C’est par le Droit que l’être humain a acquis en Occident une unité (I). Ce que la Religion avait pu faire, le Droit l’a également fait en posant sur chaque être humain la notion indétachable de lui de « personne » (I.A). Mais c’est cela qui est remis en cause aujourd’hui, non pas la personnalité et le pouvoir que l’être humain a d’exprimer sa liberté mais l’unité que cela implique dans la disposition que l’on a de soi en repoussant le (...) désir qu’autrui a toujours eu de disposer de nous. Le Droit actuel tend en effet à « pulvériser » les êtres humains en données et à transformer en prestations juridiques neutres ce qui était considéré comme de la dévoration d’autrui. La notion juridique de « consentement », cessant d’être une preuve d’une volonté libre mais devenue une notion autonome, y suffirait (I.B.). Pour empêcher que ne règne plus que la « loi des désirs », laquelle ne fait que traduire l’ajustement des forces, il faut requérir ici et maintenant la souveraineté éthique du Droit, parce que le Droit ne peut pas être qu’une technique d’ajustement des intérêts (II). L’on peut former cette requête si l’on ne veut pas vivre dans un univers a-moral (II. A), si l’on constate que l’unité de la personne est l’invention juridique qui protège l’être humain faible (II.B.). Si on en admet l’impératif, il faut alors se demander enfin qui en Droit va l’exprimer et l’imposer, notamment de la Loi, ou du Juge, car nous semblons avoir perdu la capacité de rappeler ce principe de la Personne sur laquelle l’Occident fut si centré. Or, les principes qui ne sont plus dits disparaissent. Il ne resterait plus alors que l’ajustement au cas par cas des intérêts entre êtres humains dans le champ mondial des forces particulières. À cette aune, le Droit ne serait plus qu’une technique de sécurisation des ajustements particuliers. (II. C). Réduit à cela, le Droit aurait perdu son lien avec l’Éthique. (shrink)

En publiant en 1965 Le Péché et la durée de l’ange, le P. Guérard des Lauriers, o. p. (1898-1989) offrait une contribution majeure à un débat qui divisait les thomistes. En 1946 en effet, la parution de Surnaturel du P. de Lubac avait remis en cause, textes de Thomas d’Aquin à l’appui, la thèse de l’impeccabilité naturelle de l’ange, jusqu’alors (presque) unanimement reçue dans l’École thomiste. Deux interprétations de Thomas d’Aquin polarisèrent alors le débat : la raison de la peccabilité (...) de l’ange est à rechercher ou bien dans son élévation à l’ordre surnaturel ( De malo, q. 16, a. 4), ou bien dans la structure même de la créature angélique ( Summa theologiae I a Pars, q. 63, a. 1). Servi par une herméneutique renouvelée des textes de Thomas sur la peccabilité de l’ange, et fort d’un redéploiement d’une doctrine thomiste de la liberté, articulée dans sa double dimension de spécification et d’exercice, Guérard établit que le fondement de la liberté des créatures spirituelles – et donc leur peccabilité – se situe au cœur de leur constitution métaphysique, dans la distinction réelle entre nature et personne, sans qu’intervienne nécessairement la distinction des ordres naturel et surnaturel. Son analyse pénétrante et novatrice le conduit à mettre au jour une structure du libre arbitre, laquelle intègre et unit sans confusion les deux ordres de réalité engagés dans l’acte libre : le métaphysique et le moral. Il offre ainsi une contribution de premier plan à l’élaboration d’une philosophie contemporaine de la liberté, attestant par-là la fécondité de la tradition thomiste. (shrink)

Considering the urgency of addressing grand challenges that affect human health and achieving the ambitious health targets set by the United Nations’ Sustainable Development Goals, the role of business in improving health has become critical. Yet, our systematic review of the business–health literature reveals that business research focuses primarily on occupational health and safety, health care organizations, and health regulations. To embrace the health externalities generated by business activities, we propose that future research should investigate the conditions under which business (...) articulates and participates in health challenges, engages in multilevel actions toward tackling health challenges, and improves health outcomes and its impact on the health of external stakeholders, including customers and local communities. Rémi Tison Dans cet article, je traite de la nature des processus cognitifs sous-tendant nos attributions d’états mentaux aux animaux non humains. Selon la conception traditionnelle, nous n’avons qu’un accès indirect aux états mentaux d’autrui, qui doivent être inférés sur la base du comportement. Cette conception traditionnelle influence autant les débats conceptuels concernant l’esprit des animaux que les recherches empiriques sur la cognition animale. Or de récents travaux sur la cognition sociale humaine avancent plutôt une conception « interactionniste », selon (...) laquelle les états mentaux peuvent parfois être directement perçus dans le comportement. J’applique dans cet article la conception interactionniste à l’attribution d’états mentaux aux animaux. Je conclus que celle-ci rend mieux compte des attitudes du sens commun à l’égard des états mentaux des animaux et est plus féconde pour la recherche empirique sur la cognition animale que la conception traditionnelle. We present and contrast two accounts of cooperative communication, both based on Active Inference, a framework that unifies biological and cognitive processes. The mental alignment account, defended in Vasil et al., takes the function of cooperative communication to be the alignment of the interlocutor's mental states, and cooperative communicative behavior to be driven by an evolutionarily selected adaptive prior belief favoring the selection of action policies that promote such an alignment. We argue that the mental alignment account should be rejected (...) because it neglects the action-oriented nature of cooperative communication, which skews its view of the dynamics of communicative interaction. We introduce our own conception of cooperative communication, inspired by a more radical ecological interpretation of the active inference framework. Cooperative communication, on our ecological conception, serves to guide and constrain the dynamics of the cooperative interaction via the construction and restructuring of shared fields of affordances, in order to reach the local goals of the joint actions in which episodes of cooperative communication are embedded. We argue that our ecological conception provides a better theoretical standpoint to account for the action-oriented nature of cooperative communication in the active inference framework. (shrink)

In this paper, we propose an argumentation formalism that allows for both deductive and abductive argumentation, where ‘deduction’ is used as an umbrella term for both defeasible and strict ‘forward’ inference. Our formalism is based on an extended version of our previously proposed information graph formalism, which provides a precise account of the interplay between deductive and abductive inference and causal and evidential information. In the current version, we consider additional types of information such as abstractions which allow domain experts (...) to be more expressive in stating their knowledge, where we identify and impose constraints on the types of inferences that may be performed with the different types of information. A new notion of attack is defined that captures a crucial aspect of abductive reasoning, namely that of competition between abductively inferred alternative explanations. Our argumentation formalism generates an abstract argumentation framework and thus allows arguments to be formally evaluated. We prove that instantiations of our argumentation formalism satisfy key rationality postulates. (shrink)

In this paper, I develop an account of linguistic content based on the active inference framework. While ecological and enactive theorists have rightly rejected the notion of content as a basis for cognitive processes, they must recognize the important role that it plays in the social regulation of linguistic interaction. According to an influential theory in philosophy of language, normative inferentialism, an utterance has the content that it has in virtue of its normative status, that is, in virtue of the (...) set of commitments and entitlements that the speaker undertakes by producing this utterance. This normative status is determined by the normative attitudes shared by members of the utterer’s linguistic community. I propose here an account of such normative attitudes based on the ecological interpretation of the active inference framework. I explain how social normativity can be understood in that framework as the way in which members of a group shape their social niche to make it more predictable. Finally, I apply this account of social normativity to basic communicative practices, thereby explaining how social normative expectations can emerge to regulate these communicative practices, eventually leading to the institution of the sort of normative statuses constitutive of linguistic content. In this paper, we introduce an ecological account of communication according to which acts of communication are active inferences achieved by affecting the behavior of a target organism via the modification of its field of affordances. Constraining a target organism’s behavior constitutes a mechanism of socially extended active inference, allowing organisms to proactively regulate their inner states through the behavior of other organisms. In this general conception of communication, the type of cooperative communication characteristic of human communicative interaction is a (...) way of constraining interaction dynamics toward the goals of a given joint action by constructing and altering shared fields of affordances. This account embraces a pragmatist view according to which communication is a form of action aiming to influence the behavior of a target, and stands against the traditional transmission view according to which communication fundamentally serves to convey information. Understanding acts of communication as active inference under an ecological interpretation allows us to link communicative and ultimately linguistic behavior to the biological imperative of minimizing free energy and to emphasize the action-oriented nature of communicative interaction. In everything from philosophical ethics to legal argument to public activism, it has become commonplace to appeal to the idea of human dignity. In such contexts, the concept of dignity typically signifies something like the fundamental moral status belonging to all humans. Remarkably, however, it is only in the last century that this meaning of the term has become standardized. Before this, dignity was instead a concept associated with social status. Unfortunately, this transformation remains something of a mystery in existing (...) scholarship. Exactly when and why did "dignity" change its meaning? And before this change, was it truly the case that we lacked a conception of human worth akin to the one that "dignity" now represents? In this volume, leading scholars across a range of disciplines attempt to answer such questions by clarifying the presently murky history of "dignity," from classical Greek thought through the Middle Ages and Enlightenment to the present day. Since their emergence in the 1980s, environmental virtue ethics (EVEs) have aimed to provide an alternative to deontological and consequentialist approaches for guiding ecological actions in the context of the global environmental crisis. The deterioration of the ecological situation and the challenges in addressing collective action problems caused by global changes have heightened interest in these ethics. They offer a framework for meaningful individual actions independently of the commitment of other actors. However, by shifting the focus onto individuals, EVEs appear (...) to grapple with the tension between anthropocentrism and respect for nature, as well as between self-flourishing and concern for other living beings. This article argues that this difficulty is rooted in the neglect within EVEs of the communitarian aspect of ancient virtue ethics. Drawing from Baird Callicott’s ecocentric approach and Val Plumwood’s works, this paper explores the possibility of conceiving ecological communities as collective frameworks in which both public and private virtues are defined and practiced. Consumer-based datasets are the products of data brokerage firms that agglomerate millions of personal records on the adult US population. This big data commodity is purchased by both companies and individual clients for purposes such as marketing, risk prevention, and identity searches. The sheer magnitude and population coverage of available consumer-based datasets and the opacity of the business practices that create these datasets pose emergent ethical challenges within the computational social sciences that have begun to incorporate consumer-based datasets into empirical (...) research. To directly engage with the core ethical debates around the use of consumer-based datasets within social science research, I first consider two case study applications of consumer-based dataset-based scholarship. I then focus on three primary ethical dilemmas within consumer-based datasets regarding human subject research, participant privacy, and informed consent in conversation with the principles of the seminal Belmont Report. We show that MRP + MA implies that ITP(λ, ω 2 ) holds for all cardinal λ ≥ ω 2 . This generalizes a result by Weiß who showed that PFA implies that ITP(λ, ω 2 ) holds for all cardinal λ ≥ ω 2 . Consequently any of the known methods to prove MRP + MA consistent relative to some large cardinal hypothesis requires the existence of a strongly compact cardinal. Moreover if one wants to force MRP + MA (...) with a proper forcing, it requires at least a supercompact cardinal. We also study the relationship between MRP and some weak versions of square. We show that MRP implies the failure of □(λ, ω) for all λ ≥ ω 2 and we give a direct proof that MRP + MA implies the failure of □(λ, ω 1 ) for all λ ≥ ω 2. (shrink)

In the face of challenging circumstances, many teachers turn to spirituality for sustenance and strength. Yet spirituality’s place in education and in educators’ lives has long been a matter of confusion and contention, not least because of the ambiguity of the term in its common usage. What is its relationship to religion? And what defines it? In this article, I submit that the later work of Michel Foucault offers a helpful approach to spirituality that displaces those questions—drawing attention away from (...) beliefs and/or attitudes professed, and towards the process of practical self-transformation that subjects undertake for the sake of a truth that is actualised in the body. To be spiritual in this sense is more a matter of what one does than what one believes or who one is. To offer a sense of why it matters in the lives of educators, I draw on the experiences of a San Diego high school teacher confronting interlocking personal, professional, and political challenges as a detailed example. This paper examines the question of why consumers engage in ethical consumption. The authors draw on self-affirmation theory to propose that the choice of an ethical product serves a self-restorative function. Four experiments provide support for this assertion: a self-threat increases consumers’ choice of an ethical option, even when the alternative choice is objectively superior in quantity (Study 1) and product quality (Study 2). Further, restoring self-esteem through positive feedback eliminates this increase in ethical choice (Studies 2 and 3). As (...) an additional test of the robustness of our results, a final study examined the effect of self-threat on choice in a field setting (Study 4). The findings indicate that ethical purchases are not just altruistic. They hold purposeful individual value and can help in the self-restorative process. Implications for managers making decisions regarding investment in ethical product features are discussed. (shrink)

Two longstanding questions about Hume's later moral theory have preoccupied scholars of his work: First, what does Hume mean by "humanity" in the second Enquiry, and what are we to make of its seeming replacement of "extensive sympathy" as the source of our moral sentiments? Second, what happened to the associationist account of sympathy emphasized so keenly in the Treatise? My primary task in this paper will be to answer the first of these two questions. To do this, I conduct (...) a careful analysis of Hume’s notion of humanity with heavy emphasis on the text of the second Enquiry. This is not to say I will skip over sympathy. On the contrary, if I am right that humanity is dependent on sympathy (or at a minimum, the process of sympathizing), then we must also take a close look at the Enquiry account of sympathy. -/- However, I do not directly discuss the mysterious disappearance of the associationist account of sympathy from the Enquiry in this paper. Instead, I address that part of the puzzle in a second, related article (published in the subsequent issue of BJHP in the same year). What we find in that related analysis, however, is that the associationist explanation of sympathy never really disappeared from the Enquiry . Taken together, then, the arguments of the two papers goes some distance towards confirming that there is no real inconsistency between Hume’s position in the Enquiry and the Treatise regarding humanity, sympathy, and the source of our moral sentiments. The philosophy of “ human dignity” remains a young, piecemeal endeavor with only a small, dedicated literature. And what dedicated literature exists makes for a rather slapdash mix of substantive and formal metatheory. Worse, ironically we seem compelled to treat this existing theory both charitably and casually. For how can we definitively assess any of it? Existing suggestions about the general features of dignity are necessarily contentious in virtue of being more or less blissfully uncritical of themselves. Because none of (...) the suggested features are conscientiously situated in their own right, their justification is taken to rest solely on whether each is borne out by some substantive account. But absent the sort of second-order considerations that would make for a proper metatheory, what can we do with their substantive suggestions? Of course, the concept of dignity has other forums. It figures prominently into insular analyses of either Kantian or Biblical ethics, and, to various degrees, an array of subsidiary fields of practical philosophy including human rights, bioethics, law, theories of respect, race theory, Judaic studies, feminism, care ethics, war, technology, and political philosophy. Each of these areas has an established literature. Each contributes interesting observations to the nature of dignity. But, again, ultimately, without a proper metatheory, it is unclear what to do with any of them. My goal is to remedy this, or at least reverse the trend. In doing so I will have in view one particular subfield, namely, the ever-pressing subject of human rights. (shrink)

Cet article se propose d’étudier comment, dans le monde grec antique, les femmes étaient nommées et comment s’articulait la différence des sexes en fonction du contexte d’apparition de leur nom. Il s’appuie sur la documentation épigraphique et plus particulièrement sur les décrets honorifiques – des textes gravés sur pierre souvent affichés dans l’espace public – qui honoraient une personne pour ses actions en faveur de la cité. Les femmes étaient honorées dans ces documents notamment lorsqu’elles exerçaient une charge religieuse, comme (...) celle de prêtresse. Cette étude, en partant d’un décret athénien honorant une prêtresse du nom de Timokritè, se demande où se joue le genre, en s’intéressant à la manière dont les prêtresses étaient désignées et en observant ce que la façon de les nommer indiquait sur leur statut et leur fonction. Il s’agit de montrer comment certaines femmes, en tant que prêtresses, occupaient grâce à leur statut de citoyennes des fonctions politiques de magistrates. (shrink)

The recent discovery of so-called “mirror-neurons” in monkeys and a corresponding mirroring “system” in humans has provoked wide endorsement of the claim that humans understand a variety of observed actions, somatic sensations, and emotions via a kind of direct representation of those actions, sensations, and emotions. Philosophical efforts to assess the import of such “mirrored understanding” have typically focused on how that understanding might be brought to bear on theories of mindreading, and usually in cases of action. By contrast, this (...) paper assesses mirrored understanding in cases of emotion and its import for theories of empathy and especially empathy in ethical contexts. In particular, this paper argues that the mirrored understanding claim is ambiguous and ultimately misleading when applied to emotion, partly because mirroring proponents fail to appreciate the way in which empathy might serve a distinct normative function in our judgments of what other people feel. The paper thus concludes with a call to revise the mirrored understanding claim, whether in neuroscience, psychology, or philosophy. (shrink)

Many prominent scholars of Hume's philosophy have suggested that Hume eventually abandoned his associationist account of sympathy, which he made so much of in the Treatise, by the time he came to write the second Enquiry. In this paper I reconsider the seeming disappearance of the associationist account of sympathy, but with the ultimate aim of defending a no-change hypothesis. That is, I’ll argue that careful analysis reveals that Hume not only retained the associationist theory of sympathy in his later (...) work, he made no substantive changes to this theory, including in particular, in EPM. Where exactly should we place Adam Smith in the cannon of classical liberalism? Smith's advocacy of free market economics and defence of religious liberty in The Wealth of Nations suffice for including him somewhere in that tradition.1 The nature and extent of Smith's liberalism, however, remain up for debate. One recent trend has been to characterise Smith as a proponent of social liberalism. This includes those like Stephen Darwall, Samuel Fleischacker and Charles Griswold, who have drawn attention to a kind (...) of descriptive moral egalitarianism in Smith.2 Humans, Smith seems to hold, are naturally disposed to valuing one another under a conception of equality. But that is not all these scholars suggest. They have also hinted at something more contentious ? the idea that, according to Smith, we value one another in a way resonant with contemporary notions of human dignity, conceived as the inherent value of persons grounding certain rights to, or restrictions on, treatment by others.3 In saying so, these scholars have hit upon something remarkable. However, I also think their arguments in this respect are both indirect and incomplete. Consequently, the full import of Smith's view remains obscure. This essay aims to bring some clarity. 1I intend this historically. I grant there are good reasons to be sceptical about the ultimate fate of liberty in capitalist society (e.g. Marxist reasons and reasons based on various postmodern critiques of enlightenment ideology). The philosophy of emotion has long been divided over the cognitive nature of emotion. In this paper I argue that this debate suffers from deep confusion over the meaning of “cognition” itself. This confusion has in turn obscured critical substantive agreement between the debate’s principal opponents. Capturing this agreement and remedying this confusion requires re-conceptualizing “the cognitive” as it functions in first-order theories of emotion. Correspondingly, a sketch for a new account of cognitivity is offered. However, I also argue that (...) this new account, despite tacit acceptance by all major theories of emotion, in fact rules out some of the most fundamental and controversial claims of one side of the nature-of-emotion debate, emotional cognitivism. This paper describes how music fulfills two of its broadly recognized functions—“mood regulation” and “social cohesion”—in times of pandemics and social isolation. Through a trans-historical comparison of the musical activities of the Milanese during an outbreak of plague in 1576 with the musical activities observed during the COVID lockdowns in 2020, this paper suggests a framework for understanding the role of music in the care of the biological body and the social body in times of medical disaster.

Motivated by the verification of programs with pointer variables, we introduce a temporal logic whose underlying assertion language is the quantifier-free fragment of separation logic and the temporal logic on the top of it is the standard linear-time temporal logic LTL. We analyze the complexity of various model-checking and satisfiability problems for , considering various fragments of separation logic , various classes of models , and the influence of fixing the initial memory state. We provide a complete picture based on (...) these criteria. Our main decidability result is pspace-completeness of the satisfiability problems on the record fragment and on a classical fragment allowing pointer arithmetic. -completeness or -completeness results are established for various problems by reducing standard problems for Minsky machines, and underline the tightness of our decidability results. Cet article souhaite élucider la philosophie de la chair développée par Michel Henry. Il s’agit de voir comment Henry parvient à penser la chair comme la possibilité principielle de l’individualité. Nous voulons montrer que la démarche henryenne repose non seulement sur une mise en question des canons de l’apparaître, mais également sur la conviction que le problème de l’individualité trouve sa solution dans une expérience charnelle radicale de soi-même permettant d’opérer un repli en-deçà du corps chosifié de la phénoménologie husserlienne. Cet article souhaite élucider la philosophie de la chair développée par Michel Henry. Il s’agit de voir comment Henry parvient à penser la chair comme la possibilité principielle de l’individualité. Nous voulons montrer que la démarche henryenne repose non seulement sur une mise en question des canons de l’apparaître, mais également sur la conviction que le problème de l’individualité trouve sa solution dans une expérience charnelle radicale de soi-même permettant d’opérer un repli en-deçà du corps chosifié de la phénoménologie husserlienne.
