People make different choices depending on which decision is the default option. In intertemporal choices, the default option is typically imposed externally. For example, people expect more for delaying the gain than are willing to pay for accelerating the future gain over the same period. We claim that apart from the external default, people’s choices are also influenced by the internal default such as the time perspective resulting in the reference point in the present. By manipulating the congruency between the (...) internal and external defaults, we show that incongruence between defaults decreases the strength of discounting of gains, but not of losses. Religious ethics was founded on a commitment to inclusion, welcoming projects from and about different religious and philosophical traditions. This paper argues that the increasing welcome of feminist ethics in the JRE also reveals a tension in the field between inclusion and critique: where feminist ethics is included as another tradition of ethical inquiry, its critical claims can be escaped by appeal to difference from the traditions it seeks to engage. The response to feminist critique should not be to applaud (...) its inclusion without responding to its claims. Where this occurs, religious ethicists must renegotiate the terms of inclusion and the borders of difference. Feminist critique thus requires a return to founding questions of this journal, and the field, about the terms on which different traditions can be discussed and engaged in a common, critical conversation of religious ethics. Turn-taking – the coordinated and efficient transition between the roles of sender and receiver in communication – is a fundamental property of conversational interaction. The turn-taking mechanism depends on a variety of linguistic factors related to syntax, semantics and prosody, which have recently been subject to vigorous research. This contrasts with the relative lack of studies on nonverbal visual signals and cues that can be involved in taking turns at talking. In this paper, we consider the relation between turn-transitions and (...) adaptors: a class of nonverbal behaviors prototypically involving touching one’s own body or manipulating external objects. We recorded 10 semi-scripted conversations between a total of 12 subjects and annotated the material for discrete adaptors and turn borders. We found that participants produced discrete adaptors significantly more frequently close to floor transfers. Our result goes against the long-standing tradition of interpreting adaptors as unrelated to speech and, more generally, communicative interaction. (shrink)

Using randomly generated sequences of binary events we asked participants to make predictions about the next event. It turned out that while predicting uncertain events, people do not behave unsystematically. Our research identifies four types of relatively consistent strategies for predicting uncertain binary events: a strategy immune to short-run sequential dependencies consisting of the persistent prediction of long-run majority events, hereafter called the long-run momentum strategy ; a strategy immune to short-run sequential dependencies consisting of the persistent prediction of long-run (...) minority events, called the long-run contrarian strategy ; a strategy sensitive to short-run sequential dependencies consisting of the prediction of short-run majority events, called the short-run momentum strategy ; and a strategy sensitive to short-run sequential dependencies consisting of the prediction of short-run minority events, called the short-run contrarian strategy . When the character of events remains unknown, the most common strategy is the short-run momentum strategy. With the increase of a perceived randomness of the situation, people tend more often to use the short-run contrarian strategy. People differ in their general beliefs about the continuation or reversal of a trend in various natural and social processes. Trend believers, when facing sequences of binary events commonly perceived as random, tend to use momentum strategies, whereas those who believe in the trend's reversal tend to use contrarian strategies. This paper analyses the international media coverage of the dispute surrounding the pardons the Polish President granted in 2015 to two politicians, arrested almost a decade later. However political this case has become, it is underlain by a specific interpretive problem concerning the presidential pardon power under the Constitution, particularly whether it can be exercised before a final conviction (the so-called ‘individual abolition’). This question has long been controversial in scholarship and, in recent years, has been addressed by top Polish (...) courts, passing conflicting rulings. Attempting to probe into the intersection of journalism, politics, law and linguistics, this paper evaluates the issue’s portrayal in 37 articles published on major news websites around the time of the arrest. It is argued that when reporting local legal news, international media engage in a dual translation, rendering legal communications in one language into media communications in another. While ‘lossless’ transfer cannot be expected, this research shows that certain limits should not be crossed to maintain journalistic standards. In particular, most articles entirely omit the scholarship and rulings confirming the validity of the pardons. Consequently, readers are not given an opportunity to become aware of all relevant facts and perhaps seek further information. On the positive side, it has been found that simple and accessible language does not necessarily mean material distortions in the coverage of legal issues. The research thus suggests that reporting domestic legal news for international audiences requires understanding the source context, conscious language use and a reliable selection of information. The question whether international law is a system is one of the modern topics discussed by specialists of international law. The text of P. Saganek poses this question with respect to the rules on international responsibility. The two aims are to establish whether the rules on state responsibility are a system themselves and whether they may prima facie support the idea of international law as such a system. The two prima facie answers are positive. Every violation of international law gives (...) rise to state responsibility if it can be attributed to a state and no circumstance precluding wrongfulness is in place. In this sense the rules on state responsibility form a sub-system supporting the thesis on the systemic nature of international law. On a closer analysis one can encounter several doubts as to both answers. Paradoxically those rules are too ideal, too systemic. The author – without denying the necessity of several if not the majority of the identified rules – refers to a tendency of presenting as law some non-binding documents prepared by expert groups. This is a part of a wider process of ‘paper-law’. In this sense expert groups engage in ‘creating the language’ in which the true subjects of international law are expected to speak. (shrink)

There has been a growing interest in research concerning memory modification technologies (MMTs) in recent years. Neuroscientists and psychologists are beginning to explore the prospect of controllable and intentional modification of human memory. One of the technologies with the greatest potential to this end is optogenetics—an invasive neuromodulation technique involving the use of light to control the activity of individual brain cells. It has recently shown the potential to modify specific long-term memories in animal models in ways not yet possible (...) with other MMTs. As the therapeutic potential of optogenetics has already prompted approval of the first human trials, it is especially important and timely to consider the opportunities and dangers this technology may entail. In this article, we focus on possible consequences of optogenetics as an MMT by analyzing fundamental threats potentially associated with memory modifications: the potential disruption of personality and authenticity. The following essay attempts to shed some light on Michael Longley’s poems about birds, which form a fairly complicated network of mutual enhancements and cross-references. Some of them are purely descriptive lyrics. Such poems are likely to have the name of a given species or a specific individual representative of that species in the title. Others make references to birds or use them for their own agenda, which often transcends the parameters of pure description. Sometimes birds perform an evocative function, (...) prompt the poet to explore the murky mysteries of iniquity, judge human affairs from the avian vantage, or raise ecological problems. Most of the time, however, Longley is careful not to intrude upon their baffling otherness. Many of his bird poems are suffused with an aura of subtle yet suggestive eroticism, a conflation of the avian and the amorous. (shrink)

Przedmiotem niniejszej pracy jest analiza rozprawki An Essay Concerning the Use of Reason in Propositions, The Evidence whereof depends upon Human Testimony (Londyn 1707, II wyd. 1709) brytyjskiego filozofa Anthony’ego Collinsa (1676-1729). Analiza ta prowadzi do odkrycia trudności bronionego w niej stanowiska, polegających na niejasności użytej terminologii, niejednoznaczności tezy głównej, zgodnie z którą warunkiem koniecznym uznania twierdzenia jest jego zgodność z rozumem, oraz niewystarczalności jej podanego w Eseju uzasadnienia. Zarysowano również kontekst filozoficzny i historyczny tego rzadko analizowanego dzieła.

One of the most common questions in today’s cognitive studies is the one regarding embodied cognition. The answer to this question draws our attention to many factors, including bodily actions, which also work to embody cognition. With this in mind, enactivism is included in discussions of embodiment.

Researchers of non-human animal emotions tend to defend some forms of anthropomorphism and seek ways to make it more critical, self-aware, and useful for scientific purposes. I propose that to achieve this goal, we need first to conduct a Kantian investigation into the deeper structure of anthropomorphism. I argue that we can distinguish at least three levels of anthropomorphising: a narrative level, a cognitive level and an in-between, metatheoretical level which is the deeper structure determining how we anthropomorphise. Because the (...) current debate tends to focus either on the narrative level or on the cognitive level, this paper concentrates on the metatheoretical level, discusses its role in emotion research, the possible errors it may cause, and how we can work on it, drawing on predictive processing-based theories of emotions and an evolutionary approach. The key to being critical in anthropomorphism is to be aware of the complexity of this whole structure, as well as to be able to challenge and put into question all and any of its elements. (shrink)

The aims of this paper are to: (1) identify the best framework for comprehending multidimensional impact of deep brain stimulation on the self; (2) identify weaknesses of this framework; (3) propose refinements to it; (4) in pursuing (3), show why and how this framework should be extended with additional moral aspects and demonstrate their interrelations; (5) define how moral aspects relate to the framework; (6) show the potential consequences of including moral aspects on evaluating DBS’s impact on patients’ selves. Regarding (...) (1), I argue that the pattern theory of self can be regarded as such a framework. In realizing (2) and (3), I indicate that most relevant issues concerning PTS that require resolutions are ontological issues, including the persistence question, the “specificity problem”, and finding lacking relevant aspects of the self. In realizing (4), I identify aspects of the self not included in PTS which are desperately needed to investigate the full range of potentially relevant DBS-induced changes—authenticity, autonomy, and responsibility, and conclude that how we define authenticity will have implications for our concept of autonomy, which in turn will determine how we think about responsibility. Concerning (5), I discuss a complex relation between moral aspects and PTS—on one hand, they serve as the lens through which a particular self-pattern can be evaluated; on the other, they are, themselves, products of dynamical interactions of various self-aspects. Finally, I discuss (6), demonstrating novel way of understanding the effects of DBS on patients’ selves. (shrink)

We investigated the effect of monetary rewards on the rate of pain discounting. Our aim, also, was to understand the effect of previous painful dental experiences on the rate of discounting pain. Two groups completed a discounting task. In the first group, delayed pain was weaker than immediate pain, and in the second group delayed pain was stronger than immediate pain. Two conditions were studied: pain was either accompanied by a monetary reward or not. We found that people preferred immediate (...) pain when it was weaker than delayed pain; however, when delayed pain was stronger than immediate pain, there was no clear preference. In both groups the preference for immediate pain was higher when pain was accompanied by a monetary reward. Previous painful experiences were not related to the rate of discounting. It was concluded that the preference for delayed pain depends on the intensity of pain, and it can be modified by rewards that accompany pain. (shrink)

Although it is a welcome and timely idea, the behavioural constellation of deprivation needs to explain how the development of personal control, trust, and perception of future risk is mediated through relationships with parents. Further, prioritising the present over the future may not be the essence of this constellation; perhapsnotquite being, either in the presentorin the future, is a better depiction.

This article is an attempt to show Karl Marx from the humanistic perspective in order to prove that it is unauthorized to blame him for all the evil of totalitarianism. The semantic content of the presented material includes three key areas. The first figure refers to Karl Marx, his personal characteristics and activity. Secondly, a question of philosophical foundations on which the thought of Marx is set. The third aspect of the problem concerns his economic theory. The aim of the paper is to present and analyze the interpretation of the Enlightenment which has recently been proposed by Jonathan Israel, with the focus on its philosophical aspect as opposed to the historical one. The paper consists of two parts. The task of the first part is reconstructive: it attempts to explore Israel’s most characteristic statements concerning the Enlightenment. The second and more extensive part has a polemical character: it endeavours to furnish the reader with an answer to (...) the question of the degree to which the understanding of the Enlightenment proposed by Israel can be considered a satisfying interpretation of this period. The paper suggests that the main problem which may undermine Israel’s account of the Enlightenment is associated with the unduly selective interpretation of Spinoza’s philosophy and its position in the intellectual society of that time. Lewis’ Best System Analysis of laws of nature is often criticized on the grounds that what it means to be the “best” system is too subjective for an analysis of lawhood. Recent proponents of the BSA have embraced the view’s close connection to the particulars of scientific practice despite the objection. I distinguish two compatible versions of the objection: one opposed to mind or subject dependence and the other opposed to relativity. The BSA can answer both. Answering the anti-relative version (...) of Armstrong’s objection requires that the BSA be no more or less relative than is required by scientific practice. A spectrum of relativity is introduced with extremes of minimally and maximally relative variants of the BSA, and extant variants of the BSA are located on it. Lastly, I sketch what work remains to be done with respect to Armstrong’s objection by BSA proponents depending on where in the spectrum of relativity they hope to locate their view. (shrink)

The book offers a comprehensive philosophical reconstruction of the work of Edmond Jabès─a Jewish-French poet, modern Kabbalist and thinker. It is a starting point for an enquiry into the nature of the encounter between Judaism and modern philosophy. Philosophically, Judaism becomes a re-constructed tradition: a field played with by modern forces.

Memory modification technologies (MMTs)—interventions within the memory affecting its functions and contents in specific ways—raise great therapeutic hopes but also great fears. Ethicists have expressed concerns that developing and using MMTs may endanger the very fabric of who we are—our personal identity. This threat has been mainly considered in relation to two interrelated concerns: truthfulness and narrative self‐constitution. In this article, we propose that although this perspective brings up important matters concerning the potential aftermaths of MMT utilization, it fails to (...) tell the whole story. We suggest that capturing more tangible potential consequences of MMT use, namely, its psychological ramifications is crucial both in ethical considerations and in making decisions regarding the permissibility of such interventions. To this end, we first examine what current MMTs are capable of and what are the prospects of emerging MMTs. Subsequently, we outline the relationship between memory and personal identity; specifically, we indicate that concepts of self‐defining memories and narrative identity are crucial to considering how MMTs may influence one's psychological functioning. On this basis, we analyze potential consequences of narrative disruption that may be the result of the use of MMTs; more precisely, we consider its potential effects on mental health, well‐being, and personal agency, and outline the ethical dilemmas that decision‐makers face in this context. We conclude by considering the broader cultural context that may have influence on policymaking regarding permissibility of memory modification interventions. (shrink)

Sleep spindles are frequently studied for their relationship with state and trait cognitive variables, and they are thought to play an important role in sleep-related memory consolidation. Due to their frequent occurrence in NREM sleep, the detection of sleep spindles is only feasible using automatic algorithms, of which a large number is available. We compared subject averages of the spindle parameters computed by a fixed frequency (11-13 Hz for slow spindles, 13-15 Hz for fast spindles) automatic detection algorithm and the (...) individual adjustment method (IAM), which uses individual frequency bands for sleep spindle detection. Fast spindle duration and amplitude are strongly correlated in the two algorithms, but there is little overlap in fast spindle density and slow spindle parameters in general. The agreement between fixed and manually determined sleep spindle frequencies is limited, especially in case of slow spindles. This is the most likely reason for the poor agreement between the two detection methods in case of slow spindle parameters. Our results suggest that while various algorithms may reliably detect fast spindles, a more sophisticated algorithm primed to individual spindle frequencies is necessary for the detection of slow spindles as well as individual variations in the number of spindles in general. The paper attempts to construct a theoretical account of what melancholy—in a psychoanalytical and cultural sense—may mean for jurisprudence. It argues that the map of relations and displacements between the object and the subject that is associated with melancholy in different psychoanalytical approaches can be fruitfully adopted for understanding of normativity. Based on a thorough re-reading of Freud’s Trauer und Melancholie, it suggests that there is an irremovable component of melancholy contained in the primordial act of separation of normativity from (...) non-normative reality. This interpretation is confronted with Kelsen’s Theory of Pure Law in order to analyse in which respect the momentum of self-sufficiency within normativity entails structures of melancholy. Kelsen’s concept of ‘effectiveness’ is proposed as a key link which explains how melancholic withdrawal allows the law to interact with reality. Then the paper discusses Agamben’s theory of applicability and of the state of exception to demonstrate the law’s melancholic trap. Finally, the paper draws on Lacanian and post-Lacanian approaches to melancholy in order to investigate how melancholic momentum is inherent in the very structure of the law’s validity. (shrink)

Business ethics is usually seen as set of communicates addressed to representatives of the sphere of economy. Meanwhile this attitude towards the kind of knowledge seams to be false. There are two points which justify this opinion. First of them concerns the relation between legal and ethical perspectives useful to evaluate business phenomena. Both axiological systems (in indicated background) are complementary to one another. It tends to the second argument. The relation between low and ethics makes necessary to indicate the (...) public sphere as the place, where managers together with citizens and politicians – day by day – take part in debate about rules of social and economic correctness each of them. In this short paper I consider Professor Bence Nanay’s suggestion that representationalism can be supported by the theory of tropes. I argue that from a philosophical point of view such a support is nevertheless not very strong.

W niniejszej pracy staram się osłabić gruntowną krytykę Dawida Hume’a dotyczącą „teizmu empirycznego” : a) odróżniam „realizm empiryczny”, który przypisuję Kleantesowi, od „idealizmu empirycznego”, koncepcji, co istotne, nie stwarzającej dodatkowych trudności teoretycznych, oraz b) wykazuję, że jeżeli przez „teizm empiryczny” rozumieć się będzie także to drugie stanowisko, ów teizm okaże się w istocie niepodatny na część zarzutów wysuniętych przez Hume’a.

From the Will of Knowledge to the Care-of-the-Self. Michel Foucault’s Philosophy of the Subject 1976–1982 The following article is an exploration of the intellectual journey of the French philosopher Michel Foucault in its latest period, from the Will to Knowledge, first book of the History of Sexuality, up to the later idea of care-of-the-self. The idea of the care-of-the-self is treated here as the culmination of Foucault’s philosophy, as well as its most mature expression. Maturity here means that, according to (...) this concept, the subject is not perceived as the passive outcome of games played between the forces of knowledge and power, as it was presented in the writings of Foucault from the 1960s and 1970s, but, thanks to his own actions, directed at himself, so called practices of the Self, the subject is able to create itself, in separation from the outside influences that bind him. In the context and in contrast to the idea of the care of self is the idea of self-knowledge, a solely intellectual perspective, for which – according to Foucault – the care of the self was abandoned by philosophers for many centuries. A part of the goal of this study is to demonstrate that the concept of the care of the self was introduced through a conceptual evolution, in which certain ideas, gradually changing their meanings, morphed into other ideas, to arrive at the point where the ancient Greek idea of epimeleia heautou, care of the self, was necessary to be introduced. The principal sources for Foucault’s analyses were the writings of Stoics and Epicureans from the 1st and 2nd centuries A.D., as well as the Plato’s dialogue The First Alcibiades. A method of close-reading of the published works of Foucault and the transcripts of his lectures from a period of 1976 to 1982 was used to prove the above mentioned argument. The central goal of this thesis was largely accomplished – it has been demonstrated that Foucault, by examining various Stoic and Epicurean practices of the Self, showed that the subject is not determined to be formed solely as a result of the games of knowledge and power. Thanks to the concept of care of the self, Foucault had drawn a much larger margin of freedom for the individual, than he did in his earlier works. (shrink)
