Few novel or emerging infectious diseases have posed such vital ethical challenges so quickly and dramatically as the novel coronavirus SARS‐CoV‐2. The World Health Organization declared a public health emergency of international concern and recently classified Covid‐19 as a worldwide pandemic. As of this writing, the epidemic has not yet peaked in the United States, but community transmission is widespread. President Trump declared a national emergency as fifty governors declared state emergencies. In the coming weeks, hospitals will become overrun, stretched (...) to their capacities. When the health system becomes stretched beyond capacity, how can we ethically allocate scarce health goods and services? How can we ensure that marginalized populations can access the care they need? What ethical duties do we owe to vulnerable people separated from their families and communities? And how do we ethically and legally balance public health with civil liberties? (shrink)

In this paper I develop a social conception of integrity while still holding onto the original meaning of the term. To that end I build mainly on the works of Cheshire Calhoun, whose view of integrity, developed over a decade ago, I consider to be one of the best, Charles Taylor, who has an insightful understanding of the self, which helps provide a richer conception of integrity than I believe Calhoun developed, and Lawrence Langer, who gives an (...) instructive critique of Taylor, which I use to provide the foundation for an integrity richly grounded in community. Finally I discuss how community can contribute to or diminish one’s integrity and how it can help restore one’s integrity if it has been diminished or lost. (shrink)

In this paper, I want eventually to get around to proposing a criterion of identity for events which are changes in physical objects, where events are construed as comprising a distinct metaphysical category of thing. The proposal will be preceded by a discussion of what I take to be a mistaken suggestion for such a criterion; I will do that because I think that seeing what it takes to show why that suggestion fails helps to motivate a theory about what (...) it is to be an event; and that theory wi II supply the conceptual foundations for my proposal concerning the criterion of identity for events. Before that suggestion is discussed, however, I want to discuss briefly an aspect of the question, Why do we have to give a criterion of identity for events, or for objects of any sort whatsoever? Fodor (1990) argues that the theory of evolution by natural selection will not help to save naturalistic accounts of representation from the disjunction problem. This is because, he claims, the context 'was selected for representing things as F' is transparent to the substitution of predicates coextensive with F. But, I respond, from an evolutionary perspective representational contexts cannot be transparent: only under particular descriptions will a representational state appear as a "solution" to a selection "problem" and so be adaptive. Michael Bloomberg assumed office as the 108th mayor of New York City on January 1, 2002. As he leaves the mayoralty—having won re—election twice‐his public health legacy is bitterly contested. The public health community views him as an urban innovator—a rare political and business leader willing to fight for a built environment conducive to healthier, safer lifestyles. To his detractors, Bloomberg epitomizes a meddling nanny—an elitist dictating to largely poor and working—class people about how they ought to lead their lives. (...) His policies have sparked intense public, corporate, and political ire—critical of sweeping mayoral power to socially engineer the city and its inhabitants. Here, I seek to show how Bloomberg has fundamentally changed public health policy and discourse. He has used the engine of government to make New York City a laboratory for innovation‐raising the visibility of public health, testing policy effectiveness, and probing the boundaries of state power. Even though the courts have blocked some of his boldest initiatives, he has offered a paradigm for the “new public health”—reaching beyond infectious diseases to upstream risk factors in everyday life and the human habitat. I also critically probe various arguments designed to derail his policies, along with the overarching charge of unjustified paternalism. (shrink)

In the BODY WORLDS exhibitions currently touring the United States, Gunther von Hagens displays human cadavers preserved through plastination. Whole bodies are playfully posed and exposed to educate the public. However, the educational aims are ambiguous, and some aspects of the exhibit violate human dignity. In particular, the signature cards attached to the whole-body plastinates that bear the title, the signature of Gunther von Hagens, and the date of creation mark the plastinates as artwork and von Hagens as the artist (...) in a gesture that strips the personal dignity from the donors. I conclude that the educational use of cadavers is compatible with respect for dignity if: 1) the utility of such use is great enough; 2) there are no other ways of achieving these ends; and 3) every effort is made to honor the dignity of the donors. Apart from his voluminous, immensely learned, and spectacularly successful contributions to the fields of Hermeneutics, non-dualist Metaphysics, and poetics, the sixteenth century South Indian polymath Appayyadīkṣita is famed for reviving from obscurity the moribund Śaivite Vedānta tradition represented by the Brahmasūtrabhāṣya of Śrīkaṇṭha. Appayya’s voluminous commentary on this work, his Śivārkamaṇidīpikā, not only reconstitutes Śrīkaṇṭha’s system, but radically transforms it, making it into a springboard for Appayya’s own highly original critiques of standard views of Mīmāṃsā and Vedānta. Appayya addresses long (...) sections of his commentary to matters dealt with glancingly or not at all in the root text, drawing conclusions which Śrīkaṇṭha nowhere endorses. Furthermore, the distinctive positions Appayya develops in the Śivārkamaṇidīpikā feed into Appayya’s other works in ways that have so far been largely ignored by modern scholars. For example, most or all the discussions Appayya’s Pūrvottaramīmāṃsāvādanakṣatramālā, twenty-seven essays on scattered topics in Mīmāṃsā and Vedānta, build on arguments first advanced in the Śivārkamaṇidīpikā—most notably Appayya’s totally original theory of the signification of adjectives, first developed in the Śivārkamaṇidīpikā, the full elaboration and defense of which takes up fully sixteen of the twenty-seven essays that make up the Pūrvottaramīmāṃsāvādanakṣatramālā. The Doctrine of Temporal Parts (sometimes abbreviated herein as 'DTP') asserts that, for each portion (including infinitely small portions) of the smallest period of time during which a material object exists, there is an object-a temporal part of the material object in question-which exists at that and at no other time. In "Things Change," Mark Heller offers an argument for DTP, and responds to a objection, the "No-Change" objection, to that doctrine.2 My goal in this paper is to undermine both (...) The East Asian family-oriented principle is defensible in theory as a shared decision making model and thus a viable alternative to individual-oriented decision making in bioethics. There are two crucial problems with the family-oriented principle, i.e., family-oriented paternalism and conflicts of interests between a patient and his family. These obstacles may appear formidable but they are not insurmountable in practice.

Laplace once argued that if one could “comprehend all the forces by which nature is animated,” it would be possible to predict the future and explain the past. The advent of analysis of large-scale data sets has been accompanied by newfound concerns about “Laplace’s Demon” as it relates to certain fields of science as well as management, evaluation, and audit. I begin by asking how statistical data are constructed, illustrating the hermeneutic acts necessary to create a variable. These include attributing (...) a certain characteristic to a particular phenomenon, isolating the characteristic of interest, and assigning a value to it. In addition, a population must be identified and a sample must be “taken” from that population. Next, I examine how statistical analyses are conducted, examining the interpretive acts there as well. In each case, I show how big data add new challenges. I then show how statistics are incorporated into audits and evaluations, emphasizing how alternative interpretations are concealed in the audit process. I conclude by noting that these issues cannot be “resolved” as Laplace suggested. His Demon, already banished from physics, needs to be banished from other fields of science, management, audits, and evaluations as well. (shrink)

Human genomic information is invested with enormous power in a scientifically motivated society. Genomic information has the capacity to produce a great deal of good for society. It can help identify and understand the etiology and pathophysiology of disease. In so doing, medicine and science can expand the ability to prevent and ameliorate human malady through genetic testing, treatment, and reproductive counseling.Genomic information can just as powerfully serve less beneficent ends. Information can be used to discover deeply personal attributes of (...) an individual's life. That information can be used to invade a person's private sphere, to alter a person's sense of self- and family identity, and to affect adversely opportunities in education, employment, and insurance. Genomic information can also affect families and ethnic groups that share genetic similarities. (shrink)

Law is an essential tool for public health practice, and the use of a systematic legal framework can assist with preventing chronic diseases and addressing the growing epidemic of obesity.The action options available to government at the federal, state, local, and tribal levels and its partners can help make the population healthier by preventing obesity and decreasing the growing burden of associated chronic diseases such as cardiovascular disease and Type 2 diabetes. The Centers for Disease Control and Prevention uses the (...) four-part systematic legal framework commonly referred to as “public health legal preparedness” to demonstrate the essential role law can play for any public health issue. This paper uses the “laws and legal authorities” component of the framework and should be considered in combination with the competencies, coordination, and information-best practices components of the framework. Reviews the legal position on the distinction drawn between killing and letting die in medically assisted dying.

This is a radically new interpretation of the nature of the power of God, as understood by such thinkers as Aquinas in the Middle Ages. The book provides a clear and illuminating discussion of their arguments, focusing on the distinction they made between so-called 'absolute' and 'ordained' divine power. It is full of important insights into the work of some of the key thinkers of the period, and also challenges modern theologians with the relevance and importance of these ideas today.

We live in an age defined in large part by various facets of neoliberalism. In particular, the market world has impinged on virtually every aspect of food and agriculture. Moreover, most nation-states and many international governance bodies incorporate aspects of neoliberal perspectives. Multi-stakeholder initiatives, with their own standards, certifications, and accreditations are evidence of both the continuing hegemony of neoliberalism as well as various responses to it. Importantly, to date even attempts to limit neoliberal hegemony through MSIs have been largely (...) within the parameters established by those same neoliberal agendas. However, neoliberalism is itself in crisis as a result of climate change, the continuing financial crisis, and rising food prices. The founding myths of neoliberalism are still widely held, having the effect of closing off alternative paths to the future. Yet, this need not be the case. Alternatives to the current MSIs that promote justice, democracy, and equality can still be constructed. (shrink)

Lost at times in the heat of debate about stem cell research, or any controversial advanced technology, is the need for precision in debate and discussion. The details matter a great deal, ranging from the need to use words that have precise definitions, to accurately quote colleagues and adversaries, and to cite scientific and medical results in a way that reflects the quality, rigor, and reliability of the work at issue. Regrettably, considerable inaccuracy has found its way into the debates (...) about stem cells, on all sides, with consequent fogging of the issues.A key detail that is often overlooked in the debates about the uses of human embryonic stem cells in research comes from the nature of in vitro fertilization treatment for infertility. Specifically, there are many frozen human embryos that are in excess of reproductive needs of the couple who generated them, and that must be either frozen indefinitely, donated to another couple, or destroyed. Traditional medical ethics and law draw a sharp distinction between allowing a patient to die and helping her die. Withholding or withdrawing life sustaining treatment, such as by abating technological nutrition, hydration or respiration, will cause death as surely as a lethal injection. The former, however, is a constitutional right for a competent or once-competent patient, while the latter poses a risk of serious criminal or civil liability for the physician, even if the patient requests it.

The threat posed by avian influenza appears to be rising, yet global and national health programs are preparing only fitfully. A lethal form of avian flu has rooted itself deeply into the poultry flocks of poor Asian countries that will have a hard time eradicating it. Every so often a sick bird infects a human, who usually dies from the encounter, and on rare occasions the virus seems to have spread from one person to another before the chain of infection (...) dies out. All it would take to set off a raging global pandemic would be for the virus to mutate into a form that is readily transmissible among humans. Severe Acute Respiratory Syndrome garnered a great deal of public attention because it was novel and its potential for spread was unknown. However, the SARS corona virus is significantly less virulent than pandemic influenza viral infections. (shrink)

This essay explores a simple argument for a Ground of Being, objections to it, and limitations on it. It is nonsensical to refer to Nothing in the sense of utter absence, hence nothing can be claimed to come from Nothing. If, as it seems, the universe, or any physical ensemble containing it, is past-finite, it must be caused by an uncaused Ground. Speculative many-worlds, pocket universes and multiverses do not affect this argument, but the quantum cosmologies of Alex Vilenkin, and (...) J. B. Hartle and Stephen Hawking, which claim that the universe came from literally nothing, would. I argue that their novel project cannot work for reasons both physical (their "nothing" is actually a vacuum state governed by eternal physical laws) and methodological (physical theory cannot explain the emergence of the physical per se). Thus my argument stands. However, as David Hume showed, a posteriori arguments like mine infer a creation, and Creator, of a certain character, namely, a stochastic concept of creation and a panentheistic, partly physical Creator lacking omniscience and omnipotence. Rather than undermining the cosmological argument, as Hume intended, these limitations liberate the concept of the Ground from unnecessary problems, as Hartshorne suggested. (shrink)

This article deals with a foreign policy question of extraordinary importance: what responsibilities do States have to provide economic and technical assistance to other States that have high levels of need affecting the health and life of their citizens? The question is important for a variety of reasons. There exist massive inequalities in health globally, with the result that poorer countries shoulder a disproportionate burden of disease and premature death. Average life expectancy in Africa is nearly 30 years shorter than (...) in the Americas or Europe. In one year alone, an estimated 14 million of the poorest people in the world died, while only an estimated four million would have died if this population had the same death rate as the global rich. It is staggering to observe the new normal in America: 37.9 percent of adults are obese, and 70.7 percent are either obese or overweight. One out of every five minors is obese. The real tragedy, of course, is the disability, suffering, and early death that devastates families and communities. But all of society pays, with the annual medical cost estimated at $147 billion. The causal pathways are complex, but if we drill down, sugar is a deeply consequential pathway to obesity, (...) and the single greatest dietary source is sugar-sweetened beverages. The copious amount of sugar in the American diet is no accident. Industry practices and regulatory failures have fueled this explosion. Yet there are sensible, effective interventions that would create the conditions for healthier behaviors. What are the key interventions, and how can we overcome the social, political, and constitutional roadblocks? Tobacco control offers a powerful model, suggesting that success requires a suite of interventions working in concert: labeling, warnings, taxation, portion sizes, product formulation, marketing restrictions, and bans in high-risk settings such as schools and hospitals. Each intervention deserves detailed analysis, but I'm kick-starting scholarly and policy conversation by systematically laying out the major legal tools. (shrink)
