The susceptibility of Habermas' socio-political theory (and notion of constitutional patriotism) to the charge of motivational impotence can be traced to a problem in the way in which he conceives of discursive practical reason. By implicitly constructing the notion of discursive rationality in contrast to, and in abstraction from, the rhetorical and affective components of language use, Habermas' notion of discursive practical reason ends up reiterating the same binaries — between reason and passion, abstract and concrete, universal and particular — (...) that provide the tacit parameters used by his critics to motivate the charge of impotence. Habermas' project of reconciling social integration and political rule with freedom can succeed only by rebuilding his discourse-ethical theory of politics upon a notion of discursive practical reason that overcomes these philosophy/rhetoric binaries common to both camps. The theme of consent is, without question, associated with the origins of bioethics and is one of its most significant paradigms that has remained controversial to the present, as is confirmed by the proposal for its debate during the last World Congress of Bioethics. Seen broadly as a compulsory minimum procedure in the field of biomedical ethics, even today it keeps open the issues that it has raised from the start: whether it is really necessary and whether it can be (...) proven to be effective. My goal will be to attempt to determine the most genuine and relevant meaning of consent, going back from its present dominant normative meaning and, from there, identifying or simply sketching other possible forms of its expression in the world we live in, so as to justify its pertinence and validity. This objective will involve three stages: (1) ‘Consent’ as a privileged paradigm of bioethics (the ethical-juridical sense), (2) The symbolic value of ‘consent’ (the social-cultural sense), and (3) ‘Consent’ as promotion of the human (the humanistic-personal sense) .It is concluded that the common notion of normative consent is not the only one, nor does it hold universal validity; that, from a historical-cultural perspective, new expressions of consent appear, adapted to different social contexts and to possibly be implemented in developing countries; and, finally, that consent is strictly indispensable in situations of extreme dependence, in its symbolic relational character, in as much as it promotes ethical relationships among strangers and ensures that they remain so. Durante o período colonial, milhares de artefatos culturais foram levados do continente africano pelos europeus. Nos últimos anos, a restituição de bens culturais tem chamado atenção de teóricos, governos, órgãos internacionais e regulamentações jurídicas. Contudo, há pouca informação sobre a forma como essa realidade se apresenta e é discutida. Este ensaio é uma proposta de investigação sobre a restituição dos bens culturais retirados no contexto do colonialismo, considerando a relação de países europeus com países africanos. Trata-se de analisar a constituição (...) do regime internacional de proteção e restituição do patrimônio cultural, seus princípios, limites e possibilidades, tendo em vista alguns casos de processos restitutivos realizados a partir da década de 1990 e suas narrativas. Em meio aos debates acerca da descolonização das relações entre ex-metrópoles e ex-colônias e os efeitos ainda presentes do colonialismo, este trabalho põe em marcha uma proposta teórico-metodológica que aposta no papel da memória e sua potência no que toca ao direito humano à cultura e à identidade. The text analyses rituals as endeavours to preserve the identity of a people or a portion of a people. Rituals present or re-present the supposed common history of all the migrants. Social memory and history then tend to merge and to forget... forgetfulness is the driving force behind the writing of history. Particularly critical is the moment when the migration starts, because the need to adapt to new conditions as well as to maintain what is represented as their social identity (...) makes dual – and at times contradictory – demands on the migrants’ imagination. This article analyzes the issue of organizational transparency through the lens of Thomas Aquinas’ ethics. It provides moral justification for current claims about corporate transparency and sheds light on the ethical values and virtues affecting information disclosure decisions. Transparency is conceptualized as an informational mechanism necessary for performing the virtues of truthfulness, justice, and prudence. This article extends the organizational transparency and corporate social responsibility literatures by providing an alternative moral justification grounded in virtue-based theory, which extends our understanding of (...) the information disclosure decisions made by management. Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

This paper stems from the current global worsening of the scarcity of resources for healthcare, which will deepen even more in future public emergencies. This justifies strengthening the reflection on the allocation of resources which, in addition to considering technical issues, should also involve ethical concerns. The two plans in which the allocation of resources develops—macro and micro—are then systematized, both requiring the identification of ethical criteria for the respective complex decision-making. Then, we describe how the complexity at the macro (...) level focuses on the joint consideration of the rectitude of the principles, the goodness of the ends, and the integrity—respectively the deontological, teleological, and procedural perspectives; and at the micro level, it focuses in prioritizing people, which can result in the exclusion of some, as happened with the elderly during peaks of COVID-19. The main objective of this article is to show that, in public health emergency situations, in which the daily criteria for prioritizing access to health care are not efficient, it is possible not only to ration the available means but also to rationalize them. We argue that rationing and rationalization are different concepts, entail different consequences, have different ethical foundations, and draw different guidelines for patient care. We apply them to the distribution of intensive care and vaccines to the elderly thus demonstrating the ethically legitimate domain of implementation of each of these two prioritization criteria. We conclude that rationalization respects more strictly the core ethical principles of our common morality. (shrink)

The notion of “integrity” is currently quite common and broadly recognized as complex, mostly due to its recurring and diverse application in various distinct domains such as the physical, psychic or moral, the personal or professional, that of the human being or of the totality of beings. Nevertheless, its adjectivation imprints a specific meaning, as happens in the case of “scientific integrity”. This concept has been defined mostly by via negativa, by pointing out what goes against integrity, that is, through (...) the identification of its infringements, which has also not facilitated the elaboration of an overarching and consensual code of scientific integrity. In this context, it is deemed necessary to clarify the notion of “integrity”, first etymologically, recovering the original meaning of the term, and then in a specifically conceptual way, through the identification of the various meanings with which the term can be legitimately used, particularly in the domain of scientific research and innovation. These two steps are fundamental and indispensable for a forthcoming attempt at systematizing the requirements of “scientific integrity”. (shrink)

This article explores Hannah Arendt's insights into the forms of social control operating especially in democracies, together with the possibility of resistance to such control. Since the way in which one defines freedom informs one's understanding of the techniques that suppress, regulate, and modify behaviour, the article begins by sketching Arendt's notion of freedom, and compares this to its liberal counterpart. That discussion leads to Arendt's conception of power, whose corollary is freedom, and whose suppression amounts to control. The institutional (...) and ideological infrastructure that accompanies the encroachment of ?the social? ? which Arendt links to the hegemony of liberalism ? is conceived as rendering the individual both powerless and apathetic. The article concludes with suggestions regarding resistance to modern forms of control, viewing Arendt's ontology as a source of tenable strategies for the deepening of democracy. (shrink)

Resumo: O ingresso de estudantes surdos no ensino superior tem ampliado nos últimos anos, e com isso, a inclusão desses estudantes, passa a ser um desafio. Nesse sentido, objetivamos neste estudo analisar a sua inclusão no ensino superior em Portugal. O estudo compreende a trajetória de três estudantes surdos vinculados a duas instituições de ensino superior, e cuja comunicação se estabelece pela Língua Portuguesa. Como forma de levantamento de dados, foram realizadas entrevistas semiestruradas, nas modalidades presencial e por videoconferência. Salientamos (...) que a escolha pela língua oral utilizada durante a entrevista foi dos estudantes, uma vez que estes alunos utilizam na maior parte do seu tempo a Língua Portuguesa, na sua vertente oral e escrita. Os resultados apontam para a importância de repensar a oferta de ensino permeado pela presença da Língua Gestual Portuguesa (LGP) nas atividades acadêmicas tendo em conta as principais necessidades apontadas pelos estudantes que participaram neste estudo: a) presença do intérprete de LGP nas salas de aula; b) colaboração dos professores da educação superior; c) interações sociais na universidade, e d) inclusão de estudantes surdos, o que demonstra a importância de repensar as práticas inclusivas para estudantes universitários surdos nas Instituições que frequentam. Deaf students in Higher Education in Portugal - a reflection on inclusion Abstract: The enrollment of deaf students in higher education has increased in recent years, and with that, the inclusion of these students, becomes a challenge. In this sense, we aim in this study to analyze its inclusion in higher education in Portugal. The study comprises the trajectory of three deaf students linked to two higher education institutions, and whose communication is established by the Portuguese Language. For data collection, semi-structured interviews were conducted, in person and by video conference. We emphasize that the choice of the oral language used during the interview was of the students, since these students use most of their time the Portuguese language, in its oral and written components. The results point to the importance of rethinking the teaching offer permeated by the presence of the Portuguese Sign Language (PSL) in academic activities taking into account the main needs pointed out by the students who participated in this study: a) presence of the PSL interpreter in the classroom; b) collaboration of higher education teachers; c) social interactions at the university, and d) inclusion of deaf students, which demonstrates the importance of rethinking inclusive practices for deaf students in the Institutions they attend. En este sentido, nuestro objetivo en este estudio es analizar su inclusión en la educación superior en Portugal. El estudio comprende la trayectoria de tres estudiantes sordos vinculados a dos instituciones de educación superior, cuya comunicación está establecida por la lengua portuguesa. Como medio de recopilación de datos, se realizaron entrevistas semiestructuradas, en persona y por videoconferencia. Destacamos que la elección del idioma portugués utilizado durante la entrevista fue de los estudiantes, ya que estos estudiantes utilizan la mayor parte de su tiempo el idioma portugués, en sus aspectos oral y escrito. Los resultados apuntan a la importancia de repensar la oferta docente permeada por la presencia de la Lengua de Signos Portuguesa (LSP) en las actividades académicas teniendo en cuenta las principales necesidades señaladas por los estudiantes que participaron en este estudio: a) presencia del intérprete LSP en las aulas; b) colaboración de profesores de educación superior; c) interacciones sociales en la universidad, y d) inclusión de estudiantes sordos, lo que demuestra la importancia de repensar las prácticas inclusivas para los estudiantes universitarios sordos en las Instituciones a las que asisten. This study investigates whether employees attribute different motives to their organization's corporate social responsibility efforts and if these motives influence employee performance. Specifically, we investigate whether employees could distinguish between intrinsic and extrinsic CSR motives by surveying 229 employee–supervisor dyads from various industries , and the impact of these perceptions on in-role and extra-role performance of subordinates. We found that employee task performance increases when employees attribute both intrinsic and extrinsic motives for CSR. Moreover, when employees perceive that their organization (...) invests in a CSR practice that is both intrinsic and extrinsic, they also tend to exert extra effort in their work. Biomedical research has a strong impact on a country’s scientific-technological and socioeconomic development. It can make a significant contribution at three different levels: promotion of public health; the exchange of knowledge within the scientific community; and economic/ financial profitability. Africa only attracts ~3.3% of the world’s clinical research. This small proportion is due to, among several factors, the absence of two fundamental aspects: specific robust legislation and capacity for regulatory and ethical evaluation. There are five Portuguese- speaking African countries – (...) Angola, Cabo Verde, Guinea-Bissau, Mozambique and São Tomé and Príncipe. Despite presenting different degrees of clinical research development, these countries show a common serious insufficiency in the minimum conditions necessary for hosting, collaborating or leading biomedical research projects. These countries are also excluded from the support of international organisations for capacity building because of the language barrier. The Biomedical Ethics and Regulatory Capacity Building Partnership for Portuguese-Speaking African Countries project has developed methods to build capacity and partnership through research on national law, comparisons with international standards and by issuing recommendations at a national level. Through collaborative intensive training, trainees are taught to become educators at a national level. This, in turn, creates a sustainable impact at country level. BERC-Luso is a pioneering project, owing to a combination of innovative features. The partnership project: was developed exclusively in Portuguese; involves a large number of African countries, and national and international institutions; has been further enhanced by the diversity and complementarity of its action plans; and has also benefited from a broad participatory methodology based on resolution of recipients’ problems by the recipients themselves. Gender imbalances persist throughout the world, particularly at leadership level, and equally also visible in the case of trade unions. This article focuses on CGTP-IN, the largest Portuguese trade union confederation, and sets out analysis incorporating both figures from this organisation and accounts by female members of CGTP-IN unions. Results confirm the existence of gender asymmetries, especially at the highest leadership levels. Analysis of the discourses of these women leaders reveals some awareness of the influence of gender on professional relations, (...) placing women at a disadvantage, especially where leadership is concerned. Furthermore, four reasons driving the persistence of these gender asymmetries in trade union leadership/decision-making roles were identified: family responsibilities, gendered professional segregation, masculine trade union cultures and traditional gender stereotypes. Nevertheless, the interviewees resist to means of affirmative action such as gender quotas, and instead prefer to prioritise education and raising awareness around gender equality. (shrink)

ABSTRACT In the current debate between scientific realism and empiricism, both sides seem to embrace some sort of structuralism as an important component of their descriptions of science. The structural realism is generally presented in two versions: one ontic and the other epistemic. It has been argued that that epistemic structural realism is close, if not identical, to a Kantian approach. We aim to show that this is not the case, since ESR, being fundamentally a realist position, cannot be fully (...) consistent with a transcendental approach. Such a position is better called transcendental structuralism, an alternative that we believe is worth being investigated on its own. In this paper, we will take Henry Allison's interpretation of transcendental idealism as a starting point to establish the distinctions between ESR and TS.RESUMO No debate atual entre realismo científico e empirismo, ambos os lados parecem abraçar algum tipo de estruturalismo como um componente importante de suas descrições sobre a ciência. O realismo estrutural é geralmente apresentado em duas versões: uma ôntica e outra epistêmica. Tem-se argumentado que o realismo estrutural epistêmico, por sua vez, é próximo, se não idêntico, a uma abordagem kantiana. Nosso objetivo neste artigo é mostrar que esse não é o caso. Sendo o ESR fundamentalmente uma posição realista, queremos defender que ele não pode ser totalmente compatível com uma abordagem transcendental. Uma posição kantiana mais coerente é aqui defendida sob o nome de estruturalismo transcendental. Neste artigo, partiremos da interpretação de Henry Allison do idealismo transcendental para estabelecer as devidas distinções entre ESR e TS. (shrink)

The philosopher Hannah Arendt distinguishes between making and doing politics. To make politics is to behave strategically like one is playing a chess game, in hopes of being able to control the results. Naomi Nagata opted to get her hands dirty by making politics. Politics is motivated by a love of the world and of being part of it. Naomi goes back and forth between doing and making politics, as though politics were some kind of dance. Naomi's previous partner, Inaros, (...) and current one, Holden, symbolize her relationship with politics and her search for a better way. The strategic attempt by Holden and the crew of the Rocinante to destroy uncertainty, as represented by the protomolecule, turned out to be a bad replacement for transparency, dialogue, and sharing responsibility. Buscamos neste artigo realizar uma análise sobre os termos normalidade, anormalidade, corporalidade central e periférica através do filme “Pieles” do diretor espanhol Eduardo Casanova. Para realizar este trabalho utilizamos a metodologia bibliográfica e análise fílmica. Destarte, apresentamos a descrição sobre o filme e algumas personagens, desenvolvemos uma discussão teórica e fechamos com análises sobre o filme e as considerações finais. Concluímos que não são as diferenças corpóreas, sejam elas anomalias ou mutações congênitas que definem os lugares e funções desses corpos (...) diferentes na sociedade, mas sim os padrões, normas e convenções construídas histórico-socialmente. A relação entre patroas e empregadas constitui uma privilegiada situação para a discussão sobre os conflitos de gênero e classe, uma vez que está inserida em um contexto considerado essencialmente feminino, o ambiente doméstico. Diante deste cenário, Preuss (1997) e Kofes (2001) realizaram, em diferentes épocas, estudos que exploravam esta relação. Suas pesquisam evidenciam que os conflitos gerados entre patroas e empregadas domésticas são um reflexo da disputa entre as classes pelo domínio do poder simbólico. Com base nos resultados obtidos (...) pelas autoras e utilizando o conceito de poder simbólico do teórico Pierre Bourdieu, é feito um estudo da representação das classes nas tramas das telenovelas Cheias de Charme e Avenida Brasil exibidas pela Rede Globo em diferentes horários no ano de 2012. L’un des philosophes les plus importants de l’histoire, Friedrich Nietzsche, est presque ignoré par les physiciens. L’auteur qui a déclaré la mort de Dieu au xixe siècle était enthousiasmé par la science, principalement durant la deuxième partie de son œuvre. À l’aide de la notion physique de force, Nietzsche a créé son concept de volonté de puissance. En pensant à la conservation de l’énergie, le philosophe allemand a eu une certaine inspiration pour créer son concept de l’éternel retour. Dans cet (...) article, on souligne certaines influences de la physique sur Nietzsche et on discute de l’actualité de sa position épistémologique—le perspectivisme. À partir du concept de volonté de puissance, je propose que le perspectivisme conduise à l’interprétation où la physique et la science en général sont considérées comme un jeu. (shrink)

In spite of successful tests, the standard cosmological model, the $$\varLambda$$ CDM model, possesses the most problematic concept: the initial singularity, also known as the big bang. In this paper—by adopting the Kantian difference between to think of an object and to cognize an object—it is proposed a degree of scientificity using fuzzy sets. Thus, the notion of initial singularity will not be conceived of as a scientific issue because it does not belong to the fuzzy set of what is (...) known. Indeed, the problematic concept of singularity is some sort of what Kant called the noumenon, but science, on the other hand, is constructed in the phenomenon. By applying the fuzzy degree of scientificity in cosmological models, one concludes that cosmologies with a contraction phase before the current expansion phase are potentially more scientific than the standard model. At the end of this article, it is shown that Kant’s first antinomy of pure reason indicates a limit to our cosmological models. (shrink)
