Jean-Luc Marion’s phenomenology of giveness constitutes one of the most outstanding attempts to set up a universal theory of the phenomenologically given as a whole within the framework of contemporary philosophical thought. The aim of the present study is to apply the main categories of this phenomenological theory concerning gift to the singular type of phenomenon represented by the pure indeterminate and anonymous being to which Emmanuel Levinas refers by the name of il y a in his early writings. Therefore, this concerns examining the multiple specific modes of giveness proper to the impersonal “there is” and also its paradoxical relationship both with the donor and with the receiver of such gift in order to show the possibility of a “third way” of phenomenological investigation. This is a way equally distant from the western traditional concept of Being as “stable presence” and from Levinas’ proposal geared to substitute ontology for ethics as “first philosophy”. (shrink)

En este artículo se analiza la noción de fenómeno saturado en el pensamiento de Marion, pero, ante todo, y relacionado con dicho fenómeno, el tipo de sujeto que corresponde a la afectación saturante. La discusión se centra en la superación de la figura del Yo trascendental, y de la Modernidad en general, para dar lugar a un sujeto disminuido, a una diminutio ipseitatis, debida fundamentalmente a una iniciativa que, alega Marion, no proviene tanto del sujeto afectado, cuanto del (...) fenómeno que lo afecta. Desalojado de su formidable centro, el sujeto kenotizado emprende una clase de recreación bastante peculiar, la cual consiste en el conjunto de respuestas que habrá de ofrecer a la densidad del fenómeno mencionado. El sujeto se recibe de lo que recibe. En una hermenéutica sucesiva que retoma la afectación, tendrá que hacerse cargo del golpe de lo dado, es decir, de aquello que lo afecta, pero no exactamente de la manera como afectan los objetos a un sujeto cognoscente. A la pregunta de Nancy “¿qué viene después del sujeto?”, hay que responder sin ninguna hesitación: el sujeto, empero ahora disminuido en su capacidad creadora de mundo a través de la síntesis trascendental: l’adonné, el adonado. Few ethics committees were in place when the New Jersey Supreme Court announced its ruling on the Quinlan case in 1976. Today, the vast majority of hospitals have formed ethics committees and their use in nursing homes and other healthcare facilities is growing. Given the increasing commitment to the use of ethics committees and their increasing influence on healthcare decision making, the careful evaluation of committee performance should be a high priority. Yet to date ethics committees appear to have undergone (...) relatively little scrutiny. While professional articles on ethics committees do appear and at least one journal sets aside a regular section for the discussion of “Ethics Committees at Work” articles to date have primarily been limited to essays, philosophical inquiries, reports, case studies, and, occasionally, surveys. The use of more structured research methodologies has been lacking. As a result, it is not yet clear, for example, what characteristics describe the best functioning ethics committee. Indeed, what constitutes best functioning lacks careful definition as well. Committee impact on medical decision making and patient outcomes, while discussed, has not been systematically measured and analyzed. (shrink)

Humans possess great capacity for behavioral and cultural change, but our ability to manage change is still limited. This article has two major objectives: first, to sketch a basic science of intentional change centered on evolution; second, to provide examples of intentional behavioral and cultural change from the applied behavioral sciences, which are largely unknown to the basic sciences community.All species have evolved mechanisms of phenotypic plasticity that enable them to respond adaptively to their environments. Some mechanisms of phenotypic plasticity (...) count as evolutionary processes in their own right. The human capacity for symbolic thought provides an inheritance system having the same kind of combinatorial diversity as does genetic recombination and antibody formation. Taking these propositions seriously allows an integration of major traditions within the basic behavioral sciences, such as behaviorism, social constructivism, social psychology, cognitive psychology, and evolutionary psychology, which are often isolated and even conceptualized as opposed to one another.The applied behavioral sciences include well-validated examples of successfully managing behavioral and cultural change at scales ranging from individuals to small groups to large populations. However, these examples are largely unknown beyond their disciplinary boundaries, for lack of a unifying theoretical framework. Viewed from an evolutionary perspective, they are examples of managing evolved mechanisms of phenotypic plasticity, including open-ended processes of variation and selection.Once the many branches of the basic and applied behavioral sciences become conceptually unified, we are closer to a science of intentional change than one might think. The Situationist International (1957-1972) was a small group of communist revolutionaries, originally organised out of the West European artistic avant-garde of the 1950s. The focus of my thesis is to explain how the Situationist International (SI) became a group able to exert a considerable influence on the ultra-left criticism that emerged during and in the wake of the May movement in France in 1968. My wager is that the pivotal period of the group is to be found between 1960 and (...) 1963, a period marked by the split of 1962. Often this is described as the transition of the group from being more concerned with art to being more concerned with politics, but as I will argue this definitional shorthand elides the significance of the Situationist critique of art, philosophy and politics. The two axes of my thesis are as follows. First, that the significant minority in the group which carried out the break of 1962, identified a homology between the earlier Situationist critique of art — embodied in the Situationist ‘hypothesis of the construction of situations’ — and Marx’s critique and supersession of the radical milieu of philosophy from which he emerged in the mid- 1840s. This homology was summarised in the expression of the Situationist project as the ‘supersession of art’ (dépassement de l’art). Secondly, this homology was practically embodied in the resolution of the debates over the role of art in the elaboration of the Situationist hypothesis, which had been ongoing since 1957. However, it was the SI’s encounter with the ultra-left group Socialisme ou Barbarie that would prove decisive. Via Guy Debord’s membership, the group was exposed to both the idea of a more general revolutionary criticism, but also ultimately what was identified as the insufficiently criticised ‘political militancy’ of this group. Indeed, in the ‘political alienation’ found in Socialisme ou Barbarie, a further homology was established between the alienation of the political and artistic avant-gardes. This identity would prove crucial to the further elaboration of the concept of ‘spectacle’. By way of an examination of the peculiar and enigmatic ‘Hamburg Theses’ of 1961, and the relationship between these ‘Theses’ and the Situationist criticism of art and politics worked out over the first five years of the group, I will argue that the break in 1962 should be conceived as one against politics as much as art (rather than just the latter, as it is more often represented). Additionally, I will outline how the SI, through the paradoxical reassertion of their artistic origins, attempted to synthesise their criticism of art with the recovery of the work of Marx beyond its mutilation as Marxism. Indeed, it was the synthesis of these critiques that enabled the considerable development of the concept of ‘spectacle’, opening the way to the unique influence the SI exerted in the re-emergence of a revolutionary movement at the end of the 1960s. After Husserl and Heidegger, phenomenology has attempted to push the reduction beyond the reference of objects to the performances effected by consciousness, or of beings to Being. First, a new level of the reduction comes forth in M. Henry's radical reduction of appearing to the appearing of appearing, and leads to the disclosure of a dimension in which no horizons are to be fulfilled because the superabundance of life holds sway. Secondly, according to H. Rombach, the phenomena decribed in the (...) first two levels are nothing but epiphenomena, and must be explained in terms of structures that emerge in a creative development. Reality brings forth something from itself, and we must take advantage of this contribution in order to obtain more than what is anticipated in our projects. Thirdly, J.-L. Marion advances a theory on saturated phenomena in order to account for phenomena that surpass the bounds outlined for them in the mere significational intentions because they show a surplus of intuition. The three trends lead respectively to an originary phenomenality, an outbreak of phenomena, and saturated phenomena. The article contends that they tend to come together because they link the third level of phenomenology to a reflection that turns on the duality between what appears and its appearing, and, in doing so, disclose a surplus with regard to three different aspects of the duality, i.e., appearing as such, the overall condition of what appears, or the appearing of some preeminent phenomena. Finally, some anticipations of these trends in Husserl's transcendental phenomenology are shown.Luego de Husserl y Heidegger, la fenomenología ha intentado llevar la reducción más allá de la referencia de los objetos a las operaciones efectuadas por la conciencia o de los entes al ser. This is the text of The Lindley Lecture for 2003, given by Iris Marion Young, an American philosopher.

This article presents a conceptual investigation into the value impacts and relations of algorithms in the domain of justice and security. As a conceptual investigation, it represents one step in a value sensitive design based methodology. Here, we explicate and analyse the expression of values of accuracy, privacy, fairness and equality, property and ownership, and accountability and transparency in this context. We find that values are sensitive to disvalue if algorithms are designed, implemented or deployed inappropriately or without sufficient consideration (...) for their value impacts, potentially resulting in problems including discrimination and constrained autonomy. Furthermore, we outline a framework of conceptual relations of values indicated by our analysis, and potential value tensions in their implementation and deployment with a view towards supporting future research, and supporting the value sensitive design of algorithms in justice and security. We thank the commentators for an extraordinarily diverse and constructive set of comments. Nearly all applaud our goal of sketching a unified science of change, even while raising substantive points that we look forward to addressing in our reply, which we group into the following categories: What counts as evolutionary; Ethical considerations; Complexity; Symbotypes, culture, and the future; What intentional cultural change might look like; An evolving science of cultural change; and Who decides?

This paper argues that the inappropriate framing and implementation of plagiarism detection systems in UK universities can unwittingly construct international students as ‘plagiarists’. It argues that these systems are often implemented with inappropriate assumptions about plagiarism and the way in which new members of a community of practice develop the skills to become full members of that community. Drawing on the literature and some primary data it shows how expectations, norms and practices become translated and negotiated in such a way (...) that legitimate attempts to conform with the expectations of the community of practice often become identified as plagiarism and illegitimate attempts at cheating often become obscured from view. It argues that this inappropriate framing and implementation of plagiarism detection systems may make academic integrity more illusive rather than less. It argues that in its current framing – as systems for ‘detection and discipline’ – plagiarism detection systems may become a new micro-politics of power with devastating consequences for those excluded. This study, based on the self-determination theory, investigates the link between university students' social peer and teacher integration and intrinsic motivation development. Both integration contexts are expected to contribute to the student's development, either additive or compensatory. The analyses rely on a nationally representative sample of 7,619 German university students and cover the time between the 3rd and 5th semesters in a longitudinal design. Person-centered analytical tools were applied to tap interindividual differences in the motivational trajectories as well as in (...) integration profiles. Latent transition analyses revealed distinct links between the motivational trajectories and the integration profiles, pointing to additive effects of teacher and peer integration. Positive trajectories were more likely in the Highly than in Moderately Integrated profiles. The two profiles pointing to below-average integration levels showed the same probabilities for rather negative trajectories. The results are discussed against the backdrop of self-determination theory and additive vs. compensatory effects of teacher and peer integration, proposing a threshold model. (shrink)

Two experiments examined the impact of causal relations between features on categorization in 5‐ to 6‐year‐old children and adults. Participants learned artificial categories containing instances with causally related features and noncausal features. They then selected the most likely category member from a series of novel test pairs. Classification patterns and logistic regression were used to diagnose the presence of independent effects of causal coherence, causal status, and relational centrality. Adult classification was driven primarily by coherence when causal links were deterministic (...) (Experiment 1) but showed additional influences of causal status when links were probabilistic (Experiment 2). Children’s classification was based primarily on causal coherence in both cases. There was no effect of relational centrality in either age group. These results suggest that the generative model (Rehder, 2003a) provides a good account of causal categorization in children as well as adults. (shrink)

Discussions about freedom of speech and academic freedom today are about the limits to those freedoms. However, these discussions take place mostly in the higher education trade press and do not receive any serious attention from academics and educationalists. In this paper several key arguments for limiting academic freedom are identified, examined and placed in an historical context. That contextualisation shows that with the disappearance of social and political struggles to extend freedom in society there has come a narrowing of (...) academic life and a new and impoverished concept of 'academic freedom' for a diminished idea of the human subject, of humanity and of human potential. Originally published during the early part of the twentieth century, the Cambridge Manuals of Science and Literature were designed to provide concise introductions to a broad range of topics. They were written by experts for the general reader and combined a comprehensive approach to knowledge with an emphasis on accessibility. Plato: Moral and Political Ideals by Adela Marion Adam, first printed in 1913, deals with the main substance of Plato's philosophy of ethics and politics, set within the context of (...) his intellectual debt to Socrates. Poor nutrition habits have been reported in the childcare setting. While the literature advocates the need to carry out ‘Voice of the Child’ research, few studies have explored this methodology with regard to children and food, in particular in the pre-school setting. This article aims to outline the ethical issues raised by a research ethics committee and to discuss the impact of these issues on a study that hoped to determine the food perceptions of children (aged three to four years) (...) within an ongoing nutrition and lifestyle pre-school project in Ireland. Ethical approval was granted for this study but only upon the clarification of two aspects: that only hedonic symbols previously used in the literature could be included in the study; and that parental consent be obtained from both parents of each child. Children were shown food pictures and asked to use the hedonic symbols to answer questions posed to them on the food. Owing to the ethical constraints imposed by the requirement for two-parent consent, seven children, from a potential sample of 85, were eligible to partake in the study. These children did not seem to understand the hedonic symbols recommended for use by the ethics committee, therefore preventing the collection of in-depth qualitative data. The ethical constraints placed on this study impacted on both its design and its methodology and are discussed in relation to national and international ethical guidance and legislation. Future research with children regarding food choice must balance the need for strict ethical standards with the need to explore children’s views on this subject. (shrink)
