Justice, Rights, and Tort Law.M. E. Bayles & Bruce Chapman - 1983 - Springer Verlag.
The essays in this volume are the result of a project on Values in Tort Law directed by the Westminster Institute for Ethics and Human Values. We are indebted to the Board of Westminster Col lege for its financial support. The project involved two meetings of a mixed group of lawyers and philosophers to discuss drafts of papers and general issues in tort law. Beyond the principal researchers, whose papers appear here, we are grateful to John Bargo, Dick Bronaugh, Craig (...)

    Texte, discours, cognition.Guy Achard-Bayle - 2018 - Semiotica 2018 (223):71-86.

  5. Pierre Bayle: Dialogues of Maximus and Themistius.Pierre Bayle & Michael W. Hickson - 2016 - Leiden, Netherlands: Brill's Texts and Sources in Intellectual History 256/18.
An English translation of Pierre Bayle's posthumous last book, Entretiens de Maxime et de Themiste (1707), in which Bayle defends his skeptical position on the problem of the evil. This book is often cited and attacked by G.W. Leibniz in his Theodicy (1710). Over one hundred pages of original philosophical and historical material introduce the translation, providing it with context and establishing the work's importance.

  7. Character, purpose, and criminal responsibility.Michael D. Bayles - 1982 - Law and Philosophy 1 (1):5 - 20.
This paper explores analyzing criminal responsibility from the Humean position that blame is for character traits. If untoward acts indicate undesirable character traits, then the agent is blameworthy; if they do not, then the actor is not blameworthy — he has an excuse. A distinctive feature of this approach is that that voluntariness of acts is irrelevant to determining blameworthiness. This analysis is then applied to a variety of issues in criminal law. Mens supports inferences to character traits, and the Humean (...)

Historical and Critical Dictionary: Selections.Pierre Bayle & Craig Brush - 1991 - Hackett Publishing Company.
Richard Popkin’s meticulous translation--the most complete since the eighteenth century--contains selections from thirty-nine articles, as well as from Bayle’s four Clarifications. The bulk of the major articles of philosophical and theological interest--those that influenced Leibniz, Berkeley, Hume, and Voltaire and formed the basis for so many eighteenth-century discussions--are present, including David, Manicheans, Paulicians, Pyrrho, Rorarius, Simonides, Spinoza, and Zeno of Elea.

Bayle--political writings.Pierre Bayle - 2000 - New York: Cambridge University Press. Edited by Sally Jenkinson.
Pierre Bayle was one of the most important sceptical thinkers of the seventeenth century. His work was a major influence on the development of the ideas of Voltaire (who acclaimed it for its candour on such subjects as atheism, obscenity and sexual conduct), Hume, Montesquieu and Rousseau. Banned in France on first publication in 1697, Bayle's Dictionnaire Historique et Critique became a bestseller and ran into several editions and translations. Sally L. Jenkinson's masterly new edition presents the reader with a (...)

  19. Bayle's Dictionary: Historical and Critical: By Peter Bayle, the Second Edition, to Which is Prefixed, the Life of the Author.
Revised, Corrected and Enlarged, by Pierre Desmaizeaux, Fellow of the Royal Society.
    Peter Bayle - 1997 - Routledge.
Bayle's Dictionary is one of the best known and most influential works of the eighteenth century. Banned in Catholic France on first publication in 1697 it became a bestseller and ran into several editions and translations. Its merciless scientific and philosophical enquiring challenged all assumptions and blind reverence for authority, setting new standards for all future encyclopedists. This second English edition is enlarged from the fourth French edition, which in turn had been much enlarged from Bayle's manuscripts. Edited and with (...)

    Legally enforceable commitments.Michael D. Bayles - 1985 - Law and Philosophy 4 (3):311 - 342.
A continuing issue of contract law is what purported contracts should be legally enforced. This article considers what principles rational persons would want courts to use in enforcing commitments in a society in which they expected to live. By reviewing the promise, economic value, and reasonable expectations approaches, the principles of freedom of transfer, enforceable commitments, and collective good are developed. Then, less general principles of consideration, past benefits, reliance, gratuitous commitments, and contract modification are presented. These latter principles specify (...)

In lieu of an abstract, here is a brief excerpt of the content:HUME ON BLAME AND EXCUSE17. Hume's account of blame and excuse differs in fundamental respects from many contemporary ones. Many contemporary views, ultimately derived from the Kantian dictum that 'ought' implies 'can', base excuses on the nonvoluntary character of an action. For example, H. L. A. Hart argues that the basic requirements for responsibility are that a person have the capacity and a fair opportunity to do what is (...)

    Hart's Legal Philosophy: An Examination.M. E. Bayles & Michael D. Bayles - 1992 - Springer Verlag.
This work presents, interprets, and largely defends the legal philosophy of H.L.A. Hart, except for his account of causation. Hart is considered by many persons to be the most important English writer on jurisprudence in the 20th century. The book considers his general theory of law, his theory of rights and of the enforcement of morality, and his analysis of the conditions of legal resposibility and the justification of punishment.

    A rule-utilitarian moral code.Michael D. Bayles - 1969 - Journal of Value Inquiry 3 (4):258-269.
An ideal rule-Utilitarian theory is presented which incorporates some of the advantages of those based on accepted rules. The theory attempts to maximize welfare for a society of imperfect men. First an ideal moral code is explicated. Second a principle of a practical moral code is explicated which in effect prohibits violating rules of an ideal moral code except when general conformity to an ideal rule would have bad consequences.
