This article attempts an organological and pharmacological re-interpretation of the later Heidegger’s understanding of modern technology as a provocative mode of revealing of beings, in particular of its central notions of Gestell [enframing] Gefahr [danger], Kehre [turning] and Ereignis [event]. Although these notions in principle allow us to think what is at stake currently in the Anthropocene as the age of total automation, generalized toxicity of the technical milieu and post-truth calling for a radical bifurcation, they need to be reframed (...) and re-imagined in terms of the process of exosomatization issuing from humanity’s original and necessary default of origin and situated within the perspective of entropy and negentropy, both unthought by Heidegger. Only thus will it become possible to really think and take care of what Heidegger called the danger of technology and its turning into the event as the destiny of enframing. This also requires a rethinking of Aristotle’s theory of four causes as it is invoked by Heidegger in his analysis of technology, in particular the efficient and final causes, in terms of what Deleuze called quasi-causality, here understood as the need and the obligation for mortals to make their fault come true, i.e., to make it truly happen or make it advene in truth, out of the experience of the danger as the ordeal of the necessary default. Thus becoming the anti-anthropic cause of anthropic toxicity, humans would restore final causality as quasi-causality and inaugurate, as neganthropos, the bifurcation into the Neganthropocene. Rationing health care by ordeals is likely to have different effects on women and men, and on distinct groups of women. I show how such putative effects of ordeals are relevant to achieving gender justice. I explain why some ordeals may disproportionately set back women’s interest in discretionary time, health and access to health care, and may undermine equality of opportunity for positions of advantage. Some ordeals protect the interests of the worse-off women yet set back the interests of better-off (...) women in equal opportunities. I suggest how we can use ordeal design to advance particular aims of gender justice. (shrink)

This essay begins by summarizing the reasons why unregulated health-care markets are inefficient. The inefficiencies stem from the asymmetries of information among providers, patients and payers, which give rise to moral hazard and adverse selection. Attempts to ameliorate these inefficiencies by means of risk-adjusted insurance and monetary incentives such as co-pays and deductibles lessen the inefficiencies at the cost of increasing inequalities. Another possibility is to rely on non-monetary incentives, including ordeals. While not a magic bullet, these are feasible methods (...) for addressing the inadequacies of market provision of health care, such as moral hazard. (shrink)

The appropriate goal of care for a person with a traumatic brain injury is rehabilitation in the broad, etymological sense of the word. The task is to bring the person back to the conditions of the living of a life. This requires the rehabilitation of the mind—the reconstruction of a subject.

Through close readings of Frost's poetry and often ignored prose, Mark Richardson argues that Frost's debates with Van Wyck Brooks, Malcolm Cowley, and H. L. Mencken informed his poetics and his poetic style just as much as did his deep identification with earlier writers like Emerson and William James.

I try to understand the ordeal of solitude by beginning with Marc Augé’s usage on transitional sites as a provocation, which leads us to rethink solitude as a condition of subjectivity and its various inflections, most conventionally as loneliness and, in sociology, as fragmentation, anonymity, alienation, privatization and the various opinions that link it to the deprivation of separation that longs for connection, or, more fundamentally in Simmel, as the ontological view of the tragedy of human limitation. Instead of (...) restricting us to sites, Augé’s provocation suggests that if solitude is one of a family of such usages related to the experience of being alone or apart in such a space, we might then examine ways in which it is oriented to as a condition that can vary according to extremes, say, in the way Arendt and others have contrasted the pain of loneliness with the creativity of solitude. In linking solitude to transitional sites, Augé suggests that there is something about the experience of the in-between, whether of time or space, that illuminates solitude and that makes any relationship to it a potential ordeal. I test the notion by asking how the ordeal pertains to language itself and the intermediacy of a human subject in linguistic space. (shrink)

Ordeals are burdens placed on individuals that yield no benefits to others; hence they represent a dead-weight loss. Ordeals – the most common is waiting time – play a prominent role in rationing health care. The recipients most willing to bear them are those receiving the greatest benefit from scarce health-care resources. Health care is heavily subsidized; hence, moral hazard leads to excess use. Ordeals are intended to discourage expenditures yielding little benefit while simultaneously avoiding the undesired consequences of rationing (...) methods such as quotas or pricing. Individuals often face administrative hurdles in attempting to access health care, public programmes, and other legal statuses and entitlements. These ordeals are the products, directly or indirectly, of institutional and policy design choices. I argue that evaluating whether such ordeals are justifiable or desirable instruments of social policy depends on assessing, beyond their targeting effects, the process-related burdens they impose on those attempting to navigate them and these burdens’ distributive effects. I here examine specifically how ordeals that levy time costs (...) reduce and constrain individuals’ free time, and how such time-cost ordeals may thereby create, deepen and compound disadvantages. In his writing, Gilles Deleuze drew on a vast array of source material, from philosophy and psychoanalysis to science and art. Yet scholars have largely neglected one of the intellectual currents underlying his work: Western esotericism, specifically the lineage of hermetic thought that extends from Late Antiquity into the Renaissance through the work of figures such as Iamblichus, Nicholas of Cusa, Pico della Mirandola, and Giordano Bruno. In this book, Joshua Ramey examines the extent to which Deleuze's ethics, metaphysics, and (...) politics were informed by, and can only be fully understood through, this hermetic tradition. Identifying key hermetic moments in Deleuze's thought, including his theories of art, subjectivity, and immanence, Ramey argues that the philosopher's work represents a kind of contemporary hermeticism, a consistent experiment in unifying thought and affect, percept and concept, and mind and nature in order to engender new relations between knowledge, power, and desire. By uncovering and clarifying the hermetic strand in Deleuze's work, Ramey offers both a new interpretation of Deleuze, particularly his insistence that the development of thought demands a spiritual ordeal, and a framework for retrieving the pre-Kantian paradigm of philosophy as spiritual practice. Responding to the stimulus afforded by Little et al.’s “Pragmatic pluralism: Mutual tolerance of contested understandings between orthodox and alternative practitioners in autologous stem cell transplantation,” this paper explores how the norms of qualitative inquiry affect the representation of emotion in research reports. It describes a conflict between the construction of emotion in qualitative research accounts and its application to analysis and theorization, whose origins may lie in researchers’ reticence when it comes to conveying or using the emotional features of (...) data. The technical aspects of report writing that are associated with this conflict are explored via a deconstruction of Little et al.’s paper and a survey of the qualitative research methods literature. Writing to convey emotion and analysing to include author-constructed emotional context are neglected topics. Using data in Little et al.’s text, the paper demonstrates the importance of author-constructed emotional context to theory generation. The paper recommends the inclusion of emotional context as data in analysis and points to lessons Little et al.’s paper offers in the areas of narrative technique and reflexive practice. (shrink)

In a great variety of cultures oaths, ordeals, or lie detectors are used to adjudicate in trials, even though they do not reliably discern liars from truth tellers. I suggest that these practices owe their cultural success to the triggering of cognitive mechanisms that make them more culturally attractive. Informal oaths would trigger mechanisms related to commitment in communication. Oaths used in judicial contexts, by invoking supernatural punishments, would trigger intuitions of immanent justice, linking misfortunes following an oath with perjury. (...) These intuitions would justify the infliction of costs on oath takers in a way that appears morally justified. Ordeals reflect the same logic. Intuitions about immanent justice link a worse outcome following the ordeal with a guilty verdict. This link justifies the application of the ordeal, and the fixed costs involved. Lie detectors also rely on the creation of a link between a specified outcome and a guilty verdict. However, they do not rely on intuitions about immanent justice, but on a variety of intuitions ranging from the plausibly universal to the culturally idiosyncratic. As a result, lie detectors involve lower fixed costs than ordeals, and are less cross-culturally successful than oaths or ordeals. (shrink)

This paper addresses how to think about the permissibility of introducing deadweight costs on candidate recipients of goods in order to attain better outcomes. The paper introduces some distinctions between different kinds of value dimensions that should be taken into account when such judgements are made and draws from the literature on comparisons across different value dimensions in order to canvas what sort of situations one might arguably face when evaluating ordeals. In light of the distinctions drawn and the possibilities (...) canvassed, the paper proceeds to outline what circumstances indicate which of the possible situations one is in. (shrink)

According to their standardized treatment within the Indian legal tradition, ordeals are supposed to occur, under certain circumstances, when one person formally accused another of some crime in a court of law. While not disputing the general accuracy of this standardized treatment of ordeals, this article argues for the widespread practice in pre-modern India of another—hitherto unrecognized—type of ordeal that fails to fit this basic scenario, for such ordeals would occur when someone was widely believed to have committed some (...) wrongdoing, but was not forced to stand trial in a formal judicial court. In order to prove his innocence and, thereby, mitigate the damage caused by his suspected guilt, such an individual could—and sometimes did—arrange for himself to undergo an ordeal at his own expense and independently of any formal plaint. After establishing the practice of ordeals of this sort in pre-modern India, this article then examines some possible explanations for their development. (shrink)

In 1215 the Fourth Lateran Council banned priestly involvement in the unilateral judicial ordeal, thus effectively bringing to an end the centuries-old practice of appealing to the judicium Dei as a means of resolving legal disputes. This article explores the reasons behind this seminal development in Western legal history; its principal theme is that they are more complex than modern scholars have allowed. Detailed consideration is given to the canonico-theological criticisms specifically aimed at the ordeal by contemporary critics, (...) as well as to the sweeping reforms of ecclesiastical criminal procedure initiated by Pope Innocent III in the closing years of the 12th century. It will be argued that although these factors contributed to the demise of the ordeal, they do not account for the decision to abandon it. When placed in its proper legislative context, it will be seen that that decision was a product of a long-standing campaign by Church reformers to secure the spiritual mission of the clergy by establishing a clear division of labour between the ecclesiastical order and the secular world. Finally, it will be argued that the ordeal was abandoned because Church reformers regarded it as irrational and, consequently, that the claim that it only came to be seen as irrational because it was abandoned, should be rejected. This article examines parallel challenges and avenues for progress I have observed in my efforts to introduce improvisation in classical music studies, and meditation in music and overall academic settings. Though both processes were once central in their respective knowledge traditions—improvisation in earlier eras of European classical music, meditation and contemplative disciplines in Western philosophy—as well as being globally prominent, they nonetheless occupy marginalised roles in the contemporary academy. Other parallels include the challenges and benefits inherent in the interplay between (...) tradition-specific and trans-traditional engagement, where grounding in a musical lineage such as jazz promotes informed trans-idiomatic musical exploration and synthesis, and grounding in a contemplative lineage provides foundations for navigating the often-turbulent waters of the contemporary spiritual smorgasbord. I argue that a more critical look at integrity of practice, consisting in not only methodologies but also views of consciousness and human development, is key to the future progress of the contemplative studies movement and the contributions it may make to education and society at large.
