There is overwhelming evidence that the opioid crisis—which has cost hundreds of thousands of lives and trillions of dollars (and counting)—has been created or exacerbated by webs of influence woven by several pharmaceutical companies. These webs involve health professionals, patient advocacy groups, medical professional societies, research universities, teaching hospitals, public health agencies, policymakers, and legislators. Opioid companies built these webs as part of corporate strategies of influence that were designed to expand the opioid market from cancer patients to larger groups (...) of patients with acute or chronic pain, to increase dosage as well as opioid use, to downplay the risks of addiction and abuse, and to characterize physicians’ concerns about the addiction and abuse risks as “opiophobia.” In the face of these pervasive strategies, conflict of interest policies have proven insufficient for addressing corporate influence in medical practice, medical research, and public health policy. Governments, the academy, and civil society need to develop counterstrategies to insulate themselves from corporate influence and to preserve their integrity and public trust. These strategies require a paradigm shift—from partnerships with the private sector, which are ordinarily vehicles for corporate influence, to a norm of separation. (shrink)

In Perfection and Disharmony in the Thought of Jean-Jacques Rousseau, Jonathan Marks offers an interpretation of the philosopher's thought and its place in the contemporary debate between liberals and communitarians. Against prevailing views, he argues that Rousseau's thought revolves around the natural perfection of a naturally disharmonious being. At the foundation of Rousseau's thought he finds a natural teleology that takes account of and seeks to harmonize conflicting ends. Despite the periodic table having been discovered by chemists half a century before the discovery of electronic structure, modern designs are invariably based on physicists’ definition of periods. This table is a chemists’ table, reverting to the phenomenal periods that led to the table’s discovery. In doing so, the position of hydrogen is clarified.

Over the past decade, non-invasive prenatal testing (NIPT) has been adopted into routine obstetric care to screen for fetal sex, trisomies 21, 18 and 13, sex chromosome aneuploidies and fetal sex determination. It is predicted that the scope of NIPT will be expanded in the future, including screening for adult-onset conditions (AOCs). Some ethicists have proposed that using NIPT to detect severe autosomal AOCs that cannot be prevented or treated, such as Huntington’s disease, should only be offered to prospective parents (...) who intend to terminate a pregnancy in the case of a positive result. We refer to this as the ‘conditional access model’ (CAM) for NIPT. We argue against CAM for NIPT to screen for Huntington’s disease or any other AOC. Next, we present results from a study we conducted in Australia that explored NIPT users’ attitudes regarding CAM in the context of NIPT for AOCs. We found that, despite overall support for NIPT for AOCs, most participants were not in favour of CAM for both preventable and non-preventable AOCs. Our findings are discussed in relation to our initial theoretical ethical theory and with other comparable empirical studies. We conclude that an ‘unconditional access model’ (UAM), which provides unrestricted access to NIPT for AOCs, is a morally preferable alternative that avoids both CAM’s fundamental practical limitations and the limitations it places on parents’ reproductive autonomy. The expansion of the corpus of international human rights to include the right to water and sanitation has implications both for the process of recognizing human rights and for future developments in the relationships between technology, engineering and human rights. Concerns with threats to human rights resulting from developments in science and technology were expressed in the early days of the United Nations (UN), along with the recognition of the ambitious human right of everyone “to enjoy the benefits of scientific (...) progress and its applications.” This comment explores the hypothesis that the emerging concepts most likely to follow recognition of the human right to water primarily involve issues of science and technology, such as access to medicines or clean and healthy environment. Many threats to human rights from advances in science, which were identified in the past as potential, have become real today, such as invasion of privacy from electronic recording, deprivation of health and livelihood as a result of climate change, or control over individual autonomy through advances in genetics and neuroscience. This comment concludes by urging greater engagement of scientists and engineers, in partnership with human rights specialists, in translating normative pronouncements into defining policy and planning interventions. During times of crisis, institutions tend to focus on maintaining or restoring public trust, as well as on measures to insulate themselves (and their leadership) from potential legal liability. This is because institutions reflexively turn to lawyers, risk managers, crisis consultants, and public relations firms that focus on what they euphemistically call the “optics.” In this essay, I highlight the vital importance of addressing underlying reasons for an institution's loss of public trust—in particular, the loss (or erosion) of its integrity (...) and trustworthiness. Loss of public trust generates one kind of crisis—which I term “opsis.” But there is another kind of institutional crisis that so often remains unrecognized. Just as medical sepsis in the human body is a critical condition that endangers life, the loss of an institution's integrity and trustworthiness constitutes a type of sepsis—ethical sepsis—that poses an existential threat to the institution if unaddressed. Recently Díaz, Hössjer and Marks (DHM) presented a Bayesian framework to measure cosmological tuning (either fine or coarse) that uses maximum entropy (maxent) distributions on unbounded sample spaces as priors for the parameters of the physical models (https://doi.org/10.1088/1475-7516/2021/07/020). The DHM framework stands in contrast to previous attempts to measure tuning that rely on a uniform prior assumption. However, since the parameters of the models often take values in spaces of infinite size, the uniformity assumption is unwarranted. This is known (...) as the normalization problem. In this paper we explain why and how the DHM framework not only evades the normalization problem but also circumvents other objections to the tuning measurement like the so called weak anthropic principle, the selection of a single maxent distribution and, importantly, the lack of invariance of maxent distributions with respect to data transformations. We also propose to treat fine-tuning as an emergence problem to avoid infinite loops in the prior distribution of hyperparameters (common to all Bayesian analysis), and explain that previous attempts to measure tuning using uniform priors are particular cases of the DHM framework. Finally, we prove a theorem, explaining when tuning is fine or coarse for different families of distributions. The theorem is summarized in a table for ease of reference, and the tuning of three physical parameters is analyzed using the conclusions of the theorem. (shrink)

These are not the words of a harsh critic of the Food and Drug Administration. They were penned by the agency’s deputy commissioner for food. That this is an insider’s view makes it all the more troubling. Recent studies suggest that roughly half the products on supermarket shelves proclaim their purported health benefits.2 But a trip to the supermarket suggests that this is a conservative estimate. The FDA is not powerless to regulate these claims, but it operates in a regulatory (...) framework that is the product of piecemeal reform and compromise, not intelligent design. The use of other animals for human purposes is as contentious an issue as one is likely to find in ethics. And this is so not only because there are both passionate defenders and opponents of such use, but also because even among the latter there are adamant and diametric differences about the bases of their opposition. In both disputes, the approach taken tends to be that of applied ethics, by which a position on the issue is derived from a (...) fundamental moral commitment. This commitment in turn depends on normative ethics, which investigates the various moral theories for the best fit to our moral intuitions. Thus it is that the use of animals in biomedical research is typically defended by appeal to a utilitarian theory, which legitimates harm to some for the greater good of others; while the opposition condemns that use either by appeal to the same theory, but disagreeing about the actual efficacy of animal experimentation, or by appeal to an alternative theory, such as the right of all sentient beings not to be exploited. Unfortunately, the normative issue seems likely never to be resolved, hence leaving the applied issue in limbo. The present essay seeks to circumvent this impasse by dispensing altogether with any moral claim or argument, thereby cutting the Gordian knot of animal ethics with a meta-ethical sword. The alternative schema defended is simply to advance relevant considerations, whereupon “there is nothing left but to feel.” In a word, motivation replaces justification. (shrink)

The experimental laboratory can be a horror house for rats, monkeys, and other nonhuman animals. Yet their use in this setting is usually reported in a routine manner in publications that discuss the results. These contentions are illustrated with an analysis of the way animal evidence is presented in David J. Linden’s recent book, The Accidental Mind: How Brain Evolution Has Given Us Love, Memory, Dreams, and God (Harvard University Press, 2007). The book examines current debates about the emergence of an international legal norm of democratic governance and also considers some of the wider theoretical issues to which those debates give rise. It asks should international law seek to promote democratic political arrangements? If so, on what basis, and using which of the many competing conceptions of democracy?

This article will briefly explore some of the ways in which the past has been used as a means to talk about psychotherapy as a practice and as a profession, its impact on individuals and society, and the ethical debates at stake. It will show how, despite the multiple and competing claims about psychotherapy’s history and its meanings, historians themselves have, to a large degree, not attended to the intellectual and cultural development of many therapeutic approaches. This absence has the (...) potential consequence of implying that therapies have emerged as value-free techniques, outside of a social, economic and political context. The relative neglect of psychotherapy, by contrast with the attention historians have paid to other professions, particularly psychiatry, has also underplayed its societal impact. This article will foreground some of the instances where psychotherapy has become an object of emerging historical interest, including the new research that forms the substance of this special issue of History of the Human Sciences. Reason and Ethics defends the theoretical claim that all values are subjective and the practical claim that human affairs can be conducted fruitfully in full awareness of this. Joel Marks goes beyond his previous work defending moral skepticism to question the existence of all objective values. This leads him to suggest a novel answer to the Companions in Guilt argument that the denial of morality would mean relinquishing rationality as well. Marks disarms the argument by conceding the irreality (...) of both morality and logic, but is still able to rescue rationality while dispensing with morality on pragmatic grounds. He then offers a positive account of how life may be lived productively without recourse to attributions and assertions of right and wrong, good and bad, and even truth and falsity. Written in an accessible and engaging style, Reason and Ethics will be of interest to scholars and students working in metaethics as well as to the generally intellectually curious. (shrink)

The Fold is a book of practical philosophy that takes a radical new approach to aesthetics. Laura U. Marks calls this philosophy "enfolding-unfolding aesthetics," based in ideas derived from Gilles Deleuze and others (G.F.W. Leibniz, David Bohm, and Édouard Glissant) that the universe is folded in on itself. She proposes a theory of mediation as contact and connection across the folds and a set of embodied methods for detecting such cosmic connections. In drawing out this aesthetics, Marks considers (...) the embodied and sensuous dimensions of engaging with audiovisual works and works of art-dimensions that Marks suggests are composed of the very folds that compose everything and everyone: all living beings, from humans to particles, sandwiches to stars, technologies, thoughts and images, in the present, the past, and the future. Making use of art and film, with a focus on African diaspora and Arab cinema, Marks opens ways to strengthen connections to the cosmos and to better trace processes of becoming that are immanent within the fold. The Spread is a collection of very short essays first written for his blogs by philosopher Joel Marks. They perform two main functions: to isolate some points made in his earlier writings for special or clarificatory or corrective treatment, and to draw out further implications and applications from two theories he has been promoting: desirism and its even more extreme form, analetheism (or letheism). Both theories are premised on moral nihilism: the denial of objective value. Desirism offers an alternative (...) ethics based on reason. Letheism pertains to the ultimate question(s): What is real? What is true? What is truth? Is truth real? Marks has definite answers to offer, the answers are wholly skeptical and subjective, and yet they are intended to provide concrete guidance for living.
