Este estudo busca discutir e analisar a construção da opinião pública no Twitter, tomando como estudo de caso a nomeação de Alexandre de Moraes para substituir Teori Zavascki como ministro do Supremo Tribunal Federal. A base teórica é formada a partir das relações entre o conceito de esfera pública e os sites de redes sociais. Para realizar esta análise, foram adotados métodos mistos, baseados na análise de contingência e na análise de redes. O corpus deste estudo é composto por 15.125 (...) tweets, coletados do Twitter utilizando “Alexandre de Moraes” como termo de coleta. Os dados foram analisados por meio das coocorrências entre os conceitos dos tweets, sendo possível observar os principais assuntos discutidos e posicionamentos dos usuários, em sua maioria contrários à indicação de Moraes. The foundations of linguistics continue to generate philosophical debate. Jerrold Katz claims that the subject matter of linguistics consists of abstract objects and that, as a consequence, the discipline cannot be viewed as part of psychology. I respond by arguing (1) that Katz misinterprets work in the philosophy of mathematics which he believes sheds light on foundational questions in linguistics; (2) that he misunderstands aspects of Noam Chomsky's position, against whose conception of linguistics many of his claims are directed; (3) (...) that Katz fails to dispose of a much more plausible analysis, according to which linguistics remains an empirical inquiry in spite of its abstract subject matter; and, finally, (4) that his arguments against what he calls‘generativism’, appealing to the existence of an infinitely long grammatical sentence of English, are flawed. Basically, a simulation has explanatory power only if it includes all causally relevant factors of a given empirical configuration and if the simulation delivers stable results within the measurement inaccuracies of (...) the input parameters. -/- In the second step, I examine a few examples of Axelrod-style simulations as they have been used to understand the evolution of cooperation (Axelrod, Schüßler). These simulations do not meet the criteria for explanatory validity and it can be shown, as I believe, that they lead us astray from the scientific problems they have been addressed to solve. This paper analyses the broad methodological structure of population-biological theorising. In it, I show that the distinction between initial exploratory, hypothesis-generating research and the subsequent process-reconstructing, hypothesis-testing type of research is not being made. Rather, the hypotheses generated in population biology are elaborated in such detail that students confound the initial research phase with the subsequent hypotheses-testing phase of research. In this context, I therefore analyse some testing procedures within the exploration phase and show that, as an extreme form of (...) confusion, statistical null-models are mistakenly given the status of causal population-biological theory. This is a critique of "A Natural History of Rape: Biological Bases of Sexual Coercion" (Thornhill & Palmer, 2000). Lloyd argues that they have failed to do "excellent science" as required to defend themselves against criticism. As an example, Lloyd contends that they make conclusions which depend on rape being a single trait, while failing to prorivde any basis for such an assumption.

An influential line of thinking in behavioral science, to which the two authors have long subscribed, is that many of society's most pressing problems can be addressed cheaply and effectively at the level of the individual, without modifying the system in which the individual operates. We now believe this was a mistake, along with, we suspect, many colleagues in both the academic and policy communities. Results from such interventions have been disappointingly modest. But more importantly, they have guided many (though (...) by no means all) behavioral scientists to frame policy problems in individual, not systemic, terms: To adopt what we call the “i-frame,” rather than the “s-frame.” The difference may be more consequential than i-frame advocates have realized, by deflecting attention and support away from s-frame policies. Indeed, highlighting the i-frame is a long-established objective of corporate opponents of concerted systemic action such as regulation and taxation. We illustrate our argument briefly for six policy problems, and in depth with the examples of climate change, obesity, retirement savings, and pollution from plastic waste. We argue that the most important way in which behavioral scientists can contribute to public policy is by employing their skills to develop and implement value-creating system-level change. (shrink)

An error in the Fourth Assessment Report of the Intergovernmental Panel on Climate Change, which wrongly predicted the disappearance of Himalayan glaciers by 2035, fueled doubts about the authority, honesty and rigor of the IPCC as a leading institution in climate science and, correspondingly, raised questions about whether global warming is anything more than a hoax put forward by environmentalists. The late and confusing reaction of the IPCC to these allegations only worsened the matter. By comparing assessment reports issued by (...) the IPCC, this paper asks the question: ‘Why, despite extensive peer review, did the Himalayan glacier melting rate error get published?’ I chronicle exactly what happened, consider why it happened as it did, and show how these answers require us to rethink the concept of ‘peer review’ in scientific practice. I also identify several future directions for peer review if it wants to stay ahead of the game, bearing in mind the forthcoming IPCC Assessment Reports. (shrink)

One often hears talk about some entities being "higher-level" than others: social and cultural objects, for example, are often said to be "higher-level" entities than organisms; mental properties are often said to be "higherlevel" than physical or neurological properties; and so on. Sometimes this is expressed as the idea that reality comes in ontological levels, strata of being. I will argue, however, that metaphysics is better off without making use of the idea of "levels." The levels metaphor is misleading and (...) can generate pseudo-questions and pseudo-problems. (shrink)

The current institutional focus on patient satisfaction and on surveys designed to assess this could eventually compromise the quality of health care while simultaneously raising its cost. We begin this paper with an overview of the concept of patient satisfaction, which remains poorly and variously defined. Next, we trace the evolution of patient‐satisfaction surveys, including both their useful and problematic aspects. We then describe the effects of these surveys, the most troubling of which may be their influence on the behavior (...) of health professionals. The pursuit of high patient‐satisfaction scores may actually lead health professionals and institutions to practice bad medicine by honoring patient requests for unnecessary and even harmful treatments. Patient satisfaction is important, especially when it is a response to being treated with dignity and respect, and patient‐satisfaction surveys have a valuable place in evaluating health care. Nonetheless, some uses and consequences of these surveys may actively mislead health care.Our critique of patient‐satisfaction surveys takes into consideration three different ways patients may be “satisfied.” First is the provision of medically necessary care that actually improves their outcomes. The second concerns interventions that patients or families want but that are medically unnecessary and may negatively affect health outcomes. The third category—comprising factors that are less likely to affect health outcomes but may certainly contribute to a sense of dignity and well‐being—includes “humanistic” aspects of health care, such as good communication and treating patients with respect, as well as peripheral aspects, such as convenient parking and designer hospital gowns. These distinctions are important as we explore patient satisfaction and its implications. (shrink)

In Poetic Justice Martha Nussbaum undertakes to explain how “story-telling and literary imagining” can supply “essential ingredients in a rational argument” and thereby improve public discourse regarding important ethical, political, and legal issues.

In a series of essays and letters published in 2010, commentators in bioethics debated the ethics of two interventions that aim to prevent or treat a symptom of a genetic condition called congenital adrenal hyperplasia, which can cause “virilization” in affected baby girls—the development of atypical, sometimes masculine‐appearing, genitals. Surgeries are often performed to try to “normalize” both the appearance and the function of affected girls’ genitals, and a drug thought to prevent virilization is sometimes prescribed to pregnant women who (...) are likeliest to be carrying an affected fetus. The CAH debates suggest that there is profound disagreement in the field about whether preventing or treating virilization is an appropriate goal of medicine—or, indeed, parenting. Of course, that disagreement has its roots in ongoing debates about how to understand and react to a range of anatomical and behavioral differences, from short stature to deafness to hyperactivity, as well as ongoing debates about the limits of autonomy—in this case, parental autonomy, which is all the more complex. These issues are at the heart of bioethics. Yet it can be very difficult for us to talk and write respectfully and clearly about them. Here, I recount the debates, show how they lost focus, and attempt to explain why the question about how parents and physicians should respond to atypical genitalia in children is so important and difficult. I argue that it is not a question that should be answered based on a single principle or philosophical commitment. No one principle can do all of the work. For each individual or family that faces it, the question is shaped by details about particular interventions aimed at altering a particular difference and offered in a particular social and family context. Scholars in bioethics who hold an especially strong commitment to any one principle should advocate for their views, but they must also make room for and respect the kind of pragmatic, particularized decision‐making that parents sometimes engage in. Friedrich Schiller, German poet, dramatist, philosopher and publisher, was a prominent contributor to the educational neo‐humanistic concept of Bildung at the threshold to Romanticism. Schiller assigns a pivotal role to the aesthetic education arguing that aesthetic activity reconciles sensuousness and reason and thereby creates the precondition of knowledge and morality. The article examines elitist and sexist traits in Schiller's work and whether they are constitutive to his theory of aesthetics and education. By identifying problems in the philosophical foundations of the (...) concept of Bildung the authors wish to contribute to its ongoing reconstruction in the Nordic Countries. (shrink)

Intuitive-automatic processes are crucial for making judgements and decisions. The fascinating complexity of these processes has attracted many decision researchers, prompting them to start investigating intuition empirically and to develop numerous models. Dual-process models assume a clear distinction between intuitive and deliberate processes but provide no further differentiation within both categories. We go beyond these models and argue that intuition is not a homogeneous concept, but a label used for different cognitive mechanisms. We suggest that these mechanisms have to be (...) distinguished to allow for fruitful investigations of intuition. Specifically, we argue that researchers should concentrate on investigating the processes underlying intuition before making strong claims about its performance. We summarise current models for intuition and propose a categorisation according to the underlying cognitive processes: (a) associative intuition based on simple learning-retrieval processes, (b) matching intuition based on comparisons with prototypes/exemplars, (c) accumulative intuition based on automatic evidence accumulation, and (d) constructive intuition based on construction of mental representations. We discuss how this differentiation might help to clarify the relationship between affect and intuition and we derive a very general hypothesis as to when intuition will lead to good decisions and when it will go astray. The nature of the Plague described by Thucydides in Book 2, chapter 49, has long been discussed both by medical and by classical scholars. Of numerous suggested identifications none has found general approval; and it is doubtful whether any opinion is more prevalent today than that the problem is insoluble. The classical scholar is handicapped by his ignorance of medical science; his medical colleague has often been led astray by translations deficient in exactitude if not disfigured by error. The (...) difficulties are great enough: but there is one indispensable preliminary task which can be undertaken with some prospect of success. If Thucydides' description is to be compared with modern records, it is necessary first to determine what the Greek words mean; and that can only be done by determining how far the Greek is expressed in the technical terms of contemporary medical science. It is obvious that Thucydides required a special vocabulary for this part of his work; and in fact over forty words in chapters 49 and 50 are unexampled elsewhere in his History, and a dozen more are used in meanings unexampled elsewhere. It is certain that a number of medical treatises were in circulation in Thucydides' lifetime, and that a more or less standard vocabulary had been or was being established. Now if it can be shown that the great majority of the terms employed by Thucydides in ch. 49 recur, apparently with the same meanings, as standard terms in the contemporary doctors, our second task—the comparison of Thucydides' description with modern records—will become a more rational undertaking than it was before, no longer the doubtful speculation which many of the modern doctors suppose it to be, thinking as they do that they have to deal with a layman's generalities expressed in literary language. Sorensen presents a general theory of thought experiments: what they are, how they work, what are their virtues and vices. On Sorensen's view, philosophy differs from science in degree, but not in kind. For this reason, he claims, it is possible to understand philosophical thought experiments by concentrating on their resemblance to scientific relatives. Lessons learned about scientific experimentation carry over to thought experiment, and vice versa. Sorensen also assesses the hazards and pseudo-hazards of thought experiments. Although he grants that (...) there are interesting ways in which the method leads us astray, he attacks most scepticism about thought experiments as arbitrary. They should be used, he says, as they generally are used--as part of a diversified portfolio of techniques. All of these devices are individually susceptible to abuse, fallacy, and error. I argue that a common philosophical approach to the interpretation of physical theories—particularly quantum field theories—has led philosophers astray. It has driven many to declare the quantum field theories employed by practicing physicists, so-called ‘effective field theories’, to be unfit for philosophical interpretation. In particular, such theories have been deemed unable to support a realist interpretation. I argue that these claims are mistaken: attending to the manner in which these theories are employed in physical practice, I show that interpreting (...) effective field theories yields a robust foundation for a more refined approach to scientific realism in the context of quantum field theory. The paper concludes by briefly sketching some general morals for interpretive practice in the philosophy of physics. (shrink)

With this book we see a philosopher well steeped in the Western tradition thinking through ancient Eastern disciplines, meditating on what it means to learn to breathe, and urging us all at the dawn of a new century to rediscover indigenous Asian cultures. Yogic tradition, according to Irigaray, can provide an invaluable means for restoring the vital link between the present and eternity--and for re-envisioning the patriarchal traditions of the West. Western, logocentric rationality tends to abstract the teachings of yoga (...) from its everyday practice--most importantly, from the cultivation of breath. Lacking actual, personal experience with yoga or other Eastern spiritual practices, the Western philosophers who have tried to address Hindu and Buddhist teachings--particularly Schopenhauer--have frequently gone astray. Not so, Luce Irigaray. Incorporating her personal experience with yoga into her provocative philosophical thinking on sexual difference, Irigaray proposes a new way of understanding individuation and community in the contemporary world. She looks toward the indigenous, pre-Aryan cultures of India--which, she argues, have maintained an essentially creative ethic of sexual difference predicated on a respect for life, nature, and the feminine. Irigaray's focus on breath in this book is a natural outgrowth of the attention that she has given in previous books to the elements--air, water, and fire. By returning to fundamental human experiences--breathing and the fact of sexual difference--she finds a way out of the endless sociologizing abstractions of much contemporary thought to rethink questions of race, ethnicity, and globalization. The widespread and long-lived failings of academic economics are due to an over-reliance on largely inappropriate mathematical methods of analysis. This is an assessment I have long maintained. Many heterodox economists, however, appear to hold instead that the central problem is a form of political-economic ideology. Specifically, it is widely contended in heterodox circles that the discipline goes astray just because so many economists are committed to a portrayal of the market economy as a smoothly or efficiently functioning system (...) or some such, a portrayal that, whether sincerely held or otherwise, is inconsistent with the workings of social reality. Here I critically examine the contention that a form of political-economic ideology of this sort is the primary problem and assess its explanatory power. I conclude that the contention does not fare very well. I do not, though, deny that ideology of some sort has a major impact on the output of the modern economics academy. However it is of a different nature to the form typically discussed, and works in somewhat indirect and complex ways. Having raised the question of the impact of ideology I take the opportunity to explore its play in the economics academy more generally. (shrink)

The three main kinds of theory in normative ethics, namely, consequentialism, deontology, and virtue ethics, are often presented as the ‘palette’ from which we may choose, or use as a starting point for an investigation. However, this way of doing ethics and philosophy, by the palette, may be leading some of us astray. It has led some to believe that all that there is to ethics, and to ethics of AI, is given in terms of these already devised petrified (...) categories of theory. It has also led others to abandon normative ethics and philosophy altogether and to resort to descriptive methods that are then used to justify action. I wish to argue that (1) we should not abandon traditional philosophical approaches, but (2a) this does not entail that the petrified palette should constitute the beginning of our philosophical investigations. Further, (2b) I recommend a non-methodological approach in which it is instead radical questions that spur these investigations, which arise through consideration of the practical actions (potential or otherwise) of machines and their programmers. The frame problem is the difficulty of explaining how non-magical systems think and act in ways that are adaptively sensitive to context-dependent relevance. Influenced centrally by Heideggerian phenomenology, Hubert Dreyfus has argued that the frame problem is, in part, a consequence of the assumption (made by mainstream cognitive science and artificial intelligence) that intelligent behaviour is representation-guided behaviour. Dreyfus' Heideggerian analysis suggests that the frame problem dissolves if we reject representationalism about intelligence and recognize that human agents realize the property (...) of thrownness (the property of being always already embedded in a context). I argue that this positive proposal is incomplete until we understand exactly how the properties in question may be instantiated in machines like us. So, working within a broadly Heideggerian conceptual framework, I pursue the character of a representation-shunning thrown machine. As part of this analysis, I suggest that the frame problem is, in truth, a two-headed beast. The intra-context frame problem challenges us to say how a purely mechanistic system may achieve appropriate, flexible and fluid action within a context. The inter-context frame problem challenges us to say how a purely mechanistic system may achieve appropriate, flexible and fluid action in worlds in which adaptation to new contexts is open-ended and in which the number of potential contexts is indeterminate. Drawing on the field of situated robotics, I suggest that the intra-context frame problem may be neutralized by systems of special-purpose adaptive couplings, while the inter-context frame problem may be neutralized by systems that exhibit the phenomenon of continuous reciprocal causation. I also defend the view that while continuous reciprocal causation is in conflict with representational explanation, special-purpose adaptive coupling, as well as its associated agential phenomenology, may feature representations. My proposal has been criticized recently by Dreyfus, who accuses me of propagating a cognitivist misreading of Heidegger, one that, because it maintains a role for representation, leads me seriously astray in my handling of the frame problem. I close by responding to Dreyfus' concerns. (shrink)

Does an affirmation of theistic evolution make the task of theodicy impossible? In this article, I will review a number of ancient and contemporary responses to the problem of evil as it concerns animal suffering and suggest a possible way forward which employs the ancient Jewish insight that evil—as resistance to God's will that results in suffering and alienation from God's purposes—precedes the arrival of human beings and already has a firm foothold in the nonhuman animal world long before humans (...) are ever tempted to go astray. This theological intuition is conferred renewed relevance in light of the empirical reality of evolutionary gradualism and continuity and in view of the recent findings of cognitive ethology. Consequently, I suggest that taking biological evolution seriously entails understanding “moral evil” as a prehuman phenomenon that emerges gradually through the actions and intentions of “free creatures” which—as evolutionary history unfolded—increasingly possessed greater levels of freedom and degrees of moral culpability. I have addressed a wide range of topics in my work, from fiction, the ontology of art, phenomenology, social ontology, and work on ordinary objects generally, through more recent work on metametaphysics, modality, and conceptual engineering. On the surface, these themes might seem to have little in common. Here, however, I trace back how this sequence of interests developed, as I kept stepping backwards from first-order ontological concerns, to ask what underlying presuppositions (about language, modality, and the nature of metaphysics) (...) led metaphysicians astray into a range of eliminativist and revisionary views, and into debates that often made metaphysics seem fruitless, epistemologically mysterious, and like a second-rate rival to the sciences. As my work has developed, I have aimed (partly inspired by work in phenomenology, ordinary language philosophy, and neo-pragmatism) to diagnose where much work in recent metaphysics has gone wrong. More importantly, I have sought to develop an alternative, positive view of what philosophy can do, and how we can do it, that makes philosophy clear, epistemologically transparent and relevant to human life. In epistemology and philosophy of science, there has been substantial debate about truth’s relation to understanding. “Non-factivists” hold that radical departures from the truth are not always barriers to understanding; “quasi-factivists” demur. The most discussed example concerns scientists’ use of idealizations in certain derivations of the ideal gas law from statistical mechanics. Yet, these discussions have suffered from confusions about the relevant science, as well as conceptual confusions. Addressing this example, we shall argue that the ideal gas law is best (...) interpreted as favoring non-factivism about understanding, but only after delving a bit deeper into the statistical mechanics that has informed these arguments and stating more precisely what non-factivism entails. Along the way, we indicate where earlier discussions have gone astray, and highlight how a naturalistic approach furnishes more nuanced normative theses about the interaction of rationality, understanding, and epistemic value. This paper will offer a systematic reconstruction of al-Ġazālī’s Sceptical Argument in his celebrated Deliverer/Delivered from Going Astray (al-Munqiḏ/al-Munqaḏ min al-Ḍalāl). Based on textual evidence, I will argue that the concept of certainty (yaqīn) in play in this argument is that of the philosophers—most notably Ibn Sīnā—and that it is firmly tied to demonstration (burhān) and hence to the materials of syllogism (mawwād al-qiyās). This will show that contrary to what many scholars believe, this Sceptical Argument is al-Ġazālī’s discovery (...) of a latent sceptical problem in Muslim philosophers’ epistemological theories based on Aristotle’s Posterior Analytics that escaped even the agile mind of aš-šayḫ ar-raʾīs Ibn Sīnā. This reconstruction will also shed some light on the widespread assumption that al-Ġazālī anticipates Descartes’s sceptical considerations in the First Meditation. I will argue that not only do the two thinkers use incompatible strategies to reach their respective sceptical conclusions, but both their conclusions and their use of God in refuting them are also essentially non-identical. The conclusion is that the two sceptical arguments are essentially different. (shrink)

Debate about the responsibilities of affluent people to act to lessen global poverty has dominated ethics and political philosophy for forty years. But the controversy has reached an impasse, with the main approaches either demanding too much of ordinary mortals or else letting them off the hook. In Distant Strangers I show how a preoccupation with standard moral theories and with the concepts of duty and obligation have led philosophers astray. I argue that there are serious limits to what (...) can be demanded of ordinary human beings, but that this does not mean we must abandon the moral imperative to reduce poverty. Drawing on findings from behavioral economics and psychology, I show how we can motivate better-off people to lessen poverty without excessively taxing their moral virtue. And I argue that this approach is not just pragmatically but morally appropriate. (shrink)

In this essay I present what is, I contend, the free-will problem properly thought through, or at least presented in a form in which it is possible to think about it without being constantly led astray by bad terminology and confused ideas. Bad terminology and confused ideas are not uncommon in current discussions of the problem. The worst such pieces of terminology are "libertarian free will" and "compatibilist free will." The essay consists partly of a defense of the thesis (...) that the use of these phrases by writers on the problem of free will can only generate conceptual confusion and partly of a formulation of the problem that does not make use of them. I contend that this formulation is neutral with respect to the historically important positions on free will (e. g., compatibilism and incompatibilism). (shrink)

Este trabalho analisa a repercussão social do cartaz do “Salão do Livro da Região Sul e Sudeste do Pará”, evento da Feira Pan-Amazônica do Livro de 2018, para compreender como o processo de resposta social (BRAGA, 2006) impôs uma mudança institucional por parte da Secretaria de Cultura do Estado. O país homenageado foi a Colômbia e a peça de divulgação destacava uma mulher negra carregando livros na cabeça, representação das palenqueras. O fato gerou repercussão nas redes sociais e na mídia (...) local e nacional. Os protestos voltaram-se contra a reiteração de uma imagem que inferioriza as mulheres negras, reproduzindo colonialidades de gênero, poder e saber. O corpuscompõe-se de postagens no Facebooke de matérias jornalísticas veiculadas em abril de 2018. Duas técnicas metodológicas foram usadas: a netnografia (RECUERO, 2012; KOZINETS, 2014) e a aplicação de um questionário online, por meio do Facebook e Whatsapp. (shrink)

What can fashionable ideas, blind faith, or pure fantasy possibly have to do with the scientific quest to understand the universe? In this essay I present what is, I contend, the free-will problem properly thought through, or at least presented in a form in which it is possible to think about it without being constantly led astray by bad terminology and confused ideas. Bad terminology and confused ideas are not uncommon in current discussions of the problem. The worst such pieces of terminology are “libertarian free will” and “compatibilist free will.” The essay consists partly of a defense of the thesis (...) that the use of these phrases by writers on the problem of free will can only generate conceptual confusion and partly of a formulation of the problem that does not make use of them. I contend that this formulation is neutral with respect to the historically important positions on free will (e.g., compatibilism and incompatibilism). (shrink)

Trust enters into the making of a virtuous person in at least two ways. First, unless a child has a sufficiently trusting relationship with at least one adult, it is doubtful that she will be able to become the kind of person who can form ethically responsible relationships with others. Infant trust, as Annette Baier has reminded us, is the foundation on which future trust relationships will be built; and when such trust is irreparably shaken, the adult into whom the (...) child grows may be forever cut off from intimacy. Second, a moral beginner must trust other people's moral judgment while she learns to be good. A child does not learn how to be good on her own. She follows the precepts and examples of others, absorbs the moral values of the community into which she has been born, and relies on others who, with luck, will not lead her astray but will turn out to be trustworthy in offering her guidance and correction. While there is some empirical evidence that children learn about morality better when given reasons in support of what they are being taught, part of what a child is being taught is what counts as a good reason. Thus, no moral beginner could be in a position to assess adequately the cogency of the reasons she given until she has progressed some distance in her education. Until that time, the beginner must rely on other people's judgment. That thrust enters into the making of a morally good person should thus be uncontroversial. I want to defend a much more controversial thesis: needing to trust other people's moral judgment is not just a stage we go through on the way to becoming morally virtuous. If the world of value is complex, and if our access to it is shaped by our experiences, then even among the morally mature there will continue to be a significant role for moral testimony and thus for trust. The critique of utilitarianism forms a crucial subplot in the complex analysis of social justice that John Rawls develops in his first book, A Theory of Justice.1 The weaknesses of utilitarianism indicate the need for an alternative theory, and at many stages of the argument the test for the adequacy of the new theory that Rawls elaborates is whether it can be demonstrated to be superior to the utilitarian rival. The account of social justice shifts in the transition to Rawls’s (...) second great book, Political Liberalism. The account of what is wrong with utilitarianism undergoes revision as well. In this essay I examine both the initial critique of utilitarianism and its transformation in Rawls’s later writings. To anticipate my conclusion: Rawls’s proposal that we should maximin rather than maximize leads to an interesting standoff. The argument for maximin is not compelling, but straight additive maximization of the utilitarian sort is revealed to be merely one possible function among many, any of which (for all we know) correct morality might instruct us to maximize. Rawls further urges that utilitarianism goes astray in taking the maximandum, the thing to be maximized, to be utility rather than primary social goods. The argument for primary social goods is not compelling, but it does not follow that utility alone is to be maximized. The espousal of the ideal of legitimacy in Political Liberalism does not affect these conclusions, and the arguments.. (shrink)
