Quasi-Nelson logic (QNL) was recently introduced as a common generalisation of intuitionistic logic and Nelson's constructive logic with strong negation. Viewed as a substructural logic, QNL is the axiomatic extension of the Full Lambek Calculus with Exchange and Weakening by the Nelson axiom, and its algebraic counterpart is a variety of residuated lattices called quasi-Nelson algebras. Nelson's logic, in turn, may be obtained as the axiomatic extension of QNL by the double negation (or involutivity) axiom, and intuitionistic logic as (...) the extension of QNL by the contraction axiom. A recent series of papers by the author and collaborators initiated the study of fragments of QNL, which correspond to subreducts of quasi-Nelson algebras. In the present paper we focus on fragments that contain the connectives forming a residuated pair (the monoid conjunction and the so-called strong Nelson implication), these being the most interesting ones from a substructural logic perspective. We provide quasi-equational (whenever possible, equational) axiomatisations for the corresponding classes of algebras, obtain twist representations for them, study their congruence properties and take a look at a few notable subvarieties. Our results specialise to the involutive case, yielding characterisations of the corresponding fragments of Nelson's logic and their algebraic counterparts. (shrink)

Three early 20th-century attempts at unifying separate areas of biology, in particular development, genetics, physiology, and evolution, are compared in regard to their success and fruitfulness for further research: Jacques Loeb’s reductionist project of unifying approaches by physico-chemical explanations; Richard Goldschmidt’s anti-reductionist attempts to unify by integration; and Sewall Wright’s combination of reductionist research and vision of hierarchical genetic systems. Loeb’s program, demanding that all aspects of biology, including evolution, be studied by the methods of the experimental sciences, proved highly (...) successful and indispensible for higher level investigations, even though evolutionary change and properties of biological systems up to now cannot be fully explained on the molecular level alone. Goldschmidt has been appraised as pioneer of physiological and developmental genetics and of a new evolutionary synthesis which transcended neo-Darwinism. However, this study concludes that his anti-reductionist attempts to integrate genetics, development and evolution have to be regarded as failures or dead ends. His grand speculations were based on the one hand on concepts and experimental systems that were too vague in order to stimulate further research, and on the other on experiments which in their core parts turned out not to be reproducible. In contrast, Sewall Wright, apart from being one of the architects of the neo-Darwinian synthesis of the 1930s, opened up new paths of testable quantitative developmental genetic investigations. He placed his research within a framework of logical reasoning, which resulted in the farsighted speculation that examinations of biological systems should be related to the regulation of hierarchical genetic subsystems, possibly providing a mechanism for development and evolution. I argue that his suggestion of basing the study of systems on clearly defined properties of the components has proved superior to Goldschmidt’s approach of studying systems as a whole, and that attempts to integrate different fields at a too early stage may prove futile or worse. © 2011 Elsevier Inc. Kurt Gödel’s Incompleteness theorem is well known in Mathematics/Logic/Philosophy circles. Gödel was able to find a way for any given P (UTM), (read as, “P of UTM” for “Program of Universal Truth Machine”), actually to write down a complicated polynomial that has a solution iff (=if and only if), G is true, where G stands for a Gödel-sentence. So, if G’s truth is a necessary condition for the truth of a given polynomial, then P (UTM) has to answer first that (...) G is true in order to secure the truth of the said polynomial. But, interestingly, P (UTM) could never answer that G was true. This necessarily implies that there is at least one truth a P (UTM), however large it may be, cannot speak out. Daya Krishna and Karl Potter’s controversy regarding the construal of India’s Philosophies dates back to the time of Potter’s publication of “Presuppositions of India’s Philosophies” (1963, Englewood Cliffs Prentice-Hall Inc.) In attacking many of India’s philosophies, Daya Krishna appears to have unwittingly touched a crucial point: how can there be the knowledge of a ‘non-cognitive’ mokṣa? [‘mokṣa’ is the final state of existence of an individual away from Social Contract]—See this author’s Indian Social Contract and its Dissolution (2008) mokṣa does not permit the knowledge of one’s own self in the ordinary way with threefold distinction, i.e., subject–knowledge-object or knower–knowledge–known. But what is important is to demonstrate whether such ‘knowledge’ of non-cognitive mokṣa state can be logically shown, in a language, to be possible to attain, and that there is no contradiction involved in such demonstration, because, no one can possibly express the ‘experience-itself’ in language. Hence, if such ‘knowledge’ can be shown to be logically not impossible in language, then, not only Daya Krishna’s arguments against ‘non-cognitive mokṣa’ get refuted but also it would show the possibility of achieving ‘completeness’ in its truest sense, as opposed to Gödel’s ‘Incompleteness’. In such circumstances, man would himself become a Universal Truth Machine. This is because the final state of mokṣa is construed as the state of complete knowledge in Advaita. This possibility of ‘completeness’ is set in this paper in the backdrop of Śrī Śaṅkarācārya’s Advaitic (Non-dualistic) claim involved in the mahāvākyas (extra-ordinary propositions). (Mahāvākyas that Śaṅkara refers to are basically taken from different Upaniṣads. For example, “Aham Brahmāsmi” is from Bṛhadāraṇyaka Upanisad, and “Tattvamasi” is from Chāndogya Upaniṣad. Śrī Śaṅkarācārya has written extensively. His main works include his Commentary on Brahma-Sūtras, on major Upaniṣads, and on ŚrīmadBhagavadGītā, called Bhāṣyas of them, respectively. Almost all these works are available in English translation published by Advaita Ashrama, 5 Dehi Entally Road, Calcutta, 700014.) On the other hand, the ‘Incompleteness’ of Gödel is due to the intervening G-sentence, which has an adverse self-referential element. Gödel’s incompleteness theorem in its mathematical form with an elaborate introduction by R.W. Braithwaite can be found in Meltzer (Kurt Gödel: on formally undecidable propositions of principia mathematica and related systems. Oliver & Boyd, Edinburgh, 1962). The present author believes first that semantic content cannot be substituted by any amount of arithmoquining, (Arithmoquining or arithmatization means, as Braithwaite says,—“Gödel’s novel metamathematical method is that of attaching numbers to the signs, to the series of signs (formulae) and to the series of series of signs (“proof-schemata”) which occur in his formal system…Gödel invented what might be called co-ordinate metamathematics…”) Meltzer (1962 p. 7). In Antone (2006) it is said “The problem is that he (Gödel) tries to replace an abstract version of the number (which can exist) with the concept of a real number version of that abstract notion. We can state the abstraction of what the number needs to be, [the arithmoquining of a number cannot be a proof-pair and an arithmoquine] but that is a concept that cannot be turned into a specific number, because by definition no such number can exist.”.), especially so where first-hand personal experience is called for. Therefore, what ultimately rules is the semanticity as in a first-hand experience. Similar points are voiced, albeit implicitly, in Antone (Who understands Gödel’s incompleteness theorem, 2006). Nevertheless galatomic certainly, but unwittingly succeeds in highlighting the possibility of experiencing the ‘completeness’ Second, even if any formal system including the system of Advaita of Śaṅkara is to be subsumed or interpreted under Gödel’s theorem, or Tarski’s semantic unprovability theses, the ultimate appeal would lie to the point of human involvement in realizing completeness since any formal system is ‘Incomplete’ always by its very nature as ‘objectual’, and fails to comprehend the ‘subject’ within its fold. This paper offers a critique of the Bayesian interpretation of quantum mechanics with particular focus on a paper by Caves, Fuchs, and Schack containing a critique of the “objective preparations view” or OPV. It also aims to carry the discussion beyond the hardened positions of Bayesians and proponents of the OPV. Several claims made by Caves et al. are rebutted, including the claim that different pure states may legitimately be assigned to the same system at the same time, and the (...) claim that the quantum nature of a preparation device cannot legitimately be ignored. Both Bayesians and proponents of the OPV regard the time dependence of a quantum state as the continuous dependence on time of an evolving state of some kind. This leads to a false dilemma: quantum states are either objective states of nature or subjective states of belief. In reality they are neither. The present paper views the aforesaid dependence as a dependence on the time of the measurement to whose possible outcomes the quantum state serves to assign probabilities. This makes it possible to recognize the full implications of the only testable feature of the theory, viz., the probabilities it assigns to measurement outcomes. Most important among these are the objective fuzziness of all relative positions and momenta and the consequent incomplete spatiotemporal differentiation of the physical world. The latter makes it possible to draw a clear distinction between the macroscopic and the microscopic. This in turn makes it possible to understand the special status of measurements in all standard formulations of the theory. Whereas Bayesians have written contemptuously about the “folly” of conjoining “objective” to “probability,” there are various reasons why quantum-mechanical probabilities can be considered objective, not least the fact that they are needed to quantify an objective fuzziness. But this cannot be appreciated without giving thought to the makeup of the world, which Bayesians refuse to do. Doing this on the basis of how quantum mechanics assigns probabilities, one finds that what constitutes the macroworld is a single Ultimate Reality, about which we know nothing, except that it manifests the macroworld or manifests itself as the macroworld. The so-called microworld is neither a world nor a part of any world but instead is instrumental in the manifestation of the macroworld. Quantum mechanics affords us a glimpse “behind” the manifested world, at stages in the process of manifestation, but it does not allow us to describe what lies “behind” the manifested world except in terms of the finished product—the manifested world, for without the manifested world there is nothing in whose terms we could describe its manifestation. We review the psychological literature on the organization of valence, discussing theoretical perspectives that favor a single dimension of valence, multiple valence dimensions, and positivity and negativity as dynamic and flexible properties of mental experience that are contingent upon context. Turning to the neuroscience literature that spans three levels of analysis, we discuss how positivity and negativity can be represented in the brain. We show that the evidence points toward both separable and overlapping brain systems that support affective processes depending (...) on the level of resolution studied. We move from large-scale brain networks that underlie generalized processing, to functionally specific subcircuits, finally to intraregional neuronal distributions, where the organization and interaction across levels allow for multiple types of valence and mixed evaluations. The scholarly turn toward visual culture has left in place the sensory hierarchy that subtends Western philosophy. Yet given the commodification of sense experience, an inversion of the sensory hierarchy with the proximal senses of touch, taste, and smell at the top is not necessarily any more conducive to knowledge or justice. I argue that proximal sense experience may be a vehicle of knowledge, beauty and even ethics. Operating at a membrane between the sensible and the thinkable, the proximal (...) senses have an affective dimension that permits an immanent epistemology. My examples and olfactory ‘illustrations’ emphasize the sense of smell, which, I posit, given its intimacy with emotion and memory, gives rise to an ‘olfactory unconscious’. (shrink)

Drawing on Mikhail Bakhtin’s theory of double-voicedness and James Scott’s theory of public and hidden transcripts, this essay investigates the colonial context of Romans 13:1–7 with particular attention to the Roman imperial cult. It is my contention that Paul attempts to persuade the audience to resist the imperial cult, whilst negotiating colonial power and authority. It is assumed that colonial discourse is, by nature, a double-voiced discourse in that the public transcript of the dominant and the hidden transcript of the (...) suppressed coexist in a continued state of internal tension and conflict. Seen in this light, Paul as a colonised subject parodies the public transcript of the elites in his own hidden transcript. However, Paul’s doubled-voiced discourse finally turns out to be subversive against the dominant culture by suggesting that ultimate honour, fear, and authority should not be due to the rulers of the Roman Empire but to God. Along with the Chan’s “linguistic turn”, the significance of sutras, which were despised and even regarded as the obstacle to complete enlightenment, became accepted by the Chan. Due to Yanshou’s contributions, the principle that emphasized the diversity of teaching in terms of the relationship between meaning and expression in the Sui and Tang Dynasties has been changed into a system which stressed the importance of the root/branches relationship of the mind and words. According to Yanshou, the conflict between the (...) Chan and doctrinal teachings is resolved by highlighting the significance of words. Dai Zhen’s philosophy of language took the opportunity of a transition in Chinese philosophy to develop a form of humanist positivism, which was different from both the Song and Ming dynasties’ School of Principles and the early Qing dynasty’s philosophical forms. His philosophy of language had four primary manifestations: It differentiated between “names pointing at entities and real events” and “names describing summum bonum and perfection”; In discussing the metaphysical issue of “the Dao,” it was the first to introduce a (...) syntax analysis of linguistics, clearly differentiating between the different roles of predicate verbs “zhi wei” and “wei zhi” in Classical Chinese; In criticizing Confucian thought during the Song and Ming dynasties, it adopted specific philological skills such as the analysis of phraseology, the meaning of sentences and the thread of words in texts; and It re-interpreted the meaning of Confucian classics by studying characters and language, adopting a positivist and philological manner to seek metaphysical sense in philosophy. In this way, his philosophy was different from the scholars of the School of Principles during the Song and Ming dynasties and from the goal of Western linguistic philosophy in the 20th century, which refuted metaphysics. Accordingly, it helped to develop 18th century Chinese philosophy as it turned towards linguistic philology. (shrink)

This article revisits Jeffrey Tulis’s The Rhetorical Presidency in the age of Trump, discussing the debates to which it originally responded, its core thesis and empirical evidence, as well as its impact on political science in the last three decades. The article’s second half turns to a recent critique of Tulis’s thesis by Ann C. Pluta, which manifests many of the misunderstandings that have persisted since The Rhetorical Presidency’s original publication. Habits of thought revealed in Pluta’s misunderstandings, I argue, are (...) emblematic of the political culture that is amenable to the simplistic yet politically effective appeals characteristic of rhetorical presidents like Donald Trump. Elements of the broader political-science world that are on display in Pluta’s article are symptomatic of political pathologies sustained and aggravated by the culture of the polity that political scientists inhabit and purport to study—the culture of the rhetorical presidency. What do we do when we say ‘We’? This paper pursues a response from analytic pragmatism. The guiding idea of analytic pragmatism is to look to what one must implicitly know how do to be able to use expressions to say something, including how to make that implicit know-how explicit. Accordingly, the question we are tasked to answer is what one must know how to do to say ‘We’ – that is, what practical know-how saying ‘We’ requires and can be (...) employed to make explicit. The concept normative ascent is introduced in developing an answer. On this approach, the know-how in question turns out to be a distinctively normative capacity. Both being and saying ‘We’ turns out to involve being able to do and say something normative. (shrink)

In spite of the ‘experimental turn’ now fashionable in the philosophy of science, the question of the structure and identity criteria of scientific theories continues to be a central issue for the philosophical analysis of empirical science. We need a precise metatheory of empirical theories to deal with this issue. Metatheoretical structuralism appears to offer the most adequate approach in this sense so far. First, some basic intuitions about what empirical theories are, and how they are structured, are laid (...) out. Then, the main notions used by metatheoretical structuralism to analyze theories are explained, and they are illustrated by applying them to an example of a simple physical theory. Finally, it is argued that the picture of the structure and identity of empirical theories coming out of structuralistic analysis adequately corresponds to the basic intuitions stated at the beginning. Since the dawn of molecular biology, cancer therapy has focused on druggable targets. Despite some remarkable successes, cell‐level evolution remains a potent antagonist to this approach. We suggest that a deeper understanding of the breakdown of cooperation can synergize the evolutionary and druggable‐targets approaches. Complexity requires cooperation, whether between cells of different species (symbiosis) or between cells of the same organism (multicellularity). Both forms of cooperation may be associated with nutrient scarcity, which in turn may be associated with a (...) chemiosmotic metabolism. A variety of examples from modern organisms supports these generalities. Indeed, mammalian cancers—unicellular, glycolytic, and fast‐replicating—parallel these examples. Nutrient scarcity, chemiosmosis, and associated signaling may favor cooperation, while under conditions of nutrient abundance a fermentative metabolism may signal the breakdown of cooperation. Manipulating this metabolic milieu may potentiate the effects of targeted therapeutics. Specific opportunities are discussed in this regard, including avicins, a novel plant product. (shrink)

Giordano Bruno’s Cabala del cavallo pegaseo _ _grew out of the great Italian philosopher’s experiences lecturing and debating at Oxford in early 1584. Having received a cold reception there because of his viewpoints, Bruno went on in the Cabala to attack the narrow-mindedness of the university--and by extension, all universities that resisted his advocacy of intellectual freethinking. _The Cabala of Pegasus _consists_ _of vernacular dialogues that turn on the identification of the noble Pegasus and the humble ass. In the (...) interplay of these ideas, Bruno explores the nature of poetry, divine authority, secular learning, and Pythagorean metempsychosis, which had great influence on James Joyce and many other writers and artists from the Renaissance to the modern period. This book, the first English translation of _The Cabala of Pegasus, _contains both the English and Italian versions as well as helpful annotations. It will have particular appeal to all Renaissance scholars and those interested in the Renaissance cabalistic underpinnings of modern literature. (shrink)

Increasing globalization of the nursing workforce and the desire for migrants to realize their full potential in their host country is an important public policy and management issue. Several studies have examined the challenges migrant nurses face as they seek licensure and access to international work. However, fewer studies examine the barriers and challenges internationally educated nurses (IEN) experience transitioning into the workforces after they achieve initial registration in their adopted country. In this article, the authors report findings from an (...) empirically grounded study that examines the experience of IENs who entered Ontario’s workforce between 2003 and 2005. We found that migrant nurses unanimously described nursing as ‘different’ from that in their country of origin. Specifically, IENs reported differences in the expectations of professional nursing practice and the role of patients and families in decision‐making. In addition, problems with English language fluency cause work‐related stress and cognitive fatigue. Finally, the experience of being the outsider is a reality for many IENs. This study provides important insights as policy and management decision‐makers balance the tension between increasing the IEN workforce and the delivery of safe patient care. (shrink)

What kind of turn is the turn to ethics? A Right turn? A Left turn? A wrong turn? A U-turn? Ethics is back in literary studies, philosophy, and political theory. Where critiques of universal man and the autonomous human subject had, in recent years, produced a resistance to ethics in many fields of scholarship, today these critiques have generated a crossover among disciplines and led to theories and practices that see and do ethics otherwise. (...) The decentering of the subject, the contributors to this volume suggest, has brought about a recentering of the ethical. The philosophers, political theorists, literary critics and physician whose essays are collected here bring the particularities of their disciplines and training to a vital complex of questions. Many of these authors express concerns that the turn to ethics is a turn away from politics towards moralism. Suvremene bioetičke rasprave reaktualizirale su pitanje smjene epoha. Bioetika je nastala upravo kao moralna i civilizacijska reakcija u novostvorenoj povijesnoj situaciji. U tom kontekstu, potrebno je analizirati, s jedne strane, promišljanje prijeloma epoha i predviđanje »novog srednjovjekovlja« u djelu ruskog filozofa N. A. Berdjajeva te, s druge strane, pojavu bioetike. Hoćemo li zaista zakoračiti u novu epohu, kakva će ona biti te što ćemo i u kojem obliku prenijeti iz sadašnje epohe – najviše ovisi o tome kakvog će duha biti (...) čovjek. Stanje čovjekova duha možemo iščitati iz čovjekova odnosa prema tehnici, odnosno s obzirom na snažnu interaktivnu ulogu tehnike u našem životu. Kako je pitanje odnosa čovjeka i stroja jedno od ključnih bioetičkih pitanja, problem tehnike nužno je analizirati iz perspektive Berdjajevljeva odnosa čovjeka i stroja, ali i u sklopu Heideggerova promišljanja biti tehnike. Jednako kao i Berdjajev, Heidegger smatra da ne treba poricati tehniku, već tražiti izmjenu uloge tehnike i podlaganje čovjekovu duhu na kojem leži zadatak dokučiti ono spasonosno. Duh današnjeg čovjeka duh je bogolikog čovjeka koji, uz pomoć uznapredovalog stroja, izaziva prirodu , ali taj isti stroj, koji njemu služi kao sredstvo, toliko je uznapredovao da je sada u mogućnosti izazivati njega. U tom je kontekstu nužno okrenuti se bioetici. Upravo je bioetika sa svojom pluriperspektivnom metodologijom zaslužna za pokušaj okupljanja različitih sustava vrijednosti kako bi se zajedno usmjerio sadašnji sustav vrijednosti i zaštitio budući, ali i budućnost uopće. No, hoće li bioetika ostati samo na razini rijetkog pozitivnog primjera u nizu negativnih znakova dolaska nove epohe ili ćemo ozbiljno shvatiti princip odgovornosti što nas dovodi na prag bioetičke epohe te hoće li promjena duha sadašnjeg čovjeka, prema kojem nas vodi bioetičko promišljanje, doista dovesti do podvrgavanja tehnike čovjekovom duhu – ostaju otvorena pitanja.The problem of the turn of epochs is debated once more nowadays. Contemporary discussions on bioethics once again pose this very question. Bioethics as such was created as a moral and civilisational response to the new historical situation. In that context one needs to analyze, on the one hand, both the problem of the turn of epochs and the prediction of the new Middle Ages proposed by Russian philosopher N. A. Berdyayev and, on the other hand, the emergence of bioethics which raised the question of the turn of epochs for the second time. Will we really reach the new epoch, what will it look like, what and in which form shall we transmit from the present epoch? These questions ultimately depend on the state of the human spirit which can be deciphered from man’s relation to technology, taking into account the strong interactive role which technology plays in our daily lives. Bearing in mind that the relation between the man and the machine is one of the crucial bioethical issues, this question of technology should be analyzed from Berdyayev’s relation between the man and the machine, but also within Heidegger’s analysis of the essence of technology. Similarly to Berdyayev, Heidegger states that technology must not be contradicted or denied, but rather, changed in a way to serve the human spirit – which is entrusted with the task of understanding the saving elements. The spirit of the modern man is the spirit of the divine-like creature . It is the spirit of a man who, with the help of a developed machine can challenge nature , but this same machine, which serves him as a means, has evolved to the point that it can challenge the man. In this context it seems essential to turn to bioethics. It is precisely bioethics which, thanks to its pluri-perspective methodology, takes credit for covering different systems of values to direct the present system in the right way and protect the future system and the future in general. However, the questions remain whether bioethics will stay the only positive example among the multitude of negative signs and predictions, whether it will lead us to a new, yet unknown, epoch and whether we will take seriously the principle of responsibility which leads us to the threshold of the bioethical epoch and whether the change in the spirit of the present-day man, triggered by the bioethical thinking, can change technology to make it subordinate to the human spirit. In his ‘On t and u and what they can do’, Greg Restall presents an apparent problem for a handful of well-known non-classical solutions to paradoxes like the liar. In this article, we argue that there is a problem only if classical logic – or classical-enough logic – is presupposed. 1. Background Many have thought that invoking non-classical logic – in particular, a paracomplete or paraconsistent logic – is the correct response to the liar and related paradoxes. At the most (...) basic level, the target non-classical idea is that some expressions, like ‘all and only the true propositions’, do not behave as we would expect from classical logic. Non-classical theorists argue that the class of all and only the truths is either incomplete or inconsistent: when you truly speak of all and only truths , you're either leaving some truths out, or you're letting some untruths in. Truth, in a slogan, is either gappy or glutty. Non-classicality is not a glib or easy-way-out response to the paradoxes. Innocuous-seeming notions can turn out to be philosophically substantial. Moreover, apparently correct forms of reasoning can turn out to be incorrect. To take a example, a glut theorist must hold that the following argument form is not in general valid. Either p is true or q is true. But p is untrue. So q is true. This argument form may strike our ears as acceptable. But if p is a truth value glut, then the inference fails to preserve truth. According to glut theorists, the inference breaks down in inconsistent contexts: if the subject matter involves gluts, then the inference is to be rejected. Davis is a Swedish American mixed-media artist who was born in Lund, Sweden, and currently resides in Washington, DC. Her work draws frequently on the challenges she has faced living in the United States, particularly those related to her gender and racial position. Her husband, who spent most (...) of his childhood in the same Swedish town as Davis, was born to an African American man and a white Swedish woman. When Anna, who is also white, was pregnant with her own son, now in his early twenties, she began drawing what she terms “Frocasians,” people who are neither black nor white and who cannot claim automatic acceptance from either group. As her work explores, the outsider status of Frocasions both presents opportunity and exacerbates insecurity. Davis’s Swedish roots are central to her brand of feminism. She remembers growing up in an environment where notions of gender justice were firmly embedded in the legal framework and norms of the community. Her struggles with inadequate childcare and family leave as a young mother in the United States, then, form a strong undercurrent shaping her critical perspective. Davis also narrates growing up in a household that was emotionally unstable and sometimes difficult to navigate. Relative to the abundance of literature devoted to the legal significance of UN authorisation, little has been written about whether the UN’s failure to sanction an intervention can ever make it immoral. This is the question that I take up here. I argue that UN authorisation (or lack thereof) can have some indirect bearing on the moral status of a humanitarian intervention. That is, it can affect whether an intervention satisfies other widely accepted justifying conditions, such as proportionality, “internal” legitimacy, (...) and likelihood of success. The more interesting question, however, is whether the UN’s failure to provide a mandate can make a humanitarian operation unjust independently of these other familiar considerations. Is a proportional, internally legitimate humanitarian intervention, with a just cause and strong prospect of success, still morally unacceptable if it is not approved by the United Nations Security Council? This is the question that I turn to in the second half of the paper. (shrink)

Bioethicists currently working in the United Kingdom demonstrate—as indeed do the very best of their colleagues internationally—an eagerness to engage in two extremely different but complementary approaches to their subject. First, they readily become involved in discussions of concrete bioethical issues that are of great concern to the medical profession, legislators, and the wider U.K. public. Second, perhaps because they recognize the importance of the “first-order” questions that exercise the public imagination, they show themselves commendably willing to turn their (...) critical gaze onto the very methods and frameworks they use to address those questions. This manuscript provides an overview of forensic DNA data banks and their use, with some focus on existing programs established in the U.S., Canada, and the U.K. The intent is to provide a constructive analysis of both strengths and weaknesses in performance, and especially to suggest directions for improvement. Implementation of these suggestions will be crucial to allow DNA data banks to be most effective in advancing societal goals of enhancing public safety and collective security.

While women are most likely to teach young students in classroom settings, men are most likely to teach older students in all settings, but most particularly in wind/percussion ensembles.1 Despite gender-affirmative employment practices, men constitute a large majority among band directors at all levels.2 At the (...) postsecondary level in the U.S., women constitute less than 10%.3 In all cases and all levels, the vast majority of band directors are white. Occupational segregation inhibits the development of individuals' careers as well as the development of the profession as individuals choose or are hired for positions based on their gender and/or race rather than their abilities.In terms of women university band directors, researchers have investigated employment trends,4 personal and occupational characteristics,5 occupational role models, and professional identity.6 Their findings generally have supported the hypotheses that historical precedent, traditional socialization, discrimination, segregation, and lack of role models contribute to their persistently low percentage as band directors. Longitudinal studies7 demonstrate that the percentage of women band directors has not increased significantly, and may be actually [End Page 147] declining after thirty years of enforcing affirmative action laws, which would suggest that these interventions have not provided the basis for enacting change in the profession. Further, change does not seem possible if members of the profession do not understand what causes the situation to persist. For example, while the College Band Directors National Association has supported the Linda A. Hartley and Deborah A. Sheldon study,8 their concern seems to be in only identifying the extent of the situation with the intention of increasing the number of women and non-white individuals who are band directors within the profession as it currently is constructed. This empirical approach is inadequate because it addresses neither the values held by members of the profession, nor its structure, which as previous research indicates, is poorly understood and must change to make possible meaningful increases in the number of women and non-white people.The profession of conducting university bands exists within the profession of music education in general, which, of course, exists within the profession of music. Clearly, one cannot be adequately understood without placing it in the context of the others. What is needed, then, are richer, more substantive, and meaningful understandings of the professions in general and of specific questions within them in particular, as they may provide the basis on which change can be possible. In addition to addressing the issue of persistent occupational gender and racial segregation, questions that may be addressed include positionalities9 of bands in the music education profession, the relationship of performance/conducting to the music profession, and the role of the musician in society in general. In order to accomplish this, I propose an analytical method that is both postmodern and feminist, and in which the philosophical figuration of the nomad, as explicated by Rosi Braidotti,10 is central.Postmodern/Feminist AnalysisDescribed variously as a "philosophical perspective,"11 a "sensibility,"12 and a historical moment,13 postmodernism resists definition. It may be understood as a way of perceiving the world that accepts and even embraces contradictions and uncertainties while rejecting commonly accepted cultural beliefs and practices, including humanist understandings of identity, representation, and the subject. This is a "postmodernism of resistance"14 that interrogates cultural practices, focusing on what is unexpected, marginalized, and silenced, opening spaces for change. In contrast, analysis based on modernism is constrained by binary oppositions that inscribe the positionalities of social groups. These oppositions are exemplified by Subject/Other (for example, male/female, reason/emotion) and consist of asymmetrical power relations in which the former is privileged over the latter, and the latter is defined in terms of not-the former. Postmodern analysis [End Page 148] reveals what these dualisms exclude, distort, or obscure, and provides flexibility for research from a variety of perspectives. The U.S. turn toward torture tested the moral resources of all faiths, but perhaps especially of Christianity, which has the greatest number of adherents in the United States. This moral crucible revealed that American Christian scholars and leaders were generally blind to the resources available in relation to the resources available to address torture in a study of scripture, early Christian experience under empire, Christian abuses of suspected heretics, and the just war theory, all of which are considered here. Uses of just war theory have revealed a fracture in that theory between deontological/virtue orientations and consequentialist reasoning, the latter proving susceptible to exploitation in defense of torture. Just war theory also revealed a lacuna of explicit reasoning about torture through the centuries, in a world where torture has so often been an instrument of state power. (shrink)

The frequency of discriminatory language in job advertisements placed by U. S. multinational corporations operating in Mexico was compared with that of Mexican companies using content analysis. A sample of 300 ads placed by companies from each culture was analyzed and coded by two groups of coders to calculate the frequency of discriminatory language in the job ads with respect to age, gender, physical appearance and marital status. Results of a chi square analysis revealed that U. S. multinationals firms in (...) Mexico utilize discriminatory language in job ads less frequently in the categories of age, gender and marital status. This result suggests that the legal and cultural framework of the country of origin of U. S. enterprises in Mexico may be influencing their actual recruitment practice in Mexico, and in turn, help them in setting a positive example of non-discrimination in recruitment among their Mexican counterparts. Članak analizira temu o sreći građana u Sretnom gradu Frane Petrića, iz koje slijedi slika grada u kojemu statuti doprinose jačanju povjerenja i moralnosti. Ako je utopija po definiciji okrenuta budućnosti, Petrićeva se, naprotiv, čini okrenuta prošlosti, rekonstrukciji sretnog grada patrijarhalnog uzora, kakav je tek rijetko ostvaren u povijesti čovječanstva, kao npr. onaj Sezostrisov u drevnom Egiptu. Zbog spominjanja Verone, uz drevnu Atenu, vjerojatno se u talijanskoj kritici uvriježio »mit o Veneciji«, o gradu s tisuću »korisnih« djelatnosti, na koji je (...) Petrić mogao misliti pri sastavljanju svoga prvijenca posvećenog »Presvijetloj gospodi Vigeriju i Girolamu dalla Rovere«. No, taj se mit uopće ne može nazrijeti u ovom Petrićevu djelu. Antropomorfna shema »traktata« vodi nas do Petrićeve ideje o identifikaciji grada s čovjekom, kao tijela s dušom , ali nas imena u posveti jasno vode do dinastije Della Rovere, koja je upravljala Petriću suvremenom kneževinom Urbino , i koja je od početka Cinquecenta nametnula novi lik ‘vladara’ i osuvremenjenu predodžbu ‘dvorjanina’, te si osigurala međunarodnu slavu zahvaljujući mecenatskom poticanju svake vrste umjetnosti.The paper deals with the happiness of citizens in The Happy Town by Frane Petrić, where a picture of the town in which statutes and regulations contribute to the strengthening of trust and morality is portrayed. If utopia is by definition directed towards the future, Petrić conversely turns his utopia towards the past, towards the reconstruction of a happy town according to the patriarchal pattern, which was only rarely achieved in the history of mankind, like for instance during Sesostris in ancient Egypt. Due to the mention of Verona, alongside ancient Athens, ‘the Venice myth’ became customary in Italian criticism, implying the town with thousand “useful” utilities, to which Petrić might have referred as he compiled his debut work dedicated to “Their Serenities Vigerio and Girolamo dalla Rovere”. However, that myth cannot be noticed in this Petrić’s work. The anthropomorphist scheme of the “tractate” reveals Petrić’s tendency to identify between man and town, soul and body , but the names in the dedication clearly point to Della Rovere dynasty who governed the Principality of Urbino and who imposed, from the beginning of Cinquecento, a new image of the ‘ruler’ and the modernised conception of the ‘courtier’, ensuring thereby their international fame by being patrons to all arts at the time. Edited by Richard Grusin of the Center for 21st Century Studies, this is the first book to name and characterize—and therefore consolidate—a wide array of current critical, theoretical, and philosophical approaches to the humanities and social sciences under the concept of the nonhuman turn. Each of these approaches is engaged in decentering the human in favor of a concern for the nonhuman, understood by contributors in a variety of ways—in terms of animals, affectivity, bodies, materiality, technologies, and organic and (...) geophysical systems. The nonhuman turn in twenty-first-century studies can be traced to multiple intellectual and theoretical developments from the last decades of the twentieth century: actor-network theory, affect theory, animal studies, assemblage theory, cognitive sciences, new materialism, new media theory, speculative realism, and systems theory. Such varied analytical and theoretical formations obviously diverge and disagree in many of their assumptions, objects, and methodologies. However, they all take up aspects of the nonhuman as critical to the future of twenty-first-century studies in the arts, humanities, and social sciences. Unlike the posthuman turn, the nonhuman turn does not make a claim about teleology or progress in which we begin with the human and see a transformation from the human to the posthuman. Rather, the nonhuman turn insists (paraphrasing Bruno Latour) that “we have never been human,” that the human has always coevolved, coexisted, or collaborated with the nonhuman—and that the human is identified precisely by this indistinction from the nonhuman. Stigma has become an important concept in public health law. It is widely accepted that certain diseases are disfavored in society, leading to discrimination against people identified with them, which in turn has the tendency to drive an epidemic underground—i.e., to make it more difficult for voluntary public health programs to reach and succeed among populations bent on concealing their disease or risk status. The need to reduce stigma and its effects has been used to justify the passage of (...) privacy and antidiscrimination law to protect people with HIV. More recently, stigma has been part of the arsenal of justification for special genetic antidiscrimination and privacy law. Despite its importance, however, there is no single widely accepted definition of stigma in social science, and its relationship to law has been generally under-theorized and unsupported by data, reducing our ability to effectively deploy law and other tools in the anti-stigma cause. Strano je ovdje odrednica mišljenja koja se eksplicira u kulturnim i društvenim odnosima te ga stoga treba interpretirati upravo u njegovom fenomenalnom realitetu. Kultura i politika u tom značenju više su od pukog imena za skupni naziv značenja i opravdanja djelovanja. One postaju izraz smisaonog konteksta u kojem se iščitava odnos spram stranog kao referentnog mjesta za razumijevanje samog značenja moderne, njene unutarnje diferenciranosti, tokova koji je određuju (...) i karakteristika koje se uspostavljaju u individualnim odrednicama što obilježavaju njenu povijest. Strano se, u cjelini svojega određenja, zasniva iz tjelesnosti kao realiteta njegovog postojanja. U cjelini uzevši, moderna se, smatra Waldenfels, razumijeva u njenoj postranjenosti , u njenom odnošenju spram stranog koje na koncu rezultira i postranjenjem moderne u cijelosti. Ona kao takva nije zastranila, nego po-stranila, i sama se priklonila stranosti kao vlastitom identitetu, u kojem je čvrsto uspostavljen i filozofijski diskurs na kojem se taj identitet brani. Waldenfelsova interpretacija moderne proistječe iz cjelovitog uvida u kontinuitet mišljenja koje je određuje i iskazuje se kroz njegovo sažimanje u ključnim problemima koji određuju njene tokove. U tom smislu fenomenološki diskurs njegove filozofije dobiva svojevrsno značenje ishodišta filozofijskog mišljenja na prijelazu stoljeća.Waldenfels’ phenomenological understanding of modernity is based on the understanding of “the foreign” as an essential definition of modernity. “The foreign” here is the characteristic of thinking explicated in cultural and social relationships, which should therefore be interpreted precisely in its phenomenal reality. Culture and politics in this context are more then a mere names for a collection of meanings and justifications of action. They become the expression of a meaningful context from which one can read-off the relation to “the foreign” as the reference point forunderstanding the very meaning of modernity, its inner differentiation, the streams that determine it and the characteristics that are established in the individual determinants that denote its history. “The foreign” as a whole is grounded in corporality as the reality of its existence. Waldenfels maintains that modernity, taken as a whole, is understood in its orientation towards the foreign, in its relationship with the foreign that, eventually, results in the entire modernity being oriented towards the foreign. Modernity as such did not go astray, but it became oriented towards the foreign, it decided itself to accept some sort of “the foreign” as its identity, in which the philosophical discourse is established for its defence. The relationship towards corporality, postulated in this sense in modern theory, is a consequence of the relationship towards “the foreign”. That is why the problem of transformation of philosophy is not found in the new understanding of the mind, but in the discourse of new rationality, of phenomenological thinking of the particularity oriented towards the critique of the encompassing metaphysics of subjectivity and towards all sorts of rational assumptions bout the reality. Waldenfels’ interpretation of the modernity follows from the integrative insight into continuity of the thinking that determines it, and it is expressed by his summarisation of the crucial problems that determine its paths. It is in this sense that the phenomenological discourse is established, signifying the starting point of philosophical thinking at the turn of the century. (shrink)

Bilješke koje je Martin Heidegger unosio u takozvane »crne bilježnice« potakle su, netom nakon objavljivanja, intenzivne diskusije, osobito oko pitanja antisemitizma i nacionalsocijalizma. Je li se Heideggerova osobna naklonost ka ovim ideologijama odrazila i na njegovo filozofsko djelo? U ovom ogledu razmatra se jedna, s ovim pitanjima povezana, važna tema u Crnim bilježnicama – tema sveučilišta. Ona postaje frekventnija u tri navrata, obilježena značajnim događajima u Heideggerovoj profesionalnoj biografiji: preuzimanjem funkcije rektora sveučilišta u Freiburgu, napuštanjem te funkcije te isključenjem iz (...) nastave u sklopu poratne denacifikacije Njemačke. Pokazuje se da shvaćanje sveučilišta u Crnim bilježnicama odgovara idejama predočenim u Heideggerovu rektorskom govoru, kao i da to shvaćanje nije jednako nacionalsocijalističkom, već izražava filozofovo »narodnjačko« misaono usmjerenje. Iako posjeduje neke elemente vokabulara koji su bili prisutni u nacističkoj propagandi, Heidegger svoje stavove o stvarnosti i budućnosti sveučilišta integrira s drugim svojim idejama – kritikom svođenja znanja na tehničke aspekte, kritikom izoliranja znanosti u samostalna područja i uopće kritikom zapadnjačkog mišljenja. The notes that Martin Heidegger made in the so-called Black Notebooks stimulated, immediately after publication, intense discussions, especially on the issue of anti-Semitism and National Socialism. Does Heidegger’s personal fondness for these ideologies reflect on his philosophical work? In this essay, one important topic related to these issues in Black Notebooks is discussed – the topic of university. It became more frequent on three occasions, marked by significant events in Heidegger’s professional biography: taking over as rector of the University of Freiburg, leaving that position, and exclusion from teaching as part of the postwar denazification of Germany. It turns out that the understanding of the university in the Black Notebooks corresponds to the ideas presented in Heidegger’s rector’s speech, and that this understanding is not equally National Socialist, but expresses the philosopher’s “populist” thinking. Although he possesses some elements of vocabulary that were present in Nazi propaganda, Heidegger integrates his views on the reality and future of the university with his other ideas – a critique of reducing knowledge to technical aspects, a critique of isolating science into independent fields, and a critique of Western thought. Stigma has become an important concept in public health law. It is widely accepted that certain diseases are disfavored in society, leading to discrimination against people identified with them, which in turn has the tendency to drive an epidemic underground—i.e., to make it more difficult for voluntary public health programs to reach and succeed among populations bent on concealing their disease or risk status. The need to reduce stigma and its effects has been used to justify the passage of (...) privacy and antidiscrimination law to protect people with HIV. More recently, stigma has been part of the arsenal of justification for special genetic antidiscrimination and privacy law. Despite its importance, however, there is no single widely accepted definition of stigma in social science, and its relationship to law has been generally under-theorized and unsupported by data, reducing our ability to effectively deploy law and other tools in the anti-stigma cause. According to the logic of the gendered modernity/tradition binary, women in traditional societies are oppressed and women in modern societies liberated. While the binary valorizes modern women, it potentially erases gendered oppression in the West and undermines feminist movements on behalf of Western women. Using U.S. newspaper text, I ask whether female genital cutting is used to define women in modern societies as liberated. I find that speakers use FGC to both uphold and challenge the gendered modernity/ tradition binary. Speakers (...) use FGC to denigrate non-Western cultures and trivialize the oppressions that U.S. women typically encounter, but also to make feminist arguments on behalf of women everywhere. I argue that in addition to examining how culturally imperialist logics are reproduced, theorists interested in feminist postcolonialism should turn to the distribution of such logics, emphasizing the who, where, when, and how of reinscription of and resistance to such narratives. It is not too early to suggest that the attempts to place medical care in private hands (through group insurance arrangements) has not fulfilled its promise—or better, the promises that were made for it. Yet history has not been kind to plans to make government the single payer, and the laudable progress in medical technology has placed high-technology medical care beyond the reach of most privatebudgets. In this paper I suggest that the major problem of the U.S. health care system (...) as presently conceived is a failure of legitimacy,and I put forward a proposal that purports to solve that problem. The proposal is to localize health care, on the model of a public school system, on the argument that such localization will answer most of the questions of legitimacy at the core of the private insurance imbroglio, provide a brake for medical costs, while preserving our ability to take advantage of the most advanced medical interventions. I present some initial arguments for the proposal, but await its proof in the dialogue emerging as the present insurance system collapses. (shrink)

In this paper, I argue that the U.S. and its coalition partners should announce that they intend to completely withdraw from Iraq within six months or less. And if this announcement did bring a suspension or reduction of hostilities against them, then, I argue, they should leave even sooner. For the most part, my grounds for holding this view are based on the lack of a justification for going to war against Iraq in the first place. But part of the (...) grounds for an immediate withdrawal turns on what has transpired since the U.S. and its coalition partners invaded Iraq. (shrink)

After the terrorist attacks on the United States of September 11, 2001, conservatives in this country were almost unanimous in their conviction that it was time for Canada to throw in the towel as an independent nation. Historian Michael Bliss was first out of the blocks, arguing that “although we may still chant the camp songs of Canadian sovereignty, there is probably no turning back. We are heading toward some kind of greater North American union.”1 Others were quick to chime (...) in, barely able to conceal their satisfaction at the thought that Canada would finally get its comeuppance for having, on so many occasions, defied the regional hegemon.2 Yet less than two years later, with Canada-U.S. relations at an all-time low, not only did the prospects for regional integration seem dimmer than ever, but existing arrangements like NAFTA even began to show signs of strain in the face of renewed American unilateralism. The article Metaphorical Nature of Language in Herder aims to demonstrate how Herder’s thesis regarding the metaphoricity of language reflects itself in his conception of the relationship between language and the world. A comparison with Friedrich Nietzsche’s understanding of this relationship in his essay On Truth and Lies in a Nonmoral Sense helps clarify Herder’s position. The law within each legal system is a function of the practices of some social group. In short, law is a kind of socially grounded norm. H.L.A Hart famously developed this view in his book, The Concept of Law, by arguing that law derives from a social rule, the so-called “rule of recognition.” But the proposition that social facts play a foundational role in producing law is a point of consensus for all modern jurisprudents in the Anglo-American tradition: not just (...) Hart and his followers in the positivist school, most prominently Joseph Raz and Jules Coleman, but also the anti-positivist Ronald Dworkin, who argues that law necessarily synthesizes moral considerations with social facts. But which group’s practices ground each legal system? In particular, which group’s practices undergird U.S. law? Positivists since Hart have universally pointed to either officials or judges as the “recognitional community” (my term): the group such that its rules, conventions, cooperative activities, or practices in some other sense are the social facts from which the law of a given legal system derives. So Hart and all other positivists would identify either U.S. officials or U.S. judges as the recognitional community for U.S. law. This Article grapples with the tension between the positivist’s official- or judge-centered account of the recognitional community and the “popular constitutionalism” now so widely defended by constitutional scholars such as Larry Kramer, Robert Post, Reva Siegel, Mark Tushnet, Jeremy Waldron, and many others. Surely the popular constitutionalist would want to claim that U.S. citizens, not judges or officials, are the recognitional community for U.S. law. I term this position “deep popular constitutionalism.” Indeed, it turns out that Dworkin’s account of law, in its ambition to generate associative moral obligations for the citizenry as a whole, implies deep popular constitutionalism. Here there is a disagreement, hitherto unnoticed, between Dworkin and the positivists. My solution to this disagreement – to the debate between deep popular constitutionalists and deep official or judicial supremacists -- is to dissolve it by providing a group-relative account of law. Social norms, such as norms of dress or eating, are clearly group-relative. A particular dressing or eating behavior may be socially appropriate relative to one group’s norms, yet socially inappropriate relative to another’s. This Article extends the group-relative view from social norms to law itself, with a particular focus on U.S. law and constitutionalism. Part I surveys the jurisprudential literature. It shows how Hart and successor positivists identify the rule of recognition as a social practice engaged in by officials or some subset of officials (judges), rather than citizens generally, and argues that Dworkin by contrast sees the citizenry as a whole as his recognitional community. Parts II and III defend a group-relative account of law. Part II argues, with reference to the U.S. experience, that multiple groups can simultaneously instantiate the kind of social fact that undergirds law, be it a convention, a social norm, a “shared cooperative activity” (SCA), or something else. At many points in U.S. constitutional history, multiple official or citizen groups, defined along departmental, partisan, regional, state-federal, religious, or other lines, have accepted competing rules of recognition for U.S. law. Part III argues that “law” functions, primarily, as either an explanatory or a normative construct, and that insisting on a single recognitional community for each legal system would be arbitrary, both for explanatory purposes and for normative purposes.
