Arguments for a just transition are integral to debates about climate change and the drive to create a carbon-neutral economy. There are currently two broad approaches rooted in ethics and justice for framing just energy transitions. The first can be described as internal to the transition and emphasizes the anticipation, assessment, and redressing of harms created by the transition itself and the inclusion in transition governance of groups or communities potentially harmed by its disruptions. In this article, we propose a (...) second approach to ethics and justice in an energy transition, which we describe as systemic or societal in scope. This approach complements attention to the proximate dynamics and impacts of the transition process with a focus on the distant societal and economic outcomes the transition brings into being and how they compare to conditions prior to the transition. It poses the question: do the transformative social, economic, and technological changes wrought by energy systems create more just societies and economies, or do they instead reinforce or recreate long-standing injustices and inequalities? We illustrate this approach with an assessment of one of the most significant existing forms of energy injustice: the energy-poverty nexus. We argue that the energy-poverty nexus reflects configurations of socio-energy systems that create complex, extractive feedbacks between energy insecurity and economic insecurity and, over time, reinforce or exacerbate poverty. We further argue that just energy transitions should work to disentangle these configurations and re-design them so as to create generative rather than extractive feedbacks, thus ending the energy-poverty nexus and creating long-term outcomes that are more just, equitable, and fair. In The Contemplative Self after Michel Henry: A Phenomenological Theology, Joseph Rivera provides a close and critical reconstruction of the philosophical anthropology of Michel Henry (1922-2002) while also addressing the question of how theology contributes to Henry's phenomenology. In conversation with other French figures such as Derrida, Marion, Lacoste, and Barbaras, Rivera undertakes a global thematic study of Henry's work. He shows how, for Henry, the theological debate is shifted onto a phenomenological problem, with a coincident will to (...) pursue the epistemological efforts of Husserl and Heidegger. The chapters tackle some of the most pressing debates in contemporary Continental philosophy, such as the "modern ego," the nature and experience of temporality, and the constitution of the body and otherness, and how a theological discourse may illumine those anthropological structures. The book expands on the modern narrative of the self from Descartes to Nietzsche, opens up the particular lines of inquiry Henry advances in dialogue with those figures and phenomenology in particular, and highlights the surprising theological turns in Henry's late work on Christianity. Because Henry's work is difficult, it is often misunderstood; Rivera's own vision of the self, one that is shaped by Henry but not in full agreement with him, advances insights internal to Henry but also brings into sharp focus many problematic points in Henry's phenomenological theology. An array of classical theological voices appear in the final chapters, such as St. Augustine, Tertullian, Irenaeus, Pseudo-Dionysius, and Gregory of Nyssa, all of whom are set in dialogue with Henry. A fresh and creative articulation of contemplation and selfhood, the volume is a valuable addition to the continuing conversation that seeks to build bridges between phenomenology and theology. Consensual homicide remains a crime in jurisdictions where active voluntary euthanasia has been legalized. At the same time, both jurisdictions, in which euthanasia is legal and those in which it is not, recognize that all patients (whether severely ill or not) have the right to refuse or withdraw medical treatment (including life-saving treatment). In this paper, I focus on the tensions between these three norms (the permission of active euthanasia, the permission to reject life-saving treatment, and the prohibition of consensual (...) homicide), assuming a justification of euthanasia based on the right to (personal) autonomy. I argue that the best way to provide a coherent account of these norms is to claim that patients have two distinct rights: the right to autonomy and the right to bodily integrity. This solution has some relevant implications for the discussion of the legalization of active euthanasia. (shrink)

Através da pesquisa bibliográfica e da reunião de fontes textuais relevantes para o argumento, esta relação é descrita sob a forma de uma simbiose entre o ser humano e o computador, nos termos propostos inicialmente por Asimov (2005). Uma concepção da leitura como operação da inteligência é posta em diálogo com o conceito e as aplicações da mineração de textos. Em geral, esta interdiscursividade lhes permitiu pôr na berlinda a concepção de imagem pressuposta tanto na filosofia como no cinema. Trata-se de examinar as teorias e a análise que Gilles Deleuze e Jacques Rancière fizeram de Vertigo, de Alfred Hitchcock, para entender a relação que ambos estabeleceram entre filosofia e prática fílmica analítica. O (...) objetivo final é problematizar as conexões entre imagem e narrativa, que se revelam nessa junção e que fazem parte da tradição filosófica e cinematográfica. Edited by Ivette Fred-Rivera and Jessica Leech. What is the relationship between ontology and modality: between what there is, and what there could be, must be, or might have been? Throughout a distinguished career, Bob Hale’s work has addressed this question on a number of fronts, through the development of a Fregean approach to ontology, an essentialist theory of modality, and in his work on neo-logicism in the philosophy of mathematics. This collection of new essays engages with these themes (...) in Hale’s work in order to make further progress in our understanding of ontology, modality, and the relations between them. Some essays directly address questions in modal metaphysics, drawing on ontological concerns. Others raise questions in modal epistemology and its links to matters of ontology, such as the challenge to give an epistemology of essence. There are also several essays engaging with questions of what might be called ‘modal ontology’: the study of whether and what things exist necessarily or contingently. Such issues can be raised and addressed directly, but they also have an important bearing on the kinds of semantic commitments engendered in logic and mathematics, e.g., to the existence of sets, or numbers, or properties, and so on. It is thus explored in some chapters to what extent one’s ontology—and indeed, one’s ontology of necessary beings—interacts with other plausible assumptions and commitments. (shrink)

In his recent article, ‘A Gift to Theology? Jean-Luc Marion's ‘Saturated Phenomena’ in Christological Perspective’, Brian Robinette has critiqued Marion's phenomenology for confining theology to a one-sided approach to Christology, one that stresses only the passive, mystical reception of Christ. To correct this imbalance, Robinette brings Marion into dialogue with those more active Christologies or ‘prophetical-ethical’ liberation theologies of Gustavo Gutierrez, Johann Baptist Metz and others that stress a life-praxis focused on confronting evil and suffering. In this essay I am (...) arguing that Robinette has not fully developed the ‘logic’ of Marion's phenomenology of the ‘call and the gifted’, in which both a passive and an active element are operative. I explore more fully that very dynamic phenomenological process of the call-and-the-gifted as developed in Marion's work Being Given: Toward a Phenomenology of Givenness. Once viewed in Christological perspective, and especially in light of Christ's death and resurrection, Marion's phenomenology entails an ethical trope consistent with the mission of Christ as rendered in Scriptural revelation, and thus the gap between Marion's work and the prophetical-ethical theologies of Gutierrez and Baptist Metz becomes narrowed. abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

Genetic research in human beings poses deep ethical problems, one being the problem of distributive justice. If we suppose that genetic technologies are able to produce visible benefits for the well being of people, and that these benefits are affordable to only a favored portion of society, then the consequence is obvious. We are introducing a new source of inequality. In the first section of this paper, I attempt to justify some concern for the distributive consequences of applying genetics to (...) human beings. This concern transcends a mere preoccupation for material equality. I argue that genetic inequality can undermine the very basis of social cooperation, at least regarding health care. The second section is more practical. My aim is to defend how, at least in some legal and cultural frameworks , the undesired distributive consequences of genetics are more likely to arise and more difficult to avoid. (shrink)

O presente artigo propõe-se a realizar um estudo comparado, eminentemente teórico, entre os critérios materiais para determinação do bem jurídico nas teorias normativas do direito de John Finnis e de Martha Nussbaum, com fito a apresentar o modo de fundamentação e o conteúdo das listas propostas por cada um dos autores. Inicialmente, o estudo discutirá os bens humanos básicos em Finnis. Após, as capacidades em Nussbaum. E, por fim, ambas as propostas serão comparadas, com fulcro a obter suas possibilidades e (...) limitações, em especial, a partir dos critérios de método, posição política e taxatividade. (shrink)

In normative terms, human dignity usually implies two consequences: human beings cannot be treated in some particular ways due to their condition as humans; and some forms of life do not correspond to the ideal life of our community. This study consists in discussing the meaning of this idea of human dignity in contrast to the concept of humiliation in the context of institutional, i.e. political and legal, rights. Two concepts of human dignity will be discussed. The first absolute/necessary and (...) formal/transcendental concept implies the proposition “because human beings have dignity, the following cluster of rights is valid”. Conversely, the second contingent and material concept corresponds to the thought “for being able to live in dignity, we must respect the following rights”. This paper claims that human dignity should be understood as the right to be protected from humiliation. Humiliation is the situation of incapacity or absence of self-determination. (shrink)

How to reciprocate a precious gift? In this case the gift was given to us twice. First, in the shape of Paget Henry’s pioneering reinvention of René Ménil’s “Aesthetic Marxism.” Through it, second, we’re led to rediscover the fantastic world of Ménil’s hitherto ignored but crucial contribution to contemporary philosophy: his systematization of the poetics of revolt. Our debt with Ménil and Henry is unpayable. Our humble response in this essay is to offer readers a map to the treasure that (...) is Ménil’s thought. We aim to offer a path across and beyond the sedimentation and pacifying effects of given frames of judgment and the imagination in today’s post-classical public sphere. Metaphysical underdetermination arises when we are not able to decide, through purely theoretical criteria, between competing interpretations of scientific theories with different metaphysical commitments. This is the case in which non-relativistic quantum mechanics (QM) finds itself in. Among several available interpretations, there is the one that states that the interaction with the conscious mind of a human observer causes a change in the dynamics of quantum objects undergoing from indefinite to definite states. In this paper, we argue that there seems (...) to be also a metaphysical underdetermination concerning London and Bauer’s theory of measurement between two methods of phenomenological reduction: the eidetic and the transcendental approaches. Recently, Steven French argued that both methods can be combined in order to interpret London and Bauer’s formalism. However, in this paper we argue that the eidetic one is the only viable phenomenological way to interpret this particular theory of measurement in QM based on the formalism presented by London and Bauer, hence breaking this phenomenological underdetermination. Most research on risk aversion in behavioral science with human subjects has focused on a component of risk aversion that does not adapt itself to context. More recently, studies have explored risk aversion adaptation to changing circumstances in sequential decision-making tasks. It is an open question whether one can identify evidence, at the single subject level, for such risk aversion adaptation. We conducted a behavioral experiment on human subjects, using a sequential decision making task. We developed a model-based approach for (...) estimating the adaptation of risk-taking behavior with single-trial resolution by modelling a subject’s goals and internal representation of task contingencies. Using this model-based approach, we estimated the subject-specific adaptation of risk aversion depending on the current task context. We found striking inter-subject variations in the adaptation of risk-taking behavior. We show that these differences can be explained by differences in subjects’ internal representations of task contingencies and goals. We discuss that the proposed approach can be adapted to a wide range of experimental paradigms and be used to analyze behavioral measures other than risk aversion. (shrink)

Parte de la premisa de que ésta es tomada como una estrategia para reconciliar la modernidad ilustrada, particular-mente tras el evento de la Revolución Francesa de 1789, tanto con el proyecto fundacional epistémico de la modernidad temprana como con su pasado antagónico: La concepción de la racionalidad retórica y hermenéutica, tal y como ésta procede de Platón y Aristóteles. El método de Hegel se (...) inscribiría en un afán por fusionar los aspectos omnipotentes de las narrativas ilustradas con los métodos premodernos de vinculación finita y fragmentaria con el sentido de la realidad. La recepción durante el siglo XX se preguntó si la filosofía nietzscheana era a-, im- o anti-política, es decir, si podía ser asimilada por la democracia, o si era antimoderna, elitista y reaccionaria. El italiano Roberto Esposito ha propuesto leerla como formando e informando el paradigma de la biopolítica. Se discuten cuatro lecturas de esa biopolítica: como formadora del paradigma de la inmunidad, como tanatopolítica, como liberal y neoliberal, y como biopolítica afirmativa. Twentieth-century readers wondered if Nietzschean philosophy was apolitical, (...) impolitic, or anti-political; that is, if it could be assimilated by democracy or if it was antimodern, elitist, and reactionary. The Italian philosopher Robert Esposito has proposed reading Nietzsche's philosophy as forming and informing the biopolitical paradigm. Four readings of these biopolitics are discussed: as part of the paradigm of immunity, as thanatopolitics, as liberal and neoliberal, and as affirmative biopolitics. (shrink)

Together, they help us move beyond received (...) views in phenomenology and existentialism, toward gravitational thinking and the priority of imaging over the understanding if we are to rekindle the revolutionary spirit of public imagination. In this paper the author reflects upon the past, the present and the future of philosophical education within the framework of a democratic mode of living, integrating three levels of argumentation: an autobiographic level, triggered by the encounter with an old school notebook that belonged to the author’s father; a conceptual level, in which the author recalls John Dewey’s pragmatist approach to philosophy; and a descriptive and proactive level, in which the author examines recent developments concerning the teaching of philosophy (...) and proposes a perspective on philosophical education in tune with these. The author underscores the importance of different displacements and transformations undergone by the practice of teaching philosophy during the last century, and sets up a contrast between the old practices, intended to provide a “correct view of the world”, and the urge for philosophy to provide a critique of society and knowledge. In this way, the author draws on Dewey’s ideal, according to which philosophy should carry out both a critique and a reconstruction of present experience. Finally, the author sets forth ten challenges for future philosophical education. (shrink)

This article examines a specific case of lying, at the same time judicial and mediatic, promoted from the highest levels of political power, the Leon Trotsky case, from the perspective of the work done by the International Commission of Investigation chaired by the American philosopher John Dewey. After a general justification and contextualization of the subject, and a historical account of the events that surrounded the “Moscow Trials” and the constitution of the Dewey Commission, some of the reasons why the (...) commission concluded that such processes had been judicial assemblies are reported. It closes with a reference to the way Dewey later denounced the media falsification of these events through the book Mission to Moscow. (shrink)

Resumen: La problematización de la relación entre individuo y sociedad ha atravesado la historia de las ciencias sociales. El objetivo de este escrito es mostrar la originalidad de los planteamientos de Freud sobre el tópico, a través de un análisis comparativo con las aproximaciones propias de las corrientes socioantropológicas de la escuela de Cultura y Personalidad y de la Sociología Francesa. Nuestra investigación se basó en un análisis bibliográfico tanto de algunos textos socioantropológicos claves sobre dicho debate, como de la (...) producción freudiana pertinente. La interpretación del material freudiano se organizó según tres tópicos: a) la afirmación de la determinación simbólica del síntoma, b) la borradura metodológica de la distinción individuo sociedad, y c) la teorización de una eficacia mítica, transindividual y transhistórica. Concluimos subrayando los aportes del pensamiento de Freud a la discusión: la afirmación de la determinación simbólica ofrece las condiciones para la superación de la relación de externalidad entre el polo del individuo y el de la sociedad, y el consecuente rechazo a una relación especular entre ambos. The aim of this paper is to show the originality of Sigmund Freud's ideas about the topic, through a comparative analysis with the approaches of the socio-anthropological currents of the school of Culture and Personality and of French Sociology. Our research was based on a bibliographical analysis of some key socio-anthropological texts on this debate, as well as the relevant Freudian production. The interpretation of the Freudian material was organized according to three topics: a) the affirmation of the symbolic determination of symptoms, b) the methodological erasure of the individual society distinction, and c) the theorization of a mythical, transindividual and transhistorical efficacy. We conclude by emphasizing the contributions of Freud's thought to the discussion: the affirmation of symbolic determination offers the conditions for overcoming the externality relation between the pole of the individual and that of society, and the consequent rejection of a specular relationship between the two. Thus, the emotions that humans construct are based on affective processes that exist independently from human society and are not necessarily constituted by the interplay of culture and genetic or physiological processes.
