In liberal political theory, meaningful work is conceptualised as a preference in the market. Although this strategy avoids transgressing liberal neutrality, the subsequent constraint upon state intervention aimed at promoting the social and economic conditions for widespread meaningful work is normatively unsatisfactory. Instead, meaningful work can be understood to be a fundamental human need, which all persons require in order to satisfy their inescapable interests in freedom, autonomy, and dignity. To overcome the inadequate treatment of meaningful work by liberal political (...) theory, I situate the good of meaningful work within a liberal perfectionist framework, from which standpoint I develop a normative justification for making meaningful work the object of political action. To understand the content of meaningful work, I make use of Susan Wolf’s distinct value of meaningfulness, in which she brings together the dimensions of objectivity and subjectivity into the ‘bipartite value’ of meaningfulness (BVM) (Wolf, Meaning in life and why it matters, 2010). However, in order to be able to incorporate the BVM into our lives, we must become valuers, that is, co-creators of values and meanings. This demands that we acquire the relevant capabilities and status as co-authorities in the realm of value. I conclude that meaningful work is of first importance because it is a fundamental human need, and that society ought to be arranged to allow as many people as possible to experience their work as meaningful through the development of the relevant capabilities. This article concerns the ways in which authors from various fields conceptualise the ethical issues arising in the conduct of research. We reviewed critically and systematically the literature concerning the ethics of conducting research in order to engage in a reflection about the vocabulary and conceptual categories used in the publications reviewed. To understand better how the ethical issues involved in conducting research are conceptualised in the publications reviewed, we 1) established an inventory of the conceptualisations reviewed, and 2) we (...) critically assessed them. We found that the publications reviewed mostly showed examples of descriptive ethics, in that most authors describe ethical issues without reflecting much on them, which could be explained both by 1) a lack of ethical education in research contexts, and 2) by the fact that we do not know what researchers know (or do not) about ethical issues. Additionally, the definitions identified in the publications are scarce and at times imprecise, but this seems more to point out the ethical vocabulary’s difficulties in certain contexts. Further, very few authors offer proper conceptualisations of the ethical issues arising in conducting research. When dealing with vast arrays of ethical issues to conceptualise, perhaps one ought to remember that some typologies already exist that could guide further reflection and help understand other realities for which the current ethical vocabulary may be lacking. We believe that combining the reviewed typologies, both with other well-developed typologies and critical reflection, could help support better ethical practice in conducting research. (shrink)

The term ‘moral resilience’ has been gaining momentum in the nursing ethics literature. This may be due to it representing a potential response to moral problems such as moral distress. Moral resilience has been conceptualised as a factor that inhibits immoral actions, as a favourable outcome and as an ability to bounce back after a morally distressing situation. In this article, the philosophical analysis of moral resilience is developed by challenging these conceptualisations and highlighting the risks of such limiting perspectives. (...) It is argued that moral resilience is best understood as a virtue with two associated vices, faintheartedness and rigidity. The intellectual virtue of practical wisdom is required to express resilience as a virtue. We frequently engage in activities that impose a risk of serious harm on innocent others in order to realise trivial benefits for ourselves or third parties. Many moral theories tie the evidence-relative permissibility of engaging in such activities to the size of the risk that an individual agent imposes. I argue that we should move away from such a reliance on quantified individual risks when conceptualising morally permissible risk imposition. Under most circumstances of interest, a conscientious reasoner will identify a (...) gap between the factors they deem potentially relevant to the riskiness of an agent’s behaviour, and the factors they are reasonably able to quantify. This then leads a conscientious reasoner to conclude that they cannot, in good faith, come up with a quantitative risk estimate that is genuinely tailored to the agent’s particular situation. Based on this, I argue that principles of morally permissible risk imposition fail to provide us with practical guidance if they ask us to take into account our agent-specific risks in a quantified manner. I also argue that principles of permissible risk imposition which appeal to quantified individual risks implausibly imply that it is frequently indeterminate whether engaging in some risky activity is morally permissible. For both of these reasons, I contend that principles of morally permissible risk imposition should make no reference to quantified individual risks. They should instead acknowledge that any quantitative estimates that an agent might usefully be able to consider will likely not be tailored to the agent’s idiosyncratic situation. (shrink)

The present article focuses on the conceptual structures of two Arabic words which are used in both everyday life and science: كَهْرَبَاء (kahrabāʾ) (electricity) and ضَوْء (ḍawʾ) (light). Under a cognitive linguistics approach, the polysemy of these terms, revealed in the citations extracted from ArabiCorpus, is studied. More specifically, the analysis of the terms involves the polysemy or ‘radial category’ along with its prototypical and peripheral meanings, and the main factors in projecting the idealised cognitive models (ICMs) where the radial (...) categories are formed: conceptual metaphor and conceptual metonymy. The results indicate that power and knowledge motivate the conceptualisations that underpin the categories كَهْرَبَاء (kahrabāʾ) (electricity) and ضَوْء (ḍawʾ) (light) respectively. Using such non-scientific conception in understanding the scientific senses of these terms leads to students’ confusion and failure to understand them. To ensure that students construe the scientific concepts correctly, they must be mindful of the inconsistency between their non-scientific and scientific meanings. (shrink)

The present study focused on the dynamics and factors underpinning domestic abuse survivors’ decisions to end the abusive relationship. The experiences and opinions of 12 female DA survivors and 18 support workers were examined through in-depth, one-to-one, semi-structured interviews. Hybrid thematic analysis was conducted to retrieve semantic themes and explore relationships among the themes identified and the differences in survivors’ and professionals’ narratives of the separation process. The findings highlighted that separation decisions derived from the joint action of two sets (...) of factors, the “promoters” and the “accelerators.” Whilst the “promoters” are factors leading to the separation from the abuser over time, the “accelerators” bear a stronger and more direct connection with survivors’ decision to end the abusive relationship. Despite their differences, both these factors acted as propelling forces, leading survivors to actively pursue the separation from the perpetrator. To portray the dynamic links among these factors, we propose a conceptualisation drawn from Newton’s laws of motion. Our findings also highlighted important differences in the views of survivors and support workers, as the former conceived themselves as proactive in ending the abuse, whereas the latter described the leaving process as mainly led by authorities and services supporting survivors. This study has potential implications for research, policy and clinical practice, as it suggests that far from being a linear sequence of multiple stages, leaving an abusive relationship results from a complex interplay of factors that facilitate or drastically accelerate the separation process. We argue that future research should aim at improving our current understanding of the subjective and situational factors that can act as “accelerators” or “promoters” for women’s leaving decisions. Moreover, clinicians and policymakers should invest in creating interventions that aid victims to recognise and leverage promoters and accelerators, thus increasing their readiness to end the abuse. People who are unable to make decisions about participating in research rely on proxies to make a decision based on their wishes and preferences. However, patients rarely discuss their preferences about research and proxies find it challenging to determine what their wishes would be. While the process of informed consent has traditionally been the focus of research to improve consent decisions, the more conceptually complex area of what constitutes ‘good’ proxy decision-making for research has remained unexplored. Interventions are needed to (...) improve and support proxy decision-making for research but are hampered by a lack of understanding about what constitutes decision quality in this context. A global increase in conditions associated with cognitive impairment such as dementia has led to an urgent need for more research into these conditions. The COVID-19 pandemic and subsequent necessity to conduct research with large numbers of critically ill patients has made this need even more pressing. Much of the empirical research centres on the desire to improve decision accuracy, despite growing evidence that authenticity is more reflective of the aim of proxy decisions and concerns about the methodological flaws in authenticity-focused studies. Such studies also fail to take account of the impact of decision-making on proxies, or the considerable body of research on improving the quality of healthcare decisions. This paper reports a concept synthesis of the literature that was conducted to develop the first conceptualisation of ‘good’ proxy decisions about research participation. Elements of decision quality were identified across three stages of decision-making: proxy preparedness for decision-making which includes knowledge and understanding, and values clarification and preference elicitation; the role of uncertainty, decisional conflict, satisfaction and regret in the decision-making process; and preference linked outcomes and their effect. This conceptualisation provides an essential first step towards the future development of interventions to enhance the quality of proxy decision-making and ensure proxy decisions represent patients’ values and preferences. When examining the human being as a conscious being, we are still to arrive at an understanding of, firstly, the conditions required whereby physical processes give rise to consciousness and secondly, how consciousness is something fundamental to life as an intrinsic part of nature. Humans are complex organisms with myriad interacting systems whereby the convergence of the activities toward the support and development of the whole organism requires a high level of organisation. Though what accounts for the dynamic unity of (...) the human being? From an empirical perspective the question remains unanswered. The aim of this paper is to conceptually establish a fundamental biophysical organising principle to account for the unity and organisation of the human being. To this end I draw from David Bohm’s interpretation of quantum theory to provide an adapted and adjunct conceptual scheme in the form of a Triple-Aspect-Theory (TAT) of Being as a grounding ontology. David Bohm presented a holistic view of two interwoven orders of existence defined as the Explicate material world and the Implicate (quantum) enfolded world from which the former materialises. Consistent with David Bohm’s idea that matter at a fundamental level consists of a kind of protointelligence, the TAT facilitates a perspective based on aspect conditions of the human organism intended to furnish an explanation of the constitutive mechanism (TAT) inherent in the evolving human being. The TAT operates as an organising principle by which evolution inherently proceeds and maintains itself in an interactive relation between the Implicate and Explicate orders. The accumulated effect of natural selection is to produce adaptations, but without an organising principle: ‘Consciousness’, ‘Body-of-Experience’ and ‘Intellect-Reflective’ (the terms for the engaged coexistent aspects of being) it is argued could not occur. There are limits to it: it has more to do with non-statal actors, it relates to trans-border cultural, political and economic spaces, and it follows identity-defining experiences of individuals who have lived a complex, international life. Complex and urgent challenges including climate change and the significant decline in biodiversity provide a broad agenda for interdisciplinary scholars interested in the implications facing businesses, humanity, and other species. Within this context of sustainability, persistent conflicts between key paradigms create substantial barriers against—but also opportunities for—developing new conceptual approaches and theoretical models to understand and respond to these critical issues. Here, I revisit paradigmatic tensions to assess their impact on research and debate on sustainability, ethics, and business. Drawing on (...) relational ontology and values of nature that recognise humanity’s tight embeddedness within the planetary ecosystem, I examine how conceptualising sustainability as the _pursuit of life_ might generate new insights for research and practice into the wider transformation needed to sustain and restore socioecological systems. The aim here, however, is not to reconcile these paradigmatic tensions but instead use them as a fruitful lens for examining the implications for sustainability, while acknowledging the inherent ethical dilemmas for individuals, organisations, and society. Recently, some authors have claimed that, from a republican perspective, market relations are dominating. However, _prima facie_, this idea does not fit within the (neo-)republican conceptualization of domination, which models domination on the master-slave relation. The aim of this article is to twofold. First, I try to argue that market relations can be seen as dominating. Second, I attempt to show that this can be done through an extension of the (neo-)republican conceptualization of domination. I try to achieve this by (...) comparing the master-slave relation with the accounts of those authors who maintain that market relations entail domination. This comparison reveals that there are fundamental similarities between the master-slave relation and the dynamics within market relations that are identified as dominating. What they have in common is the specific harm of domination, which I call the ‘logic of domination’. However, where the master-slave relation and market relations diverge is in the characteristics of the relation that causes the logic of domination to materialize. I argue that Pettit’s concept of discursive control allows us to extend his account of domination in such a way that we can conceive of market relations as dominating. (shrink)

Since its inception, donor conception practices have been a reproductive choice for the infertile. Past and current practices have the potential to cause significant and lifelong harm to the offspring through loss of kinship, heritage, identity, and family health history, and possibly through introducing physical problems. Legislation and regulation in Australia that specifies that the welfare of the child born as a consequence of donor conception is paramount may therefore be in conflict with the outcomes. Altering the paradigm to a (...) child-centric model, however, impinges on reproductive choice and rights of adults involved in the process. With some lobby groups pushing for increased reproductive choice while others emphasise offspring rights there is a dichotomy of interests that society and legislators need to address. Concepts pertaining to a shift toward a child-centric paradigm are discussed. (shrink)

This paper attempts a conceptualisation of authority intended to be useful across all areas where the concept is relevant. It begins by setting off authority against power, on the one hand, and respect, on the other, and then spells out S1’s authority as consisting in S2’s voluntary action performed in the belief that S1 would approve of it. While this definition should hold for authority generally, a distinction is made between three different kinds of authority according to what grounds (...) them: personal, acquired and bestowed authority. Authority thus defined is then used as an example to argue that there is a kind of property that is response-dependent , but, consisting in all and only a response, is ontologically different from both secondary qualities and value judgments. While secondary qualities are interactive in that they depend on both the object and the perceiver and on what they are like, genuinely R-D qualities depend ontologically and metaphysically only on the responder. This paper looks at how digital humanities can modify our more traditional understanding and conceptualisation of literary characters. Through the analysis of cast lists from more than 880 French plays from 1630 to 1810, and the “close reading” of some sample texts, it proposes a classification of units of characterisation that can be identified in plays. In the last part, the paper sketches a protocol for the encoding of these characters in a TEI conformant way, and discusses the advantages (...) and the drawbacks of such an endeavour. (shrink)

In the philosophy of well-being, there is hardly anything written on the lives of people with autism or on the question whether existing philosophical theories of well-being are suited for understanding how well the lives of autistic persons are going. This paper tries to make some progress towards filling this gap. I start by giving a concise account of autism, which highlights the huge heterogeneity among autistics. I discuss some basic features of autism, ask whether there are good reasons why (...) we would need an account of well-being specifically for autistics and what philosophical well-being research could learn from being informed by autistic experiences and phenomenology. I then investigate to what extent the capability approach gives us a helpful theory of well-being for autistics, and what looking through an autism-lens can contribute to the further development of the capabilitarian well-being. In particular, I show that some capabilities that are crucially relevant for autistics are also relevant for the lives of non-autistic people. The final part of the paper looks at an important difficulty in using the capabilitarian account of well-being for autistics, namely: should the normative focus be on achievements (functionings) or real opportunities (capabilities)? This article examines conceptualisations of violence against women developed in Brazilian feminism, and in legal and institutional measures against violence, from the 1980s to the present. Based on ethnographic studies carried out at the Women’s Police Stations and Special Criminal Courts, and the controversies surrounding the 2006 Brazilian Law on domestic and familial violence, the authors map the meanings of expressions such as ‘violence against women’, ‘marital violence’, ‘domestic violence’, ‘family violence’ and ‘gender violence’. The article reveals that the discourse (...) that transforms violence into crime, in the Brazilian context, leads to semantic and institutional developments that replace an interest in politicising justice for the defence of women with the judicialisation of family relations. Certes, les normes, règlements et directives ne représentent pas tout le droit, mais les relations entre concepts nouveaux (totalement partagés) et concepts anciens (partiellement partagés ou non partagés) tendent à permettre une (...) explicitation des points communs et des différences. Il ne s’agit pas ici de droit comparé, mais de terminologie comparée, ou plutôt de confrontation terminologique. L’idée principale est qu’il faut distinguer ce qui est partagé entre experts (c’est-à-dire des conditions nécessaires et suffisantes) et ce qui ne l’est pas (ce qui est plus ou moins «encyclopédique» ou «idiomatique»). Une autre conviction, fondée sur les versions parallèles et les définitions spécialisées, est qu’il existe un vocabulaire juridique fondamental, vecteur de concepts minimaux partagés. Neurodevices that collect neural (or brain activity) data have been characterised as having the ability to register the inner workings of human mentality. There are concerns that the proliferation of such devices in the consumer-directed realm may result in the mass processing and commercialisation of neural data (as has been the case with social media data) and even threaten the mental privacy of individuals. To prevent this, some argue that all raw neural data should be conceptualised and regulated as “medical (...) data” even if it is collected from consumer-directed devices in obviously non-clinical settings. In this paper, we argue that without a clearer formulation of what does and does not count as medical data, this approach might also uncritically enlarge the scope for medical influence and an unwarranted medicalisation of everyday aspects of mental life. Indeed, if we were to accept the position that all neural data is medical data because it offers insights into personally sensitive information (such a person’s thoughts, emotions, or intentions) then this could even unnecessarily expand the boundaries of medical data to other forms of data that otherwise seem to be non-clinical. If all brain data (neural activity data) is considered to be medical data even when collected from consumer-directed devices then we might unintentionally reduce meaningful distinctions between what is and what is not rightfully in the purview of medicine. Since the dawn of the internet, pornography has effectively become ubiquitous, pervasive, and increasingly normalised. Study findings show remarkable similarities in how the brain reacts to pornography, and other known addictive substances, and indicate that consuming pornography is comparable to consuming other known addictive substances. Moreover, two of the biggest risk factors for addiction are the substance’s availability and its easy accessibility, particularly in the case of younger persons. To date, pornography addiction has been conceptualised as a behavioural addiction. However, (...) the body of research data on pornography addiction does not provide conclusive support for behavioural addiction. The aim of this thesis is to put forward the idea that pornography can, and should, be conceptualised as an addictive substance, and, that when pornography is consumed, an addictive substance is consumed. In order to support this claim, there are many factors that must be addressed. I first clarify what pornography entails by exploring how it is conceptualised, what pornography ‘does’, and what it means to be a pornography consumer. Secondly, I examine the conceptualisations of substances, substance consumption and addiction, respectively, as well as the subsequent difference between substance and behavioural addiction. Thirdly, I give an inclusive overview of pornography addiction by not only examining the most recent perspectives of researchers, but also of pornography consumers. I conclude by suggesting how we should go about conceptualising pornography addiction, and then propose how the set of diagnostic criteria for pornography use disorder should be formulated for a future iteration of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders. I argue that, given the abundance of academic research on substance addiction, compared to the scarcity of research on behavioural addiction, conceptualising pornography as an addictive substance is more likely to create a sense of urgency for the future research of pornography addiction than would be the case if it is considered a potential behavioural addiction. Furthermore, I argue that the classification of pornography as an addictive substance, and the inclusion of pornography use disorder in a future iteration of the DSM, will raise awareness of the potential adverse effects of pornography consumption and, therefore, the harmful consequences of pornography use disorder. Academic data show little evidence that the concept of the missio hominum was ever explored beyond its context as developed by Nico Smith. There is little to no research that has conceptualised this phenomenon in light of imago Dei and the role it should play in fulfilling missio Dei’s mandate. It uses the relational nature of the Union of the Divine Trinity derived in imago Dei to conceptualise the idea of the missio hominum in the broader context of missio Dei. (...) It aims to examine the role of missio hominum in fulfilling the objectives and scope of missio Dei. Missio Dei here means the mission of God, which uses human relationships as an instrument to achieve the eternal goal of missio Dei. Nico Smith’s account is used here to support the need for missio hominum within the broader understanding of missio Dei. This research is a first step towards a deeper understanding of the missio hominum in service to missio Christos and missio spiritus and the collective participation of missio ecclesiae towards the goal of missio Dei. The academic focus on missio hominum from Smith’s perspective is lacking or neglected by missiology scholars.Contribution: This article, therefore, presents overarching research areas in missiology, which are important for the overall and further understanding of missio Dei. The events surrounding the ‘Arab Spring’ have attracted an enormous amount of attention by the international press as well as on social media platforms, especially in its initial phase in early 2011. This article investigates how violent and forceful actions during the ‘Arab Revolutions’ were conceptualised linguistically by incorporating notions of Cognitive Semantics in a critical comparative study of press reports and Twitter posts. Focus is placed specifically on combining Talmy’s theory of Force Dynamics with methods of Critical Discourse Studies (...) in order to investigate diverging forms of schematisation of forceful interactions among protest participants. The most frequently recurring opposing force-dynamic patterns identified are defying a hindrance, prevailing stability and causation of action as well as inaction. Cette étude met en relief la portée empirique de la définition du concept d’anglicisme dans l’analyse d’anglicismes lexicaux dans un corpus de presse écrite francophone. Elle examine en diachronie (2000-2015) les différences découlant de l’opposition entre trois acceptions de l’anglicisme ainsi que les effets sur des analyses comparatives portant sur l’origine géographique (France ou Québec) et sur la nature (« de référence » ou « populaire ») du journal. ABSTRACTHumiliation lacks an empirically derived definition, sometimes simply being equated with shame. We approached the conceptualisation of humiliation from a prototype perspective, identifying 61 features of humiliation, some of which are more central to humiliation than others. Prototypical humiliation involved feeling powerless, small, and inferior in a situation in which one was brought down and in which an audience was present, leading the person to appraise the situation as unfair and resulting in a mix of emotions, most notably disappointment, (...) anger, and shame. Some of the features overlapped with those of shame whereas other features overlapped with those of anger. Which specific features are present may determine whether the humiliation experience becomes more shame- or anger-like. (shrink)

La nécessité d’une approche anthropologique du concept d’identité provient de la nature de l’identité, qu’elle soit personnelle ou collective, qui n’est pas un phénomène « donné naturellement », mais une forme, culturellement définie et construite, de la vie humaine dans un milieu culturel en tant que « seconde nature » ; celle-ci conditionne et conceptualise humainement les différents « modes de vie » des individus et des peuples. Étant donné que la culture représente le contexte essentiel de la vie sociale (...) et individuelle de l’homme, elle fournit un modèle pour un mode de vie et de pensée commun de l’expérience collective, comme cadre des valeurs de référence sur lequel s’appuient les définitions et les interprétations de l’identité. Ainsi, le paradigme culturel permet aux chercheurs de comprendre ce que signifie l’identité dans des conditions socio-historiques et des connotations idéologiques différentes, en assumant un concept dynamique inverse du modèle national d’identité, qui lui est lié aux groupes ethniques et exclut la possibilité du changement. Le texte traitera également de la conceptualisation, orientée traditionnellement, de l’identité en Serbie, ainsi que de son influence sur la lenteur des changements dans la transition démocratique en ce nouveau millénaire. It first compares the problem of health insurance coverage to the problem of unemployment to show that in terms of the numbers of individuals affected lack of health insurance is a problem comparable in importance to the problem of unemployment. Secondly, the paper discusses the methodology involved in measuring health insurance coverage, and argues that the current method of estimation of the uninsured underestimates (...) the extent that individuals go without health insurance. Third, the paper briefly introduces Amartya Sen's functionings and capabilities framework to suggest away of representing the extent to which individuals are uninsured. Fourth, the paper sketches a means of operationalizing the Sen representation of the uninsured in terms of the disability-adjusted life-year (DALY) measure. (shrink)

In this article, we sought reconciliation between the “body‐as‐representation” and the “body‐as‐experience,” that is, how the body is represented in discourse and how the body of older people with cognitive impairment is experienced. We identified four contemporary “technologies” and gave examples of these to show how they influence how older people with cognitive impairment are often represented in acute care settings. We argued that these technologies may be mediated further by discourses of ageism and ableism which can potentiate either the (...) repressive or productive tendencies of these technologies resulting in either positive or negative care experiences for the older person and/or their carer, including nurses. We then provided examples from research of embodied experiences of older people with dementia and of how nurses and other professionals utilized their inter‐bodily experiences to inform acts of caring. The specificity and individuality of these experiences were more conducive to positive care experiences. We conclude the article by proposing that the act of caring is one way nurses seek to reconcile the “body‐as‐representation” with the “body‐as‐experience” to mitigate the repressive effects of negative ageism and ableism. The act of caring, we argue, is the essence of caring enacted through the provision of person‐centred care which evokes nurses to respond appropriately to the older person's “otherness,” their “variation of being” while enabling them to enact a continuation of themselves and their own version of normality. In 2009, with the enactment of the Lisbon Treaty, the Charter of Fundamental Rights of the European Union entered into force. Under Article 8 of the Charter, for the first time, a stand-alone fundamental right to data protection was declared. The creation of this right, standing as a distinct right to the right to privacy, is undoubtedly significant, and it is unique to the European legal order, being absent from other international human rights instruments. This commentary examines the parameters of (...) this new right to data protection, asking what are the principles underpinning the right. It argues that the right reflects some key values inherent in the European legal order, namely: privacy, transparency, autonomy and nondiscrimination. It also analyses some of the challenges in implementing this right in an era of ubiquitous veillance practices and Big Data. (shrink)

This comprehensive and authoritative statement of fundamental principles of sociological analysis integrates approaches that are often seen as mutually exclusive. John Scott argues that theorising in sociology and other social sciences is characterised by the application of eight key principles of sociological analysis: culture, nature, system, structure, action, space-time, mind and development. He considers the principal contributions to the study of each of these dimensions in their historical sequence in order to bring out the cumulative character of knowledge. Showing that (...) the various principles can be combined in a single disciplinary framework, Scott argues that sociologists can work most productively within an intellectual division of labour that transcends artificial theoretical and disciplinary differences. This article undertakes to explain the importance of discourse in the modern philosophy of law. It conceptualises discourse as a step to the comprehensive truth of a phenomenon, which does not exist in most forms of modern methods. Therefore, modern philosophy of law must be sought through a vigorous application of the method of discourse in deducing the diversity of truth-seeking in modern legal doctrine and the application of law in contemporary society. In this article, the author endeavours to systemise (...) that discourse is capable of comprehending a single absolute fact in legal doctrine and law, which is necessary to produce the exact procedures in society. Thus, discourse unfolds the relationship between the known and the unknown into a philosophical principle. It is then conceivable that discourse by its deduction creates societal forms and substances for the investigator to understand the true form and nature of law in society. This chapter describes the application of reduction concepts in emergence and self organization of complex dynamical system. Condition-dependent laws compress and dynamical equation sets provide implicit compressed representations even when most of that information is not explicitly available without decompression. And, paradoxically, there is still the determined march of fundamental analytical dynamics expanding its compression reach toward a Theory of Everything—even while the more rapidly expanding domain of complex systems dynamics confronts its assumptions and its monolithicity. Nor does science fall (...) apart into a disunified aggregate of particular cases since, with fundamental dynamics as a backbone, complex matching up of models across theoretical and empirical domains then articulates its model-structured skeleton. Discussion provides the delicately entwined dance of emergence and reduction providing constraints on compression that also permit its expansion. However, while the vision is not dead, it is currently substantially more complexly structured through model similarities and differences than that initially envisaged and individuals are left with deep questions about compression unresolved. Educational researchers are increasingly striving on the edge of possibility to re-imagine and realise the future. Activist scholarship requires appropriate philosophical and theoretical bases, what Stetsenko refers to as ‘dangerous’ – useful in the struggle for a better world. How might praxis, agency and learning be charged with transgressive spirit? This paper considers the Theory of Practice Architectures and Transformative Activist Stance, established frameworks that dangerously address praxis, agency and learning. Adopting a postabyssal approach, contributions from the Global South and (...) East are drawn on to develop an epistemologically plural basis for thinking differently about praxis, agency and learning. Recent Latin American scholarship reinvigorates Freirean ideas through connections with Fals Borda and contemporary feminist pedagogues, centred on a notion of feeling-thinking. Luitel’s interpretations of Vedic philosophy provide radically different ideas of negative dialectics, chaos, responsibility and liberation. An open-minded, open-hearted, open-ended approach is crucial to making these ideas more useful in the struggle over alternative, more equitable and just futures. (shrink)

This article investigates the code of holiness as well as the objectives of holiness in the Gospel of John. The en route to holiness will be dealt with in a following article, 'Conceptualizing holiness in the Gospel of John: the en route to holiness and the character of holiness '. In the Gospel of John, the holiness of the trinity constitutes the theological environment for the code of holiness and forms the basis for the exhortation to holiness. The code of (...) holiness is described in the light of the interaction of three levels of relationships: the unity between Father and the Son as the example of holiness, the unity between Jesus and the disciples as the basis for holiness and the unity among the disciples as the inducting objective for holiness. For the Fourth Evangelist, the objective of holiness is fourfold: The first objective is to constitute a unity among the followers of Jesus, although it is not explicitly defined in this context. The second objective refers to the preparation of Jesus' disciples to continue Jesus' mission. The third objective for holiness is that the world may believe and may know that God has sent his Son. The fourth and the ultimate objective is the glorification of God. (shrink)

J’explore de façon critique la supposition du DSM[1] et de théoriciens tels que Wakefield et Gert selon laquelle les troubles mentaux doivent être attribués à un individu plutôt qu’à un groupe de personnes. Cette supposition est particulièrement problématique en pédopsychiatrie où le système familial est très souvent au centre de l’attention clinique. Il y a bien sûr des éléments de preuve substantiels indiquant que certains troubles mentaux des individus sont causés par leurs relations avec les autres et que leur guérison (...) est grandement facilitée en traitant le groupe, tel que la famille, comme un tout. Malgré cela, il y a eu beaucoup moins de travail conceptuel visant à définir ce que cela pourrait être pour un couple, une famille ou un autre groupe que de se voir attribuer un trouble mental. Pour traiter de cette question, j’utilise un débat entre Wakefield et Murphy et Woolfolk sur la question de savoir s’il fait partie du concept de trouble mental que celui-ci soit causé par une dysfonction interne de la personne. Je discute aussi de la proposition faite par Bolton d’abandonner complètement le concept de trouble mental et d’utiliser plutôt le concept, plus large, de problème de santé mentale. Je soutiens qu’en fin de compte le caractère individuel des troubles mentaux ne constitue pas une vérité conceptuelle a priori, et qu’il faut faire intervenir des considérations pragmatiques pour décider s’il est utile de nous limiter à une telle définition ou si nous pourrions être mieux servis par une définition plus extensive. Je fais le lien avec le pragmatisme et je soutiens qu’une approche pluraliste non réductive est particulièrement appropriée en pédopsychiatrie.I critically explore the assumption of the DSM and theorists such as Wakefield and Gert that mental disorder must be attributed to an individual rather than a group of people. This assumption is especially problematic in child and adolescent psychiatry where very often the focus of clinical attention is the family system. There is of course substantial evidence that some mental disorders of individuals are caused by their relationships with other people and that their recovery is greatly facilitated by treating the group, such as a family, as a whole. However, there has been much less conceptual work on defining what it might be for a couple, family or other group to itself be attributed a mental disorder. To address this issue, I employ a debate between Wakefield , Murphy and Woolfolk on whether it is part of the concept of a mental disorder that it is caused by an internal malfunction of a person. I also discuss the proposal of Bolton that we do away with the concept of mental disorder altogether and instead use a broader concept of mental health problem. I argue that ultimately it is not an a priori conceptual truth that mental disorders are individual, and we need to bring in pragmatic considerations to decide whether it is helpful to restrict ourselves to such a definition or whether we could be better served by a more expansive definition. I link this to the philosophical view of pragmatism and argue that a pluralistic nonreductive approach is especially appropriate in child and adolescent psychiatry. (shrink)

Improving surgical interventions is key to improving outcomes. Ensuring the safe and transparent translation of such improvements is essential. Evaluation and governance initiatives, including the IDEAL framework and the Macquarie Surgical Innovation Identification Tool have begun to address this. Yet without a definition of innovation that allows non-surgeons to identify when it is occurring, these initiatives are of limited value. A definition seems elusive, so we undertook a conceptual study of surgical innovation. This indicated common conceptual areas in discussions of (...) innovation, that we categorised alliteratively under the themes of “purpose”, “place”, “process”, “product” and “person”. These conceptual areas are used in varying—sometimes contradictory—ways in different discussions. Highlighting these conceptual areas of surgical innovation may be useful in clarifying what should be reported in registries of innovation. However our wider conclusion was that the term “innovation” carries too much conceptual baggage to inform normative inquiry about surgical practice. Instead, we propose elimination of the term “innovation” from serious discourse aimed at evaluation and regulation of surgery. In our view researchers, philosophers and policy-makers should consider what it is about surgical activity that needs attention and develop robust definitions to identify these areas: for our own focus on transparency and safety, this means finding criteria that can objectively identify certain risk profiles during the development of surgery. We shall consider this space not as a thing in itself, but in terms of its old and new interactions with the countries of western Europe, in order to understand the phenomena of reconstructed identities in general, in the context of their relationship to the period of globalisation (...) in which we now find ourselves. This paper addresses the impact of genetic advances and understandings on our concept of the self and the individual. In particular it focuses on conceptions of the ‘autonomous individual’ in the post-Enlightenment tradition and in bioethics. It considers the ascendancy of the autonomous individual as the model of the self and describes the erosion of substantial concepts of the self and the reduction of the self to “the will”—with the accompanying values of freedom, choice and autonomy. This conception of the (...) self as an isolated, autonomous individual, characterised by acts of ‘will’ is then critiqued drawing on both theoretical sources, particularly the work of Iris Murdoch, and practical sources, namely the difficulties raised by genetics. Our aim with this paper is to investigate the phenomenon of multiple-marking in NZE. We endeavour to find a common label to describe different grammatical features of NZE. Three constructions are analysed here. Nonagreement in there-existentials, multiple negation, and multiple comparison. In addition, we also examine the sub-varieties of NZE and aim to find tendencies between a standard (Pākehā English – PE) and an Indigenous variety of English (Māori English – ME). As we are interested in the role sociolinguistic factors (...) (such as speakers’ ethnicity) play in the constructions, our data are extracted from the Wellington corpus of spoken New Zealand English. Moreover, our findings reveal that multiple-marking is frequent in NZE; that PE and ME show similar productivity in multiple-marking constructions; and that sociolinguistic factors contribute to how speakers make linguistic choices. Our paper concludes by revisiting our research questions and providing suggestions for further research. (shrink)

Recent conceptual developments in the psychology of gender can be productively applied to understanding two facets of emotion: the biological manifestation of emotion and the psychological embodiment of emotion. Gender researchers distinguish between sex, the biologically based categories of female and male and gender, the psychological features that are often associated with biological states and that involve social categories rather than biological categories. In other words, the term sex is used to refer to the physical fact of primary and secondary (...) sex characteristics; the term gender is used to refer to a psychological and cultural construct, a loose translation of sex into social terms. It is proposed that two analogous facets of emotion can be identified, namely, one which is comprised of emotion's hardwired, pan-cultural, developmentally persistent qualities, the analogue to sex. The second, constructed aspect of emotion is the analogue to gender. Six dimensions on which sex and gender can be contrasted are described, and the application of each to the study of emotion is discussed. (shrink)
