As a scientific, materialist worldview becomes increasingly difficult to repudiate, and as philosophers increasingly uncover and articulate the conceptual nature of morality and distinctively moral normativity, the threat of moral anti-realism becomes more and more real. This perspective is argued in Chapter One. Chapter Two discusses how laws and bioethical trends that pertain to the clinical management of patients in a vegetative coma differ from country to country and continue to give rise to unresolved legal debates and scientific controversy. Chapter (...) Three covers how caregivers in palliative care must be supported to better understand patients hopes and needs, making them comfortable to decide when or how much they want to eat. Chapter Four synthesises findings from four empirical studies conducted in Western Africa (Togo) on topics related to the autonomy (end of life decision-making among terminally-ill patients), benevolence and non-malevolence (breaking bad news to elderly patients and their families), and justice (informal payments to physicians, criminal prosecution in cases of HIV transmission) principles of bioethics. Finally, Chapter Five argues that expert members in Ethics committees have an unfair upper-hand, with their decisions trumping other debates in committee deliberations. ArgumentFollowing an international trend, Italy has reformed its university system, especially concerning methods and tools for research evaluation, which are increasingly focused on a number of bibliometric indexes. To study the effects of these changes, we analyze the changing profiles of economists who have won competitions for full professorship in the last few decades in the country. We concentrate on individual characteristics and on scientific production. We show that the identification of a univocal and standardized concept of “research quality” within (...) the new research assessments has progressively imposed a strategy of “homologation,” especially for women. We find that women economists are at a higher risk of discrimination than their male colleagues and thus they are more likely to conform their research activities to the standardized profile imposed by the gender-blind application of simplistic bibliometric methods. In State v. McKnight, the Supreme Court of South Carolina decided 3-2 to affirm McKnight’s conviction for homicide by child abuse based on the finding that her cocaine use during pregnancy caused her daughter to be stillborn. Under South Carolina law, a person is guilty of homicide by child abuse if he or she “causes the death of a child under the age of eleven while committing child abuse or neglect, and the death occurs under circumstances manifesting extreme indifference to (...) human life.” During the trial, the pathologist who conducted the autopsy testified that the only way for the infant to have cocaine byproducts present in her system was ifthe mother had ingested cocaine, and the cause of death was intrauterine fetal demise. Another pathologist testified that there was a reasonable degree of medical certainty that the cause of death was intrauterine cocaine exposure. (shrink)

It has been argued that an adequate feminist response to sexist pornography demands not just efforts to eradicate sexist beliefs, but also aesthetic counter-intervention at the level of taste. This view motivates support for feminist pornography. This paper takes the feminist pornography suggestion seriously by unpacking difficulties for the project. I begin by spelling out two views about what makes feminist pornography feminist: the ‘content view,’ and the ‘context view,’ and discuss what I take to be existing arguments for the (...) latter. I then present two objections to the context view: the first focuses on how we characteristically interact with pornography (as a masturbatory aid), the second challenges the value of authenticity upon which much feminist pornography rests. If these arguments are correct, then there are serious flaws with feminist pornography as it is commonly conceived. I close with a brief suggestion of an alternative approach rooted in feminist solidarity. (shrink)

Aristotle often describes virtue in an idealized way, indicating that the virtuous person will never err or have a bad desire. Yet, drawing from empirical work on character and personality, many philosophers and psychologists believe that most people’s behavior stems from situational factors and that good behavior often stems from the wrong motives, such as maintaining a good mood or relieving feelings of guilt. Further, some suggest that the variability in most people’s behavior raises a challenge to traditional categories of (...) character such as virtue, vice, continence, and incontinence. Thus, it may seem impossible to develop virtue and that people lack character as Aristotle conceived of it. Drawing from Aristotle’s Rhetoric and Politics, I develop accounts of actual virtue and the character of ordinary people and respond to these two concerns. (shrink)

The globalism objection poses two distinct challenges to Aristotelian views of virtue. On the one hand, the consistency thesis demands that a virtue is behaviorally expressed in a wide range of trait-relevant situations. On the other hand, the evaluative integration thesis suggests that the presence of one virtue increases the probability of other, similar virtues, posing a problem for Aristotle’s reciprocity of the virtues thesis. I show that, by contrast to contemporary Aristotelian views and views attributed to Aristotle, Aristotle’s own (...) theory of virtue escapes the globalism objection. I address the consistency thesis by showing that each of Aristotle’s moral virtues are narrower than commonly assumed. I then address the evaluative integration thesis through a discussion of practical wisdom, showing that Aristotle believed one could fall short of perfect virtue, while still being fully virtuous. The upshot is that, despite idealizations of virtue throughout the Nicomachean Ethics, Aristotle held a realistic account of virtue, one that is different from contemporary Aristotelian views, and one that is empirically adequate insofar as it allows for more than a few virtuous people. Self-sovereign identity solutions implemented on the basis of blockchain technology are seen as alternatives to existing digital identification systems, or even as a foundation of standards for the new global infrastructures for identity management systems. It is argued that ‘self-sovereignty' in this context can be understood as the concept of individual control over identity relevant private data, capacity to choose where such data is stored, and the ability to provide it to those who need to validate it. It is also (...) argued that while it might be appealing to operationalise the concept of ‘self-sovereignty’ in a narrow technical sense, depreciation of moral semantics obscures key challenges and long-term repercussions. Closer attention to the normative substance of the ‘sovereignty’ concept helps to highlight a range of ethical issues pertaining to the changing nature of human identity in the context of ubiquitous private data collection. This chapter argues that the choice of trust conceptualisations in the context of consumer Internet of Things (IoT) can have a significant impact on the understanding and implementations of a user’s private data protection. Narrow instrumental interpretations of trust as a mere precondition for technology acceptance may obscure important moral issues such as malleability of user’s privacy decisions, and power imbalances between suppliers and consumers of technology. A shift of focus in policy proposals from trust to the trustworthiness of technology (...) can be the first step on the way to addressing these moral concerns. It is argued that complexity of IoT systems, comprised of technological artefacts and institutional data-collecting entities, warrants the moral value of distrust as a prima facie assumption for technological design and regulatory measures. Such a conceptual perspective highlights importance of technological measures that can minimise reliance on trust in consumer IoTs and regulatory measures aimed to improve transparency of IoT architectures. This qualitative classroom study investigated the development of pragmatic competence in academic discussions through content analysis of student reflective writing. The aims of the study were: to understand the greatest challenges that students faced during the learning process, the causes of those challenges, and the most successful strategies that students employed to overcome the challenges. In addition, the analysis investigated other significant themes in the reflective writing that related to the students’ experiences in developing their pragmatic competence in discussions. Five (...) advanced English for Academic Purposes (EAP) students at a Sino-US institution in China participated over the course of a semester. Results showed that common challenges included: hesitation resulting in missed opportunities to speak, lack of clarity when speaking, inability to repair communication breakdowns, and difficulty with listening comprehension. Self-reflection allowed the learners to understand the various reasons for the challenges they faced and to develop appropriate pragmalinguistic and sociopragmatic strategies for coping with them. It also enabled the instructor to make suggestions suited to learners’ specific needs. In addition to revealing specific challenges, causes, and strategies that students employed, themes that emerged through content analysis included the impact of students’ emotional lives on their learning and performance, as well as the value of authentic communication in the development of pragmatic competence for academic discussions. This exploratory classroom investigation provides suggestions for teaching pragmatic competence in academic discussions and for additional classroom explorations that empower learners to develop autonomy. This paper argues that the practical implementation of blockchain technology can be considered an institution of property similar to legal institutions. Invoking Penner's theory of property and Hegel's system of property rights, and using the example of bitcoin, it is possible to demonstrate that blockchain effectively implements all necessary and sufficient criteria for property without reliance on legal means. Blockchains eliminate the need for a third-party authority to enforce exclusion rights, and provide a system of universal access to knowledge and (...) discoverability about the property rights of all participants and how the system functions. The implications of these findings are that traditional property relations in society could be replaced by or supplemented with blockchain models, and implemented in new domains. (shrink)

In the early 1960s, American philosopher of science Thomas Kuhn contributed to a “crisis of rationality” with his hypothesis that science develops by means of paradigm shifts. He challenged the positivist concept of cumulative and continuous scientific progress. According to Kuhn, the relation between two succeeding scientific traditions ‘separated by a scientific revolution’ is characterized by conceptual incommensurability that constrains the interpretation of science as a cumulative, steadily progressing enterprise. Thomas Kuhn’s philosophy was heavily criticized by German-American biologist Ernst Mayr (...) as unapplicable to the history of biology. Mayr, one of the most outstanding evolutionary biologists of the 20th century and a “co-architect” of the so-called Modern Synthesis (contemporary Darwinism), published extensively on the history and philosophy of biology as he thought that theoretical biology cannot progress without proper philosophy of science. Being convinced of the progressive development of Darwinism, Mayr pointed out that Kuhn’s concept of scientific revolutions does not reflect conceptual changes in evolutionary biology. Here we summarize Mayr’s critiques of Kuhn and, based on our own research, take Mayr’s side in the controversy between two great thinkers. (shrink)

In this study, I reconstruct and compare Alain Badiou’sBeing and Event(2005) and Graham Priest’sOne(2014), arguing that the ontologies pursued within the two texts are intriguingly analogous in a number of ways. Both Badiou and Priest are committed to thinking through classically ontological problems without denying the validity of the paradoxes they raise; both regard Plato’sParmenidesas an early and formative account of these paradoxes; both establish conclusions to the effect that unity – or “oneness” – is indeed a contradictory phenomenon; and (...) both, as a corollary of this conclusion, develop frameworks which confer ontological prominence uponthe voidandemptinessrespectively, thereby arriving at what appears to be a shared ontological nihilism. In this comparative study, I not only enquire whether the frameworks adopted by Badiou and Priest really do lead to nihilist conclusions, but also attempt to clearly outline their trajectories of thought for the benefit of those who might be tempted to dismiss their seemingly outlandish theses out of hand. ABSTRACTThis article discusses some common narratives found in discourses on national identity in Russia and Japan, and their temporal transformations reflecting the needs of a nation as it becomes a colonial empire. National identity discourse is examined from the viewpoint of national antagonism arising from an external threat. Russian and Japanese intellectuals, with their vastly different historical and cultural heritage, have dwelled upon similar issues pertaining to modernization of the state and adoption or rejection of foreign ideas and ways of (...) life. There are several themes in Russian and Japanese discourses on national identity that share a significant overlap, particularly themes of national uniqueness and a ‘special path’, deterministic worldviews, imperial cosmopolitanism/messianism and criticism of ‘Western’ philosophical systems and concepts. This article elucidates the shared aspects of these narratives and philosophical inquiries in Russia and Japan and puts them into a historical context. (shrink)

The purpose of the present paper is to develop kinematics of the special relativity with an anisotropy of the one-way speed of light. As distinct from a common approach, when the issue of anisotropy of the light propagation is placed into the context of conventionality of distant simultaneity, it is supposed that an anisotropy of the one-way speed of light is due to a real space anisotropy. In that situation, some assumptions used in developing the standard special relativity kinematics are (...) not valid so that the “anisotropic special relativity” kinematics should be developed based on the first principles, without refereeing to the relations of the standard relativity theory. In particular, using condition of invariance of the interval between two events becomes unfounded in the presence of anisotropy of space since the standard proofs drawing the interval invariance from the invariance of equation of light propagation are not valid in that situation. Instead, the invariance of the equation of light propagation, which is a physical law, should be taken as a first principle. A number of other physical requirements, associativity, reciprocity and so on are satisfied by the requirement that the transformations between the frames form a group. Finally, the correspondence principle is to be satisfied which implies that the coordinate transformations should turn into the Galilean transformations in the limit of small velocities. The above formulation based on the invariance and group property suggests applying the Lie group theory apparatus which includes the following steps: constructing determining equations for the infinitesimal group generators using the invariance condition; solving the determining equations; specifying the solutions using the correspondence principle; defining the finite transformations by solving the Lie equations; relating the group parameter to physical parameters. The transformations derived in such a way, as distinct from the transformations derived in the context of conventionality of distant simultaneity, cannot be converted into the standard Lorentz transformations by a coordinate change. The anisotropic nature of the presented transformations manifests itself in that they do not leave the interval invariant but only provide the conformal invariance of the interval. The relations that represent measurable effects include the conformal factor which depends on the relative velocity of the frames and the anisotropy degree. It is important to note the use of the correspondence principle as a heuristic principle which allows to relate the conformal factor to the anisotropy degree and thus completely specify the transformations and observable quantities. Annotation Redefines globalization as merely the framework of the current political debate on the future of world power.

Increasingly, biologists are using computers to model and to create biological representations. However, the exponential growth in available biological dataposes a challenge for experimental and theoretical researchers in both Biology and in Computer Science. In short, when even the simple retrieval of relevant biological information for a researcher becomes a complex task — its analysis and synthesis with other biological information will become even more daunting and unlikely. In this context, specially organized ‘structures of representation’ are needed for the efficient (...) interpretation of experimentally generated data. The “semantic Web” is a recent trend in networking techniques that we will examine here as a possible strategy for the computation of biological data — one that may allow us to take into account both the semiotic dimensions of biological processes, as well as their dynamic organization into stable and systemic levels. Thereupon, we propose that a semantic network for biology could benefit from principles rooted in such previous representation efforts as computer-generated ‘landscapes’ and ‘physical attractors’ — and that such principles could, in turn, then be better integrated into biological research through the development of a more semiotically informed user / computer interface design. This contribution contextualizes the relationship between fragility and education in the light of people’s changing conditions and perspectives, and their impact on educational processes, focusing in particular on the consequences of the outbreak of the Covid-19 pandemic. By doing so, it introduces this focus, illustrates its coherence, and explains the basic methodological choice, namely the adoption of the Systematic Review, to explore different aspects of the relationship between fragility and education.

BackgroundCognitive dysfunctions, both subjective and detectable at psychometric testing, may follow SARS-CoV-2 infection. However, the ecological-functional relevance of such objective deficits is currently under-investigated. This study thus aimed at investigating the association between objective cognitive measures and both physical and cognitive, ecological-functional outcomes in post-COVID-19.MethodsForty-two COVID-19-recovered individuals were administered the Mini-Mental State Examination and the Montreal Cognitive Assessment. The Functional Independence Measure was adopted to assess functional-ecological, motor/physical and cognitive outcomes at admission and discharge.ResultsWhen predicting both T0/T1 FIM-total and-Motor scores (...) based on MMSE/MoCA scores, premorbid risk for cognitive decline and disease-related features, no model yielded a significant fit. However, the MoCA - but not the MMSE significantly predicted T0/T1 FIM-Cognitive scores. The MoCA was significantly related only to T0/T1 FIM-Cognitive Memory items.DiscussionCognitive measures are not associated with physical/motor everyday-life outcomes in post-COVID-19 patients. The MoCA may provide an ecological estimate of cognitive functioning in this population. (shrink)

This paper looks at the development of blockchain technologies that promise to bring new tools for the management of private data, providing enhanced security and privacy to individuals. Particular interest present solutions aimed at reorganizing data flows in the Internet of Things architectures, enabling the secure and decentralized exchange of data between network participants. However, as this paper argues, the promised benefits are counterbalanced by a significant shift towards the propertization of private data, underlying these proposals. Considering the unique capacity (...) of blockchain technology applications to imitate and even replace traditional institutions, this aspect may present certain challenges, both of technical and ethical character. In order to highlight these challenges and associated concerns, this paper identifies the underlying techno-economic factors and normative assumptions defining the development of these solutions amounting to technologically enabled propertization. It is argued that without careful consideration of a wider impact, such blockchain applications could have effects opposite to the intended ones, thus contributing to the erosion of privacy for IoT users. This article studies the specific designation of morals under the conditions of a modern society. Due to the circumstances that morals are able to overcome differences between the social regulatory systems and to unite the perceptions of a regulatory framework, they have become a major contemporary metalegal regulator. Being a significant social regulator, morals also play a mediation role between law and other social regulatory systems. In this role of theirs, they make a substantial factor having an influence on building (...) and changing legal prescriptions. Morals are also studied as a variable in the conditions of a dynamically developing society and changing conditions of living. Some models of behaviours, which were considered to be against moral only several decades ago, are nowadays regarded as completely normal. (shrink)

The moral significance of blockchain technologies is a highly debated and polarised topic, ranging from accusations that cryptocurrencies are tools serving only nefarious purposes such as cybercrime and money laundering, to the assessment of blockchain technology as an enabler for revolutionary positive social transformations of all kinds. Such technological determinism, however, hardly provides insights of sufficient depth on the moral significance of blockchain technology. This thesis argues rather, that very much like the cryptographic tools before them, blockchains develop in a (...) constant feedback loop. Blockchain applications are driven by values, normative assumptions, and personal commitments of researchers, which shape moral effects of technology. At the same time these very assumption are often embedded in preexisting moral conception and ethical theories, implicitly or explicitly accepted by blockchain developers. And just as the introduction of one flawed element in the cryptographic application can have mass scale effects, the introduction of flawed normative assumptions can have far reaching consequences in blockchain applications. This thesis argues that we should not take normative assumptions present in blockchain applications as given. Just like the open-source code is developed through the public revision and scrutiny, we should aim to make normative assumptions transparent and be ready to revise them in case we find some bugs. How can we qualify claims that blockchain technologies enable new types of institutions? Can blockchain technologies eliminate trust in complex socio-technical systems? What does individual sovereignty mean in the context of private data control and privacy? Whether property in private data enabled by blockchain applications can solve moral issues of privacy and commercial surveillance? Answers to these and other questions map some of the key normative assumptions present in the current blockchain applications and serve as a contribution to the open-source project of the future society built on the fundamental human values. This paper examines the plays of African-American playwright Adrienne Kennedy, Funnyhouse of a Negro (1962) and The Owl Answers (1963), which remain important for their engagement with notions of African-American identity, resistance and agency through their attention to mixed race female characters or mulattos who experience bodily and psychological traumas that demonstrate the abuse of the colonized on a deeply visceral level. Kennedy's plays have remained controversial because of their failure to comply with the nationalistic orientation of the Black Arts (...) Movement (BAM) of 1960s America. I aim to examine these plays through a framework of postcolonial-feminist performance analysis that finds its way back to histories of colonization and slavery, enabling through such returns, a compelling critique of the manoeuvrings of racial hierarchies and power imbalances. As well, I argue that Kennedy's protagonists are de-essentialized fractured beings who fail to embody either White superiority or Black nationalist pride, as they oscillate between two polarities. Such failure (on the part of Kennedy's mulattos) allows for a strategic de-essentialization of identity that interrogates fixed categorization. As well, through a form that is fluid, fragmented and blurs the distinctions among history, memory, space and time, her works impart political agency to the characters and enable an empowered sense of the ‘self-in-process.’. In der vorliegenden Arbeit soll ein in der analytischen Philosophie aufgestelltes Programm zur Explikation der kausalen Begrifflichkeit kritisch untersucht werden. Seine kritische Analyse mag im Hinblick auf die Rolle von Interesse sein, welche die kausalen Begriffe in einer allgemeinen Theorie der wissenschaftlichen Erklärung zu spielen haben. Diese Analyse könnte außerdem m.E. zur Bestimmung des Ausgangspunktes einer positiven Behandlung der mit den kausalen Begriffen zusammenhängenden Sinnfragen beitragen.

The article builds on Husserl’s “trivial” observations from the manuscript Reason — Science. Reason and Morality — Reason and Metaphysics on the topic of conscience, to then question the neglect of the topic of misguided conscience or self-deception in Heidegger’s model of conscience from §§ 54–60 of Being and Time. In Heidegger’s conception of conscience (as a silent call appealing to the authenticity of Dasein) we will not find a number of points important to the Husserlian understanding of conscience: neither (...) the unrevealed horizons of prior life, nor the relativity of intersubjective contexts, nor a misguided (and doubting) conscience, still less a search for (presumed) evidence. That said, the way Heidegger axiomatically sets up the original culpability of Dasein creates a number of dead ends or blind spots in this model. It is to these that Mark Richir addresses in his interpretation (or, more precisely, two alternative interpretations), speaking of the “original symbolic mishap” that befell Dasein, and then of the “symbolic tautology” in which it has become a prisoner. Richir’s critique is not aimed at “overcoming” Heidegger’s model of conscience, but at demonstrating a transcendental illusion — probably inevitable for one who is guided by “authenticity” and the “inner voice.” This is a kind of critical phenomenology of “authenticity”, which manages to avoid the closedness of phenomenology in itself by “grafting” in it poststructuralism. This is why both the first and the second interpretation by the Belgian phenomenologist focus on the problem of symbolic structures: “original symbolic mishap” in the first case and “symbolic tautology” in the second. We investigate the parallelism between aesthetic experience and the practice of phenomenology using Viktor Shklovsky’s theory of “estrangement”. In his letter to Hugo von Hofmannsthal, Husserl claims that aesthetic and phenomenological experiences are similar; in the perception of a work of art we change our attitude in order to concentrate on how the things appear to us instead of what they are. A work of art “forces us into” the aesthetic attitude in the same way as the phenomenological epoché drives (...) us into the phenomenological one. The change of attitudes is a condition of possibility of aesthetic and/or phenomenological experience. Estrangement is an artistic device that breaks the routinized forms of perception: one sees the thing as new and does not just “recognize” it automatically. Shklovsky insists that it is possible if one experiences or feels the form of the work of art—in an affective and even sensuous way. We claim that this is similar to the phenomenological seeing, or intuition, which, according to Husserl, should be devoid of all understanding. Phenomenological epoché can also be described as a philosophical technique that aims to arrest the “ready-made,” “taken for granted,” “pre-given” meanings in order to access a new meaning which is not yet stabilized, the “meaning-in-formation.” It is not enough to turn from what appears to how it appears; one has to oscillate between these conflicting attitudes, or rather to keep them both at the same time thus gaining a kind of a 3D-vision of meaning in its becoming. This double life in two different attitudes can be clarified in terms of Roman Jakobson’s theory of antinomic coexistence between the poetic and communicative functions of language. The notion of “double life in two attitudes” uncovers the role that ostranenie can play in the philosophical transformation of the subject based on variety and essential mobility of the affective components involved. Proposing a phenomenological interpretation of a passage from Samuel Beckett we show how the radicalization of ostranenie can lead even to “meta-estrangement”: to estrangement of the everyday “lack of estrangement.” We conclude with a remark on the productivity of this form of estrangement in the phenomenological context. The article analyzes some key motives of both classical German phenomenology and contemporary French phenomenology. The theme of sense-formation, a recurring thread throughout Husserl's entire body of work, serves as a discussion starting point.A special emphasis is put on one of Husserl's posthumously published texts from 1933, in which he distinguishes between the open process of sense-formation [Sinnbildung] and the closed sense-structures [Sinngebilde]. The “phenomenon” to which phenomenological philosophy refers here is not a “pre-given thing” yet, but rather the horizon (...) in which its sense is shaped. This fundamental intuition is crucially important for the project of “nonstandard” phenomenology, which Richir is developing in the context of Francophone philosophy. The implicit conception of conscience from Ludwig Wittgenstein’s notes from 1929 is brought into comparison with the theory of conscience as a paradoxical identity of guilt and innocence by Philip Konrad Marheineke (which served as a pattern for Kierkegaardian concept of “despair”) and of conscience as a (grammatical and temporal) redoubling by Vladimir Jankélévitch. Wittgensteinian views on conscience and feeling of guilt tend to Marheineke-Kierkegaard’s model (the guilt hides in innocence and vice versa) and to Jankélévitch’s model (the wrongdoing from (...) the past makes us regret the innocence which preceded it in a far remote past). I explore these tautological models of conscience using the example of Wittgensteinian metaphor of “waterwheel”: of an engineering failure producing a constant sentiment of guilt. Austrian philosopher describes his “incapacity to think” as a source of background, freely floating guilt. “Uselessness” and “mediocrity” or as he puts it “groundlessness of your own existence” altogether with “incapacity to think”—those are the self-accusations of the thinker. This torturing state he at the same time considers to be the source of his own philosophical productivity. Would a conscience be possible which would be free of this tautological structure and of this endless “rumination” of the petty guilt? The article proposes a hypothesis how one could break the tautological circle of an idling scrupulous conscience. (shrink)
