While COVID-19 has generated a massive burden of illness worldwide, healthcare workers (HCWs) have been disproportionately exposed to SARS-CoV-2 coronavirus infection. During the so-called ‘first wave’, infection rates among this population group have ranged between 10% and 20%, raising as high as one in every four COVID-19 patients in Spain at the peak of the crisis. Now that many countries are already dealing with new waves of COVID-19 cases, a potential competition between HCW and non-HCW patients for scarce resources can (...) still be a likely clinical scenario. In this paper, we address the question of whether HCW who become ill with COVID-19 should be prioritised in diagnostic, treatment or resource allocation protocols. We will evaluate some of the proposed arguments both in favour and against the prioritisation of HCW and also consider which clinical circumstances might warrant prioritising HCW and why could it be ethically appropriate to do so. We conclude that prioritising HCW’s access to protective equipment, diagnostic tests or even prophylactic or therapeutic drug regimes and vaccines might be ethically defensible. However, prioritising HCWs to receive intensive care unit (ICU) beds or ventilators is a much more nuanced decision, in which arguments such as instrumental value or reciprocity might not be enough, and economic and systemic values will need to be considered. Although shared decision-making is a standard in medical care, unilateral decisions through process-based conflict resolution policies have been defended in certain cases. In patients who do not stand to receive proportional clinical benefits, the harms involved in interventions such as cardiopulmonary resuscitation seem to run contrary to the principle of non-maleficence, and provision of such interventions may cause clinicians significant moral distress. However, because the application of these policies involves taking choices out of the domain of shared decision-making, they face (...) important ethical and legal problems, including a recent challenge to their constitutionality. In light of these concerns, we suggest a re-conceptualization of informed non-dissent as an alternative approach in cases where the application of process-based policies is being considered. This clinician-directed communication model still preserves what is valuable in such policies and salvages professional integrity, while minimising ethical and legal challenges. (shrink)

It is argued in this article that Foucault’s most distinctive contribution to philosophical practice is to be found in his distinctive mode of taking up historiography, exploring critically the conditions and limits of knowledge through archival work. The focus on knowledge would seem to place him in the critical lineage of Kant; however, his appeal to history and archival explorations reconfigure the relation between sensibility and the understanding in a way that suggests a different concern with the conditions of “a (...) possible knowledge.” After discussing how Foucault’s archival work engages a distinct sensibility, I suggest that his concern with knowledge can best be understood not within a transcendental project, however historicized, but within the logical space of Hegel’s Doctrine of the Concept, specifically the discussion of the Idea of cognition where it is a question of the twin processes of unifying subjectivity and objectivity as expressive of cognition’s “urge to truth.” Understood within this conceptual context, Foucault’s distinctive archival approach to what he calls “subjectivation” and “objectivation” allows us to appreciate the distinction between knowledge and truth in a way that leaves open the possibility of transformation. This article proposes and empirically tests a theoretical framework incorporating Reidenbach and Robin’s (J Bus Ethics 10(4):273–284, 1991 ) conceptual model of corporate moral development. The framework is used to examine the relation between governance and business ethics, as proxied by diversity management (DM), and financial reporting quality, as proxied by the magnitude of earnings management (EM). The level of DM and governance quality are measured in accordance with the ratings of Jantzi Research (JR), a leading provider of social and (...) governance research for institutional investors. This DM score is part of an index developed by JR that investment managers use to integrate DM criteria into their investment decisions. As expected, a negative relation between corporate DM development and financial reporting quality is found while controlling for other factors known in the literatures on governance and accounting choices to affect earnings quality. Despite some caveats presented in conclusion, this study contributes to the ethics, governance, and financial reporting literatures by studying the dynamics between governance and ethics in the prevention of EM. This study investigates the engagement of family firms in corporate social responsibility. We first compare their corporate social performance to non-family firms. Then, following recent evidence on the heterogeneity of family firms, we examine two factors that may influence CSP within family firms: the level of family control and the governance orientation of the country in which they operate. This research is based on a theoretical framework which considers both agency and socioemotional wealth influences on family firms CSR engagements. Overall, (...) we find that family firms exhibit lower CSP than non-family firms. But when focusing on family firms, our analyses show a curvilinear relationship between family control and CSP. At lower levels of control, family owners invest more in social initiatives to protect their SEW. Beyond a threshold level of control that we estimate at 36 % in our sample, economic considerations prevail over SEW and social performance starts decreasing. We also find that family firms operating in stakeholder-oriented countries are more attentive to social concerns than those operating in more shareholder-oriented countries. (shrink)

El objetivo de este trabajo es sostener el carácter epocal de la tecnología, lo cual requirió la convergencia de transformaciones intelectuales como sociales. Las observaciones de Hans Blumenberg en torno a una historia espiritual de la tecnología, que desplaza las perspectivas antropológicas y cientificistas de esta, constituyen una piedra de toque fundamental para esta comprensión. La tecnología en tanto fenómeno histórico es un tema y signatura de una época particular la Modernidad. Así, Blumenberg sitúa la emergencia de la tecnología en (...) sus análisis del tránsito de la Edad Media a la Modernidad, subrayando como la preocupación por la teología de la creación de la escolástica tardía se pone en cuestión y se abre una nueva vía: la autoafirmación del ser humano. Es en este cambio de época que la tecnología adquiere un nuevo estatus, impensado anteriormente, como una vía de autoafirmación del ser humano. La historia espiritual de la tecnología desplaza la historia de los inventores y las invenciones, así como niega la posición de que la tecnología sea una mera aplicación de la ciencia. En contrario, la impronta “espiritual” remite a la investigación de los presupuestos históricos que hacen posible su emergencia, así como las recepciones/innovaciones que la tecnología ha producido. La teoría tridimensional va más allá de la mera constatación de que la experiencia jurídica implica cierta correlación entre hechos, normas y valores, pues pretende deducir conclusiones de mayor alcance. La indagación acerca de la naturaleza de cada uno de esos elementos y la comprensión dialéctica de su relación son claves. Los valores son el elemento más complejo de la triada. Se diferencia de otros entes ideales porque son realizables, inagotables, trascendentales y polares, pues se comprenden en relación a sus (...) contrarios y definidos como intencionalidades históricamente objetivadas en el proceso de la cultural que implican siempre el sentido vectorial de un acción posible. Los hechos son actos o hechos en sentido estricto, esto es, independientes de la iniciativa humana y que adquieren significado “inter homines”. Las normas se sitúan entre ambos, como tomas de postura ante los hechos en una función tensional de valores. El derecho es concebido como una integración dialéctica de los tres elementos, como la integración normativa de hechos según valores, y sus normas como la forma positiva y calificación axiológica del hecho en una coyuntura dada. De otro lado, se analizan las relaciones entre el derecho y el mundo de vida en que está inmerso, como una realidad complementaria de la realidad del derecho y entre las que existen interrelaciones continuas. También son objeto de análisis desde ese triple punto de vista el Derecho Natural, como un conjunto normativo de exigencias trascendentales, el derecho positivo en el plano experiencial y los principios y categorías que gobiernan los procesos de interpretación de las normas. The COVID-19 pandemic has generated an imbalance between the clinical needs of the population and the effective availability of advanced life support (ALS) resources. Triage protocols have thus become necessary. Triage decisions in situations of scarce resources were not extraordinary in the pre-COVID-19 era; these protocols abounded in the context of organ transplantation. However, this prior experience was not considered during the COVID-19 outbreak in Spain. Lacking national guidance or public coordination, each hospital has been forced to put forth independent (...) and autonomous triage protocols, most of which were, nonetheless, based on common ethical principles and clinical criteria. However, controversial, non-clinical criteria have also been defended by Spanish scientific societies and public institutions, including setting an age cut-off value for unilaterally withholding ALS, using ‘social utility’ criteria, prioritising healthcare professionals or using ‘first come, first served’ policies. This paper describes the most common triage criteria used in the Spanish context during the COVID-19 epidemic. We will highlight our missed opportunities by comparing these criteria to those used in organ transplantation protocols. The problems posed by subjective, non-clinical criteria will also be discussed. We hope that this critical review might be of use to countries at earlier stages of the epidemic while we learn from our mistakes. (shrink)
