The historian and religious scholar Ernst Ludwig Ehrlich (1921-2007) was among the most influential minds in the post-Shoah German-speaking Jewish world. In 1943, with the help of Christian friends, he escaped from Berlin to Switzerland, where as a student, he became a spokesman in Jewish-Christian dialogue. Hartmut Bomhoff narrates how despite the experience of expulsion, life in the underground, and flight, Ehrlich became a bridge-builder.

Hartmut Rosa advances an account of the temporal structure of society from the perspective of critical theory. He identifies three categories of change in the tempo of modern social life: technological acceleration, evident in transportation, communication, and production; the acceleration of social change, reflected in cultural knowledge, social institutions, and personal relationships; and acceleration in the pace of life, which happens despite the expectation that technological change should increase an individual's free time. According to Rosa, both the structural and (...) cultural aspects of our institutions and practices are marked by the "shrinking of the present," a decreasing time period during which expectations based on past experience reliably match the future. When this phenomenon combines with technological acceleration and the increasing pace of life, time seems to flow ever faster, making our relationships to each other and the world fluid and problematic. It is as if we are standing on "slipping slopes," a steep social terrain that is itself in motion and in turn demands faster lives and technology. As Rosa deftly shows, this self-reinforcing feedback loop fundamentally determines the character of modern life. (shrink)

The language of balancing and proportionality figures increasingly, often in judicial and academic constitutional legal reasoning in Western democracies. The spread of this particular form of discourse raises important methodological and substantive issues for scholars of comparative law. While the dominant narrative in the relevant lines of scholarship has long been one of similarity and convergence, this article argues that not enough attention has been paid to the possibility of difference—the idea that references to balancing might mean very different things (...) in different settings. In Parts I and II, the article suggests that a methodological shift—from a focus on balancing as doctrine to a focus on balancing as legal argument—will be necessary to bring out these different meanings. Based on a case study of early and mid-twentieth century practices in Germany and the United States, it is argued that one crucial difference in the local meanings of balancing in these settings relates to the extent to which choices of legal form are locally expected to have inherent substantive implications. The comment deals with the relevance of Coleman’s Foundations of Social Theory for so called ‘sociological theory’. On the one hand Coleman’s work is an extraordinary contribution to the solution of some of the most important ‘classical’ questions of sociology. On the other hand it is to be expected that the enormous potential of the book probably has only limited effects within the wider sociological profession. One reason for that estimation is the unfamiliarity of many sociologists with Coleman’s instruments of (...) aggregation of collective effects. The other - more important - reason is that Coleman almost completely leaves out any discussion of the importance of ‘symbolic’ and ‘cultural’ processes. Insofar the book is indeed a ‘Foundation of Social Theory’ but not a foundation of ‘sociology’ in its past and present understanding. (shrink)

If we are to find the criteria for critical analyses of social arrangements and processes not in some abstract, universalist framework, but from the guiding ‘self-interpretations’ of the societies in question, as contemporary contextualist and ‘communitarian’ approaches to social philosophy suggest, the vexing question arises as to where these self-interpretations can be found and how they are identified. The paper presents a model according to which there are four interdependent as well as partially autonomous spheres or ‘levels’ of socially relevant (...) self-interpretation that have to be taken into account equally in order to provide a sound basis for social and political criticism. Thus, it is from the tensions and incoherences between (A) social ideas and doctrines, (B) social institutions and practices, (C) individual beliefs and convictions, and (D) body-practices and habits that social pathologies can be identified and possible solutions can be envisaged. The greatest risks of Covid-19 are not arising from its direct effects on morbidity and mortality but from exaggerated aspirations to control such effects politically. A swift transformation from an epidemic to an endemic state of affairs may in case of a disease with comparatively low and unequally distributed mortality like covid-19 be an option, too. This needs to be laid out but it is not the task of science to plead for this or any other option.

The Convention on Biological Diversity opens the possibility to negotiate a legally binding Biosafety Protocol to assess and minimize risks in the field of transboundary transfer, handling, and use of organisms modified by genetic engineering. Two principles— the Precautionary Principle and the Principle of Familiarity—guiding the risk assessment as basis of import decisions on such organisms are discussed. Developing and European industrialized countries favor the Precautionary Principle. The U.S., Australia, Japan, and some others call for the Principle of Familiarity. These (...) two principles exhibit opposite effects on scientific progress in general and on scientific methodology of risk assessment in particular. With the example of risk assessment by the U.S. company Monsanto discussed below, it could be illustrated that the Principle of Familiarity opens the way for superficial evaluations based on citing arbitrary references while the Precautionary Principle is an incentive for developing and applying sound methodology in experimental risk assessment. on the transboundary transfer of such LMOs, for example, on the international exchange of and trade with transgenic seeds, grains, animals, or bacteria. The negotiations are based on Articles 19.3 and 8(g) of the Convention on Biological Diversity, elaborated during the Earth Summit in Rio de Janeiro, Brazil, in 1992, and on Decision II/5 of the Second Conference of the Parties to this Convention in Jakarta, Indonesia, in 1995 (see the appendix; for more documents, see www.biodiv.org). Until the Fourth Conference of the Parties in 1998, 172 states ratified this convention. This conference decided to finish the Biosafety Protocol in February 1999. In 1998, transgenic crops were allowed to be planted in eight (75%) countries of the world. As the country with the largest acreage of transgenic crops and as the main trader of LMOs, the United States cannot become a member of the protocol until it has ratified the Convention on Biological Diversity. This book develops a notion of differences and "otherness" beyond hegemonic and hierarchical thinking as represented by the legacies of Western philosophical and political thinking. In doing so, it relates to the 20th Century phenomenological discourse, especially to Georg Simmel, Alfred Schütz, Emmanual Lévinas, and Jacques Derrida, and drafts our understanding of difference as a genuine human experience of a social and political world that is in motion and transformative, rather than static and predictable. On this basis of temporalized ontology (...) and its normative consequences, differences are drafted as a positive social and political force and as powerful capacities of transformation and change. In practical terms, this understanding is most important for our theorizing and acting upon peace, peace-building, and conflict solution. Differences appear now not as obstacle to peace and reconciliation, but as lively and constructive articulation of "otherness" and as a positive power of transformation, emancipation, and change.This book will be of interest to students of international relations, philosophy, and political theory. Während der größte Teil der Bevölkerung die kieferorthopädische Therapie, also die Veränderung der Zahn- bzw. Kieferstellung, als eine Behandlung betrachtet, die vor allem auf eine Verbesserung des Erscheinungsbildes zielt, sehen der kieferorthopädische und zahnärztliche Berufsstand sowie auch private und öffentliche Kostenträger in bestimmten Abweichungen von Zahn- oder Kieferstellungen eine Gefährdung der oralen Gesundheit und der Funktionsfähigkeit des Gebisses. Letztere Auffassung bestimmt das ärztliche Handeln in der Kieferorthopädie und begründet auch die Übernahme zumindest bestimmter Leistungen durch die gesetzlichen Krankenkassen. Anhand aktueller (...) wissenschaftlicher Erkenntnisse lassen sich jedoch in vielen Fällen keine (akuten oder potentiellen) gesundheitlichen oder essentiellen funktionellen Beeinträchtigungen und Risiken abweichender Zahnstellungen nachweisen. Ziel dieses Aufsatzes ist es, diesem Widerspruch nachzugehen. Im Folgenden werden wir aufzeigen, welche Faktoren die Anbieter kieferorthopädischer Leistungen beeinflussen, welches die entscheidenden Gründe und Grundlagen für die Behandlung sind und an welchen Kriterien sich die Leistungsübernahme durch die Krankenkassen orientiert. Dabei wird deutlich werden, dass die formalen Kriterien von Behandlung und Kostenübernahme, die tatsächliche Behandlungs- und Kostenerstattungspraxis, die Erwartungen derjenigen, die Behandlungsleistungen in Anspruch nehmen und der aktuelle Stand der Forschung zu erwartbaren Funktionsbeeinträchtigungen durch Zahnstellungsvariationen nicht zwanglos zu vereinbaren sind. Erforderlich erscheint ein interdisziplinärer normativer Diskurs über die Frage, wie die diagnostizierten Spannungen aufzulösen wären. Als Anregung für einen solchen Diskurs werden wir im Ausblick alternative Lösungsstrategien vorstellen. (shrink)

Vitruvius’ technical text De architectura and Horace’s poetic letter 2.1 are both directed at Augustus. Within the corpus of Augustan literature they alone contain two anecdotes in which Alexander the Great clearly functions as a role model for the princeps. It is striking that in both cases the ruler’s relationship to the arts - architecture and poetry respectively - is addressed. In the following article I shall give a close reading of both passages and place them in their literary and (...) historical context. Although both texts belong to very different genres, remarkable similarities can be observed. Alexander turns out to be an ambivalent figure, to whom Augustus and his artistic advisors cannot but refer back. (shrink)

A German writer's aphoristic, poetic, and difficult reflections on Heidegger's Being and Time. There is a beyond of reason and unreason. It is the human psyche. —Positive Nihilism Like many German intellectuals, Hartmut Lange has long grappled with Heidegger. Positive Nihilism is the result of a lifetime of reading Being and Time and offers a series of reflections that are aphoristic, poetic, and (appropriately, considering his object of study) difficult. Lange begins with an abyss (“There is an abyss of (...) the finite. It is temporality”) and proceeds almost immediately to extremity: “The twentieth century was governed by psychopaths. They collapsed the boundaries of moral reason and refuted Kant's analysis of consciousness.” He reflects further: “But who shall punish whom? One man's virtue is another man's crime. Thus Hitler could feel unwaveringly, as he wiped out entire populations, the starry sky above him and the moral law within him, as stipulated by Kant.” He considers the concept of civilization (“misleading”; “how should one oppose the remedies of civilization to the egomania, the murderous appetites of such outright psychopaths as Stalin or Pol Pot?”), the act of thinking (a fata morgana), the psyche, and Heidegger's Dasein. Positive Nihilism can be considered a pocket companion to Being and Time. “Heidegger's understanding of Being is nihilistic,” Lange writes, and then explains his assertion. He draws on Kant, Nietzsche, Kierkegaard, and Shakespeare's Othello for supporting arguments and illustrations. “Everyone is possessed of the courage to have angst about death. The question is whether this courage necessarily secures those vital advantages Heidegger alleges”–that “self-understanding [is] the mental anticipation of death.” Lange wrestles with Heidegger's position, calling on Tolstoy, Georg Trakl, Herman Bang, and Heinrich von Kleist to argue against it. In Buchanan’s broad “constitutional contractarian” framework ultimate justification depends on the institutional arrangements under assessment being universally accepted. Accordingly, market arrangements have the same status as in-period collective decision-making rules: both equally hang or fall on whether they emerged from constitutional consensus. The paper underlines this ‘equivalence’ by showing that the constitutional calculus over market ‘rights’ follows the same analytic structure as the derivation of in-period collective decision rules. This means that Buchanan’s view of the virtues of markets is essentially (...) rooted in a collective decision and despite his self-professed “classical liberal” inclinations, his relation to standard defences of the market order is at best equivocal. This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. (...) Constitutional orders are facing both inwards and outwards - and the outside world influences their interiors just as much as their internal orders help shape their surroundings. Zusammenfassung Ist im Akt der Vergebung zugleich ein Element des Vergessens enthalten? In welchem Verhältnis stehen Vergebung und Vergessen? Und vergisst selbst Gott, wenn er vergibt? Den konstruktiven Konnotationen des Vergessens nachzugehen, scheint mit der Pflicht des Erinnerns zu kollidieren. Daher wird in einem ersten Teil im Gespräch mit Nietzsche herausgearbeitet, in welcher Hinsicht Menschen auf das Vergessen angewiesen sind. In einem zweiten Teil wird die komplizierte und verzweigte Grammatik des Vergessens expliziert. Auf dieser Basis kann in einem dritten theologischen (...) Teil die riskante Frage beantwortet werden, in welcher Hinsicht Gott vergisst, wenn er vergibt. Dazu wird die These ausgearbeitet, wonach einerseits die Vergebung der einzige Grund des Vergessens sein darf, um einer blinden Ignoranz vorzubeugen, und wonach andererseits das Vergessen eine mögliche Folge der Vergebung sein kann, damit ein Miteinander nicht bleibend vergiftet sei, sondern als tatsächlich befreit erlebt werden kann. The paper starts by identifying dynamic stabilization as a defining feature of modern societies. This term refers to the fact that such a society requires growth, augmentation and high rates of innovation in order to reproduce its structure and to preserve the socioeconomic and political status quo. The subsequent sections explore the mechanisms and consequences of this mode of social reproduction, proceeding in three steps. First, three key aspects or ‘motors’ of dynamization are identified, namely the mechanisms of appropriation, acceleration (...) and activation. In the second step, we argue that this ‘Triple-A-Mode’ of dynamic stabilization necessarily entails a logic of incessant escalation which eventually threatens to undermine itself, leading to a multifaceted process of destabilization. Unmistakable signs of this can be seen in the current financial, democratic, ecological and psychosocial crises. The third and last part briefly and very preliminarily sketches out the possible contours of a ‘post-growth’ society which could move beyond the current mode of dynamic stabilization. (shrink)

O cuidado espiritual é um componente essencial para a qualidade dos serviços em cuidados paliativos (CP). Este artigo apresenta a revisão da literatura empírica sobre cuidadores(as) espirituais que atuam nos Cuidados Paliativos. O método utilizado foi a revisão integrativa, com levantamento nas bases Periódicos CAPES, PsycARTICLES e PubMed. Após exame das 643 publicações encontradas, 54 estudos foram selecionados para análise, categorizados em quatro grandes temas: “identidade dos(as) cuidadores(as) espirituais”, “capacitação dos(as) cuidadores(as) espirituais”, “atuação dos(as) cuidadores(as) espirituais” e “impactos da atuação (...) dos(as) cuidadores(as) espirituais”. O suporte espiritual é fator vital para o bem-estar e a qualidade de vida no fim da vida, sendo que o cuidado paliativo transdisciplinar é fundamental para prover atendimento às necessidades espirituais e psicossociais, o que será facilitado pela adoção de métodos padronizados. Currículos de treinamento e ferramentas de avaliação específicos permitem a avaliação sistemática nos resultados dos pacientes, familiares e clínicos. Considerando a importância da religiosidade no contexto cultural brasileiro, o aprofundamento do tema do cuidado espiritual é de grande relevância para profissionais que trabalham em CP. A Bioética e a Teologia são chamadas a contribuir com estudos nessa área a fim de que o cuidado espiritual possa ser efetivamente integrado nas equipes de CP. (shrink)
