The aim of the paper is to propose a preferences representation model under risk where risk perception can be past experience dependent. A first step consists in considering a one period decision problem where individual preferences are no more defined only on decisions but on pairs (decision, past experience). The obtained criterion is used in the construction of a dynamic choice model under risk. The paper ends with an illustrative example concerning insurance demand. It appears that our model allows to (...) explain modifications in the insurance demand behavior over time observed on the insurance markets for catastrophic risk and difficult to justify with standard models. Medical students’ mask-making can provide valuable insights into personal and professional identity formation and wellness. A subset of first- and second-year medical students attending a medical school wellness retreat participated in a mask-making workshop. Faculty-student teams examined student masks and explanatory narratives using visual and textual analysis techniques. A quantitative survey assessed student perceptions of the experience. We identified an overarching theme: “Reconciliation/reclamation of authentic identity.” The combination of nonverbal mask-making and narrative offers rich insights into medical students’ experience and (...) thinking. Freedom and the subject were guiding themes for Michel Foucault throughout his philosophical career. In this clear and comprehensive analysis of his thought, Johanna Oksala identifies the different interpretations of freedom in his philosophy and examines three major divisions of it: the archaeological, the genealogical, and the ethical. She shows convincingly that in order to appreciate Foucault's project fully we must understand his complex relationship to phenomenology, and she discusses Foucault's treatment of the body in relation to recent feminist (...) work on this topic. Her sophisticated but lucid book illuminates the possibilities that Foucault's philosophy opens up for us in thinking about freedom. (shrink)

The paper studies the relationship between political violence and biological life in the thought of Hannah Arendt, Giorgio Agamben and Michel Foucault. I follow Foucault in arguing that understanding political violence in modernity means rethinking the ontological boundary between biological and political life that has fundamentally ordered the Western tradition of political thought. I show that while Arendt, Agamben and Foucault all see the merging of the categories of life and politics as the key problem of Modernity, they understand this (...) problem in crucially different terms and suggest different solutions to it. This results in different understandings of the relationship between violence and the political. It is my contention that the violence of modern biopolitical societies is not due to originary ties between sovereign power and biopower, as Agamben claims. Sovereign states use biopolitical methods of violence, but this violence is not an originary or necessary aspect of political power. In order to criticise the forms of violence specific to modern biopolitical societies we must expose the points of tension, as well as of overlap between two types of power – biopower and sovereign power. Understanding their distinctive rationalities is crucial for developing effective strategies against current forms of political violence. (shrink)

The paper explicates a politicized conception of reality with the help of Michel Foucault’s critical project. I contend that Foucault’s genealogies of power problematize the relationship between ontology and politics. His idea of productive power incorporates a radical, ontological claim about the nature of reality: Reality as we know it is the result of social practices and struggles over truth and objectivity. Rather than translating the true ontology into the right politics, he reverses the argument. The radicality of his method (...) lies in showing how the ontological order of things is in itself the outcome of a political struggle: Ontology is politics that has forgotten itself. I argue that Foucault’s thought accomplishes the politicization of ontology with two key theoretical moves. The first is the contestation and provocation of all given and necessary ontological foundations. He affirms the ontological view that there is a discontinuity between reality and all ontological schemas that order it, and a subsequent indeterminacy of reason in establishing ultimate truths or foundations. After this initial step whereby ontology is denaturalized—made arbitrary or at least historically contingent—the way is open for explanations that treat the alternative and competing ontological frameworks as resulting from historical, linguistic and social practices of power. The second key move is thus the exposure of power relations and their constitutive role in our conception of reality. I conclude by considering the implications of Foucault’s politicization of ontology for our understanding of politics. (shrink)

This article defends the theoretical centrality of Michel Foucault’s account of subjectivation for critical responses to neoliberalism against those Marxist critics who claim that his focus on the subject pushed the Left into the fraught terrain of identity politics. A key contention is that a theoretically sophisticated account of subjectivation is a requisite for any philosophically coherent and politically effective theorization of resistance against neoliberalism. Critical accounts of neoliberal subjectivation must be recognized as indispensable for understanding the conditions of possibility (...) for class struggle and not as an alternative theoretical frame to it. The article also relates Foucault’s and Karl Marx’s thought on the question of power and its relationship to the subject. It presents a reading of Foucault as a post-Marxist who modified, rejuvenated, and extended Marx’s views on power and subjectivation. While Foucault developed his understanding of subjectivation as a critical response to the problems he identified in the French Marxist accounts of his time—particularly in the work of Louis Althusser—his appropriation of Marx should be recognized as decisive for the development of his account of productive power and the concomitant understanding of the subject. The article defends the importance of metaphysical inquiry in feminist philosophy and interrogates possible directions for such a project. A key aim is questioning the possibility of revisionary metaphysics as well as emphasising the consequences of the linguistic turn for any such project. I argue that before we can embark on any metaphysical inquiry – feminist or otherwise – we are doomed to repeating Immanuel Kant's monumental question of how is metaphysics possible? I then ask how metaphysics is understood in (...) feminist discussions and focus on one contemporary effort to create feminist metaphysics, namely Christine Battersby's The Phenomenal Woman: Feminist Metaphysics and the Patterns of Identity (1998). Through a critical analysis of her position I tease out the problems, paradoxes and obstacles that the project of feminist metaphysics faces. Finally, I explicate the politicised conception of reality that I find in Michel Foucault's thought and conclude by considering its consequences for our understanding of feminist metaphysics and politics. A common feature of all standard theories of the laws of nature is that they are "absolutist": They take laws to be either all metaphysically necessary or all contingent. Science, however, gives us reason to think that there are laws of both kinds, suggesting that standard theories should make way for "non-absolutist" alternatives: theories which accommodate laws of both modal statuses. In this paper, we set out three explanatory challenges for any candidate non-absolutist theory and discuss the prospects of the (...) two extant candidates in light of these challenges. We then develop our own non-absolutist theory, the essentialist DTA account, which combines the nomic-necessitation or DTA account with an essentialist approach to metaphysical modality in order to meet the three explanatory challenges. Finally, we argue that the distinction between kinematical and dynamical laws found in physical theories supports both non-absolutism in general and our proposed essentialist DTA view in particular. In a recent paper, Tuomas Tahko has argued for a hybrid view of the laws of nature, according to which some physical laws are metaphysically necessary, while others are metaphysically contingent. In this paper, we show that his criterion for distinguishing between these two kinds of laws — which crucially relies on the essences of natural kinds — is on its own unsatisfactory. We then propose an alternative way of drawing the metaphysically necessary/contingent distinction for laws of physics based on (...) the central kinematical/dynamical distinction used in physical theorising, and argue that the criterion can be used to amend Tahko’s own account, but also that it can be combined with different metaphysical views about the source of necessity. Two approaches to elevating certain laws of nature over others have come to prominence recently. On the one hand, according to the meta-laws approach, there are meta-laws, laws which relate to laws as those laws relate to particular facts. On the other hand, according to the modal, or non-absolutist, approach, some laws are necessary in a stricter sense than others. Both approaches play an important role in current research, questioning the ‘orthodoxy’ represented by the leading philosophical theories of natural laws—Humeanism, (...) the DTA view, dispositional essentialism and primitivism. This paper clarifies the relations between these two emerging approaches, as well as their applicability to physical laws and the status of the challenges they pose for standard theories of laws of nature. We first argue that, despite some significant similarities between the two approaches (especially in the context of Lange’s counterfactual account of laws), they are in general distinct and largely independent of each other. Then, we argue that the support for meta-laws from physical theory and practice is more questionable than usually presented. (shrink)

Vaidya has recently argued that while Husserl’s method for acquiring knowledge of essence through use of our imagination is subject to a vicious epistemic circle, we can still use the method to successfully attain objectual understanding of essence. In this paper, I argue that the Husserlian objectual understanding-based epistemology envisaged by Vaidya suffers from a similar epistemic circularity as its knowledge-based foil. I argue that there is a straight-forward solution to this problem, but then raise three serious problems for an (...) amended version of Vaidya’s proposal and any similar Husserlian epistemology of essence. The paper closes with some general reflections on applying the Husserlian method to the contemporary notion of essence and on the idea of refocusing the epistemology of essence on understanding instead of knowledge. Gideon Rosen has recently sketched an argument which aims to establish that the notion of metaphysical modality is systematically ambiguous. His argument contains a crucial sub-argument which has been used to argue for Metaphysical Contingentism, the view that some claims of fundamental metaphysics are metaphysically contingent rather than necessary. In this paper, Rosen’s argument is explicated in detail and it is argued that the most straight-forward reconstruction fails to support its intended conclusion. Two possible ways to save the argument are (...) rebutted and it is furthermore argued that the crucial sub-argument only supports a rather particular variant of Metaphysical Contingentism. (shrink)

In his influential article ‘Essence and Modality’, Fine proposes a definition of necessity in terms of the primitive essentialist notion ‘true in virtue of the nature of’. Fine’s proposal is suggestive, but it admits of different interpretations, leaving it unsettled what the precise formulation of an Essentialist definition of necessity should be. In this paper, four different versions of the definition are discussed: a singular, a plural reading, and an existential variant of Fine’s original suggestion and an alternative version proposed (...) by Correia which is not based on Fine’s primitive essentialist notion. The first main point of the paper is that the singular reading is untenable. The second that given plausible background assumptions, the remaining three definitions are extensionally equivalent. The third is that, this equivalence notwithstanding, Essentialists should adopt Correia’s version of the definition, since both the existential variant, which has de facto been adopted as the standard version of the definition in the literature, and the plural reading suffer from problems connected to Fine’s primitive essentialist notion. This article reflects on the current philosophical tendency to construct non-dualistic subjectivity models in response to the criticism of the traditional authoritarian human subject. Following thinkers such as Emmanuel Lévinas, Michel Foucault or Jacques Derrida, the literature has largely identified traditional metaphysics based on dualistic hierarchies as the major source of violence. Perceiving phenomenology as a method that focuses on the concepts of the lived experience and situatedness, I combine this approach with the feminist calls for dismantling the hierarchical relationship (...) of subjectivity to the world. I draw on the concepts of Sonia Kruks, Linda Martin Alcoff, Sara Heinämaa, Judith Butler, Bonnie Mann and Johanna Oksala to inquire how dualism-overcoming phenomenology can be applied to feminist thought. I focus in particular on the approach that Oksala outlines in her book, Feminist Experiences: Foucauldian and Phenomenological Investigations, where she proposes a transcendental view on feminist experience. Intriguingly, she understands transcendental as situated – historically, culturally and politically. Consequently, my final question concerns the possibility of combining the two usually conflicted approaches: transcendental and historical regarding the fundamental phenomenological distinction between the empirical and the transcendental. This paper motivates and defends a principle which captures a systematic connection between essence, truth, and grounding. It says that if a proposition expresses an essential truth, i.e., if it is true in virtue of the nature of some objects, then there are grounds for its truth which involve these objects. Together with the assumption that a fact can only be grounded in facts which are relevant to it, this principle is then applied in an argument against the monotonicity of (...) the Essentialist notion ‘true in virtue of the nature of’. The most recent (Fifth) revision of the Declaration of Helsinki, adopted in October 2000 by the World Medical Association (WMA), reinforces the longstanding prohibition against offering placebo instead of effective therapy. The WMA left no doubt that if a beneficial treatment for a condition has already been recognised, it is unethical to offer placebo in place of such treatment to anyone in a study of the same condition. We have previously drawn attention to the discrepancy between the spirit of the (...) Declaration and the common practice of using placebo controls in randomised trials even if effective treatment exists. Despite the mandates of the Declaration of Helsinki and concern from ethicists and scientists, the US Food and Drug Administration (FDA) continues to demand and defend placebo‐controlled evidence of efficacy and safety for the development of many new pharmaceuticals, even if effective therapy exists. We suggest that the FDA's arguments defending their practice are insufficient to justify medical research that violates the Declaration of Helsinki. (shrink)

It has been argued that quantum mechanics forces us to accept the existence of metaphysical, mind-independent indeterminacy. In this paper we provide an interpretation of the indeterminacy involved in the quantum phenomena in terms of a view that we call Plural Metaphysical Supervaluationism. According to it, quantum indeterminacy is captured in terms of an irreducibly plural relation between the actual world and various misrepresentations of it.

This paper provides an overview of the history of the notion of essence in 20th century analytic philosophy, focusing on views held by influential analytic philosophers who discussed, or relied on essence or cognate notions in their works. It in particular covers Russell and Moore’s different approaches to essence before and after breaking with British idealism, the (pre- and post-)logical positivists’ critique of metaphysics and rejection of essence (Wittgenstein, Carnap, Schlick, Stebbing), the tendency to loosen the notion of logical necessity (...) to accommodate certain metaphysical truths in Wittgenstein and others, Quine’s logical rehabilitation of metaphysics and criticism of de re modality, the modal view of essence promoted by the development of quantified modal logic (C. I. Lewis, Barcan Marcus, Kripke) and direct reference theory (Barcan Marcus, Kripke, Putnam), and the emergence of the notion of metaphysical necessity (Kneale, Kripke), and finally Fine’s re-establishment of a Neo-Aristotelian, hyperintensional notion of essence in contemporary metaphysics. This paper criticizes Soames’s main argument against a variant of two-dimensionalism that he calls strong two-dimensionalism. The idea of Soames’s argument is to show that the strong two-dimensionalist’s semantics for belief ascriptions delivers wrong semantic verdicts about certain complex modal sentences that contain both such ascriptions and claims about the truth of the ascribed beliefs. A closer look at the formal semantics underlying strong two-dimensionalism reveals that there are two feasible ways of specifying the truth conditions for claims of the (...) latter sort. Only one of the two yields the problematic semantic verdicts, so strong two-dimensionalists can avoid Soames’s argument by settling for the other way. (shrink)

The purpose of this introduction is to give a rough overview of the discussion of the formalization of arguments, focusing on deductive arguments. The discussion is structured around four important junctions: i) the notion of support, which captures the relation between the conclusion and premises of an argument, ii) the choice of a formal language into which the argument is translated in order to make it amenable to evaluation via formal methods, iii) the question of quality criteria for such formalizations, (...) and finally iv) the choice of the underlying logic. This introductory discussion is supplemented by a brief description of the genesis of the special issue, acknowledgements, and summaries of each article. (shrink)

In October 2013, the Declaration of Helsinki was revised a seventh time in its 50 year history. While it is the most widely accepted set of ethical principles for the protection of patients participating in medical research, the Declaration of Helsinki has also been subject of constant controversy. In particular, its paragraph on the use of placebo controls in clinical trials divides the research community into active-control and placebo orthodox proponents, both continuously demanding revisions of the Declaration of Helsinki in (...) favour of their position. The goal of the present project is to compare the mainly theoretical controversy with regulatory implementation. We distributed a questionnaire to national drug regulatory authorities from different countries to collect information on the authorities’ respective approaches to interpretation and implementation of the Declarations’ placebo paragraph in the conduct of medical research. Our findings suggest that the majority of drug regulatory authorities have established a practice of a middle ground, allowing placebo controls in some instances. Various interpretations of “serious harm” and “methodological reasons” are proposed as well as safeguards to avoid abuse of the option to use placebo-controls. Leaving the placebo paragraph open to various interpretation is a result of the Declaration of Helsinki’s character as a guidance document. With the current version controversy will continue. The Declaration should be continued to be strengthened to enforce the appreciation of conducting medical research with the highest ethical standard. (shrink)

The starting point of this paper is an argument to the conclusion that the definition of metaphysical possibility in terms of correct conceivability, conceivability informed by knowledge of relevant essences, found in Rosen (2006) is equivalent to a version of the essentialist definition of metaphysical necessity. This argument appears to show that correct conceivability is a notion of conceivability by name only and is therefore of no interest to epistemologists of modality. In this paper, I present the equivalence argument, explain (...) the idealizing assumptions involved in it and sketch a version of the conceivability approach which weakens these assumptions in order to show that the notion of correct conceivability can still play a specific limited role in the epistemology of modality. The “Goldwater rule,” a policy adopted by the American Psychiatry Association in 1973, prohibits organization members from diagnosing or offering professional opinions regarding the mental health of public figures without both first-hand evaluation and authorization. Initially developed in response to a controversial survey of APA members during the 1964 Presidential election campaign, the ethics rule faced few large scale challenges until the election of Donald Trump in 2016. Since that time, a significant number of psychiatrists have either violated or criticized (...) the rule openly. This paper argues that whatever the initial merits of the rule, the prohibition has since been rendered obsolete by the combined lack of professional consensus supporting the policy, absence of a meaningful enforcement mechanism, and the credible statements of non-APA members in the mental health professions regarding public figures. Divers (2014) argues that a Lewisian theory of modality which includes both counterpart theory and modal realism cannot account for the truth of certain intuitively true modal sentences involving cross-world comparatives. The main purpose of this paper is to defend the Lewisian theory against Divers’s challenge by developing a response strategy based on a degree-theoretic treatment of comparatives and by showing that this treatment is compatible with the theory.

Psychiatry is rapidly changing. The authors review the history of psychiatry in the United States, its gradual integration into medicine and society, and the dialectic between its “biologic” and “mentalist” outlooks. After describing the current state of the profession and its knowledge base, they discuss the likely future of the field: psychiatry's projected mode of practice and economics; its future as a science for understanding human behavior; its expected boundaries with other treatment disciplines; its anticipated relationship with academia and with (...) the community at large; and internal issues for the profession. The epistolary corpus of M. Cornelius Fronto, the rhetoric teacher of the ‘princes’ M. Aurelius and L. Verus, offers valuable insights into the functioning of the monarchical order of the Principate, despite the seemingly trivial subject matter of many of his letters, due to the unique level of communication. Especially the communication with the domus Augusta provides important additions to the comparable letters of Pliny the Younger. While scholars have so far concentrated on Fronto’s relationship with his pupil Marcus, this (...) contribution focuses on the communication with and about the adoptive father of his pupils, Antoninus Pius, because it makes tangible the ‘rules of the game’ of the interaction between the senatorial elite and the princeps who came from their ranks. The gratiarum actio of the acting consuls can be seen as a key political ritual of the High Empire and as an important aspect of the communication between senatorial aristocracy and princeps. The only surviving speech of this type from this period, Pliny’s Panegyricus, has, however, been judged very differently due to a lack of comparison. In this context, it is often overlooked that although the gratiarum actio of M. Cornelius Fronto has not survived, the Corpus Frontonianum contains both illuminating (...) references to this speech delivered in 142 AD in the absence of the princeps and Antoninus Pius’ reaction to its published version. This article asks about the possible insights into the panegyric ritual that emerge from these fragments of information. (shrink)
