This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are dealing with professional boundary (...) issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Background Retraction is a mechanism for alerting readers to unreliable material and other problems in the published scientific and scholarly record. Retracted publications generally remain visible and searchable, but the intention of retraction is to mark them as “removed” from the citable record of scholarship. However, in practice, some retracted articles continue to be treated by researchers and the public as valid content as they are often unaware of the retraction. Research over the past decade has identified a number of (...) factors contributing to the unintentional spread of retracted research. The goal of the Reducing the Inadvertent Spread of Retracted Science: Shaping a Research and Implementation Agenda (RISRS) project was to develop an actionable agenda for reducing the inadvertent spread of retracted science. This included identifying how retraction status could be more thoroughly disseminated, and determining what actions are feasible and relevant for particular stakeholders who play a role in the distribution of knowledge. -/- Methods These recommendations were developed as part of a year-long process that included a scoping review of empirical literature and successive rounds of stakeholder consultation, culminating in a three-part online workshop that brought together a diverse body of 65 stakeholders in October–November 2020 to engage in collaborative problem solving and dialogue. Stakeholders held roles such as publishers, editors, researchers, librarians, standards developers, funding program officers, and technologists and worked for institutions such as universities, governmental agencies, funding organizations, publishing houses, libraries, standards organizations, and technology providers. Workshop discussions were seeded by materials derived from stakeholder interviews (N = 47) and short original discussion pieces contributed by stakeholders. The online workshop resulted in a set of recommendations to address the complexities of retracted research throughout the scholarly communications ecosystem. -/- Results The RISRS recommendations are: (1) Develop a systematic cross-industry approach to ensure the public availability of consistent, standardized, interoperable, and timely information about retractions; (2) Recommend a taxonomy of retraction categories/classifications and corresponding retraction metadata that can be adopted by all stakeholders; (3) Develop best practices for coordinating the retraction process to enable timely, fair, unbiased outcomes; and (4) Educate stakeholders about pre- and post-publication stewardship, including retraction and correction of the scholarly record. -/- Conclusions Our stakeholder engagement study led to 4 recommendations to address inadvertent citation of retracted research, and formation of a working group to develop the Communication of Retractions, Removals, and Expressions of Concern (CORREC) Recommended Practice. Further work will be needed to determine how well retractions are currently documented, how retraction of code and datasets impacts related publications, and to identify if retraction metadata (fails to) propagate. Outcomes of all this work should lead to ensuring retracted papers are never cited without awareness of the retraction, and that, in public fora outside of science, retracted papers are not treated as valid scientific outputs. In this essay, I examine Jean-Luc Nancy’s notion of the sense of the world in relation to the phenomenological investigation of the life-world in Husserl and the worldhood of the world in Heidegger. My aim is to address the reasons why Nancy stresses the need for a different thinking that goes beyond the phenomenological gesture in order to approach the sense of the world. What is at stake in this other gesture is the overcoming of the way in which phenomenology (...) privileges seeing as the mode of access to the phenomenon, which is but one sense among many and which, as one sense among many, fails to bring thought into relation with the pluralisation of sense. The second part of the essay interprets the pluralisation of both sense and world in terms of Nancy’s turn to art, which by touching upon the limit of philosophy, turns the latter into the praxis of the exposition of sense. Pluralisation betokens Nancy’s attempt to think the finitude of the world as that which spaces itself out into multiple, singular and shared. (shrink)

This paper deals with the question whether Muslims who live in the West might be considered as the future outsiders of the Islamic world. It suggests that the Muslims of the West might become those through whom, in a totally unexpected and unforeseen fashion, could come the progress – even the salvation – of an Islamic civilization that the author considers as currently locked into a state of moral, social, intellectual and spiritual stagnation. To this effect, the author focuses mainly (...) on the notion of individual and of human rights, and discusses how the Islamic and Western traditions might be brought together. These mixed ancestries also come with different social expectations. In the social-political world of Native Studies where I walk daily, my French grandmother, mamere, is argued as coming from a world of privilege because she was white-skinned, and my Cree grandmother, nokum is thought to come (...) from a world of oppression because she was dark-skinned. Yet both my grandmothers experienced abuse and prejudice. How and where the abuses originated may be different, but they did occur. I have a lot to learn from my grandmothers, but it has taken me many years of inner conflict, self-righteousness, and pain to get to this understanding. To acknowledge both grandmothers having been oppressed means I cannot continue to think of the world in simplistic, binary terms of colonizer/colonized. I must legitimize the equality of suffering in both cultures. Indeed, my worldviews had been turned upside down as I began to identify with the feminist movement, nonetheless it is nokum's world that was shattered, demeaned, and distorted, so it is her world I bring to you today with this story. Now, happily, disavowed by most nations under the 1972 Biological Weapons Convention, the presumption is that any future deployment would be at the hands of rogue states, criminal gangs or perhaps terrorist organisations, to whom they could appeal because of their apparent ease of preparation and dissemination coupled with their sinister reputation and potential for causing mass casualties.But Herbert's villain is different. He is a trained scientist possessing expert skills and with access to pathogens, reagents and cutting-edge technology. Such a person might appear outwardly to be part of the conventional academic establishment except that their motives impel them to act covertly outside the accepted ethical and legal boundaries of their profession. Such ‘outsiders’ evade detection because they act alone and can, through their privileged position, anticipate and thwart regulation or investigation. On occasion, I am appointed by our local probate court to help make health care decisions for patients who are no longer capable of making these decisions for themselves. I'll visit my client in the hospital and review his or her chart, and I'll have numerous opportunities to talk about the illness and treatment options with attending physicians, residents, and nurses. My phone calls to them will be returned promptly. If doctors arrive at the conclusion that nothing further can be (...) done for the patient, we'll discuss how best to proceed. This end‐of‐life talk never comes as a surprise to me because I will have been included in the team's decision‐making process, in the manner of professionals interacting with another professional. Last fall, I became a family surrogate decision‐maker after my mother was hospitalized over the course of a few months, for a number of reasons, in three hospitals in New York. I assumed I would manage her care as I did my clients’, with a sense of control and involvement in the process, but I quickly learned that I had in fact entered a kind of alternate universe as far as decision‐making was concerned. Undergoing extreme sufferings, the heroine wistfully ponders mimicry as an impulse to break out of her mare’s nest and to establish herself within one culture. Indeed, unlike what Bhabha (...) believes mimicry cannot upset the total authority of the “Centre”. Meanwhile, Antoinette used it as a result of her longings for the position of the “Centre” which she is unable to attain because of her hybrid existence. Countering Homi K. Bhabha’s central argument, this essay contends that Antoinette’s mimicry of Englishness fails to fend off the norms of the superior power, but partakes in celebrating the very ideals that Bhabah’s theory is trying to keep at bay. ]]>. This book provides a detailed theoretical overview and analytical understanding of informal labour markets in the context of economic reforms. Grounded in the neo-classical general equilibrium framework, it analyses the impact of deregulatory policies on the welfare of informal workers in a segmented labour market.

The usual way with scepticism is to formulate a problem in connection with the external world and then apply this to other minds. Drawing on work by Stanley Cavell and Richard Moran, I argue that the sceptic misses an important difference in our concepts of mind and of body, and that this is reflected in the sceptic’s formulation of a problem regarding other minds. I suggest that an understanding of this important conceptual difference is also missing from the work of (...) those who attempt to reply to (dismiss, or ignore) the sceptic. In this connection I discuss both inferential and perceptual accounts of our knowledge of other minds. I identify an error in these accounts that may be thought to arise from a lack of understanding of the important conceptual difference here, and then develop an understanding of this error that draws on the work of Edith Stein and Stanley Cavell. Essays at the intersection of philosophy and architecture explore how we understand and inhabit space. To be outside allows one a fresh perspective on the inside. In these essays, philosopher Elizabeth Grosz explores the ways in which two disciplines that are fundamentally outside each another—architecture and philosophy—can meet in a third space to interact free of their internal constraints. "Outside" also refers to those whose voices are not usually heard in architectural discourse but who inhabit its space—the destitute, the homeless, (...) the sick, and the dying, as well as women and minorities. Grosz asks how we can understand space differently in order to structure and inhabit our living arrangements accordingly. Two themes run throughout the book: temporal flow and sexual specificity. Grosz argues that time, change, and emergence, traditionally viewed as outside the concerns of space, must become more integral to the processes of design and construction. She also argues against architecture's historical indifference to sexual specificity, asking what the existence of (at least) two sexes has to do with how we understand and experience space. Drawing on the work of such philosophers as Henri Bergson, Roger Caillois, Gilles Deleuze, Jacques Derrida, Luce Irigaray, and Jacques Lacan, Grosz raises abstract but nonformalistic questions about space, inhabitation, and building. On the one hand, freedom is said to be the property of a subject. On the other, freedom only happens in the space of being-in-common. Freedom, then, is the place of a conflict between the “self” and the “with,” between independence or autonomy and dependence or sharing. Resolving this apparent antinomy requires showing how the with ontologically constitutes the self. This, in turn, allows for a rethinking of freedom beyond what liberal democracy and political economy have to offer, as the (...) renewed opening of existence onto nothing, or onto an “outside” that the opening itself constitutes. Are Lévinas and Deleuze two allies in their effort to break away from the Western ontology, which is based on the logic of the One and the Same, or do their philosophies represent two distant galaxies? The purpose of this paper is not to argue for either possibility, but to show the issue in all its complexity. Conjunctions as well as disjunctions of Lévinas' metaphysical thinking and Deleuze's nomadic philosophy should be dealt with on the background of the problems of (...) sexual difference and human face that play an important part in both conceptions. The analysis of these phenomena shall allow us to see the common denominator of both philosophical conceptions in the relation of thought to the outside, even though they approach the outside in two different ways. Ainslie's account of willpower is conspicuously individualistic. Because other people, social influence, and culture appear only peripherally, it risks overlooking what may be resolve's deeply social roots. We identify a general “outside-in” explanatory strategy suggested by a range of recent research into human cognitive evolution, and suggest how it might illuminate the origins and more social aspects of resolve.

Post-secondary students in the applied professions (e.g., business, education, psychology) often see the value of creativity to their future work, but have never had the opportunity to critically examine their assumptions about creativity. A more critically examined and substantiated understanding of creativity can go a long way in helping pre-professional students consider how creativity might be best applied and cultivated in their future professional work. The purpose of this article is to discuss how principles of critical thinking can be brought (...) to bear on understanding creativity. First, a discussion of the importance of critically examining the basic assumptions surrounding creativity will be presented. Then, a pedagogical framework for incorporating critical thinking into the examination of creativity will follow. Finally, an example of how the model might: be used with post-secondary students will be presented, followed by a brief conclusion. (shrink)

Conventionalism about property is the view that all moral duties correlative to property rights depend essentially either on the existence of a convention that assigns conventional ownership of objects, or on the existence of a body of positive law that confers legal property rights. It has been objected that, if Conventionalism about property is true, then it is impossible for someone to have her property right violated by someone who is not a member of the community in which her conventional (...) property right is assigned. But it is possible. When Christopher Columbus sailed up to the island of Hispaniola in 1492, he and his sailors wronged the inhabitants by forcing them off their land. So, Conventionalism is false. This is the Outsider Challenge for Conventionalism. The Outsider Challenge (and its first premise, in particular) receives support from the Benefit Condition, according to which one can be morally obligated to comply with a conventional rule only if one benefits or has one’s interests protected by the convention of which it is a part. Despite its provenance and plausibility, however, I think that the Benefit Condition should be rejected. Doing so in a principled way allows us to square Conventionalism with our moral intuitions and, thus, address the Outsider Challenge. My main aim in this essay is to reject the Benefit Condition in one such principled way by providing a Contractualist answer to the question of when, and why, someone is morally required to respect another’s conventional property right. One is morally required to respect the conventional property rights of another when and because failing to do so would run afoul of the Principle of Established Practices (pep) – a principle for which I give a Contractualist justification. Roughly, the pep requires us to comply with sufficiently just social practices in the absence of special justification, and the fact that one’s interests are not protected by a property convention is not always a sufficiently strong reason for one to violate the duties assigned by that convention. Since the fact that one’s interests are not protected by a property convention is not necessarily a special justification for violating the pep, the pep gives us reason to reject the Benefit Condition and, thus, the Outsider Challenge, too. How should judges decide which linguistic canons to apply in interpreting statutes? One important answer looks to the inside of the legislative process: Follow the rules that lawmakers contemplate. A different answer, based on the “ordinary meaning” doctrine, looks to the outside: Follow the rules that would guide an ordinary person’s understanding of the legal text. Empirical scholars have studied statutory interpretation from the inside—revealing what rules drafters follow—but never from the outside. We offer a novel framework for empirically testing (...) interpretive canons “from the outside,” recruiting 4,500 people from the United States, as well as a sample of U.S. law students, to evaluate hypothetical scenarios that correspond to each canon’s triggering conditions. -/- The empirical findings provide crucial evidence about which traditional canons “ordinary meaning” actually supports, and they carry several further implications. First, interpretive canons are not a closed set. We discovered new canons that are not yet reflected as legal canons, including one we term the “non-binary gender canon” and another the “quantifier domain restriction canon.” Second, the results support a new understanding of the ordinary meaning doctrine itself, as one focused on the ordinary interpretation of rules, as opposed to the traditional focus on “ordinary language” generally. Third, many of the canons reflect that ordinary people interpret rules with an intuitive anti-literalism. This anti-literalism finding challenges textualist assumptions about ordinary meaning, as well as offering a theme for researching other currently unrecognized canons. Most broadly, we hope the Essay initiates a new research program in empirical legal interpretation. If ordinary meaning is relevant to legal interpretation, interpreters should look to evidence of how ordinary people actually understand legal rules. We see our experiments as a first step in that new direction. (shrink)

Some philosophers—for example, Husserl, Alva Noë and Susanna Siegel—have claimed that the contents of visual sensations standardly include references to the later visual episodes that one would have under certain conditions. The current paper claims that there are no good reasons for accepting that view. Instead, it is argued that the conscious phenomena which have been cited as manifesting the presence within visual contents of references to ways that things would look in the course of later visual sensations are better (...) explained in another manner: in terms of references within the contents of ordinary visual sensations to ways that things actually then look from various perspectives. Perceptual phenomena reviewed by O'Regan & Noë (O&N) cannot be explained by bottom-up activity alone, but conventional interpretations suffice if perceptions are seen as activations of memory models of the outside world and its events. Motor involvement is necessary only during the phylogenetic and ontogenetic development of perceptual mechanisms.

While some scholars have interpreted his discussion as a commentary on the persona of a nun, this article considers what Abelard's remarks might mean for understanding the development of the concept of race in Western thought. In (...) particular, it considers whether Abelard's discussion, both in the letter and in his metaphysical writings, challenges the common position that Europeans did not develop a concept of race until at least the early modern period. It examines these texts to determine the extent to which his remarks reveal congruities or differences with later more explicit conceptions of race. (shrink)

Blanchot often evoked the silence required for literary writing, a silence which he says must “be imposed” on a pre-existing and indistinct murmur of language. Likewise, he evokes this murmur itself as an originary ground of all speech, including literary speech. Less often recognized are the ways in which he also locates this murmur in the realm of public speech and everyday language, the rumor of speech spoken by no one and by everyone, a realm which he in turn links (...) with the exigencies of publication and publicity that bear on the literary work within modern societies marked by mass media and technically mediated communication. Blanchot himself thus points to an unexpected convergence, in these sonic images of impersonal murmuring flows of language, between literary language per se, and a language that is traditionally considered inauthentic, empty, superficial, a chattering nullity. This essay attempts to press on this border by showing Blanchot’s anxious, and probably futile, attempts to maintain the distinction he so profoundly and rigorously effaces. As literature is threatened by the indistinction of language from which it originates, it reveals an unexpected convergence with the leveling modes of language marked by mass media and by technicity in general. Observer memories, memories where one sees oneself in the remembered scene, from-the-outside, are commonly considered less accurate and genuine than visual field memories, memories in which the scene remembered is seen as one originally experienced it. In Remembering from the Outside (OUP, 2019), Christopher McCarroll debunks this commonsense conception by offering a detailed analysis of the nature of observer memories. On the one hand, he explains how observer and field perspectives are not really mutually exclusive in an experience, including memory (...) experiences. On the other hand, he argues that in observer memories there is no additional explicit representation of oneself experiencing the event: the self-presence is transparent and given by the mode of presentation. Whereas these are two lines of strategic and original argumentation, they are not exempt of problems. In this critical notice, I focus on the problematic aspects of McCarroll’s account. I show that it presents some issues that affect the internal coherence of the overall framework, and that some aspects and central notions would have needed more development to offer a precise picture of the nature of observer memories. On the one hand, freedom is said to be the property of a subject. On the other, freedom only happens in the space of being-in-common. Freedom, then, is the place of a conflict between the “self” and the “with,” between independence or autonomy and dependence or sharing. Resolving this apparent antinomy requires showing how the with ontologically constitutes the self. This, in turn, allows for a rethinking of freedom beyond what liberal democracy and political economy have to offer, as the (...) renewed opening of existence onto nothing, or onto an “outside” that the opening itself constitutes. This short paper is to provide answer to the question what is there outside the Universe? If the Universe is expending, what does it expend into? An answer was provided, the universe is expanding into its complementary universe. If that is so, then what the complementary universe is? A new perception is provided that matter exist as a logical state. What is the logical state creating matter? This question is being answered by the relationship between the universe and its complementary (...) universe satisfying the equilibrium equation that total matter of both universes, the inner universe and the complementary universe, collapse into zero, i.e. no matter.
