Conflicts between legal norms are common in reality. In many legislations, legal conflicts between norms are resolved by applying ordered principles. This work presents a formalization of the conflict resolution mechanism and introduces action legal logic (⁠ALL) to reason about the normative consequences of possibly conflicting legal systems. The semantics of ALL is explicitly based on legal systems consisting of norms and ordered principles. Legal systems specify the legal status of transitions in transition systems and the language of ALL describes (...) the legal status of paths in transition systems. Despite the rising interest in environmental strategies, few studies have examined how managerial cognition of such strategies influences actual innovation capability development. Taking a managerial cognition perspective, this study investigates how managers’ perceptions of institutional pressures relate to their focus on proactive environmental strategy, which in turn affects firms’ realized innovation capability. The findings from a primary survey and three secondary datasets of publicly listed companies in China reveal that managers’ perceived business and social pressures are positively associated with their (...) focus on proactive environmental strategy, which consequently fosters innovation capability development. Moreover, state ownership and government administrative control weaken the impact of managerial focus on proactive environmental strategy on innovation capability. These findings have important implications for how managerial cognition supports environmental strategy and organizational capability building under the influence of institutional pressures and government intervention. The literature on the interplay between geographic communities and organizations has largely ignored the role of individual residents. In adopting a meso-perspective, we examine a potentially vital relationship between corporate conduct and pro-social behavior demanding sacrifice from individuals. Drawing on Weber ), we theorize that organizations in a community legitimize personal social conduct in three ways—by serving as role models, imparting norms and values, and routinizing forms of interaction. We study the relationship between corporate social responsibility behavior by local firms (...) and the social distancing of citizens in US counties during the Covid-19 pandemic, a core ethical outcome. We argue and find that the residents of communities in which firms exhibit higher levels of CSR engaged in more SD during the Covid-19 pandemic. This was true when firms were long-established, isomorphic in their CSR, and major employers and vendors. Moreover, CSR relating to the treatment of employees as well as positive and negative extremes in CSR bore especially strong relationships with SD. Implications are drawn for the study of business ethics, as modeled by CSR, as a force for ethical personal behavior and public health in communities. (shrink)

Rational constructivism is one of the leading theories in developmental psychology. But it is not a purely psychological theory: rational constructivism also makes a number of substantial epistemological claims about both the nature of human rationality and several normative principles that fall squarely into the ambit of epistemology. The aim of this paper is to clarify and defend both theses and several other epistemological claims, as they represent the essential epistemological dimensions of rational constructivism.

The Green Revolution is often seen as epitomising the dawn of scientific and technological advancement and modernity in the agricultural sector across developing countries, a process that unfolded from the 1940s through to the 1980s. Despite the time that has elapsed, this episode of the past continues to resonate today, and still shapes the institutions and practices of agricultural science and technology. In Brazil, China, and India, narratives of science-led agricultural transformations portray that period in glorifying terms—entailing pressing national imperatives, (...) unprecedented achievements, and heroic individuals or organizations. These “epic narratives” draw on the past to produce meaning and empower the actors that deploy them. Epic narratives are reproduced over time and perpetuate a conviction about the heroic power of science and technology in agricultural development. By crafting history and cultivating a sense of scientific nationalism, exceptionalism, and heritage, these epic narratives sustain power-knowledge relations in agricultural science and technology, which are underpinned by a hegemonic modernization paradigm. Unravelling the processes of assemblage and reproduction of epic narratives helps us make sense of how science and technology actors draw on their subjective representations of the past to assert their position in the field at present. This includes making claims about their credentials to envision and deliver sustainable solutions for agriculture into the future. (shrink)

In the current study, late Chinese–English bilinguals performed a facial expression identification task with emotion words in the task-irrelevant dimension, in either their first language or second language. The investigation examined the automatic access of the emotional content in words appearing in more than one language. Significant congruency effects were present for both L1 and L2 emotion word processing. Furthermore, the magnitude of emotional face-word Stroop effect in the L1 task was greater as compared to the L2 task, indicating that (...) in L1 participants could access the emotional information in words in a more reliable manner. In summary, these findings provide more support for the automatic access of emotional information in words in the bilinguals’ two languages as well as attenuated emotionality of L2 processing. The problem of adaptive finite-time fault-tolerant control and output constraints for a class of uncertain nonlinear half-vehicle active suspension systems are investigated in this work. Markovian variables are used to denote in terms of different random actuators failures. In adaptive backstepping design procedure, barrier Lyapunov functions are adopted to constrain vertical motion and pitch motion to suppress the vibrations. Unknown functions and coefficients are approximated by the neural network. Assisted by the stochastic practical finite-time theory and FTC theory, the proposed (...) controller can ensure systems achieve stability in a finite time. Meanwhile, displacement and pitch angle in systems would not violate their maximum values, which imply both ride comfort and safety have been enhanced. In addition, all the signals in the closed-loop systems can be guaranteed to be semiglobal finite-time stable in probability. The simulation results illustrate the validity of the established scheme. Unlike previous studies which generally seem to focus more on Hausa metaphorical expressions, this study investigates a wide range of uses ofίdὸ‘eye’ in its constructional metonymy patterns in the language by exploring corpus data that contain over 300 eye-related expressions. We observe that some constructional metonymies maintain a set of fixed words and syntax in activating conceptual shifts and producing eye metonymies while others have semi-fixed patterns and produce the same metonymies. Lexical items liketsόkάlế,kὰn,ὰ,dὰ, andbὰsίrὰamong others are constant constituents in (...) the constructional metonymies in which they appear. In the metonymic chaining, the basic mapping of eye metonymies occurs via thepart for partrelation under E-metonymies and thesub- for supercategoryrelation under C-metonymies. We also observe that E→E→C coding has the highest chained metonymic structure in the creation of the eye metonymies. Both attributive and predicative colligates motivate metonymic senses in the language. Finally, our analysis reveals that the eye is metonymically conceptualized and semantically extended to various target domains and produces metonymic conceptualizations that make the eye stand for vision, desire, envy, control, attention, perception, person, meeting, brain, intelligence, and so on. The present research explored how foreign language listening anxiety affected Chinese university students' English listening test performance and how proficiency and gender mediated the effects of FLLA on the latter. Two different populations from two universities in China answered the 20-item Foreign Language Listening Anxiety Scale as well as a demographic questionnaire and took an English listening test. Analyses of the collected data revealed the following major findings: Five latent factors underlay the FLLAS, when working alone, FLLA significantly negatively predicted (...) students' English listening test performance, and when working with proficiency and gender, English proficiency level, gender and FLLAS2 significantly predicted students' English listening test performance. These findings confirm the negative effects of FLLA on students' English listening test performance. They also indicate that English proficiency and gender mediate FLLA's effects on the latter, with English proficiency not only directly but also indirectly affecting the latter. (shrink)

In order to provide a unified framework for studying non-commutative algebraic logic, Rump and Yang used three axioms to define quantum B-algebras, which can be seen as implicational subreducts of quantales. Based on the work of Rump and Yang, in this paper we shall continue to investigate the properties of three axioms in quantum B-algebras. First, using two axioms we introduce the concept of generalized quantum B-algebras and prove that the opposite of the category GqBAlg of generalized quantum B-algebras is (...) equivalent to the category LogPQ of logical pre-quantales, but we can not prove that pre-quantales can be used as the injective objects in GqBAlg. Next, we use one axiom to propose the concept of C-algebras and show that a C-algebra is a group if and only if each of its elements is dualizing. Further, by dualizing elements of a C-algebra X, we can define different binary operations on X such that X is a moniod. Finally, we by the Zig–Zag relation discuss some properties of quantum B-algebras. (shrink)

Different nations responded to the global spread of COVID-19 differently. How do people view the governance practices and effects of various countries? What factors affect their views? Starting from the three-dimensional model of cognitive-affective-media, this study examines how pandemic perception, the national feeling, which is the emotional preference of public for different countries, and media use affect the Chinese public views on the performance of other countries in controlling COVID-19. After performing regression analysis on the data of 619 Chinese public (...) samples collected by an online survey, it reveals the following: pandemic perception is negatively correlated with the evaluation of controlling-pandemic performance in different countries by Chinese residents, whereas national feeling is positively correlated with the evaluation of controlling-pandemic performance. The use of media has different characteristics in the evaluation of controlling-pandemic performance in different countries by Chinese residents. Television has a significant influence on the evaluation of controlling-pandemic performance in the United States, China, and Germany by Chinese residents. Collectivist cultural orientation has no significant impact on the evaluation of the anti-pandemic performance of different countries by Chinese residents, whereas virus perception only has a significant impact on the evaluation of the controlling-pandemic performance of the United States and Italy. Research has confirmed the existence of the cognitive-affective-media model in the evaluations by public on the governance of other countries, and prospects for the superimposed role of media in the cognitive-affective model. Third-party fairness maintenance could win some reputational benefits, and it includes two methods: punishment and compensation. We predicted that the third parties' preference between punishment and compensation are affected by whether they are free to choose between the two methods, and the affection could be interpreted through reputational benefits. The present study includes two sections. In Study 1, the participants acted as fourth parties who were asked to rate the reputations of the third parties who had chosen different response methods (...) to an unfair result of the dictator game. The results showed that there was no reputational difference between the two methods when third parties were not free to choose, but the reputation of compensation was better when third parties were free to choose. In Study 2, the participants acted as third parties. The participants were asked to choose a method to respond to an unfair result of the dictator game. There were two reputational contexts: secret and open. The results showed that when third parties were not free to choose, they had no preference between the two methods under the two reputational contexts, but when third parties were free to choose freely, they prefer punishment under the secret context but prefer compensation under the open context. This study systematically reveals a reputational interaction between fourth and third parties, and verifies the affection of reputational benefits on the third parties' preference between punishment and compensation. The marketization of interest rate is an inevitable requirement for China’s financial reform and joining the WTO to connect with the international financial market. It is also an important link to improve the marketization degree of China’s financial system. The marketization of interest rate in China is gradually advancing according to its preset mode. In the process of interest rate marketization, an unavoidable problem is that while the interest rate marketization gives the commercial banks the autonomy of capital pricing, the (...) fluctuation of interest rate is more and more frequent. However, due to the fluctuation of interest rate, the loan as the main assets of commercial banks will be prepayed by borrowers, and the time deposit as the main liabilities of commercial banks will be withdrawn by depositors in advance; that is, embedded options are implied in asset liability items, which makes it difficult for commercial banks to accurately calculate the actual interest margin of deposits and loans and manage the interest rate risk. Therefore, it is of great significance to identify and price such embedded option value. On the basis of identifying and decomposing the embedded options in deposit and loan of commercial banks, according to the change characteristics of deposit and loan interest rate of Chinese commercial banks, this paper chooses jump-diffusion interest rate model to describe the change of benchmark interest rate of deposit and loan in China and demonstrates the advantages of this model compared with other models. Based on Monte Carlo simulation technology, the embedded options of five-year fixed deposit and ten-year prepayable loan in China are priced. On this basis, it points out that the real interest margin of commercial bank’s deposit and loan should be the nominal interest margin minus the value of deposit and loan’s embedded options. In the process of interest rate risk management, we should pay attention to the existence of embedded options and carry out effective management. (shrink)

In 2011, Jiangsu Province set up the guidance fund for sports industry. In 2016, Jiangsu Provincial Finance Department jointly issued the document with Jiangsu Provincial Sports Bureau, which was changed to “Jiangsu Special Fund for Sports Industry Development.” By 2019, Jiangsu Province has funded 1,009 sports industry development projects with a total investment of 796.6 million yuan. The effect of the investment has attracted extensive attention from the government, society, and enterprises. Entrusted by Jiangsu Sports Industry Guidance Center, this research (...) team spent one year on the performance research of 1,009 projects supported by special funds for the development of sports industry, from the construction of evaluation index system to the design, issuance, collection, and processing of questionnaires. Using the methods of literature, questionnaire, expert interview, and mathematical statistics, this paper takes the performance management of the special funds for the development of sports industry in Jiangsu Province as the research object, based on the investigation and analysis of the current situation of the special funds for the development of sports industry in Jiangsu Province. It analyzes the special funds from four aspects: the rate of funds in place, the ratio of funds pulled, the completion rate of project implementation, and the rate of fund prerecovery. Then, this paper expounds the current situation, effectiveness, and problems of the performance management of the special funds for the development of sports industry and puts forward some countermeasures and suggestions for improvement. In this paper, we consider a pseudo-parabolic equation, which was studied extensively in recent years. We generalize and extend the existing results in the following three aspects. First, we consider the vacuum isolating phenomenon with the initial energy \\) satisfying \\le 0\) and \ (...) asymptotic behaviors of the solutions and the energy functional. Generally speaking, we establish the exponential decay of the solutions and energy functional when the solutions exist globally, and the concrete decay rate is given. As for the blow-up solutions, we prove that the solutions grow exponentially and obtain the behavior of energy functional as the time t tends to the maximal existence time. Previous research has demonstrated that regular exercise modulates motor cortical plasticity and cognitive function, but the influence of short-term high-intensity interval training remains unclear. In the present study, the effect of short-term HIIT on neuroplasticity and executive function was assessed in 32 sedentary females. Half of the participants undertook 2 weeks of HIIT. Paired-pulse transcranial magnetic stimulation was used to measure motor cortical plasticity via short intracortical inhibition and intracortical facilitation. We further adapted the Stroop task using functional near-infrared spectroscopy (...) to evaluate executive function in the participants. The results indicated that, compared with the control group, the HIIT group exhibited decreased ICF. In the Stroop task, the HIIT group displayed greater activation in the left dorsolateral prefrontal cortex and left orbitofrontal cortex even though no significant difference in task performance was observed. These findings indicate that short-term HIIT may modulate motor cortical plasticity and executive function at the neural level. (shrink)

Firstly, data on existing higher education theories and innovation theories are analyzed. Secondly, two companies in the sample data are selected for detailed analysis. Finally, research conclusion and corresponding talent management strategies are presented. The results show that the cumulative contribution value of employees is 87.496%. The cumulative contribution value of human capital is 70.322%. The (...) contribution value of cumulative innovation performance is 61.658%. The cumulative contribution value of R&D investment is 45.306%. The coefficient for the overall sample size is 0.509. The employee quality coefficient is 0.452. The correlation coefficient for educational attainment is 0.598. The high-tech service industry has the highest correlation coefficient at 0.504. The auto industry has the highest coefficient at 0.669. The experimental research has drawn the following conclusion: Talents positively affect enterprise innovation performance; Research and Development investment has a positive correlation with enterprise innovation performance; R&D investment has a positive correlation with talents. Through experimental research, the education level of employees is measured by academic qualifications, but the essence of academic qualification measurement is the level of knowledge and skills that employees have. In summary, the study can extend the strategic analysis of the cultivation of innovative talents and play a valuable auxiliary role in cultivating innovative talents. (shrink)

The article considers the theory of cognition of the Russian and Soviet philosopher Vasily Seseman in its relation to the main philosophical orientations in early 20th-century: phenomenology, neokantianism, and intuitionism. Seseman’s theory of cognition is interesting today because, following the tradition of neo-Kantianism, it largely shares the principles and methods of phenomenology, poses epistemological problems that were not explicitly formulated by Edmund Husserl, and offers solutions that are relevant today. The article highlights a common thematic field combining phenomenology, neo-Kantianism, and (...) intuitionism. This field is set by the initial subject-object cognitive attitude, the desire to identify the conditions for the possibility of cognition, the recognition of the presence of a non-linguistic level of knowledge. Moving in this unified theoretical cognitive context of the early twentieth century, Seseman offers his own solution to the following problems: defining the subject of cognition, developing the method of intuition in general and in relation to the contemplation of essence, distinguishing between objective and non-objective attitudes and using this distinction to describe different types of cognition, thematizing the irrational in cognition, and understanding the judgment and its role in the final formation of cognition. Seseman believes that the cognition of reality is preceded by the perception of its objects. He diverges from the Neo-Kantians, who claim that the objects of cognition are formed only in judgment, and holds a position than Husserl, according to whom we perceive the world around us already objectively. However, unlike Husserl, Seseman does not recognize the cognitive nature of perception and argues that knowledge begins with a reflexive fixation of the object of cognition. The cognition of an individual object is embodied in a judgment in which the relation of the object to its environment is fixed and the object is defined as a unique combination of universal properties. Finally, it is shown that the solution of epistemological questions inevitably leads Seseman to ontological issues. (shrink)

The article analyses reflection as a methodology of Husserl's phenomenology. Husserl used reflection as a method in his research, but did not always specifically consider it when describing his own methodology. He paid much more attention to essential intuition, epoché (reduction) and intentional analysis. The author develops the thesis that reflection is inextricably linked with these methods and requires special study. The article discusses the specifics of reflexive analysis used in Husserl's phenomenology to study consciousness and solve problems of cognition (...) of the external world. The author takes into account its goals and objectives, which determine the terminological apparatus for fixing its results and are based on a certain understanding of the experience of consciousness. The article discusses the definition of reflection as an activity and examines the main factors that determine the kinds of reflection. According to the author of the article, reflection as an activity can be defined by the following formula: the direction of attention to EXPERIENCE for the “detection” of its FORMS and their fixation by means of certain SEMIOTIC TOOLS carried out for the sake of achieving some PURPOSE. In this formulation, the terms “experience”, “form”, “semiotic tools”, “purpose” are understood (...) as parameters, the specification of which sets the description of certain kinds of reflection. In addition, the structure of “detection” participates in the formation of reflection, which consists of the languages of description, conceptual and terminological apparatus, knowledge and other conceptual means of the reflecting subject. Variants for specifying the parameters of the definition are considered in the article on the material of various philosophical techniques (mainly domestic tradition) and a number of general cultural reflexive practices. The author correlates his understanding of reflection with a number of ideas of the Moscow Methodological Circle (MMC), in which reflection techniques were given great importance. In particular, the author schematizes his understanding as a special case of an “act of activity”, the idea of which is the development within the MMC of some of K. Marx’s ideas. In connection with the clarification of the temporal structure of reflection (which is not grasped by schematization of reflection as an act of activity), the author introduces the idea of an elementary cycle of reflection and fixes it in the form of a scheme. In conclusion, the author examines the question of the correlation of reflection and thinking and considers the possibilities of correlating his definition of reflection with the typology of reflection set by the scheme of the thinking-communication-activity-system (proposed in MMC in 1983). The micro-level corporate social responsibility (CSR) literature has underscored the economic benefits of an organization's CSR investments, such as bolstering employees' organizational commitment and improving work performance. Yet, research on the potential influence of CSR in fostering socially oriented outcomes among employees has been rather scarce. This study aims to investigate the influence of CSR on employees' internal whistleblowing behaviors and the underlying mechanisms. A three-time-point survey was distributed across the service, manufacturing, construction, and financial insurance industries in Chinese enterprises. (...) The findings reveal that both internal and external CSR positively impact employees' internal whistleblowing behaviors through the mediating role of moral courage, with internal CSR demonstrating a stronger effect. Organizational loyalty positively moderates the mediating role of moral courage in the relationship between internal CSR/external CSR and internal whistleblowing behaviors. Theoretically, this study presents a pioneering endeavor in establishing the link between CSR and employees' internal whistleblowing behaviors, underscoring the significant role that employees' perceptions of CSR play in enhancing societal well-being and ethical governance. Besides contributing to the micro-level CSR literature, this study also provides practical insights for organizations seeking to leverage CSR as a tool for promoting employees' ethical conduct. The article discusses the features of Kant's project of descriptive metaphysics and its development in Husserl's transcendental phenomenology. Kant's project of descriptive metaphysics can be seen in three senses: as a transcendental philosophy in General, which deals with the study of cognition, as a metaphysics of experience, aimed at studying the first principles of world experience, and as revealing the structure of our thinking about the world. All these variants of descriptive metaphysics were developed in Husserl's transcendental phenomenology. The author (...) pays special attention to the analysis of the phenomenological doctrine of consciousness, since in Husserl's approach one can see the development of the project of descriptive metaphysics in all three senses Husserl understands consciousness as cognizing consciousness, that is, as cognition; the phenomenological understanding of consciousness also includes a mode of thinking about the world; consciousness is considered by Husserl as a real everyday experience. The article examines the theory of knowledge of the Russian philosopher of the XXth century V. E. Sesemann and his understanding of reality. The author emphasizes that in the field of epistemology, Sesemann, being influenced by E. Husserlʼs phenomenology, first of all, answers the question of the possibility of cognition of the reality of the surrounding world and the special role of perception in this process. However, unlike Husserl, Sesemann is convinced that true knowledge is achievable not only in relation (...) to the things of the world, but also in relation to their relationships and interrelations, which are seen in a special kind of intuition – a conceptual intuition. Seseman believes that the cognition of the surrounding world depends not only on the cognizing subject, but also on the objectivity itself, which may not always be accessible to cognition. The article pays close attention to Sesemannʼs understanding of reality as the reality of becoming, one of the types of which is movement. In this case, Sesemann argues, it is impossible to create a unified picture of the world, and our knowledge can only be probabilistic. The author examines the epistemological and ontological views of Seseman in the context of his time, comparing them with the main trends of philosophy of the XXth century, primarily with phenomenology and neo-Kantianism. The article discusses the work of Boris Valentinovich Yakovenko, one of the most prominent representatives of Russian neo-Kantianism. The philosophy of Yakovenko is analyzed in the context of the German and Russian philosophical traditions of the early twentieth century - phenomenology and neo-Kantianism. Being a supporter of neo-Kantianism, Yakovenko devoted most of his research to questions of cognition. The article examines the foundations of criticism, directed by Yakovenko against modern gnosiological approaches. The unacceptability of these approaches consists in mixing different (...) types of being by Yakovenko. Yakovenko believes that Husserl's phenomenology focuses on the study of the process of psychological cognition, and it is impossible based on subjectivity to achieve objective knowledge. Cohen, in the opinion of Yakovenko, denying the possibility of a pure givenness of sensations, relativizes the very idea of existence, implying only science under it. Yakovenko calls his own ontological attitude transcendental pluralism. Transcendental pluralism recognizes the self-sufficiency and independence of each kind of Being, between which there is no connection. The cognition of this plurality of identities must be non-presumability and absolute and is possible, according to Yakovenko, in a special kind of intuition. This intuition Yakovenko called mystical, however, does not give its detailed description and justification. Nevertheless, an appeal to his philosophy allows us to actualize theoretical-cognitive problems that are of interest to us today: the problem of subjectivity and objectivity, the problem of non-presumability of knowledge, “pure givenness”, transcendence and immanence, the ratio of various types of intuitions in cognition, etc. (shrink)
