Ideal theory faces a paradox. The ‘capacity of guidance’ is an important feature of most normative theories, but ideal principles of justice are not well suited to guide action in non-ideal circumstances. This charge presses us to seek plausible avenues to connect ideal values with the non-ideal realisation of justice. The objective of this paper is to introduce an analytical framework and present a case study in support of what I call the ‘reflective integration thesis’. The thesis states that: if (...) we wish to formulate principles of justice that can guide action in non-ideal circumstances, we need to integrate ideal and non-ideal theory, and the way to integrate ideal and non-ideal theory is by seeking reflective equilibrium between these levels. Taking climate justice as a model, this paper will explore the features of a non-ideal theory of justice, thereby providing insights about the structure of an action-guiding theory. It will show that, in order to guide action, our ideal principles of climate justice need to be reformulated in the light of real-world considerations, which we only obtain by integrating the relevant empirical work on the matter. The authors argue that Morenian-inspired existential psychodrama turns out to be a formidable lever for opening up existence as it allows schizophrenic patients to incorporate the experience of an “absolutely other” on which the foundation of any autonomous self is built. More precisely, by relying on their clinical experiences, the authors show how psycho-dramatic play goes along with an intense movement of original projection which carries psychotic patients externally in relation to themselves. Offset from their pathological world, these patients feel (...) more inclined to “wear someone else’s shoes,” for the duration of the game, and they do so in a manner that is both sensorial and pathic. This surprising and creative “journey,” which allows them to return to the world better attuned to others and to themselves, is merely an enactment of a “true” intersubjective encounter: the very essence of existential psychodrama. By applying phenomenology to this psychodramatic method, notably by relying on the hypothesis of psychosis being a disorder of what Bin Kimura calls the “ aida,” the authors hope to contribute to the advancement of psychosis’ psychotherapy. Political philosophers have started to reflect on how these problems intersect with theories of global justice. This paper explores the idea according to which action-guiding principles of justice can only be formulated at such intersections. This is the starting point from which I develop a ‘non-ideal theory’ of global justice. The methodology of this theory posits that principles of justice (...) are formulated according to the practice they are intended to regulate. Individual practices provide insights about the formulation of principles, for the non-ideal circumstances that prevent the realisation of justice are only revealed through the interpretation of each practice. With regard to the content of principles, I reject the notion that non-ideal theory is applied ideal theory. I offer instead an overview of the main features of a conception of justice for a non-ideal world based on the ideas of compliance, fact-sensitivity, feasibility and path-dependence. The contribution of this paper is twofold: to provide the conceptual framework for an action-guiding non-ideal theory of global justice and to show why this theory is well-suited to address problems of a globalised economy, such as tax competition. O objetivo deste artigo é apontar a importância vital do diálogo socrático e, em especial, na figura de Sócrates na construção da tese dos exercícios espirituais de Pierre Hadot e a transformação/construção ética do sujeito ante a condição frágil e vulnerável do ser humano. Esse objetivo é aqui pensado a partir da interpretação que Hadot faz da figura de Sócrates e da filosofia antiga. Com efeito, desde o início do pensamento grego, o Sábio aparece como uma norma viva e concreta (...) como nota Hadot: “essas pesquisas, essas reflexões sobre o Sábio como norma se fixaram pouco a pouco, por muitas razões, na figura única de Sócrates”. La France est une nation légère - ce lieu commun antique est abondamment repris tout au long du XVIIIe siècle, témoignant de profonds bouleversements axiologiques, scientifiques et éthiques, dont ce volume collectif cherche à mesurer l'importance et les enjeux, en racontant l'histoire d'un autre siècle des Lumières: celle d'un siècle de la Légèreté. Ce volume collectif offre une perspective interdisciplinaire, croisant les champs d'études concernés par la question de la légèreté. Les 15 articles réunis analysent tant la peinture que la (...) morale, tant les sciences que l'histoire politique, tant la littérature que les technologies ou l'économie. Ensemble, ces articles révèlent la complexité de la légèreté au dix-huitième siècle, en proposant non seulement des analyses nouvelles originales de sources bien connues (Hogarth, Fontenelle ou Voltaire) mais aussi des découvertes de textes et des objets moins souvent étudiés (La Morlière, le Père Castel, Octave Uzanne, les cabriolets ou les parfums). L'un des atouts principaux de cette recherche est son approche critique et historiographique de la légèreté qui remet en question la façon dont s'écrit l'Histoire. Derrière les idées reçues, ce livre découvre les enjeux nationaux, diplomatiques, voire parfois aussi existentiels qui ont participé à la construction des représentations du dix-huitième siècle français. Over recent years, various semantics have been proposed for dealing with updates in the setting of logic programs. The availability of different semantics naturally raises the question of which are most adequate to model updates. A systematic approach to face this question is to identify general principles against which such semantics could be evaluated. In this paper we motivate and introduce a new such principle the refined extension principle. Such principle is complied with by the stable model semantics for (single) (...) logic programs. It turns out that none of the existing semantics for logic program updates, even though generalisations of the stable model semantics, comply with this principle. For this reason, we define a refinement of the dynamic stable model semantics for Dynamic Logic Programs that complies with the principle. (shrink)

Bien que les violences conjugales soient un véritable problème de santé publique, force est de constater qu’elles restent souvent indifférenciées. Les auteurs discutent dans cette contribution des enjeux de la violence causée par des vulnérabilités spécifiques, inhérentes souvent à la conjugalité mais se répercutant sur la parentalité et l’enfant, et qui nécessitent l’intervention de la justice. Ils se basent sur le dispositif « Protection médiation prévention » ( pmp ) pour illustrer que la justice peut présenter un vecteur thérapeutique utile (...) à appeler à la (juste) place de chaque membre de la famille dès l’annonce d’un conflit en amont de la violence et l’installation de troubles psychologiques pérennes, notamment pour l’enfant. La confrontation avec la justice peut être l’occasion de sensibiliser aux souffrances engendrées par les violences et créer une amorce thérapeutique. Pour cela, les professionnels doivent pouvoir discriminer ce qui relève du registre du conflit et de la violence tout comme de la dysparentalité et de la conjugopathie. Ces réflexions et expériences de terrain ont débouché sur une recherche-action à l’université de Caen qui vise à proposer des interventions spécifiques et différenciées dans des situations de conflits et/ou de violence dans le cadre de l’assistance éducative. Even though hesitations (e.g., um/uh) were historically perceived as involuntary non-linguistic items (e.g., Maclay & Osgood 1959), more recently, a number of scholars have suggested that hesitations can behave like (a) lexical items (e.g., Clark & Fox Tree 2002), and (b) at least in some contexts and with some functions as grammatical items like suffixes/clitics (Kirjavainen, Crible & Beeching 2022; Tottie 2017). The current study contributes to this body of work and presents two spoken language corpus analyses (frequency analysis; network (...) analysis) investigating the nature of the Finnish planning particle tota. Our results suggest that tota is more similar to grammatical items than lexical items. (shrink)

A commonly held view is that giving to the poor is superogatory i.e., that while it is a good thing to do, it is not morally wrong for us not to do so. This essay sets out to show that for the affluent in the world giving to the poor is not superogatory but is rather a moral obligation. The paper critiques Singer's famous argument in ‘Famine, Affluence and Morality’ and finds that although the argument is a cogent and powerful (...) one, Singer, when trying to apply the argument to how we should act, somewhat skews the argument's real implications. Furthermore, it is argued that a cosmopolitan concern for the global poor is the morally correct response to have, and the author defends this view by examining the proper effect that aspects like geographical distance, nationality, reciprocity, and the nature of the global economic system should have on our moral considerations. In conclusion, it is argued that since the way that each person utilises his/her resources is a reflection of what he/she values, then for many of us in positions of affluence, in order to be moral, much more should be done in order to help those experiencing dire, life-threatening poverty across the globe.1. This thesis aims to critique the Universal Declaration of the Rights of Mother Earth and its underlying moral justification in order to provide a stronger and improved version of both. In Chapter 1 I explore what sort of moral justification is necessary to establish the Universal Declaration on firm grounds and explore its relation to environmental ethics and rights discourse. I argue that a non-anthropocentric perspective is necessary to justify the Universal Declaration’s rights. In Chapter 2 I explore the underlying (...) justification of the Universal Declaration as discovered in the works of Cormac Cullinan and Father Thomas Berry. I argue that their ethical framework is indeterminate, has many ambiguities and uncertainties, and, among other problems, it does not provide a clear action-guiding framework. In Chapter 3 I develop an alternative justification for the Universal Declaration. I argue against many predominant moral theories, that in light of our best scientific and moral understanding we should expand the realm of moral concern to include all living beings, a moral theory I call Life’s Imperative. In Chapter 4 I illustrate that Life’s Imperative is a much stronger, more coherent justification for the Universal Declaration, one that coheres with both our best understanding of the natural world and our relation to it, and to an environmental ethic reflective of that relationship. Unfortunately many of the weaknesses in the current implicit justification of the Universal Declaration have also led to it enshrining rights that are themselves problematic. In order to address these issues, I revise its rights to accord with the stronger justification that I established in Chapter 3. The end result of doing so is a revised version of the Universal Declaration. (shrink)

We present a version of system Fω, called image, in which the layer of type constructors is essentially the traditional one of Fω, whereas provability of types is classical. The proof-term calculus accounting for the classical reasoning is a variant of Barbanera and Berardi’s symmetric λ-calculus.We prove that the whole calculus is strongly normalising. For the layer of type constructors, we use Tait and Girard’s reducibility method combined with orthogonality techniques. For the layer of terms, we use Barbanera and Berardi’s (...) method based on a symmetric notion of reducibility candidate. We prove that orthogonality does not capture the fixpoint construction of symmetric candidates.We establish the consistency of image, and relate the calculus to the traditional system Fω, also when the latter is extended with axioms for classical logic. In this paper I aim to critically analyse the underlying moral justification of the rights enshrined in the Universal Declaration of the Rights of Mother Earth. The aim of the critique is to highlight some of the problematic areas that underpin the Declaration’s rights and in doing so to point to ways that one can begin to rectify the problems with them and the Universal Declaration itself. The paper aims to critically examine the moral justification for the Universal Declaration’s rights, (...) which is found in the works of Thomas Berry and his commentators who use the notion of ‘subjectivity’ to justify the existence of such rights. The paper critically examines such a notion and argues that it is not strong enough to do the work required of it, and that it is too problematic to serve as a justification for the Universal Declaration’s rights, as the ethical framework it provides is too cryptic and indeterminate, and does not provide us with an adequate action- and law-guiding framework upon which to establish the Universal Declaration and its rights.
