In The Quantum Self, Danah Zohar argues that the insights of modem physics can illuminate our understanding of everyday life -- our relationships to ourselves, to others, and to the world at large. Guiding us through the strange and fascinating workings of the subatomic realm to create a new model of human consciousness, the author addresses enduring philosophical questions. This study argues that one of Dōgen Zenji’s most renowned essays, the “Genjōkōan” of 1233, can be read as an exposition of interpretive sensibilities. By drawing a comparison between the function of the principle of the “dharma position” (法位) and that of interpretive charity as formulated in the Judaic tradition, I argue that the “Genjōkōan” initiates the reader into Dōgen’s dialectical interpretive perspective. As he elaborated on this theme throughout his life in many writings, Dōgen strived to creatively pacify the (...) lasting tensions between authority and interpretation, textual closure and hermeneutical openness. Thus, I propose that examining the dialectics of the “dharma position” as a hermeneutical framework expressed in pivotal passages of the “Genjōkōan”, may deepen our appreciation of the image of Dōgen the interpreter. In this paper, I seek to present the range of issues involved in the efforts of sixteenth‐century kabbalists to understand the nature of selfhood, and the paths prescribed for the formation of an ideal life. I reflect on the mystical writings of Moshe Cordovero, Eliyahu de Vidas, andayyim Vital—probing their conceptions of core identity, the polarity between body and soul, and the ethical guidance for a life well lived. In so doing, I consider the following additional themes, and their relation (...) to the matrix of self‐formation and religious identity: reincarnation and rebirth; the virtue of humility and self‐effacement; the cultivation of wisdom; ideals of piety and prophetic experience; asceticism; and the spiritual transcendence of desire. In presenting this wide range of constituent themes, I argue that sixteenth‐century kabbalists understood the soul to be the ultimate marker of personal identity (nuanced and complicated by the doctrine of reincarnation), and that they formulated a vision of an ideal ethics in which the human being functions as an earthly vessel for the divine presence. What is more, the preparation of that vessel required a degree of humility so extreme that the attainment of ideal personhood ultimately involved the effacement of that very identity. (shrink)

The distinction between access consciousness and phenomenal consciousness is a subject of intensive debate. According to one view, visual experience overflows the capacity of the attentional and working memory system: We see more than we can report. According to the opposed view, this perceived richness is an illusion—we are aware only of information that we can subsequently report. This debate remains unresolved because of the inevitable reliance on report, which is limited in capacity. To bypass this limitation, this study utilized (...) color diversity—a unique summary statistic—which is sensitive to detailed visual information. Participants were shown a Sperling-like array of colored letters, one row of which was precued. After reporting a letter from the cued row, participants estimated the color diversity of the noncued rows. Results showed that people could estimate the color diversity of the noncued array without a cost to letter report, which suggests that color diversity is registered automatically, outside focal attention, and without consuming additional working memory resources. Culling is used in traditional public health policies to control animal populations. These policies aim primarily to protect human interests but often fail to provide scientific evidence of effectiveness. In this article, we defend the need to move from a strictly anthropocentric approach to disease control towards a One Health ethics, using culling practices as an example. We focus on the recent badger culls in the UK, claiming that, based on data provided by the English Government, these culls may be (...) unjustified, all thing considered. We highlight the relevance of ethical reasoning rooted in One Health for this discussion, and make several suggestions including a moratorium on culling until data are provided to support the effectiveness of culling; to conduct a randomized trial to compare proactive culling with alternative methods; to apply deliberative democratic methods to assess public opinion towards the culls, and to find in Brexit an opportunity for aiming for more effective control measures. The question of whether conscious experience is restricted by cognitive access and exhausted by report, or whether it overflows it—comprising more information than can be reported—is hotly debated. Recently, we provided evidence in favor of Overflow, showing that observers discriminated the color‐diversity (CD) of letters in an array, while their working‐memory and attention were dedicated to encoding and reporting a set of cued letters. An alternative interpretation is that CD‐discriminations do not entail conscious experience of the underlying colors. In 2015, the Israeli Knesset passed the force-feeding act that permits the director of the Israeli prison authority to appeal to the district court with a request to force-feed a prisoner against his expressed will. A recent position paper by top Israeli clinicians and bioethicists, published in Hebrew, advocates for force-feeding by medical professionals and presents several arguments that this would be appropriate. Here, we first posit three interrelated questions: 1. Do prisoners have a right to hunger-strike? 2. Should governing (...) institutions force-feed prisoners and/or is it ethical to force-feed prisoners? 3. Should healthcare professionals force-feed prisoners? We then focus on the first and third questions. We first briefly provide several arguments to support the right of prisoners to refuse treatment. Next, we critically review the arguments presented in the Israeli position paper, demonstrating that they are all misguided at best. Lastly, we briefly present arguments against force-feeding by medical professionals. We conclude that healthcare providers should not participate in the force-feeding of prisoners. (shrink)

This article examines perceptions of military and defense expenditure as held by Asian students. By using quantitative data from the Asian Student Survey1 of 2008 it addresses the following questions: to which areas would Asian students like to see their government allocate more or less resources and, specifically, how supportive of defense and military spending are Asian students. This study finds that data concerning one country have appeared deviant. While designating the strongest will to increase defense and military spending among (...) all countries sampled in the survey, Chinese students from leading universities also exhibit the lowest levels of perceived military threats. The rest of the paper explores the of Chinese students by generating and testing a null hypothesis. In it, Chinese students' high demand for military spending is associated with an aggressive design, whereby anti-foreign, unilateral, and nationalist sentiments coincide. After refuting the null hypothesis, the paper advances an alternative explanation that links students' inclination with the call to modernize the People's Liberation Army. (shrink)

Loneliness is a major public health concern, particularly during pandemics such as Covid. It is extremely common, and it poses a major risk to human health. Technological solutions including social media, robots, and virtual reality have been advocated and implemented to relieve loneliness, and their use will undoubtedly increase in the near future. This paper explores the use of technological solutions from a normative perspective, asking whether and to what extent such measures should indeed be relied upon. The conclusion is (...) that technological solutions are unquestionably part of the solution to loneliness, but that they cannot and should not constitute the whole solution. It is important to note that this is not a straw‐man argument, as several organizations and scholars have strictly focused on such technological solutions for loneliness. (shrink)

Most professional guidelines advocate family presence during resuscitation (FPDR). Many clinicians, however, are still reluctant to implement this recommendation. In this article I present the most comprehensive case for FPDR to date. I review the little that has been written about the ethics of FPDR, as well as the available empirical evidence. More importantly, I present and defend three arguments for FPDR: adherence to professional guidelines, benefit to patients and relatives, and patients’ autonomy. I conclude with suggestions for future research.

This article poses a response to one argument supporting the force feeding of political prisoners. This argument assumes that prisoners have moral autonomy and thus cannot be force fed in the early stages of their hunger strike. However, as their fasting progresses, their cognitive competence declines, and they are no longer autonomous. Since they are no longer autonomous, force feeding becomes justified. This article questions the recurrent citation of a paper in empirical support of the claim that hunger strike causes (...) mental disorders or cognitive impairments. The paper, written by Daniel Fessler, partially relies on the Minnesota Starvation Experiment conducted in 1944 to 1945 for scientific support. Using widely accepted criteria for assessing the ethical acceptability of clinical research, we argue that the Minnesota Starvation Experiment had significant scientific shortcomings and is a case of unethical research. From this, we question the appropriateness of citing the Minnesota Starvation Experiment and consequently Fessler’s paper. If Citing Fessler’s paper becomes problematic, this particular argument for the force feeding of prisoners loses much of its strength. (shrink)

Dōgen’s life and thought are closely examined in light of the wider historical and religious contexts of Song dynasty China and the Kamakura era in Japan. This collection offers a careful consideration of Dōgen’s rich literary legacy by examining his significance situated as he was at the historical crossroads between the Chinese (...) Two studies examined gender differences in lying when the truth-telling bias prevailed and when inspiring lying and disbelief. The first study used 156 community participants in pairs. First, participants completed the Narcissistic Personality Inventory, the Lie- and Truth Ability Assessment Scale, and the Rational-Experiential Inventory. Then, they participated in a deception game where they performed as senders and receivers of true and false communications. Their goal was to retain as many points as possible according to a payoff matrix that specified (...) the reward they would gain for any possible outcome. Results indicated that men lied more and were more successful lie-tellers than women. In addition, men believed the sender less than women but were not more successful detectors of lies and truths. Higher perceived lie-telling ability, narcissistic features, and experiential thinking style explained men’s performance. The second study used 100 volunteers who underwent the same procedure. However, the payoff matrix encouraged lying and disbelieving. Results showed again that men lied more than women. As to performance, men were more successful lie detectors than women, but there was no truth detection difference. Women did not differ in their success in telling and detecting lies and truths. The inconsistent gender differences in production and detection lies and truths dictate caution in interpreting them. (shrink)

Intergroup competition over resources is attested since the dawn of history. Written and archaeological evidence go back to at least the fourth millennium BC. According to accepted views, evolution has favored humans because of their ability to have cumulative cultures, which has made flexible adaptation possible. One major aspect of this adaptation has been the ability to handle power contests without engaging physical force. Instead, increasing prestige dynamics has allowed contest management by displaying symbolic assets. These have growingly been instrumental (...) in deterring external assaults, thus guaranteeing the possession – or expansion – of a group’s resources. However, while material assets are believed to create status by the evidence of their tangible usefulness (such as foods, husbandry and tools), symbolic assets are by definition subject to ongoing negotiation, entirely dependent on being socio-semiotically recognized as types of capital. Symbolic stock exchanges thus appear to have been determinative since antiquity in hierarchizing ethnic and political groups fighting over resources, prioritizing ones over the others. They have culminated in repertoires of more solid tangible and intangible assets, from impressive buildings, city gates, gardens and temples, to ideas such as freedom, quality of life and wealth, justice, personal security, or whatever values that have gained universal recognition. The article discusses the creation and expansion of such symbolic repertoires and their uncertain position in recent times. (shrink)

This paper applies the argumentative perspective to the concept of scientific fact by combining the rhetorical and the sociological perspectives. The scientific fact is presented as an entity having both an epistemic and a social meaning, and the scientific paper is presented as a discourse that has both an epistemic value and role related to knowledge and to the description of the ‘world,’ and a social value, fulfilling social roles within its relevant discourse community. The discussion leads to some insights (...) into the connection between scientific language and facts. Scientific language reflects the degree of facticity of the utterance at every stage: various linguistic and discursive elements reflect the current factual status of the utterance. This conception of fact is dynamic and open to discussion, and it is presented from the author’s point of view. On the other hand, language, or the choice of language usage, creates facticity in the sense of social acceptance: by using language, the researcher reports on his belief that what he is describing is indeed a fact. The essence of the scientific paper as an argumentative text is that its point of departure is the faith of the speaker in the facticity of the new information, and its rhetorical aim is to convince the audience, based on its disciplinary rationality, to accept that same faith and thereby usher the new claim into the shared disciplinary body of knowledge. In _The Curious Case of the Camel in Modern Japan_, Ayelet Zohar addresses issues of Orientalism, colonialism, and exoticism in modern Japan, through images of camels – the epitome of Otherness, and a metonymy for Asia in the Japanese imagination.

Several bioethicists have recently advocated the force-feeding of prisoners, based on the assumption that prisoners have reduced or no autonomy. This assumed lack of autonomy follows from a decrease in cognitive competence, which, in turn, supposedly derives from imprisonment and/or being on hunger strike. In brief, causal links are made between imprisonment or voluntary total fasting and mental disorders and between mental disorders and lack of cognitive competence. I engage the bioethicists that support force-feeding by severing both of these causal (...) links. Specifically, I refute the claims that VTF automatically and necessarily causes mental disorders such as depression, and that these mental disorders necessarily or commonly entail cognitive impairment. Instead, I critically review more nuanced approaches to assessing mental competence in hunger strikes, urging that a diagnosis of incompetence be made on a case-by-case basis—a position that is widely shared by the medical community. Conflicts of interest in corporate law can be addressed by two main alternatives: a requirement of a majority of the minority vote or the imposition of duties of loyalty and fairness. A comparison of Delaware, the UK, Canada, and Israel reveals that while the conflicts of interest problem within publicly-traded corporations receives different treatment in the different jurisdictions — either a fairness rule or a majority of the minority rule — closely-held corporations receive the same treatment of an imposition of (...) duties of loyalty and fairness. This article explains this finding, demonstrating that determining which of these rules is adopted is, in fact, a choice between liability rule protection and property rule protection. This choice depends on the total and relative transaction costs. These costs include both the negotiation costs attendant upon a property rule, as well as the adjudication costs associated with a liability rule. The sum of these costs is influenced by the efficacy of the judicial system and of extralegal mechanisms such as the market for corporate control, the capital market, and the types of investors active in the market. Because the different jurisdictions have different relative costs, due to differences in the economy and the legal systems, publicly-traded corporations are treated differently in each system. However, sometimes conflict of interest situations share the same main characteristics — as with closely-held corporations—leading to the domination of one solution, and thus the same solution is applied for closely-held corporations in the different jurisdictions. In this essay, I examine aspects of Walzer's exposition of The Jewish Political Tradition (=the title of a multi-volume work of which he is leading editor) as they intersect with his work on political theory more generally. The Jewish tradition seems to present a radical example of "anti-politics": of a people existing outside the political realm. This is due both to the historical fact of their long exile, and to the shadow cast upon human politics by the prophetic ideology of (...) Divine Sovereignty. Despite their long-lasting lack of sovereignty, Jewish communities sustained a significant political life and a rich political discourse; this can serve to illustrate the primacy of the people's common life over the state, whose function is to support this life. As for divine sovereignty, it need not negate human political agency; instead, it can furnish – as in the case of the biblical prophets – the grounding for effective social criticism; though it is far from clear who, if anyone, is heir to the prophetic-critical mantle in post-biblical Judaism. In this essay we discuss an ethical dilemma that recently arose in our institution, involving healthcare workers who lamented the requirement to shave their facial hair as a condition to care for COVID-19 patients. The essay represents a genuine attempt to grapple with the dilemma sensibly and vigorously. We first provide a brief introduction, focusing on the tension between religious tolerance and the institutional obligation to optimize patient care and public health in the age of COVID-19. We then discuss the (...) complex relationship between facial hair and cultural as well as religious factors throughout history. Next, we make a case, based on several principles in Islam jurisprudence, that Muslim healthcare professionals in our institution should be expected to shave their facial hair so they could care for COVID patients. We end with considering two alternative solutions that were offered in the literature. (shrink)
