Why is it so plausible that business organisations in contemporary society use values in their communication? In order to answer this question, a sociological, system theoretical approach is applied which approaches values not pre-empirically as invisible drivers for action but as observable semantics that form organisational behaviour. In terms of empirical material, it will be shown that business organisations resort to a communication of values whenever uncertainty or complexity is very high. Inevitably, value semantics are applied in organisations first when (...) the speakers are uncertain about which stakeholders to whom they have to address (uncertainty) or when different stakeholder groups have to be addressed simultaneously (complexity); second, when the identity of the organisation has to be described; and third, when future strategic options that cannot be expressed by quantitative terms have to be communicated. Values accordingly play a role in organisational practice when certain aspects are indeterminate. Therefore, they are a means for organisations to communicate under fuzzy circumstances. Public and government outrage over recent tax fraud and tax shelter cases led to significant changes in the preparer penalty laws under the Small Business Work Opportunity Act of 2007. This study experimentally examines the effectiveness of the revised preparer penalty provisions at reducing tax preparer aggressiveness. Specifically, we examine the impact of two significant components of the changes to the preparer penalty provisions - the increase in penalty amount and the increase in the likelihood of sustaining the tax position (...) required to avoid penalty imposition (required likelihood threshold) - on tax preparers’ willingness to (1) recommend an uncertain position and (2) sign a tax return containing an aggressive position. The results suggest that both the increase in penalty amount and the increase in required likelihood threshold reduce tax preparers’ willingness to recommend an uncertain position and/or sign a tax return containing an aggressive position. Of the two components, the results indicate that the increase in required likelihood threshold is more effective at reducing tax preparer aggressiveness than the increase in penalty amount. Congress may want to rethink its recent decision to reduce the required likelihood threshold for many of the decisions that tax preparers make with their clients. (shrink)

MUC1 and MUC4 are the two membrane mucins that have been best characterized. Although they have superficially similar structures and have both been shown to provide steric protection of epithelial surfaces, recent studies have also implicated them in cellular signaling. They act by substantially different mechanisms, MUC4 as a receptor ligand and MUC1 as a docking protein for signaling molecules. MUC4 is a novel intramembrane ligand for the receptor tyrosine kinase ErbB2/HER2/Neu, triggering a specific phosphorylation of the ErbB2 in the (...) absence of other ErbB ligands and potentiating phosphorylation and signaling through the ErbB2/ErbB3 heterodimeric receptor complex formed in the presence of neuregulin. In contrast, MUC1 has a highly conserved cytoplasmic tail, which binds β‐catenin, a key component of adherens junctions and a regulator of transcription, in a process that is tightly regulated by MUC1 phosphorylation. The specific localization of these membrane mucins to the apical surfaces of epithelial cells suggests that their signaling functions may be important as sensor mechanisms in response to invasion or damage of epithelia. El presente artículo tiene como objetivo analizar la recepción argentina de los governmentality studies , particularmente con los denominados anglofoucauldians . En esta dirección, nos referimos, inicialmente a los “deslizamientos” y “sobreentendidos” implicados en la traducción local de la perspectiva que examinamos. En segundo lugar, en un nivel más teórico y general, abordamos las limitaciones que supone la analítica del gobierno entendida en términos de la descripción de unas racionalidades políticas. En este punto, proponemos un modo alternativo, aunque complementario, de (...) reflexión sobre las prácticas discursivas de gobierno. Para ello, nos nutrimos de las elaboraciones provenientes del análisis materialista del discurso. Finalmente, en las conclusiones reflexionamos acerca del Sur como posición enunciativa desde la cual contribuir al debate teórico-conceptual sobre el problema del gobierno y la gubernamentalidad. Drawing on the hypothesis that workplace harassment may be considered a genre of negative communication serving malicious purposes, the purposes of this paper are threefold. In the first place, we consider the difficulties involved in proving workplace harassment before administration or in court. In the second place, we analyse the challenges workplace harassment poses to linguistic analysis, with special reference to genre theory, and suggest ways of making the theory compatible with the new linguistic input the language of harassment provides. (...) Finally, we illustrate the knowledge the expert linguist can offer from the perspective of genre theory in cases involving workplace harassment. In order not to build a castle in the sky, our analysis is grounded in an exemplary case study relating to a specific type of harassment in the workplace that Leymann named « workplace mobbing ». La amenaza del terrorismo y la radicalización son desafíos que trascienden las fronteras internacionales, por sus consecuencias negativas para nuestra sociedad. España fue uno de los países europeos más afectados por los atentados terroristas. Ejemplo de ello fueron los firmados años de liderazgo de la banda terrorista ETA (1961-2010); el 11M (2005), que sacudió no solo a Madrid, sino a toda Europa; y los atentados de Barcelona y Cambrills (2017), todos los cuales dieron la voz de alarma sobre la necesidad (...) de detectar y prevenir la radicalización, ya que aparentemente se trataba de jóvenes integrados en la sociedad. El sufrimiento, el dolor y la muerte tangible del terrorismo hacen de la pedagogía de la muerte la mejor manera de abordar la educación del terrorismo desde un enfoque radical e inclusivo holístico, un estudio de la educación que la ve como antesala de una formación profunda por interiorización. Se basa en varios enfoques didácticos y formativos: (1) enfoque de acompañamiento educativo, desde el que se ofrecen respuestas eficaces a situaciones de duelo vivenciadas por algún miembro de la comunidad educativa; (2) un enfoque curricular centrado en promover la conciencia de la finitud en la educación y su tratamiento normalizado; (3) Un enfoque evolutivo fenomenológico entendido a partir de la teoría evolutiva desde la conciencia donde el nacimiento y la muerte no definen claramente el antes y el después. (4) Un enfoque meditativo vacío de la inexistencia. A partir de ahí, se hace referencia a la meditación para alcanzar la plena conciencia. Pues bien, en esta contribución científica se propone cómo trabajar con aplicar cada uno de estos enfoques en una Didáctica del Terrorismo que tenga un cuenta un enfoque radical e inclusivo. Although there is now a substantial body of literature exploring the effects of language diversity in international management contexts, little attention has been paid to the ethical dimensions of language diversity at work. This conceptual paper draws on the concept of epistemic injustice in order to explore how language, and in particular corporate language policies, may act as a source of epistemic injustice within the workplace. It demonstrates how language competence affects credibility judgements about a speaker, and also considers how (...) corporate language policies can create situations of hermeneutic injustice, in which marginalised groups are denied the vocabularies to understand their own experiences. Finally, ways in which such epistemic harms can be reduced are discussed, and the possibilities for management education to create epistemically responsible managers are highlighted. (shrink)

We call systematic disputes that are particularly hard to resolve deep disagreements. We can divide most theories of deep disagreements in analytic epistemology into two camps: the Wittgensteinian view and the fundamental epistemic principles view. This essay analyzes how both views deal with two of the most pressing issues a theory of deep disagreement must address: their source and their resolution. After concluding that the paradigmatic theory of each camp struggles on both fronts, the essay proceeds to show that, despite (...) their differences, these theories share some core assumptions and think of deep disagreements similarly: as grounded in fundamental epistemic differences between the parties. This underlying conception of deep disagreements the author calls “the fundamental model.” The essay provides reasons to be wary of this conception, and hence, mainstream epistemologists’ treatment of the issue. Following the critically acclaimed _Zen at War_, Brian Victoria explores the intimate relationship between Japanese institutional Buddhism and militarism during the Second World War. Victoria reveals for the first time, through examination of the wartime writings of the Japanese military itself, that the Zen school's view of life and death was deliberately incorporated into the military's programme of 'spiritual education' in order to develop a fanatical military spirit in both soldiers and civilians. Furthermore, that D. T. Suzuki, the (...) most famous exponent of Zen in the West, is shown to have been a wartime proponent of this Zen-inspired viewpoint which enabled Japanese soldiers to leave for the battlefield already resigned to death. Victoria takes us onto the naval battlefield in the company of warrior-monk and Rinzai Zen Master Nakajima Genjô. We view the war in China through the eyes of a Buddhist military chaplain. The book also examines the relationship to Buddhism of Japan's seven Class-A war criminals who were hung by the Tokyo War Crimes Tribunal in 1948. A highly controversial study, this book will be of interest, first and foremost, to students of Zen as well as all those studying the history of this period, not to mention anyone concerned with the perennial question of the 'proper' relationship between religion and the state. Numerous societal issues, from climate change to pandemics, require public engagement with scientific research. Such engagement reveals challenges that can arise when experts communicate with laypeople. One of the most common frameworks for framing these communicative interactions is the deficit model of science communication, which holds that laypeople lack scientific knowledge and/or positive attitudes towards science, and that imparting knowledge will fill knowledge gaps, lead to desirable attitude/behavior changes, and increase trust in science. §1 introduces the deficit model in more (...) detail and shows that adhering to this model often fails to achieve its aims, which motivates the main question of this chapter: how can Ludwik Fleck’s theory of thinking collectives address the persistent problem of deficit approaches in science communication? I suggest that it can do so by exposing the deficit model’s implicit assumption of an expert-lay divide. Accordingly, §2 lays out Fleck’s theory and §3 contrasts it with contemporary debates about science communication. Following this descriptive work, §4 draws on Fleck’s ideas to make four concrete suggestions for further questioning the expert-lay divide. (shrink)

In Building Better Beings, Vargas develops and defends a naturalistic account of responsibility, whereby responsible agents must possess a feasibly situated capacity to detect and respond to moral considerations. As a preliminary step, he also offers a substantive account of how we might justify our practices of holding responsible—viz., by appeal to their efficacy in fostering a ‘valuable form of agency’ across the community at large, a form of agency that precisely encompasses sensitivity to moral considerations. But how do these (...) accounts relate to one another? Though I find much that is appealing in Vargas’s general approach, I challenge his insistence that these accounts should be treated as ‘conceptually independent’, arguing that this generates an objectionable “justification gap”: on his analysis, someone could remain an appropriate target of our responsibility practices and yet fail to be a morally responsible agent. In closing, I offer a potential solution to this problem, though it means re-visioning how the account of moral responsibility is conceptually tied to the justification of our responsibility practices. Civic engagement requires individuals to have both knowledge of democratic principles and the skills for enacting change. Acquiring the knowledge and skills necessary for a productive civic life can be difficult for students if they are not provided conceptual scaffolds and opportunities to practice citizenship. We implemented and studied an activity using Westheimer and Kahne's (2004) citizenship typology during a summer civics institute to help students grapple with their understandings of “good” citizenship. We found (1) students appropriated the language of (...) Westheimer and Kahne's citizenship typology by using it to describe their expanding understandings of citizenship; and (2) students used the citizenship typology to name and make sense of their civic identity. We discuss these findings and reflect on our use of Westheimer and Kahne's citizenship typology as a cognitive scaffold. (shrink)

In this article, we explicate evidence-based nursing (EBN), critically appraise its framework and respond to nurses’ concern that EBN sidelines the caring elements of nursing practice. We use resources from care ethics, especially Vrinda Dalmiya’s work that considers care as crucial for both epistemology and ethics, to show how EBN is compatible with, and indeed can be enhanced by, the caring aspects of nursing practice. We demonstrate that caring can act as a bridge between ‘external’ evidence and the other pillars (...) of the EBN framework: clinical expertise; patient preferences and values. Drawing on an influential EBN handbook, section 1 presents the aims and features of EBN, including the normative principle that EBN should take place within a ‘context of caring’. We aim to understand this context and whether it can be neatly detached from the EBN framework, as the handbook seems to suggest. In section 2, we highlight the grounds for resistance to EBN from the nursing community, before mounting the argument that nursing practices can be understood fruitfully through feminist care ethics and/or virtue ethics lenses. In section 3, we deepen that analysis using Dalmiya’s concepts of care-knowing and care as a hybrid ethico-epistemic virtue, which are ideally suited to the complex practices of nursing. In section 4, we bring this rich understanding of care into conversation with EBN, showing that its framework cannot be adequately theorised without paying proper attention to care. Caring can be neither an innocuous background assumption of nor an afterthought to the EBN framework. (shrink)

This paper is divided into two parts. In Section 1, I explore and defend a “regulative view” of folk-psychology as against the “standard view”. On the regulative view, folk-psychology is conceptualized in fundamentally interpersonal terms as a “mind-making” practice through which we come to form and regulate our minds in accordance with a rich array of socially shared and socially maintained sense-making norms. It is not, as the standard view maintains, simply an epistemic capacity for coming to know about the (...) mental states and dispositions already there. Importantly, the regulative view can meet and beat the standard at its own epistemic game. But it also does more.
