This paper synthesizes scholarship from several academic disciplines to identify and analyze five major ethical challenges facing data-driven policing. Because the term “data-driven policing” emcompasses a broad swath of technologies, we first outline several data-driven policing initiatives currently in use in the United States. We then lay out the five ethical challenges. Certain of these challenges have received considerable attention already, while others have been largely overlooked. In many cases, the challenges have been articulated in the context of related discussions, (...) but their distinctively ethical dimensions have not been explored in much detail. Our goal here is to articulate and clarify these ethical challenges, while also highlighting areas where these issues intersect and overlap. Ultimately, responsible data-driven policing requires collaboration between communities, academics, technology developers, police departments, and policy-makers to confront and address these challenges. And as we will see, it may also require critically reexamining the role and value of police in society. (shrink)

Machine Learning has become a popular tool in a variety of applications in criminal justice, including sentencing and policing. Media has brought attention to the possibility of predictive policing systems causing disparate impacts and exacerbating social injustices. However, there is little academic research on the importance of fairness in machine learning applications in policing. Although prior research has shown that machine learning models can handle some tasks efficiently, they are susceptible to replicating systemic bias of previous human decision-makers. While there (...) is much research on fair machine learning in general, there is a need to investigate fair machine learning techniques as they pertain to the predictive policing. Therefore, we evaluate the existing publications in the field of fairness in machine learning and predictive policing to arrive at a set of standards for fair predictive policing. We also review the evaluations of ML applications in the area of criminal justice and potential techniques to improve these technologies going forward. We urge that the growing literature on fairness in ML be brought into conversation with the legal and social science concerns being raised about predictive policing. Lastly, in any area, including predictive policing, the pros and cons of the technology need to be evaluated holistically to determine whether and how the technology should be used in policing. After posing the problem of technocracy according to the debate between Marcuse and Habermas, the article situates Simondon’s perspective and, thematizing the relations between society, culture and technological development, it analyzes a series of ethical and political elements involved in his philosophy. In this vein, the paper addresses Simondon’s criticism of the technocratic utopia, introduces his conceptualization of the technique and examines the three concepts he provides to rethink political practice.

Pinhas Sadeh was considered as an unorthodox writer as regards his environment, the “State Culture” in Israel. In the first part of this paper I present the biography of the author and his most representative work, Life as a parable, published in 1958, as well as his romantic and frankist roots and his leaning towards Christianity according to the Gospel. In the second part a mythical analysis of this work is made according to the inner journey of hero, through which (...) the main character is looking for his life meaning. In this second part I present my methodology, based on works of the Eranos Society (Mircea Eliade, C.G. Jung, Gilbert Durand). Afterwards, I analyse the mithems that I have found in Life as a parable. Finally, I make a mythical comparison between this novel and Siddharta, of Hermann Hesse. (shrink)

Para ello, y teniendo como eje la tensión entre forma e individuación, presenta un esquema general de lectura para abordar la relación de Simondon con la Gestaltpsychologie, desprendiendo de allí tres (...) cuestiones: el uso metodológico de la analogía; la crítica simondoniana a la primera etapa de la psicología de la forma y al "principio del equilibrio estable"; el análisis simondoniano de la tercera etapa de dicha escuela, y del "principio de organización estructural", desde el horizonte del problema del comportamiento. Gilbert Ryle claimed that intelligent actions and activities are not merely the external signs of inner mental workings but rather that such actions and activities are the workings of the mind itself. In this thesis I propose an interpretation and defence of sich claim, against a common an, in my view, mistaken way of understanding Ryle's position. In chapter [1]. I introduce the argumentative thread of this thesis and a more detailed overview of the chapters. In chapter [2], I (...) criticise Stanley and Williamson's understanding of Ryle's argument and position. In chapters [3]-[5] I examine Ryle's position and provide a way of understanding his view against what I take his main opponent, INTELLECTUALISM, to be. Chapter [6] offers an argument against INTELLECTUALISM as a way of motivating a Rylean account intelligent actions and activities. Functionalism as a philosophical position has been recently applied to the case of emotion research. However, a number of objections have been raised against applying such a view to scientific theorizing on emotions. In this article, I argue that functionalism is still a viable strategy for emotion research. To do this, I present functionalism in philosophy of mind and offer a sketch of its application to emotions. I then discuss three recent objections raised against it and respond to each of (...) them. These objections claim that functionalism is intractable because (i) it does not support a scientifically interesting taxonomy of emotions for experimental settings, (ii) it is inherently teleological, and (iii) it cannot be falsified. I argue that these objections either rely on a simplified version of functionalism as a philosophical position or they pose challenges that functionalists can readily address. Lastly, I conclude by drawing some lessons these objections suggest for a tractable functionalist account of emotions. (shrink)

The use of black box algorithms in medicine has raised scholarly concerns due to their opaqueness and lack of trustworthiness. Concerns about potential bias, accountability and responsibility, patient autonomy and compromised trust transpire with black box algorithms. These worries connect epistemic concerns with normative issues. In this paper, we outline that black box algorithms are less problematic for epistemic reasons than many scholars seem to believe. By outlining that more transparency in algorithms is not always necessary, and by explaining that (...) computational processes are indeed methodologically opaque to humans, we argue that the reliability of algorithms provides reasons for trusting the outcomes of medical artificial intelligence. To this end, we explain how computational reliabilism, which does not require transparency and supports the reliability of algorithms, justifies the belief that results of medical AI are to be trusted. We also argue that several ethical concerns remain with black box algorithms, even when the results are trustworthy. Having justified knowledge from reliable indicators is, therefore, necessary but not sufficient for normatively justifying physicians to act. This means that deliberation about the results of reliable algorithms is required to find out what is a desirable action. Thus understood, we argue that such challenges should not dismiss the use of black box algorithms altogether but should inform the way in which these algorithms are designed and implemented. When physicians are trained to acquire the necessary skills and expertise, and collaborate with medical informatics and data scientists, black box algorithms can contribute to improving medical care. Recent literature on dialogical logic discusses the case of tonk and the notion harmony in the context of a rule-based theory of meaning. Now, since the publications of those papers, a dialogical version of constructive type theory has been developed. The aim of the present paper is to show that, from the dialogical point of view, the harmony of the CTT-rules is the consequence of a more fundamental level of meaning characterized by the independence of players. The idea that deep brain stimulation (DBS) induces changes to personality, identity, agency, authenticity, autonomy and self (PIAAAS) is so deeply entrenched within neuroethics discourses that it has become an unchallenged narrative. In this article, we critically assess evidence about putative effects of DBS on PIAAAS. We conducted a literature review of more than 1535 articles to investigate the prevalence of scientific evidence regarding these potential DBS-induced changes. While we observed an increase in the number of publications in theoretical neuroethics (...) that mention putative DBS-induced changes to patients’ postoperative PIAAAS, we found a critical lack of primary empirical studies corroborating these claims. Our findings strongly suggest that the theoretical neuroethics debate on putative effects of DBS relies on very limited empirical evidence and is, instead, reliant on unsubstantiated speculative assumptions probablyin lieuof robust evidence. As such, this may reflect the likelihood of a speculative neuroethics bubble that may need to be deflated. Nevertheless, despite the low number of first-hand primary studies and large number of marginal and single case reports, potential postoperative DBS changes experienced by patients remain a critical ethical concern. We recommend further empirical research in order to enhance theoretical neuroethics work in the area. In particular, we call for the development of better instruments capable of capturing potential postoperative variations of PIAAAS. (shrink)

In this paper I argue that many scholars involved in the contemporary free will debates have underappreciated the philosophical appeal of agent causation because the resources of contemporary emergentism have not been adequately introduced into the discussion. Whereas I agree that agent causation’s main problem has to do with its intelligibility, particularly with respect to the issue of how substances can be causally relevant, I argue that the notion of substance causation can be clearly articulated from an emergentist framework. According (...) to my proposal, a free agent is _a causally powerful substance that emerges in an anomic way from her constitutive mental events_, downwardly constraining, selecting and, in this way, having control on them. As we shall see, this particular concept of agent causation not only makes sense of the deep insight behind agent libertarianism, but it also provides us with the resources to solve some of the main objections that have been raised against it. It is true that here I cannot develop a complete defense of the evidential credentials of emergentism. Still, even if the considerations that follow do not serve to convince detractors of agent causal libertarian accounts of free will, they do suggest that libertarian agent causation is more promising than is typically acknowledged. The phenomenological effects of deep brain stimulation (DBS) on the self of the patient remains poorly understood and under described in the literature, despite growing evidence that a significant number of patients experience postoperative neuropsychiatric changes. To address this lack of phenomenological evidence, we conducted in-depth, semistructured interviews with 17 patients with Parkinson's disease who had undergone DBS. Exploring the subjective character specific to patients' experience of being implanted gives empirical and conceptual understanding of the potential phenomenon of DBS-induced self-estrangement. (...) Our study concluded that (1) the more patients preoperatively felt alienated by their illness, the more they experienced postoperative self-estrangement, and (2) the notion of self-estrangement seems to exist in association with certain common qualitative characters, namely, loss of control, which reflects a deteriorative estrangement, and distorted perception of capacities, which reveals a restorative estrangement. These findings indicate that subjective self-reports help us to understand some aspects of the potential phenomenon of DBS-induced self-estrangement. (shrink)

We would like to thank the authors of the commentaries for their critical appraisal of our feature article, Who is afraid of black box algorithms?1 Their comments, suggestions and concerns are various, and we are glad that our article contributes to the academic debate about the ethical and epistemic conditions for medical Explanatory AI. We would like to bring to attention a few issues that are common worries across reviewers. Most prominently are the merits of computational reliabilism —in particular, when (...) promoted as an alternative to transparency—and CR as necessary but not sufficient for delivering trust. We finalise our response by addressing concerns about the place and role of artificial intelligence in medical decision-making and the physician’s responsibilities. We understand the concerns and reservations that some of the reviewers express regarding the epistemic merits of CR. This article asks the question, ``what is reliable machine learning?'' As I intend to answer it, this is a question about epistemic justification. Reliable machine learning gives justification for believing its output. Current approaches to reliability (e.g., transparency) involve showing the inner workings of an algorithm (functions, variables, etc.) and how they render outputs. We then have justification for believing the output because we know how it was computed. Thus, justification is contingent on what can be shown about the algorithm, (...) its properties, and its behavior. In this paper, I defend computational reliabilism (CR). CR is a computationally-inspired off-shoot of process reliabilism that does not require showing the inner workings of an algorithm. CR credits reliability to machine learning by identifying reliability indicators external to the algorithm (validation methods, knowledge-based integration, etc.). Thus, we have justification for believing the output of machine learning when we have identified the appropriate reliability indicators. CR is advanced as a more suitable epistemology for machine learning. The main goal of this article is to lay the groundwork for CR, how it works, and what we can expect as a justificatory framework for reliable machine learning. (shrink)

Philosophical personalism has generated a very powerful field of study in the twentieth and twenty first centuries but has not produced a systematic exposition. This book fills this big gap by offering for the first time a full systematic personalistic vision of the human person. This ambitious volume offers a pedagogical and integrated exposition of philosophical personalism, answering vital questions about human identity and existence in a way that the reader can achieve an integrated view of the person. The book (...) points to the real life of each person so that, by partially unraveling the mystery of the personal being, it becomes a philosophical guide for life. For these reasons, the book can be used both for academic purposes, as a manual of philosophy of man or for personal enlightenment. Divided in five parts, the first part of the book works as an introduction, offering an overview of the human person and of the notion of person. The second part describes the internal structure of the human being addressing topics as corporeity as a personal fact; sensibility and the senses; affectivity; intelligence; freedom understood as choice and self-determination and, finally, the personal self. The third part analyses the person in action and some special types of action such as work and language. The fourth part deals with interpersonal relationships beginning with I-You relationship and following with the family and the social structure. While new generations of implantable brain computer interface devices are being developed, evidence in the literature about their impact on the patient experience is lagging. In this article, we address this knowledge gap by analysing data from the first-in-human clinical trial to study patients with implanted BCI advisory devices. We explored perceptions of self-change across six patients who volunteered to be implanted with artificially intelligent BCI devices. We used qualitative methodological tools grounded in phenomenology to conduct in-depth, semi-structured interviews. Results (...) show that, on the one hand, BCIs can positively increase a sense of the self and control; on the other hand, they can induce radical distress, feelings of loss of control, and a rupture of patient identity. We conclude by offering suggestions for the proactive creation of preparedness protocols specific to intelligent—predictive and advisory—BCI technologies essential to prevent potential iatrogenic harms. Much of our know-how is acquired through practice: we learn how to cook by cooking, how to write by writing, and how to dance by dancing. As Aristotle argues, however, this kind of learning is puzzling, since engaging in it seems to require possession of the very knowledge one seeks to obtain. After showing how a version of the puzzle arises from a set of attractive principles, I argue that the best solution is to hold that knowledge-how comes in degrees, (...) and through practice a person gradually learns how to do something. However, the two standard accounts of know-how in the literature, intellectualism and anti-intellectualism, cannot properly account for the distinctive way in which know-how is gradually acquired by practice, a process in which conceptual representations and practical abilities are intimately interwoven. Drawing on Gareth Evans's work, I outline an account that may do so, and use this account to distinguish between two forms of learning to explain why skill generally cannot be learnt through testimony, and requires practice. El presente trabajo trata de analizar el origen de esta forma de entender la acción redentora divina en un momento histórico concreto y "al final de los tiempos". Un primer marco, original y originario, arraiga en las bases culturales, cósmicas y místicas de la escena de Israel y en las primeras composiciones del Antiguo Testamento. Su esquema fue utilizado y adaptado por los profetas y, dentro de la (...) evolución natural de la profecía, acabó en laliteratura apocalíptica. De ahí siguió al Nuevo Testamento, y la catequesis de la Iglesia hizo el resto. El presente trabajo pretende seguir los diferentes momentos de esta evolución. Una vez desvelado el sentido de las formas literarias, debemos aprender a leer en ellas el mensaje revelado: ¿seguimos esperando al Dios que nos redime? o ¿Ese día llegó con Jesús y sólo estamos esperando lacelebración de su victoria? This paper examined the relationship between coaches and youth athletes in China by comparing data collected before and after the lockdown. A total of 221 youth athletes aged 13-19 years in one professional football school completed coach-athlete relationship questionnaires. The rank-sum test was used to verify the differences in the data. The results of the Mann-Whitney U test showed that the mean value of the three dimensions of the coach-athlete relationship (closeness, commitment, and complementarity) increased after the COVID-19 lockdown. The (...) results also showed that athletes of different age categories showed different changes in the coach-athlete relationship after the lockdown, and the changes were not significantly related to the severity of the COVID-19 epidemic. This paper inquires the systematical consequences in the Nietzschean critics of the biological determination of life. We proposed an analysis about central topics of this determination: the finalism, the life and chaos. This approach allows us to relieve a systematical conception of what Nietzsche understands by “necessity”. This conception of necessity is not metaphysic in the traditional sense, but implies a subversion of all special metaphysic. Beyond this, it entails a critical to the transcendental and normative version, own of Kantian (...) thought, about the question of life. The purpose of this paper is to expose the function of the culture and thought of the Far East, expressed in Japanese Zen Buddhism and Chinese Chan (as well as, in general, in Chinese philosophy and culture), within the thought of Byung-Chul Han. This dimension of the Korean's work has not been sufficiently deepened in the analyses that are made of him. This error leads to mistakes such as stating that there is no emancipation proposal in Han or that his (...) work is limited to a pessimistic description of the world. Thus, the investigation that follows the bibliographic-documental research method is divided into three moments; the first exposes the foundations of the philosophy of Zen-chan Buddhism developed by Han; the second delineates the ontology of Hanian falsification and; the third, analyzes the theses on the East within Han's theoretical project. Haeusermann et al. (Citation2023) draw three overall conclusions from their study on closed loop neuromodulation and self-perception in clinical treatment of refractory epilepsy. The first is that closed-loop neuromodulation devices did not substantially change epileptic patient’s personalities or self-perception postoperatively. The second is that some patients and caregivers attributed observed changes in personality and self-perception to the epilepsy itself and not to the DBS treatments. The third is that the devices provided participants with novel ways to make sense of their (...) illness. These findings further demonstrate a misalignment between some neuroethicists’ concerns about putative postoperative changes to personality, and the empirical evidence for such changes. Haeusermann et al. nonetheless concede that “neurotechnology directed at persisting rather than episodic clinical phenomena could have greater implications for personality or self-perception, either because they operate more continuously or are directed at clinical phenomena that are more stably integrated into patients’ self-concepts” (41). We acknowledge that the hypothesis that participants did not report changes because they were only episodically and not continually stimulated offers an interesting line for future investigation. Nonetheless, we would like to propose that potential postoperative personality changes might be correlated with the pathophysiology itself, rather than the stimulation effects of the technology. Generally, we advance the view that unintended effects solely induced by the technology cannot be excluded per se. Regardless, this comment aims to highlight that ethicists’ starting premise should be that patients suffering from diverse pathophysiology, or patients who are treated with stimulation in different brain regions and with differing parameters, would likely not react in the same way to treatment. In this article, I focus on the role of computer simulations as exploratory strategies. I begin by establishing the non-theory-driven nature of simulations. This refers to their ability to characterize phenomena without relying on a predefined conceptual framework that is provided by an implemented mathematical model. Drawing on Steinle’s notion of exploratory experimentation and Gelfert’s work on exploratory models, I present three exploratory strategies for computer simulations: (1) starting points and continuation of scientific inquiry, (2) varying the parameters, and (3) (...) scientific prototyping. Although during the last decades the philosophy of chemistry has greatly extended its thematic scope, the main difficulties appear in the attempt to link the chemical description of atoms and molecules and the description supplied by quantum mechanics. The aim of this paper is to analyze how the difficulties that threaten the continuous conceptual link between molecular chemistry and quantum mechanics can be overcome or, at least, moderated from the perspective of BM. With this purpose, in “The quantum-mechanical challenges” section (...) the foundational incompatibility between chemical and SQM descriptions will be briefly recalled. “Bohmian mechanics” section will be devoted to explain the main features of BM. In “Empirical equivalence and underdetermination” section, the consequences of the empirical equivalence between SQM and BM will be discussed. Finally, in the Conclusion, we will stress the scope of the obtained conclusions and the philosophical difficulties that still remain even after adopting BM for foundational purposes. (shrink)

This article investigates the connections between the logics of being wrong, introduced in Steinsvold (2011, Notre Dame J. Form. Log., 52, 245–253), and factive ignorance, presented in Kubyshkina and Petrolo (2021, Synthese, 198, 5917–5928). The first part of the paper provides a sound and complete axiomatization of the logic of factive ignorance that corrects errors in Kubyshkina and Petrolo (2021, Synthese, 198, 5917–5928) and resolves questions about the expressivity of the language. In the second half, it is shown that the (...) relationship between the two logics suggests an alternative axiomatization for the logic of factive ignorance, the adequacy of which is easily proved via straightforward translations. El artículo busca caracterizar la noción y práctica de la filosofía de un grupo de profesores colombianos del siglo XX. Se parte de la revisión historiográfica del relato “normalizador” en la historia de la filosofía local. El análisis cualitativo de textos escritos entre 1940 y 1960 propone una lectura ambivalente sobre algunas características del oficio de la filosofía, al exponer las tensiones entre una vocación filosófica y las modestas condiciones del oficio. Otras tensiones mostrarán los dos ejes desde donde aquellos (...) profesores pretendieron hacer filosofía: el técnico y el cultural. En 1950, el relato del proceso normalizador de la filosofía fue reforzado por Francisco Romero desde unos referentes ejemplarizantes, “adánicos”, e incluso épicos. Luego, el relato sobre las décadas comprendidas entre 1940 y 1960 se cristalizó bajo el lente retrospectivo de 1980, pero desde una mirada unilateral de la categoría de “normalización”, enfocada solo en aspectos técnicos y disciplinares de la filosofía. Para recuperar el eje cultural, se perfila la figura del “intelectual” de mediados de siglo XX a partir de lo que Renán Silva ha caracterizado como el “pastor de almas”, como aquel que podía interpretar la cultura popular y dictarle un derrotero. Una segunda entrega, ocupada del análisis de distintos registros textuales de la escritura filosófica de mitad de siglo XX, más centrados en el eje de la interpretación y orientación cultural. In Olivi´s division of the sciences, which can be found in his treatise De perlegendis philosophorum libris, c. 9, there seems to be a twofold place for metaphysics: one as part of the theoretical sciences and another as part of the practical, alongside medicine and ethics. This view is based on a misreading of the manuscripts. For the second appearance of metaphysics one should read “mechanica” instead. Thus, this paper shows that the thesis of an unconventional approach to metaphysics in (...) Olivi cannot be sustained by De perlegendis philosophorum libris. (shrink)

En este artículo se pretende problematizar la noción de injusticia testimonial, mediante una reconstrucción históricofilosófica de algunos usos contemporáneos del testimonio. La literatura sobre el testimonio en el siglo XX no siempre considera la discusión filosófica acerca del significado epistémico del testimonio, pese a que ambos asuntos podrían articularse mejor si el testimonio se comprende desde sus usos históricos recientes, y si la interpretación de los testimonios históricos se sostiene en una concepción adecuada del dispositivo discursivo de la testificación. Se (...) realizó un análisis filosófico del discurso testimonial y una revisión histórica de sus usos en dos contextos testimoniales: los testimonios del Holocausto y la literatura del testimonio latinoamericana. Como resultado de esta reconstrucción históricofilosófica sugerimos ampliar la noción de injusticia testimonial para que, además del desconocimiento o rechazo de la palabra ajena, incorpore el enrarecimiento de la testificación que cabe reconocer en cierto paradigma contemporáneo expresivista de la memoria testimonial.AbstractIn this article we try to problematize the notion of testimonial injustice, through a historical-philosophical reconstruction of some contemporary uses of testimony. The literature on testimony in the twentieth century does not always consider the philosophical discussion of the epistemic meaning of testimony, although both issues could be articulated better if testimony is understood from its recent historical uses, and the interpretation of historic testimony is held on an adequate conception of the discursive device of witnessing. We conducted a philosophical analysis of testimonial discourse and a historical review of its use in two testimonial contexts: Holocaust Testimonies and Latin American literature of testimony. As a result of this historical-philosophical reconstruction, we suggest to expand the notion of testimonial injustice so that, apart from disregard or rejection of the word of others, it incorporates the rarefaction of witnessing, which can be recognized in a certain expressivist contemporary paradigm of testimonial memory. La sección 32 del tratado De anima de Jámblico comienza con el análisis de tres posibles explicaciones acerca del modo en que el alma ingresa en el cuerpo. Las dos primeras son anónimas mientras que la tercera es atribuida por el filósofo de Calcis a los seguidores de Plotino. El tema se anuncia en la sección anterior en la que puede leerse desde el principio una referencia a “Hipócrates el Asclepíade” que conecta con una sentencia anterior que se ha perdido (...) y que marcaría el comienzo de la argumentación. Como posible fuente de Jámblico se suele citar a Porfirio, quien incluye las opiniones de Hipócrates, de un filósofo anónimo y de Numenio de Apamea sobre el momento en que comienza la vida y el alma se asocia de manera natural con el cuerpo. En el desarrollo de estas argumentaciones se aprecia un conocimiento implícito de las hipótesis embriológicas de la época. (shrink)
