The field of socio-legal research has encountered three fundamental challenges over the last three decades - it has been criticized for paying insufficient attention to legal doctrine, for failing to develop a sound theoretical foundation and for not keeping pace with the effects of the increasing globalization and internationalization of law, state and society. This book examines these three challenges from a methodological standpoint. It addresses the first two by demonstrating that legal sociology has much to say about justice (...) as a kind of social experience and has always engaged theoretically with forms of normativity, albeit on its own empirical terms rather than on legal theory's analytical terms. The book then explores the third challenge, a result of the changing nature of society, by highlighting the move from the industrial relations of early modernity to the post-industrial conditions of late modernity, an age dominated by information technology. It poses the question whether socio-legal research has sufficiently reassessed its own theoretical premises regarding the relationship between law, state and society, so as to grasp the new social and cultural forms of organization specific to the twenty-first century's global societies. This book shows that Hauriou's positivist and pragmatic jurisprudence and social theory, as well as their application to the study of institutions, is satisfactorily supported by his idealistic philosophy. The nine chapters first locate Hauriou's influences, then situate his disciplinary methodologies within methodology in general. The central chapters concern each of the three methodologies in turn.

There are realist philosophers and social scientists who believe in the indispensability of social ontology. However, we argue that certain pragmatist outlines for inquiry open more fruitful roads to empirical research than such ontologizing perspectives. The pragmatist conceptual tools in a Darwinian vein—concepts like action, habit, coping and community—are in a particularly stark contrast with, for instance, the Searlean and Chomskian metaphysics of human being. In particular, we bring Searle's realist philosophy of society and mind under critical survey in this (...) paper and contrast it with a pragmatist, sociologizing approach. Drawing from Dewey, James, and recent antirepresentationalism, we propose for research work a methodological relationalism of its own kind, altogether detached from the ontologies of society and mind. Current sociological theories appear to have lost their general persuasiveness in part because, unlike the theories of the ‘classical era’, they fail to maintain an integrated stance toward society, and the practical role that sociology plays in society. The authors explore various facets of this failure and possibilities for reconstructing sociological theories as integrated wholes capable of conveying a moral and political immediacy. They discuss the evolution of several concepts (for example, the social, structure, and self) and address the (...) significant disputes (for example, structuralism versus humanism, and individual versus society) that have dominated twentieth-century sociological thought. Their ideas and analyses are directed towards an audience of students and theorists who are coming to terms with the project of sociological theory, and its relationship with moral discourses and political practice. The authors of these essays are sociological theorists from the United States, the United Kingdom and Canada. They are all established, but not ‘establishment’ authors. The book contains no orthodoxies, and no answers. However, the essays do contribute to identifying the range of issues that will constitute the agenda for the next generation of sociological theorists. (shrink)

The following paper is a descriptive and retrospective study that analyses the basic elements of a methodological design in projects approved by Fondecyt in 1992 and 1999 considering the disciplines of anthropology and sociology. The analyses used four steps to create a methodological design. First, the projects selected were classified as qualitative or quantitative, according to the definition given by the own authors and looked for the arguments used by the authors for using the selected methodology. Then a detailed (...) analysis is done on how these selected projects describe and elaborate a methodological strategy, reviling or not their stringency and precision of the methodological proposals. El presente trabajo es un estudio descriptivo y retrospectivo que analiza los elementos básicos de un diseño metodológico en los proyectos aprobados por Fondecyt en los años 1992 y 1999 en dos disciplinas: antropología y sociología. Para ello se utilizó como criterio de análisis cuatro pasos para la elaboración de un diseño metodológico. Primero se definió a los proyectos como cualitativos o cuantitativos en el marco de la definición de los propios autores, buscándose también las argumentaciones dadas para el uso de una u otra metodología. The explanatory power of structures in analytical sociologists’ agent-based models brings into question methodological individualism. We defend that from an explanatory point of view, the syntactic properties of models require semantic conditions of interpretation drawn from a conceptual research framework; in such a framework, social/relational structures have only partial, explanatory power ; and taking the explanation further through generative mechanism modeling necessitates calling upon methodological individualism’s generic framework of interpretation that relies on social actors’ rational capacity. These mark two different attitudes toward philosophical metaphysics and ontological commitments. In recent years methodological debates in the social sciences have increasingly focused on issues relating to epistemology. Realism and Sociology makes an original contribution to the debate, charting a middle ground between postmodernism and positivism.

Applied sociology will be understood in the following discussion as a unique and original form of sociology; i.e., in its logic and practice distinguished from traditional sociology it is understood as an explanatory body of knowledge and an intellectual discourse about intentional/purposeful social action and behavior. The application of sociology proper to such substantive fields as family, art, law and sport, commonly called applied sociology, which reproduce the body of sociological knowledge just a second time, (...) is not part of such understanding. Applied sociology in its original sense has its own logic in which purpose, implementation and the process of social-problem solution are crucial. It will in the end lead to an applied action or implementation theory. It is, to paraphrase Lazarsfeld, the methodology of “sociology in action” (1960). (shrink)

In the new edition of the program of the CPSU, it is pointed out in particular that it is necessary to concentrate attention on "the study and comprehensive analysis of the experience amassed in creating a new society in the USSR and in other socialist countries, on the dialectics between the forces and relations of production, on the material and spiritual spheres under conditions of socialism, (...) on the laws of genesis of a communist social formation, and the ways and means of advancement to its higher phase.". Nowadays, the widespread view is that classical sociology is tainted with ‘methodological nationalism and it would appear that there has been a significant overlap between social and political space. We disagree with this point of view for three reasons: (1) by dealing with the global world, classical sociology has already glimpsed the possibility of going beyond the nation-state as a unit of analysis; (2) having operated above all with the notion of ‘social’ rather than ‘national’, its categories are (...) transnational; and (3) when classical sociology has dealt with national society, studies have not reified it within its political boundaries. Consequently, in our opinion, classical sociology highlights both analytical categories that go beyond the ontology of the nation-state as well as new socio-political forms defined within the trajectory of modernity under the pressure of globalization processes. Max Weber’s methodology is often treated by some as his principal contribution to social science, while his comparative sociology of religion starting with the famous Calvinist thesis is the Schwerpunkt in his work, according to others. There are several reasons to locate and analyze the conjunctions between these two interpretations. Weber’s ideal type is formulated in several places, not only in the so-called ‘Objectivity’ essay from 1904, but also for instance in the marginal utility-essay from 1908. His three meta-texts (...) for the three volumes in GARS (Gesammelte Aufsätze zur Religionssoziologie) are also illuminating, especially in ‘Einleitung’ (‘Introduction’) and ‘Zwischenbetrachtung’ (or ‘Intermediate Reflections’). It was in the ‘Zwischenbetrachtung’ where he commented on religion in India, partly as an ‘identity giving other’, that the ideal type reappeared. Weber deals with the uniqueness of Occidental culture and his comparative religion serves as supporting evidence, much in line with J S Mill’s canons for the logic of isolating independent variables by similarities and differences -as indicated in a letter by Weber to Georg von Below. As a result Weber serves still today as a sparring partner for theorists of the Axial Age and the multi-modernity paradigm. (shrink)

Historically, the sociology of emotion has been relatively long on theory and short on methods. This collection of articles seeks to remedy this by introducing new ways to capture the four factors of emotion, as articulated by Thoits : meaning, expression, label, and physiology. As a group, these studies reify existing dichotomies in the literature—that is, emotional experience versus emotional expression—and seek to reconcile them. Additionally, they all champion the use of mixed methods—either simultaneously or sequentially—adopting some combination of (...) direct or indirect observation, subjective understanding/experience, and physiological change. Book review of: Jeff Kochan (2017). Science as Social Existence: Heidegger and the Sociology of Scientific Knowledge (Cambridge UK: Open Book Publishers).

Google Trends reveals that at the time we were writing our article on ‘The Coming Crisis of Empirical Sociology’ in 2007 almost nobody was searching the internet for ‘Big Data’. It was only towards the very end of 2010 that the term began to register, just ahead of an explosion of interest from 2011 onwards. In this commentary we take the opportunity to reflect back on the claims we made in that original paper in light of more recent discussions (...) about the social scientific implications of the inundation of digital data. Did our paper, with its emphasis on the emergence of, what we termed, ‘social transactional data’ and ‘digital byproduct data’ prefigure contemporary debates that now form the basis and rationale for this excellent new journal? Or was the paper more concerned with broader methodological, theoretical and political debates that have somehow been lost in all of the loud babble that has come to surround Big Data. Using recent work on the BBC Great British Class Survey as an example this brief paper offers a reflexive and critical reflection on what has become – much to the surprise of its authors – one of the most cited papers in the discipline of sociology in the last decade. This dissertation seeks to contribute to research in the philosophy of social science. The study focuses upon select epistemological and ontological aspects of Hannah Arendt’s work from which methodological implications are drawn pertaining to sociology. Arendt, although critical of the sociology of her time, has become increasingly cited and influential for emerging sociological research and this study seeks to contribute to this by focusing upon the problem of novelty. The aim is to explore the philosophical and methodological implications (...) of novelty for social science by working through three case studies that are theoretically pivotal for social science—action, the ‘social’, and the self—in terms of novelty as expressed in Arendt’s writing. Arendt is critical of methodology and epistemology, aiming to draw her readers to ontological concerns outlined from her preoccupation with the 'world' and social reality. In this aim, Arendt seeks to distance herself from social sciences that she claims ignore human novelty in favour of reading social regularities, tendencies and similarities. Despite her disdain for method, Arendt suggests a anti-methodological 'method' (outlined in an overlooked footnote) for keeping trained upon and for dealing with novel, anomalous events. In the seed of this method lies a unique opportunity for social science to reassess and extend its methods, addressing this oversight and in so doing bring to light the novel social object as a legitimate subject of social research. Emotions are an emergent feature of interaction, and many of the articles in this special section touch on this. What I find interesting is that we get a glimpse into how emotions unfold in a situation, and how the flow of emotions in any study can run from participant to participant, participant to researcher, and researcher to participant. Part of this flow of emotions is influenced by reflexivity or the awareness of self and other feeling states, which is addressed by (...) some of the contributors. What is particularly challenging is how to carefully study emotions as they surface in situations, and many of the contributors encourage us to pause and think about how to do this. (shrink)

Drawing on and extending the Foucaultian philosophical framework that Jeffrey Bishop develops in his masterful book, The Anticipatory Corpse: Medicine, Power, and the Care of the Dying, we undertake a sociological analysis of the neurological procedure—deep brain stimulation —which implants electrodes in the brain, powered by a pacemaker-like device, for the treatment of movement disorders. Following Bishop’s work, we carry out this analysis through a two-fold strategy. First, we examine how a multidisciplinary team evaluates candidates for this implant at a (...) major medical center. We present excerpts from an ethnographic study of the “case conference” where disease entities are presented, contested, ratified, and made objects for intervention with this technology. The case conference becomes the key site in the transition from “person-with-illness” to “person-with-brain-implant” as a team of health professionals determines a plan of action by interpreting both statistical and “quality of life” data regarding their patients. Second, this article explores these decision-making processes through Bishop’s conceptualization of evidence-based medicine, which relies on statistical approaches as the ultimate authority in knowledge production and medical decisions. We then reflect on Bishop’s critique of the social sciences and the methodological, analytical, and substantive ramifications that The Anticipatory Corpse can offer future sociological work. Manzo (2023/2020, this volume) objects to Nathalie Bulle's article with Denis Phan “Can Analytical Sociology Do Without Methodological Individualism?” (Philosophy of the Social Sciences, 2018) that the rationality associated with the understanding interpretation of MI cannot be taken to be trans-situational. This reply argues that either (1) this is a misunderstanding resulting from a confusion between the general rational capacity of human beings, to which Bulle and Phan refer, and the specific behavioral patterns associated with given situations and models (...) or (2) this objection supports a structural reductionism in which the structural level tends to “reduce” the individual level, so that the behavioral patterns are directly implied by the structures. Scientific reasoning – presumed unique, perfect, objective – still solidly bases its foundations on the consequences of the evident success (theoretical and practical) obtained over the centuries starting from Galilean intuition. Over time, the granitic belief that scientific success can depend exclusively on a single, simple principle of method, has actually been slightly undermined; there is still a solid scientific basis about this idea, but the demands for rethinking and eclecticism also in the methodological approach begin to be "important". It (...) therefore seems absolutely compelling to note the difference between "inanimate" sciences – which have gradually seen the level of compliexity growing, however, resulting from the fact that the more the system of knowledge grows and the greater are the dark areas to be revealed – and "animated" sciences who have as their object of interest people, sensibility, ethics, behaviors and social actions. In this article, I criticize environmental sociology’s conventional diagnosis of its methodological situation and overly narrow definition of its field. I argue for a greater engagement with the natural science base and consideration of anthropological approaches. I start with conceptual analysis, identifying the human-environment relationship as a pro-active two-way interaction. I then present an outline of global environmental dynamics, highlighting the unequal size of human activities on geosphere and biosphere scale, and the role of the biosphere as manager of (...) the geosphere, this as context for the human population problem. Three types of environmental problems are next identified: urban-industrial, rural-agrarian, and high hazard exposure. These are seen as forming a continuum, with anthropogenic and natural factors synergizing at the centre. I comment on their geographic distribution, noting Europe’s limited and specific environmental experience. Lastly I attempt an overview without biological metaphors of the humanenvironment relationship through time, commenting on its inherent imbalances and how these might be diagnosed. I conclude that sociology’s bias to modernity and the West renders it inadequate to the global environmental question. A wider and deeper spacio-temporal consideration is needed, with the whole continuum of environmental problems considered. For this, environmental sociology should seek a synthesis with cultural anthropology centring on the anthropological concept of culture, an approach, I argue, that is accessible through the sociology of Max Weber. In this article I seek to relate the psychology of Carl Jung to sociological theory, specifically Weber. I first present an outline of Jungian psychology. I then seek to relate this as psychology to Weber’s interpretivism. I point to basic methodological compatibilities within a Kantian frame, from which emerge central concerns with the factors limiting rationality. These generate the conceptual frameworks for parallel enquiries into the development and fate of rationality in cultural history. Religion is a major theme here: contrasts (...) of eastern and western religion; the rise of prophetic religion and the disenchantment of modernity. Weber’s categories ‘ascetic’ and ‘mystic’ seem applicable to his own and Jung’s approaches and indeed temperaments, while a shared ironic view of rationality leads to similar visions of the disenchanted modern world. I conclude that Jung is sociologically coherent, but in an entirely different sense from Freud: rather than a constellation of family, socialization, ideology, social continuity, there is an analysis of cultural history against a background of adult normal psychology. I conclude that sociology should acknowledge Jung, but not in terms of over-arching theory. Rather Jungian insights might be used to orient new enquiries, and for reflexive analysis of sociology’s methodological debates. (shrink)

From this perspective, we should see a weeding out of theories to a small number, but this is not likely to occur because each of the many theoretical perspectives has a resource base of adherents. This article focuses on two developments in nineteenth-century (philosophy of) social science: Moritz Lazarus’s and Heymann Steinthal’s Völkerpsychologie and Georg Simmel’s early sociology of knowledge. The article defends the following theses. First, Lazarus and Steinthal wavered between a “strong” and a “weak” program for Völkerpsychologie. Ingredients for the strong program included methodological neutrality and symmetry; causal explanation of beliefs based on causal laws; a focus on groups, interests, tradition, culture, or materiality; determinism; and a self-referential model of social institutions. (...) Second, elements of the weak program were the blurring of explanatory and normative interests, an emphasis on freedom of the will, and antirelativism and antimaterialism. Third, later research projects keeping the label “Völkerpsychologie” followed the weak program. Fourth, in the 1880s and 1890s, Simmel tried to build on some of the elements of the strong program. Much has been written in the last decade about how we should understand the value of the sociology of bioethics. Increasingly the value of the sociology of bioethics is interpreted by its advocates directly in terms of its relationship to bioethics. It is claimed that the sociology of bioethics (and related disciplinary approaches) should be seen as an important component of work in bioethics. In this paper we wish to examine whether, and how, the sociology of (...) bioethics can be defended as a valid and justified research activity, in the context of debates about the nature of bioethics. We begin by presenting and arguing for an account of bioethics that does justice to the content of the field, the range of questions that belong within this field, and the justificatory standards (and methodological orientations) that can provide convincing answers to these questions. We then consider the role of sociology in bioethics and show how and under what conditions it can contribute to answering questions within bioethics. In the final section, we return to the sociology of bioethics to show that it can make only a limited contribution to the field. (shrink)

In 2004, Michael Burawoy challenged sociologists to move beyond the ivory tower and into the realm of activism, to engage in public discourses about what society could or should be. His call to arms sparked intense debate among sociologists. Which side would "sociology" take? Who would define "the norm," and how could public sociology possibly speak for all sociologists? In this volume, which opens with a foreword by Michael Burawoy, leading Canadian sociologists continue the debate by discussing not (...) only how and why they should do sociology but also how ethical judgments influence sociological practice and the evaluation of research. This article discusses agent-based simulation (ABS) as a tool of sociological understanding. I argue that agent-based simulations can play an important role in the expansion of explanatory understanding in the social sciences. The argument is based on an inferential account of understanding (Ylikoski 2009, Ylikoski & Kuorikoski 2010), according to which computer simulations increase our explanatory understanding by expanding our ability to make what-if inferences about social processes and by making these inferences more reliable.
