How should we live? What do we owe to other people? In Goodness and Advice, the eminent philosopher Judith Jarvis Thomson explores how we should go about answering such fundamental questions. In doing so, she makes major advances in moral philosophy, pointing to some deep problems for influential moral theories and describing the structure of a new and much more promising theory. Thomson begins by lamenting the prevalence of the idea that there is an unbridgeable gap between fact and (...) value--that to say something is good, for example, is not to state a fact, but to do something more like expressing an attitude or feeling. She sets out to challenge this view, first by assessing the apparently powerful claims of Consequentialism. Thomson makes the striking argument that this familiar theory must ultimately fail because its basic requirement--that people should act to bring about the "most good"--is meaningless. It rests on an incoherent conception of goodness, and supplies, not mistaken advice, but no advice at all. Thomson then outlines the theory that she thinks we should opt for instead. This theory says that no acts are, simply, good: an act can at most be good in one or another way--as, for example, good for Smith or for Jones. What we ought to do is, most importantly, to avoid injustice; and whether an act is unjust is a function both of the rights of those affected, including the agent, and of how good or bad the act is for them. The book, which originated in the Tanner lectures that Thomson delivered at Princeton University's Center for Human Values in 1999, includes two chapters by Thomson ("Goodness" and "Advice"), provocative comments by four prominent scholars--Martha Nussbaum, Jerome Schneewind, Philip Fisher, and Barbara Herrnstein Smith--and replies by Thomson to those comments. In my contribution to this volume, I (BHS) comment on on the stultifying rhetoric of contemporary analytic moral theory as illustrated in Judith Jarvis Thomson's Tanner Lectures, with particular reference to Thomson's anxieties about the moral relativism exhibited by college freshman and to her efforts--quite strained, in my view, and inevitably unsuccessful--to demonstrate the existence of objective judgments in matters of morality and taste .

Two decades of research on euthanasia in the Netherlands have resulted into clear insights in the frequency and characteristics of euthanasia and other medical end-of-life decisions in the Netherlands. These empirical studies have contributed to the quality of the public debate, and to the regulating and public control of euthanasia and physician-assisted suicide. No slippery slope seems to have occurred. Physicians seem to adhere to the criteria for due care in the large majority of cases. Further, it has been shown (...) that the majority of physicians think that the euthanasia Act has improved their legal certainty and contributes to the carefulness of life-terminating acts. In 2005, eighty percent of the euthanasia cases were reported to the review committees. Thus, the transparency envisaged by the Act still does not extend to all cases. Unreported cases almost all involve the use of opioids, and are not considered to be euthanasia by physicians. More education and debate is needed to disentangle in these situations which acts should be regarded as euthanasia and which should not. Medical end-of-life decision-making is a crucial part of end-of-life care. It should therefore be given continuous attention in health care policy and medical training. Systematic periodic research is crucial for enhancing our understanding of end-of-life care in modern medicine, in which the pursuit of a good quality of dying is nowadays widely recognized as an important goal, in addition to the traditional goals such as curing diseases and prolonging life. Aristotle offers a conception of the private and its relationship to the public that suggests a remedy to the limitations of liberalism today, according to Judith A. Swanson. In this fresh and lucid interpretation of Aristotle's political philosophy, Swanson challenges the dominant view that he regards the private as a mere precondition to the public. She argues, rather, that for Aristotle private activity develops virtue and is thus essential both to individual freedom and happiness and to the well-being of (...) the political order. Swanson presents an innovative reading of the Politics which revises our understanding of Aristotle's political economy and his views on women and the family, slavery, and the relation between friendship and civic solidarity. She examines the private activities Aristotle considers necessary to a complete human life--maintaining a household, transacting business, sustaining friendships, and philosophizing. Focusing on ways Aristotle's public invests in the private through law, rule, and education, she shows how the public can foster a morally and intellectually virtuous citizenry. In contrast to classical liberal theory, which presents privacy as a shield of rights protecting individuals from one another and from the state, Aristotle, Swanson argues, presents privacy as opportunity or duty to pursue excellence. She concludes that for Aristotle a regime can attain self-sufficiency only by bringing about a dynamic equilibrium between the public and the private. The Public and the Private in Aristotle's Political Philosophy engages both long-standing and contemporary debates surrounding the interpretation of Aristotle. It will be essential reading for scholars and students of political philosophy, political theory, classics, intellectual history, and the history of women. (shrink)

The notion of trustworthy AI has been proposed in response to mounting public criticism of AI systems, in particular with regard to the proliferation of such systems into ever more sensitive areas of human life without proper checks and balances. In Europe, the High-Level Expert Group on Artificial Intelligence has recently presented its Ethics Guidelines for Trustworthy AI. To some, the guidelines are an important step for the governance of AI. To others, the guidelines distract effort from genuine AI regulation. (...) In this chapter, we engage in a critical discussion of the concept of trustworthy AI by probing the concept both on theoretical and practical grounds, assessing its substance and the feasibility of its intent. We offer a concise overview of the guidelines and their vision for trustworthy AI and examine the conceptual underpinnings of trustworthy AI by considering how notions of 'trust' and 'trustworthiness' have been discussed in the philosophical literature. We then discuss several epistemic obstacles and moral requirements when striving to achieve trustworthy AI in practice before concluding with an argument in support of the establishment of a trustworthy AI culture that respects and protects foundational values. Two ideas shape the epistemology of testimony. One is that testimony provides a unique kind of knowledge. The other is that testimonial knowledge is a social achievement. In traditional terms, those who affirm these ideas are anti-reductionists, and those who deny them are reductionists. There is increasing interest, however, in the possibility of affirming these ideas without embracing anti-reductionism. Thus, Sanford Goldberg uses the idea of epistemic buck-passing to argue that even reductionists can accept the uniqueness of testimonial knowledge, and (...) Jennifer Lackey gives both speaker and hearer an essential role in testimonial justification, rejecting both reductionism and anti-reductionism in favor of what she calls dualism. After distinguishing a weaker and a stronger notion of buck-passing, we show how anti-reductionists can use the stronger notion to motivate their position, and to answer Goldberg’s and Lackey’s challenges. 'Community' and 'justice' recur in anthropological, historical, and legal scholarship, yet as concepts they are notoriously slippery. Historians and lawyers look to anthropologists as 'community specialists', but anthropologists often avoid the concept through circumlocution: although much used by historians, legal thinkers, and political philosophers, the term remains strikingly indeterminate and often morally overdetermined. 'Justice', meanwhile, is elusive, alternately invoked as the goal of contemporary political theorizing, and wrapped in obscure philosophical controversy. A conceptual knot emerges in much legal and political (...) thought between law, justice, and community, but theories abound, without any agreement over concepts.The contributors to this volume use empirical case studies to unpick threads of this knot. Local codes from Anglo-Saxon England, north Africa, and medieval Armenia indicate disjunctions between community boundaries and the subjects of local rules and categories; processes of justice from early modern Europe to eastern Tibet suggest new ways of conceptualizing the relationship between law and justice; and practices of exile that recur throughout the world illustrate contingent formulations of community. In the first book in the series, Legalism: Anthropology and History, law was addressed through a focus on local legal categories as conceptual tools. Here this approach is extended to the ideas and ideals of justice and community. Rigorous cross-cultural comparison allows the contributors to avoid normative assumptions, while opening new avenues of inquiry for lawyers, anthropologists, and historians alike. (shrink)

The Netherlands is one of the few countries where euthanasia is legal under strict conditions. This study investigates whether Dutch newspaper articles use the term ‘euthanasia’ according to the legal definition and determines what arguments for and against euthanasia they contain. We did an electronic search of seven Dutch national newspapers between January 2009 and May 2010 and conducted a content analysis. Of the 284 articles containing the term ‘euthanasia’, 24% referred to practices outside the scope of the law, mostly (...) relating to the forgoing of life-prolonging treatments and assistance in suicide by others than physicians. Of the articles with euthanasia as the main topic, 36% described euthanasia in the context of a terminally ill patient, 24% for older persons, 16% for persons with dementia, and 9% for persons with a psychiatric disorder. The most frequent arguments for euthanasia included the importance of self-determination and the fact that euthanasia contributes to a good death. The most frequent arguments opposing euthanasia were that suffering should instead be alleviated by better care, that providing euthanasia can be disturbing, and that society should protect the vulnerable. Of the newspaper articles, 24% uses the term ‘euthanasia’ for practices that are outside the scope of the euthanasia law. Typically, the more unusual cases are discussed. This might lead to misunderstandings between citizens and physicians. Despite the Dutch legalisation of euthanasia, the debate about its acceptability and boundaries is ongoing and both sides of the debate are clearly represented. (shrink)

This article examines three terms associated with the take-up of Foucault’s analysis of the biopolitical, namely identity, nature and life. It argues that Foucault opposes their reduction respectively to sameness, to origin, or to some primordial force. These reductions not only fall into species of metaphysics, they fail to recognize the integration of difference and of constitutive relationality in Foucault’s conceptualization of the process of subjectivation and becoming as historically dynamic and mobile. The article emphasizes the importance of historicization and (...) of a constructive genealogy in Foucault’s approach, running counter to metaphysics, and opening new avenues for political action based on the recognition of the interiority of resistance to dispositifs of power and of the creative force in individuation. But it is nevertheless morally imperative to reduce global poverty and inequality. Distinguishing between the Ought of states of affairs and the Ought of moral obligation, I defend an approach that looks to institutions to alter the environment within which people make choices and that employs our understanding of human psychology to encourage changes in behavior. A workshop in Philosophy for Children was offered this summer at Viterbo College with generous support from the Wisconsin Humanities Committee. Dr. Ronald Reed and the author conducted the week long workshop. The workshop was promoted primarily by distribution of brochures to regional schools. Four questions were addressed in the brochure: What is Philosophy for Children?, How will Philosophy for Children work in your classroom?, Why teach Philosophy for Children?, and Who should attend?. This approach was taken as part of (...) an effort at making teachers, principals and parents informed about the basic nature fo a Philosophy for Children program. (shrink)

This article posits that in Foucault’s later work we find not a forgetting of literature, but a reformulation of the role that literature had come to occupy in his work, and that, in this later work, there is a trace of the texts on literary thought that he wrote from the 1960s to the mid-1970s. Drawing upon Foucault’s later work, I reconsider the key question: What relationship does literature, as literature, have with the political dimension of discourses? After her German academic life came to a halt in 1933, Arendt carried her dissertation into exile in France, and years later took the same battered and stained copy to New York. During the late 1950s and early 1960s, as she was completing or reworking her most influential studies of (...) political life, Arendt was simultaneously annotating and revising her dissertation on Augustine, amplifying its argument with terms and concepts she was using in her political works of the same period. The disseration became a bridge over which Arendt traveled back and forth between 1929 Heidelberg and 1960s New York, carrying with her Augustine's question about the possibility of social life in an age of rapid political and moral change. In _Love and Saint Augustine_, Joanna Vecchiarelli Scott and Judith Chelius Stark make this important early work accessible for the first time. Here is a completely corrected and revised English translation that incorporates Arendt's own substantial revisions and provides additional notes based on letters, contracts, and other documents as well as the recollections of Arendt's friends and colleagues during her later years. The UK Government's Higher Education (Freedom of Speech) Bill is currently progressing through Parliament. The bill is designed to strengthen free speech and academic freedom in higher education, in response to what former Education Secretary Gavin Williamson describes as ‘the rise of intolerance and cancel culture upon our campuses’. But is there really a crisis of academic freedom in British universities?To see that there is, say Judith Suissa and Alice Sullivan, we need only look at the contemporary reality of (...) suppression of debate on sex and gender. The evidence they catalogue of suppression of research, of blacklisting, harassment and smear campaigns, of no-platforming, disinvitations and shutting down of events, is incontrovertible. The recent experience of scholars and students wishing to discuss the material reality and political salience of sex makes complacency about academic freedom a luxury we cannot afford.Suissa and Sullivan set out a powerful argument for the role of academic freedom in pursuing truth within the academy and developing democracy beyond it. They effectively counter attempts to narrow the scope of academic freedom so as to render it compatible with no-platforming. And they lay out a series of practical steps administrators can take to ensure that universities are places where an expansive and pluralistic intellectual climate prevails.This is a timely and compelling intervention in a vexed but urgent public debate. For their clear-sighted diagnosis of where and how academic freedom has been eroded in our universities, and for their judicious account of what must be done to rebuild it, Suissa and Sullivan deserve a wide and attentive hearing. This paper challenges the assumption that reasons are intrinsic to rational action. A great many actions are not best understood as ones in which the agent acted for reasons--and yet they can be understood as rational, and as open to rational criticism. The relative paucity of explicit reason-giving, practical arguments in daily life presents a general philosophical problem. It reflects the existence of a class of ways in which reason can regulate action, which goes far beyond producing reasons or applying (...) principles. Much practical reasoning takes the form of what H. P. Grice called 'thought-transitions'. These are neither in the form of standard practical arguments, nor can they be so reconstructed without distorting the ways in which an agent thinks. Some actions to which one is led by a thought transition are rational, namely when what Grice called a 'propension' towards a given class of actions--a standing inclination to act in certain ways--would itself stand up to rational evaluation. The paper examines two bases for such endorsement, one local and limited, and one much more speculative, due to Grice himself. (shrink)

One of the most difficult contemporary issues facing the bioethics of clinical research is balancing the maintaining of a universality of ethics standards with a sensitivity to cultural issues and differences. The concept of “vulnerability” for research subjects is especially apt for investigating the ethical and cultural issues surrounding the conduct of genetic research among new immigrants to the United States, using the Sudanese Nuer and Dinka tribes, recently settled in the Midwest, as an example. Issues of cultural vulnerability arise (...) for some immigrants, related to relationship to the earth and to kinship issues, that threaten the narrative richness of a subject's life as well as the way she situates herself in the world. To many people, the very idea of nationalism smacks of ethnocentrism or even racism. They suspect that violence, hatred, and distrust of the Other, embodied in a sharply divided world of "us" and "them," always lurk within the nationalist's heart. Recent world events have done nothing to allay these suspicions. Nationalism, on this view, is an evil to be overcome by a cosmopolitan stance that denies the significance of national boundaries. Yet positive values have also been associated with the nationalist (...) idea, as some recent accounts remind us.ii Democracy, autonomy, community, pluralism -- these goods have been connected with the development of nationalism over the past several centuries. Some of the values underlying nationalism also manifest themselves today in its dilute and more respectable cousin, multiculturalism. And it goes without saying that whatever its merits, nationalism exerts enormous power on the aspirations of many people around the world. (shrink)

This paper has two aims. The first is to describe several sources of the moral responsibility to remedy or alleviate global poverty—reasons why an agent might have such a responsibility. The second is to consider what sorts of agents bear the responsibilities associated with each source—in particular, whether they are collective agents like states, societies, or corporations, on the one hand, or individual human beings on the other. We often talk about our responsibilities to the poorest people in the world, (...) or what we owe them. So the question is who this we is. I shall argue that the answer depends on the source of the responsibility. Some responsibilities—one species of causal responsibilities—belong in the first instance to collectives, although they will also trickle down to at least some individuals within the collective. Other responsibilities—humanitarian responsibilities, and a different species of causal responsibilities—belong in the first instance to individuals, but can, I shall argue, “trickle up” to collectives of which individuals are members. Dieser Beitrag nimmt als Ausganspunkt die gegenwärtige kontroverse Debatte um den adäquaten Erklärungsansatz in der Kognitionswissenschaft, und zwar zwischen Enaktivisten einerseits und Repräsentationalisten andererseits. Beispielhaft wurde aufgezeigt, dass in Bezug auf die soziale Kognition der enaktivistische Ansatz eine Voraussetzung machen muss, die er mit seinen eigenen Mitteln nicht einzufangen in der Lage ist. Denn der Versuch, das Verstehen des Anderen durch gemeinsame Sinnstiftung der Akteure innerhalb ihrer sozialen Interaktion zu erklären, gerät in einen Zirkel, da nicht erklärt wird, wie die (...) Kopplung und damit der Prozess der sozialen Interaktion allererst zustande kommen kann. Als Lösung dieses Problems wird eine repräsentationalistische Analyse der vorausgesetzten Fähigkeit, andere als potentielle Kooperationspartner anzusehen, entwickelt, und zwar mit den Mitteln von Millikans Teleosemantik. Diese Theorie aus dem Kontext der Debatte um die Naturalisierung mentaler Repräsentationen liefert mit den PP Repräsentationen den adäquaten Begriff, um sowohl verkörperte, handlungsorientierte Repräsentationen zur Analyse von Affordanzen, als auch verkörperte interaktionsorientierte Repräsentationen zur Analyse sozialer Affordanzen zu entwickeln. Dies erlaubt die Annahme einer zentralen Funktion für die soziale Wahrnehmung, die den blinden Fleck des enaktivistischen Ansatzes ausfüllen kann. Zugleich demonstriert diese Analyse der sozialen Wahrnehmung die explanatorische Überlegenheit (minimal) repräsentationalistischer Erklärungen gegenüber rein enaktivistischen Alternativen. (shrink)
