Recent discussion of Scanlon's account of value, which analyses the value of X in terms of agents' reasons for having certain pro-attitudes or contra-attitudes towards X, has generated the problem (WKR problem): this is the problem, for the buck-passing view, of being able to acknowledge that there may be good reasons for attributing final value to X that have nothing to do with the final value that X actually possesses. I briefly review some of the existing solutions offered to the (...) WKR problem, including those by Philip Stratton-Lake and Jonas Olson, and offer a new, better one, which accommodates all the relevant cases presented in the literature. (shrink)

This essay responds to David Enoch’s “The Disorder of Public Reason,” published in a previous issue of Ethics. I seek to set the record straight on several of the many charges Enoch makes. More importantly, having clarified some of the more basic points, I make some preliminary efforts at identifying when his brand of moral realism and my version of public reason differ—and, perhaps, where they are more compatible than one might think.

Abstract:When people reason on the basis of moral rules, do they suppose that in the absence of a prohibitory rule they are free to act, or do they suppose that morality always requires a justification establishing a permission to act? In this essay we present a series of learning experiments that indicate when learners tend to close their system on the basis of natural liberty and when on the principle of residual prohibition. Those who are taught prohibitory rules tend to (...) infer natural liberty while those taught permission rules tend to infer residual prohibition. In mixed cases, where learners are taught both types of rules, there is some tendency to suppose that natural liberty is the default. Both natural liberty and its denial can be learned; is there a reason to adopt one system of moral rules or the other? We argue that systems of social morality based on a principle of natural liberty have a striking advantage over their competitors: they are well adapted to effectively exploring the constant novel circumstances that arise in open, dynamic, societies. Republican liberty, as recently defended by Philip Pettit and Quentin Skinner, characterises liberty in terms of the absence of domination, instead of, or in addition to, the absence of interference, as favoured by Berlin-style negative liberty. This article considers several claims made on behalf of republican liberty, particularly in Pettit's and Skinner's recent writings, and finds them wanting. No relevant moral or political concern expressed by republicans, it will be contended here, fails to be accommodated by negative liberty.

At one point Rawls thought that “a normalization of interests attributed to the parties” is “common to social contract doctrines.” Normalization has a great appeal: once we specify the normalized perspective, we can generate strong and definite principles of justice. Public reasoning is restricted to those who reason from the eligible, normalized, perspective; those who fall outside the “normal” are to be dismissed as unreasonable, unjust, or illiberal. As Rawls’s political liberalism project developed he increasingly relaxed his normalization assumptions, allowing (...) room for not only different conceptions of the good, but of justice. This paper explores the post-Rawlsian movement in public reason to maximally relax, or even abandon, normalizing assumptions, drawing on a maximal diversity of normative perspectives in public justification. The public reason project is at a critical juncture. Are we to look back, defending Rawls’s substantive conclusions by devising new defenses of normalization, circling the wagons around the cherished two principles? Or are we to seek to fulfill the promise of public reason as providing a common public and moral world in the midst of diversity? (shrink)

Michael Moehler’s Minimal Morality is a wonderful and important book, from which I have learned a great deal. It reinvigorates rational choice moral theory in the process of confronting what I see as the most important issue in social and moral philosophy today: can those in a deeply morally divided society endorse a common moral framework to structure social cooperation? Is a rational moral order possible under conditions of deep and wide moral diversity? Minimal Morality’s answers are thoughtful and innovative. (...) I am not, however, entirely persuaded that Minimal Morality can fulfil its promise of grounding a cooperative order when ‘traditional’ modes moral justification cannot. (shrink)

The ethical choices faced by engineers today are increasingly complex. Competing and conflicting ethical demands from clients, communities, employees, and personal objectives combine to suggest that engineers employ ethical approaches that are adaptive yet grounded in three concrete professional circumstances: first, that engineers apply unique professional skills in the service of a client, subject to protecting the public interest; second, that engineers advance the state of knowledge of their professional field through reflection, research, and sharing experience in journals and conferences, (...) and third, that they develop new professionals by active mentoring. This paper examines five features of American pragmatism and suggests that its emphasis on specific, context-based ethical decision making can assist engineers in a postmodern setting. In particular, it considers the venues of interpersonal ethical choices, institutional ethical conflicts, and social choices that have ethical components. Pragmatism suggests that in such a complex ethical climate, there is a need for the co-evolution of judgment and action, for individual reflective judgment in particular situations, and for ceasing to search for a single, immutable principle for ethical choice. In a series of influential papers, John McDowell has argued that the rule‐following considerations explored in Wittgenstein’s later work provide support for a particularist form of moral objectivity. The article distinguishes three such arguments in McDowell’s writings, labelled the Anthropocentricism Argument, the Shapelessness Argument, and the Anti‐Humean Argument, respectively, and the author disputes the effectiveness of each of them. As far as these metaethical debates are concerned, the article concludes that the rule‐following considerations leave everything in their place.

Theologies of human nature routinely reflect the insights of evolutionary biology, for which human biological nature is variable, changing and indeterminate in its boundaries with other living things. However, these theologies do not yet reflect what biotechnology discloses about human biological nature, namely, that it is malleable and indeterminate in its boundaries with machines. Does respect for human biological nature as created by God, or protection of the human person whose nature it is, require us to refrain from taking advantage (...) of its malleability and indeterminacy to select or design functions and traits? Or should we welcome malleability and indeterminacy as conditions for us to fulfill a vocation to determine our nature or bring it to perfection? And do malleability and indeterminacy render obsolete the notion that we look to our nature to determine what our good is? This article answers these questions. (shrink)

In the rise of modern scientific philosophy, one can distinguish four general periods. Its early phase is part of the intellectual history of 19th-century Austria-Hungary. Second, we find it reaching its self-confident form in the 1920s and early ‘30s, chiefly in the collaborative achievements of the Vienna Circle and its analogous groups in Prague, Berlin, Lwow and Warsaw. Third is the period of its further growth and accommodation during the period roughly from the late 1930s to about 1960, especially in (...) the U.S.A., as mediated largely by the European refugees from fascism. In Part V of his Discourse on the Method, Descartes introduces a test for distinguishing people from machines that is similar to the one proposed much later by Alan Turing. The Cartesian test combines two distinct elements that Keith Gunderson has labeled the language test and the action test. Though traditional interpretation holds that the action test attempts to determine whether an agent is acting upon principles, I argue that the action test is best understood as a test of common (...) sense. I also maintain that this interpretation yields a stronger test than Turing's, and that contemporary artificial intelligence should consider using it as a guide for future research. (shrink)

In this article, I appeal to the phenomenon of moral hazard in order to explain how at least some of the inequalities permitted by Luck Egalitarianism can be given an alternative, more plausible grounding than that which is supplied by Luck Egalitarianism. This alternative grounding robs Luck Egalitarianism of a potentially significant source of intuitive support whilst enabling conditional welfare policies to survive the attacks on them made by Elizabeth Anderson, Jonathan Wolff, and others.

The Matrix exposes us to the uncomfortable worries of philosophical skepticism in an especially compelling way. However, with a bit more reflection, we can see why we need not share the skeptic’s doubts about the existence of the world. Such doubts are appropriate only in the very special context of the philosophical seminar. When we return to normal life we see immediately that they are groundless. Furthermore, we see also the drastic mistake that Cypher commits in turning his back upon (...) reality and re-entering the matrix. Not only does reason compel us to admit the existence of the external world, it also requires us to face this world, to build for ourselves meaningful lives within it, and to engage, as adults, in the serious business of living. During its most vigorous period, the Vienna Circle movement was, by and large, kept rather marginal by the political and academic forces in its European home; they tended to see it as a dangerous search, in the Enlightenment tradition, for a world conception that would be free from metaphysical illusions, free from the kind of clericalism that had a strangle-hold on state and university, and free from the romantic madness of the rising fascist ideology. The wonder, in fact, is that (...) in its day, against such opposition, the Vienna Circle commanded adherence by such an array of distinguished intellectuals, even if they were only a small fraction of the total intelligentsia.
