BackgroundRelatives have no formal position in the practice of euthanasia and physician-assisted suicide (EAS) according to Dutch legislation. However, research shows that physicians often involve relatives in EAS decision-making. It remains unclear why physicians do (not) want to involve relatives. Therefore, we examined how many physicians in the Netherlands involve relatives in EAS decision-making and explored reasons for (not) involving relatives and what involvement entails.MethodsIn a mixed-methods study, 746 physicians (33% response rate) completed a questionnaire, and 20 were interviewed. The (...) questionnaire included two statements on relatives’ involvement in EAS decision-making. Descriptive statistics were used, and multivariable logistic regression analyses to explore characteristics associated with involving relatives. In subsequent interviews, we explored physicians’ views on involving relatives in EAS decision-making. Interviews were thematically analysed.ResultsThe majority of physicians want to know relatives’ opinions about an EAS request (80%); a smaller group also takes these opinions into account in EAS decision-making (35%). Physicians who had ever received an explicit EAS request were more likely to want to know opinions and clinical specialists and elderly care physicians were more likely to take these opinions into account. In interviews, physicians mentioned several reasons for involving relatives: e.g. to give relatives space and help them in their acceptance, to tailor support, to be able to perform EAS in harmony, and to mediate in case of conflicting views. Furthermore, physicians explained that relatives’ opinions can influence the decision-making process but cannot be a decisive factor. If relatives oppose the EAS request, physicians find the process more difficult and try to mediate between patients and relatives by investigating relatives’ objections and providing appropriate information. Reasons for not taking relatives’ opinions into account include not wanting to undermine patient autonomy and protecting relatives from a potential burdensome decision.ConclusionsAlthough physicians know that relatives have no formal role, involving relatives in EAS decision-making is common practice in the Netherlands. Physicians consider this important as relatives need to continue with their lives and may need bereavement support. Additionally, physicians want to perform EAS in harmony with everyone involved. However, relatives’ opinions are not decisive. (shrink)

The Dutch law states that a physician may perform euthanasia according to a written advance euthanasia directive when a patient is incompetent as long as all legal criteria of due care are met. This may also hold for patients with advanced dementia. We investigated the differing opinions of physicians and members of the general public on the acceptability of euthanasia in patients with advanced dementia.

Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

Although euthanasia and assisted suicide in people with psychiatric disorders is relatively rare, the increasing incidence of EAS requests has given rise to public and political debate. This study aimed to explore support of the public and physicians for euthanasia and assisted suicide in people with psychiatric disorders and examine factors associated with acceptance and conceivability of performing EAS in these patients. A survey was distributed amongst a random sample of Dutch 2641 citizens and 3000 physicians. Acceptance and conceivability of (...) performing EAS, demographics, health status and professional characteristics were measured. Multivariable logistic regression analyses were performed. Of the general public 53% were of the opinion that people with psychiatric disorders should be eligible for EAS, 15% was opposed to this, and 32% remained neutral. Higher educational level, Dutch ethnicity, and higher urbanization level were associated with higher acceptability of EAS whilst a religious life stance and good health were associated with lower acceptability. The percentage of physicians who considered performing EAS in people with psychiatric disorders conceivable ranged between 20% amongst medical specialists and 47% amongst general practitioners. Having received EAS requests from psychiatric patients before was associated with considering performing EAS conceivable. Being female, religious, medical specialist, or psychiatrist were associated with lower conceivability. The majority of the psychiatrists were of the opinion that it is possible to establish whether a psychiatric patient’s suffering is unbearable and without prospect and whether the request is well-considered. The general public shows more support than opposition as to whether patients suffering from a psychiatric disorder should be eligible for EAS, even though one third of the respondents remained neutral. Physicians’ support depends on their specialization; 39% of psychiatrists considered performing EAS in psychiatric patients conceivable. The relatively low conceivability is possibly explained by psychiatric patients often not meeting the eligibility criteria. (shrink)

BackgroundThe Netherlands is one of the few countries where euthanasia is legal under strict conditions. This study investigates whether Dutch newspaper articles use the term ‘euthanasia’ according to the legal definition and determines what arguments for and against euthanasia they contain.MethodsWe did an electronic search of seven Dutch national newspapers between January 2009 and May 2010 and conducted a content analysis.ResultsOf the 284 articles containing the term ‘euthanasia’, 24% referred to practices outside the scope of the law, mostly relating to (...) the forgoing of life-prolonging treatments and assistance in suicide by others than physicians. Of the articles with euthanasia as the main topic, 36% described euthanasia in the context of a terminally ill patient, 24% for older persons, 16% for persons with dementia, and 9% for persons with a psychiatric disorder. The most frequent arguments for euthanasia included the importance of self-determination and the fact that euthanasia contributes to a good death. The most frequent arguments opposing euthanasia were that suffering should instead be alleviated by better care, that providing euthanasia can be disturbing, and that society should protect the vulnerable.ConclusionsOf the newspaper articles, 24% uses the term ‘euthanasia’ for practices that are outside the scope of the euthanasia law. Typically, the more unusual cases are discussed. This might lead to misunderstandings between citizens and physicians. Despite the Dutch legalisation of euthanasia, the debate about its acceptability and boundaries is ongoing and both sides of the debate are clearly represented. (shrink)

Background Studies describing physicians’ experiences with sedation at the end of life are indispensible for informed palliative care practice, but they are scarce. We describe the accounts of physicians from the USA and the Netherlands, two countries with different regulations on end-of-life decisions regarding their use of sedation.Methods Qualitative face-to-face interviews were held in 2007–2008 with 36 physicians , including primary care physicians and specialists. We applied purposive sampling and conducted constant comparative analyses.Results In both countries, the use of sedation (...) was described in diverse terms, especially in the USA, and was often experienced as emotionally challenging. Respondents stated different and sometimes multiple intentions for their use of sedation. Besides alleviating severe suffering, most Dutch respondents justified its use by stating that it does not hasten death, while most American respondents indicated that it might hasten death but that this was justifiable as long as that was not their primary intention. While many Dutch respondents indicated that they initiated open discussions about sedation proactively to inform patients about their options and to allow planning, the accounts of American respondents showed fewer and less-open discussions, mostly late in the dying process and with the patient's relatives.Conclusions The justification for sedation and the openness with which it is discussed were found to differ in the accounts of respondents from the USA and the Netherlands. Further clarification of practices and research into the effect and effectiveness of the use of sedation is recommended to enhance informed reflection and policy making. (shrink)

BackgroundAn important principle underlying the Dutch Euthanasia Act is physicians' responsibility to alleviate patients' suffering. The Dutch Act states that euthanasia and physician-assisted suicide are not punishable if the attending physician acts in accordance with criteria of due care. These criteria concern the patient's request, the patient's suffering (unbearable and hopeless), the information provided to the patient, the presence of reasonable alternatives, consultation of another physician and the applied method of ending life. To demonstrate their compliance, the Act requires physicians (...) to report euthanasia to a review committee. We studied which arguments Dutch physicians use to substantiate their adherence to the criteria and which aspects attract review committees' attention.MethodsWe examined 158 files of reported euthanasia and physician-assisted suicide cases that were approved by the review committees. We studied the physicians' reports and the verdicts of the review committees by using a checklist.ResultsPhysicians reported that the patient's request had been well-considered because the patient was clear-headed (65%) and/or had repeated the request several times (23%). Unbearable suffering was often substantiated with physical symptoms (62%), function loss (33%), dependency (28%) or deterioration (15%). In 35%, physicians reported that there had been alternatives to relieve patients' suffering which were refused by the majority. The nature of the relationship with the consultant was sometimes unclear: the consultant was reported to have been an unknown colleague (39%), a known colleague (21%), otherwise (25%), or not clearly specified in the report (24%). Review committees relatively often scrutinized the consultation (41%) and the patient's (unbearable) suffering (32%); they had few questions about possible alternatives (1%).ConclusionDutch physicians substantiate their adherence to the criteria in a variable way with an emphasis on physical symptoms. The information they provide is in most cases sufficient to enable adequate review. Review committees' control seems to focus on (unbearable) suffering and on procedural issues. (shrink)

Since Marxist historical research has certainly not been exempt from this temptation, one has to start any debate about Marxist historiography with the demand to accord empirical research the chance to shake even the cornerstones of one’s own theoretical conceptions. In a paper that has triggered off a new discussion on ‘Political Marxism’, Samuel Knafo and Benno Teschke insist on (...) such a practice. In recent decades, there has been a proliferation of alternative food networks which promote an agenda of reconnection, allegedly linking consumers and producers to the socio-ecological origins of food. Rarely, however, does the AFN literature address “origins” of food in terms of animals, as in the case of meat. This article takes a relational approach to the reconnection agenda between humans and animals by discussing how the phenomenon of animal welfare and “happy” meat are enacted by producers and consumers in (...) mundane, embodied, and nuanced ways. Utilizing hybrid conceptualizations of human–animal relations through “natureculture” and “being alongside”, we demonstrate that consumers and producers of AFNs perform natureculture entanglements daily, often considering humans and animals as part of one another and the ecological system. Nonetheless, we also point to how participants in AFNs set boundaries to distance themselves from moments of animal life and death, explaining away uncomfortable affective naturecultures through commodification logics. Drawing on qualitative data from consumers and producers of food networks in Austria, we introduce the concept of “human–animal magnetism” to illustrate that the draw for humans to care about other animal lives exists within a spectrum of attraction and disassociation, engendered through specific human–animal interactions. Ultimately, we offer a cautiously hopeful version of alterity in AFNs of meat in which more caring human–animal relations are possible. (shrink)

This article argues that Pulcinella, a figure of classical Italian commedia dell’arte, could also be considered as emblematic for the reordering of politics in the early-modern and modern periods. By placing emphasis on the common underlying theatrical aspects of ‘representation’, it effectively connects the absolutist and democratic periods and helps us to understand why actors and acting came to play such a prominent role in contemporary politics, whether as politicians imitating actors, or as actors actually becoming politicians. The article also (...) shows that this sublimation of theatre into politics is not even a contemporary phenomenon but can be traced back to the ancient mime, following the origins of Pulcinella, and the first crisis of democracy, in classical Athens, in the footsteps of Plato. Helmets from Delphi Among the votive offerings which were found in Delphi, helmets play an essential part : There are about 90 specimen kept in the museum, approximately half of which are from one of the two sanctuaries for certain, it is likely that the other helmets are from there, as well. They were made between the 8th and the second half of the 5th century. The number of helmet-consecrations, however, already decreased in the middle of the 6th century. Only (...) few helmets give us a clue on the exhibition practices: By means of the fixing holes it is to be recognized that they were once exhibited in form of a "tropaeum". Some repaired examples clearly show that used helmets were consecrated. As it also happened in other sanctuaries, a lot of examples were damaged on purpose, others were cannibalized for their material. (shrink)

Die Vita und die Sentenzen des Neopythagoreers Secundus wurden im Mittelalter in zahlreiche Sprachen ubersetzt und teilweise sehr frei bearbeitet. Eine kritische Edition der arabischen und der athiopischen Versionen blieb jedoch lange ein Desiderat der Forschung. Im Anschluss an die mehr als 120 Jahre alte Forschungsarbeit des Orientalisten Paulus Johannes Bachmann (1862-1894) schliesst Martin Heide nun diese Lucke unter Berucksichtigung samtlicher Handschriften. Die ausfuhrliche Einleitung widmet sich der Komposition des gesamten Buches in den verschiedenen Versionen, besonders aber der Frage (...) nach der Ubersetzungsvorlage der orientalischen Texte. Der kritischen Edition der arabischen, der athiopischen und der syrischen Versionen folgt eine deutsche Ubersetzung, die in zahlreichen Anmerkungen auf die jeweiligen Beziehungen zu ihren Vorlagen verweist. In dem erganzenden Beitrag von Stefan Weninger zur Ubersetzungssprache wird aufgezeigt, wie der athiopische Ubersetzer trotz enger Bindung an seine arabische Vorlage einen freien Ubersetzungsstil wahlte. Die besondere Sprache dieser Version liefert zudem neue Belege fur das athiopische Lexikon. Die hier vorgelegten Versionen des Secundus Taciturnus belegen einmal mehr die grosse Bedeutung und Langlebigkeit von popularphilosophischen Werken der Spatantike sowie die Flexibilitat der syrischen, der arabischen und der athiopischen Sprachen in der Wiedergabe ihrer Vorlagen. My reply to the comments of Parkinson (2010) and Kuppens (2010) is organized in three parts. The first part deals with Parkinson’s claim that the scope of our research is limited because no real emotions were elicited. I suggest that the outcomes in our studies are structurally similar to real emotions but that they lack intensity. In the second part, I try to correct three potential misunderstandings regarding the nature of the comparison process that I proposed. In the third part, (...) I respond to Kuppens’ suggestion that we also need to consider the transition of appraisal values into the other components of emotion (actions tendencies, responses, and subjective experience). Critics of appraisal theory have difficulty accepting appraisal (with its constructive flavor) as an automatic process, and hence as a potential cause of most emotions. In response, some appraisal theorists have argued that appraisal was never meant as a causal process but as a constituent of emotional experience. Others have argued that appraisal is a causal process, but that it can be either rule-based or associative, and that the associative variant can be automatic. This article first proposes empirically investigating whether (...) rule-based appraisal can also be automatic and then proposes investigating the automatic nature of constructive (instead of rule-based) appraisal because the distinction between rule-based and associative is problematic. I argue that two interpretations of this framework are available, neither of which captures the relationship between a model and the protein structure it represents or between multiple models of protein structure. Further, it inclines us toward concluding prematurely that models of protein structure are right in their contexts and makes (...) extrapolation of findings from one context to another seem unwarranted. Instead, protein structure determination ought to be understood as _modestly monistic_. There is one model for every protein in each physicochemical context, and models of the same protein produced in different contexts are compatible with one another. ‘Integrating’ multiple models amounts to extrapolating from one context to another; this is possible because the effect of context on protein folding is relatively weak and predictable. Among emotions, surprise has been extensively studied in psychology. In linguistics, surprise, like other emotions, has mainly been studied through the syntactic patterns involving surprise lexemes. However, little has been done so far to correlate the reaction of surprise investigated in psychological approaches and the effects of surprise on language. This cross-disciplinary volume aims to bridge the gap between emotion, cognition and language by bringing together nine contributions on surprise from different backgrounds - psychology, human-agent interaction, linguistics. Using different methods (...) at different levels of analysis, all contributors concur in defining surprise as a cognitive operation and as a component of emotion rather than as a pure emotion. Surprise results from expectations not being met and is therefore related to epistemicity. Linguistically, there does not exist an unequivocal marker of surprise. Surprise may be either described by surprise lexemes, which are often associated with figurative language, or it may be expressed by grammatical and syntactic constructions. BackgroundInformed consent as stipulated in regulatory human research guidelines requires that a volunteer is well-informed about what will happen to them in a trial. However researchers are faced with a challenge of how to ensure that a volunteer agreeing to take part in a clinical trial is truly informed. We conducted a qualitative study among volunteers taking part in two HIV clinical trials in Uganda to find out how they defined informed consent and their perceptions of the trial procedures, study (...) information and interactions with the research team.MethodsBetween January and December 2012, 23 volunteers who had been in the two trials for over 6 months, consented to be interviewed about their experience in the trial three times over a period of nine months. They also took part in focus group discussions. Themes informed by study research questions and emerging findings were used for content analysis.ResultsVolunteers defined the informed consent process in terms of their individual welfare. Only two of the volunteers reported having referred during the trial to the participant information sheets given at the start of the trial. Volunteers remembered the information they had been given at the start of the trial on procedures that involved drawing blood and urine samples but not information about study design and randomisation. Volunteers said that they had understood the purpose of the trial. They said that signing a consent form showed that they had consented to take part in the trial but they also described it as being done to protect the researcher in case a volunteer later experienced side effects.ConclusionVolunteers pay more attention during the consent process to procedures requiring biological tests than to study design issues. Trust built between volunteers and the research team could enhance the successful conduct of clinical trials by allowing for informal discussions to identify and review volunteers’ perceptions. These results point to the need for researchers to view informed consent as a process rather than an event. (shrink)

Practical reason is the means by which beliefs and desires come together to produce actions. Practical rationality is difficult because we have many beliefs and many desires, and they often pull us in conflicting directions. The theory of practical reason must explain the fact that desires can conflict with one another, and the fact that we can act against our all‐things‐considered judgment (weakness of will, akrasia, and incontinence). The standard explanation of these facts invokes some form of partitioning among desires. (...) Davidson's view creates, by contrast, a partition within practical reason itself. He distinguishes between forms of rationality that are constitutive of action, and forms of rationality that are normative standard from which action can fall short. Davidson's “principle of continence,” a rule against weakness of will, is such a principle: it is required for acting well, but not for acting. (shrink)

A lively debate in the literature on moral progress concerns the role of practical reasoning: Does it enable or subvert moral progress? Rationalists believe that moral reasoning enables moral progress, because it helps enhance objectivity in thinking, overcome unruly sentiments, and open our minds to new possibilities. By contrast, skeptics argue that moral reasoning subverts moral progress. Citing growing empirical research on bias, they show that objectivity is an illusion and that moral reasoning merely rationalizes pre-existing biased moral norms. In (...) this article, I argue that both the rationalists and the skeptics fail to understand fully the role of practical reasoning by focusing exclusively on moral reasoning to the neglect of social reasoning. In the first half of the article, I argue against the skeptics by vindicating moral reasoning. I identify a Democratic Model of moral reasoning which is reliable and effective in overcoming bias. In the second part of the article, I argue against the rationalists. Drawing on a paradigmatic case of moral progress, i.e., the British abolition of the slave trade, I illustrate that moral reasoning, even when sound, is insufficient to motivate progressive action. The explanation for this puzzling phenomenon is not that the moral norm against cruelty is inert, as skeptics might suggest. Rather, it is that the moral norm against cruelty was overridden by the social norm of slavery which was tied to the British joint commitments to freedom and national honour. The debate between rationalists and skeptics centers around the moral rationality of human action, failing to recognize that human action is in fact primarily about social rationality. I defend a joint commitment account of social rationality, and offer a novel Communitarian Model of social reasoning which follows the logic of social rationality to revise social norms. I defend the reliability and efficacy of the Communitarian Model of social reasoning by applying it to the abolitionist social movement to show how Britons gave fellow Britons social reasons grounded in their joint commitments to freedom and national honour to end slavery.
