It is over 20 years since Michael Crotty's groundbreaking critique of phenomenological research in nursing. However, rather than entering into the acrimonious discussions that followed, we developed a research method that we believed translated Gadamer's philosophy into the world of empirical research. Fundamental to that work was our differentiation of hermeneutics from phenomenology. The aim of the present paper was to provide a critical analysis of the citations from publication in 2003 until the end of 2017. We identified (...) 402 citations of which 362 were included. One hundred and sixty‐three articles mentioned the article in passing, usually in a list of authors who had discussed hermeneutics. Sixteen citations misrepresented the method mainly claiming that we discussed a method for hermeneutic phenomenology (or phenomenological hermeneutics). Of the 117 citations that partially used the method, the main focus was the four steps of data analysis. Sixty studies used our method in totality although they derive from varying philosophical standpoints. Disappointingly, there has been little critique of our Gadamerian research method. For health disciplines to truly make progress in the academic stage, it is vital that we engage in with critique, some of which will come through open and honest reflexive engagement with our topics. The occurrence of poor patient care is emerging as one of the most significant, challenging, and critical issues confronting contemporary nursing and those responsible for the provision of health care more generally. Indeed, as a consequence of the increased recognition of the manner in which nurses can be implicated in the occurrence of poor patient care, there has been sustained critical debate that seeks to understand how such healthcare failings can occur and, in particular, why nurses seemingly fail (...) to intervene, raise concerns, and effectively respond to prevent the occurrence and continuation of such poor patient care. In seeking to contribute to this critical discussion, and in contrast to those “situational explanations” that maintain that the failure to raise concerns is a consequence of the contextual factors and challenging conditions to which nurses can be subject in the clinical setting, this paper will provide a resolutely philosophical analysis of that failure. In particular, it will draw upon the work of Jean‐Paul Sartre—the French philosopher generally regarded as one of the most influential thinkers of the twentieth century—in order to propose that his work can be productively recontextualized to provide a detailed, challenging, and provocative critical analysis of the occurrence and continuation of poor patient care and the role of individual nurse practitioners in such healthcare failings. The unusual applicability of mathematics to the description of the physical reality still remains a major investigative task for philosophers, physicists, mathematicians and cognitive scientists. The presented article offers a critical analysis of the philosophical motivations and development of a major attempt to resolve this task put forward by two prominent Polish philosophers: Józef Życiński and Michał Heller. In order to explain this particular property of mathematics Życiński has first introduced the concept of the field of rationality together (...) with the field of potentiality to be followed by Heller’s formal field and the field of categories. It turns out that these concepts are fully intelligible once located within philosophical stances on the relations between mathematics and physical reality. It will be argued that in order to achieve more extended conceptual clarification of the precise meaning of the field of rationality, further advancements in the understanding of the nature of the human mind are required. In this context the question rises what the exact relation between these various conceptions of information is and (...) whether there is a real need to enrich these mathematically more or less rigid definitions with a less formal notion of semantic information. I investigate various philosophical aspects of the more formal definitions of information in the light of Floridi’s theory. The position I defend is that the formal treatment of the notion of information as a general theory of entropy is one of the fundamental achievements of modern science that in itself is a rich source for new philosophical reflection. This makes information theory a competitor of classical epistemology rather than a servant. In this light Floridi’s philosophy of information is more a reprise of classical epistemology that only pays lip service to information theory but fails to address the important central questions of philosophy of information. Specifically, I will defend the view that notions that are associated with truth, knowledge, and meaning all can adequately be reconstructed in the context of modern information theory and that consequently there is no need to introduce a concept of semantic information. This paper argues that there is a need to critically assess bias in the representations of older adults in the field of Human–Robot Interaction. This need stems from the recognition that technology development is a socially constructed process that has the potential to reinforce problematic understandings of older adults. Based on a qualitative content analysis of 96 academic publications, this paper indicates that older adults are represented as; frail by default, independent by effort; silent and technologically illiterate; burdensome; and (...) problematic for society. Within these documents, few counternarratives are present that do not take such essentialist representations. In these texts, the goal of social robots in elder care is to “enable” older adults to “better” themselves. The older body is seen as “fixable” with social robots, reinforcing an ageist and neoliberal narrative: older adults are reduced to potential care receivers in ways that shift care responsibilities away from the welfare state onto the individual. Free Energy Principle underlies a unifying framework that integrates theories of origins of life, cognition, and action. Recently, FEP has been developed into a Markovian monist perspective. The paper expresses scepticism about the validity of arguments for Markovian monism. The critique is based on the assumption that Markovian models are scientific models, and while we may defend ontological theories about the nature of scientific models, we could not read off metaphysical theses about the nature of target systems from our theories (...) of nature of scientific models. The paper draws attention to different ways of understanding Markovian models, as material entities, fictional entities, and mathematical structures. I argue that none of these interpretations contributes to the defence of a metaphysical stance. This is because scientific representation is a sophisticated process, and properties of Markovian models—such as the property of being neither physical nor mental—could not be projected onto their targets to determine the ontological properties of targets easily. The public accounting industry’s voluntary code of conduct in the United States is the American Institute of CPA’s Code of Professional Conduct. Based on our analysis, we conclude that the accounting industry’s current code is limited in its ability to serve the public interest in three respects. Specifically, the code is input-based, requires no third-party attestation of compliance with the code, and contains no public reporting process of code compliance/noncompliance at the accounting firm level. We propose that the accounting (...) profession should reorient its largely input-based Code of Professional Conduct to include output-based performance measurements. We also conclude that third-party attestation of compliance with the profession’s code would help to promote compliance. Finally, we maintain that the accounting industry should initiate a public reporting process at the individual accounting firm level. Such a requirement would add a degree of public accountability as to whether a firm complies or fails to comply with the industry’s voluntary code of conduct. (shrink)

Despite its prominence in the abortion debate and in public policy, the discourse of 'unborn patient' has not been subjected to critical scrutiny. We provide a critical analysis in three steps. First, we distinguish between the descriptive and normative meanings of 'unborn child.' There is a long history of the descriptive use of 'unborn child.' Second, we argue that the concept of an unborn child has normative content but that this content does not do the work that (...) opponents of abortion want it to do, namely, to establish the independent moral status of fetuses and their rights, the right to life in particular. Third, we argue that the normative content of 'unborn child' should be dependent moral status, not independent moral status. We conclude that the ethical concept of the fetus as a patient should replace the discourse of “unborn child” when that phrase is used normatively. (shrink)

:In this paper, the author argues that Joseph Fins’ mosaic decisionmaking model for brain-injured patients is untenable. He supports this claim by identifying three problems with mosaic decisionmaking. First, that it is unclear whether a mosaic is a conceptually adequate metaphor for a decisionmaking process that is intended to promote patient autonomy. Second, that the proposed legal framework for mosaic decisionmaking is inappropriate. Third, that it is unclear how we ought to select patients for participation in mosaic decisionmaking.

The predominant function of Australian clinical ethics committees (CECs) is policy formation. Some committees have an educational role. Few committees play any direct role in advising on ethics in the management of individual patients and this occurs only in exceptional circumstances. There is a tendency to exaggerate both the number and function of committees. It is suggested that studies of ethics committees, based on questionnaire surveys, should be interpreted cautiously. An examination of ethical issues indicates that there is a role (...) for a critical analysis of power relations in Australian hospitals that is not fulfilled by CECs. (shrink)

We discuss a recent work by J. Lawrence et al. [arxiv.org/abs/2208.11793] criticizing relational quantum mechanics (RQM) and based on a famous nonlocality theorem Going back to Greenberger Horne and Zeilinger (GHZ). Here, we show that the claims presented in this recent work are unjustified and we debunk the analysis.

Reproductive medical technology has revolutionized the natural order of human procreation. Accordingly, some have celebrated its advent as a new and liberating determinant of kinship at the global level and advocate it as a right to reproductive health while others have frowned upon it as a vehicle for “guiltless exchange of sexual fluid” and commodification of human gametes. Religious voices from both Christianity and Islam range from unthinking adoption to restrictive use. While utilizing this technology to enable the married couple (...) to have children through the use of their own sexual material is welcome, the use of third party, surrogacy, and reproductive cloning are not in keeping with the sacrosanct principles of kinship, procreation through licit sexual intercourse, and social cohesiveness for building a cohesive family as uphold by both Christianity and Islam. To examine such larger issues emanating from these new ways of human procreation, beyond the question of legality, is a point which legal scholars in both Christianity and Islam, when issuing religious decrees, have not anticipated sufficiently. The article proposes to be an attempt to that end through a qualitative critical content analysis of selected literature written on the subject. (shrink)

Fundamentals of Critical Argumentation presents the basic tools for the identification, analysis, and evaluation of common arguments for beginners. The book teaches by using examples of arguments in dialogues, both in the text itself and in the exercises. Examples of controversial legal, political, and ethical arguments are analyzed. Illustrating the most common kinds of arguments, the book also explains how to evaluate each kind by critical questioning. Douglas Walton shows how arguments can be reasonable under the right (...) dialogue conditions by using critical questions to evaluate them. The book teaches by example, both in the text itself and in exercises, but it is based on methods that have been developed through the author's thirty years of research in argumentation studies. The Orthodox Churches are part of the ecumenical movement with the inner wish to clarify the theological elements which keep the whole Christianity divided. For this goal, every Church is represented somehow in discussions by her theologians who are training to carry a theological dispute at this level. The Romanian Orthodox Church was indirectly represented in the World Council of Church by professor Ion Bria (1929-2002), who had worked officially at the Ecumenical Centre in Geneva for more than 20 years. (...) This theological research has the aim to speak to us about Bria’s personality and ecumenical activity. In order to accomplish this goal, I will expand my research in three chapters. In the first one, I will present his biographical life. Until this moment he remains the most important Romanian theologian involved in the ecumenical dialogue. The second chapter deals with the history of the modern ecumenical movement and also with Bria’s perspective on the dialogue between Orthodoxy and ecumenism, which are for him two correlative elements. Bria comes to confront the anti-ecumenical part within the Orthodox Church who does not accept the Christian dialogue being afraid of heresy. Bria explain how through dialogue, the line between Orthodoxy and the other Christians can be overrun. In the third chapter I explain the missionary concept ‘liturgy after the Liturgy’, both historically and theologically. Being aware that there are some uncertainties around this concept I decided to clarify it in a proper way. Bria is known as the promoter of this concept, so I will search to find out who is the originator of this expression as such. In the same chapter I will analyze the ecclesiological elements from Bria’s writings. The ecumenical dialogue is interpreted of being an ecclesiological problem par excellence so I will outline Bria’s position regarding the teaching of the Church. In conclusion I will present in a synthetic way the results of this study. (shrink)

Nursing Inquiry 2010; 17: 221–230A critical analysis of health promotion and ‘empowerment’ in the context of palliative family care-givingTraditionally viewed as in opposition to palliative care, newer ideas about ‘health-promoting palliative care’ increasingly infuse the practices and philosophies of healthcare professionals, often invoking ideals of empowerment and participation in care and decision-making. The general tendency is to assume that empowerment, participation, and self-care are universally beneficial for and welcomed by (...) all individuals. But does this assumption hold for everyone, and do we fully understand the implications of health-promoting palliative care for family caregivers in particular? In this study, we draw on existing literature to highlight potential challenges arising from the application of ‘family empowerment’ strategies in palliative home-care nursing practice. In particular, there is a risk that empowerment may be operationalized as transferring technical and medical-care tasks to family caregivers at home. Yet, for some family caregivers, a sense of security and support, as well as trust in professionals, may be equally if not more important than empowerment. Relational and role concerns may also at times take precedence over a desire for empowerment. The potential implications of ‘family empowerment’ are explored in this regard. ‘Family empowerment’ approaches need to be accompanied by a strong understanding of how to best support individual palliative family caregivers. Objective Analyze racial differences in comfort with medical research using an alternative to the traditional approach that treats white people as a raceless norm.Methods Quantitative analysis of survey responses (n = 1,570) from Black and white residents of the US to identify relationships between perceptions of research as a right or a risk, and comfort participating in medical research.Results A lower proportion of white respondents reported that medical experimentation occurred without patient consent (p < 0.001) and a higher proportion (...) of white respondents reported that it should be their right to participate in medical research (p = 0.02). Belief in one’s right to participate was significantly predictive of comfort (b = 0.37, p < 0.001). Belief in experimentation without consent was significantly predictive of comfort for white respondents but not for Black respondents in multivariable analysis.Conclusions A rights-based orientation and less concern about the risks of medical research among white respondents demonstrate comparative advantage. Efforts to diversify medical research may perpetuate structural racism if they do not (1) critically engage with whiteness and its role in comfort with participation, and (2) identify and respond specifically to the needs of Black patients. Influence of other’s assessments on individuals in society and their reaction is an amusing topic, given Cooley’s Looking Glass Self concept concerning this, simultaneously being the subject of this critical analysis. The fact manifesting an opinion that an individual’s true self changes due to other perceptions is often subjected to various critical considerations, creating the impression that in reality the concept is infeasible. The purpose is determining the “hole” in the third component, proving that the true self (...) is occasionally susceptible to constant change, depending on other’s perceptions and the individual himself. Regarding the methodology, several methods were used to prove the critical attitude towards this topic. Applications of comparative analysis, descriptive and historical methods are present. Our result is concluding the individual develops a certain attitude influenced by different experiences, being crucial to whether he will be ready to change his true self or not. (shrink)

Among the means of valid cognition, the one which appears first in every enumeration, which was considered as being the basis of all other means of knowledge and which was considered as a legitimate method of knowledge by all schools of Indian thought is perception (pratyakṣa). With regard to perception, we can naturally expect such questions as ‘what is it to perceive’ or ‘what do we mean when we say that something is perceived’. It is generally believed that the philosophical (...) theories of perceptions are really theories about what we mean by ordinary perceptual statements. In considering our knowledge about the external world, the philosopher tends to consider the way in which perception can and does provide us with the knowledge and the nature, extent and certainty of knowledge it provides us with. It is a well acknowledged fact that perception is the fundamental source of knowledge. In Buddhist epistemology, a systematic discussion on perception is found in the writings of Dignāga’s Pramāṇasamuccaya with vṛitti, who belongs to Yogācāra school of Buddhism of Mahayana tradition. An attempt has been made in this paper to explain and examine critically the first chapter of Pramāṇasamuccaya with vṛitti, i.e., perception with special reference to Non-Buddhist schools, namely Nyāyayikas, Vaiśeṣikas, Sāṁkhyans and Mīmāṁsakas. To explain it, the paper has been divided into three sections. Section I deals with Dignāga’s theory of perception and examination of non-Buddhist school's theory of perception, section II deals with Dignāga’s examination of nature of Perception with reference to non-Buddhists schools and section III deals with conclusion. Australia does not allow adult smokers to buy or use electronic nicotine delivery systems that contain nicotine without a prescription. This paper critically evaluates the empirical and ethical justifications provided for the policy by Federal and State governments, public health advocates and health organisations. These are: that ENDS should only be approved as products for smoking cessation when there is evidence from randomised controlled trials that they are effective; that as a matter of precaution we should not allow the sale (...) of ENDS to smokers as consumer products because we do not know what their long-term effects will be; and that allowing ENDS to be sold as consumer goods will enable the tobacco industry to market ENDS to young people which will also lead to an increase in youth smoking. We show that the arguments and evidence offered in support of all these claims is very weak. We also argue that even if the evidence were stronger, it would not justify denying adult smokers the right to use ENDS either to quit smoking or as a long-term alternative to smoking cigarettes. We outline ENDS policies that would more ethically address the public health concerns that motivated the current policy by allowing adult smokers to access ENDS for smoking cessation or tobacco harm reduction under tight regulations that discourage commercial promotion and adolescent use. This article discusses the feedback on students’ ethics essays provided by eight markers in the Faculty of Medical Sciences at Newcastle University. It highlights significant shortcomings, including failures to identify instances where students had failed to select and to conclude on ethical issues, logical errors, misunderstandings of ethical arguments made in the literature, instances of simple deference, and a lack of critical engagement with relevant literature. Markers also made a large number of linguistic errors and, on many occasions, failed (...) to explain clearly what they meant. Some indication is given of what the cost of this might be to health care students as well as to those who are affected by the quality of their ethical decisions. The article concludes by providing some guidance on how this cost might be reduced at Newcastle University as well as in many other institutions where similar problems are likely to exist. (shrink)

Given the need for organs, public organizations use social marketing strategies to increase the number of donors. Their campaigns employ a variety of moral appeals. However, their effects on audiences are unclear. We identified 14 campaigns in Germany from over the last 20 years. Our approach combined a multimodal analysis of categorized posters with a qualitative analysis of responses, collected in interviews or focus groups, of 53 persons who were either skeptical or undecided about organ donation. The combined (...) analyses revealed that the posters failed to motivate laypersons in general to donate, and were even less effective on skeptical or undecided individuals. We explain this in terms of the types of moral messages found on posters and the limits of such social marketing strategies. Furthermore, we discuss certain ethical aspects of organ donation campaigns pertaining to communicating norms and trust in public institutions. (shrink)

Editors’ AbstractThis articles expresses a strong discontent with Sinologism and argues that its rise is the result of an uncritical application of Said’s Orientalism and postcolonial theory to Sinology, and that its proponents have committed a grave error in treating Sinology as a discourse of ideology full of subjective imaginations, to the neglect of the fact that Sinology is a branch of objective scholarship. After reviewing the evolution of the concept of Sinology in history, it critically analyzes some major ideas (...) of Sinologism in relation to Orientalism and draws the conclusion that the proponents of Sinologism are unaware of the inherent problems in Said’s theory and postmodern theory, have inadequate knowledge of Sinological history, and oversimplified the complex issues in Sinological studies. Levinas’s ethics has not been able to address the plethora of human challenges arising from the ethical quicksand and moral quandaries in our existential world. The problem of ethics in Levinas’ s philosophical cum phenomenological analysis, is the problem of human communication, social interaction, human emancipation, freedom, and existential/ metaphysical relations. Freedom has become not just a hot concept in different fields of study, but a very powerful and a driving concept. For Levinas, freedom is not just the absence (...) of constraints or impediments but obedience to laws and even the laws of nature inclusive. This paper adopted the method of hermeneutic to critically analyze Levinas’s phenomenological ethics. This paper concludes by exposing the facts that human communication or interaction is based on understanding and the ethics of difference is part and parcel of inter-subjectivity. Dasein is always faced with the fulfilment in its lived temporality. A sharing of the world is an essential characteristics of human togetherness. Dasein, in its dialogical engagement and existential commitment is usually based on freedom, strife, world sharing and resistance. Dialogical philosophy is the foremost part of world’s cosmic law of concrete social network. (shrink)

Greening Auto Jobs: A Critical Analysis of the Green Job Solution provides a major contribution to the growing and important field of environmental sociology and labor studies by providing a theoretical and practical understanding of how the broader political-economic relations of society affect the relationship between labor and the environment.

This paper focused on analysing the three very famous ethnographic works on Pukhtun Society of Swat. First, the work of Fredrik Barth “Political Leadership among Swath Pathans, was analysed then analysis of counter work to Barth’s done by Akbar S. Ahmed, “Millennium and Charisma among Pathans”, then there was critical review of the work by Charles Lindholm “Frontier Perspectives: Essays on Comaritive Anthropology”. Works of Louis Dupree, Talal Asad and Micheal Meeker, have also consulted to critically analyse the (...) works of the mentioned authors. This paper is an effort to examine the fact that the works of Fredrik Barth, Akber S. Ahmed, and Charles Lindholm present partially true picture about the socio-economic settings of Swat Pashtuns but not a fully appropriate, impartial and correct image of that society. If one would fully depend on these works to understand the economic and political circumstances of Swat society, then it would be probably insufficient and misleading owing to a significant difference in the writings of all these writers though written from the same society. It means that all of them were writing from the different positions, from separate cultural, educational and professional backgrounds. Their backgrounds have great influence on their writing, which made their work subjective and biased. Thus, it assumes that though an anthropologist tries to remain impartial and objective while writing about any culture, he cannot be, because of his cultural restriction. So, there is an effort to give an answer to the research question by applying the idea of post-modernist approach of James Clifford “writing culture”, also getting support by the Michel Foucault ideas of “Knowledge/Power” in discourse analysis. Thus, it is supposed here that work of each above mentioned authors is a partial truth, because in an ethnographic work author plays a central role and he writes ethnography as an auto-biography (based on his/her cultural limitation). I analyze the “Sportsman’s Code,” arguing that several of its rules presuppose a respect for animals that renders hunting a prima facie wrong. I summarize the main arguments used to justify hunting and consider them in relation to the prima facie case against hunting entailed by the sportsman’s code. Sport hunters, I argue, are in a paradoxical position—the more conscientiously they follow the code, themore strongly their behavior exemplifies a respect for animals that undermines the possibilities of justifying hunting altogether. Religion plays a vital role in the formation of conscience and therefore is very important in determining how people co-exist in a society. Nigerian citizens live in regions other than their ethnic geographical areas, but they are not recognised as people of the same destiny and subjects of equal rights. The long period of military dictatorship that truncated the country's democracy since the civil war gave Nigerians a constitution which adopted the Sharia legal system within a purported secular state. This (...) encouraged a wide range of religious fanaticism and led to various demands for human rights, which has become a worrisome issue to concerned Nigerians. This article used secondary sources of data, such as newspaper publications and journal articles to examine the impact of religion on the state of the Nigerian nation today. The article calls for the harmonisation of Christianity and Islamic teachings in line with the secularity of the Nigerian state in order to reduce the increasing tensions in the country and make the journey to nationhood more realistic. CONTRIBUTION: This article proposes that the secularity of the Nigerian state has to be maintained by political and religious leaders in order to attain purposeful nationhood and achieve sustainable and genuine development of the country. In African society today, ubuntu as a notion of African humanism has been, and still is, subject to critical discussion. In African literature, philosophy, ethics, anthropology and theology, ubuntu plays a vast role and scholars in Africa and globally find the notion highly debated. The concept of identity development on the African continent has been written about broadly. This article unpacks the ubuntu philosophies of Augustine Shutte, Kwame Gyekye and John Mbiti. The views of these scholars will be contrasted (...) to critically engage the conceivable commonalities for identity development through cultures. The question addressed herein is: What are the similarities and dissimilarities of ubuntu as a cornerstone for identity development in modern Africa? This article also examines the divergent definition and historical development of ubuntu culture, ubuntu philosophy of identity development, environmental development and various thinkers’ understanding of this African worldview in current Africa and further afield. Contribution: This research contributes to African theological ethics of the new landscape identity and explores the ubuntu worldviews as a developmental process of identities across cultures.
