This paper points out some problems with two recent logical systems – one due to Prakken and Sartor, the other due to Kowalski and Toni – designedfor the representation of defeasible arguments in general, but with a specialemphasis on legal reasoning.

This paper takes part in the ongoing debate on how emotions can be dealt with by argumentation theory. Its main goal is to formulate a relationship between emotion and argumentation which differs from that usually found in most of the literature on the subject. In the “standard” conception, emotions are seen as the objects of appeals which function as adjuvants to argumentation: speakers appeal to pity, fear, shame and the like in order to enhance the cogency of an argument (...) which bears on something else—whether it be the validity of a disputable opinion or the opportunity of a course of action. According to the “alternative” conception which I propose to consider, emotions themselves may be viewed, in some cases, as the very objects of argumentation. This conception lays emphasis on the arguability of emotions. Drawing on insights from current psychological and philosophical theories, it involves a reassessment of the Aristotelian concept of pathos, as well as an in-depth critical discussion of normative and descriptive approaches to emotional appeals. In the 1980s, Pollock’s work on default reasons started the quest in the AI community for a formal system of defeasible argumentation. The main goal of this paper is to provide a logic of structured defeasible arguments using the language of justification logic. In this logic, we introduce defeasible justification assertions of the type t : F that read as “t is a defeasible reason that justifies F”. Such formulas are then interpreted as arguments and their acceptance semantics is given (...) in analogy to Dung’s abstract argumentation framework semantics. We show that a large subclass of Dung’s frameworks that we call “warranted” frameworks is a special case of our logic in the sense that Dung’s frameworks can be obtained from justification logic-based theories by focusing on a single aspect of attacks among justification logic arguments and Dung’s warranted frameworks always have multiple justification logic instantiations called “realizations”. We first define a new justification logic that relies on operational semantics for default logic. One of the key features that is absent in standard justification logics is the possibility to weigh different epistemic reasons or pieces of evidence that might conflict with one another. To amend this, we develop a semantics for “defeaters”: conflicting reasons forming a basis to doubt the original conclusion or to believe an opposite statement. This enables us to formalize non-monotonic justifications that prompt extension revision already for normal default theories. Then we present our logic as a system for abstract argumentation with structured arguments. The format of conflicting reasons overlaps with the idea of attacks between arguments to the extent that it is possible to define all the standard notions of argumentation framework extensions. Using the definitions of extensions, we establish formal correspondence between Dung’s original argumentation semantics and our operational semantics for default theories. One of the results shows that the notorious attack cycles from abstract argumentation cannot always be realized as justification logic default theories. (shrink)

“Deductivism” is a broad label for various theories that emphasize the importance of deductive argument in contexts of rational discussion. This paper makes a case for a very specific form of deductivism. The paper highlights the dialectical importance of advancing deductively valid arguments in natural-language reasoning. Sections 2 and 3 explain the various forms that deductivism has taken. Section 4 makes a case for a particular form of deductivism. Section 5 discusses the value of deductive argument in law. (...) This is my response to a premise-by-premise argument in Anca Gheaus’s “Biological Parenthood: Gestational, Not Genetic.”.

Research has shown that the construction of visual representations may have a positive effect on cognitive skills, including argumentation. In this paper we present a study on learning argumentation through computer-supported argument diagramming. We specifically focus on whether students, when provided with an argument-diagramming tool, create better diagrams, are more motivated, and learn more when working with other students or on their own. We use learning analytics to evaluate a variety of student activities: pre and post questionnaires (...) to explore motivational changes; the argument diagrams created by students to evaluate richness, complexity and completion; and pre and post knowledge tests to evaluate learning gains. It is argued that, contrary to prevailing opinion, Bas van Fraassen nowhere uses the argument from underdetermination in his argument for constructive empiricism. It is explained that van Fraassen’s use of the notion of empirical equivalence in The Scientific Image has been widely misunderstood. A reconstruction of the main arguments for constructive empiricism is offered, showing how the passages that have been taken to be part of an appeal to the argument from underdetermination should actually be interpreted.

In this work, Paul Bartha proposes a normative theory of analogical arguments and raises questions and proposes answers regarding the criteria for evaluating analogical arguments, the philosophical justification for analogical reasoning, and the place of scientific analogies in the context of theoretical confirmation.

By Parallel Reasoning is the first comprehensive philosophical examination of analogical reasoning in more than forty years designed to formulate and justify standards for the critical evaluation of analogical arguments. It proposes a normative theory with special focus on the use of analogies in mathematics and science. In recent decades, research on analogy has been dominated by computational theories whose objective has been to model analogical reasoning as a psychological process. These theories have devoted little attention to normative questions. In (...) this book Bartha proposes that a good analogical argument must articulate a clear relationship that is capable of generalization. This idea leads to a set of distinct models for the critical analysis of prominent forms of analogical argument. The same core principle makes it possible to relate analogical reasoning to norms and values of scientific practice. Reasoning by analogy is justified because it strikes an optimal balance between conservative values, such as simplicity and coherence, and progressive values, such as fruitfulness and theoretical unification. Analogical arguments are also justified by appeal to symmetry--like cases are to be treated alike. In elaborating the connection between analogy and these broad epistemic principles, By Parallel Reasoning offers a novel contribution to explaining how analogies can play an important role in the confirmation of scientific hypotheses. How Moore’s open question argument works, insofar as it does, remains a matter of controversy. My purpose here is to construct an open question argument based on a novel interpretation of how Moore’s argument might work. In order to sidestep exegetical questions, I do not claim here to be offering Moore’s own argument. Rather, I offer a reconstruction making use of important elements of Moore’s methodology and assumptions that could be reasonable within a Moorean viewpoint. The (...) crucial role within the argument is played by what I call the real thought move. I show that the reconstructed argument is more defensible from some standard objections than the common construction. I finish by drawing attention to a neglected objective that would make sense within Moore’s viewpoint, showing that it fits with a major commitment of Bonjour’s moderate rationalism, and show how the package might be important for the non-naturalist today. The clinical ethics literature is striking for the absence of an important genre of scholarship that is common to the literature of clinical medicine: systematic reviews. As a consequence, the field of clinical ethics lacks the internal, corrective effect of review articles that are designed to reduce potential bias. This article inaugurates a new section of the annual "Clinical Ethics" issue of the Journal of Medicine and Philosophy on systematic reviews. Using recently articulated standards for argument-based normative ethics, we (...) provide a systematic review of the literature on concealed medication for the management of psychiatric disorders. Four steps are completed: identify a focused question; conduct a literature search using key terms relevant to the focused question; assess the adequacy of the argument-based methods of the papers identified; and identify conclusions drawn in each paper and whether they apply to the focused question. We identified seven papers and provide an assessment of them. While none of the papers fully meet the standards of argument-based ethics, they did provide rationales for the use of concealed medications, with the important requirement such a practice be accountable in explicit organizational policy to prevent abuse of patients with mental illness or dementia. This study examines the concept of argumentation empirically, to correct the normative conception of argumentation adopted by most scholars since Aristotle. They are not interested in what argumentation is, but in what it ought to be. The pre-Aristotelian approach is preferable, because it recognizes that argumentation, although it includes persuasion, also embraces other eristic techniques in which the speaker does not necessarily seek to persuade, but simply to prevail. This broader descriptive and pragmatic analysis explains the different ways in which (...) discourse actually occurs and particular arguments succeed, leaving in a secondary place the opinion of each author on how they should be. More recently, invisible derivational verb templates have been proposed, which treat argument structure patterns as zero derivational affixes that combine with a root verb to yield a new verb. While the derivational (...) template perspective can address several problems that arise for traditional lexical rules, it still faces problems in accounting for idioms, which often contain specifications that are not appropriately assigned to individual verbs or derivational affixes (regarding adjuncts, modification, and inflection). At the same time, it is clear that verbs play a central role in determining their distribution. The balance between verbs and phrasal argument structure constructions is addressed via the Principles of Semantic Coherence and Correspondence together with a usage‐based hierarchy of constructions that contains entries which can include particular verbs and other lexical material. The goal of this chapter is to catalogue ways in which practical argumentation —argumentation aimed at deciding on a course of action—is produced discursively in deliberative discussions. This is a topic largely neglected in the literature on PA focused primarily on the abstract features of practical inference. I connect to this literature by arguing that the complex scheme of PA inferentially hinges on three different principles for rationally selecting means to achieve the desired goal: the means have to be either (...) the best, satisfactory or necessary in order to ground the practical inference and thus be adopted. Based on these theoretically-derived distinctions, I scrutinise the linguistic indicators of the three types of means-goal inferences of PA. As a corpus, I use a set of official European Union policy documents called Transforming Europe’s energy system released in Brussels in July 2015. (shrink)

The traditional problem of free will and determinism is ostensibly about settling the relationship between free will and determinism. According to the standard narrative, this problem boils down to settling whether free will stands in a compatibility or incompatibility relation with determinism. Similarly, there is traditional debate over whether a compatibility or an incompatibility relationship holds between free will and indeterminism. Since indeterminism is simply the negation of determinism, anyone who holds that human free will is incompatible with both determinism (...) and indeterminism seems to be committed to free-will impossibilism, i.e. the view that free will is metaphysically impossible. We might summarize this constructive dilemma argument as follows: -/- The Standard Dilemma Argument 1. Necessarily, either determinism or its negation, i.e. indeterminism, is true. 2. Necessarily, determinism is incompatible with free will. 3. Necessarily, indeterminism is incompatible with free will. 4. Therefore, free will is metaphysically impossible; impossibilism is true. -/- In this essay, I argue that the term “incompatible” used in this argument is ambiguous. Since there are two fundamentally different ways to disamabiguate the term “incompatible”, there are at least four substantively different ways to disambiguate the Standard Dilemma Argument. Because these four arguments are typically conflated, the philosophically interesting differences between these four instances of the Standard Dilemma Argument are generally ignored. (shrink)

In this paper, I argue that the “positive argument” for Constructive Empiricism (CE), according to which CE “makes better sense of science, and of scientific activity, than realism does” (van Fraassen 1980, 73), is an Inference to the Best Explanation (IBE). But constructive empiricists are critical of IBE, and thus they have to be critical of their own “positive argument” for CE. If my argument is sound, then constructive empiricists are in the awkward position of having to (...) reject their own “positive argument” for CE by their own lights. (shrink)

This paper shows that low-level generalisations in argument structure constructions are crucial to understanding the concept of alternation: low-level generalisations inform and constrain more schematic generalisations and thus constructional meaning. On the basis of an analysis of the causative alternation in English, and more specifically of the theme, I show that each construction has its own schematic meaning. This analysis is conducted on a dataset composed of 11,554 instances of the intransitive non-causative construction and the transitive causative (...) construction. The identification of lower-level generalisations feeds into the idea that language acquisition is organic and abstractions are formed only gradually from exposure to input. So far, most of the literature on argument structure constructions has focused on the verb itself, and thus fails to capture these generalisations. I make up for this deficit through an in-depth analysis of the causative alternation. (shrink)

This paper explores the role of metonymy in determining a syntactic argument alternation (“conductor-vehiclealternation”) which occurs in English and Portuguese:o piloto acelerou a Ferrari“the driver speeded up the Ferrari”/a Ferrari acelerou“the Ferrari speeded up/sped away”. Since the verbs in theconductor-vehiclealternation haveconductorandvehiclearguments (controller and controlled entities), a metonymic process can occur, allowing thevehicleexpression to provide access to theconductorparticipant. To explain how metonymy allows a verb with two participants to be integrated into a construction with a single argument, we (...) assume that metonymy gathers information about both entities involved; thevehicleexpression provides mental access to bothvehicleandconductor(“fusion”). We also discuss cognitive and pragmatic factors involving the choice of a construction over another. Constructions withvehicleexpressions as subject are used when thevehicleis salient or theconductoris unknown. This also explains whydirigir“drive” does not alternate in Portuguese, contrarily to prediction and differently from Englishdrive. We provide a comparative account of the behavior of this verb in both languages.Dirigir, differently fromdrive, conceptualizes semantic components incompatible with a situation in which the agent/conductoris not salient or is unknown. This research adds to the ongoing body of literature on the role of metonymy in grammar and is a contribution to the understanding of the metonymic process, as a fusion, and also to argument alternation processes and lexical-constructional integration. David Buller and Valerie Hardcastle have argued that various discoveries about the genetics and nature of brain development show that most ?central? psychological mechanisms cannot be adaptations because the nature of the contribution from the environment on which they are based shows they are not heritable. Some philosophers and scientists have argued that a strong role for the environment is compatible with high heritability as long as the environment is highly stable down lineages. In this paper I support this view (...) by arguing that the discoveries Buller and Hardcastle refer to either do not show as strong a role for the environment as they suggest, or these discoveries show that the brain's developmental process depends in many cases on input from the environment that is highly stable across generations. Research on legal discourse has developed according to a variety of perspectives. As for descriptive accounts, two approaches are noteworthy. Firstly, Anglophone scholars have dealt with legal language from a genre-based viewpoint. Secondly, French studies have focused on argumentation in judicial texts, by considering the forms of reasoning involved in it and, albeit more rarely, its linguistic constituents. This paper aims at reinforcing the linguistic component of the analysis of legal discourse, by carrying out a corpus-based genre analysis on a (...) sample of 40 judgments. First of all, the results of the investigation of the genre structure of judgments will be presented. The comparative approach adopted will show that the differences between European and English/Irish judgments mainly concern the generic move Arguing the case. Secondly, analysis will concentrate in more detail on one of the most frequent tools used in the discursive construction of argumentation within the aforementioned move, i.e. the widely spread reporting verb HOLD. A study of its concordances suggests that it is used in all types of judgments as a meta-argumentative operator signalling either an authoritative stance taken by the Court or an equally authoritative reported argumentation of another judge or court. Over the past years, in books and journals (this journal included), N. Maxwell launched a ferocious attack on B. C. van Fraassen’s view of science called Constructive Empiricism (CE). This attack has been totally ignored. Must we conclude from this silence that no defence is possible and that a fortiori Maxwell has buried CE once and for all? Or is the attack too obviously flawed as not to merit exposure? A careful dissection of Maxwell’s reasoning will make it clear that (...) neither is the case. This dissection includes an analysis of Maxwell’s ‘aberrance–argument’ (omnipresent in his many writings) for the claim that science implicitly and permanently accepts a substantial, metaphysical thesis about the universe, which then paves the way for his own metaphysical-realist hierarchy-view of science. This aberrance-claim, which Maxwell directs against a widely shared and harmful ideology of science called ‘Standard Empiricism’, generally has been ignored too, for more than a quarter of a century. Our conclusions will be that (i) Maxwell’s attacks on CE can be beaten off, and (ii) his ‘aberrance–arguments’ do not establish what Maxwell believes they establish, but (iii) we can draw a number of valuable lessons from these attacks about the nature of science and of the libertarian nature of CE. Legal theory and practice, particularly on the exchange of pleadings, are referred to as a means of examining current thinking in pragmatics on relevance. The rules of pleadings suggest that the concept of relevance as used in pragmatics is emptied of any meaning and that theories of argumentation have not sufficiently taken into account the preliminary construction which issues to be argued about require.

McTaggart’s argument for the unreality of time was first published in the 1908 article “The Unreality of Time,” and a revised version appeared in the 1927 book The Nature of Existence. I argue that these two versions are significantly different. The second construction of the argument is important because it neutralizes a compelling objection. McTaggart’s initial argument tries to show that the conception of an A-series is self-contradictory. A natural objection is that the apparent contradiction can (...) be resolved by making clear that an event has incompatible A-properties only successively. McTaggart anticipates and responds to the objection. My main contention is this: McTaggart’s initial response to the objection fails, but in the second construction of his argument he succeeds in showing that the contradiction cannot be resolved in the way suggested by the objection. I also explain why the second construction has been overlooked for so long. (shrink)

This study focuses on the use and function of refutation in two televised debates during which candidates who have reached the second round of the French presidential elections come face to face. The aim of this study is to examine the forms and functions of refutation within the theoretical framework of dialogism. The rhetorical-argumentative functions of refutation and the challenges of this discursive practice in the genre “televised political debate” will also be put forward.

An important but unstudied event in US legal institutions is when judges question plaintiff and defense attorneys about the issue that brings them to an appeals hearing before a state supreme court. In this article I analyze judges' questioning during the oral argument phase of the New York Court of Appeals' hearing of Hernandez v. Robles, a case concerning whether the state was violating same-sex couples' constitutional rights by denying them access to marriage. The article's purpose is to show (...) how the content, format, and language style of judges' questioning turns constructs the judges as persons possessing particular attitudes, judicial philosophies, political leanings, and personalities. The article provides a quantitative overview of the 186 questioning turns and analyzes the discourse in selected episodes to evidence how features of questioning generate identity inferences. The conclusion considers how the oral argument phase of Appeals Court proceedings contributes to larger discourses of the law. (shrink)

In this paper, we put forward an interdisciplinary framework describing different levels of self-representations, namely non-conceptual, conceptual and propositional self-representations. We argue that these different levels of self-representation are differently affected by cultural upbringing: while propositional self-representations rely on “theoretical” concepts and are thus strongly influenced by cultural upbringing, non-conceptual self-representations are uniform across cultures and thus universal. This differentiation offers a theoretical specification of the distinction between an independent and interdependent self-construal put forward in cross-cultural psychology. Hence, this does (...) not only allow for a deeper understanding of different self-conceptions, but also for a formulation of new hypotheses regarding the cultural influence on self-representations. As one example, we will highlight the role of the proposed levels of self-representation for emotional experience and formulate some major implications of our interdisciplinary framework for future empirical research. Inspired by Rudolf Carnap's Der Logische Aufbau Der Welt, David J. Chalmers argues that the world can be constructed from a few basic elements. He develops a scrutability thesis saying that all truths about the world can be derived from basic truths and ideal reasoning. This thesis leads to many philosophical consequences: a broadly Fregean approach to meaning, an internalist approach to the contents of thought, and a reply to W. V. Quine's arguments against the analytic and the a priori. (...) Chalmers also uses scrutability to analyze the unity of science, to defend a conceptual approach to metaphysics, and to mount a structuralist response to skepticism. Based on the 2010 John Locke lectures, Constructing the World opens up debate on central philosophical issues involving language, consciousness, knowledge, and reality. Richard Lewontin is often cited as an inspiration and founder of what is now known as Niche Construction Theory. The first goal of this paper is to argue that they present distinct arguments from niche construction against Adaptationism. While Niche Construction Theory argues that natural selection is not the only adaptive evolutionary force, Lewontin rejects the externalist characterization of natural selection. The key difference lies in the types of phenomena that are allowed to count as “niche (...) class='Hi'>construction” and their argumentative roles. The second goal is to argue that it is time to revive Lewontin’s argument. I argue that it finds renewed support in Denis Walsh’s ecological affordance framework and empirical evidence from ecological developmental biology. Reexamining the roots of Niche Construction Theory, I suggest that the rich conceptual resources therein provide a way for Niche Construction Theory to also develop a neo-Lewontinian argument against the externalism of natural selection explanations.
