What did early national Americans mean when they articulated fears of those twin sins of a republic that idolized the classical virtues of manly self-restraint? This essay argues that the fear of luxury and effeminacy circulated not just as airy metaphor but as palpable reality, specifically in the figure of the female recumbent on the sofa. The article traces separately the careers of Enlightenment Venus, who especially in her recumbent form embodied fears of passion in a republic built on (...) reasoned consent, and the sofa, a piece of neoclassical furniture that rose to great popularity at this time and was envisioned as both effeminate and luxurious in fictional and nonfiction writing. The essay then joins the two figures of recumbent Venus and the sofa, showing how they were mutually enabling, and how they entered into early national conversations about labor and race. It concludes by examining how two educated American women, the self-described Roman matrons Mercy Otis Warren and Martha Bayard Smith, incorporated the image of the supine woman and her implied sofa into fictional writings about classical polities in danger. By knitting political ideologies, imaginative worlds, and neoclassical objects, the essay suggests a way for historians to flesh out the intellectual history of early national women, showing how they could participate in a conversation about modern politics and classical antiquity from which we have assumed they were largely disbarred. Whether we read Derrida or not, many of us in and outside of the academy are invested in destabilizing established narratives, ideas, and categories. Similarly, we are eager to show how dominant narratives and categories tend to cover over more promising ways of imagining and interpreting the world. Recently, this deconstructive spirit has been directed toward discourses about the black church, black religion, and black cultures more generally. Authors like Curtis (...) There are those who take Nietzsche seriously as a philosopher and study his works for their own sake, while others seek to mine his works for philosophical gold to determine what he might (...) have to offer their particular area of specialization (and sometimes these objectives overlap). On the other hand, there are those who seek to sensationalize Nietzsche by making him out to be a caricature or buffoon of sorts—far less deserving of the kind of seriousness we reserve for other figures such as Descartes or Kant. Instead, Nietzsche's philosophical legacy is colored by his ill health, alleged homosexuality, or "madness." Some recent biographies have only perpetuated the caricature. Fortunately, Small's book is not one of them.Small aims to explain the philosophical relationship between Nietzsche and Rée. Nietzsche's background is well known, while Rée's life has received only slight attention from scholars. Although he did not self-identify as Jewish, Rée was born into a wealthy Jewish family, which afforded him the luxury of attending several different German universities. After studying law, psychology, and physiology, he finally settled on philosophy. By the time Rée met Nietzsche, he had already defended a dissertation on Aristotle's ethics and published his first book, Psychological Observations, in 1875.Throughout the book, Small subtly fuses the personal with the philosophical without weakening the philosophical substance of Nietzsche's or Rée's ideas. In explaining Rée's influence on Nietzsche during the seven years of their friendship, Small accomplishes several objectives.First and foremost, Small illuminates the development of Nietzsche's thought from 1875 until 1882. It was during these years that Nietzsche published Human, All Too Human (1878; the first supplement to the book was published in 1879 and the second in 1880), Daybreak (1881), and The Gay Science (1882). More importantly, Small demonstrates the nexus between these works and Rée's Psychological Observations (1875) and The Origin of Moral Sensations.During the winter of 1876–77, Nietzsche and Rée lived together. At this time Nietzsche began writing Human, All Too Human, while Rée wrote The Origin of Moral Sensations. Nietzsche turned to Rée's Psychological Observations for headings for his own Human, All Too Human. Thus, "'On Religious Things' became 'The Religious Life,' while 'On Woman, Love and Marriage' became 'Woman and Child'" (28). As Nietzsche continued work on Human, All Too Human, Rée's The Origin of Moral Sensations was published and Nietzsche drew inspiration from this book as well. In section 40 of The Wanderer and His Shadow (the second supplement to Human, All Too Human), Nietzsche provides an abbreviated version of the core argument of that work, namely that the move away from utility and towards socially accepted norms as the determining factor in behavior is what led to morality. For these reasons, it is no surprise that Nietzsche referred to the "Rée-ness" of his work, and dubbed books like Human, All Too Human as "Réealism" (x, 33, 65). Their mutual admiration for Schopenhauer, denial of free will, skepticism about morality and metaphysics, and adherence to philosophical naturalism created a friendship that nurtured their philosophical development generally and their philosophical projects more specifically.Third, Small sheds light on how Nietzsche integrated Rée's aphoristic style into his own philosophical writings. This is helpful because it contextualizes Nietzsche's writing style during the time when his strict preoccupation with philological matters had ended and he began exhibiting contempt for morality and extolling the virtues of scientific knowledge.Fourth, Small discusses Nietzsche's break with Rée, the central tension of which he locates in Nietzsche's willingness to move beyond Rée's merely descriptive approach to moral phenomena towards a life-affirming philosophy. Social norms – rules governing which behaviours are deemed appropriate or inappropriate within a given community – are typically taken to be uniquely human. Recently, this position has been challenged by a number of philosophers, cognitive scientists, and ethologists, who have suggested that social norms may also be found in certain non-human animal communities. Such claims have elicited considerable scepticism from norm cognition researchers, who doubt that any non-human animals possess the psychological capacities necessary for normative cognition. However, there is (...) little agreement among these researchers about what these psychological prerequisites are. This makes empirical study of animal social norms difficult, since it is not clear what we are looking for and thus what should count as behavioural evidence for the presence (or absence) of social norms in animals. To break this impasse, we offer an approach that moves beyond contested psychological criteria for social norms. This approach is inspired by the animal culture research program, which has made a similar shift away from heavily psychological definitions of ‘culture’ and to become organized around a cluster of more empirically tractable concepts of culture. Here, we propose an analogous set of constructs built around the core notion of a normative regularity, which we define as a socially maintained pattern of behavioural conformity within a community. We suggest methods for studying potential normative regularities in wild and captive primates. We also discuss the broader scientific and philosophical implications of this research program with respect to questions of human uniqueness, animal welfare and conservation. (shrink)

My aim in this paper is to defend negligence as a legitimate basis for moral and criminal culpability. In so doing, I also hope to demonstrate how philosophical and jurisprudential perspectives on responsibility can mutually inform each other. While much of the paper focuses on criminal negligence, my aim is to show how attention to certain doctrines and concepts in criminal law can shed light on our understanding of moral culpability including culpability for negligence. It is often taken to be (...) a fundamental principle of criminal law that an act cannot be guilty unless it is accompanied by a culpable state of mind or mens rea. This has led to scepticism regarding negligence as a legitimate basis for desert-based criminal sanction because it is not clear that negligence picks out any mental state at all, much less a culpable one. In this paper I articulate and defend a unified account of moral and criminal culpability that rejects the standard view of mens rea that underlies negligence-skepticism. Specifically, I hold that the mens rea element of a crime does not function to inculpate, as is standardly held, but to partly determine the description under which an action counts as wrongful. While I agree that we should be especially cautious about criminalizing negligence, the relevant question, on my view, is not whether a given mens is sufficiently culpable but whether the mens-cum-actus is sufficiently wrongful to warrant the attention of criminal justice. Shard cinema tells an expansive story of how moving images have changed in the last three decades, and how they have changed us along with them, rewiring the ways we watch, fight, and navigate an unsteady world. In a set of interrelated essays that range from the writings of early factory workers to the distributed sight of contemporary surveillance, Williams argues for deep links between the images we see and the hidden labors frozen into them, exploring how even the apparently (...) trivial or spectacular carries unique opportunities to detect and process the social frictions of their making. As an antidote to human exceptionalism we turn to the account of aesthetic judgment in Darwin’s Descent of Man, according to which the mental capacities of humans differ from those of lower animals only in degree, not in kind. Thoroughgoing naturalistic explanation of these capacities is (...) made easier by shifting away from the substance-metaphysical implications of the search for an account of mind, toward a dispositional account of the origins of mindfulness. English summary: The study of the philosophy of history is currently divided into two largely irreconcilable approaches. The methodological and scientific analysis of historical practice stands opposed to an approach based on the reflection on the historicity of human identity. Previous attempts to overcome this discrepancy have been prevented from seeking recourse in Hegel's historical thought, since it is still seen as representing a substantialist and tangible philosophy of history and therefore as being theoretically obsolete. Max Winter shows that Hegel (...) not only possesses a theoretically sophisticated and formal philosophy of history, but one that is also able to bridge gaps within philosophy of history today, in that it combines an epistemology of historical knowledge with a theory of historical identity. The idea of ‘relations’ being ‘between’ things pushes one into a ‘this’ and ‘that’ (and maybe ‘and the other’) thinking space. In Jacques Derrida's famous words: ‘Deconstruction is justice’. The responsibility of deconstruction is to disrupt those taken‐for‐granted meanings of curriculum discourses by opening them up and releasing them from their metaphysical assumptions to see what or who may have been overlooked, marginalised and omitted in the process of curriculum‐making. The new model of knowledge formulated in The Schools White Paper for the General Certificate in Secondary Education examinations (GCSE6) is located within a challenging curriculum framework in which grade boundaries are raised, end‐of‐module examinations are replaced with end‐of‐course examinations and opportunities to re‐sit examinations through the course of the programme of study are removed. The application of artificial intelligence (AI) to judicial decision-making has already begun in many jurisdictions around the world. While AI seems to promise greater fairness, access to justice, and legal certainty, issues of discrimination and transparency have emerged and put liberal democratic principles under pressure, most notably in the context of bail decisions. Despite this, there has been no systematic analysis of the risks to liberal democratic values from implementing AI into judicial decision-making. This article sets out to fill this (...) void by identifying and engaging with challenges arising from artificial judicial decision-making, focusing on three pillars of liberal democracy, namely equal treatment of citizens, transparency, and judicial independence. Methodologically, the work takes a comparative perspective between human and artificial decision-making, using the former as a normative benchmark to evaluate the latter. -/- The chapter first argues that AI that would improve on equal treatment of citizens has already been developed, but not yet adopted. Second, while the lack of transparency in AI decision-making poses severe risks which ought to be addressed, AI can also increase the transparency of options and trade-offs that policy makers face when considering the consequences of artificial judicial decision-making. Such transparency of options offers tremendous benefits from a democratic perspective. Third, the overall shift of power from human intuition to advanced AI may threaten judicial independence, and with it the separation of powers. While improvements regarding discrimination and transparency are available or on the horizon, it remains unclear how judicial independence can be protected, especially with the potential development of advanced artificial judicial intelligence (AAJI). Working out the political and legal infrastructure to reap the fruits of artificial judicial intelligence in a safe and stable manner should become a priority of future research in this area. In kritischer Auseinandersetzung mit Heidegger und Gadamer entwickelt er einen neuen Ansatz, der phänomenologische, hermeneutische und strukturanalytische Verfahren zusammenführt. Genaue Analysen der Grundbegriffe Weitergabe, Wiederholung, Muster, Verstehen und Sinn erarbeiten eine Ontologie des traditionalen Phänomens.
