The notion of ‘Inclusionary Othering,’ in garnering uptake within diverse nursing spheres, muddies a critical understanding of Othering by obscuring the colonial production, exploitation and perpetuation of the Other for economic and political gain. The ongoing genocide of Indigenous women and girls in Canada is a direct manifestation of the Othering process and in response to the report's Calls for Justice, it is an apt time to re‐enliven the conversation of the process of Othering's philosophical construction. The purpose of this (...) article is to re/turn to the philosophical underpinnings of the process of Othering in hopes of enlivening a new wave of resistance within nursing and elsewhere to the means by which the Other is constructed as well as to the notion of Inclusionary Othering itself. Perhaps this re/turn to the philosophy of Edward Said and Sylvia Wynter can result in further thwarting the Othering construct by highlighting its colonial construction and usher in a pragmatic shift, increasing critical engagement with the construct as well as inspiring a re/newed resistance toward Othering in nursing practice. Recent discussions on corporate citizenship highlight the new political role of corporations in society by arguing that corporations increasingly act as quasi-governmental actors and take on what hitherto had originally been governmental tasks. By examining political and sociological citizenship theories, the authors show that such a corporate engagement can be explained by a changing conception of corporate citizens from corporate bourgeois to corporate citoyen. As an intermediate actor in society, the corporate citoyen assumes co-responsibilities for social and civic affairs and (...) actively collaborates with fellow citizens beyond governmental regulation. This change raises the question of how such corporate civic engagement can be aligned with public policy regulations and how corporate activities can be integrated into the democratic regime. To clarify the mode of CC contributions to society, the authors will apply the tenet of subsidiarity as a governing principle which allows for specifying corporations’ tasks as intermediate actors in society. By referring to the renewed European Union strategy for Corporate Social Responsibility, the authors show how such a subsidiary corporate-governmental task-sharing can be organized. (shrink)

Based on the extended conceptualization of corporate citizenship, as provided by Matten and Crane :166–179, 2005), this paper examines the new role of corporations in society. Taking the ideas of Matten and Crane one step further, we argue that the status of corporations as citizens is not solely defined by their factual engagement in the provision of citizenship rights to others. By analysing political and sociological citizenship theories, we show that such engagement is more adequately explained by a change in (...) the self-conception of corporate citizens from corporate bourgeois to corporate citoyens. While the corporate bourgeois acts primarily for private business purposes, the corporate citoyen engages in society, performing civil and political rights and duties. As an intermediate actor in society, shaped by the principle of subsidiary task-sharing, the corporate citoyen undertakes co-responsibility for social and civic affairs and actively collaborates with fellow citizens below, beside and beyond governmental regulation. What if in discussion the critic refuses to recognize an emotionally expressed argument of her interlocutor as an argument, accusing him of having presented no argument at all. In this paper, we shall deal with this reproach, which taken literally amounts to a charge of having committed a fallacy of non-argumentation. As such it is a very strong, if not the ultimate, criticism, which even carries the risk of abandonment of the discussion and can, therefore, not be made without burdening (...) oneself with correspondingly strong obligations. We want to specify the fallacies of non-argumentation and their dialectic, i.e., the proper way to criticize them, the appropriate ways for the arguer to react to such criticism, and the appropriate ways for the critic to follow up on these reactions. Among the types of fallacy of non-argumentation, the emphasis will be on the appeal to popular sentiments. Our aim is to reach, for cases of non-argumentation, a survey of dialectical possibilities. By making the disputants themselves responsible for the place of emotion in their dialogues, we hope to contribute to a further development of the theory of dialectical obligations. (shrink)

The discussion around artificial empathy and its ethics is not a new one. This concept can be found in classic science fiction media such as Star Trek and Blade Runner and is also pondered on in more recent interactive media such as the video game Detroit: Become Human. In most depictions, emotions and empathy are presented as the key to being human. Misselhorn's new publication shows that these futuristic stories are becoming more and more relevant today. We must ask ourselves (...) whether we are socially responsible enough to deal with the consequences of artificial empathy/awareness. If we create artificial life, we should be prepared to treat them accordingly as living beings with respect and no longer categorize them as objects. The author does not rule out the idea that machines might one day become more human than humans themselves and that we humans might even lose our own specific cognitive, emotional and social abilities. This study investigates the aptitude–treatment interaction between text modality and learners’ modality preference on learning outcomes and cognitive load, which is currently a point of controversy. The Meshing Hypothesis postulates there are better learning outcomes when the modality of a learning environment matches the learner´s preference. However, previous research supporting the Meshing Hypothesis shows methodological issues. Therefore, clear empirical support is needed. We tested 42 learners in a between-subject design: Their preferences were either auditive–ambiguous or visual, and half of each (...) preference group randomly learned either with an auditive or a visual text. As expected, we did not find any main effects, but a significant interaction between the text modality and the learner´s preference for comprehension outcomes, extraneous cognitive load, and germane cognitive load. Specifically, learners with a preference for visual texts benefit from learning with their preferred modality, they showed higher comprehension scores and less extraneous load when learning from a visual text. Auditive–ambiguous learners showed almost equal results with both text modalities. This might be explained by the fact that most texts in everyday life are presented visually, and therefore learners with an auditive preference needed to develop appropriate reading strategies. In the 20th century the NAZI doctrine lead to Porrajmos - the Gypsy Holocaust. In the post-war communist countries, Gypsies were forced to give up their traditional ways of life and become productive. Persecution of Gypsies - those who stayed in the post-communist countries and those who migrated to the West - continued in Europe after the big changes of (...) 1989 and up to the present time. ABSTRACT:A wide range of research uses patterns of genetic variation to infer genetic similarity between individuals, typically referred to as genetic ancestry. This research includes inference of human demographic history, understanding the genetic architecture of traits, and predicting disease risk. Researchers are not just structuring an intellectual inquiry when using genetic ancestry, they are also creating analytical frameworks with broader societal ramifications. This essay presents an ethics framework in the spirit of virtue ethics for these researchers: rather than focus on (...) rule following, the framework is designed to build researchers’ capacities to react to the ethical dimensions of their work. The authors identify one overarching principle of intellectual freedom and responsibility, noting that freedom in all its guises comes with responsibility, and they identify and define four principles that collectively uphold researchers’ intellectual responsibility: truthfulness, justice and fairness, anti-racism, and public beneficence. Researchers should bring their practices into alignment with these principles, and to aid this, the authors name three common ways research practices infringe these principles, suggest a step-by-step process for aligning research choices with the principles, provide rules of thumb for achieving alignment, and give a worked case. The essay concludes by identifying support needed by researchers to act in accord with the proposed framework. (shrink)

Over the course of the last three decades, computer simulations have become a major tool of doing science and engaging with the world, not least in an effort to predict and intervene in a future to come. Born in the context of the Second World War and the discipline of physics, simulations have long spread into most diverse fields of enquiry and technological application. This paper introduces a topical collection focussing on simulations in the life sciences. Echoing the current state (...) of tinkering, fast developments, segmentation of knowledge and interdisciplinary collaboration, and in an effort to bridge the science-humanities divide, the contributors to this collection come from multiple disciplinary backgrounds, including information studies, cognitive sciences, philosophy and biology. The ambiguous character of simulations, their cutting across scientific disciplines, analysis and prediction, understanding and doing, gave rise to their success in contemporary life sciences and has been the object of much scientific debate. One of the main aims of this topical collection, by contrast, is to call into question the assumption of an obvious use and easy transfer of methods between fields of knowledge as diverse as, e.g. physics and biology. The collection presents historical case studies from various biological sub-fields. The articles study how simulations are used and the ways they contribute specifically to our understanding of life. Taking up Sergio Sismondo’s description of simulations as “compromises” and “glue”, they also critically engage with the question of what exactly the life sciences have been gluing together over the last two decades. How do civilians react to being harmed in war? Existing studies argue that civilian casualties are strategically costly because civilian populations punish a belligerent who kills civilians and support the latter's opponent. Relying on eighty-seven semi-structured interviews with victims of coalition attacks in Afghanistan, this article shows that moral principles inform civilians’ attitudes toward their own harming. Their attitudes may therefore vary with the perceived circumstances of an attack. Civilians’ perception of harm as unintended and necessary, in accordance with the (...) moral principles of distinction and necessity, was associated with narratives that cast an attack as relatively more legitimate and with a partial or full release of the coalition from blame. The principle of proportionality, which requires that civilian casualties are caused in pursuit of a legitimate war aim, informed their abstract attitudes toward civilian casualties in Afghanistan. Two rules of international law, which accord with the moral principles of distinction and necessity, were reflected in the civilians’ attitudes. The legal rule of proportionality, which diverges from the namesake moral principle, failed to resonate with the civilians. The article explores whether compliance with the legal rules of distinction and necessity can contribute to mitigating the strategic costs of civilian casualties. (shrink)

The situationally disqualifying ad hominem attack is an argumentative move in critical dialogue whereby one participant points out certain features in his adversary's personal situation that are claimed to make it inappropriate for this adversary to take a particular point of view, to argue in a particular way, or to launch certain criticisms. In this paper, we discuss some examples of this way of arguing. Other types of ad hominem argumentation are discussed as well and compared with the situationally disqualifying (...) type. The socalled Houtlosser Dilemma highlights the danger of unconditionally condoning ad hominem arguments. We propose a classification of ad hominem, and a more restrictive use of the term 'circumstantial'. Finally, we discuss whether ad hominem arguments are (always?) to be rejected as fallacious. Historians have often described embryology and concepts of development in the period around 1800 in terms of “temporalization” or “dynamization”. This paper, in contrast, argues that a central epistemological category in the period was “rhythm”, which played a major role in the establishment of the emerging discipline of biology. I show that Caspar Friedrich Wolff’s epigenetic theory of development was based on a rhythmical notion, namely the hypothesis that organic development occurs as a series of ordered rhythmical repetitions and variations. Presenting Christian Heinrich Pander’s and Karl Ernst von Baer’s theory of germ layers, I argue that Pander and Baer regarded folding as an organizing principle of ontogenesis, and that the principle’s explanatory power stems from their understanding of folding as a rhythmical figuration. In a brief discussion of the notion of rhythm in contemporary music theory, I identify an underlying physiological epistemology in the new musical concept of rhythm around 1800. The paper closes with a more general discussion of the relationship between the rhythmic episteme, conceptions of life, and aesthetic theory at the end of the eighteenth century. (shrink)

In response to stakeholder pressure, companies increasingly make ambitious forward-looking sustainability commitments. They then draw on corporate policies with varying degrees of alignment to disseminate and enforce corresponding behavioral rules among their suppliers and business partners. This goal-based turn in private sustainability governance has important implications for its likely environmental and social outcomes. Drawing on paradox theory, this article uses a case study of zero-deforestation commitments in the Indonesian palm oil sector to argue that goal-based private sustainability governance’s characteristics set (...) the stage for two types of paradoxes to emerge: performing paradoxes between environmental, social, and economic sustainability goals, and organizing paradoxes between cooperation and competition approaches. Companies’ responses to these paradoxes, in turn, can explain the lack of full goal attainment and differential rates of progress between actors. These results draw our attention to the complexities hidden behind governance through goal setting in the corporate space, and raise important questions about the viability of similar strategies such as science-based targets and net-zero goals. This issue ofScience in Contextis dedicated to the question of whether there was a “cinematographic turn” in the sciences around the beginning of the twentieth century. In 1895, the Lumière brothers presented their projection apparatus to the Parisian public for the first time. In 1897, the Scottish medical doctor John McIntyre filmed the movement of a frog's leg; in Vienna, in 1898, Ludwig Braun made film recordings of the contractions of a living dog's heart (cf. Cartwright 1992); in 1904, Lucien (...) Bull filmed in slow motion a bullet entering a soap bubble. In 1907 and 1908, respectively, Max Seddig and Victor Henri recorded Brownian motion with the help of a cinematograph (Curtis 2005). In 1909, the Swiss Julius Ries was one of the first to film fertilization and cell division in sea urchins (Ries 1909). In that same year in Paris, Louise Chevroton and Frédéric Vlès used a film camera to observe cell division in the same object (Chevroton and Vlès 1909). As early as 1898, the Parisian surgeon Eugène-Louis Doyen began filming several of his operations, among them the spectacular separation of the Siamese twins Doodica and Radica (Bonah and Laukötter 2009). And in England, the scientist and zoologist Francis Martin Duncan produced an array of popular-scientific films for Charles Urban: “The unseen world: A series of microscopic studies” was presented to the public in the Alhambra Theatre in London for the first time in 1903 (see Gaycken in this issue). She offers her own views about the genre with reference to contemporary documents and testimonials, secondary work, scholarly work, fiction and film. These observations and stories all circulate around her own 1986 landmark text, Winter in the Morning.

Understanding risk factors for relationship dissolution and poor relationship adjustment among couples has been an active area of research in relationship science. One risk factor, non-marital cohabitation, has shown to predict higher rates of relationship dissolution and relationship instability in some samples, but the associations among German parents with children over time are less clear. In this study, we examined the links between non-marital cohabitation and 10-year outcomes in 220 German families with preschool-aged children at the initial assessment followed into (...) adolescence. Families were assessed 7 times over the 10 years and retention at the 10-year follow-up was over 92%. After accounting for multiple testing, only mother’s report of better initial interparental communication predicted whether parents were likely to stay together over the course of the 10 years. Adolescents of parents who cohabited were at higher risk for externalizing symptoms 10 years later compared to children of married parents. In addition, although there were no differences between cohabiting couples and married couples at the initial assessment in relationship adjustment, cohabiting mothers who stayed with their partner over the 10 years showed significantly greater declines in relationship adjustment over the 10 years compared to married mothers. Findings indicate the need for further research that explores family structure and dynamics over time to inform refinement of prevention programs targeting relationships and children’s mental health. The article aims to present the concepts of Adam Smith which are important considering the current disputes over liberalism, as well as the challenge that is the maintenance of the world’s economic order. Firstly, the article analyses the significance of the division of labour which is perceived as a fundamental premise for transitioning from small communities and face-to-face exchanges to the impersonal exchange and the expanded social order in which relations with strangers become meaningful. Secondly, the present work indicates that (...) Smith did not neglect the matter of justice when proclaiming the need for freedom. He believed that efficient functioning of the market depends on the political system and a man’s ethical system, and his criticism of interventionism was not directed against the state as an institution co-creating the social order, but against the act of granting special privileges to certain interest groups. Thirdly, the article refers to the concept of coordination described by Scottish moral philosophers and the so-called Smith Problem. In this context, the article presents arguments against the assumption that John Nash’s theory provided proof of the erroneous nature of Adam Smith’s concepts. Arguments in favour of the timelessness of the economic philosophy of the father of economics are also drawn from Vernon Smith’s experimental economy and the research of evolutionary psychologists. Peter Koslowski’s project of ‘ethical economy’ can be understood as an effort to search for human face of late capitalism. In his perspective ‘ethical economy’ is not a simple combination and connection between economy and ethics but is a new approach which includes three fields: theory of ethical premises of economy, concept of ethics profiled towards needs of economy and ethical and economical theory of goods and cultural values. Koslowski reinterprets problems of maximization found in classical economy. He criticizes the (...) model of homo oeconomicus as the model of a reactive man not understood as activated. According to Koslowski, economical theory of market balance also requires reinterpretation. Without assuming that teleology belongs internally to social reality and therefore to market as well, so to create environment for development of human subjectivity, there cannot exist any theory of legitimization of individualistic economic institutions which protect freedom. Without that, Koslowski claims, there can only be theory of social process authority in which the strongest reinforce their positions. Taking subjectivity and auto-referential character of a human being into consideration is the ontological basis, which allows to reach ethical dimension of decision-making processes and responsibility. By analogy, the mechanism of ‘invisible hand’ requires referring to common good. In the age of globalization ‘invisible hand’ is a source of evil. (shrink)

Life in good health and health security prove the most significant values highlighted by moral philosophy in the time of the environmental crisis. The imperfect operation of healthcare poses a threat for humans. Administrative measures regulate insufficiently medicine and healthcare. They need to be backed up by ethics, which cannot be seen solely as ethics of an individual’s conscience. What is needed is professional, practice-oriented and institutionalized-within-healthcare-organizations ethics. Recently, there have appeared a great number of new international documents setting standards (...) of medical procedures in compliance with the requirements of the new bioethical values. At the same time elements of the ethical infrastructure such as bioethics commissions or committees have been created. In the face of the specificity and the complexity of ethical issues and problems encountered within contemporary medical practice the requirement of high ethical competence of all healthcare workers often fails to be sufficient. In argumentation, as elsewhere, speakers strategically engage favourable presumptions by manifestly making themselves accountable for their communicative efforts. Such strategies provide the addressee with reasons to regard the speaker as accountable in specific ways and, via that regard for the speaker, with situation-specific rationales for responding positively to what the speaker says. This paper identifies some resources available to arguers for strengthening, elaborating, and focusing such special presumptions. The paper offers an analysis of Barbara Jordan’s “Statement on the Articles of (...) Impeachment” as illustrative of these resources for strengthening a speaker’s ethos. (shrink)

BackgroundOrganizations worldwide increasingly adopt inclusive talent management, and this approach appears to rhyme particularly well with the Nordic welfare model. Questions about its value remain understudied, however. The inclusive approach is rooted in positive psychology and focuses on recognizing each employee's individual talents and assessing whether they fit the long-term needs of the organization, since a fit is assumed to be associated with employees' wellbeing. In the present study, we test this assumption focusing specifically on a key talent management practice, (...) talent identification, and the social dimension of employee wellbeing.MethodData were collected through an employee survey conducted within the Finnish units of four international manufacturing organizations and analyzed using logistic regression.ResultsWe found that the recognition of individual talents for long-term deployment by the organization is positively associated with social wellbeing in terms of supervisor support and social climate in the work unit, as perceived by the employees.ConclusionOur results tentatively suggest that inclusive talent management creates value through the identification of employees' individual talents as this practice can be associated with their enhanced wellbeing. Rozważania podjęte w tym artykule nawiązują do współczesnej dyskusji o normatywności znaczenia, jaka została zapoczątkowana przez S. Kripkego. Główny nurt tej dyskusji dotyczy związku normatywności znaczenia z poprawnością użycia wyrażeń i pozostawia problem rozumienia samej normatywności na boku. W tym artykule podjęta zostanie próba odpowiedzi na takie pytania, jak: Na czym polega normatywność reguł znaczeniowych? Jak rozumieć normy i co je wyróżnia spośród innych reguł? Do jakich racji można odwołać się w uzasadnieniu normatywności znaczenia? W niniejszym artykule, jako punkt wyjścia, (...) została krótko przedstawiona teza Kripkego o normatywności znaczenia oraz dominująca linia dyskusji dotyczącej tej tezy. Zostały pokazane trudności związane ze sformułowaniem kryterium poprawnego użycia, oraz wskazane, że istnienie reguł użycia wyrażeń nie jest jednoznaczne z normatywnością tych reguł. Podjęta została próba wskazania podstawowej charakterystyki znaczeń terminów „reguły” i „normy”, a następnie została omówiona kwestia społecznej determinacji reguł znaczeniowych. Zostało pokazane, że reguły użycia wyrażeń są zakotwiczone w społecznej funkcji języka. Na koniec została poruszona kwestia związku społecznie ugruntowanych reguł użycia wyrażeń z funkcją reprezentacji w języku świata pozajęzykowego. Znaczenie rozumiane jako treść wyrażenia nie jest tylko konwencjonalne, ale jest też konstytuowane przez reprezentatywną funkcję języka. Zostało wskazane, aby normatywność znaczenia rozpatrywać w dwu wymiarach: społecznym, konwencjonalnym oraz drugim związanym z funkcją reprezentacji świata w języku. (shrink)

This paper discusses several types of relevance criticism within dialogue. Relevance criticism is a way one could or should criticize one's partner's contribution in a conversation as being deficient in respect of conversational coherence. The first section tries to narrow down the scope of the subject to manageable proportions. Attention is given to the distinction between criticism of alleged fallacies within dialogue and such criticism as pertains to argumentative texts. Within dialogue one may distigguish tenability criticism, connection criticism, and narrow-type (...) relevance criticism. Only the last of these three types of criticism constitutes a charge of fallacy and carries with it a burden of proof. In the second it is observed that a full study of narrow-type relevance criticism would require the construction of complicated, many-layered, dialogue systems. Such a study can, however, be profitably preceded by setting up profiles of dialogue that help us discuss the ins and outs of certain types of move. This is illustrated with an example. (shrink)

Formal dialectic has its roots in ancient dialectic. We can trace this influence in Charles Hamblin’s book on fallacies, in which he introduced his first formal dialectical systems. Earlier, Paul Lorenzen proposed systems of dialogical logic, which were in fact formal dialectical systems avant la lettre, with roles similar to those of the Greek Questioner and Answerer. In order to make a comparison between ancient dialectic and contemporary formal dialectic, I shall formalize part of the Aristotelian procedure for Academic debates. (...) The resulting system will be compared (1) with Van Eemeren and Grootendorst’s system of rules of Critical Discussion (the pragma-dialectical discussion procedure), which must, however, first itself be reconstructed as a formal dialectical system, and (2) with a Hamblin-type system, and (3) a Lorenzen-type system. When drawing comparisons, it will become clear that there is a line to be drawn from Aristotle to formal dialectic and pragma-dialectics, extending to contemporary computational models of argument. We shall investigate the similarities and dissimilarities between old and new dialectic. For the ‘old dialectic’, we base our survey mainly on Aristotle’s Topics and Sophistical Refutations, whereas for the ‘new dialectic’, we turn to contemporary views on dialogical interaction, such as can, for the greater part, be found in Walton’s The New Dialectic. Three issues are taken up: types of dialogue, fallacies, and strategies. Though one should not belittle the differences in scope and outlook that obtain between the old (...) and the new dialectic, the paper will show that in many respects the old dialectic foreshadows the new dialectic. [Wilfrid Hodges] During the last forty or so years it has become popular to offer explanations of logical notions in terms of games. There is no doubt that many people find games helpful for understanding various logical phenomena. But we ask whether anything is really 'explained' by these accounts, and we analyse Paul Lorenzen's dialogue foundations for constructive logic as an example. The conclusion is that the value of games lies in their ability to provide helpful metaphors and representations, rather (...) than in any true conceptual analysis. In fact some of the standard explanations of logical notions in terms of competitive games simply don't work. /// [ Erik C. W. Krabbe] In an attempt to redeem the Lorenzen-type dialogues from their detractors, it is perhaps best first to provide a survey of the various benefits these dialogues have been supposed to yield. This will be done in Section I. It will not be possible, within the confines of this paper, to scrutinize them all, but in Section II we shall delve deeper into the capacity of this type of dialogue to yield a model for the immanent criticism of philosophical positions. Section III will extend the concept of a dialogue in such a way as to conform better with our intuitive conceptions of what a rational discussion of a position should contain. This will be followed up by a concept of 'winning a dialogue' that takes position midway between the old conception of 'winning one play' and that of the full-fledged presentation of a winning strategy. Concepts of 'rational discussion' are thus shown to be, plausibly, more fundamental than those of proof. They are tied to Aristotle's theory of categories and to peculiarities of Greek grammar that fail to hold appeal for a contemporary readership. Yet, upon closer inspection, Figure of Speech shows many points of contact with views and problems that inhabit 20th-century analytical philosophy. In the paper, some Aristotelian examples will be analyzed to gain a better understanding of this fallacy. The case of (...) the Third Man argument and some modern cases lend plausibility to the claim that Figure of Speech is of more interest as a type of fallacy than has generally been assumed. Finally, a case is made for the view that Figure of Speech, though listed among the fallacies dependent upon language, is not properly classified as a fallacy of ambiguity. More likely, it should be looked upon as a type of non sequitur. This has important consequences for the profile of dialogue associated with this fallacy. (shrink)

Sometimes pernicious circularities appear in definitions of fundamental concepts of argumentation theory. For instance, in pragma-dialectical theory, the concept of a fallacy and that of a critical discussion aiming at resolving a difference of opinion mutually presuppose one another. A similar relationship obtains, in argumentation theory at large, between the concept of argumentation and that of rationality. Again, the concept of an argumentative dialogue presupposes a concept of statement. Yet, statementhood is sometimes claimed to be determined by a locution’s function (...) in dialogue. Similarly, for the concepts of proof and argument. Are these circularities really objectionable? Are they resolvable? If they are not, how can we live with them? It will be argued that some of these problems can be neglected some of the time, but not all of them all of the time. Though there may be no royal road towards resolution, several strategies can be applied. But sometimes patience is what is needed. (shrink)

Contemporary theory of argumentation offers many insights about the ways in which, in the context of a public controversy, arguers should ideally present their arguments and criticize those of their opponents. We also know that in practice not all works out according to the ideal patterns: numerous kinds of derailments are an object of study for argumentation theorists. But how about the use of unfairstrategiesvis-à-vis one’s opponents? What if it is not a matter of occasional derailments but of one party’s (...) systematic refusal to take other parties seriously? What if one party continually forgoes any form of critical testing and instead resorts to threats or blackmail? Can this be countered by the tools of reason? Or should one pay one’s opponent back in the same coin? To gain some grasp of these issues, we describe a number of strategies used in the public controversy about induced earthquakes in Groningen. We check whether these strategies arefair,i.e.balanced, transparent,andtolerant.We also investigate the effects of the choice for a particular kind of strategy. It appears that, in circumstances, choosing a fair strategy may be detrimental for resolving the controversy and choosing an unfair one beneficial. Following up ideas from social psychology and political science, we formulate some guidelines for the choice of strategies. At the end, we stress the importance — especially for those whose opinions carry little weight — of having a society in which the knowledge and skills needed for assessing the fairness of strategies are widespread. BackgroundEverybody has the right to decide whether to receive specific medical treatment or not and to provide their free, prior and informed consent to do so. As dementia progresses, people with Alzheimer’s dementia (PwAD) can lose their capacity to provide informed consent to complex medical treatment. When the capacity to consent is lost, the autonomy of the affected person can only be guaranteed when an interpretable and valid advance directive exists. Advance directives are not yet common in Germany, and their (...) validity is often questionable. Once the dementia diagnosis has been made, it is assumed to be too late to write an advance directive. One approach used to support the completion of advance directives is ‘Respecting Choices’®—an internationally recognised, evidence-based model of Advance Care Planning (ACP), which, until now, has not been evaluated for the target group of PwAD. This study’s aims include (a) to investigate the proportion of valid advance directives in a memory clinic population of persons with suspected AD, (b) to determine the predictors of valid advance directives, and (c) to examine whether the offer of ACP can increase the proportion of valid advance directives in PwAD.MethodWe intend to recruit at leastN = 250 participants from two memory clinics in 50 consecutive weeks. Of these, the first 25 weeks constitute the baseline phase (no offer of ACP), the following 25 weeks constitute the intervention phase (offer of ACP). The existence and validity of an advance directive will be assessed twice (before and after the memory clinic appointment). Moreover, potential predictors of valid advance directives are assessed.DiscussionThe results of this study will enhance the development of consent procedures for advance directives of PwAD based on the ACP/Respecting Choices (R) approach. When comparing aesthetic with moral values Ingarden does not define their mutual relation but tries to determine generic moments of various types. Neither aesthetic nor moral values can exist autonomously but require a vehicle. Aesthetic values appear as some qualifications of aesthetic objects, whereas moral values are some qualifications of conscious subjects and a proper structure both of subjects and of the world which must admit free actions is indispensable for the realisation of moral values. Ingarden admits the possibility of (...) a different mode at existence for moral values than for aesthetic ones, the former being more firmly rooted in their foundation. Values form hierarchies. Theory serve nothing but themselves and depend on no evaluation, Ingarden tries to demonstrate the objectivity of values, listing the conditions on which it depends, and postulates that a necessary correlation be sought between the properties of the vehicle and the values of determinate qualities. The main difference between aesthetic and moral values is that the latter are obligatory in character. This may be read from the content of their ideas. Values only partly go into the general ontology developed by Ingarden, but this ontology was no closed system even for himself and there is evidence that he may have expended his conception to embrace also the sphere of values. Ingarden described accurately neither the mode of existence nor the formal structure of va1ues. His closest interest belonged to their matter because in it he thought he might find the principle of grouping values into various genera. He regarded the study of the laws of co-existence of various value, as a major task of material ontology. Moral values may be credited with a higher dignitas than other values and their realisation is not without influence on the acting subject’s personality. In conclusion the authoress proposes to define value as a new qualitative dimension of the object serving as its vehicle. The value dimension of objects might go in various directions depending on the kind of value involved. (shrink)

Some critical reactions hardly give clues to the arguer as to how to respond to them convincingly. Other critical reactions convey some or even all of the considerations that make the critic critical of the arguer’s position and direct the arguer to defuse or to at least contend with them. First, an explication of the notion of a critical reaction will be provided, zooming in on the degree of “directiveness” that a critical reaction displays. Second, it will be examined whether (...) there are normative requirements that enhance the directiveness of criticism. Does the opponent have in circumstances a dialectical obligation to provide clarifications, explanations, or even arguments? In this paper, it is hypothesized that the competitiveness inherent in critical discussion must be mitigated by making the opponent responsible for providing her counterconsiderations, if available, thus assisting the proponent in developing an argumentative strategy that defuses them.
