condition and Cixous's celebration of it helps to explain the contrast between his position at the margins of literature and her unequivocal embrace of it.
