In this Article we propose an analytical framework for allocating responsibility for the protection of worker’s rights in the global labor market. Since production and services have expanded globally, and the state’s ability to protect worker’s rights on the national level has been undermined, the main challenge today is to find the appropriate institutional arrangements that allocate responsibility in a manner that realizes basic labor standards. The Article argues that in the context of a global labor market, responsibility should be (...) perceived in terms of "shared responsibility," whereby responsibility is shared by a complex network of agents and institutions that take part in global production and services. Within these global social networks and connections, labor relations generate a unique type of social connection which implies a special type of commitment and obligation towards workers. We propose four principles to guide the allocation of responsibility for remedying the unjust conditions of workers in the world, based on measures of connectedness, capacity, benefit, and contribution. We argue that a comprehensive theory of reciprocals must rely on a general taxonomy of restrictions on the interpretation of relational expressions. Developing such a taxonomy, we propose a new principle for interpreting reciprocals that relies on the interpretation of the relation in their scope. This principle, the Maximal Interpretation Hypothesis (MIH), analyzes reciprocals as partial polyadic quantifiers. According to the MIH, the partial quantifier denoted by a reciprocal requires the relational expression REL in its scope to denote a maximal (...) relation in REL’s interpretation domain. In this way the MIH avoids a priori assumptions on the available readings of reciprocal expressions, which are necessary in previous accounts. Relying extensively on the work of Dalrymple et al. (Ling Philos 21:159–210, 1998), we show that the MIH also exhibits some observational improvements over Dalrymple et al.’s Strongest Meaning Hypothesis (SMH). In addition to deriving some attested reciprocal interpretations that are not expected by the SMH, the MIH offers a more restrictive account of the way context affects the interpretation of reciprocals through its influence on relational domains. Further, the MIH generates a reciprocal interpretation at the predicate level, which is argued to be advantageous to Dalrymple et al.’s propositional selection of reciprocal meanings. More generally, we argue that by focusing on restrictions on relational domains, the MIH opens the way for a more systematic study of the ways in which lexical meaning, world knowledge and contextual information interact with the interpretation of quantificational expressions. According to virtue theory, morality is about the person performing the actions. In The Good Place, Chidi Anagonye is characterized not by habitual moral action but by pained decision making and insecurity. One might say that Chidi can be forgiven for not having yet perfected his character because he is, after all, still acting voluntarily and making moral decisions most of the time. Chidi often wavers and changes his mind about what he should do. Even when he seems to have (...) a good moral intuition about what is right, he second‐guesses himself and overcomplicates things. Chidi falls in the category of incontinence. He has a generally good sense of what a moral person would do in a given situation and a generally reliable moral intuition. Because The Good Place requires near moral perfection, one can confidently say that Chidi deserves his spot in The Bad Place. (shrink)

This article presents such a conceptual framework and a critical in-depth analysis of current ILO freedom of association jurisprudence. Adam Smith’s formal legacy to posterity consisted of meticulously revised editions of his two published works, The Theory of Moral Sentiments and The Wealth of Nations; long-standing plans for treatises on Jurisprudence, Rhetoric, and the Fine Arts were abandoned on the grounds that there was no time to complete them. This chapter discusses Smith oeuvre as component parts of an unrealized plan to develop a Science of Man on experimental principles. Smith’s introduction to this grand projet as a student is (...) explored and the influence of Hutcheson and Hume is emphasized as is the fact that Smith developed both the published and unpublished components of his Science of Man simultaneously. The question of the meaning Smith attached to ‘science’ is a continuing theme of the chapter. (shrink)

Inspired by the work of intellectual historian J. G. A. Pocock, this 1993 collection explores the political ideologies of early modern Britain.

Despite the drastic differences in their views of the intellect and the location and specific function of the will both Aquinas and Averroes are able to claim that their systems allow for moral agency because they both place the will—a faculty that is of prime importance to the process of moral action—in the individual. Both philosophers think that they are following Aristotle in making their claims about the will and the intellects. This paper will examine the issue of will and (...) the related issue of the intellects as it appears in the Aristotelian texts and in the subsequent work of Averroes and Aquinas. It will argue that at least some of the divergence in Averroes and Aquinas can be attributed to an issue of translation regarding De Anima, and a difference in the role of cogitation and the intellects regarding will. Are nonconscious processes sufficient to cause false memories of a nonstudied event? To investigate this issue, we controlled and measured conscious processing in the DRM task, in which studying associates causes false memories of nonstudied associates . During the study phase, subjects studied visually masked associates at extremely rapid rates, followed by immediate recall. After this initial phase, nonstudied test words were rapidly presented for perceptual identification, followed by recognition memory judgments. On the perceptual identification task, we found significant priming (...) of nonstudied associates, relative to control words. We also found significant false recognition of these nonstudied associates, even when subjects did not recall this word at study or identify it at test, indicating that nonconscious processes can cause false recognition. These recognition effects were found immediately after studying each list of associates, but not on a delayed test that occurred after the presentation of several intervening lists. Nonconscious processes are sufficient to cause this memory illusion on immediate tests, but may be insufficient for more vivid and lasting false memories. (shrink)

In the vast literature centering on the Itinerarium Egeriae there is a serious lacuna. No attempt has been made to analyse the circle of readers to whom this remarkable document was addressed and for whose sake Egeria recorded so faithfully every detail of her journey. Yet if a full understanding of the IE is to be achieved, some definition of the circle of Egeria and of its relations with the pilgrim is essential. In other words, who in the West at (...) that point in the late fourth century, would have been so interested in Holy Land pilgrimage as to read attentively such a personal account as the IE? The following is a tentative essay to gauge the concerns, expectations and cultural background of Egeria's immediate circle of readers through her own emphasis on various aspects of her pilgrimage. In addition, the investigation will try to assess the place of pilgrimage in the life of western communities and the value of communications between the pilgrim on the road and the society back at home. A giant of the eighteenth-century Enlightenment, David Hume was one of the most important philosophers ever to write in English. He was also a brilliant historian. In this book—a new and revised edition of his 1989 classic—Nicholas Phillipson shows how Hume freed history from religion and politics. As a philosopher, Hume sought a way of seeing the world and pursuing happiness independently of a belief in God. Counter-terrorism officials in the USA and the UK responded to the events of 11 September 2001 and 7 July 2005 with an increasing resort to the use of ?intelligence-led policing? methods such as racial and religious profiling. Reliance on intelligence, to the effect that most people who commit a certain crime have a certain ethnicity, can lead to less favourable treatment of an individual with that ethnicity because of his membership in that group, not because of any act he is (...) suspected or known to have committed. This paper explains the context in which intelligence-led policing flourishes, and how this discussion contributes to the profiling debate in both the USA and the UK, and then sets out two key contentions. First, we argue that Article 14 ECHR as applied under the UK Human Rights Act has a more protective, and less ?prosecutorial?, conception of discrimination than has the US Equal Protection Clause, meaning that judges need not find a discriminatory motive to find that discrimination has occurred. Second, we contend that Article 14 provides the judiciary with the key tool of proportionality, which, when properly applied, makes it harder for discrimination to stand up to scrutiny. (shrink)

In this paper I want to discuss David Hume's views about morals, politics and citizenship and the role of philosophers and philosophizing in modern civil society - what I shall call his theory of civic morality. This is a subject which has been neglected by philosophers, presumably because it is of limited philosophical interest. But it is of considerable interest to the historian who wants to understand Hume's development as a philosopher, to locate his thought within a specific, Scottish context (...) and to arrive at some understanding of his surprisingly close and cordial relations with the literary and social world of enlightened Edinburgh. These are large claims and I cannot hope to substantiate them fully in a short paper. My purpose is first, to show that, historically speaking, Hume's preoccupation with civic morality was of central rather than peripheral interest to him as a philosopher and that it helps to explain his otherwise rather puzzling decision to give up philosophizing systematically in the manner of Hobbes and Locke, in favour of polite essay-writing in the manner of Addison and Steele. My second purpose is to suggest that Hume's interest in civic morality, his neo-Addisonian mode of philosophizing about it and the nature of his understanding of politics, citizenship and philosophizing in a modern age was, unlike his thought about religion, responsive to and consonant with some of the most important ideological preoccupations of his Scottish contemporaries. It was, I suspect, a shared interest which helped to contain some of the anxieties Hume's notorious religious scepticism caused his contemporaries. Without it, he could not possibly have emerged as one of the leaders of Edinburgh's intellectual life in the age of the Scottish Enlightenment. (shrink)

The Israeli settler movement plays a key role in Israeli politics and the Arab-Israeli conflict, yet very few empirical studies of the movement exist. We describe a recent approach for distinguishing between stochastic and deterministic sources of variability, focusing on the mammalian cell cycle. Variability between cells is often attributed to stochastic noise, although it may be generated by deterministic components. Interestingly, lineage information can be used to distinguish between variability and determinism. Analysis of correlations within a lineage of the mammalian cell cycle duration revealed its deterministic nature. Here, we discuss the sources of such variability and the possibility that the underlying deterministic process (...) is due to the circadian clock. Finally, we discuss the “kicked cell cycle” model and its implication on the study of the cell cycle in healthy and cancerous tissues. (shrink)

Population aging and longevity in the context of declining social commitments raise concerns about disadvantage, inequality, and the well‐being of older people. In this short piece, we use the concept of precarity as a lens to understand new and sustained forms of insecurity that affect late life, and we illustrate how these risks, when experienced over time and in relation to conditions such as austerity, can deepen disadvantage.

One of the core debates concerning equity in the response to the threat of anthropogenic climate change is how the responsibility to reduce greenhouse gas emissions should be allocated, or, correspondingly, how the right to emit greenhouse gases should be allocated. Two alternative approaches that have been widely promoted are, first, to assign obligations to the industrialized countries on the basis of both their ability to pay and their responsibility for the majority of prior emissions, or, second, to assign emissions (...) rights on a equal per capita basis. Both these proposals ignore intra-national distributional equity. Instead, we develop a policy framework we call 'Greenhouse Development Rights' which allocates obligations to pay for climate policies on the basis of an individually quantified metric of capacity and responsibility . Crucially, the GDRs framework looks at the distribution of income within countries and treats people of equal wealth similarly, whatever country they live in. Thus even poor countries have obligations proportional to the size and wealth of their middle and upper classes, defined relative to a 'development threshold'. While this method nominally identifies the 'right to development' as applying to people, not countries, as a proposal for a treaty among sovereign nations, there is no obvious way to give legal meaning to that right. In this paper, then, we raise some of the philosophical and political questions that arise in trying to quantify capacity and responsibility and to use the 'right to development' as a principle for allocating costs.*. While existing literature on labor governance in the globalized economy tends to focus on empirical and conceptual investigations, the article contributes to the emerging scholarship by proposing moral justifications for labor governance schemes that go beyond voluntary private regulations and include public enforcement mechanisms. Drawing on normative theories of justice and on empirical-legal research, our Labor Model of (...) Shared Responsibility introduces three main claims: First, that responsibility for protecting and promoting labor standards in global supply chains should be shared by all private and institutional actors involved (whether directly or indirectly) in the production and distribution processes. Second, we offer a normative model for allocating responsibility among the various actors, based on five principles: connectedness, contribution, benefit, capacity, and power. Despite the growing global consensus regarding the need to ensure minimal labour standards such as adequate safety and health conditions, freedom of association, and the prohibition of child labour, millions of workers across the world continue to work in horrific conditions. Who should be held responsible, both morally and legally, for protecting workers' rights? What moral and legal obligations should individuals and institutions bear toward foreign workers in their countries? Is there any democratic way to generate, regulate, and enforce labour (...) standards in a global labour market? This book address these questions by taking a fresh look at the normative assumptions underlying existing and proposed international labour regulations. By focusing on international labour as a particular sphere of justice, it seeks to advance both the contemporary philosophical debate on global justice and the legal scholarship on international labour.
