International migration of work force is presently a high amplitude phenomenon. Romanian people have emigrated for work around the world, being engaged both in the physically hardest jobs and in activities that require completion of specialized courses and certification in a particular field. This last category includes social workers who, following schooling and certification and even having a minimal experience in the home country, apply for jobs in the field of social assistance. These recruiters aim to distribute social (...) workers at the workplace of interest, according to certain well-defined criteria. In the present paper we describe international migration of work force, and we illustrate it by adding case studies of life experience of social workers who underwent the process of emigration to the United Kingdom. Throughout the emigration process, these workers experienced certain changes in their life principles, mentality, values, and were marked by professional dilemmas in extreme situations. (shrink)

The European emigration on the other side of the Atlantic was a complex phenomenon. The areas inhabited by Romanians got acquainted to this phenomenon towards the end of the nineteenth century and the beginning of the twentieth. Therefore, starting with the year 1895, a certain mixture of causes led to a massive migration to America, especially of the Romanians from the rural areas. The purpose of our study is to explore the causes of the Romanian emigration across the (...) ocean up to the First World War to present the Romanian emigrants' features (occupation, age, gender, social status, religious affiliation, the way they were distributed across the North-American territory) and to bring forth essential aspects of the way they embraced the assimilation process. From a methodological standpoint our analyses are based upon official data of the US Census. This data is being interpreted in the light of some reference papers referring to the period that makes the object of our study. A certain amount of information presented here relies on our research activity in the Metropolitan Archives of Sibiu, where the ecclesiastic correspondence of that time provides very interesting data.  . From a problem that concerned only a small number of people, migration has become a constant concern both nationally and internationally. The concrete realities in different regions have become over time subjects of analysis and reflection in order to find solutions that meet the many theoretical and practical issues raised by migration. In Romania people are increasingly discussing about migration and its implications on all sectors of human life. In this context, the Romanian Orthodox Church is (...) called by his priests, to contribute to the integration of people of other nationalities, cultures and beliefs that are established here and at the same time, to help her spiritual children living and working in different parts of the world to preserve and to confess their Orthodox Christian faith. Following the violent protests in the Republic of Moldova against the Communist Party – governing since 2001 – that took place in April 2009, after the release of the parliamentary elections results, the Romanian Government has adopted the measure of simplifying the fundamental and formal conditions for regaining Romanian citizenship through Government Emergency Ordinance (GEO) No. 36/2009 for modifying and completing Law on Citizenship No. 21/1991. This measure is focusing particularly on the citizens of the Republic of Moldova (...) who wish to be granted Romanian citizenship. By presenting the changes brought by GEO No. 36/2009, by comparing them to the other changes made to Law No. 21/1991 in 2007 and 2008, this article tries to answer the question of how the system of granting and regaining Romanian citizenship should be regulated, taking into account the Romanian accession to the European Union and the necessity to discard the consequences of the Ribbentrop – Molotov Pact, which was officially condemned by the Romanian Parliament in 1991. The de lege ferenda proposals made in this article have the purpose to make the system of acquiring Romanian citizenship more transparent and easier to explain to the entitled persons and to the European Union institutions monitoring the legal and illegal migration. Although migration and religion have traditionally developed as two separate research topics, in the current context of globalization and trans-nationalism attention begins to focus on the way they interconnect. Religion received little attention in Romanian studies on migration undertaken so far. Using the results of our survey among Romanian international migrants of different religious faiths, this paper aims to raise interest in migration-religion relationship and, at the same time, to improve the understanding of the economic (...) performance factors in a migration context by focusing on the distinctive characteristics of Romanian religious minorities. We address both the theoretical and the empirical dimension of this topic, making use of various statistical methods. Our main findings are consistent with the assumption that religious belief is reflecting upon the behavior and economic performance of Romanian migrants. (shrink)

Migrant women are often stereotyped. Some scholars associate the feminization of migration with domestic work and criticize the “care drain” as a new form of imperialism that the First World imposes on the Third World. However, migrant women employed as domestic workers in Northern America and Europe represent only 2% of migrant women worldwide and cannot be seen as characterizing the “feminization of migration”. Why are migrant domestic workers overestimated? This paper explores two possible sources of bias. The (...) first is sampling: conclusions about “care drain” are often generalized from small samples of domestic workers. The second stems from the affect heuristic: imagining children left behind by migrant mothers provokes strong feelings of injustice which trump other considerations. The paper argues that neither source of bias is unavoidable and finds evidence of gender stereotypes in the “care drain” construal. (shrink)

Migration is one of the social processes that have influenced and are still deeply influencing current Romanian society, given that millions of Romanian citizens have relatives who had longer or shorter migration projects. Migration leads to socio-economic and cultural changes, which cause temporary or permanent changes in the human reality, the way of life and the personality of those who leave, but also of those who remain at home. Certainly, migration affects, first of all, (...) the family, changing both its structure and functionality. The temporarily disintegrated family has become one of the forms towards which the evolution of the family is moving, raising a multitude of problems aimed at a new lifestyle and interaction, new demands in the line of adjustment and accommodation both within and outside the family. The phenomenon of emigration in order to find a workplace affects both the family, as a social nucleus, and the individual as part of the family structure. Migration has a major impact on the relationship between spouses, on the parent-child relationship, on parental behavior, on destiny, in general. Although the family remains central to the existence of individuals in a transnational situation, its cohesion is not self-evident; it becomes a problem of community integration. Following the way in which the perspective on the family has changed in the context of migration, the study aims to identify and analyze the most important transnational practices through which family cohesion was maintained in the case of Romanian migration. To better understand this process of maintaining transnational family cohesion, we use an analytical model in four dimensions (social, positional, cultural and identity). (shrink)

Migration generates well-being for individuals and communities, but the pursuit of well-being is not without risks. Tens of thousands of Romanian children are affected by the migration of their parents, others have to cope with the effects of their own migration. Should migrants have difficulties adjusting when returning “home”? Is readjustment even possible for all remigrants, without support? The article aims to present some issues that the remigrants are confronted with when trying to readjust to their (...) communities of origin. The article shows how readjustment is influenced by the social image, which in turn influences the social support for their adjustment and subsequent development. (shrink)

The current phenomenon of migration is a consequence of contemporary globalization, having a major impact on interreligious dialogue. In the beginning of our article, we give a short introduction regarding the most major migrations in the Christian history. We can say today there is no nation on earth that has not experienced migration. Within the Orthodox world, we speak about migration using the word diaspora, those who are outside the national territory of the Church. In connection with (...) the phenomenon of migration and the attitude that Orthodox Christians must have in this regard, the Holy and Great Synod of Crete was also expressed in 2016. In the same time, the phenomenon of migration grows in Romania from one year to the next, producing important changes regarding the economic, cultural, social and religious realities. According to our understanding, when we discuss about the religious life in Romania, one must take into account, first of all, the characteristics of this people, its culture and traditions that are over two millennia old. The similarities and differences with the organization and functioning of other religious systems in Europe and around the world cannot and must not exclude the defining elements of a people that has asserted its origins and defended its spiritual integrity over the centuries. In our (...) country there is a close connection between the history, culture, spirituality and education of this people of Latin origin and mostly of Orthodox faith. Starting from these realities, the Romanian Orthodox Church had an important role in preserving the values and national identity in the face of the frequent stepsons of history. Regarding interreligious education in Romania, it is done in public schools, with the discipline of Religion, where, especially in high school, there are classes in the History of Religions in which one learns about religious traditions around the world and how to interact with people belonging to other denominations, religions and ideologies. The phenomenon of migration increases in our country from one year to another producing important changes in terms of economic, cultural, social and religious realities. Taking into account all these realities, the state must promote policies that protect migrant populations and defend human rights for these communities. At the same time, they must be actively involved in protecting families where one or more members are working abroad and in the process of educating children who remain in the care of relatives. In Romania, the Baptist denomination includes, according to the 2002 census, about 130,000 believers, subsequent to the Pentecostal denomination. Areas having a large number of followers are Banat and some parts of Transylvania; besides these, there can be added large urban areas such as Bucharest, Timişoara, Constanţa, Cluj-Napoca, Oradea, and Arad. In terms of ethnicity, Romanians represent the majority, followed by the Hungarians (Hungarian Baptist Convention). One of the smallest minorities in Romania, that is the Czechs, also provides a number (...) of believers, in the village of Sfînta Elena (Coronini Township, Caraş-Severin County) being the only Czech Baptist community in our country. Here, besides Catholics, a Baptist community is to be found, twice as small and of fairly recent origin. In the following, we intend to outline its image, based on field observations and interviews carried out between 2005-2010 (All of these have been materialised in our book, Istorie şi memorie în comunităţile cehilor din Clisura Dunării). We paid a particular interest in the neo-Protestant group, in order to identify means of building the image of another group with a different faith, considering the double minority, ethnic and religious status. Also, we tried to capture the ratio of forces between two different faith groups that were facing the same economic and social problems, problems that have caused the depopulation of villages, by massive migration of people to the Czech Republic. The notion of a migration system is often invoked but it is rarely clearly defined or conceptualized. De Haas recently provided a powerful critique of the current literature highlighting some important flaws that recur through it. In particular, migration systems tend to be identified as fully formed entities, and there is no theorization as to how they come into being and how they break down. The internal dynamics which drive such changes are not examined. Such critiques of (...) class='Hi'>migration systems relate to wider critiques of the concept of systems in the broader social science literature, where they are often presented as black boxes in which human agency is largely excluded. The challenge is how to theorize system dynamics in which the actions of people at one time contribute to the emergence of systemic linkages at a later time. This article focuses on the genesis of migration systems and the notion of pioneer migration. It draws attention both to the role of particular individuals, the pioneers, and also the more general activity of pioneering which is undertaken by many migrants. By disentangling different aspects of agency, it is possible to develop hypotheses about how the emergence of migrations systems is related to the nature of the agency exercised by different pioneers or pioneering activities in different contexts. This article presents the development of elementary schools supported by the Orthodox Church in Transylvania between 1868 and 1921. Until 1918, Transylvania belonged to Hungary. In 1918, it was united with the Kingdom of Romania. As Hungary was a particularly complex state in ethnic and confessional terms before 1918, the school system developed under the coordination and financing of the churches. The government intended to gradually replace them with schools run by communities or state. It was not until the end (...) of the 19th century that radical measures were taken. The situation was fully resolved just after the unification of Transylvania with Romania when Romanian Orthodox denominational schools were nationalised and transformed into state schools.Contribution: Although summary works on the history of education in Romania or various research on the history of schools at the local level have appeared in Romanian, the impact of governmental and legislative decisions in Hungary on Orthodox confessional education in Transylvania has not been analysed. In German, the historian Joachim von Puttkamer has dealt with this perspective but especially concerning the schools in the Slovak areas of Greater Hungary. This PhD thesis of the author, P Brusanowski, was the first approach in this direction regarding the Romanians in Transylvania. The article presents for the first time in English a short analysis of the relationship of the Orthodox Church authorities in Transylvania to the educational policy decisions of the central authorities in Budapest. The parallel use of the reports of the Ministry of Education to the Hungarian Parliament, and the reports of the school councils of the executive body of the Romanian Orthodox Church in Transylvania to the ecclesiastical legislative forum, is an important part of this article. To discuss what was the attitude of the Romanian society towards the increasing economic, social and political role of the Jews throughout history is one of the aims of this paper. Serban Papacostea, the outstanding specialist in mediaeval history, makes use of the syntagm “hostile tolerance”, which specified the general attitude towards the Jews of the Orthodox mediaeval world of Byzantine origin. Tolerance - defined the unlimited opportunity for Jews to be accepted, settle, move and act freely within the (...) Romanian principalities, all the way to the status of possessing properties in Moldavia and Wallachia. There were, however, mixed feelings of hostility manifest at three distinct levels: mental, juridical and political. As for the mentalities, both popular and high brow education as well as prejudices held the Jews guilty for the death of Christ. Even if physically the Jewish presence in Romania has become symbolical, the history of the Jews, the traditions of the Jewish culture and spirituality, the imprint of the Jewish contribution on the emergence and development of the Romanian society will remain the perennial values of a historiography aspiring to fulfill its duty, forever preserved in the conscience of generations to come. This paper deals with the Romanian experience as a developer of projects and investor of resources in the countries of the Global South during the 1970s. It follows the country’s grand narrative in its Communist Party’s documents, as compared to that of the statements of the international meetings of the commu­nist parties in the 1960s and 1970s and to that present in the party’s newspaper Scinteia, and in contrast to documents of the political executive committee of the Romanian (...) Communist Party collected from the Romanian National Archives and the Council for the Study of the Securitate Archives. The purpose of this research is to analyse the Romanian solidarity messages in the party discourse, their degree of compliance with the solidarity messages of the rest of the countries in the socialist camp, actual actions of humanitarian assistance in the countries of the Global South, and how those actions and messages were filtered and transmitted to the Romanian readers of print press. The results indicate a discrepancy between public discourse and archival discourse on the one hand, and the nature of information disclosed to the public, on the other. (shrink)

Social scientific evidence suggests that labor migration can increase resilience to climate change. For that reason, some have recently advocated using labor migration policy as a tool for climate adaptation. This paper engages with the normative question of whether, and under what conditions, states may permissibly use labor migration policy as a tool for climate adaptation. I argue that states may use labor migration policy as a tool for climate adaptation and may even have a duty (...) to do so, subject to two moral constraints. First, states must also provide acceptable alternative options for adaptation so that the vulnerable are not forced to sacrifice their morally important interests in being able to remain where they are. Second, states may not impose restrictive terms on labor migrants to make accepting greater numbers less costly for themselves because doing so unfairly shifts the costs of adaptation onto the most vulnerable. How should we understand the political morality of migration? Are travel bans, walls, or carrier sanctions ever morally permissible in a just society? This book offers a new approach to these and related questions. It identifies a particular vision of how we might apply the notion of justice to migration policy - and an argument in favor of expanding the ethical tools we use, to include not only justice but moral notions such as mercy.

Little work has been done to explore the moral foundations of the state’s right to territory.1 In modern times, the state has mostly been assumed to be a territorial unit, and no need was perceived to reflect on precisely what justifies its territorial jurisdiction. The state’s territoriality is related to another topic that has remained under-theorized: immigration. There is, moreover, an obvious relationship between these topics: the more powerful a state’s rights over its territory, the more powerful the right to (...) constrain access to that territory might become – or so, at any rate, we might suppose. Rights to territory and rights to immigration are usefully theorized together.2 Our starting point is a Lockean analysis of the moral foundations of territoriality offered by Simmons (2001). This is a natural starting point not only because Simmons is one of the very few contemporary writers who have taken up philosophical questions about territoriality in the first place, but also because Locke’s thought, as Simmons makes clear, actually allows for the development of a sophisticated account of territoriality. It offers a historical survey of the tradition of scientific philosophy in Romania. It examines some problems in the foundations of logic, mathematics, linguistics, the natural and social sciences. Among the more specific topics, it discusses scientific explanation, models, and mechanisms, as well as memory, artifacts, and rules of research. The present study represents a preliminary theoretical attempt to analyse the socio-political influence and impact of the Romanian Orthodoxy within the Romanian public life and political culture since 1990, both through the relation between the Orthodox Church and the state, and its impact on the wider society. An open-ended reflection on a constantly unfolding reality, the approach focuses on demonstrating the profound “modernity”—not backwardness—of Orthodoxy’s implicit political theology and derived ideologies and their “modern” destructiveness. The pivotal segment of (...) the study is the relation between modernity and a theory of exclusion derived from a rather unorthodox (brief) interpretation of its emergence from the main carriers of modernity, namely Enlightenment and humanism. Instead of conclusion, the final section compiles and comments a few reformist initiatives and some possible philosophical-theological ways out of the deadlock of ideological self-centrism that still dominates our Orthodoxy. Drawing on the existent literature in the field and on in-depth interviews, we aim to examine here the practice and the meaning of wearing hijab by Romanian-born Muslim women. In our attempt to show the particularities of veiling among young Romanian-born Muslim women, we take into account the social and cultural context, the meanings and the values that these women convey to wearing the hijab and the consequences that such a practice has for their lives in the community (...) and in the Romanian society at large. We hope that the findings presented and discussed in this paper will enrich the research on this topic and will add a new perspective on the status of Muslim women in Eastern Europe. (shrink)

The study discusses the paradox of the failure of the Romanian Church United with Rome, Greek-Catholic (RCUR) to assert itself after 1990, in the context of a revival of the life of all other religious communities. The significant decrease in the number of Greek-Catholic believers and the difficulties in exercising their rights are germane to the limits of democracy in Romania. No other vulnerable communities, neither immigrants, gays, Roma,nor Jehovah's Witnesses, have been denied, all this time, the protection of (...) the Romanian state, as Greek-Catholics have been. The systematic denial of the rights of the Romanian Church United with Rome (Greek-Catholic) is explained by the feature which distinguishes RCUR faithful from the members of other vulnerable communities: their organisation is perceived by the Romanian Orthodox Church (ROC) as an adversary. The Romanian Orthodox Church constantly proclaimed the illegitimacy of the RCUR in the first half of the twentieth century, and participated in its dissolution when the opportunity arose in 1948. It holds today the same explicit goal. The societal circumstances, specific to anarchic democracy, allow a major player like the ROC to impose its policy of undermining the RCUR. In accordance with Bruce Bueno de Mesquita and Alastair Smith's concept, the material and symbolic competition between the RCUR and the ROC is interpreted as an example of "bad behavior as good politics". The ROC strategy finds an optimal framework for maximizing gain in the circumstances of the Romanian anarchic democracy. (shrink)

Nursing migration: global treasure hunt or disaster‐in‐the‐making?International nurse migration — moving from one country to another in the search of employment — is the focus of this article. The majority of member states of the World Health Organization report a shortage, maldistribution and misutilisation of nurses. International recruitment has been seen as a solution. The negative effects of international migration on the ‘supplier’ countries may be recognised today but are not effectively addressed.Nurse migration is motivated by (...) the search for professional development, better quality of life and personal safety. Pay and learning opportunities continue to be the most frequently reported incentives for nurse migration, especially by nurses from less‐developed countries. Career opportunities were considered key incentives for nurses emigrating from high‐income countries. Language was reported to be a significant barrier. The positive global economic/social/professional development resulting from international migration needs to be weighed against a substantial ‘brain and skills drain’ experienced by supplier countries. The vulnerable status of migrant nurses is also of concern in certain cases. The focus on short‐term solutions as opposed to resolving the problem of a worldwide shortage of nurses causes great concern. Recent initiatives attempt to curb or channel international recruitment. The delicate balance between recognising the right of individual nurses to migrate and a collective concern for the health of a nation’s population must be achieved. (shrink)

The European ideals – as well as the idea of Europe per se – are faced with a serious challenge due to recent migration crisis: it is not just the reflexes, the effectiveness and the policies, but also the consistency, the principles and the justification of the notion of the European Union that is in stake. Kant’s concept of universal hospitality could probably provide a good way out of this conundrum: while hospitality has largely been viewed as a solidarity-related (...) imperfect duty towards others, that is, a less compelling duty that allows moral agents for certain latitude concerning the occasions and the degree of its implementation, Kant’s views allow for a totally different perspective, and, in my view, a much more philosophically nuanced one: hospitality might also be considered as an autonomy-based duty owed to others, and in this respect could count as a perfect, morally compelling duty. To the extent that the concept of Europe consists in humanitarian ideals that are based upon a strong philosophical humanistic tradition, I consider my claim to be in perfect harmony with the true spirit of Europe. This study investigates whether and how the corporate social responsibility (CSR) profile of a company transfers to another company when an executive leaves a firm. We integrate upper echelon and institutional theories, and develop a novel measure of CSR profiles to explore this issue with a longitudinal data set of executive migrations over a 14-year period. We find that migrated executives assimilate elements of their old firms’ CSR profiles into their new firms (i.e., narrowing the distance between the two firms’ (...) CSR profiles), and this is true for both CSR and corporate social irresponsibility (CSiR). This relationship is stronger when the migrating executive comes from a bigger firm with better social and financial performance than that of the new firm. We also find that the potential for improvement in CSR profiles in migration holds true for CSiR, but not CSR. Our findings have import for upper echelon theory and the managerial discretion afforded to executives regarding CSR decisions. (shrink)

Climate change intersecting with complex socio-economic and political processes has produced distinctive patterns of crisis migration. However there exists a significant gap in understanding and theorizing these forms of migration creating significant policy challenges. Using a case study of an interstate migrant settlement in Bengaluru, India this article unpacks migration as an adaptation strategy through the lens of emotions. The article offers significant insights into how emotions affect the choice of migration as an adaptation strategy and (...) shapes the differential experiences of risks and vulnerability for different groups of people. Emphasizing such relational aspects of migration, the article calls for more research that develops a nuanced understanding of the emotional landscapes of migrants across migration pathways. In response to Albrecht et al.’s (J Agric Environ Ethics 26(4):827–845, 2013) discussion on the ethics of assisted migration, we emphasize the issues of risk and scientific uncertainty as an inextricable part of a comprehensive ethical evaluation. Insisting on a separation of risk and ethical considerations, although arguably common in many policy contexts, is at best misguided and at worst damaging.

ABSTRACT The paper presents and briefly analyses some of the provisions of a Romanian legislative proposal which arrived at the Presidency for ratification twice, in slightly different forms, and which was rejected twice: the first time at the Presidency in October 2004, and the second at the Constitutional Court in July 2005. The proposal was finally dropped in February 2006. My intention here is to point to some of the most problematic deficiencies of the legislative document in the hope (...) that this may assist with future debates and regulations on assisted reproduction either in Romania or elsewhere. The fluid use of the terminology associated with “migration governance” can obscure its intention and implications. Different meanings of core terminology risks allowing troubling policies that are not really about migration, understood widely as border crossing, or even more broadly as human movement, to be legitimized. UN-level coordination with regard to “migration governance” needs to be part of addressing this concern. For example, this article advocates explicitly engaging with this risk through the implementation of the Global Compact (...) for Safe, Orderly and Regular Migration. It considers this issue from the perspectives of a handful of countries, each of which has its own complex relationship to the compact. It argues that in each of these apparently very different contexts, policies identified as being directed at “migration control” can be found to be directed not at controlling migration but at reconfiguring existing and stable state societies along ethnic, racial, linguistic, and other lines. The development of implementation plans for the Global Compact for Migration provides the opportunity to interrogate the purposes of “migration governance” and to find mechanisms to address its hidden uses. The link between language and thought formed a major new exploration of twentieth-century philosophy. Languages nuance our ideas and perceptions. Though from various angles, Heidegger, Derrida, Wittgenstein forged new ways of understanding the relationship between our views of the external world and our culturally and linguistically pre-determined modes of expression. Another giant in this field of exploration is the Romanian philosopher Constantin Noica (1909-1987), who has so far remained generally unknown to the Western World because of the Iron Curtain. (...) The Romanian Sentiment of Being (Sentimentul românesc al ființei), first published in Romanian in 1978, is a philosophical work at the intersection of metaphysics and philosophy of language. The title of this book may be deceptive. "Romanian" does not mean ethnically circumscribed; it does not limit ontology to nationality but rather reflects on how language can carry ontological thought. The Romanian Sentiment of Being invites the readers to meditate on the fundamental theme of being and how it is expressed in a culture in time. This being in time marks the tension between moment and eternity, captured in the fairytale "Ageless Youth and Deathless Life" ("Tinerețe fără batrânețe și viață fără de moarte"), which Noica interprets in detail. The translation of the story will be found in the appendix. Noica also analyzes one of the most famous poems in Romanian, Mihai Eminescu's "The Evening Star" ("Luceafărul"), and readers will find its translation in the appendix. (shrink)

Specific to Moldavia and Bucovina—the Eastern and Northern parts of Romania—these monasteries have attracted visitors for the past 500 years. Migration und Armut sind eng miteinander verbunden. Für die meisten Migrant*innen ist Armut der Grund, ihre Heimat zu verlassen, um anderswo ein günstigeres wirtschaftliches Umfeld zu finden. Der Internationalen Organisation für Migration zufolge lag die Zahl der sogenannten Arbeitsmigrant*innen im Jahr 2015 weltweit bei 150,3 Millionen, bei einer Gesamtzahl von 247,6 Millionen Migrant* innen. Diese Zahlen erfassen Migrant* innen mit offizieller Arbeitserlaubnis und es ist anzunehmen, dass die Zahl von Arbeitsmigrant*innen ohne legale Dokumente deutlich höher ist.

Das Thema Migration wird in Politik, Medien und Offentlichkeit, aber auch in der Philosophie kontrovers diskutiert. Die vorliegende Studie geht von der These aus, dass sich Kants Uberlegungen zum Weltburgerrecht in einer produktiven Disharmonie zu gegenwartig vertretenen philosophischen wie politischen "Lagern" in der Migrationsdebatte befinden. Zur Begrundung dieser These wird zunachst die neuere Debatte um Migration anhand dreier Theoriestrange vorgestellt, die diese massgeblich strukturieren: der Kommunitarismus, der egalitaristische Kosmopolitismus und der liberale Nationalismus. Anschliessend werden die fur die Migrationsdebatte (...) entscheidenden Theoriegange in Kants politischer Philosophie erschlossen. Auf dieser Grundlage wird schliesslich die Produktivitat und systematische Relevanz von Kants Theorie fur die Hauptfragen der gegenwartigen Debatte herausgearbeitet und eine rechtsmoralische Migrationstheorie entworfen. Es werden dabei insbesondere die Themengebiete Asyl, (il-)legitime Abweisungsgrunde, Staatenlosigkeit, der Erwerb der Staatsburgerschaft, das Recht auf Auswanderung und individuelle Hilfspflichten sowie die Frage nach der Notwendigkeit einer "weltburgerlichen Gesinnung" diskutiert. The migration of constitutional ideas across jurisdictions is one of the central features of contemporary constitutional practice. The increasing use of comparative jurisprudence in interpreting constitutions is one example of this. In this 2007 book, leading figures in the study of comparative constitutionalism and comparative constitutional politics from North America, Europe and Australia discuss the dynamic processes whereby constitutional systems influence each other. This article argues that in response to these intense pressures to emigrate, poor men from rural Mexico do more than make instrumental calculations about migration to the border; they must negotiate masculine ideals and adopt strategic gendered practices in relation to the migration experience and the dynamic economic, (...) social and cultural conditions of the border region. KelleyThe Journal of the History of Ideas, in collaboration with other institutions, including the Universities of Bucharest and Budapest and the Soros Foundation, recently sponsored the second in a series of international conferences being planned on topics in current intellectual history. (The first, “Interrogating Tradition,” was held at Rutgers University, 13–16 November 1997.) The Romanian conference, which was held in the (...) Elisabeta Palace in Bucharest (27–31 May 1998), was devoted to “Culture and the Politics of National Identity in Modern Romania.” Over forty scholars, mainly from Romania but some also from the U.S., France, Germany, and Hungary, gathered to discuss a variety of questions about Romanian society, past, present, and speculative future; and they were joined by at least as many visitors, especially students, from the local area and beyond.Topics discussed included politics, language, economics, historiography, religion, education, philosophy, ideologies, intelligentsia, particular intellectuals, minorities, and women (though not Gypsies or gays). Under this riot of rubrics a wide range of questions were posed in interdisciplinary fashion, with frequent, sometimes impassioned interventions. What is—was, might have been, can be—Romania? Who is a Romanian (and who not)? What is Romania’s relation to the West and the East? (And what are the “West” and the “East”?) To modernity, to modernism, to modernization? What is—has been, should be—the function of intellectuals, of political and cultural elites, in understanding the Romanian past and in setting a course for the future? What, more generally, is the role of history in answering such questions? Or is history perhaps (as Karl Krause remarked of psychoanalysis) the disease for which it claims to be the cure?Keith Hitchens’s keynote address suggested that rehashing old essentialist debates might not be productive at millennium’s end, but the conference itself could not avoid some excursions down the paths of memory and myth. For historians, Western historians anyway, Romania seems to have too many pasts. Located at the juncture of four previous empires, Romania is a mosaic, or perhaps a pandemonium, of ethnic, religious, economic, and ideological groups that can only imagine, or invent, a nationality. Geographically (and in many ways culturally) remote from the West, Romania for a long time (as Sorin Antohi remarked) lacked both a public sphere and a civil society; and suffering “a Counter-Reformation without a Reformation” (Alexandru Dutu’s phrase), it has not enjoyed a tradition of religious or ethnic toleration. Nor have either the Germans or the Jews (as Glass said) found their own unity within the changing borders of the modern Romanian state. Not until the nineteenth century did Romania develop, out of its Boyar background (as Siupiur argued), an intellectual elite that could create a modern national history and help turn “peasants into Romanians” (Antohi’s phrase); and even then this elite seemed more attracted to conservative [End Page 735] (Herder, Savigny, Burke) than to liberal views of autochthonism. Many features of Western modernity, such as Newtonian science, reached Romania late, and indeed there was a retrograde movement against liberalism under the aegis by orthodox religion. In any case this intelligentsia has been as fragmented and multiform as the Romanian past itself. True, some Romanian scholars like to posit a mainstream tradition, “excesses aside,” as one speaker put it—but how, asked another, can historians put “excesses” aside from the devastating perspective of this century?Political and cultural self-examination was the dominant theme of this conference. Nationality, said Pippidi, depends on three factors, viz., name, language, religion, and territory. The Romanian name dates from the tenth century, indicating a separation of the Roman from the Greek tradition in Wallachia; and from the seventeenth century the idea of a mainly Roman provenance was given privilege. As a language, “Romanian” was spoken in the late Middle Ages, but the first written document is dated 1521. The principal religion in Romania was and is Greek orthodox, although there are also Roman Catholic, Jewish, Islamic, and German Protestant communities, as well as the Uniate church created in the eighteenth century.
