Studie předkládá interpretaci souboru článků, které Jan Patočka uveřejnil na počátku své filosofické kariéry a v nichž programově vyložil vlastní stanovisko k problematice historického poznání a smyslu dějin. Na základě výkladu Patočkových statí studie konstatuje, že soubor ve svém celku připravuje předložení ucelené filosofické koncepce a že jeho prostřednictvím Patočka přispěl k soudobé diskusi, „sporu o smysl českých dějin“. Studie nejprve nabízí představení tohoto sporu a jeho dobového kontextu a argumentuje, že tato souvislost má podstatný význam pro porozumění Patočkovým textům. (...) Na základě toho poté studie shrnuje Patočkovu interpretaci hlavních zainteresovaných argumentačních pozic a kritiku, kterou vůči nim snáší. V následujícím kroku studie předkládá interpretaci Patočkova vlastního pojetí dějin. Na závěr představuje východisko tohoto pojetí, Patočkovu koncepci člověka. The paper proposes an interpretation of a set of articles published by Jan Patočka at the beginning of his philosophical career, in which he programmatically sets forth his point of view of the problem of historical knowledge and the meaning of history. Based on the reading of the texts the paper arrives at the conclusion that this collection as a whole anticipates a comprehensive philosophical concept and that by means of these texts Patočka contributed to the discussion of the day, “the dispute over the meaning of Czech history”. The paper begins by presenting the dispute as well as its contemporary context and argues that this link bears essential significance to the understanding of Patočka’s texts. On this basis it then summarizes Patočka’s interpretation of the different parties of the argument and the critique to which he submits them. In the next step the paper presents Patočka’s interpretation of his own conception of history. It concludes by an exposition of the basis of this conception, Patočka’s concept of man. (shrink)

Prvním cílem předkládané studie je podat podrobnější výklad pojetí smyslového vnímání v rukopisech Jana Patočky z let 1939–1945. Druhým cílem je ukázat originální i šířeji sdílenou stránku Patočkova pojetí na základě jeho srovnání s analogickými tezemi formulovanými v přednáškách Maurice Merleau-Pontyho z roku 1953. – Východiskem Patočkovy koncepce smyslového vnímání je myšlenka předmětné a horizontové intencionality. Jejím účelem je toto pojetí intencionality deskriptivně založit a interpretativně rozvinout tak, aby umožnilo pochopit vztah a distanci prožívajícího a prožívaného. Za tímto účelem Patočka (...) koncipuje pojem bytostného zájmu jednotlivého bytí o toto bytí samo jakožto princip předmětné intencionality a počátek individuální sebeobjektivace, jíž je tělo. Vztah mezi tímto zájmem, tělem a předmětnou intencí popisuje jako poměr výrazu a vyjádření. Na základě této deskripce předkládá fenomenologickou interpretaci veškeré předmětnosti jakožto výrazu určitého života na jedné straně a intencionálního vyjádření na straně druhé. – Právě tento závěr se ve srovnání s tezemi Merleau-Pontyho ukazuje jako originální myšlenka Patočkova filosofického fragmentu. I respond to a challenge raised by Jordan Pascoe: Kant’s conception of obtaining full citizenship through working oneself up necessarily condemns some people to passive citizenship. I argue that we should not focus on work to establish universal full citizenship. Rather, a Universal Basic Income, an income paid regularly to everyone and without conditions, can secure everyone’s full citizenship. Moreover, I argue that such a scheme is more Kantian in nature than hitherto assumed.

To incorporate medical ethics into clinical practice, it must first be understood and valued by health care professionals. The recognition of this principle led to an expanding and continuing educational effort by the ethics committee of the Vancouver General Hospital. This paper reviews this venture, including some pitfalls and failures, as well as successes. Although we began with consultants, it quickly became apparent that education in medical ethics must reach all health care professionals—and medical students as well. Our greatest successes (...) came in the formative years of a medical career (ie, in medical school and residency training programmes), but other efforts were not wasted, particularly among nurses and other health care professionals.Although this is a personal review of the experience in one institution, the lessons learnt in Vancouver are applicable to the further development of medical ethics in the UK. This article re-evaluates the role of the manuscript tradition of the Historia Augusta in debates over the original contents and authorship of the text. Evidence for physical disruptions to the text before our oldest surviving manuscripts points to an earlier manuscript distributed across multiple codices. A multi-volume archetype eliminates critical arguments against the author's claims about lives missing before the Life of Hadrian as well as in the lacuna for the years a.d. 244–260. Other multi-volume codices of the eighth and (...) ninth centuries show that loss of an initial volume would have disrupted the textual tradition for the index, titles and authorial attributions. Comparison of our most complete early witness, Pal. lat. 899, to the independent branches of the textual tradition shows discrepancies between these paratextual elements as expected in a disrupted tradition. Ultimately, this article concludes that the current debates on authorship and the original scope of the Historia Augusta rest on paratextual elements from a single branch of the manuscript tradition, raising doubts about the centrality of these controversies to understanding the work. Nuestra pregunta será: ¿cómo comprender al estructuralismo? ¿Cómo indicar sus límites cuando se trató de un conjunto de propuestas teóricas que atravesó disciplinas, que sufrió cruces con diversas teorías y cuyas premisas nunca fueron establecidas con claridad? A partir del concepto de problemática, desarrollado por Althusser fundamentalmente en La revolución teórica de Marx, se nos abrirá la posibilidad de interrogar al conjunto de propuestas teóricas que lo (...) conformaron, no tanto como un canon aplicable a las más diversas materias sino como un espacio teórico atravesado por contradicciones. Así, nos apoyaremos en la noción de problemática porque la consideramos particularmente fértil para pensar un campo teórico más como un conjunto de problemas y preguntas que como un compendio de respuestas a dificultades teóricas claramente delimitadas.Pretendemos destacar las contradicciones que vertebran al estructuralismo porque nos conducirán a plantear que es posible emplazar una distancia en su interior, distancia que mostrará como una de sus variantes aquella que afirma la imposibilidad de pensar una estructura de estructuras final que las totalice a todas. Este hecho es el que nos pondrá delante cómo las tensiones internas del estructuralismo permiten mostrar el modo en que algunas de sus propuestas balizan el camino del posestructuralismo. (shrink)

Checklists have been used to improve quality in many industries, including healthcare. The use of checklists, however, has not been extensively evaluated in clinical ethics consultation. This article seeks to fill this gap by exploring the efficacy of using a checklist in ethics consultation, as tested by an empirical investigation of the use of the checklist at a large academic medical system (Cleveland Clinic). The specific aims of this project are as follows: (1) to improve the quality of ethics consultations (...) by providing reminders to ethics consultants about process steps that are important for most patient-centered ethics consultations, (2) to create consistency in the ethics consultation process across the medical system, and (3) to establish an effective educational tool for trainers and trainees in clinical ethics consultation. The checklist was developed after a thorough literature review and an iterative process of revising and testing by a group of experienced ethics consultants. To pilot test the checklist, it was distributed to 46 ethics consultants. After a six-month pilot period in which ethics professionals used the checklist during their clinical activities, a survey was distributed to all of those who used the checklist. The 10-item survey examined consultants’ perceptions regarding the three aims listed above. Of the 25 survey respondents, 11 self-reported as experts in ethics consultation, nine perceived themselves to have mid-level expertise, and five self-reported as novices. The majority (68 percent) of all respondents, regardless of expertise, believed that the checklist could be a “helpful” or “very helpful” tool in the consultation process generally. Novices were more likely than experts to believe that the checklist would be useful in conducting consultations. The limitations of this study include: reduced generalizability given that this project was conducted at one medical system, utilized a small sample size, and used self-reported quality outcome measures. Despite these limitations, to the authors’ knowledge this is the first investigatation of the use of a checklist systematically to improve quality in ethics consultation. Importantly, our findings shed light on ways this checklist can be used to improve ethics consultation, including its use as an educational tool. The authors hope to test the checklist with consultants in other healthcare systems to explore its usefulness in different healthcare environments. (shrink)

A physician and spokesman for the French Ideologues, Pierre-JeanGeorges Cabanis (1757-1808) stands at the crossroads of several influential developments in modern culture--Enlightenment optimism about human perfectibility, the clinical method in medicine, and the formation and adaptation of liberal social ideals in the French Revolution. This first major study of Cabanis in English traces the influences of these developments on his thought and career. Originally published in 1980. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously (...) out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions. The goal of the Princeton Legacy Library is to vastly increase access to the rich scholarly heritage found in the thousands of books published by Princeton University Press since its founding in 1905. In this paper I explore some ideas inspired by Federico Picinali’s Justice In-Between: A Study of Intermediate Criminal Verdicts. Picinali makes a case for the introduction of intermediate options in criminal trials – verdicts with consequences that are harsher than an acquittal, but not so harsh as a conviction. From a certain perspective, the absence of intermediate options in criminal trials is puzzling – out of kilter with much of our everyday decision-making and, perhaps, with the recommendations of expected utility (...) theory. I will argue, however, that the lack of intermediate options is much less puzzling when put in the context of our ordinary practices of blame and non-legal punishment. (shrink)

For regular sets in Euclidean space, previous work has identified twelve ‘basic’ computability notions to which many previous notions considered in literature were shown to be equivalent. With respect to those basic notions we now investigate on the computability of natural operations on regular sets: union, intersection, complement, convex hull, image, and pre-image under suitable classes of functions. It turns out that only few of these notions are suitable in the sense of rendering all those operations uniformly computable.

Firms use algorithms to make important business decisions. To date, the algorithmic accountability literature has elided a fundamentally empirical question important to business ethics and management: Under what circumstances, if any, are algorithmic decision-making systems considered legitimate? The present study begins to answer this question. Using factorial vignette survey methodology, we explore the impact of decision importance, governance, outcomes, and data inputs on perceptions of the legitimacy of algorithmic decisions made by firms. We find that many of the procedural governance (...) mechanisms in practice today, such as notices and impact statements, do not lead to algorithmic decisions being perceived as more legitimate in general, and, consistent with legitimacy theory, that algorithmic decisions with good outcomes are perceived as more legitimate than bad outcomes. Yet, robust governance, such as offering an appeal process, can create a legitimacy dividend for decisions with bad outcomes. However, when arbitrary or morally dubious factors are used to make decisions, most legitimacy dividends are erased. In other words, companies cannot overcome the legitimacy penalty of using arbitrary or morally dubious factors, such as race or the day of the week, with a good outcome or an appeal process for individuals. These findings add new perspectives to both the literature on legitimacy and policy discussions on algorithmic decision-making in firms. (shrink)

I argue that, alongside the already well-established prohibition against treating persons as mere means, Kant’s Formula of Humanity requires a prohibition against treating persons as mere things. The former captures ethical violations due to someone’s (perceived) instrumental value, e.g. exploitation, the latter captures cases in which I mistreat others because they have no instrumental value to me. These are cases in which I am indifferent and complacent towards persons in need; forms of mistreatment frequently suffered by the world’s poorest. I (...) explain why we need the category of treating others as mere things and what the prohibition against such treatment entails. Prohibitions against treating as mere means and as mere things are both essential for understanding the specific nature and extent of our duties to the world’s poorest. (shrink)

The history of the Euclidean Steiner tree problem, which is the problem of constructing a shortest possible network interconnecting a set of given points in the Euclidean plane, goes back to Gergonne in the early nineteenth century. We present a detailed account of the mathematical contributions of some of the earliest papers on the Euclidean Steiner tree problem. Furthermore, we link these initial contributions with results from the recent literature on the problem.

Recognize the “philo- sophia ” as such, this side of Postmodernism, means, starting from the surprising studies of Heribert Boeder, see it as a thought epochally built on a Wisdom, that is, on a initial Knowledge about the Destiny of Man. For the philo-sophical thought of the so-called “German Idealism”, that Wisdom is neither that of the Muses, as in the First epoch, neither the “Christian sapientia”, as in the Middle epoch, but the “Civil Consciousness” about Duty and Freedom.

The vast majority of research in nursing ethics over the last decade indicates that nurses may not be fully prepared to ‘deliver the good’ for their patients, or to contribute appropriately in the wider current health care climate. When suitable research projects were evaluated for this article, one key question emerged: if nurses are educationally better prepared than ever before to exercise their ethical decision-making skills, why does research still indicate that the expected practice-based improvements remain elusive? Hence, a number (...) of ideas gleaned from recent research about the current nature of nursing ethics, and especially teaching nursing ethics to student nurses, are analysed and critiqued in this article, which concludes with a cluster of ideas and conclusions based on that analysis. It is hoped that such a review may serve as a catalyst for nurse educators to re-examine their teaching practices with a view to enhancing good nursing practice through educational means. (shrink)
