: McDowell opposes the view that the intentionality of language and thought remains mysterious unless it can be understood ‘from outside the conceptual order’. While he thinks the demand for such a ‘sideways-on’ understanding can be the result of ‘scientistic prejudice’, he points to Sellars's thought as exhibiting a different source: a distortion of our perspective ‘from within the conceptual order’. The distortion involves a failure on Sellars's part to see how descriptions from within the conceptual order can present expressions (...) and mental acts as related to extra-conceptual objects (a failure in turn explained by his failure to see how such relations could have normative import). In this paper, I argue that Sellars's thought suffers from no such distortion. If that is right, McDowell's examination of Sellars has not uncovered a disorder whose treatment might help relieve the desire for a sideways-on view. (shrink)

The advent and expanding role of jurilinguistics as part of the federal legislative process are closely associated with the gradual recognition of the equal authority of the two linguistic versions of federal legislation, as well as the implementation of co-drafting as the most effective method of taking into account the equal authority of the two official languages of the country. Jurilinguistics gradually made its way into the federal legislative process starting in the mid 70s and quickly resulted in the establishment (...) of a formal group dealing with French jurilinguistics, comprised of Francophone drafters and jurilinguists. Jurilinguists played a key role in the development of drafting standards for the drafting of a truly authentic French version of federal legislation. In the late 90s, Anglophone jurilinguists were also hired to ensure the highest quality possible for the English version of the federal laws and, along with their Francophone counterparts, to ensure the functional equivalence of the two language versions. The implementation of the departmental policy on legislative bijuralism constituted an additional challenge for the drafter who, fortunately, can rely on comparative law experts, as well as the sound advice of the jurilinguists, to produce legislative texts that are consistent with the principles of clarity in drafting legal documents. ABSTRACT:‘Race’ has long searched for a stable, suitable idea, with no consensus on a master meaning in sight. What I call deflationary pluralism about the existence of race recognizes that various meanings may be true as far as they go but avoids murky disputes over whether there are races in some sense. Once we have rejected the notion that racial essences yield innate cognitive differences, there is little point to arguing over the race idea. In its place, I propose the (...) idea of socioancestry, which jettisons racial thinking yet recognizes the social dynamics of color. For example, Black Americans, many of whom have traceable non-African ancestry, constitute an Africa-identified, socioancestrally black subgroup. ‘Race’ talk is not needed to sustain legitimate color-conscious approaches to social identity and social justice. Long-standing fixation on the race idea has obscured the simple truth that visible continental ancestry is the root of the social reality of color consciousness. (shrink)

This paper examines the pressures leading two very different Early Modern philosophers, Descartes and Locke, to invoke two ways in which thought is directed at objects. According to both philosophers, I argue, the same idea can simultaneously count as “of” two different objects—in two different senses of the phrase ‘idea of’. One kind of intentional directedness is invoked in answering the question What is it to think that thus-and-so? The other kind is invoked in answering the question What accounts for (...) the success of our proper methods of inquiry? For Descartes as well as Locke, the two kinds of “ofness” come apart as a result of strong rationalist commitments. However, I will suggest that even if we reject such commitments, we go wrong if we assume that a single kind of intentional directedness suffices to address both questions. (shrink)

Building on recent work, I present sequent systems for the non-classical logics LP, K3, and FDE with two main virtues. First, derivations closely resemble those in standard Gentzen-style systems. Second, the systems can be obtained by reformulating a classical system using nonstandard sequent structure and simply removing certain structural rules (relatives of exchange and contraction). I clarify two senses in which these logics count as “substructural.”.

We investigate the haggling process in bargaining. Using an experimental bargaining game, we find that a first offer has a significant impact on the bargaining outcome even if it is costless to reject. First offers convey information on the player’s reservation value induced by his social preferences. They are most often accepted when they are not above the equal split. However, offers which request much more than the equal split induce punishing counter-offers. The bargaining outcome is therefore critically influenced by (...) the balance of toughness and kindness signalled through the offers made in the haggling phase. (shrink)

On aurait pu les ignorer, faire comme si elles n'existaient pas, et tenter de construire une fiction unitaire qui aurait prétendu dire la totalité de notre identité historique. C'eut été se méprendre sur la dynamique profonde que traduit (...) le nom contemporain. Elle se déploie ainsi : la représentation moderne du monde est débordée de toutes parts par une multiplicité qu'elle ne peut plus contenir, et qui la fait apparaître pour ce qu'elle est : un imaginaire, une illusion ; imaginaire de la distinction, de la séparation, alors que le contemporain propose, lui, un imaginaire marqué par l'indistinction, la déhiérarchisation, la globalisation. Toutes les histoires documentées dans cet essai retrouvent ce mouvement. Ainsi des espaces publics de l'art qui voient la fin du dispositifinstitution musée d'art moderne au profit des centres d'art contemporain et évoquent par là une manière différente d'habiter le monde. Ainsi du très grand nombre qui ne se laisse plus discipliner dans les concepts politiques hérités de la modernité. D'autres émergent (multitude, publics), prenant mieux en compte la double poussée de la massification et de la différenciation. Ainsi de la production du savoir qui se décentre et s'horizontalise. Ainsi du temps vécu comme une concordance de temporalités à l'ère hypermédiatique. Ainsi de l'imaginaire littéraire, emblématique de la modernité et lié au support-livre, qui intègre un plus vaste régime de publication. Ainsi de la pensée du monde qui est désormais une pensée des mondes. En six stations qui sont autant de mots-clés du contemporain (exposition, médias, controverses, publication, institutionnalisation, archéologie), cet essai s'attache à décrire les transformations actuelles des formes culturelles et des visions de l'histoire. Innocence is a notion that can prove controversial. Claims of innocence typically support not imposing burdens on the innocent when their conduct is relevantly unobjectionable. This paper examines innocence in the context of violent conflict between states or groups. Many thinkers about the morality of such violence want to establish a principle that would protect innocent civilians. Yet the common view in just war theory does not affirm the moral innocence of civilians. Similarly, the common view that soldiers have an (...) equal right to kill does not affirm their equal moral culpability. (shrink)

Current empirical evidence does not seem to confirm that an improvement in living conditions is the cause of the shift in the human mindset toward innovation and long-term risky investment. However, it may well be one of the conditions for greater tolerance of income inequality in exchange for a steady increase in average income.

Various stakeholders approach sustainability in their own way. How they do this is reflected in their discursive behaviour. The stakeholder groups explored here include Traditional Shareholders, Incentive-Coerced Management, Pro-Sustainability Corporate, and Activists. Each of these stakeholder groups is shown to engage in a unique discourse, which provides insight into how each approach sustainability. This paper draws on Foucault’s ideas to help understand these discourses in terms of a framework based on Harré’s positioning theory. A new level of understanding is derived (...) about the different points of view about sustainability. Business leaders can harness this to improve how they approach sustainability. (shrink)
