Background Gerontechnologies are increasingly used in the care for older people. Many studies on their acceptability and ethical implications are conducted, but mainly from the perspective of principlism. This narrows our ethical gaze on the implications the use of these technologies have. Research question How do participants speak about the impact that gerontechnologies have on the different phases of care, and care as a process? What are the moral implications from an ethic of care perspective? Research design Secondary analysis of (...) semi-structure interviews, whose segments on specific technologies were analysed through reflexive thematic analysis. Participants and research context Sixty-seven Swiss stakeholders involved in the use of gerontechnologies, including professional caregivers, informal caregivers, and older persons themselves. Ethical considerations The research study was evaluated by the Ethics Commission of Northwest and Central Switzerland (EKNZ). All participants received an information document before the interview date detailing the purpose, procedure, and anonymization measures. After explaining the study during the agreed upon interview time and upon receiving their written informed consent, the interview process began. Findings/results Four themes are identified: Identifying care needs, Taking responsibility, Hands-on work, Responding to care. As part of these themes, many codes highlighting the ambivalent impact of gerontechnologies are created, ranging from ‘Expanded capacity for…identifying care needs’ to ‘Create new & (un)necessary…hands-on work’. The moral implications of these results from the care ethics perspective are discussed, through the ethical elements of: attentiveness, responsibility, competence, and responsiveness. Conclusions The moral implications of gerontechnologies on care phases from the care ethics perspective open up several questions on whether they actually help give care a central role in social life and provide more competent care. Aggregative consequentialism and several other popular moral theories are threatened with paralysis: when coupled with some plausible assumptions, they seem to imply that it is always ethically indifferent what you do. Modern cosmology teaches that the world might well contain an infinite number of happy and sad people and other candidate value-bearing locations. Aggregative ethics implies that such a world contains an infinite amount of positive value and an infinite amount of negative value. You can affect only a finite (...) amount of good or bad. In standard cardinal arithmetic, an infinite quantity is unchanged by the addition or subtraction of any finite quantity. So it appears you cannot change the value of the world. Modifications of aggregationism aimed at resolving the paralysis are only partially effective and cause severe side effects, including problems of “fanaticism”, “distortion”, and erosion of the intuitions that originally motivated the theory. For decades a debate has played out in the literature about who bioethicists are, what they do, whether they can be considered professionals qua bioethicists, and, if so, what professional responsibilities they are called to uphold. Health care ethics consultants are bioethicists who work in health care settings. They have been seeking guidance documents that speak to their special relationships/duties toward those they serve. By approving a Code of Ethics and Professional Responsibilities for Health Care Ethics Consultants, (...) the American Society for Bioethics and Humanities (ASBH) has moved the professionalization debate forward in a significant way. This first code of ethics focuses on individuals who provide health care ethics consultation (HCEC) in clinical settings. Proposals to modernise fertility law in the UK In November 2023, the Human Fertilisation and Embryology Authority (HFEA) published recommendations 1 for changes to the Human Fertilisation and Embryology Act. 2 The HFEA regulates fertility treatments and embryo research in the UK. The recommendations were informed by a public consultation process during which the HFEA heard from patients, professionals and others with an interest in the regulations. The consultation ran from February - April 2023 and received just over 6800 responses. (...) This paper presents core features of the virtue ethics of American philosopher Ella Lyman Cabot. It offers an articulation of her position in Everyday Ethics (1906), and argues that Cabot's account has the resources to respond to a critique leveled against her mentor, Josiah Royce—namely, that a virtue ethics organized around loyalty is too easily corrupted by loyalty to bad causes. In addition to its importance to a full picture of the pragmatist tradition in moral philosophy, engagement (...) with Cabot's work is critical to an accurate grasp of the virtue ethics revival of the 20th century. Robert Zafft presents the too-often abstract language of business ethics in straight-forward language, laying out two themes commonly ignored: in the real world, it is often easy to lay out an ethical path but often very difficult to implement and encourage adherence to that path, and reputation is the single most important asset in business.

We have all become used to the rapid change around us, and with it, the shifting landscape of medical ethics. It appears, however, that the acceleration phase of change in biomedical sciences is only just beginning, and we need to be prepared for new challenges ahead. This issue of the journal considers several of them: in epigenome editing, 1 in bioprinting 2 and in cryonics. 3 With all of these developments, we need to be doing our ethical thinking proactively (...) rather than reactively; and we need to consider not only what we think the ethical problems might be but what frameworks we have for arguing how we should address them. Analyses of contemporary surveillance are considered in relation to the growing liquidity of contemporary social relations. When state surveillance is revealed by Edward Snowden to depend on consumer data, this illustrates Bauman’s observations about today’s rapidly mobile and “extraterritorial” power. Such power is increasingly based on highly asymmetrical visibility of watcher and watched but paradoxically also depends on “panoptic selfie-surveillance” which complicates both analysis and ethics in significant ways. Strongly panoptic power, where it still exists, is largely at the (...) margins, in Bauman’s writing, as seen for instance his gesturing towards Loic Wacquant’s. Here, as in Didier Bigo’s “banopticon” the power is exclusionary rather than inclusionary — which was the form of the original panopticon design. But the soft forms of “selfie surveillance” also have panoptic dimensions that demand consideration. The ethical questions now foregrounded go far beyond questions of “privacy”, narrowly conceived, to issues of social inclusion and democratic participation. (shrink)

A common theme in the historiography of Greek ethics says that modern ethics is characterized by imperative notions such as ‘duty’—and with a Judeo‐Christian notion of imperatives or commands issued by god—whereas ancient ethics supposedly deals mainly with ‘attractive notions such as ‘good’ and ‘virtue’. This thought is often juxtaposed with the idea that imperative notions betoken a conflict between one's duty and one's good, because an imperative seems to be required only to command people to do (...) what they do not wish to do, which is felt to be inappropriate to the supposed eudaimonism of Greek ethics. In fact Greek ethics makes substantial use of imperative notions, and does not attempt to show that attractive notions are more basic or preferable in ethics. (shrink)

Despite having worked in higher education for over twenty years, I am still, first and foremost, a practicing nurse. My employer requires me to be a nurse and my regulator regards what I do as nursing. My practice is regulated by the Code and informed by nursing ethics. If I am nurse, practicing nursing, does that mean that my students are my patients? This paper considers how the relationship that I have with my students can be informed by the (...) ethics of the nurse/patient relationship. After some initial theoretical preparation concerning argument from analogy, the paper identifies some areas for comparison between the two relationships. Areas of similarity and difference identify two areas of concern: Nurse education and educators regularly engage in coercion and surveillance in an attempt to increase student success, both of which would be considered outside nursing ethics. It is concluded that these coercive practices are not conducive to an environment where character is cultivated. Despite current financial and workforce pressures, nurse lecturers and more especially their managers would do well to return to the professional ethics of nursing to question and guide their practice. 30 years ago, R. Edward Freeman levied an influential challenge against the “separation thesis”, which maintains that ethical and business concerns are distinct and separable. However, achieving an integration of empirical and normative research continues to pose significant challenges. In this article, it is argued that the tradition of philosophical pragmatism offers a pathway to bridge this divide. While Freeman’s critique is rooted in pragmatism, it falls short of fully embracing the pragmatist turn as advocated by Charles S. Peirce and (...) John Dewey, who extended the methodologies of empirical inquiry to ethical issues. Typically, this pragmatist turn has been sidelined due to the formidable objection that norms and values cannot be empirically confirmed nor disconfirmed. This objection is critically examined, arguing that it is largely based on conceptions of science associated with positivism and logical empiricism, effectively challenged by pragmatism. Embracing a pragmatist perspective, it is argued, can substantially enhance both theoretical and empirical research within business ethics. This approach entails integrating observations that pertain to the values, norms and responsibilities of businesses. Conversely, with a comprehensive understanding of the theoretical underpinnings of such proposals, observations can help determine which ethical theories and perspectives best accommodate empirical findings. Additionally, pragmatism presents a novel approach to the role of business in society, enabling businesses to engage in democratic processes of inquiry into value. (shrink)

This paper is the English translation and adaptation of my inaugural lecture in Amsterdam for the Chair Anthropology of Everyday Ethics in Health Care. I argue that the challenges in health care may look daunting and unsolvable in their scale and complexity, but that it helps to consider these problems in their specificity, while accepting that some problems may not be solved but have become chronic. The paper provides reflections on how to develop a scientific approach that does not (...) aim to eradicate bad things but explores ways in which to live with them. Crucial in this quest is the attention to how we conceptualize problems, and whether this is specific enough for addressing present day concerns. I propose an anthropology of everyday ethics as a way to study people’s everyday ways of handling a variety of goods in practice. I draw specific attention to exploring aesthetic values in everyday life amongst these, values that are used abundantly to qualify events in everyday life but rarely theorized in philosophy or social science. The “ ethics of belief” refers to a cluster of questions at the intersection of epistemology, philosophy of mind, psychology, and ethics. The central question in the debate is whether there are norms of some sort governing our habits of belief formation, belief maintenance, and belief relinquishment. Is it ever or always morally wrong to hold a belief on insufficient evidence? Is it ever or always morally right to believe on the basis of sufficient evidence, or to withhold (...) belief in the perceived absence of it? Is it ever or always obligatory to seek out all available epistemic evidence for a belief? Are there some ways of obtaining evidence that are themselves immoral or imprudent? -/-. (shrink)

How should we move from environmental ethics—discussing reasons for action—to environmental action: doing and being engaged? Since the way a problem is defined constitutes the way it is solved, it is important to see whether we define the problem as one of environmental awareness—how people think about human-nature relationships—or as one of political consciousness: holding a belief that environmental matters constitute a political issue that should be treated not merely as a technological case but rather as a political one. (...) Both options are possible, yet imply different modes of action. The former option implies radical changes in education, and the latter implies radical changes in our political institutions. Since radical changes need political legitimacy, many activists assume that democracy is an obstacle. It is argued that this is empirically false and confuses the problem with the solution. (shrink)

In this article, I will present a construction of a Nishitanian ethics of sympathy primarily based on passages from Nishitani Keiji’s principal work of his middle period Religion and Nothingness (Shūkyō to ha nani『宗教とは何か』). To establish the normativity of Nishitani’s concept of sympathy I will present his concept of force (chikara 力) as its basis. I will argue that the role of force has been hereto overlooked in the analysis of Nishitani’s concept of circuminsessional relations which has impaired the (...) task of constructing an ethical theory from his thought. I will primarily engage with Brett Davis’s work on circuminsessional relations to demonstrate this point, as I believe he has provided the most robust account of it thus far. After establishing this construction, I aim to elucidate the relative advantages of Nishitanian ethics of sympathy and address potential critiques. First, I will position Nishitanian ethics of sympathy as responding to Nietzsche’s critique of Schopenhauer’s morality of compassion. Nietzsche's critique is strong and that responding to him on Nishitanian grounds will be useful in demonstrating the advantages of my construction. Next, I will respond to a critique given in Peter-Hans Liederbach’s ‘Between the Ontological and the Ontic’ that accuses Nishitani’s philosophy of being unable to offer a basis for ethics. Lastly, I wish to position Nishitanian ethics of sympathy as a starting point for expanding the tradition of sympathy-based morality in East Asian philosophy. I will do this by relating Nishitani’s concept of sympathy to Justin Tiwald’s work on sympathy in Confucianism. (shrink)

Background Increasing social pluralism adds to the already existing variety of heterogeneous moral perspectives on good care, health, and quality of life. Pluralism in social identities is also connected to health and care disparities for minoritized patient (i.e. care receiver) populations, and to specific diversity-related moral challenges of healthcare professionals and organizations that aim to deliver diversity-responsive care in an inclusive work environment. Clinical ethics support (CES) services and instruments may help with adequately responding to these diversity-related moral challenges. (...) However, although various CES instruments exist to support healthcare professionals with dealing well with morally challenging situations in healthcare, current tools do not address challenges specifically related to moral pluralism and intersectional aspects of diversity and social justice issues. This article describes the content and developmental process of a novel CES instrument called the Diversity Compass. This instrument was designed with and for healthcare professionals to dialogically address and reflect on moral challenges related to intersectional aspects of diversity and social justice issues that they experience in daily practice. Methods We used a participatory development design to develop the Diversity Compass at a large long-term care organization in a major city in the Netherlands. Over a period of thirteen months, we conducted seven focus groups with healthcare professionals and peer-experts, carried out five expert interviews, and facilitated four meetings with a community of practice consisting of various healthcare professionals who developed and tested preliminary versions of the instrument throughout three cycles of iterative co-creation. Results The Diversity Compass is a practical, dialogical CES instrument that is designed as a small booklet and includes an eight-step deliberation method, as well as a guideline with seven recommendations to support professionals with engaging in dialogue when they are confronted with diversity-related moral challenges. The seven recommendations are key components in working toward creating an inclusive and safe space for dialogue to occur. Conclusions The Diversity Compass seeks to support healthcare professionals and organizations in their efforts to facilitate awareness, moral learning and joint reflection on moral challenges related to diversity and social justice issues. It is the first dialogical CES instrument that specifically acknowledges the role of social location in shaping moral perspectives or experiences with systemic injustices. However, to make healthcare more just, an instrument like the Diversity Compass is not enough on its own. In addition to the Diversity Compass, a systemic and structural approach to social justice issues in healthcare organizations is needed in order to foster a more inclusive, safe and diversity-responsive care and work environment in health care organizations. Clinical bioethics plays a significant role in hospital settings through bioethics consultations, which focus on providing ongoing assistance in complex situations within the doctor-patient dynamic. These consultations entail regular interaction between physicians and clinical bioethicists. This situation prompts an exploration into how bioethics consultations affect physicians. The current research aims to understand the influence of bioethics consultations on physicians’ bioethical knowledge by analyzing the lexical content in their patients’ medical records. Medical records are a synthesis carried out by physicians, often (...) reflecting collaborative efforts, and capturing verbal statements indicative of thought processes suggestive of learning. The study is a sequential mixed-methods design with a retrospective descriptive approach, comparing medical records from the early years of the Department of Humanism and Bioethics’ operation (2013–2015) to the more recent ones (2019). Technical bioethical terminology such as “therapeutic effort limitation,” “futility,” “beneficence,” and “respect for autonomy” is more prevalent in recent medical records. This trend may stem from the positive impact of bioethics consultations conducted by the Department, with haptic communication serving as a particularly effective form of interaction with others during experiences of moral distress. This appears to be characteristic of cultures like those in Latin America. (shrink)

In this amazingly prophetic work, done late in his career, Herbert Spencer offers an approach to ethics that anticipates developments throughout the twentieth century. He moves away from the twin evils of ethical doctrines bequeathed to us by an ancient past that are simply no longer feasible but also avoids modern standards of ethical conduct that are simply impossible to attain. "By association with rules that cannot be obeyed," Spencer writes, "rules that can be obeyed lose their authority." The (...) volume opens with three chapters on conduct: its evolution, good and bad, and ways of judgment. This is followed by a series of chapters that examine ethics from a variety of scientific perspectives: physics, biology, psychology, and sociology. The work then moves on to specific issues of deep human concern: the relativity of pleasures and pain, egoism versus altruism in explaining actions, and trial and compromise in decision-making about ethical concerns. Spencer's work anticipates the movement toward pragmatic, naturalistic, and even positivist approaches to ethics. He emphasizes that a relativist approach while in keeping with the spirit of the industrial age, also poses a variety of problems that admit only of empirical solutions. He understands that his critical stance on absolutism should not blind researchers to the ideals assumed by the ancients that assist people in their everyday living. In short, this is a remarkable work, entirely modern, and yet containing a sharp evaluation of how ethical data serve to enhance ethical conduct. (shrink)

Evidence shows that during birth women frequently experience unconsented care, coercion, and a loss of autonomy. For many countries, this contradicts both the law and medical ethics guidelines, which emphasize that competent and fully informed women’s autonomy must always be respected. To better understand this discordance, we empirically describe perinatal maternity care providers’ and women’s moral deliberation surrounding coercive measures during birth. Data were obtained from 1-on-1 interviews with providers (N = 15) and women (N = 14), and a (...) survey of women (N = 118). Analyses focused on an in-depth exploration of responses to a question on the permissibility of coercion in birth whose wording was borrowed from a Swiss medical-ethical guideline. Reasons for and against a principle permissibility of coercive measures in birth were grouped into clusters of reasons to build a coherent explanatory framework. Factors considered morally relevant when deliberating on coercion included women’s decisional capacity, beneficence/non-maleficence, authority through knowledge on the part of providers, flaws of the medical system, or the imperative to protect the most vulnerable. Also, we identified various misconceptions, such as the conviction that a pathological birth can justify coercion or that fetal rights can justifiably infringe on women’s autonomy. Information and education on the issue of coercion in birth are urgently needed to enable women to fully exercise their reproductive autonomy, to prevent long-term adverse health outcomes of women and children, and to reconcile the medical vigilance which has lead to a reduction of perinatal morbidity and mortality with women’s enfranchisement in their own care. Contemporary society operates beyond safe boundaries of the Earth system. Returning to a safe operating space for humanity within Earth system boundaries is a question of justice. The relevance of the economy—and thus of business—for bringing society back to a safe and just operating space highlights the importance of business ethics research for understanding the role of business in Earth system justice. In this commentary, we explore the relevance of business ethics research for understanding the crucial role of (...) business in the dynamics of the Earth system. We do so by integrating the perspectives of business ethics and system-oriented sustainability science on the basis of the theory of metabolic rift, which explains how the dynamics of capitalism result in the destruction of the natural environment. On this basis, we argue that a mutually reinforcing relationship between perpetual economic growth and profit seeking behaviour of business, which we call the _loop of unsustainability_, continually deepens the metabolic rift and keeps business from effectively contributing to Earth system justice. This perspective allows us to formulate firm-level and system-level preconditions for attaining Earth system justice, and to sketch a research agenda that links business ethics scholarship with questions of Earth system justice.
