This chapter focuses on one of the common fallacies in Western philosophy, 'false dilemma (FD)'. According to Andrea A. Lunsford, John J. Ruskiewicz, and Keith Walters, a FD tends to “reduce a complicated issue to excessively simple terms” or, when intentionally created, tends to “obscure legitimate alternatives”. FD reflects incorrect thinking because it presents a problem or issue as having only two possible solutions when in fact there are more. Liam Dempsey noted that shows such as The Daily Show and (...) The Colbert Report often employed FD in order to highlight the “theatrics” that are found in political events or the use of FD by politicians. Politics aside, an FD exists anytime an extreme dichotomy of choices appears as the only possible answers. Advertisers also create an FD when creating a situation with only two outcomes and the only correct or positive outcome leads to their brand. (shrink)

After surveying and criticizing some earlier definitions of "disease", we propose that a general term--malady--be used to represent what all diseases, illnesses, injuries, etc., have in common. We define a malady as the suffering, or increased risk of suffering an evil in the absence of a distinct sustaining cause. We discuss the key terms in the definition: evil, distinct sustaining cause, and increased risk. We show that the role of abnormality is to clarify these terms rather than to be used (...) directly in the definition of malady. (shrink)

This paper introduces and defends a new principle for when a structural equation model is apt for analyzing actual causation. Any such analysis in terms of these models has two components: a recipe for reading claims of actual causation off an apt model, and an articulation of what makes a model apt. The primary focus in the literature has been on the first component. But the problem of structural isomorphs has made the second especially pressing (Hall 2007; Hitchcock 2007a). Those (...) with realist sympathies have reason to resist the standard response to this problem, which introduces a normative parameter into the metaphysics (Hall 2007; Halpern and Hitchcock 2010, 2015; Halpern 2016a; Menzies 2017; Gallow 2021). However, the only alternative solution in the literature leaves central questions unanswered (Blanchard and Schaffer 2017). I propose an independently motivated aptness requirement, Evident Mediation, that provides the missing details and resolves the structural isomorph problem without need for a normative parameter. If you were looking for a philosopher likely to appeal to Americans, Friedrich Nietzsche would be far from your first choice. After all, in his blazing career, Nietzsche took aim at nearly all the foundations of modern American life: Christian morality, the Enlightenment faith in reason, and the idea of human equality. Despite that, for more than a century Nietzsche has been a hugely popular—and surprisingly influential—figure in American thought and culture. In _American Nietzsche_, Jennifer Ratner-Rosenhagen delves deeply into (...) Nietzsche's philosophy, and America’s reception of it, to tell the story of his curious appeal. Very little research into women farmers in developed countries has been produced by economists, but much of what has been studied by scholars in other disciplines has economic implications. This article reviews such research produced by scholars in all disciplines to explore to what extent women farmers are becoming more equal to men farmers and to suggest further contributions to the literature. As examples, topics that has been widely researched in developing countries but have received almost no attention in developed (...) countries include comparisons of men and women farmers’ productivity and their access to and use of resources. Discoveries in these and other areas will be important not only for their insights into the agricultural industry in developed countries, but also because they will inform, and be informed by, research on women farmers in developing countries. Recent empirical work suggests that intuitions may be less reliable than previously assumed. However, given the ubiquity of intuition in philosophical reasoning, it is tempting to give intuitions some evidential weight. This chapter develops an account called ‘moderate intuitionism’, a view whereby intuitions are generally reliable, but nonetheless capable of substantial degrees of error. Believing that the general reliability of intuition emerges from the nature of language, the chapter develops an outline for a disposition-based metasemantic theory which can ground the (...) link between intuition and truth: terms refer to whatever a speaker would be disposed to apply them to when in possession of all relevant information. Well-constructed thought experiments can elicit intuitions and generally reflect the semantic facts but this account can also explain why intuitions occasionally err — i.e. when a thought experiment fails to specify information that would influence the speaker’s dispositions. The primary purpose behind effectiveness research is to determine whether a treatment with demonstrated efficacy has utility when administered to the general population. The main questions these studies are meant to answer are these: Can the typical patient respond to treatment? Is the treatment acceptable to the typical patient? Can the treatment be administered safely and in its entirety in the typical treatment setting? Is the treatment under study significantly better than the community standard of care both from a cost (...) and outcome perspective? Answering these questions is meant to provide sufficient information to providers and policymakers so that effective interventions can be adopted and become the new community standard. For this research to make a meaningful impact on a provider and policymaker's decision to change the status quo, study interventions should be compared to the existing community standard of treatment, often referred to as treatment as usual. From an ethical perspective, this decision may not always be the safest choice. In some populations, TAU may mean no treatment at all, and in others TAU may be worse than withholding treatment. The effectiveness researcher is then caught between the pull to do no harm and the need for research to have an impact on change. The purpose of this article is to highlight certain conditions when TAU is ethically acceptable and to discuss alternatives when TAU may be an unethical treatment condition. For purposes of precision, we focus exclusively on psychotherapy effectiveness research rather than system-intervention research or medication-intervention research. (shrink)

Emotional arousal and negative affect enhance recall of central aspects of an event. However, the role of discrete emotions in selective memory processing is understudied. Undergraduates were asked to recall and rate autobiographical memories of eight emotional events. Details of each memory were rated as central or peripheral to the event. Significance of the event, vividness, reliving and other aspects of remembering were also rated for each memory. Positive affect enhanced recall of peripheral details. Furthermore, the impairment of peripheral recall (...) was greatest in memories of anger, not of fear. Reliving the experience at retrieval was negatively correlated with recall of peripheral details for some emotions (e.g., anger) but not others (e.g., fear), irrespective of similarities in affect and intensity. Within individuals, recall of peripheral details was correlated with less belief in the memory's accuracy and more likelihood to recall the memory from one's own eyes (i.e., a field perspective). This dissertation begins by addressing the question of when a causal model is apt for deciding questions of actual causation with respect to some target situation. I first provide relevant background about causal models, explain what makes them promising as a tool for analyzing actual causation, and motivate the need for a theory of aptness as part of such an analysis (Chapter 1). I then define what it is for a model on a given interpretation to be accurate of, that (...) is, say only true things about, some target situation. This involves a systematization of various representational principles mentioned and/or discussed throughout the literature into a method of interpretation, which I propose be taken as standard (Chapter 2). Next, I explain and address two reasons for which accuracy as I’ve defined it is insufficient for aptness. The first reason – already discussed in the literature – is the problem of structural isomorphs. In response, I propose the aptness condition of Explicit Partial Mediation (Chapter 3). The second reason – which has yet to be noticed – is the problem of the indeterminacy of accuracy. As I demonstrate, a model is accurate of a target situation only relative to a set of background possibilities – what I call a modal profile. It follows that a model represents a situation only relative to some modal profile or other. I go on to discuss the ramifications of this observation for a theory of actual causation in terms of models. I argue that the relativity be taken at face value and built into our metaphysical account of causation, resulting in a view that I call causal relativism (Chapter 4). I explore one advantage of this view in detail: that the resulting account can defend the principle of strong proportionality against several objections (Chapter 5). Finally, I apply the earlier discussion of aptness to attempts to provide a semantics of counterfactuals in terms of causal models – an interventionist semantics. I show how just as a similarity semantics relies on an opaque notion of similarity, an interventionist semantics relies on an analogous notion of aptness. The challenge of articulating aptness thus undermines the claim that an interventionist semantics avoids representational problems inherent in a similarity semantics (Chapter 6). Knowledge demands more than accuracy: epistemologists are broadly agreed that those who know are non-accidentally right, satisfying some kind of safety condition. However, it is hard to formulate any adequate account of safety, and harder still to explain exactly why we care about it. This paper approaches the problem by looking at a concrete human cognitive capacity, face recognition, to see where epistemic safety shows up in it. Drawing on new models in artificial intelligence, and making a case that human (...) face recognition is relevantly similar, I argue that safety is a natural feature of successful generalization. The concluding section of the paper applies this lesson to the problem of our intuitive recognition of knowledge. (shrink)

This paper draws from critical data studies and related fields to investigate police officer-involved homicide data for Los Angeles County. We frame police officer-involved homicide data as a rhetorical tool that can reify certain assumptions about the world and extend regimes of power. We highlight the possibility that this type of sensitive civic data can be investigated and employed within local communities through creative practice. Community involvement with data can create a countervailing force to powerful dominant narratives and supplement activist (...) projects that hold local officials accountable for their actions. Our analysis examines four Los Angeles County police officer-involved homicide data sets. First, we provide accounts of the semantics, granularity, scale and transparency of this local data. Then, we describe a “counter data action,” an event that invited members of the community to identify the limits and challenges present in police officer-involved homicide data and to propose new methods for deriving meaning from these indicators and statistics. The Russian invasion of Ukraine in 2022 was met with condemnation from the European Union and the United States as an "unprovoked and unjustified military aggression" that undermines the liberal international order. However, some international relations scholars, such as John Mearsheimer, argue that Russia had genuine security concerns with regard to Ukraine and that the invasion was a response to the threat of NATO membership for Ukraine. Both liberal and realist perspectives on the invasion rely on the assumption of rational, (...) cost-benefit calculations by actors, but cultural factors and irreconcilable non-material interests may also be at play in shaping the actions and motivations of states. Understanding the cultural and national identity factors at play in the invasion of Ukraine is complex and difficult, but they cannot be ignored in attempting to understand and address the conflict. Since 1997 there has been a significant increase in the number and percentage of Kansas farmers who are women. Using Reskin and Roos’ model of “job queues and gender queues” I analyze changes in the agricultural industry in Kansas that resulted in more women becoming “principal farm operators” in the state. I find there are three changes largely responsible for women increasing their representation in the occupation: an increase in the demand for niche products, a decrease in the average farm (...) size, and greater societal acceptance of women as farmers. This study adds to the growing literature on women principal farm operators in developed countries, and is among the first to explore why women are becoming a larger percentage of the occupation in the United States. The European Union approach to data protection consists of assessing the adequacy of the data protection offered by the laws of a particular jurisdiction against a set of principles that includes purpose limitation, transparency, quality, proportionality, security, access, and rectification. The EU's Data Protection Directive sets conditions on the transfer of data to third countries by prohibiting Member States from transferring to such countries as have been deemed inadequate in terms of the data protection regimes. In theory, each jurisdiction is (...) evaluated similarly and must be found fully compliant with the EU's data protection principles to be considered adequate. In practice, the inconsistency with which these evaluations are made presents a hurdle to international data-sharing and makes difficult the integration of different data-sharing approaches; in the 20 years since the Directive was first adopted, the laws of only five countries from outside of the EU, Economic Area, or the European Free Trade Agreement have been deemed adequate to engage in data transfers without the need for further administrative safeguards. Globally, there is a lack of adherence to the WHO definition of live birth. This is leading to untenable ethical inconsistencies due to significant variation in which infants are being acknowledged and registered as alive. If an infant is not registered as alive, there can be no acknowledgement of their rights as a child, and there are subsequent implications for worldwide child health resources and funding. Being alive should not be a quality that is geographically determined. It is well established that language production and comprehension are influenced by information status, for example, whether information is given, new, topical, or predictable, and many scholars suggest that an important component of information status is keeping track of what information is in common ground, and what is not. Information status affects both speakers' choices and how listeners interpret the speaker's meaning. Although there is a wealth of scholarly work on information status, there is no consensus on the mechanisms by (...) which it is used, and in fact relatively little discussion of the underlying representations and psycholinguistic mechanisms. Moreover, a major challenge to understanding information status is that its effects are notoriously variable. This study considers existing proposals about information status, focusing on two questions: how is it represented; and by what mechanisms is it used? I propose that it is important to consider whether representations and mechanisms can be classified as either explicit or emergent. Based on a review of existing evidence, I argue that information status representations are most likely emergent, but the mechanisms by which they are used are both explicit and emergent. This review provides one of the first considerations of information status processing across multiple domains. (shrink)

In this paper I argue that reference to a developmental account of agency can help explain, and in cases also alter, our current practices when it comes to the non-consensual medical treatment of children. It does this through its explanation of how stages of development impact the types of interests we have.

This study assesses how variations in heteronormative culture in high schools affect the well-being of same-sex-attracted youth. The authors focus on the stigmatization of same-sex attraction to better understand how heteronormativity may marginalize a wide range of youth. Specifically, the authors use data from the National Longitudinal Study of Adolescent Health to examine how variation across schools in football participation, religious attendance, and urban locale affects same-sex-attracted adolescents' depressive symptoms, self-esteem, fighting, and academic failure. The results suggest that though same-sex-attracted (...) youth are at greater risk for decreased well-being, these youth are at higher risk in nonurban schools and in schools where football and religion have a larger presence. Results vary for boys and girls: The urban locale of a school has a larger impact for boys, while school religiosity has a greater impact for girls. (shrink)

Charles Beitz has presented us with a new and novel theory of human rights, one that is motivated by a concern for the enforcement of human rights in modern international practice. However, the focus on states in his human rights project generates a tension between the universal aspirations of individual human rights and the vulnerable individuals who through rendition or state failure find themselves outside the international state system. This paper argues that Beitz and other theorists of human rights make (...) a mistake when they define human rights in statist terms. The scope of a theory of human rights must include all human beings, even if not simply in virtue of their humanity. The aspiration for human rights to be political and not metaphysical is interesting and admirable, but the human scope of human rights must be retained in order for human rights to retain their critical force. In Western Europe, debates surrounding the integration of ‘Muslim’ women over the last decade signify the ways in which racialized notions of gender and sexuality have come to define acceptable and unacceptable ways of being European. Discourses concerning the wearing of the headscarf and ‘honour crimes’ are particular ways in which ‘Muslim’ genders are produced, condemned and held responsible for posing a threat to supposedly stable European values of gender equality and sexual emancipation. This article examines some of the interventions (...) by feminist and gay activists Germany regarding the veil and so-called honour crimes, which reflect an increasing acceptance of the state’s escalating racialization processes on the part of activists. The article concludes that the very racialization of the category ‘Muslim’ needs to be examined not only in a postcolonial context but also how this process has emerged after 9/11 and the ‘War on Terror’. In this paper I argue that excising a final end from accounts of virtue does them more harm than good. I attempt to establish that the justification of contemporary virtue ethics suffers if moved this one step too far from the resources in traditional accounts. This is because virtue, as we tend to describe it, rests on an account of practical rationality wherein the role of the final end is integral. I highlight the puzzles that are generated by the ellipsis (...) that is “the role of a final end” in contemporary theories of virtue. The authors of these theories devise ad hoc solutions for these puzzles, puzzles that do not exist for traditional final end-based accounts. Recent critics of virtue ethics have certainly not been satisfied the explanations being offer in lieu of references to a final end. As a remedy, I recommend that the role of a final end be reintroduced in contemporary virtue ethics. I hope to explain that there is nothing to be frightened of and much to be gained. (shrink)
