The UK government has recently committed to adopting a new policy—dubbed ‘Martha’s Rule’—which has been characterised as providing patients the right to rapidly access a second clinical opinion in urgent or contested cases. Support for the rule emerged following the death of Martha Mills in 2021, after doctors failed to admit her to intensive care despite concerns raised by her parents. We argue that framing this issue in terms of patient rights is not productive, and should be avoided. Insofar as (...) the ultimate goal of Martha’s Rule is the provision of a clinical service that protects patient safety, an approach that focuses on the obligations of the health system—rather than the individual rights of patients—will better serve this goal. We outline an alternative approach that situates rapid clinical review as part of a suite of services aimed at enhancing and protecting patient care. This approach would make greater progress towards addressing the difficult systemic issues that Martha’s Rule does not, while also better engaging with the constraints of clinical practice. (shrink)

Many people accept, at least implicitly, what I call the asymmetry claim: the view that moral realism is more defensible than aesthetic realism. This article challenges the asymmetry claim. I argue that it is surprisingly hard to find points of contrast between the two domains that could justify their very different treatment with respect to realism. I consider five potentially promising ways to do this, and I argue that all of them fail. If I am right, those who accept the (...) asymmetry claim have a significant burden of proof. (shrink)

The political and financial investments in the implementation of forensic DNA databases and the ethical issues related to their use and expansion justify inquiries into their performance and general utility. The main function of a forensic DNA database is to produce matches between individuals and crime scene stains, which requires a constant input of individual profiles and crime scene stains. This is conditioned, among other factors, by the legislation, namely the criteria for inclusion of profiles and the periods of time (...) and conditions for their retention and/or deletion. This article aims to provide an overview of the different legislative models for DNA databasing in Europe and ponder if wider inclusion criteria – and, consequently, database size – translates into more matches between profiles of crime scene stains and included individuals. The legislation governing forensic DNA databases in 22 countries in the European Union was analysed in order to propose a typology of two major groups of legislative criteria for inclusion/retention of profiles that can be classified as having either expansive effects or restrictive effects. We argue that expansive criteria for inclusion and retention of profiles do not necessarily translate into significant gains in output performance. (shrink)

In practice, scoring rules elicit good probability estimates from individuals, while betting markets elicit good consensus estimates from groups. Market scoring rules combine these features, eliciting estimates from individuals or groups, with groups costing no more than individuals. Regarding a bet on one event given another event, only logarithmic versions preserve the probability of the given event. Logarithmic versions also preserve the conditional probabilities of other events, and so preserve conditional independence relations. Given logarithmic rules that elicit relative probabilities of (...) base event pairs, it costs no more to elicit estimates on all combinations of these base events. (shrink)

This study assesses the disconnect between television news directors' and journalism students' perceptions of issues in media ethics. Responses from 60 news directors and 166 students enrolled in ethics courses at three universities offer insight into what issues practitioners actually face, what issues students think they will face, and how serious each group perceives potential ethical dilemmas to be. Both groups agree that ethics is best learned on the job.

Every year medical researchers make contact with a large number of cancer survivors with the aim of evaluating cancer treatment. For this reason we decided to investigate how Swedish cancer survivors perceived their participation in research studies focusing on the long-term consequences of being a survivor of gynaecological or urinary bladder cancer. Data were collected by means of two study-specific postal questionnaires, both consisting of questions covering physical symptoms, well-being and the experience of being a cancer survivor. Both questionnaires also (...) included questions evaluating the participants’ experience of being research subjects. The questionnaires were developed in close co-operation with cancer survivors. The study population consisted of 1068 cancer survivors. Of these, 95% (n=1003) reported that they thought the study was valuable and 54% (n=559) that they had been positively affected by participating. Four per cent (n=39) expressed that they had been negatively affected by their participation in the study. The vast majority of the cancer survivors thought that participating in their particular study was valuable. (shrink)

If we are not to conclude that most planets like Earth have evolved life as intelligent as we are, we must presume Earth is not random. This selection effect, however, also implies that the origin of life need not be as easy as the early appearance of life on Earth suggests. If a series of major evolutionary transitions were required to produce intelligent life, selection implies that a subset of these were “critical steps,” with durations that are similarly distributed. The (...) time remaining from now until simple life is no longer possible on Earth must also be similarly distributed. I show how these results provide timing tests to constrain models of critical evolutionary transitions. (shrink)

Chalmers is right: we should expect our civilization to, within centuries, have vastly increasedmental capacities, surely in total and probably also for individual creatures and devices.We should also expect to see the conflicts he describes between creatures and devices with more versus less capacity. But Chalmers' main prediction follows simply by extrapolating historical trends, and the conflicts he identifies are common between differing generations. There is value in highlighting these issues, but once one knows of such simple extrapolations and standard (...) conflicts, it is hard to see much value in Chalmers' added analysis. (shrink)

This book's importance is derived from three sources: careful conceptualization of teacher induction from historical, methodological, and international perspectives; systematic reviews of research literature relevant to various aspects of teacher induction including its social, cultural, and political contexts, program components and forms, and the range of its effects; substantial empirical studies on the important issues of teacher induction with different kinds of methodologies that exemplify future directions and approaches to the research in teacher induction.

Intuition is surely a theme of singular importance to phenomenology, and Henry writes sometimes as if intuition should receive extensive attention from phenomenologists. However, he devotes relatively little attention to the problem of intuition himself. Instead he off ers a complex critique of intuition and the central place it enjoys in phenomenological speculation. This article reconstructs Henry’s critique and raises some questions for his counterintuitive theory of intuition. While Henry cannot make a place for the traditional sort of intuition given (...) his commitment to the primacy of life as the natural and spontaneous habitation of consciousness, an abode entirely outside the world, there nevertheless with some modification to Henry’s thinking could be a role for intuition to play in discerning the traces of life in the world. It is commonly assumed that persons who hold abortions to be generally impermissible must, for the same reasons, be opposed to embryonic stem cell research [ESR]. Yet a settled position against abortion does not necessarily direct one to reject that research. The difference in potentiality between the embryos used in ESR and embryos discussed in the abortion debate can make ESR acceptable even if one holds that abortion is impermissible. With regard to their potentiality, in vitro embryos are here argued (...) to be more morally similar to clonable somatic cells than they are to in vivo embryos. This creates an important moral distinction between embryos in vivo and in vitro. Attempts to refute this moral distinction, raised in the recent debate in this journal between Alfonso Gómez-Lobo and Mary Mahowald, are also addressed. (shrink)

While the question of whether selected-effects accounts of function or causal-role accounts of function provide the ‘true' functional analysis has given way to a general pluralistic consensus, Philip Kitcher has suggested that different functional accounts allow for unification. I argue that Kitcher's attempt to unify the two functional analyses fails because he adopts the environment-centered perspective on selection as a premise. The premise is undermined by the role niche construction is likely to play in the context of evolution. Can we succeed in giving consciousness a naturalistic explanation, that is, an explanation in “broadly physical terms”? This is the “problem of consciousness” which, along with other aspects of the mind-body problem, is explored by McGinn in a collection of eight independently written but related, sometimes overlapping papers, all but two previously published. The papers span a decade and divergent approaches. The resulting juxtaposition of two contrasting “resolutions” of the problem by the same author invites their comparison.

ABSTRACT This essay analyses the visual representation of melancholy and related themes in the work of American artist Thomas Eakins (1844–1916). Its particular focus is Home Scene (1870–1871), an intimate portrait of two of the artist’s sisters in the parlour of their family home in Philadelphia. Through a close examination of Home Scene in relation to later portraits by and of the artist, my analysis sheds new light on how and why Eakins reshaped ideations of melancholy based in European art (...) and intellectual history within the context of nineteenth century American culture. While representing both the appearance and effects of melancholy in Home Scene and many other of his portraits, Eakins also constructed aspects of his own artistic identity in accordance with this theme. Analysing the ideas and practices that impacted these processes, this study shows how the artist’s life-long fascination with the intertwined subjects of melancholy, mental illness, and the trope of the misunderstood artist-genius informed his personal and professional lives as it intersected with prominent discourses on women, gender, and medicine in post-Civil War America. Providing theoretical and applied analyses of Michel Henry's practical philosophy in light of his guiding idea of Life, this is the first sustained exploration of Henry's practical thought in anglophone literature, reaffirming his centrality to contemporary continental thought. This book ranges from the tension between his methodological insistence on life as non-intentional and worldly activities to Henry's engagement with the practical philosophy of intellectuals such as Marx, Freud, and Kandisky to topics of application such as labor, abstract art, education, political (...) liberalism, and spiritual life. An international team of leading Henry scholars examine a vital dimension of Henry's thinking that has remained under-explored for too long. (shrink)
