How do people perceive the minds of organizations? Existing work on organizational mind perception highlights two key debates: whether organizational groups are ascribed more agency than experience, and whether people are really perceiving minds in organizational groups at all. Our current paper and its data weigh in on these debates and suggest that organizations can indeed be ascribed experiential minds. We present a “member and goals” framework for systematically understanding the mind perception of organization. This framework suggests that people can (...) perceive the organizational mind through its elemental building blocks: members (people who form the organization) and goals (its aims). Four studies reveal that people ascribe agency and experience to organizations based on whether the members of organizations and the goals of the organization are characterized by agency or experience. Study 1 finds that past work on mind perception often examines for‐profit corporations, which consist of agentic members (corporate professionals) and agentic goals (market competition). Studies 2 and 3 reveal that when an organization with members and goals high (vs. low) in experience, people imbue its mind with perceived experience—equal to that of a person—and that even emotions low in warmth (i.e., anger) can imbue an organization with such perceptions. Study 4 shows the moral consequences of emphasizing experience: after organizational wrongdoing, experiential organizations are seen to deliver more sincere apologies and are more forgiven. (shrink)

For virtually all the major schools of Western opinion, the collapse of the Communist regimes in Eastern Europe and in the Soviet Union, between 1989 and 1991, represents a triumph of Western values, ideas, and institutions. If, for triumphal conservatives, the events of late 1989 encompassed an endorsement of “democratic capitalism” that augured “the end of history,” for liberal and social democrats they could be understood as the repudiation by the peoples of the former Soviet bloc of Marxism-Leninism in all (...) its varieties, and the reemergence of a humanist socialism that was free of Bolshevik deformation. The structure of political and economic institutions appropriate to the transition from post-Communism in the Soviet bloc to genuine civil society was, accordingly, modeled on Western exemplars—the example of Anglo-American democratic capitalism, of Swedish social democracy, or of the German social market economy— or on various modish Western academic conceptions, long abandoned in the Soviet and post-Soviet worlds, such as market socialism. No prominent school of thought in the West doubted that the dissolution of Communist power was part of a process of Westernization in which contemporary Western ideas and institutions could and would successfully be exported to the former Communist societies. None questioned the idea that, somewhere in the repertoire of Western theory and practice, there was a model for conducting the transition from the bankrupt institutions of socialist central planning, incorporated into the structure of a totalitarian state, to market institutions and a liberal democratic state. This article builds on the food sovereignty literature to ask pointed questions about the interplay of market forces and political liberalism. Specifically, we use cuisine as a lens to interrogate the assumption that multiculturalism is compatible with Indigenous food sovereignty. Because multicultural inclusion is the means by which Indigenous Peoples’ gastronomies are commodified and alienated, they experience not gastronomic multiculturalism but culinary colonialism. Accordingly, food sovereignty in colonial contexts must embrace both the active sharing and the mindful withholding of food (...) as political acts, and acknowledge that culinary culture is not simply a market commodity but also a politically-embedded process. In drawing together the threads of this argument, we advocate for a broadening of the discussion on Indigenous food sovereignty to include the resistance and resurgence enacted through gastronomy. Knowing who benefits financially from a securities trade is necessary for the detection, prosecution and deterrence of illegal securities trading. Foreign jurisdictions with banking or securities secrecy laws are frequently used as a platform for illegal activity to frustrate law enforcement. This paper considers the extent to which Canadian law gives effect to so-called foreign blocking legislation. We conclude that while Canadian law does not generally give effect to foreign blocking legislation, it imposes only limited requirements on market intermediaries to (...) collect beneficial ownership information. ABSTRACTThe aim of this paper is twofold. Firstly, to examine questions about the role and responsibilities of transaction lawyers working in the financial sector that, it is argued here, deserve closer scrutiny than they have hitherto received since the banking and economic crisis of 2008. It considers the manner in which the conduct of such lawyers in the pre-crisis financial markets may have played a particular role in contributing to the sources of latent risk that bore systemic fruit in 2008. This article illustrates how a traditional U.S. pharmaceutical industry supply chain operates, beginning with pharmaceutical compounds and ending at patient‐dispensing hospitals or pharmacies. Furthermore, to place the problem of U.S. drug shortages in historical perspective, a review of the annual volume of such shortages over the last decade is undertaken. Following this review of recent drug shortages is an analysis of the market forces and business decisions that drive the creation of a pharmaceutical gray market, its attendant “price gouging” (...) and product integrity issues, and the alterations in the traditional pharmaceutical industry supply chain model. In response to persistent drug shortages, the U.S. Food and Drug Administration (FDA) has recently been empowered by the executive and legislative branches of the U.S. government to actively address this issue. To reflect these FDA challenges, a thorough review of these new agency charges and responsibilities is undertaken. Lastly, an analysis of the results of recent FDA public policy actions on mitigating drug shortages, as well as recommendations tor market‐based solutions to the gray market problem that pharmaceutical manufacturers, hospitals and pharmacies could institute as industry‐wide standards of business practice, are discussed in the conclusion. This paper expands the definition of gray-marketing to include some ethically problematic marketing activities and techniques used in personal selling in China. Based on this, a conceptual model of gray-marketing for a particular type of selling in which both the sellers and the buyers exhibit problematic ethics in an exchange and the associated hypotheses are developed and tested. The findings show that, first, the respondents have different ethical evaluations of different marketing practices used in (...) personal selling such as giving and accepting gifts, buying and accepting meals, and offering and accepting kickbacks. Some of these practices may not be considered unethical. Second, in terms of ethical assessment, gray-marketing practiced by buying agents is more unacceptable than when practiced by sales agents. Third, a person's ethical evaluation of gray-marketing behavior, empathy for gray-marketing, and belief that gray-marketing has serious consequences, significantly affects his inclination to use gray-marketing. This paper concludes with a discussion of some possible applications of our research findings. (shrink)

The study analyzes the influential factors of consumers’ willingness to purchase gray-market smartphones by considering the model of novelty seeking, status consumption, integrity, and perceived risk. Attitude toward counterfeit is used as mediation in the model. The causalities in the model of problematic willingness of consumer to purchase gray-market smartphones are hypothesized. A total sample of 350 respondents with 238 effective samples is collected by interviewing with questionnaires at the service counters of telecommunications operators. Structure equation modeling (SEM) (...) is adopted in the analysis. Consumers’ attitude toward counterfeit goods is found to be positively related to the willingness of consumers to purchase gray-market smartphones, but perceived risk is negatively related to consumers’ willingness to purchase. As for personality constructs, integrity and status consumption are found to be negatively related to consumers’ attitude toward counterfeit goods, but novelty seeking is positively related to the attitude. Further, managerial implications for branded smartphone manufacturers and telecommunications regulators are provided by the research. (shrink)

Purpose The internet has provided a gamut of benefits to consumers. The digital world, however, also provides space for various illegal or unethical consumer activities. Consumers may not always be fully aware of the unethical or illegal nature of some of the online activities that they engage in. This study aims to examine the questionable side of online consumer behaviour in an emerging market where internet penetration and smart phone accessibility is rapidly expanding. Using a third-person technique, this study attempts (...) to empirically capture the perceptions of Indian adults regarding the prevalence of various questionable online activities such as unauthorized downloading of digital content, spreading fake news/misinformation and fraudulent returns and to understand the extent to which these respondents believe that such actions are acceptable or illegal and unethical. Design/methodology/approach An online questionnaire was used to collect primary data from 212 consumers. Non-probability convenience and snowball sampling was used for the purpose. Findings Unauthorized watching or downloading of online content is reported to be the most prevalent among the various types of questionable behaviours examined. However, it is behaviours such as fraudulent returns and spreading misinformation through online channels which are considered to be the most unethical or illegal. Certain behaviours which may be deemed to be unethical and illegal nevertheless are seen as acceptable. Significant differences between demographics in the case of several of the unethical activities are reported. Research limitations/implications This study examines the grey and dark side of online behaviours among consumers in an emerging market and points to the need for action on several fronts to increase consumer awareness and sensitivity about the unethical or illegal nature of some of their online activities and the implications for multiple stakeholders. Based on the findings of this study, recommendations directed at consumers, marketers and policymakers are discussed. Originality/value Although the benefits of online communication channels have been extensively studied, their ability to facilitate certain unethical and even illegal activities is an under-researched area. The inclination to engage in these types of questionable behaviours may have been exacerbated by the restrictions imposed by the COVID-19 pandemic. This study highlights the importance of research on various grey consumer activities in the digital space and paves the way for further investigations by identifying online actions which are considered as most prevalent and/or unethical and illegal. There has recently been a flurry of activity in the philosophy of language on how to best account for the unique features of epithets. One of these features is that epithets can be appropriated (that is, the offense-grounding potential of a term can be removed). We argue that attempts to appropriate an epithet fundamentally involve a violation of language-governing rules. We suggest that the other conditions that make something an attempt at appropriation are the same conditions that characterize acts of (...) civil disobedience. Accounting for attempts at appropriation is thus both a linguistic and socio-political endeavor. We demonstrate how these two facets of attempts at appropriation also help us understand the communicative features of civil disobedience. (shrink)

This Article examines the ways in which market vendors in Kampala, Uganda, responded to plans to redevelop their markets through the concession of long-term leases to private investors. These plans met with massive resistance from the marketers, with significant outcomes. The Article uncovers how the marketers actively negotiated a “gray space” between legality and illegality and creatively used the law, with a view to asserting themselves as the legitimate rulers of their markets. It shows how the marketers engaged in (...) highly diverse modalities of struggle, stretching across the legal/illegal boundary. They organized in multiple configurations which were flexible, hybrid and mutant in character, rather than being fixed in particular organizational categories. In their struggles, the marketers engaged in shifting alliances and with a disparate range of political allies. Their politics were fluid, untamed and pragmatic, but also contradictory and fractured. This flexibility and pragmatism enabled them to navigate a complex political landscape and to make instrumental use of a generally unfavorable legal environment. (shrink)

Does Anne Conway (1631–79) hold that the created world consists of a single underlying substance? Some have argued that she does; others have argued that she is a priority monist and so holds that there are many created substances, but the whole created world is ontologically prior to each particular creature. Against both of these proposals, this article makes the case for a substance pluralist interpretation of Conway: individual creatures are distinct substances, and the whole created world is not ontologically (...) prior to the individual creatures that compose it. The basic argument for such a view draws on Conway's claims about the freedom and moral responsibility of individual creatures. Anne Conway rejects the view that creatures are essentially members of any natural kind more specific than the kind 'creature'. That is, she rejects essentialism about species membership. This chapter provides an analysis of one of Anne Conway's arguments against such essentialism, which (as I argue) is drawn from metaethical rather than metaphysical premises. In her view, if a creature's species or kind were inscribed in its essence, that essence would constitute a limit on the creature's potential to participate in (...) the divine good. It is this consideration that ultimately leads her to reject essentialism about species membership. The chapter concludes with an examination of some of the metaethical consequences of Conway's view as well as a lesson it can teach us about ideal adviser accounts of the good. (shrink)

There has recently been emphasis put on providing two-factor accounts of monothematic delusions. Such accounts would explain (1) whether a delusional hypothesis (e.g. someone else is inserting thoughts into my mind) can be understood as a prima facie reasonable response to an experience and (2) why such a delusional hypothesis is believed and maintained given its implausibility and evidence against it. I argue that if we are to avoid obfuscating the cognitive mechanisms involved in monothematic delusion formation we should split (...) the first factor (1 above) into two factors: how abnormal experience can give rise to a delusional ‘proto-hypothesis’ and how a ‘proto-hypothesis’ in consort with normal experiences and background information, can be developed into a delusional hypothesis. In particular I will argue that a schizophrenic is faced with the unusual requirement of having to identify an introspectively accessible thought as one's own, and that this requirement of identification is the central experiential abnormality of thought insertion, auditory verbal hallucination, and alien control (i.e. passivity symptoms). Additionally, I will consider non-experiential factors which are required for the formation of a delusional hypothesis. (shrink)

The theme of this year’s Spindel Conference was Social Ontologies of Race. This editorial introduction serves as both a general introduction to the topic of racial ontology and an introduction to this volume’s contributions. I will first explain some central ideas for discussions of ontology in general. I will then make some basic taxonomic distinctions common to discussions of racial ontology and suggest some clarifications. I will then go on to discuss the five contributions to this volume.

I argue that standard explanations of Du Bois' theory of race inappropriately characterize his view as attempting to provide descriptive criteria for races. Such an interpretation makes it both susceptible to Appiah's circularity objection and alienates it from Du Bois' central project of solidarity—which is the central point of “Conservation.” I propose that we should understand his theory as providing a normative account of race: an attempt to characterize what some races should be in terms of what other races are. (...) In providing such an account I will also show how my interpretation of Du Bois' criteria avoids the circularity objection by making the criteria central to the project of solidarity. Thus, this interpretation avoids what I take to be the two main problems with standard descriptive explanations of Du Bois' criteria. (shrink)

David Rosenthal and Josh Weisberg have recently provided a counter argument to Ned Block’s argument that a Higher Order Thought theory of consciousness cannot accommodate the existence of hallucinatory conscious states . Their counter argument invokes the idea of mental appearances: a non-existent intentional object which is to aid in an account of subjective conscious awareness. I argue that if mental appearances are to do the work they are supposed to, we cannot draw a mental appearance/reality distinction. I provide an (...) alternative story that a HOT theorist can invoke to account for cases of conscious misrepresentation. Such a story will require denying the existence of hallucinatory conscious states while still accounting for conscious misrepresentation. This is a cost I believe the HOT theorist should be willing to pay. (shrink)

Mobile health tools are often said to empower users by providing them with the information they need to exercise control over their health. We aim to bring clarity to this claim, and in doing so explore the relationship between empowerment and autonomy. We have identified three distinct models embedded in the empowerment rhetoric: empowerment as information, empowerment as control, and empowerment as values. Each distinct model of empowerment gives rise to an associated problem. These problems, the Problem of Interpretation, the (...) Value Alignment Problem, and the Priority Problem, show that mobile health tools in their current form are either insufficient for empowerment or are self‐defeating. These digital health technologies encourage users to adopt an individualized conception of autonomy, one that may weaken the doctor–patient relationship and undermine practices in shared decision making, and ultimately may not deliver on improving the health outcomes for those that need it the most. The first part of this paper surveys the current literature in the history of nineteenth-century mathematics in order to show that the question “Did the increasing abstraction of mathematics lead to a sense of anxiety?” is a new and valid question. I argue that the mathematics of the nineteenth century is marked by a growing appreciation of error leading to a note of anxiety, hesitant at first but persistent by 1900. This mounting disquiet about so many aspects of mathematics after (...) 1850 is seldom discussed. The second part explores the issue of anxiety in mathematical life through an interesting account of an address made by a mathematician in 1911, Oscar Perron. The third and final part ventures some conclusions about the value of anxiety as a question for historians of mathematics to pursue. (shrink)

On the ethics of extending human life: healthy people have a right to carry on livingHumanity has long demonstrated a paradoxical ambivalence concerning the extension of a healthy human lifespan. Modest health extension has been universally sought, whereas extreme health extension has been regarded as a snare and delusion—a dream beyond all others at first blush, but actually something we are better off without. The prevailing pace of biotechnological progress is bringing ever closer the day when humanity will be able (...) to act on the latter view by rejecting a clear and present opportunity for much longer healthy lives. Indeed, some biogerontologists contend that that day has already arrived, to the extent that our hesitation in embarking on a vigorous “war on ageing” is already delaying the point at which a cure for ageing will be developed. Here I consider whether our present caution concerning the wisdom of truly curing ageing is likely to survive the increased scrutiny that it will receive in coming years as a result of these technical advances. I conclude that it will not, because of its irreconcilability with values that are more deeply held by the large majority of humanity than any values that argue against the quest for a cure. I further conclude that all the major current reasons given for not curing ageing are mere crutches to help us cope with the immutability of ageing that we have been brought up to accept. Our failure to set aside such irrationality is already shortening potential longevity—quite probably of those already alive today—to a staggering degree. Nicholas Agar, Jeff McMahan and Allen Buchanan have all expressed concerns about enhancing humans far outside the species-typical range. They argue radically enhanced beings will be entitled to greater and more beneficial treatment through an enhanced moral status, or a stronger claim to basic rights. I challenge these claims by first arguing that emerging technologies will likely give the enhanced direct control over their mental states. The lack of control we currently exhibit over our mental lives greatly contributes to our (...) sense of vulnerability. I then argue moral status should be viewed in terms of vulnerability. The enhanced will slowly gain the ability to command their mental states, reducing their vulnerability. These radically enhanced beings will have greater capacities, and possibly an inner life more valuable than our own. They will also be less vulnerable, and as a result, their moral status will be subordinate to our own. (shrink)

While many animals — pigeons, for example — have analogue magnitude states , it has recently been argued that certain discriminatory tasks provide evidence for the claim that these states are non-conceptual . These states are taken to be nonconceptual in that they cannot meet a test for concept possession such as Evans’s Generality Constraint. I argue that while such animals probably do not have numerical concepts, the evidence suggests that they could have numerical-ish concepts. On what I call ‘the (...) diffuse’ account of numerical-ish concepts, animals could have analogue magnitude states which represent amount and these states could meet the Generality Constraint . This account also avoids the problems faced by a ‘centred’ account of numerical-ish concepts which cannot meet the Generality Constraint. (shrink)
