The article offers an empirical analysis of the ways in which Mexican press portrays Ukraine. To do this, this paper focuses on three major daily newspapers of Mexico, El Universal,La Jornadaand Milenio. The article offers a 12-month long diagnosis of the news, which discloses the agenda of objects and attributes regarding Ukraine. Therefore this study helps to explore the processes and factors that generate media image and communicate it to Mexican society. As far as methodology is concerned, a combination of (...) two aspects was employed in this study. The first was a quantitative analysis of news reports. The second was a qualitative interpretation applied to discover the evaluative undertones of the stories based on content analysis. To this end, all the 689 stories analyzed in this paper are classified as positive, negative and neutral and grouped - according to their topic - into 8 major categories: Economy, Politics, International Relations, Society, Culture, Public Security, Sports and Miscellanea. This study focuses on all the news reports on Ukraine, including those, which briefly mention the country, its territories or people. Moreover, the main findings of the paper were contrasted with the aspirations of communicative strategies of current Ukrainian government in order to understand whether the present image of the country in Mexico is adequate or desirable. Therefore, the analysis clearly indicates the dark and bright sides of country's projection in three analyzed newspapers. All the aforementioned efforts aim at better positioning of Ukraine both in Mexican society and internationally. (shrink)

Air pollution is a current concern of people and government entities. Therefore, in urban scenarios, its monitoring and subsequent analysis is a remarkable and challenging issue due mainly to the variability of polluting-related factors. For this reason, the present work shows the development of a wireless sensor network that, through machine learning techniques, can be classified into three different types of environments: high pollution levels, medium pollution and no noticeable contamination into the Ibarra City. To achieve this goal, signal smoothing (...) stages, prototype selection, feature analysis and a comparison of classification algorithms are performed. Children and adolescents are not indifferent to the dramatic impact of the COVID-19 pandemic, and the need to be forced to live in confinement. The change in life to which they have been abruptly subjected forces us to understand the state of their mental health in order to adequately address both their present and future needs. The present study was carried out with the intention of studying the consequences of confinement on anxiety, sleep routines and executive functioning of 1,028 children (...) and adolescents, aged from 6 to 18 years, residing in Spain to; assess if there are differences regarding these consequences in terms of sex and age; how anxiety affects executive functioning in males and females; and to examine the possible correlations between the measured variables. For this purpose, an online questionnaire containing five sections was designed: the first section gathers information on sociodemographic and health data, while the following sections gather information from different standardized scales which measure anxiety, sleep and executive functions, whose items were adapted in order to be completed by parents, and/or legal guardians. The statistical analyzes carried out highlights significant differences in executive functioning between males and females. In turn, in regards to age, greater difficulties were detected in anxiety in the 9 to 12 age group and greater sleep disturbances between 13 and 18 year olds. On the other hand, significant differences were found in intra-sexual executive functioning depending on whether they presented greater or lesser anxiety, with executive functioning being more tendentiously maladjusted in males than in females, revealing a significantly relevant effect size. Positive correlations are obtained between state anxiety and sleep and executive functioning alterations. Finally, through Path Analysis, it is verified that state anxiety is the variable with the greatest weight within the model that would explain the alteration in the executive functioning of the present sample. Teacher strikes have taken place in the United States since the end of the 19th century, became much more common in the 1960s, and have enjoyed a resurgence over the past five years (2018-2023). In this paper, we analyze teacher strikes with two main objectives. First, we examine how sexism and misogyny impact discourse around teacher strikes, as well as the justifications that teachers themselves give for striking. We find that teachers are at risk of being deemed ‘immoral’ unless they (...) justify their decision to strike by appealing to their being in the service of others. Pressure to adopt this framing not only negatively impacts teachers’ dignity as human beings deserving of adequate compensation and working conditions, but it also inadvertently upholds unjust patriarchal norms regarding teaching as care work. In the second part of this paper, we put forward alternative framings teachers can adopt in justifying their decisions to strike. The framings are rooted in philosophical literature that allows for self-regarding actions to be recognized as properly moral in certain circumstances. We argue that by extending this recognition to teachers who strike, we combat covert sexist expectations and uphold the dignity of teachers as persons. (shrink)

O presente artigo trata do conceito de poder na gênese e na sustentação do Estado a partir do vínculo conceitual das obras de G. W. F. Hegel e Carl Schmitt. Hegel, na Filosofia do Direito, propôs um itinerário da vontade em seu movimento histórico. A vontade, expressando a liberdade, seria o princípio dinamizador e fundante do próprio ente estatal. Carl Schmitt, retendo a leitura de Hegel sobre o direito, também admitiu a vontade como base do Estado, sobreposta à própria lei, (...) visto que esta não possui força para criar a estrutura política do porte do ente estatal. Especificamente, o artigo explora como o filósofo e o teórico político mencionados forneceram explicações sobre se o poder é gerado nas engrenagens internas do Estado ou se ele é transmitido ao ente estatal de uma fonte externa. Para alcançar tal objetivo, analisam-se três aspectos: o primeiro deles é o grau de semelhança entre a vontade livre de Hegel e a “decisão” elaborada por Schmitt. O segundo aspecto procura identificar como a vontade e a decisão se inserem na composição do Estado enquanto entidade política. Por fim, considera-se neste artigo como a vontade e a decisão no Estado são contidas ou estimuladas pelo dispositivo constitucional. (shrink)

Esta investigación analiza la presencia del discurso eurocéntrico en los manuales de Historia del Arte de Bachillerato desde una dimensión sociogenética. La muestra se compone de ejemplares pertenecientes a editoriales españolas de alcance nacional (Anaya, ECIR, Ediciones Ruiz, SM, Teide y Vicens Vives) en una cronología que comprende los distintos periodos por los que ha atravesado la materia entre 1953 y 2006. El estudio deriva de la aplicación de un guion de análisis documental que contempla, entre sus variables, la construcción (...) de identidades. Los resultados muestran la presencia y resistencia sociohistórica del discurso eurocéntrico en los manuales de Historia del Arte analizados, tendiéndose con ello a la construcción, reproducción y esencialización de identidades etnocéntricas. De este modo, para ahondar en la formación de una ciudadanía crítica, se hace necesario replantear los enfoques y las finalidades que fundamentan el relato de la Historia del Arte escolar en recursos como el que nos ocupa en este trabajo. O presente estudo investigou as relações entre qualidade de vida e presença de sintomas depressivos e ansiosos em profissionais da saúde que estão atuando com pacientes infectados pela COVID-19, em um hospital da região metropolitana de Porto Alegre. Setenta e um participantes (84,5% mulheres), com média de idade de 30 anos (± 6,7), responderam ao questionário sociodemográfico, ao Inventário de Depressão deBeck II, ao Inventário de Ansiedade de Beck e à Escala de Qualidade de Vida “WHOQOL-bref”. Dos profissionais amostrados, observou-se (...) escores significativamente maiores de depressão (64,8%) do que ansiedade (50,7%). Identificou-se que quanto maiores os escores de ansiedade e de depressão, menores os escores de qualidade de vida. Diante dos resultados, observou-se associações significativas em relação aos sintomas depressivos, aos sintomas ansiosos e à qualidade de vida. Concluiu-se que é de grande relevância abordar essa temática, visto que o prejuízo à saúde mental desses profissionais deve ser considerado, principalmente em tempos de pandemia. (shrink)

O presente trabalho tenciona analisar, a partir do “Prefácio” da Fenomenologia do Espírito de Hegel, qual o papel da religião na condução da consciência ao Saber Absoluto, último e máximo nível de compreensão que o ser humano pode alcançar de si e do mundo. Para tanto, o trabalho ora apresentado indica o propósito de Hegel, a partir de uma descrição panorâmica do citado “Prefácio”, em situar a consciência e a religião dentro do sistema contido na Fenomenologia. Em seguida, é apresentada (...) a posição da consciência no mundo, tensionada entre o desejo de apropriar-se do outro, de um lado, e o dever de reconhecê-lo, do outro. Com efeito, a pesquisa em comento demonstra que a religião oferece uma alternativa para resolver essa tensão entre consciências, propondo-lhes um equilíbrio social mediante o conceito de “comunidade”. Por fim, esta investigação debruça-se em como, na Fenomenologia, o Saber Absoluto, meta da consciência, está intimamente correlacionado com o conceito de Deus, que é o eixo da doutrina religiosa. Los derechos de la infancia son de formulación reciente, y hasta el siglo XX no surgen los primeros intentos de reconocerlos y regularlos. Además de revisar los textos jurídicos que formulan y protegen esos derechos a nivel mundial, este estudio promueve una lectura filosófica de los derechos de la infancia y del papel de las familias con respecto a esos derechos. La ética del cuidado proporciona un marco de reflexión muy oportuno para plantear la responsabilidad ética que las familias, y (...) la sociedad en general, tienen hacia los niños y niñas, que son los miembros más vulnerables de la sociedad y los que padecen con mayor crudeza las consecuencias de la pobreza, la migración o los desastres naturales. Este estudio lleva a cabo una revisión crítica sobre los derechos de la infancia y los principales intentos de reconocer y garantizar jurídicamente esos derechos a nivel internacional. Explora también la situación actual de la infancia a nivel mundial, enfatizando las consecuencias negativas de la pandemia de COVID-19 en ese sector vulnerable de la población. Por último, se adopta la perspectiva de la ética del cuidado para analizar las responsabilidades de las familias y el papel de las instituciones y de la sociedad en general hacia la protección de la infancia. Objetivo: El siguiente artículo tiene como propósito la revisión de la literatura existente cuyo enfoque sea las herramientas tecnológicas utilizadas para el abordaje del paciente con síntomas de salud mental, de manera virtual, para describir las ventajas, la eficacia, la efectividad y los beneficios de estas herramientas, a partir de la literatura encontrada. Métodos: se realizó una búsqueda en las bases de datos Pubmed, Elsevier, UpToDate, Journal of Medical Internet Research y Google Académico. Se identificó un total de 58 artículos (...) que versan sobre la eficacia y efectividad de las diferentes modalidades digitales (tales como aplicaciones, cuestionarios en línea, mensajes de texto, etc.) que tratan la salud mental. Resultados: la búsqueda realizada arrojó un total de 58 artículos. Tras la eliminación de duplicados, el número fue de 50 artículos. Después de la caracterización de la información basada en la revisión de la totalidad del contenido, fueron elegidos 30 artículos para que sirvieran como base para la construcción de la síntesis de datos. Conclusiones: las herramientas virtuales utilizadas en salud mental ofrecen un sin fin de beneficios para prestar un servicio con un acceso más sencillo a la población, de forma económica y efectiva, sin temor a que los pacientes sean estigmatizados al momento de buscar ayuda, como se pudo evidenciar en los artículos presentados. Además, las herramientas digitales utilizadas en psiquiatría han demostrado ser eficaces y seguras, sin embargo, son de reciente aparición y cuentan con una cantidad limitada de estudios que demuestren objetivamente su eficacia en esta área. En esta contribución ensayaremos una reflexión, desde las coordenadas de los estudios sobre ciencia, tecnología y sociedad (CTS), sobre el impacto de la pandemia del coronavirus en España. Estudiaremos la evolución de la percepción social en España sobre la vacunación contra la COVID-19 a la luz de los avances científicos e industriales en el desarrollo de las vacunas, las decisiones y debates políticos que acompañaron a la gestión de la crisis sanitaria y la cobertura mediática del proceso por parte de (...) los medios de comunicación. Para ello utilizaremos fundamentalmente los datos proporcionados por el Centro de Investigaciones Sociológicas (CIS) complementados, puntualmente, con datos ofrecidos por otras encuestas nacionales e internacionales, así como una amplia selección de noticias aparecidas en medios de comunicación que contribuyeron a configurar el imaginario público sobre la pandemia durante los meses previos y posteriores al inicio de la vacunación en España, que comenzó en nuestro país a finales de diciembre de 2020. Aunque este estudio exploratorio se basa en datos de encuestas y de medios, no pretende ofrecer un análisis descriptivo detallado, sino que su alcance se limita a una reflexión que pueda contribuir a comprender mejor el significado de la pandemia para las cambiantes relaciones C-T-S. La fenomenología distingue el cuerpo-objeto (Körper) del cuerpo vivido (Leib); se interesa por este último y por el cuerpo que se nos manifiesta en nuestras experiencias y les da expresión. Este cuerpo fenoménico es el punto cero de nuestras vidas, el anclaje de nuestra existencia. La fenomenología de Simone de Beauvoir le aplica la diferencia sexual.Esta contribución continúa la hermenéutica de Beauvoir centrándose en su conocida máxima, “no se nace mujer, se llega a serlo”, teniendo en cuenta que las interpretaciones (...) se dan desde y para determinadas situaciones. La nuestra es el siglo XXI y las investigaciones fenomenológicas y feministas. Dado que la traducción es un modo de interpretación, señalaremos cómo El segundo sexo ha contribuido a comprender el devenir mujer. Para ello, en primer lugar, expondremos nuestra concepción hermenéutica de la traducción. Destacaremos después el “estilo” fenomenológico de Beauvoir y las influencias recíprocas con Merleau-Ponty para abrir la posibilidad de una diferencia sexual sin determinismos. (shrink)

Los acuerdos de paz concertados entre el gobierno colombiano y las FARC en 2016 se han visto no solo como la finalización del conflicto armado, sino como la posibilidad de imaginar y construir una sociedad inclusiva, justa y participativa. Se ha argumentado que los acuerdos de paz son la ruta más corta para lograr los objetivos del Estado democrático, y cumplir con lo estipulado en su narración como parte de un pacto social que conlleva a la convivencia pacífica. Sin embargo, (...) una mirada detallada y crítica a los lugares descriptivos y, por ende, prácticos a los acuerdos desde un punto de vista del feminismo centrado en la noción de diferencia revela en los acuerdos un sentido de exclusión y marginalización de la mujer que reproduce los marcos teóricos de un feminismo centrado en la igualdad y la equidad. El pensamiento filosófico de Luce Irigaray permite fracturar y descentrar las lógicas masculinas en la tradición filosófica de occidente y abre paso a la diferencia como concepto que recrea y re-imagina el espacio público y el marco político. Así, se posibilita una inclusión que fortalece la ciudadanía como derecho y como única garante de la reconciliación en la sociedad colombiana. (shrink)

El artículo defiende la posibilidad de una teoría de la acción animal en el planteamiento estoico apoyándose en la doctrina de la oikeiosis. El artículo afirma que, si bien los estoicos lantearon la existencia de impresiones, impulsos y asentimientos en el caso de los seres humanos y de los animales, el contenido que tienen dichos conceptos en cada uno de los ámbitos es sustancialmente diferente. En ese sentido, la exploración que se realiza permite, por un lado, identificar con mayor precisión (...) lo que es distintivo de los animales desde la perspectiva estoica y, por otro, mostrar cómo la comparación entre seres humanos y animales ratifica una unidad de criterio en la doctrina, según la cual los seres naturales se comportan conforme a su naturaleza. Within the strong branch of artificial intelligence, which is aimed at creating thinking machines with intellectual powers like those of man, the most explored research program is symbolic aI, defined as the attempt to use electronic computers to replicate the human mind, either assuming a structural and functional similarity between them, or trying to replicate the behavior produced by the human mind through computational processes that also have an intentional structure but are only instrumentally equivalent. In this paper we show (...) that strong symbolic aI, in either of its two variants, is impossible, since formal systems, that is what all computer programs ultimately are, are not sufficient to replicate in an intentional way four intellectual faculties of man that are essential to intelligent behavior: sense of the situation, common sense, procedural skills and theory abduction. ABSTRACT: The mental models theory predicts that, while conjunctions are easier than disjunctions for individuals, when denied, conjunctions are harder than disjunctions. Khemlani, Orenes, and Johnson-Laird proved that this prediction is correct in their work of 2014. In this paper, I analyze their results in order to check whether or not they really affect the mental logic theory. My conclusion is that, although Khemlani et al.'s study provides important findings, such findings do not necessarily lead to questioning or to rejecting (...) the mental logic theory. RESUMO: A teoria dos modelos mentais prevê que, enquanto as conjunções são mais fáceis do que as disjunções, para os indivíduos, quando negadas, as conjunções são mais difíceis do que as disjunções. Khemlani, Orenes e Johnson-Laird provaram que essa previsão está correta, em seu trabalho de 2014. Neste trabalho, analiso os seus resultados, a fim de verificar se eles realmente afetam a teoria da lógica mental ou não. Minha conclusão é que, embora o estudo da Khemlani, Orenes and Johnson-Laird forneça resultados importantes, tais resultados não conduzem necessariamente a minar ou rejeitar a teoria da lógica mental. I try to show that Steiner's theory has very implausible normative consequences since it does not accept the prima facie character or rights. This theory is unable to solve the conflicts of interests in which the only intuitively plausible solution consists in overriding someone's rights.

The history of Credit Rating Agencies [CRAs], commonly called Rating Agencies, has a long and distinguished trajectory marked by influence, reputation and power. Due to the ability of this field to instigate significant changes in market regulations and actions of economic actors, this subject is extensively debated within the literature. In economic sociology, while some studies have focused on perceptions of performativity and market devices to understand how the calculability of its methods influences the economy, others, along relational lines of (...) sociology, aim to understand them through a more complex constructive process. In this study, we attempt to fill a gap by exploring the complementarity between two theoretical approaches to sociology: theory of fields and performativity. Thus, we mobilize theory of fields to understand the inter-field relationship between the State and CRAs. Specifically, this paper sets out to i) analyze the co-constitution of the state and market fields with the field of CRAs; ii) describe the existing regulation and situate the CRAs and their classification devices in the broader history of the State and the market; iii) analyze how the legitimation of the CRAs by the State generates broader social contexts that assist in the performative work of the CRAs. Based on historical documentary research, we analyze some of the main milestones and regulatory events in the field of CRAs. This research reaffirms the assumption that even after credibility crises, the State is the most significant predictor of legitimacy, power, and influence that CRAs hold to date. The legitimacy of this power and influence has yet to be exhausted because the reputation of CRAs is rooted in the reputation of the State itself. This happens because the State provides essential actions (such as regulations) for the existence of the financial market. Thus, results suggest that the State, through regulatory measures, can engage several other fields to promote the legitimacy of performative work of the CRAs, whose purpose is to provide calculation tools to shape markets. abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

En este trabajo adoptamos una postura crítica, en primer lugar, ante un planteamiento que desde la investigación empírica pretende explicar los fines propios de la educación. Frente a éste proponemos la metodología hermenéutico-crítica para desentrañar cuáles son los fines últimos de la educación. Descubrimos que desde la metodología hermenéutico-crítica es posible enfocar adecuadamente el fin de la educación así como aportar una justificación ética solvente. Profundizando en la dimensión crítica de la hermenéutica, pero sin desvincularla de su quicio experiencial, reparamos (...) en que no basta con interpretar los valores establecidos por la sociedad, sino que es necesario ahondar en el radical ético que justifica la educación como auténtico desarrollo humano de las capacidades morales. Esta experiencia primordial de la educación que hunde sus raíces en el radical humano es una experiencia genuinamente ética. A este respecto, destacamos once claves del enfoque éticohermenéutico y sus ventajas para la determinación del enclave de la educación. (shrink)

Este trabajo pretende colaborar a facilitar la tarea docente del profesorado, que debe desarrollar a través de sus decisiones de departamento, la enseñanza del hecho religioso como alternativa a unas enseñanzas de las religiones confesionales, en los dos últimos cursos de la ESO y en el primer curso del Bachillerato. Este aspecto nos orienta a desarrollar el currículo de esta nueva materia, preferentemente, hacia el vector cultural y social del hecho religioso, reservado a las enseñanzas comprometidas con una determinada crrencia (...) religiosa -voluntariamente elegida por el alumnado- la preferencia en el desarrollo de los contenidos confesionales de la religión. Su toma de contacto con las corrientes doctrinales con las que se familiariza durante su estancia en Oriente y la relación que traba con los obispos en los sínodos a los que asiste le llevan a constatar la existencia de más puntos en común que divergencias. Bernard Suits’ groundbreaking work, The Grasshopper: Games, Life, and Utopia, has profoundly shaped the philosophy of sport. Its sequel, Return of the Grasshopper: Games, Leisure, and the Good Life in the Third Millennium, released in October 2022, enriches scholarly understandings of Suits’ views on games, emphasizing the normative aspects of gameplay and its impact on people’s pursuit of the good life. In this book symposium, world-leading Suits scholars analyze the Suitsian conception of gameplay and its relevance to his views on (...) Utopia outlined in the sequel, covering a wide range of topics. Filip Kobiela explores counterfactual situations in Suits’ oeuvre. Christopher Bartel and Gwen Bradford scrutinize the ethical nature and ramifications of Suits’ claim that life is an unconscious game. R. Scott Kretchmar and John S. Russell present thoughtful critiques of Suits’ musing on Utopia. William J. Morgan’s contribution integrates contemporary work studies to illuminate Suits’ utopia. In 2014, an international group of scholars from various fields analysed the “societal dimensions” of synthetic biology in an interdisciplinary summer school. Here, we report and discuss the biologists’ observations on the general perception of synthetic biology by non-biologists who took part in this event. Most attendees mainly associated synthetic biology with contributions from the best-known public figures of the field, rarely mentioning other scientists. Media extrapolations of those contributions appeared to have created unrealistic expectations and irrelevant fears that were (...) widely disconnected from the current research in synthetic biology. Another observation was that when debating developments in synthetic biology, semantics strongly mattered: depending on the terms used to present an application of synthetic biology, attendees reacted in radically different ways. For example, using the term “GMOs” rather than the term “genetic engineering” led to very different reactions. Stimulating debates also happened with participants having unanticipated points of view, for instance biocentrist ethicists who argued that engineered microbes should not be used for human purposes. Another communication challenge emerged from the connotations and inaccuracies surrounding the word “life”, which impaired constructive debates, thus leading to misconceptions about the abilities of scientists to engineer or even create living organisms. Finally, it appeared that synthetic biologists tend to overestimate the knowledge of non-biologists, further affecting communication. The motivation and ability of synthetic biologists to communicate their work outside their research field needs to be fostered, notably towards policymakers who need a more accurate and technical understanding of the field to make informed decisions. This article shows how epideictic rhetoric and argumentation may be interrelated in a general-interest newspaper framed as a single discourse produced by a collective author. In more specific terms, the view advanced here is that newspaper as whole has an epideictic dimension which, in terms of argumentation, is the fundamental or predominant one. The usefulness of this approach is twofold. In terms of rhetoric, to explore the applicability of epideictic rhetoric to journalistic discourse; and in the field of journalism studies, (...) the goal is to draw on the theory of epideictic rhetoric so as to refine the conceptualization of the nature of argumentation in the newspaper as such. Given this twofold perspective, the account of newspaper discursive practices will be general, and the classical and contemporary epideictic theory will be briefly summarized. However, the outcome of this analysis is an example of a fruitful encounter between the two fields. (shrink)

Este trabajo tiene el objetivo de argumentar cómo se manifiesta la generosidad en la vida y obra de José Martí. Muestra la necesidad e importancia de recurrir a sus obras para fortalecer este valor desde los escenarios familiares, escolares, comunitarios y sociales. Se concluyó que la generosidad constituye en la actualidad una tarea pedagógica de gran importancia y el legado martiano es una vía obligada a recorrer. This work has the objective of analyzing how the generosity in Marti's life and (...) work is expressed. It shows the need and importance of turning to his works to strengthen this value from the family, scholar, community and social scenes. It was concluded that generosity constitutes at the present time a pedagogical task of great importance and the Martian legate is an obligated way to travel. (shrink)

Los Estados confederados proyectan la existencia de un doble sistema normativo: federal y local. Esto provoca el surgimiento de colisiones y contradicciones entre ambos sistemas, lo que se pensaría debería ser resuelto por el derecho internacional, atendiendo el principio de subsidiariedad, no obstante, esto no siempre es así, ya sea porque el derecho internacional no regule ese caso concreto o bien, porque el Estado en cuestión no haya otorgado su consentimiento y la respuesta no le sea vinculante. Estas reflexiones invitan (...) a contrastar la naturaleza de las normas del derecho local y del derecho internacional, pues mientras que las primeras son asociativas, dado que no necesariamente requieren ser consentidas para ser vinculantes, las segundas, aparentemente, sí requieren el consentimiento de los Estados para que tengan efectos vinculantes. En este artículo pretendemos postular una posible solución al problema del conflicto entre los distintos órdenes normativos, partiendo desde una postura cuasi-voluntarista. Las obligaciones cuasi-voluntarias son aquellas que no surgen del consentimiento, pero tampoco completamente de los roles que tienen los Estados en el sistema internacional. Estas obligaciones nacen en el núcleo de grupos dominantes, a los que llamaremos grupos autocontenidos en el ámbito internacional, que tienen como rol la creación y socialización de las normas y obligaciones de derecho internacional, logrando que los otros grupos simplemente las sigan como si tuvieran un deber de hacerlo. Para ello, servirá como referencia el análisis del caso de las disimiles normas migratorias entre California y Texas dentro de Estados Unidos. (shrink)

In this paper, we discuss two recurring themes in Sosa’s work, reexamined in Judgment and Agency (SOSA, 2015) from a new angle, i.e. the place and importance of reflection in the cognitive economy of the epistemic agent, and epistemic value. Regarding the latter, Sosa suggests that knowing full well, which necessarily involves reflection, has value because it contributes to human flourishing. Although Sosa’s “new virtue epistemology” appears very promising in explaining different intuitions regarding epistemology and demonstrating that it is possible (...) to join reliabilist and responsibilist accounts of virtue epistemology, we believe that solving the value problem requires further clarification in order to truly explain the value of knowledge.
