This article formulates a deterrence theory of punishment based on Lockean premises. Following authors such as Warren Quinn and Daniel Farrell, it is claimed that a justification for the right to punish must be built upon the recognition of the importance of a right to issue retaliatory threats. Contrary to those authors, however, the articulation of such recognition is made within a Lockean theory of individual rights. This allows us to appreciate the specific role deterrence has in a (...) plausible conception of punishment, and thus address certain objections that have been formulated recently, especially by David Boonin. David Boonin has recently advanced several challenges to the self-defense justification of punishment. Boonin argues that the self-defense justification of punishment justifies punishing the innocent, justifies disproportionate punishment, cannot account for mitigating excuses, and does not justify intentionally harming offenders as we do when we punish them. In this paper, I argue that the self-defense justification, suitably understood, can avoid all of these problems. To help demonstrate the self-defense theory’s attraction, I also develop some contrasts between the self-defense justification, (...) class='Hi'>Warren Quinn’s better known ‘auto-retaliator’ argument, and desert-based justifications of punishment. In sum, I show that the self-defense justification of punishment is more resilient than commonly supposed and deserves to be taken seriously as a justification of punishment. (shrink)

This paper examines the challenge that psychoanalytic theory cannot be refuted. It does so by considering the theory in its orthodox Freudian form, and in the main branches into which it can be divided ? the theory of Instincts, of Development, of Psychic Structure, of Mental Economics or Defence, and of Symptom Formation. The essential character of the generalizations and concepts of these branches will just be indicated; and we shall ask of each branch whether it is possible to refute (...) it. A considerable amount of scientific enquiry has been done into the concepts and generalizations of psychoanalysis. Relevant examples of these enquiries will be noted; and the question asked whether these scientific studies have in fact done anything to refute or support the various branches of psychoanalytic theory. ABSTRACT With a particular focus on the experience of young people in higher education, this paper turns to the philosophical work of Cora Diamond to open up new ways of conceptualising mental health. We claim that Diamond offers a compelling insight into that experience of human difficulty so often subsumed by a medicalised vocabulary. We propose that she offers philosophically astute perceptions of the related human attempts at deflection. And we situate this reading of Diamond against a broader understanding of (...) the contemporary university as a place of institutional darkness. In developing this general discussion, we place ourselves within a very particular context. We draw on the narratives of a number of third-level students in Ireland, who shared their experiences as part of a hermeneutic phenomenological study into the lived experience of mental health difficulties. The Covid-19 crisis has clarified the demand for an ultra-brief single-session, online, theory-led, empirically supported, psychological intervention for managing stress and improving well-being, especially for people within organizational settings. We designed and delivered “4Ds for Dealing with Distress” during the crisis to address this need. 4Ds unifies a spectrum of familiar emotion regulation strategies, resilience exercises, and problem-solving approaches using perceptual control theory and distils them into a simple four-component rubric. In essence, the aim is to reduce distress and restore (...) wellbeing, both in the present moment through current actions, and through expressing longer-term goal conflicts to discover new perspectives that arise spontaneously after sufficient time and consideration. The intervention is user-led in that it draws on users’ own idiosyncratic and pre-existing experiences, knowledge, skills and resources to help them apply an approach, or combination of approaches, that are proportionate and timed to the nature and context of the stress they are experiencing. In this article we review the empirical basis of the approach within experimental, social, biological and clinical psychology, illustrate the novel and time-efficient delivery format, describe its relevance to sports and exercise, summarise feedback from the recipients of the intervention to date, and describe the directions for future evaluation. Three underlying conflicts are analyzed, namely, the values of equality versus community, interracial community versus multiculturalism, individuality versus racial-ethnic community. Is it a scientific theory? — a myth? — or like a prescientific example of natural philosophy? — a branch of medical knowledge? — a premature empirical synthesis that is an approximation to the truth? Each of these answers runs into objections and difficulties, some of which are examined or noted. On the assumption that it is a provisional story which approximates to (...) the truth, the question is then raised: what can we do to find out how much of an approximation to the truth the theory really is? The relevance and value of psychological studies are discussed; and the suggestion is made that the status of Psychoanalytic Theory will remain an ambiguous one for some time to come. (shrink)

We focus on two components of Page's argument in favour of localist representations in connectionist networks: First, we take issue with the claim that localist representations can give rise to generalisation and show that whenever generalisation occurs, distributed representations are involved. Second, we counter the alleged shortcomings of distributed representations and show that their properties are preferable to those of localist approaches.

This article is concerned with the antagonistic character of democratic politics, specifically in relation to the neo-republican conceptualisation of politics, as outlined by Philip Pettit. I take up a problem not addressed in the neo-republican scholarship, namely, the broader dispute over the practice of contestation and the scope of its reach in relation to the activity of politics. This article proceeds through an examination of what I call Pettit’s method of political theory in order to approach sideways the concept of (...) ‘contestation’ as a marker for a sublimated antagonistic dimension of neo-republican politics. Drawing on the work of Rancière and the insights of post-Nietzschean critical theory (Derrida, Laclau and Arendt), I examine the relationship between populism, democratic contestation and non-domination in neo-republican discourse. As such, this article exerts pressure on Pettit’s privileging of a status concept of freedom as the supreme political ideal of republican politics. This article explores the political possibilities opened up through a re-politicisation of non-domination, and the radical potential that resides in a politics that does not foreclose on democracy, understood in terms of popular power and not popular control. How good is psychotherapy as a tool of research into human nature? There is an orthodox defence of it as a research tool, which relies on showing that interpretations are true of the patient when they satisfy certain criteria. This defence is examined and rejected. The reply is considered that an interpretation which 'keeps things moving' is true, or an approximation to the truth. This reply is rejected by comparing and contrasting an interpretation in psychotherapy with one from brainwashing sessions. (...) Two suppositions about psychotherapy (which weaken its discovery powers) are deliberately adopted — the suppositions that the material produced is 'perspective' and 'method' dependent. An unorthodox defence of psychotherapy is then offered — by means of a watery sense of 'discover'. This enables us to outline a weak sense in which psychotherapy is a valid enterprise, but one which is still strong enough for research purposes. (shrink)

In Australia as is the case elsewhere, ethics is a developing aspect of business behaviour. Many educational institutions and business enterprises have a strong interest in the subject, particularly from the practical viewpoint of creating an ethical culture in business that has substantial practical effects. In this paper, the codes of ethics of five large enterprises are examined. They were selected as being typical of a collection of corporate codes used in Australia held by the Ethics Research Group at the (...) University of Technology, Sydney. Two codes were from international companies: a chemical manufacturing company and a health, beauty and medical manufacturer. The other codes were from an Australian bank, an Australian federal government business agency, and an Australian mining company.Corporate codes of ethics rarely contain operational definitions to direct their addressees on situations of moral hazard and the required response, to achieve a particular desired ethical corporate culture. Consequently, addressees constitute the locus of ethical decision making in enterprises. By contrast, the language used in the corporate codes examined construct an authoritarian position in the writer/reader relationship from the overuse of grammatical structures such as relational clauses, the passive, nominalisation, grammatical metaphor and modality. Collectively, these structures communicate a strong sense of obligation and even powerlessness since a strong authoritarian tone is established which does not give the addressees the possibility of discretionary decision making. Some philosophers believe that punishing convicted criminals in order to deter other, potential criminals would be morally questionable even if we had good evidence that doing so would achieve its goal, at least to a substantial degree. And they believe this because they believe that doing so would be an instance of “using” convicted criminals in a morally objectionable way. Tadros aims to show that we would indeed be “using” convicted criminals in such cases but that, while “using” others is (...) ordinarily morally wrong, there are cases in which it is in fact morally permissible . Moreover, he claims that punishing convicted criminals in order to deter other, potential criminals is an instance of “using” others that is sometimes clearly morally justifiable. My aim is to show how extraordinarily interesting some of Tadros’ arguments are but also why, in my view, they fail to establish the view he claims they support. I also suggest some ways in which Tadros might revise his arguments to support his central claim more effectively. (shrink)
