Le présent article s’appuie sur une pratique psychologique dans le cadre de visites médiatisées. Il cible notamment les entretiens cliniques réalisés par le psychologue avec les parents dans l’après-coup des visites médiatisées et a pour objectif de saisir l’enjeu clinique de ces temps d’entretiens. Deux vignettes cliniques permettent d’esquisser les potentialités des rencontres en l’absence des enfants. Il apparaît que ces entretiens favorisent le rétablissement d’une activité de mentalisation et de symbolisation. Enfin, une discussion métapsychologique éclaire les études de cas.

L’article présente la concordance et les accordages entre le travail processuel du psychologue en visite médiatisée et les fonctions maternelles assurées par l’assistant(e) familial(e) auprès de l’enfant accueilli. Dans une approche inter et transdisciplinaire garantie par un métacadre institutionnel sécurisant, le psychologue clinicien se trouve à l’articulation de ces instances complémentaires. Les enfants amenés à rencontrer leur(s) parent(s) en visite médiatisée se sont développés dans une famille aux liens pathologiques. Le clinicien vient assurer une fonction de (...) moi-auxiliaire pour l’enfant, favorisant l’émergence d’une autonomisation psychique possible quant à sa relation avec ses parents. Au sein de l’accueil familial, l’enfant exprimera les modalités relationnelles qui sont siennes, trouvera chez l’assistant(e) familial(e) une nouvelle figure parentale d’identification et d’attachement. La situation de Clémence illustre les effets subjectivants de chacun des cadres d’intervention et par-delà le travail inter et transdisciplinaire mené. (shrink)

Les visites médiatisées sont des temps de remise en contact protégés par la présence obligatoire d’un tiers professionnel entre un enfant qui fait l’objet d’une mesure de protection judiciaire et son ou ses parents dont l’autorité parentale a été restreinte du fait d’une situation de danger ou de risque de danger de l’enfant suspectée ou avérée. Ces mesures, ordonnées par un magistrat, visent à encadrer le maintien des relations entre l’enfant et son parent, utile et nécessaire pour la construction psychique (...) de l’enfant, tout en donnant la possibilité d’une part d’évaluer la qualité des liens et les capacités parentales et, d’autre part, d’accompagner enfant et parent dans un travail d’élaboration sur la signification de cette mesure de protection. In lieu of an abstract, here is a brief excerpt of the content:The Adoro Te Devote of St. Thomas AquinasSr. Lucia Marie of the Visitation Langford O.P.The Adoro te devote is perhaps the most well-beloved Eucharistic hymn of our time, popularly attributed to St. Thomas Aquinas, the medieval Dominican friar known for his theological treatises as well as his Eucharistic hymnography. Unlike most of Aquinas's work, the poem reveals the intensely personal side of his faith. Rich in theological content and (...) inspiring deep Eucharistic devotion, this poem amply repays a closer investigation. We will look first at the questions of authorship, background, and structure before moving on to a discussion of the text itself.The "Disputed Question" of AuthorshipWhile the Adoro te has traditionally been attributed to St. Thomas Aquinas, the Thomistic authorship of the text was contested in the twentieth century, with two main objections being raised. The first claims that the content of the poem contradicts Thomas's own teachings and cannot have flowed from the same pen. The second objection is historical, claiming that a lack of evidence makes Thomistic authorship improbable.The first objection, claiming that the content of the poem is irreconcilable with Thomistic authorship, takes objection to a line in the poem which seems to claim that sense perception is unreliable and inaccurate, at least with regard to the Eucharist. The text of the Adoro te uses the word fallitur (deceived) with reference to the senses: "Visus, tactus, gustus in te fallitur"—"Sight, touch, taste in you are deceived." Some scholars have claimed that this line contradicts the teaching of Aquinas that the senses are [End Page 365] infallible in regard to their proper sensibles.1 Robert Wielockx addresses this charge in his study of the Adoro te, arguing that "the text does not contradict the continuous teaching of Thomas according to which the senses are not wrong when they judge their proper object, which as far as the Eucharist is concerned, is only the sacramental species."2 The substantial presence of Christ in the Eucharist is a mystery which is not knowable by the senses, and as Paul Murray, O.P., observes: "That's surely the point St. Thomas is making."3 However, the Thomistic insistence that all knowledge comes through our senses is not missing even here. While sight, touch, and taste fall short of comprehending the truth before them, the Adoro te itself proclaims that it is another sense—hearing—which reveals the mystery: "sed auditu solo tute creditur"—"but by hearing alone it is safely believed."4Thus there is no solid objection to Thomistic authorship based on the poem's content. But what about the historical evidence? Dom André Wilmart published a comprehensive study of the manuscript tradition in 1929. Noting that there were no extant copies of the text dating to Aquinas's lifetime and that the biography of Aquinas written by his own Dominican confrere and contemporary, William of Tocco, made no mention of the Adoro te, he considered it most probable that the poem was authored at a later date and ascribed to Aquinas.5However, Dom Wilmart did not know that he was not working with William of Tocco's final version of his work. The publication of a critical edition of William of Tocco's Ystoria Sancti Thome de Aquino in 1996 demonstrated that Tocco published his work in four successive redactions. The fourth and final version of his text (unknown to Dom Wilmart) was finished just before his death in 1323, and in this final version, Tocco includes the text of the Adoro te, attributing its authorship to St. Thomas.6 [End Page 366] Furthermore, Wielockx published a study of the Adoro te in 1998; his investigation of the manuscript tradition found that, of fifty-one sources, forty-four explicitly cite St. Thomas as their author. This study applied psychographic segmentation theory to explore the psychological type profile of 1082 visitors to four cathedrals (three in England and one in Wales) and to set this profile alongside the published national normative data. Data provided by the Francis Psychological Type Scales demonstrated that among cathedral visitors there were more introverts (60%), sensing types (72%) and judging types (80%), with a balance between thinking types (49%) and feeling types (51%). Comparisons with the population norms demonstrated that extraverts and (...) perceiving types were significantly underrepresented among visitors to these four cathedrals. The implications of these findings are discussed for enhancing the visitor experience of those currently visiting and for attracting those psychological types currently less likely to visit. CONTRIBUTION: Situated within the science of cathedral studies, this article demonstrates (by means of applying psychographic segmentation theory and gathering data from four cathedrals) that extraverts and perceiving types were significantly under-represented among cathedral visitors. As people grow old, many risk becoming chronically lonely which is associated with e.g. depression, dementia, and increased mortality. Whoever else should help to protect them from this risk, various philosophers have argued that any children that they might have will often be among them. Proceeding on this assumption, this article considers what filial duties to protect ageing parents from loneliness consist of, or might consist of. I develop my answer by showing that a view that may be intuitively plausible, (...) namely that they simply require children to visit their ageing parents regularly when they can do so at reasonable cost and call, text, and/or email them from time to time, is defective in three respects. First, it ignores children’s potential responsibilities to encourage and/or facilitate social interaction between their parents and third parties. Second, it ignores their potential responsibilities to help provide their parents with non-human companionship. Third, it elides over their duties to coordinate their efforts to offer loneliness protection with others. What I end up proposing instead, then, is an approach for protecting ageing parents from loneliness that is multi-faceted. (shrink)

Some doctors and nurses played a key role in Nazism. They were responsible for the sterilization and murder of people with disabilities. Nazi doctors used concentration camp inmates as guinea pigs in medical experiments that had military or racial objectives. What we have learnt about the behaviour of doctors and nurses during the Nazi period enables us to reflect on several issues in present-day medicine. In some authors' opinions, the teaching of the medical aspects of the Holocaust could be a (...) new model for education relating to professionalism, Human Rights, Bioethics and the respect of diversity. Teaching Medicine and the Holocaust could be a way of informing doctors and nurses of violations of Ethics in the past. Moreover, a Study Trip to Holocaust and Medicine related sites has a strong pedagogical value. Visiting Holocaust related sites, T4 centres and the places where medical experiments were carried out, has a special meaning for medical students. Additionally, tolerance, anti-discrimination, and the value of human life can be both taught and learned through this curriculum. The following article recounts our experiences of organizing and supervising a study trip with a group of medical students to some Holocaust and medicine-related sites in Berlin and Hadamar. The study tour included lectures at universities in Düsseldorf and Berlin. (shrink)

Ted Sider aptly and concisely states the self-visitation paradox thus: 'Suppose I travel back in time and stand in a room with my sitting 10-year-old self. I seem to be both sitting and standing, but how can that be?' (2001, 101). I will explore a relativist resolution of this paradox offered by, or on behalf of, endurantists.1 It maintains that the sitting and the standing are relative to the personal time or proper time of the time traveler and is intended (...) to yield the result that Ted is sitting at a certain initial personal/proper time but is not standing relative to that time. Similarly, it is also supposed to yield that Ted is standing relative to a later personal/proper time, but not sitting relative to that .. (shrink)

Jessica Flanigan argues that individuals have the right to self-medicate. Flanigan presents two arguments in defense of this right. The first she calls the epistemic argument and the second she calls the rights-based argument. I argue that the right to self-medicate hangs and falls on the rights-based argument. This is because for the epistemic argument to be sound agents must be assumed to be epistemically competent. But, Flanigan’s argument for a constitutionally mandated right to self-medicate models agents as epistemically incompetent. (...) For Flanigan, agents are different at the pharmacy than they are at the polls. I identify this behavioral asymmetry and advocate a symmetric and realistic behavioral postulate for both arguments. The result, however, is that the success of the epistemic argument becomes contingent which fails to justify a constitutionally mandated right. I proceed to raise skepticism about the rights-based argument as well. I conclude that there is reason to be skeptical that these arguments can justify a constitutionally mandated right to self-medicate. Ultimately, a bottom-up approach to pharmaceutical ethics is preferable. (shrink)

ABSTRACTThe role of exemplification and exemplars is receiving increasing attention in educational theory. Usually, this is connected to emulation models in character and moral education. Exemplars in this framework are those who show us how to act and what to do, and inspire us emotionally to improve. In Hannah Arendt’s unfinished work on judgement, the exemplar plays a different role. Instead of functioning as an inspiration for behavioural change, the exemplar inspires thinking. In Men in Dark Times and the lecture (...) series ‘Some questions of moral philosophy’, we find a collection of texts describing in detail some of the intellectual inspirations for Arendt’s work on exemplarity and judgement. In this paper, I will use an exploration of these texts as a starting point for considering the role of exemplarity in the development of educational judgement. (shrink)

At Danish universities, the governance structure is regulated by law. This structure was radically changed in 2003, abolishing the republican rule of the senate consisting of academics, students, and staff in favour of an authoritarian system assigning all executive power to the vice-chancellor, or as we say in Denmark, the rector. To introduce the current situation at Danish universities, in the first two sections of this article, I will compare them with more well-known counterparts in other countries. This situation is (...) reflected in exemplary cases, and in the third section, I focus on the most dramatic controversy ever encountered at a Danish university, the Koldau case, which reached national newspaper headlines and broadcasting in two rounds in 2011 and 2012. In the fourth section, I will interpret the case as an educational controversy in light of two conflicting ideas of the modern university, which may be attributed to two leading Enlightenment figures, Wilhelm von Humboldt and Denis Diderot. The conclusion is that to some extent, the failure to resist the neo-liberal university reforms in Denmark and the UK, and the drama of the Koldau case, may be explained with reference to the conflicting ideologies of those involved in these controversies. The Qurʾānic term, ‘ẓann,’ is usually understood and translated as conjecture. However, I argue that the Qurʾān uses ‘ẓann’ to mean dogmatic zeal or, in other words, being zealous to a certain belief. For conjecture, the Qurʾān uses the root ‘ḥ-s-b,’ such as, ‘ayaḥsabu.’ Although the Qurʾān may criticize some people's conjectures, it does not criticize the act of formulating opinions with the root ‘ḥ-s-b.’ However, the Qurʾān does criticize the act of ‘ẓann.’ This further emphasizes the distinction between conjecture (...) and ‘ẓann,’ according to the Qurʾān. The main emphasis is that when the Qurʾān requires people to shun most ‘ẓann,’ it is argued that it is asking to shun zealous beliefs and dogmas, and it is not asking to shun the formulation of conjectures. The method used is philological, in which the cognates are analyzed in their contexts and compared with their uses in the Qurʾān. Defining ‘ẓann’ as dogmatic zeal rather than conjecture has far-reaching implications in understanding Qurʾānic epistemology and the epistemic process it expects its audience to have. (shrink)

The self-visitation paradox is one paradox of time travel. As Ted Sider puts it, “Suppose I travel back in time and stand in a room with my sitting 10-year-old self. I seem to be both sitting and standing, but how can that be?” (2001, 101). So as not to beg any questions, let us label what is sitting B and what is standing C. The worry is about how B can be C in light of the looming contradiction that this (...) one person would be sitting and standing. Sider’s own approach is perdurantist, and holds that B is not C. My concern, though, is with solutions offered by, or on behalf of, endurantists–more 1 specifically, with solutions holding that B is C. The endurantist answer I shall criticize is a relativizer position maintaining that the sitting and the standing need to be relativized to the personal time or proper time of the time traveler. This manner of solution has been offered by Paul Horwich (1975, 433-435 ; 1987, 114-115) and also by Simon Keller and Michael Nelson (2001, 344). I will show that such a view has a linguistically suspect element and that there are three further reasons why relativizing only in this way falls short of solving the paradox. This will be enough to squash the relativizer position because it will not be clear how additional relativization could help, and furthermore any additional relativization would only make the linguistic matter worse. I will also present some considerations in favor of a non-contradiction endurantist alternative; this view eliminates the need for any relativization by denying that sitting and standing are contradictory properties. Yvon Garlan En visitant et revisitant les ateliers amphoriques de Thasos p. 269-329 L'article fait le bilan des recherches sur les ateliers amphoriques de Thasos entreprises en 1977 et présente, sous forme de tableaux commentés et abondamment illustrés, les milliers de timbres qui en sont issus. Les dernières fouilles réalisées au Molos par le service archéologique ont fourni un matériel particulièrement abondant (plus de 3 000 exemplaires) et riche en indications sur les variantes de matrices et l'impression des cachets entre (...) le dernier tiers du IVe siècle et le début de la seconde moitié du IIIe siècle. Le dépotoir de Chioni, fouillé en 1995 par l'École française d'Athènes, se scinde en deux ensembles : le premier contenant une cinquantaine de timbres «anciens » du milieu du IVe siècle et le second plus de 400 timbres «récents » qui mentionnent 85 éponymes postérieurs aux environs de 320. Chaque année, de 1978 à 2003, les sites connus ou présumés de production amphorique ont été l'objet de collectes de surface qui ont permis d'esquisser ou de compléter leur étude. La classification chronologique des magistrats amphoriques de Thasos a été revue en conséquence, sous forme d'un tableau argumenté, du début du timbrage «récent » (qui devrait se dater des environs de 333 av. J.-C.) jusque vers 210 (plusieurs décennies sans doute avant sa disparition). (shrink)

ABSTRACT In the ‘Cook Ding cutting up an ox’ parable, Zhuangzi advanced a doctrine on craft and its relationship with Dao. With reference to Merleau-Ponty’s philosophy in conjunction with an analysis of Zhuangzi’s epistemological position, we argue that Zhuangzi understood craft as involving the supersession of the cognitive. In craft, the relationship between human and world is non-cognitive and ‘pre-objective’, the living of this kind of relationship gives rise to a non-cognitive ‘practical sense’ which enables the craftsman’s movements to spontaneously (...) constitute wuwei. Zhuangzi’s ideal is that this kind of relationship is generalized to life as a whole, thereby enabling human actions to spontaneously constitute wuwei generally. This is why he stipulated ‘doing away with knowing’ as a self-cultivation technique required for attaining Dao. Thus, craft constitutes an embodiment of Dao in the double-sense of wuwei and the non-cognitive and ‘pre-objective’ relationship between human and world which enables wuwei. (shrink)

This article discusses Dutch visiting nurses’ moral considerations of their daily work. It is based on an empirical study using extensive semistructured interviews. The study is informed by the theoretical debate on the ‘ethics of care’ and the ‘ethics of justice’. It is argued that this debate easily turns into an unfruitful contest between these two perspectives: which one is best? The results suggest that visiting nurses’ moral considerations of their day-to-day work can be described well in terms of an (...) ethic of care. At the same time, however, concepts and issues central to an ethic of justice are also of crucial importance to their considerations. Nurses’ ways of managing to combine both perspectives, even in situations of apparent conflict between them, are described. Thus, clues are provided on how the debate on the ethics of care and the ethics of justice may be carried out in a more fruitful way apart from through hierarchically opposing both perspectives. The purpose of this study was to explore and interpret the meaning of relatives’ experiences of encounters with nurses when visiting residents in nursing homes. Thirteen relatives of residents in three nursing homes in Sweden were interviewed. The interviews were tape‐recorded and transcribed verbatim. The method used was hermeneutical text analysis. Four themes emerged in the analysis and interpretation of the whole text: ‘being paid attention to’, ‘being ignored’, ‘being involved’ and ‘being safe and secure’. A further interpretation of the (...) findings shows a deeper understanding of the meaning of relatives. This meaning was revealed as being invited into an encounter with nurses and gave a sense of community but the opposite was being ignored and left outside. This study gives a deeper understanding of the meaning of encounters between relatives and nurses in nursing homes; it also illuminates how these encounters also can affect the care of the residents. This new understanding can hopefully offer support for nurses during their encounters with relatives and optimise the ability to provide a positive outcome for residents in nursing homes. (shrink)

Are Detroit ruin tours a form of morally permissible cultural tourism, or do these tours amount to a form of exploitation? To answer this question I compare Detroit ruin tours with ‘slum tours’ – guided tours of slums in the world's major cities. I argue that exploitation of the sort we find in slum tourism also exists, to a lesser extent, in Detroit ruin tours. To show this I detail two different accounts of exploitation and argue that Ruth Sample's account (...) best captures what is most morally problematic with slum tours and ruin tours. I then identify the similarities and differences between slum tours and ruin tours, and provide suggestions for how ruin tours could be retooled to avoid some of the worries of exploitation. Finally, I suggest that with the proper framing Detroiters could embrace photographic tours as a new form of cultural tourism. (shrink)

Human connection is universally important, particularly in the context of serious illness and at the end of life. The presence of close family and friends has many benefits when death is close. Hospital visitation restrictions during the Coronavirus pandemic therefore warrant careful consideration to ensure equity, proportionality, and the minimization of harm. The Australian and New Zealand Society for Palliative Medicine COVID-19 Special Interest Group utilized the relevant ethical and public health principles, together with the existing disease outbreak literature and (...) evolving COVID-19 knowledge, to generate a practical framework of visiting restrictions for inpatients receiving palliative and end-of-life care. Expert advice from an Infectious Diseases physician ensured relevance to community transmission dynamics. Three graded levels of visitor restrictions for inpatient settings are proposed, defining an appropriate level of minimum access. These depend upon the level of community transmission of COVID-19, the demand on health services, the potential COVID-19 status of the patient and visitors, and the imminence of the patient’s death. This framework represents a cohesive, considered, proportionate, and ethically robust approach to improve equity and consistency for inpatients receiving palliative care during the COVID-19 pandemic and may serve as a template for future disease outbreaks. Attacks explanatory deductivism, the view that all genuine explanations have the form of a correct deductive argument. The view has strong intuitive appeal to many philosophers. The author offers a defense against the claim that there are no statistical explanations of particular facts. In other words, he shows that statistical explanations of statistical generalizations – in the form that Hempel designated as the deductive–statistical variety – are not the only correct forms of statistical explanation. In this Article, I examine the Visiting Mechanisms under the Convention against Torture (CAT) and the Optional Protocol thereto (OPCAT), applying an analytic approach resting on Foucault’s Discipline and Punish. I argue that international Visiting Mechanisms essentially constitute disciplinary apparatuses as depicted by Foucault. However, because they fail to recognise this functional similarity, they do not effectively apply the methods of inducing panoptic power. Most notably the concept of ‘hierarchical observation’ is hardly utilised at all. The two introduced legal entities, (...) the Committee against Torture under CAT, and the Subcommittee for the Prevention of Torture under OPCAT, both engage in visits to states with a view to eradicate torture and ill-treatment throughout the world. Critically examining their systemic design and practises reveals that the preventative ante hoc mandate of the Subcommittee is more effective than the post hoc inquiries of the Committee. Nevertheless, because both entities unfortunately fail to fully utilise panoptic power, the article concludes by offering a set of recommendations for both bodies that could arguably enhance their overall effectiveness. In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. School-aged children often participate in school field trips, summer camps or visits at informal learning institutions like zoos and museums. However, relatively little is known about children’s memory and learning from these experiences, what types of event details and facts are retained, how retention varies across age, and whether different patterns are observed for different types of experiences. We aimed to answer these questions through a partnership with a local zoo. Four- to 10-year-old children participated in a weeklong summer camp, (...) during which they engaged in dynamic events, including visits to zoo animals. On the last day of camp, we elicited autobiographical event narratives for two types of experiences: a child-selected animal event and an experimenter-selected animal event. We coded event narratives for length and breadth using previously used autobiographical memory narrative coding schemes. In addition, we created a coding scheme to examine retention of semantic information. We report the types of autobiographical event details and facts children recalled in their narratives, as well as age group differences that were found to vary depending on the type of information and type of event. Through this naturalistic, yet controlled, study we gain insights into how children remember and learn through hands-on activities and exploration in this engaging and dynamic environment. We discuss how our results provide novel information that can be used by informal learning institutions to promote children’s memory and retention of science facts. (shrink)
